2. यह तद्‌र्थ पदोन्नति निम्नलिखित शर्तों के अधीन होगीः--

(i.) तदर्थ पदोन्नति निम्नलिखित अदालती मामालों के निर्णयों के अध्यधीन होगीः--

क. पंजाब और हरियाणा के माननीय उच्च न्यायालय द्वारा CWP सं. 13218/2009 में पातिर दिनांक 15.07.2011 के आदेश और अंतिम निर्णय से उत्पन्न SLP(C) सं. 30621/2011 तथा माननीय सर्वोच्च न्यायालय के समक्ष प्रस्तुत अन्य मामले।

ख. ऑल इंडिया इक्वॉलिटी फोरम और अन्य बनाम यूओआई और अन्यों द्वारा फाइल की गई WP(C) सं. 3490/2010 में माननीय दिल्ली उच्च न्यायालय के दिनांक 23.08.2017 के निर्णय से उत्पन्न SLP(C) सं. 31288/2017।

ग. माननीय दिल्ली उच्च न्यायालय के दिनांक 12.11.2018 के निर्णय के विरूद्ध एस.एन. जासरा और राज कुमार के संबंध में SLP सं. 5724-5725/2019।

(iii.) सुश्री गरिमा सिंह और अन्यों द्वारा फाईल की गई ओ. ए. सं. 3278/2010 में केन्द्रीय प्रशासनिक न्यास, प्रमुख बेंच के दिनांक 09.05.2011 के आदेश तथा श्री रोहतास भानकर और अन्य बनाम यूओआई और अन्यों द्वारा फाइल की गई 2004 की CA सं. 6046-6047 में माननीय सर्वोच्च न्यायालय के दिनांक 15.07.2014 के निर्णय के अनुसरण में अवर सचिव तथा उप सचिव की चयन सूची को तैयार किया जाना ।

(iv.) प्रारंभ में तदर्थ पदोन्नति 31.12.2021 तक की अवधि या अगले आदेशों तक, इनमें से जो भी पहले हो, तक के लिए होगी।

(v.) तदर्थ पदोन्नति को किसी भी समय बिना कोई कारण बताए रद्‌द किया जा सकता है।

(vi.) तदर्थ पदोन्नति मंत्रालय/विभाग में निदेशक का पदभार ग्रहण करने की तारीख, जिसमें अधिकारियों को तैनात किया जाना है, से प्रभावी होगी।

(vii.) यदि अधिकारी कार्यग्रहण अवधि में विस्तार के लिए संवर्ग नियंत्रण प्राधिकारी की पूर्व-मंजूरी के बिना प्रशिक्षण और कार्मिक विभाग द्वारा आदेश जारी किए जाने की तारीख से 30 दिनों के भीतर निदेशक पद का प्रभार ग्रहण करने में असफल रहता है तो उसकी तदर्थ पदोन्नति रद्‌द हो जाएगी।

(c) The SLP Nos. 5724-5725/2019 in respect of S. N. Jasra & Raj Kumar against Delhi High Court's judgment dated 12.11.2018;

(d) Any other connected court matter.

(ii) The ad hoc promotions shall not confer any right on the officers to continue in the grade of Director indefinitely or for inclusion in the Select List for regular promotion to the grade or to claim seniority in the grade.

(iii) Finalization of US and DS Select Lists in consonance with the Central Administrative Tribunal, Principal Bench's order dated 09.05.2011 passed in O.A. No. 3278/2010 filed by Ms. Garima Singh & Ors and Hon'ble Supreme Court's judgment dated 15.07.2014 in CA No. 6046-6047 of 2004 filed by Shri Rohtas Bhanakar & Ors. vs UOI & Anr.

(iv) The ad hoc promotions shall be initially for a period upto 31.12.2021 or until further orders, whichever is earlier.

(v) The ad hoc promotions may be terminated at any point of time without giving any reason therefor.

(vi) The ad hoc promotions will take effect from the date of assumption of charge of the post of Director in the Ministry/Department in which the officers are posted.

(vii) If an officer fails to assume the charge of the post of Director within 30 days of issue of the order by DoP&T without the prior approval of the Cadre Controlling Authority for extension in joining time, his ad hoc promotion will be liable to be cancelled.

Prabha, Section Officer of Central Secretariat Service (CSS) is promoted to the Grade I (Under Secretary) of CSS on ad-hoc basis w.e.f. the forenoon of 21st December, 2020 for a period upto 30.06.2021 or till the posts are filled up on regular basis or until further orders whichever is earlier.
