आ. अ. 01 .— यत:, भारत निर्वाचन आयोग द्वारा उत्तर प्रदेश राज्य में 80-सिकन्दरा राऊ विधान सभा निर्वाचन क्षेत्र से साधारण निर्वाचन, 2017 की घोषणा प्रेस नोट संख्या ईसीआई/प्रे.नो./1/2017 दिनांक 4 जनवरी, 2017 के जरिए की गई थी; और

यत:, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 78 के अनुसार, निर्वाचन लड़ने वाले प्रत्येक अभ्यर्थी को, निर्वाचित अभ्यर्थी के निर्वाचन की तारीख से 30 दिनों के भीतर निर्वाचन व्यय के अपने लेखे की सही प्रति संबन्धित जिला निर्वाचन अधिकारी को दाखिल करनी होती है;

यत:, 80-सिकन्दरा राऊ विधान सभा निर्वाचन क्षेत्र के रिटर्निंग अधिकारी द्वारा उक्त विधान सभा क्षेत्र से निर्वाचन के परिणाम दिनांक 11 मार्च, 2017 को घोषित किए गए थे और इस प्रकार, निर्वाचन व्यय का लेखा दाखिल करने की अन्तिम तारीख 10 अप्रैल, 2017 थी; और

(1)² THE GAZETTE OF INDIA : JANUARY ⁹, ²⁰²¹/ PAUSHA ¹⁹, ¹⁹⁴² [PART II—SEC. ³(iii)] यत:, जिला निर्वाचन अधिकारी, हाथरस जिला, उत्तर प्रदेश द्वारा प्रस्तुत दिनांक 12 अप्रैल, 2017 की रिपोर्ट के अनुसार, उत्तर प्रदेश के 80-सिकन्दरा राऊ विधान सभा निर्वाचन क्षेत्र से निर्वाचन लड़ने वाले अभ्यर्थी श्री श्रीचन्द्र अपने निर्वाचन व्यय का सही लेखा विधि द्वारा यथापेक्षित रीति से दाखिल करने में विफल रहे हैं; और

यत:, जिला निर्वाचन अधिकारी, की उक्त रिपोर्ट के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप नियम (5) के अंतर्गत श्री श्रीचन्द्र को दिनांक 18 अक्तू बर, 2018 को निर्वाचन व्यय का लेखा निम्नलिखित त्रुटियों के साथ दाखिल करने हेतु कारण बताओं नोटिस नं. 76/उ.प्र.-वि.स./80/भा.नि.आ./ नोटिस/टेरी./उ.अनु.-III-उ.प्र./2017 जारी किया गया था:-

(1) निर्वाचन व्यय की मदों के सन्दर्भ में बिल वाउचर प्रस्तुत नहीं किये गये हैं ।

(2) बैंक स्टेटमेन्ट प्रस्तुत नहीं किया गया है; और

यत:, निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप नियम (6) के अनुसार एवं उपयु र्क्त कारण बताओ नोटिस के द्वारा श्री श्रीचन्द्र को निर्देश दिया गया था कि वे इस नोटिस के प्राप्त होने के 20 दिनों के भीतर लेखा दाखिल नहीं करने के कारणों को स्पष्ट करते हुए लिखित रूप में अपना अभ्यावेदन निर्वाचन आयोग के समक्ष प्रस्तुत करें और साथ ही उक्त त्रुटियों को दूर करते हुए अपना निर्वाचन व्ययों का लेखा जिला निर्वाचन अधिकारी, हाथरस के समक्ष प्रस्तुत करें; और यत:, जिला निर्वाचन अधिकारी, हाथरस जिला, द्वारा भारत निर्वाचन आयोग को प्रस्तुत की गई पावती रसीद के अनुसार, उक्त नोटिस श्री श्रीचन्द्र को दिनांक 29 दिसम्बर, 2019 को तामील किया गया था; और

यत:, जिला निर्वाचन अधिकारी, हाथरस ने दिनांक 7 अगस्त, 2020 की अपनी अनुपूरक रिपोर्ट में यह बताया है कि श्री श्रीचन्द्र द्वारा अभी तक कोई जवाब नहीं दिया गया है और मूल वाउचर सहित हस्ताक्षरित निर्वाचन व्यय के सही लेखे का विवरण प्रस्तुत नहीं किया गया है; और

यतः, भारत निर्वाचन आयोग द्वारा अभ्यर्थी श्री श्रीचन्द्र को अंतिम अवसर प्रदान करते हुए पत्र सं० 76/उ.प्र.- वि.स./80/भा.नि.आ./पत्र/टेरी./उ.अनु.-III-उ.प्र./2017, दिनांक 18 अगस्त, 2020 जारी किया गया, जो जिला निर्वाचन अधिकारी, हाथरस के माध्यम से उनकी पत्नी किरन देवी को दिनांक 4 सितम्बर, 2020 को श्री श्रीचन्द्र द्वारा नामांकन पत्र में दर्शाये गये पते पर तामीला किया गया था; और

यत:, जिला निर्वाचन अधिकारी, से प्राप्त दिनांक 18 दिसम्बर, 2020 की रिपोर्ट के अनुसार श्री श्रीचन्द्र द्वारा उक्त कमियों को सुधारते हुए न तो कोई लेखा जमा किया गया है न ही कोई अभ्यावेदन प्रस्तुत किया गया है | इसके अतिरिक्त, उक्त नोटिस/पत्र मिलने के उपरांत भी अभ्यर्थी द्वारा उक्त विफलता के लिए भारत निर्वाचन आयोग के समक्ष कोई कारण अथवा स्पष्टीकरण प्रस्तुत नहीं किया गया है; और

यत:, तथ्यों और उपलब्ध दस्तावेजों के आधार पर, आयोग का यह समाधान हो गया है कि श्री श्रीचन्द्र विहित प्रपत्र में अपने निर्वाचन व्यय का लेखा दाखिल करने में विफल रहे हैं और उनके पास इस विफलता के लिए कोई भी उचित कारण अथवा औचित्य नहीं है; और

यत:, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में अनुबंधित किया गया है कि :-

"यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति –

(क) निर्वाचन व्ययों का लेखा उस समय के भीतर और उस रीति में जैसी इस अधिनियम के द्वारा या अधीन अपेक्षित है, दाखिल करने में विफल रहा है; तथा

(ख) उस विफलता के लिए कोई अच्छा कारण या औचित्य नहीं है,

तो निर्वाचन आयोग शासकीय राजपत्र में प्रकाशित आदेश द्वारा उसको निरर्हित घोषित करेगा और ऐसा व्यक्ति उस आदेश की तारीख से तीन वर्ष की कालावधि के लिए निरर्हित होगा ।";

अत:, अब लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अनुसरण में भारत निर्वाचन आयोग एतदद्वारा

घोषणा करता है कि श्री श्रीचन्द्र, निवासी ग्राम हुसैनपुर, तहसील सिकन्दराराऊ, जिला हाथरस, उत्तर प्रदेश, जो उत्तर प्रदेश

विधान सभा साधारण निर्वाचन, 2017 में 80-सिकन्दरा राऊ विधान सभा निर्वाचन क्षेत्र से निर्वाचन लड़ने वाले अभ्यर्थी थे,

इस आदेश की तारीख से तीन वर्ष की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य-क्षेत्र की विधान

सभा अथवा विधान परिषद का सदस्य चुने जाने अथवा होने के लिए निरर्हित होंगे ।

ELECTION COMMISSION OF INDIA

ORDER

New Delhi, the 7th January, 2021

O. N. 01 .—WHEREAS, the General Election for 80-Sikandra Rao Assembly Constituency of Uttar Pradesh, 2017 was announced by the Election Commission of India vide Press Note No. ECI/PN/1/2017 dated 4 th January, 2017; and

WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate has to lodge a true copy of his accounts of election expenses within 30 days with the concerned District Election Officer, from the date of election of the returned candidate; and

WHEREAS, the result of the election for 80-Sikandra Rao Assembly Constituency was declared by the Returning Officer on 11th March, 2017 and hence the last date for lodging the accounts of election expenses was 10th April, 2017; and

WHEREAS, as per the report dated 12th April, 2017 submitted by the District Election Officer, Hathras District, Uttar Pradesh, Sh. Shrichandra, a contesting candidate from 80-Sikandra Rao Assembly Constituency of Uttar Pradesh has failed to lodge accounts of his election expenses, in the manner prescribed under the law; and

WHEREAS, on the basis of the said report of the District Election Officer, a Show-Cause notice No. 76/UP- LA/80/ECI/Notice/TERR/NS-III-UP/2017, dated 18th October, 2018 was issued under sub rule (5) of Rule 89 of the Conduct of Election Rules, 1961 by the Election Commission of India to Sh. Shrichandra, for the following defects in accounts of his election expenses:-

(i) Bill vouchers were not presented in respect of items of election expenditure.

(ii) Bank Statement was not submitted; and

WHEREAS, through the above said Show Cause Notice and as required under sub rule (6) of Rule 89 of the Conduct of Election Rules, 1961, Sh. Shrichandra was directed to submit his representation in writing to the Commission explaining the reason for the above said shortcomings in his accounts of election expenses and also to lodge the accounts, after rectifying the above mentioned defects, with the District Election Officer, Hathras within 20 days from the date of receipt of the notice; and

WHEREAS, as per the acknowledgement receipt made available to the Election Commission by the District Election Officer, Hathras, the said notice was served on Sh. Shrichandra on 29th December, 2019; and

WHEREAS, the District Election Officer, Hathras has submitted in his supplementary report, dated 7th August, 2020 that Sh. Shrichandra, has not submitted any representation or a statement of correct account of his election expenses duly signed, along with original vouchers etc. till that date; and

WHEREAS, the candidate was given last opportunity to rectify the defects found in his accounts, vide Commission's letter No. 76/UP-LA/80/ECI/LET/TERR/NS-III-UP/2017, dated 18th August, 2020, which was served on his wife Kiran Devi on 4th September, 2020 through the District Election Officer, Hathras at the address provided by the candidate in the nomination papers; and⁴ THE GAZETTE OF INDIA : JANUARY ⁹, ²⁰²¹/ PAUSHA ¹⁹, ¹⁹⁴² [PART II—SEC. ³(iii)] WHEREAS, as per the report, dated 18th December, 2020 submitted by the District Election Officer to the Commission, Sh. Shrichandra has neither rectified the above mentioned defects nor any representation has been received from him. Further, no representation from the candidate has been received in the Secretariat of the Election Commission of India, after delivery of the above mentioned notice/letter; and

WHEREAS, on the basis of facts and available records, the Commission is satisfied that Sh. Shrichandra has failed to lodge his accounts of election expenses in the manner prescribed under law and has no good reason or justification for the failure to do so; and

WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that :-

"If the Election Commission is satisfied that a person-

(a) Has failed to lodge an account of election expenses within the time and in the manner required by or under this Act; and

(b) Has no good reason or justification for the failure,

the Election Commission shall, by order published in the official Gazette, declare him to be disqualified and any such person shall be disqualified for a period of three years from the date of the order.";

NOW THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission of India hereby declares Sh. Shrichandra, resident of Village- Husainpur, Tehsil Sikandra Rao, District Hathras, Uttar Pradesh and a contesting candidate from 80-Sikandra Rao Assembly Constituency of the State of Uttar Pradesh in the General Elections to the State Legislative Assembly, 2017, to be disqualified for being chosen as and for being a member of either House of Parliament or the Legislative Assembly or Legislative Council of a State or Union Territory for a period of three years from the date of this order.

आ. अ. 02 .— यतः, निर्वाचन आयोग का यह समाधान हो गया है कि नीचे तालिका के स्तंभ (2) में यथा-विनिर्दिष्ट लोक सभा के साधारण निर्वाचन, 2019 में तालिका के स्तंभ (4) में विनिर्दिष्ट निर्वाचन लड़ने वाले प्रत्येक अभ्यर्थी, जो तालिका के स्तंभ (3) में अपने नाम के सामने निर्वाचन-क्षेत्र से निर्वाचन लड़े थे, लोक प्रतिनिधित्व अधिनियम, 1951 तथा उसके अधीन बनाए गए नियमों और आदेश के अन्तर्गत यथापेक्षित रीति जैसा कि उक्त सारणी के स्तम्भ (5) में दर्शाया गया है, से अपने निर्वाचन व्यय का लेखा दाखिल करने में विफल रहे हैं; और

यतः, उक्त अभ्यर्थियों ने निर्वाचन आयोग द्वारा सम्यक् नोटिस दिए जाने के बावजूद, उक्त विफलता के लिए कोई कारण व स्पष्टीकरण नहीं दिया है और निर्वाचन आयोग का यह समाधान हो गया है कि उक्त विफलता के लिए उनके पास कोई उपयुक्त या न्यायोचित कारण नहीं है;

अतः, अब लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10-क के अनुसरण में, भारत निर्वाचन आयोग, अधोलिखित सारणी के स्तंभ (4) में विनिर्दिष्ट व्यक्तियों को इस आदेश की तारीख से तीन वर्ष की अवधि के लिए संसद के किसी भी सदन या राज्य की विधानसभा अथवा विधान परिषद के लिए सदस्य के रूप में चुने जाने या सदस्य होने के लिए निरर्हित घोषित करता हैः-[भाग II—खण्ड 3(iii)] भारत का राजपत्र : जनवरी ⁹, ²⁰²¹/पौष ¹⁹, ^{1942 5} सारणी

Whereas, the said candidates have not furnished any reason or explanation for the said failure even after due notice and the Election Commission is thus satisfied that they have no good reason or justification for the said failure;

Now, therefore, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission hereby declares the persons specified in column (4) of the table below to be disqualified for being chosen as, and for being, a member of either House of the Parliament or of the Legislative Assembly or Legislative Council of a State for a period of three years from the date of this order: -

यत:, जिला निर्वाचन अधिकारी, की उक्त रिपोर्ट के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप नियम (5) के अंतर्गत श्री राजशेखर सेंगर को दिनांक 18 अक्तू बर, 2018 को निर्वाचन व्यय का लेखा निम्नलिखित त्रुटियों के साथ दाखिल करने हेतु कारण बताओं नोटिस नं. 76/उ.प्र.-वि.स./80/भा.नि.आ./ नोटिस/टेरी./उ.अनु.-III-उ.प्र./2017 जारी किया गया था:-

यत:, जिला निर्वाचन अधिकारी, हाथरस ने दिनांक 7 अगस्त, 2020 की अपनी अनुपूरक रिपोर्ट में यह बताया है कि श्री राजशेखर सेंगर द्वारा अभी तक कोई जवाब नहीं दिया गया है और मूल वाउचर सहित हस्ताक्षरित निर्वाचन व्यय के सही लेखे का विवरण प्रस्तुत नहीं किया गया है; और

यतः, भारत निर्वाचन आयोग द्वारा अभ्यर्थी श्री राजशेखर सेंगर को अंतिम अवसर प्रदान करते हुए पत्र सं० 76/उ.प्र.-वि.स./80/भा.नि.आ./पत्र/टेरी./उ.अनु.-III-उ.प्र./2017, दिनांक 18 अगस्त, 2020 जारी किया गया, जो जिला निर्वाचन अधिकारी, हाथरस के माध्यम से उन्हें दिनांक 31 अक्तू बर, 2020 को प्राप्त हुआ; और

यत:, जिला निर्वाचन अधिकारी, से प्राप्त दिनांक 18 दिसम्बर, 2020 की रिपोर्ट के अनुसार श्री राजशेखर सेंगर द्वारा उक्त कमियों को सुधारते हुए न तो कोई लेखा जमा किया गया है न ही कोई अभ्यावेदन प्रस्तुत किया गया है | इसके अतिरिक्त, उक्त नोटिस/पत्र मिलने के उपरांत भी अभ्यर्थी द्वारा उक्त विफलता के लिए भारत निर्वाचन आयोग के समक्ष कोई कारण अथवा स्पष्टीकरण प्रस्तुत नहीं किया गया है; और

यत:, तथ्यों और उपलब्ध दस्तावेजों के आधार पर, आयोग का यह समाधान हो गया है कि श्री राजशेखर सेंगर विहित प्रपत्र में अपने निर्वाचन व्यय का लेखा दाखिल करने में विफल रहे हैं और उनके पास इस विफलता के लिए कोई भी उचित कारण अथवा औचित्य नहीं है; और[भाग II—खण्ड 3(iii)] भारत का राजपत्र : जनवरी ⁹, ²⁰²¹/पौष ¹⁹, ^{1942 7} यत:, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में अनुबंधित किया गया है कि :-

"यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति –

(क) निर्वाचन व्ययों का लेखा उस समय के भीतर और उस रीति में जैसी इस अधिनियम के द्वारा या अधीन अपेक्षित है, दाखिल करने में विफल रहा है; तथा

(ख) उस विफलता के लिए कोई अच्छा कारण या औचित्य नहीं है

तो निर्वाचन आयोग शासकीय राजपत्र में प्रकाशित आदेश द्वारा उसको निरर्हित घोषित करेगा और ऐसा व्यक्ति उस आदेश की तारीख से तीन वर्ष की कालावधि के लिए निरर्हित होगा ।";

अत:, अब लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अनुसरण में भारत निर्वाचन आयोग एतदद्वारा घोषणा करता है कि श्री राजशेखर सेंगर, निवासी हंसगढी, पोस्ट हसौना, जगमोहनपुर, जिला अलीगढ़, उत्तर प्रदेश, जो उत्तर प्रदेश विधान सभा साधारण निर्वाचन, 2017 में 80-सिकन्दरा राऊ विधान सभा निर्वाचन क्षेत्र से निर्वाचन लड़ने वाले अभ्यर्थी थे, इस आदेश की तारीख से तीन वर्ष की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य-क्षेत्र की विधान सभा अथवा विधान परिषद का सदस्य चुने जाने अथवा होने के लिए निरर्हित होंगे ।

ORDER

New Delhi, the 7th January, 2021

O.N. 03 .—WHEREAS, the General Election for 80-Sikandra Rao Assembly Constituency of Uttar Pradesh, 2017 was announced by the Election Commission of India vide Press Note No. ECI/PN/1/2017 dated 4 th January, 2017; and

WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate has to lodge a true copy of his accounts of election expenses within 30 days with the concerned District Election Officer, from the date of election of the returned candidate; and

WHEREAS, the result of the election for 80-Sikandra Rao Assembly Constituency was declared by the Returning Officer on 11th March, 2017 and hence the last date for lodging the accounts of election expenses was 10th April, 2017; and

WHEREAS, as per the report dated 12th April, 2017 submitted by the District Election Officer, Hathras District, Uttar Pradesh, Sh. Raj Shekhar Sengar, a contesting candidate from 80-Sikandra Rao Assembly Constituency of Uttar Pradesh has failed to lodge accounts of his election expenses, in the manner prescribed under the law; and WHEREAS, on the basis of the said report of the District Election Officer, a Show-Cause notice No. 76/UP- LA/80/ECI/Notice/TERR/NS-III-UP/2017, dated 18th October, 2018 was issued under sub rule (5) of Rule 89 of the Conduct of Election Rules, 1961 by the Election Commission of India to Sh. Raj Shekhar Sengar, for the following defects in accounts of his election expenses:-

(i) Bill vouchers were not presented in respect of items of election expenditure.

(ii) Bank Statement was not submitted; and

WHEREAS, through the above said Show Cause Notice and as required under sub rule (6) of Rule 89 of the Conduct of Election Rules, 1961, Sh. Raj Shekhar Sengar was directed to submit his representation in writing to the Commission explaining the reason for the above said shortcomings in his accounts of election expenses and also to lodge the accounts, after rectifying the above mentioned defects, with the District Election Officer, Hathras within 20 days from the date of receipt of the notice; and⁸ THE GAZETTE OF INDIA : JANUARY ⁹, ²⁰²¹/ PAUSHA ¹⁹, ¹⁹⁴² [PART II—SEC. ³(iii)] WHEREAS, as per the acknowledgement receipt made available to the Election Commission by the District Election Officer, Hathras, the said notice was served on Sh. Raj Shekhar Sengar on 29th December, 2018; and WHEREAS, the District Election Officer, Hathras has submitted in his supplementary report, dated 7th August, 2020 that Sh. Raj Shekhar Sengar, has not submitted any representation or a statement of correct account of his election expenses duly signed, along with original vouchers etc. till that date; and

WHEREAS, the candidate was given last opportunity to rectify the defects found in his accounts, vide Commission's letter No. 76/UP-LA/80/ECI/LET/TERR/NS-III-UP/2017, dated 18th August, 2020, which was served on him on 31st October, 2020 through the District Election Officer, Hathras; and

WHEREAS, as per the report, dated 18th December, 2020 submitted by the District Election Officer to the Commission, Sh. Raj Shekhar Sengar has neither rectified the above mentioned defects nor any representation has been received from him. Further, no representation from the candidate has been received in the Secretariat of the Election Commission of India, after delivery of the above mentioned notice/letter; and

WHEREAS, on the basis of facts and available records, the Commission is satisfied that Sh. Raj Shekhar Sengar has failed to lodge his accounts of election expenses in the manner prescribed under law and has no good reason or justification for the failure to do so; and

WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that :-

"If the Election Commission is satisfied that a person-

(a) Has failed to lodge an account of election expenses within the time and in the manner required by or under this Act; and

(b) Has no good reason or justification for the failure,

the Election Commission shall, by order published in the official Gazette, declare him to be disqualified and any such person shall be disqualified for a period of three years from the date of the order.";

NOW THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission of India hereby declares Sh. Raj Shekhar Sengar, resident of Village- Hansgari, Post Hasona Jagmohanpur, District Aligarh, Uttar Pradesh and a contesting candidate from 80-Sikandra Rao Assembly Constituency of the State of Uttar Pradesh in the General Elections to the State Legislative Assembly, 2017, to be disqualified for being chosen as and for being a member of either House of Parliament or the Legislative Assembly or Legislative Council of a State or Union Territory for a period of three years from the date of this order.

आदेश

आ. अ. 04.— यतः, निर्वाचन आयोग का यह समाधान हो गया है कि नीचे तालिका के स्तंभ (2) में यथा-विनिर्दिष्ट लोक सभा के साधारण निर्वाचन, 2019 में तालिका के स्तंभ (4) में विनिर्दिष्ट निर्वाचन लड़ने वाले प्रत्येक अभ्यर्थी, जो तालिका के स्तंभ (3) में अपने नाम के सामने निर्वाचन-क्षेत्र से निर्वाचन लड़े थे, लोक प्रतिनिधित्व अधिनियम, 1951 तथा उसके अधीन बनाए गए नियमों और आदेश के अन्तर्गत यथापेक्षित रीति जैसा कि उक्त सारणी के स्तम्भ (5) में दर्शाया गया है, से अपने निर्वाचन व्यय का लेखा दाखिल करने में विफल रहे हैं; और

यतः, उक्त अभ्यर्थियों ने निर्वाचन आयोग द्वारा सम्यक् नोटिस दिए जाने के बावजूद, उक्त विफलता के लिए कोई कारण व स्पष्टीकरण नहीं दिया है और निर्वाचन आयोग का यह समाधान हो गया है कि उक्त विफलता के लिए उनके पास कोई उपयुक्त या न्यायोचित कारण नहीं है;

अतः, अब लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10-क के अनुसरण में, भारत निर्वाचन आयोग, अधोलिखित सारणी के स्तंभ (4) में विनिर्दिष्ट व्यक्तियों को इस आदेश की तारीख से तीन वर्ष की अवधि के लिए संसद के किसी भी सदन या राज्य की विधानसभा अथवा विधान परिषद के लिए सदस्य के रूप में चुने जाने या सदस्य होने के लिए निरर्हित घोषित करता हैः-
