आ. अ. 115.— यतः, आयोग ने महाराष्ट्र के 16-नांदेड़ संसदीय निर्वाचन क्षेत्र के लिए अपनी अधिसूचना सं.-464/EPS/2019 (2) दिनांक 19.03.2019 के द्वारा लोकसभा के साधारण निर्वाचन, 2019 आयोजित करने की घोषणा की थी और सोनसाले सुनील मनोहरराव पूर्वोक्त निर्वाचन में निर्वाचन लड़े/लड़ीं थे;

और यतः, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 77 (1) के अनुसार, निर्वाचन लड़ने वाला प्रत्येक अभ्यर्थी या तो स्वयं या अपने निर्वाचन एजेंट द्वारा, (वह तिथि जब उसे नाम-निर्देशित किया गया है) और (उसके परिणाम की घोषणा की तिथि), दोनों तारीखें सम्मिलित, के बीच उसके द्वारा या उसके निर्वाचन एजेंट द्वारा उपगत या अधिकृ त निर्वाचन संबंधी सभी खर्चों का एक पृथक और सही लेखा रखेगा और लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 78 के अनुसार, निर्वाचन लड़ने वाले प्रत्येक अभ्यर्थी निर्वाचित अभ्यर्थी के निर्वाचन की तारीख से 30 दिनों के भीतर निर्वाचन व्यय का लेखा जिला निर्वाचन अधिकारी को दर्ज करेगा जो धारा 77 के अंतर्गत उसके द्वारा अथवा उसके निर्वाचन एजेंट द्वारा रखे गए लेखे की सत्य प्रतिलिपि होगी;

ELR-2019/CR 804/19/33 के जरिए प्राप्त, जिला निर्वाचन अधिकारी एवं कलेक्टर, नांदेड़ जिला, महाराष्ट्र द्वारा प्रस्तुत रिपोर्ट के अनुसार, महाराष्ट्र के 16-नांदेड़ संसदीय निर्वाचन क्षेत्र से निर्वाचन लड़ने वाले अभ्यर्थी, सोनसाले सुनील मनोहरराव, विधि द्वारा यथापेक्षित रीति से अपने निर्वाचन व्यय का कोई भी लेखा दाखिल करने में असफल रहे/रहीं हैं;

और यतः, जिला निर्वाचन अधिकारी, नांदेड़ जिला, महाराष्ट्र, की रिपोर्टों के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप नियम (5) के तहत निर्वाचन व्यय का लेखा दाखिल करने में असफल रहने पर, सोनसाले सुनील मनोहरराव को दिनांक 13.01.2020 को कारण बताओ नोटिस जारी किया गया था;

और यतः, निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप नियम (6) के अनुसार, दिनांक 13.01.2020 के उपयु र्क्त कारण बताओ नोटिस के माध्यम से, सोनसाले सुनील मनोहरराव को निदेश दिया गया था कि वे इस नोटिस के प्राप्त होने के 20 दिनों के भीतर लेखे न प्रस्तुत कर पाने का कारण स्पष्ट करते हुए आयोग को लिखित में अपना अभ्यावेदन प्रस्तुत करें और निर्वाचन व्यय का अपना लेखा भी दाखिल करें/अपने लेखे में त्रुटियों को सही करें और उसे संबंधित जिला निर्वाचन अधिकारी को प्रस्तुत करें;

और यतः, सोनसाले सुनील मनोहरराव की पत्नी द्वारा उक्त नोटिस दिनांक 20.01.2020 को प्राप्त किया गया था।

अभ्यर्थी की पत्नी से प्राप्त पावती रसीद, जिला निर्वाचन अधिकारी एवं कलेक्टर, नांदेड़ जिला द्वारा दिनांक 21.01.2020 के अपने पत्र सं. 2019/Sasha-3/Election/CR द्वारा आयोग को प्रस्तुत कर दी गई है;

और यत:, जिला निर्वाचन अधिकारी, नांदेड़ द्वारा दिनांक 03.09.2020 के अपने पत्र सं. 2020/GB- 3/Election/EL.Exp/CR के द्वारा प्रस्तुत की गई अनुपूरक रिपोर्ट में यह कहा है कि सोनसाले सुनील मनोहरराव, ने निर्वाचन का लेखा प्रस्तुत नहीं किया;

और यत:, आयोग का यह समाधान हो गया है कि सोनसाले सुनील मनोहरराव निर्वाचन व्यय का लेखा दाखिल करने में असफल रहे हैं और असफलता के लिए उनके पास कोई समुचित कारण या न्यायोचित्य नहीं है;

और यत:, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में यह अनुबंधित किया गया है कि:-

"यदि निर्वाचन आयोग का यह समाधान हो जाता है कि कोई व्यक्ति-

(क) निर्वाचन व्ययों का लेखा उस समय के भीतर और उस रीति में जैसी इस अधिनियम के द्वारा या अधीन अपेक्षित है, दाखिल करने में असफल रहा है; तथा

(ख) उसके पास उस असफलता के लिए कोई समुचित कारण या न्यायोचित्य नहीं है,

तो निर्वाचन आयोग शासकीय राजपत्र में प्रकाशित आदेश द्वारा उसको निरहित घोषित करेगा और ऐसा कोई भी व्यक्ति उस आदेश की तारीख से तीन वर्ष की कालावधि के लिए निरहित होगा."

अब इसीलिए, लोक प्रतिनिधित्व अधिनियम,1951 की धारा 10क के अनुसरण में भारत निर्वाचन आयोग एतद्द्वारा महाराष्ट्र राज्य के 16- नांदेड़ संसदीय निर्वाचन क्षेत्र से लोकसभा के साधारण निर्वाचन, 2019 में निर्वाचन लड़ने वाले अभ्यर्थी, सोनसाले सुनील मनोहरराव, निवासी- सखोजीनगर महाराणा प्रताप चौक, नांदेड़. तां.जिला. नांदेड़, पिनकोड़- 431905, को संसद के किसी भी सदन या राज्य या संघ राज्य-क्षेत्र की विधानसभा अथवा विधान परिषद के लिए सदस्य चुने जाने या होने के लिए इस आदेश की तारीख से तीन वर्ष की अवधि के लिए निरहित घोषित करता है।

ELECTION COMMISSION OF INDIA

ORDER

New Delhi, the 7th December, 2020

O.N. 115.— WHEREAS, the Commission had declared to hold the General Election to Lok Sabha, 2019 vide its Notification No.464/EPS/2019 (2) dated 19.03.2019 for 16- Nanded Parliamentary Constituency of Maharashtra State and Sonsale Sunil Manoharrao had contested the aforesaid election;

AND WHEREAS, as per Section 77 (1) of the Representation of the People Act, 1951, every candidate at election shall, either by himself/herself or by his/her election agent, keep a separate and correct account of all expenditure in connection with the election incurred or authorized by him/her or by his/her election agent between (the date on which he has been nominated) and the date of declaration of the result thereof, both dates inclusive & as per Section 78 of the Representation of the People Act, 1951, every contesting candidate at an election shall, within thirty days from the date of election of the returned candidate lodge account of his/her election expenses with the District Election Officer (DEO) which shall be in a true copy of the account kept by him/her or by his/her election agent under Section 77;

AND WHEREAS, as per the report under rule 89(2) of the Conduct of Elections Rules, 1961, submitted by the District Election Officer and Collector, Nanded District, Maharashtra, through the Chief Electoral Officer's letter No. ELR-2019/CR 804/19/33 dated 15.09.2019 Sonsale Sunil Manoharrao contesting candidate from 16- Nanded Parliamentary Constituency of Maharashtra, has failed to lodge any account of his/her election expenses as required by law;

AND WHEREAS, on the basis of the reports of the District Election Officer, Nanded District, Maharashtra, a Show Cause notice dated 13.01.2020 was issued by the Election Commission of India under Sub Rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 to Sonsale Sunil Manoharrao for non submission of account of Election expenses;

AND WHEREAS, as per Sub Rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, through the above said Show Cause Notice dated 13.01.2020, Sonsale Sunil Manoharrao was directed to submit his/her representation in writing in the Commission explaining the reason for non submission of accounts and also to lodge his/her accounts of election expenses/rectify the defects in his/her accounts and submit the same to the District Election Officer concerned within 20 days from the date of receipt of the notice;

AND WHEREAS, the said notice was received by the wife of Sonsale Sunil Manoharrao on 20.01.2020. Acknowledgement receipt obtained from the wife of candidate has been submitted to the Commission by District Election officer and Collector, Nanded District vide his letter No. 2019/Sasha-3/Election/CR dated 21.01.2020;

AND WHEREAS, in the supplementary report submitted by DEO, Nanded vide his letter No. 2020/GB- 3/Election/El.Exp/CR dated 03.09.2020, it has been stated that Sonsale Sunil Manoharrao has not submitted the election expenses;

AND WHEREAS, the Commission satisfied that Sonsale Sunil Manoharrao has failed to lodge an account of election expenses and has no good reason or justification for the failure;

AND WHEREAS, Section 10 A of the Representation of the People Act, 1951 stipulates that:-

"If the Election Commission is satisfied that a person-

(a) has failed to lodge an account of election expenses within the time and in the manner required by or under this Act; and

(b) has no good reason or justification for the failure,

the Election Commission shall, by order published in the official Gazette, declare him to be disqualified and any such person shall be disqualified for a period of three years from the date of the order."

NOW THEREFORE, in pursuance of Section 10 A of the Representation of the People Act, 1951, the Election Commission of India hereby declares Sonsale Sunil Manoharrao, resident of Sakhojinagar, Maharana Pratap Chowk, Nanded, Ta. Dist. Nanded, Pincode- 431 905 the contesting candidate for the General Election to the Lok Sabha Election, 2019 from 16- Nanded Parliamentary Constituency of the State of Maharashtra to be disqualified for being chosen as and for being a member of either House of Parliament or the Legislative Assembly or Legislative Council of a State or Union Territory for a period of three years from the date of this order.

आ. अ. 116.—यतः, आयोग ने संघ प्रदेश दादर एवं नागर हवेली के यू- 03- दादर एवं नागर हवेली संसदीय निर्वाचन क्षेत्र के लिए अपनी अधिसूचना सं.-464/EPS/2019 (3) दिनांक 28.03.2019 के द्वारा लोकसभा के साधारण निर्वाचन, 2019 आयोजित करने की घोषणा की थी और ड़ोंगरकर ईशवरभाई गोप्जीभाई पूर्वोक्त निर्वाचन में निर्वाचन लड़े/लड़ीं थे;

और यतः, निर्वाचनों का संचालन नियम, 1961, के नियम 89 (2) के अधीन, मुख्य निर्वाचन अधिकारी के दिनांक 08.07.2019 के पत्र सं. ADM/Election/2019/37 के जरिए प्राप्त, जिला निर्वाचन अधिकारी एवं कलेक्टर, दादर एवं नागर हवेली, द्वारा प्रस्तुत रिपोर्ट के अनुसार, संघ प्रदेश दादर एवं नागर हवेली के यू- 03- दादर एवं नागर हवेली संसदीय निर्वाचन क्षेत्र से निर्वाचन लड़ने वाले अभ्यर्थी, ड़ोंगरकर ईशवरभाई गोप्जीभाई, विधि द्वारा यथापेक्षित रीति से अपने निर्वाचन व्यय का कोई भी लेखा दाखिल करने में असफल रहे/रहीं हैं;

और यतः, जिला निर्वाचन अधिकारी, दादर एवं नागर हवेली, की रिपोर्टों के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप नियम (5) के तहत निर्वाचन व्यय का लेखा दाखिल करने में असफल रहने पर, ड़ोंगरकर ईशवरभाई गोप्जीभाई को दिनांक 10.01.2020 को कारण बताओ नोटिस जारी किया गया था;

अभ्यर्थी से प्राप्त पावती रसीद, सहायक (इलेक्शन), दादर एवं नागर हवेली द्वारा दिनांक 24.01.2020 के अपने पत्र सं.

ADM/Election/571/04/Part-II द्वारा आयोग को प्रस्तुत कर दी गई है;

और यत:, सहायक (इलेक्शन), दादर एवं नागर हवेली द्वारा दिनांक 11.02.2020 एवं 01.12.2020 के अपने पत्र सं. ADM/Election/571/04/Part-II के द्वारा प्रस्तुत की गई अनुपूरक रिपोर्ट में यह कहा है कि ड़ोंगरकर ईशवरभाई गोप्जीभाई, ने निर्वाचन का लेखा प्रस्तुत नहीं किया;

और यत:, आयोग का यह समाधान हो गया है कि ड़ोंगरकर ईशवरभाई गोप्जीभाई निर्वाचन व्यय का लेखा दाखिल करने में असफल रहे हैं और असफलता के लिए उनके पास कोई समुचित कारण या न्यायोचित्य नहीं है;

और यत:, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में यह अनुबंधित किया गया है कि:-

"यदि निर्वाचन आयोग का यह समाधान हो जाता है कि कोई व्यक्ति-[भाग II—खण्ड 3(iii)] भारत का राजपत्र : दिसम्बर 12, 2020/अग्रहायण 21, 1942 321 (क) निर्वाचन व्ययों का लेखा उस समय के भीतर और उस रीति में जैसी इस अधिनियम के द्वारा या

अधीन अपेक्षित है, दाखिल करने में असफल रहा है; तथा

(ख) उसके पास उस असफलता के लिए कोई समुचित कारण या न्यायोचित्य नहीं है,

तो निर्वाचन आयोग शासकीय राजपत्र में प्रकाशित आदेश द्वारा उसको निरहित घोषित करेगा और ऐसा कोई भी

सिल्वासा, दादर एवं नागर हवेली, पिन- 396 230, को संसद के किसी भी सदन या राज्य या संघ राज्य-क्षेत्र की विधानसभा

AND WHEREAS, as per the report under rule 89(2) of the Conduct of Election Rules, 1961, submitted by the District Election Officer, Dadra and Nagar Haveli, through the Chief Electoral Officer's letter No. ADM/Election/2019/37 dated 08.07.2019, Dongarkar Ishwarbhai Gopjibhai contesting candidate from U-03- Dadra and Nagar Haveli Parliamentary Constituency of Union Territory of Dadra and Nagar Haveli, has failed to lodge any account of his/her election expenses as required by law;

AND WHEREAS, on the basis of the reports of the District Election Officer, Dadra and Nagar Haveli, a Show Cause notice dated 10.01.2020 was issued by the Election Commission of India under Sub Rule (5) of Rule 89 of the Conduct of Election Rules, 1961 to Dongarkar Ishwarbhai Gopjibhai for non submission of account of Election expenses;

AND WHEREAS, as per Sub Rule (6) of Rule 89 of the Conduct of Election Rules, 1961, through the above said Show Cause Notice dated 10.01.2020, Dongarkar Ishwarbhai Gopjibhai was directed to submit his/her representation in writing in the Commission explaining the reason for non submission of accounts and also to lodge his/her accounts of election expenses/rectify the defects in his/her accounts and submit the same to the District Election Officer concerned within 20 days from the date of receipt of the notice;

AND WHEREAS, the said notice was received by Dongarkar Ishwarbhai Gopjibhai on 17.01.2020. Acknowledgement receipt obtained from the candidate has been submitted to the Commission by Assistant (Election), Dadra and Nagar Haveli vide his letter No. ADM/Election/571/04/Part-II dated 24.01.2020;

AND WHEREAS, in the supplementary report submitted by Assistant (Election), Dadra and Nagar Haveli vide his letter No. ADM/Election/571/04/Part-II dated 11.02.2020 and 01.12.2020, it has been stated that till date no such representation has been received from Dongarkar Ishwarbhai Gopjibhai;

"If the Election Commission is satisfied that a person-

और यतः, निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप नियम (6) के अनुसार, दिनांक 10.01.2020 के उपयु र्क्त कारण बताओ नोटिस के माध्यम से, हलपटी राजेशभाई भानाभाई को निदेश दिया गया था कि वे इस नोटिस के[भाग II—खण्ड 3(iii)] भारत का राजपत्र : दिसम्बर 12, 2020/अग्रहायण 21, 1942 323 प्राप्त होने के 20 दिनों के भीतर लेखे न प्रस्तुत कर पाने का कारण स्पष्ट करते हुए आयोग को लिखित में अपना अभ्यावेदन प्रस्तुत करें और निर्वाचन व्यय का अपना लेखा भी दाखिल करें/अपने लेखे में त्रुटियों को सही करें और उसे संबंधित जिला निर्वाचन अधिकारी को प्रस्तुत करें;

और यतः, हलपटी राजेशभाई भानाभाई की पत्नी के द्वारा उक्त नोटिस दिनांक 17.01.2020 को प्राप्त किया गया था। अभ्यर्थी की पत्नी से प्राप्त पावती रसीद, सहायक (इलेक्शन), दादर एवं नागर हवेली द्वारा दिनांक 24.01.2020 के अपने पत्र सं. ADM/Election/571/04/Part-II द्वारा आयोग को प्रस्तुत कर दी गई है;

और यत:, सहायक (इलेक्शन), दादर एवं नागर हवेली द्वारा दिनांक 11.02.2020 एवं 01.12.2020 के अपने पत्र सं. ADM/Election/571/04/Part-II के द्वारा प्रस्तुत की गई अनुपूरक रिपोर्ट में यह कहा है कि हलपटी राजेशभाई भानाभाई, ने निर्वाचन का लेखा प्रस्तुत नहीं किया;

और यत:, आयोग का यह समाधान हो गया है कि हलपटी राजेशभाई भानाभाई निर्वाचन व्यय का लेखा दाखिल करने में असफल रहे हैं और असफलता के लिए उनके पास कोई समुचित कारण या न्यायोचित्य नहीं है;

और यत:, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में यह अनुबंधित किया गया है कि:-

"यदि निर्वाचन आयोग का यह समाधान हो जाता है कि कोई व्यक्ति-

(ख) उसके पास उस असफलता के लिए कोई समुचित कारण या न्यायोचित्य नहीं है,

O.N. 117.—WHEREAS, the Commission had declared to hold the General Election to Lok Sabha, 2019 vide its Notification No.464/EPS/2019 (3) dated 28.03.2019 for U-03- Dadra and Nagar Haveli Parliamentary Constituency of Union Territory of Dadra and Nagar Haveli and Halpati Rajeshbhai Bhanabhai had contested the aforesaid election;

AND WHEREAS, as per the report under rule 89(2) of the Conduct of Election Rules, 1961, submitted by the District Election Officer, Dadra and Nagar Haveli, through the Chief Electoral Officer's letter No. ADM/Election/2019/37 dated 08.07.2019, Halpati Rajeshbhai Bhanabhai contesting candidate from U-03- Dadra and Nagar Haveli Parliamentary Constituency of Union Territory of Dadra and Nagar Haveli, has failed to lodge any account of his/her elections expenses as required by law;

AND WHEREAS, on the basis of the reports of the District Election Officer, Dadra and Nagar Haveli, a Show Cause notice dated 10.01.2020 was issued by the Election Commission of India under Sub Rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 to Halpati Rajeshbhai Bhanabhai for non submission of account of Election expenses;

AND WHEREAS, as per Sub Rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, through the above said Show Cause Notice dated 10.01.2020, Halpati Rajeshbhai Bhanabhai was directed to submit his/her representation in writing in the Commission explaining the reason for non submission of accounts and also to lodge his/her accounts of election expenses/rectify the defects in his/her accounts and submit the same to the District Election Officer concerned within 20 days from the date of receipt of the notice;

AND WHEREAS, the said notice was received by the wife of Halpati Rajeshbhai Bhanabhai on 17.01.2020. Acknowledgement receipt obtained from his wife has been submitted to the Commission by Assistant (Election), Dadra and Nagar Haveli vide his letter No. ADM/Election/571/04/Part-II dated 24.01.2020;

AND WHEREAS, the Commission satisfied that Halpati Rajeshbhai Bhanabhai has failed to lodge an account of election expenses and has no good reason or justification for the failure;

AND WHEREAS, Section 10 A of the Representation of the People Act, 1951 stipulates that:-

"If the Election Commission is satisfied that a person-

(a) has failed to lodge an account of election expenses within the time and in the manner required by or under this Act; and

(b) has no good reason or justification for the failure,

464/EPS/2019 (3) दिनांक 28.03.2019 के द्वारा लोकसभा के साधारण निर्वाचन, 2019 आयोजित करने की घोषणा की

थी और संतोष बालासाहेब बिचुकाले पूर्वोक्त निर्वाचन में निर्वाचन लड़े/लड़ीं थे;

और यतः, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 77 (1) के अनुसार, निर्वाचन लड़ने वाला प्रत्येक अभ्यर्थी

या तो स्वयं या अपने निर्वाचन एजेंट द्वारा, (वह तिथि जब उसे नाम-निर्देशित किया गया है) और (उसके परिणाम की घोषणा

की तिथि), दोनों तारीखें सम्मिलित, के बीच उसके द्वारा या उसके निर्वाचन एजेंट द्वारा उपगत या अधिकृ त निर्वाचन संबंधी

और यतः, जिला निर्वाचन अधिकारी, सोलापुर जिला, महाराष्ट्र, की रिपोर्टों के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप नियम (5) के तहत निर्वाचन व्यय का लेखा दाखिल करने में असफल रहने पर, संतोष बालासाहेब बिचुकाले को दिनांक 15.11.2019 को कारण बताओ नोटिस जारी किया गया था;

और यतः, निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप नियम (6) के अनुसार, दिनांक 15.11.2019 के उपयु र्क्त कारण बताओ नोटिस के माध्यम से, संतोष बालासाहेब बिचुकाले को निदेश दिया गया था कि वे इस नोटिस के प्राप्त होने के 20 दिनों के भीतर लेखे न प्रस्तुत कर पाने का कारण स्पष्ट करते हुए आयोग को लिखित में अपना अभ्यावेदन प्रस्तुत करें और निर्वाचन व्यय का अपना लेखा भी दाखिल करें/अपने लेखे में त्रुटियों को सही करें और उसे संबंधित जिला निर्वाचन अधिकारी को प्रस्तुत करें;

अभ्यर्थी की माता से प्राप्त पावती रसीद, जिला निर्वाचन अधिकारी एवं कलेक्टर, सोलापुर जिला द्वारा दिनांक 02.12.2019 के अपने पत्र सं. Election/Desk/16/Misc./RR/1743/2019 द्वारा आयोग को प्रस्तुत कर दी गई है;

और यत:, जिला निर्वाचन अधिकारी, सोलापुर द्वारा दिनांक 31.07.2020 के अपने पत्र सं.

Election/Desk/16/Misc./RR/283/2020 के द्वारा प्रस्तुत की गई अनुपूरक रिपोर्ट में यह कहा है कि संतोष बालासाहेब बिचुकाले, ने निर्वाचन का लेखा प्रस्तुत नहीं किया;

और यत:, भारत निर्वाचन आयोग का यह समाधान हो गया है कि संतोष बालासाहेब बिचुकाले निर्वाचन व्यय का लेखा दाखिल करने में असफल रहे हैं और असफलता के लिए उनके पास कोई समुचित कारण या न्यायोचित्य नहीं है;

और यत:, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में यह अनुबंधित किया गया है कि:-

"यदि निर्वाचन आयोग का यह समाधान हो जाता है कि कोई व्यक्ति-

AND WHEREAS, Section 10 A of the Representation of the People Act, 1951 stipulates that:-

"If the Election Commission is satisfied that a person-

(a) has failed to lodge an account of election expenses within the time and in the manner required by or under this Act; and

(b) has no good reason or justification for the failure,

NOW THEREFORE, in pursuance of Section 10 A of the Representation of the People Act, 1951, the Election Commission of India hereby declares Madhukar Vitthal Nistane, resident of Gajanan Maharaj Ward, Vasant Nagar Ghatanji, Post- Ghatanji, Ta. Ghatanji, Dist- Yavatmal the contesting candidate for the General Election to the Lok Sabha Election, 2019 from 13- Chandrapur Parliamentary Constituency of the State of Maharashtra to be disqualified for being chosen as and for being a member of either House of Parliament or the Legislative Assembly or Legislative Council of a State or Union Territory for a period of three years from the date of this order.

आ. अ. 120.—यतः, आयोग ने महाराष्ट्र के 02- धुले संसदीय निर्वाचन क्षेत्र के लिए अपनी अधिसूचना सं.- 464/EPS/2019 (4) दिनांक 02.04.2019 के द्वारा लोकसभा के साधारण निर्वाचन, 2019 आयोजित करने की घोषणा की थी और मेवाती हिना यूसूफभाई पूर्वोक्त निर्वाचन में निर्वाचन लड़े/लड़ीं थे;

और यतः, निर्वाचनों का संचालन नियम, 1961, के नियम 89 (2) के अधीन, मुख्य निर्वाचन अधिकारी के दिनांक 10.10.2019 के पत्र सं. ELR-2019/CR 804/19/33 के जरिए प्राप्त, जिला निर्वाचन अधिकारी, धुले जिला, महाराष्ट्र द्वारा प्रस्तुत रिपोर्ट के अनुसार, महाराष्ट्र के 02- धुले संसदीय निर्वाचन क्षेत्र से निर्वाचन लड़ने वाले अभ्यर्थी, मेवाती हिना यूसूफभाई, विधि द्वारा यथापेक्षित रीति से अपने निर्वाचन व्यय का कोई भी लेखा दाखिल करने में असफल रहे/रहीं हैं;

और यतः, जिला निर्वाचन अधिकारी, धुले जिला, महाराष्ट्र, की रिपोर्टों के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप नियम (5) के तहत निर्वाचन व्यय का लेखा दाखिल करने में असफल रहने पर, मेवाती हिना यूसूफभाई को दिनांक 14.01.2020 को कारण बताओ नोटिस जारी किया गया था;

और यतः, निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप नियम (6) के अनुसार, दिनांक 14.01.2020 के उपयु र्क्त कारण बताओ नोटिस के माध्यम से, मेवाती हिना यूसूफभाई को निदेश दिया गया था कि वे इस नोटिस के प्राप्त होने के 20 दिनों के भीतर लेखे न प्रस्तुत कर पाने का कारण स्पष्ट करते हुए आयोग को लिखित में अपना अभ्यावेदन प्रस्तुत करें और निर्वाचन व्यय का अपना लेखा भी दाखिल करें/अपने लेखे में त्रुटियों को सही करें और उसे संबंधित जिला निर्वाचन अधिकारी को प्रस्तुत करें;

और यतः, मेवाती हिना यूसूफभाई द्वारा उक्त नोटिस दिनांक 26.01.2020 को प्राप्त किया गया था। अभ्यर्थी से प्राप्त पावती रसीद, जिला निर्वाचन अधिकारी एवं कलेक्टर, धुले जिला द्वारा दिनांक 29.01.2020 के अपने पत्र सं. G/Cell- 11/Election/WS/70/2020 द्वारा आयोग को प्रस्तुत कर दी गई है;

और यत:, जिला निर्वाचन अधिकारी, धुले द्वारा दिनांक 19.03.2020 के अपने पत्र सं. G/Cell- 11/Election/WS/171/2020 के द्वारा प्रस्तुत की गई अनुपूरक रिपोर्ट में यह कहा है कि मेवाती हिना यूसूफभाई, ने निर्वाचन का लेखा प्रस्तुत नहीं किया;

और यत:, आयोग का यह समाधान हो गया है कि मेवाती हिना यूसूफभाई निर्वाचन व्यय का लेखा दाखिल करने में असफल रहे हैं और असफलता के लिए उनके पास कोई समुचित कारण या न्यायोचित्य नहीं है;

और यत:, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में यह अनुबंधित किया गया है कि:-

"यदि निर्वाचन आयोग का यह समाधान हो जाता है कि कोई व्यक्ति-

(ख) उसके पास उस असफलता के लिए कोई समुचित कारण या न्यायोचित्य नहीं है,

तो निर्वाचन आयोग शासकीय राजपत्र में प्रकाशित आदेश द्वारा उसको निरहित घोषित करेगा और ऐसा कोई भी व्यक्ति उस आदेश की तारीख से तीन वर्ष की कालावधि के लिए निरहित होगा।"

अब इसीलिए, लोक प्रतिनिधित्व अधिनियम,1951 की धारा 10क के अनुसरण में भारत निर्वाचन आयोग एतद्द्वारा महाराष्ट्र राज्य के 02- धुले संसदीय निर्वाचन क्षेत्र से लोकसभा के साधारण निर्वाचन, 2019 में निर्वाचन लड़ने वाले अभ्यर्थी, मेवाती हिना यूसूफभाई, निवासी- 401, बारासाचा चौक, रायपुर मिल के पास, सरसपुर, अहमदाबाद - 380 018, को संसद के किसी भी सदन या राज्य या संघ राज्य-क्षेत्र की विधानसभा अथवा विधान परिषद के लिए सदस्य चुने जाने या होने के लिए इस आदेश की तारीख से तीन वर्ष की अवधि के लिए निरहित घोषित करता है।

New Delhi, the 7th December, 2020

O.N. 120.— WHEREAS, the Commission had declared to hold the General Election to Lok Sabha, 2019 vide its Notification No.464/EPS/2019 (4) dated 02.04.2019 for 02- Dhule Parliamentary Constituency of Maharashtra State and Mevati Hina Yusufbhai had contested the aforesaid election;

AND WHEREAS, as per the report under rule 89(2) of the Conduct of Elections Rules, 1961, submitted by the District Election Officer and Collector, Dhule District, Maharashtra, through the Chief Electoral Officer's letter No. ELR-2019/CR 804/19/33 dated 10.10.2019 Mevati Hina Yusufbhai contesting candidate from 02- Dhule Parliamentary Constituency of Maharashtra, has failed to lodge any account of his/her election expenses as required by law;

AND WHEREAS, on the basis of the reports of the District Election Officer, Dhule District, Maharashtra, a Show Cause notice dated 14.01.2020 was issued by the Election Commission of India under Sub Rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 to Mevati Hina Yusufbhai for non submission of account of Election expenses;

AND WHEREAS, as per Sub Rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, through the above said Show Cause Notice dated 14.01.2020, Mevati Hina Yusufbhai was directed to submit his/her representation in writing in the Commission explaining the reason for non submission of accounts and also to lodge his/her accounts of election expenses/rectify the defects in his/her accounts and submit the same to the District Election Officer concerned within 20 days from the date of receipt of the notice;

AND WHEREAS, the said notice was received by Mevati Hina Yusufbhai on 26.01.2020. Acknowledgement receipt obtained from the candidate has been submitted to the Commission by District Election officer and Collector, Dhule District vide his letter No. G/Cell-11/Election/WS/70/2020 dated 29.01.2020;

AND WHEREAS, in the supplementary report submitted by DEO, Dhule vide his letter No. G/Cell- 11/Election/WS/171/2020 dated 19.03.2020, it has been stated that Mevati Hina Yusufbhai did not submitted any reply or concerned report with reference to served show Cause notice;

AND WHEREAS, the Commission satisfied that Mevati Hina Yusufbhai has failed to lodge an account of election expenses and has no good reason or justification for the failure;

AND WHEREAS, Section 10 A of the Representation of the People Act, 1951 stipulates that:-

"If the Election Commission is satisfied that a person-

(a) has failed to lodge an account of election expenses within the time and in the manner required by or under this Act; and

(b) has no good reason or justification for the failure,

NOW THEREFORE, in pursuance of Section 10 A of the Representation of the People Act, 1951, the Election Commission of India hereby declares Mevati Hina Yusufbhai, resident of 401, Barasacha Chauk, Near Raipur Mill, Saraspur, Ahemadabad- 380 018, the contesting candidate for the General Election to the Lok Sabha Election, 2019 from 02- Dhule Parliamentary Constituency of the state of Maharashtra to be disqualified for being chosen as and for being a member of either House of Parliament or the Legislative Assembly or Legislative Council of a State or Union Territory for a period of three years from the date of this order.
