आदेश

नई दिल्ली, 23 सितम्बर, 2020

आ. अ. 109.—यत:, भारत निर्वाचन आयोग द्वारा लोकसभा के साधारण निर्वाचन, 2019 की घोषणा प्रेस नोट सं. ईसीआई/प्रे.नो./23/2019 दिनांक 10 मार्च, 2019 द्वारा की गई थी । तय कार्यक्रम के अनुसार, मतगणना की तारीख 23 मई, 2019 थी ।

और यतः, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 78 के अनुसार, निर्वाचन लड़ने वाले प्रत्येक अभ्यर्थी को, निर्वाचित अभ्यर्थी के निर्वाचन की तारीख से 30 दिनों के भीतर निर्वाचन व्यय के अपने लेखे की सत्य प्रतिलिपि जिला निर्वाचन अधिकारी को दाखिल करनी होती है;

(299) और यतः, झारखण्ड राज्य के संबंधित रिटर्निंग अधिकारी द्वारा 01-राजमहल (अ.ज.जा.) संसदीय निर्वाचन क्षेत्र सहित उक्त निर्वाचन के परिणाम 23 मई, 2019 को घोषित किए गए थे । इस प्रकार निर्वाचन व्ययों का लेखा दाखिल करने की अंतिम तारीख 22 जून, 2019 थी;

और यतः, जिला निर्वाचन अधिकारी, साहेबगंज जिला, झारखण्ड द्वारा प्रस्तुत और मुख्य निर्वाचन अधिकारी, झारखण्ड, द्वारा दिनांक 5 जुलाई, 2019 के पत्र सं. 01/निर्वा.-ईईएम-को.-23/2019/5197 द्वारा अग्रेषित दिनांक 26 जून, 2019 की रिपोर्ट के अनुसार, श्री मंगल मरांडी, जो झारखण्ड के 01-राजमहल (अ.ज.जा.) संसदीय निर्वाचन क्षेत्र से निर्वाचन लड़ने वाले निर्दलीय अभ्यर्थी हैं, विधि द्वारा यथापेक्षित अपने निर्वाचन व्यय का कोई लेखा दाखिल करने में असफल रहे हैं;

और यतः, जिला निर्वाचन अधिकारी, साहेबगंज जिला, झारखण्ड और मुख्य निर्वाचन अधिकारी, झारखण्ड, की रिपोर्टों के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप नियम (5) के तहत निर्वाचन व्यय का लेखा दाखिल करने में असफल रहने पर, श्री मंगल मरांडी को दिनांक 23 अगस्त, 2019 को कारण बताओ नोटिस जारी किया गया था;

और यतः, निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप नियम (6) के अनुसार, दिनांक 23 अगस्त, 2019 के उपयु र्क्त कारण बताओ नोटिस के जरिए, श्री मंगल मरांडी को निदेश दिया गया था कि वे इस नोटिस के प्राप्त होने के 20 दिनों के भीतर लेखे न प्रस्तुत कर पाने का कारण स्पष्ट करते हुए आयोग को लिखित में अपना अभ्यावेदन प्रस्तुत करें और निर्वाचन व्यय का अपना लेखा दाखिल करें/अपने लेखे में त्रुटियों को सही करें और उसे संबंधित जिला निर्वाचन अधिकारी को प्रस्तुत करें;

और यतः, उक्त नोटिस श्री मंगल मरांडी को दिनांक 5 सितंबर, 2019 को सौंप दिया गया था । पावती रसीद, जिला निर्वाचन अधिकारी, साहेबगंज द्वारा दिनांक 10 जून, 2020 के अपने पत्र सं.132/निर्वा. द्वारा आयोग को प्रस्तुत कर दी गई है ।

और यत:, जिला निर्वाचन अधिकारी, साहेबगंज द्वारा प्रस्तुत दिनांक 10 जून, 2020 के अपने पत्र सं.132/निर्वा द्वारा प्रस्तुत की गई अनुपूरक रिपोर्ट में यह उल्लेख है कि श्री मंगल मरांडी ने आज की तारीख तक कोई भी अभ्यावेदन अथवा अपने निर्वाचन व्यय का लेखा प्रस्तुत नहीं किया है । इसके अलावा, उन्होंने भारत निर्वाचन आयोग का सम्यक नोटिस मिलने के बाद भी उक्त असफलता का न तो कोई कारण बताया है और न ही कोई स्पष्टीकरण दिया है;

और यत:, भारत निर्वाचन आयोग का यह समाधान हो गया है कि श्री मंगल मरांडी निर्वाचन व्यय का लेखा दाखिल करने में असफल रहे हैं और विफलता के लिए उनके पास कोई समुचित कारण या न्यायोचित्य नहीं है;

और यत:, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में यह अनुबंधित किया गया है कि:-

"यदि निर्वाचन आयोग का यह समाधान हो जाता है कि कोई व्यक्ति-

(क) निर्वाचन व्ययों का लेखा उस समय के भीतर और उस रीति में जैसी इस अधिनियम के द्वारा या अधीन अपेक्षित है, दाखिल करने में असफल रहा है; तथा

(ख) उसके पास उस असफलता के लिए कोई समुचित कारण या न्यायोचित्य नहीं है,

तो निर्वाचन आयोग शासकीय राजपत्र में प्रकाशित आदेश द्वारा उसको निरर्हित घोषित करेगा और ऐसा कोई भी व्यक्ति उस आदेश की तारीख से तीन वर्ष की कालावधि के लिए निरर्हित होगा ।"

अब इसीलिए, लोक प्रतिनिधित्व अधिनियम,1951 की धारा 10क के अनुसरण में भारत निर्वाचन आयोग एतद्द्वारा झारखण्ड राज्य के 01-राजमहल (अ.ज.जा.) संसदीय निर्वाचन क्षेत्र से लोकसभा के साधारण निर्वाचन, 2019 में निर्वाचन लड़ने वाले निर्दलीय अभ्यर्थी, श्री मंगल मरांडी, निवासी गांव + डाक – बरमसिया, थाना – बरहैट, जिला – साहेबगंज,[भाग II—खण्ड 3(iii)] भारत का राजपत्र : अक्तूबर ³, ²⁰²⁰/आश्विन ¹¹, ¹⁹⁴² 301 झारखण्ड को संसद के किसी भी सदन या राज्य या संघ राज्य-क्षेत्र की विधानसभा अथवा विधान परिषद के लिए सदस्य चुने जाने या होने के लिए इस आदेश की तारीख से तीन वर्ष की अवधि के लिए निरर्हित घोषित करता है ।

ELECTION COMMISSION OF INDIA

ORDER

New Delhi, the, 23rd September, 2020

O. N. 109.—WHEREAS, the General Election to Lok Sabha, 2019 was announced by Election Commission of India vide Press Note No. ECI/PN/23/2019 dated 10th March, 2019. As per the schedule, Date of Counting was 23rd May, 2019.

AND WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate has to lodge a true copy of his/her account of election expenses within 30 days with the District Election Officer, from the date of election of returned candidate;

AND WHEREAS, the result of the said election was declared by the concerned Returning Officer including 01-Rajmahal (ST) Parliamentary Constituency of the State of Jharkhand on 23rd May, 2019. As such the last date for lodging of account of election expenses was 22nd June, 2019.

AND WHEREAS, as per the report dated 26th June, 2019 submitted by the District Election Officer, Sahibganj

District, Jharkhand and forwarded by Chief Electoral Officer, Jharkhand vide letter No. 01/र्नविा०-EEM-को०- 23/2019/5197 dated 5th July, 2019, Shri Mangal Marandi, an Independent contesting candidate from 01-Rajmahal (ST) Parliamentary Constituency of Jharkhand, has failed to lodge any account of his election expenses as required by law.

AND WHEREAS, on the basis of the reports of the District Election Officer, Sahibganj District, Jharkhand and the Chief Electoral Officer, Jharkhand, a Show Cause notice dated 23rd August, 2019 was issued by Election Commission of India under Sub Rule (5) of Rule 89 of the Conduct of Election Rules, 1961 to Shri Mangal Marandi for non-submission of Election expenses;

AND WHEREAS, as per Sub Rule (6) of Rule 89 of the Conduct of Election Rules, 1961, through the above said Show Cause Notice dated 23rd August, 2019, Shri Mangal Marandi was directed to submit his representation in writing in the Commission explaining the reason for non-submission of accounts and also to lodge his accounts of election expenses/rectify the defects in his accounts and submit the same to the District Election Officer concerned within 20 days from the date of receipt of the notice;

AND WHEREAS, the said notice was delivered to Shri Mangal Marandi on 5th September, 2019.

Acknowledgment receipt has been submitted to the Commission by District Election Officer, Sahibganj vide his letter No. 132/निर्वा dated 10th June, 2020.

AND WHEREAS, in the supplementary report submitted by District Election Officer, Sahibganj vide his letter

No. 132/र्नविा dated 10th June, 2020, it has been stated that Shri Mangal Marandi, has not submitted any representation or his account of election expenses, till date. Further, he has furnished neither any reason nor explanation for the said failure even after receipt of the due notice to the Election Commission of India as well;

AND WHEREAS, the Commission is satisfied that Shri Mangal Marandi has failed to lodge an account of election expenses and has no good reason or justification for the failure;

AND WHEREAS, Section 10A of the Representation of the People Act, 1951 stipulates that :-

"If the Election Commission is satisfied that a person:

आ. अ. 110.— यत:, भारत निर्वाचन आयोग का यह समाधान हो गया है कि स्तंभ 2 में विनिर्दिष्ट कर्नाटक राज्य से लोक सभा साधारण निर्वाचन, 2019 में नीचे की सारणी में अपने नाम के सामने स्तंभ 3 में विनिर्दिष्ट संसदीय निर्वाचन क्षेत्र से, स्तंभ 4 में विनिर्दिष्ट निर्वाचन लड़ने वाला प्रत्येक अभ्यर्थी, लोक प्रतिनिधित्व अधिनियम, 1951 तथा तद्धीन बनाए गए नियमों के अंतर्गत यथाअपेक्षित उक्त सारणी के स्तंभ 5 में यथादर्शित अपने निर्वाचन व्यय का लेखा दाखिल करने में असफल रहा/रही है।

और यत:, उक्त अभ्यर्थियों ने निर्वाचन आयोग द्वारा सम्यक नोटिस दिए जाने के बावजूद उक्त असफलता के लिए न तो कोई कारण, न ही कोई स्पष्टीकरण दिया है या उनके द्वारा दिए गए अभ्यावेदन, यदि कोई हो, पर विचार करने के उपरांत निर्वाचन आयोग का यह समाधान हो गया है कि उक्त असफलता के लिए उनके पास कोई उपयुक्त या न्यायोचित कारण नहीं है;

अत:, अब, उक्त अधिनियम की धारा 10क के अनुसरण में, भारत निर्वाचन आयोग नीचे की सारणी के स्तंभ 4 में विनिर्दिष्ट व्यक्तियों को संसद के किसी सदन या किसी राज्य या संघ राज्य-क्षेत्र की विधान सभा अथवा विधान परिषद या लोक सभा के लिए सदस्य चुने जाने और होने के लिए, इस आदेश की तारीख से तीन वर्ष की अवधि के लिए निरर्हित घोषित करता है:

N. 110.—Whereas, the Election Commission of India is satisfied that each of the contesting candidate specified in column 4 of the Table below at the General Election to the Lok Sabha, 2019, from the State of Karnataka, specified in column 2 and held from the Parliamentary Constituency specified in column 3 against his/her name has failed to lodge the account of his/her election expenses as shown in column 5 of the said Table as required by the Representation of the People Act, 1951 and the Rules made thereunder;

And whereas, the said candidates have furnished neither any reason nor explanation for the said failure even after due notice by the Election Commission or after considering the representation made by them, if any, the Election Commission is satisfied that they have no good reason or justification for the said failure;

Now, therefore, in pursuance of Section 10A of the said Act, the Election Commission of India hereby declares the persons specified in column 4 of the Table below to be disqualified for being chosen as and for being a member of either House of Parliament or the Legislative Assembly or Legislative Council of a State or of Union Territory for a period of three years from the date of this order: -
