सा.का.नि. 02.— केन्द्रीय सरकार, असम राइफल्स अधिनियम, 2006 (2006 का 47) की धारा 165 की उप-धारा (2) के खंड (क) और खंड (ख) के साथ पठित उप-धारा (1) द्वारा प्रदत्त षक्तियों का प्रयोग करते हुए और असम राइफल्स, (समूह 'ग' योधक) पद भर्ती नियम, 2000 जहां तक हवलदार (ऑपरेटर रेडियो और लाइन) और राइफलमैन (ऑपरेटर रेडियो और लाइन) के पद से संबंधित है, उन बातों के सिवाय अधिक्रांत करते हुए अधिक्रमण से पहले किया गया है या करने का लोप किया गया है, गृह मंत्रालय के अधीन असम राइफल्स में हवलदार (ऑपरेटर रेडियो एवं लाइन) पद पर भर्ती की पद्धति विनियमन के लिए निम्नलिखित नियम बनाती है, अर्थात :-

1. संक्षिप्त नाम और प्रारंभ.—(1) इन नियमों का संक्षिप्त नाम गृह मंत्रालय असम राइफल्स, हवलदार (ऑपरेटर रेडियो और लाइन) योद्धक पद भर्ती नियम, 2020 हैं।

(2) ये नियम राजपत्र में उनके प्रकाषन की तारीख को प्रवृत्त होंगे।

2. पद संख्या, वर्गीकरण तथा वेतन बैंड और ग्रेड वेतन या वेतनमान.—पद संख्या, उसका वर्गीकरण तथा उसके वेतन मैट्रिक्स का स्तर वह होगा, जो इन नियमों से उपाबद्ध अनुसूची के स्तम्भ (2) से स्तंभ (4) में विनिर्दिश्ट हैं।

3. भर्ती की पद्धति, आयु-सीमा और अर्हताएं आदि.—उक्त पद पर भर्ती की पद्धति, आयु-सीमा, अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो पूर्वोक्त अनुसूची के स्तंभ (5) से (13) में विनिर्दिश्ट हैं।

4. निरर्हता. - कोइ भी व्यक्ति, -

(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है या विवाह की संविदा की है; या (ख) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी अन्य व्यक्ति से विवाह किया है या विवाह की संविदा की है, उक्त पद पर नियुक्ति का पात्र नहीं होगा :

परन्तु केंद्र सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी।

5. चिकित्सा स्वस्थता.—(1) इन नियमों में किसी बात के होते हुए भी केवल ऐसे व्यक्ति जो चिकित्सा प्रवर्ग ''षेप-1'' में हैं, इन नियमों के उपबंधों के अधीन प्रोन्नति पर नियुक्ति के पात्र होेंगे।

स्पश्टीकरण-इस नियम के प्रयोजन के लिए 'षेप-1' से तात्पर्य चिकित्सा श्रेणी को निम्न प्रकार परिभाशित किया है :-

(क) ऐसे कोड अक्षर शेप द्वारा जो निम्नलिखित कृत्यों का प्रतिनिधित्व करते हैं, उपदर्षित दिए गए कारकों के अधीन अधिकारी की योग्यता सुनिष्चित करने के पश्चात्‌ चिकित्सा अधिकारी द्वारा किया गया चिकित्सा वर्गीकरण अभिप्रेत है :-

एस - मनोवैज्ञानिक

एच - श्रवण शक्ति

ए - उपांग (अपैन्डेजेज)

पी - शारीरिक क्षमता

ई - दृश्टि शक्ति

(ख) प्रत्येक कारक के अधीन, किसी अधिकारी की कार्यात्मक क्षमता निर्दिश्ट है जो प्रत्येक कोड अक्षर के सामने अंक 1 से 5 तक की कार्यक्षमता उपदर्षित करते हुए दर्षाई जाएगी और कोड अक्षर के पश्चात्‌ अंक लिखे जाएंगे, सिवाय उसके जहां कोई अधिकारी सभी कारकों में श्रेणी-1 में हैं, वहां उसका प्रवर्ग एस1 एच1 ए1 पी1 ई1 लिखने की बजाय शेप-1 लिख कर दर्षाया जा सकेगा। इन अंकों का साधारण मूल्यांकन निम्नानुसार है :-

हवलदार (ऑपरेटर रेडियो एवं लाइन)

(क) किसी भी स्थान पर सभी तरह के कर्तव्यों के लिए योग्य।

(ख) छोड़कर, नेमी या निश्क्रिय कर्तव्यों के लिए योग्य किन्तु ऊँचे स्थान (2700 मीटर से अधिक) अत्यधिक ठंडे क्षेत्रों या पहाड़ी भूखंडों पर और दीर्घ कर्तव्य भारों के लिए नियोजन योग्यता की परिसीमाएं हो सकती हैं।

(ग) सभी कर्तव्यों के लिए योग्य, परन्तु कर्तव्यों में तीव्र कठिनाई या दोनों कानों या आँखों की श्रवण शक्ति या दृश्टि की तीक्ष्णता की मांग अंतगर््रस्त है या नहीं, पर निर्भर करते हुए कर्तव्यों के प्रकार और नियोजन योग्यता क्षेत्रों के अनुसार परिसीमाएं हो सकती हैं।

(घ) अस्पताल में भर्ती होने या बीमारी की छुट्‌टी के कारण कर्तव्यों के लिए अस्थायी रूप से अयोग्य।

(ड.) कर्तव्यों के लिए स्थायी रूप से अयोग्य।

6. षिथिल शक्ति.—जहां केंद्रीय सरकार की यह राय है कि ऐसा करना आवष्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके, इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेष द्वारा षिथिल कर सकेगी।

7. व्यावृति.—इन नियमों की कोई बात, ऐसे आरक्षण, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय-समय पर निकाले गए आदेषों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछले वगार्,े भूतपूर्व सैनिकों और अन्य विषेश प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है।

New Delhi, the 5th January, 2021

G.S.R. 02.— In exercise of the powers conferred by sub-section (1) read with clauses (a) and (b) of sub- section (2) of section 165 of the Assam Rifles Act 2006, (47 of 2006), and in supersession of the Assam Rifles (Group 'C' Combatised posts) Recruitment Rules, 2000, in so far as they relate to the post of Havildar (Operator Radio and Line) and Rifleman (Operator Radio and Line), except as respects to things done or omitted to be done before such supersession, the Central Government hereby makes the following rules regulating the method of recruitment to the post of Havildar (Operator Radio and Line), in the Assam Rifles under the Ministry of Home Affairs, namely :-

1. Short title and commencement.—

(1) These rules may be called the Ministry of Home Affairs, Assam Rifles Havildar (Operator Radio and Line), Combatised post, Recruitment Rules, 2020.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of post, classification and level in the pay matrix.—The number of post, its classification and level in the pay matrix attached thereto, shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

3. Method of recruitment, age-limit, qualifications etc.—The method of recruitment to the post, age-limit, qualification and other matters relating thereto, shall be as specified in columns (5) to (13) of the aforesaid Schedule.

4. Disqualification.—No person, –

(a) who, has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any person, shall be eligible for appointment to the said post :

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

5. Medical Fitness.— (1) Notwithstanding anything contained in these rules, only those persons who are in medical category SHAPE-I, shall be eligible for appointment or promotion under the provisions of these rules.

Explanation. - For the purpose of this rule, "SHAPE- I" means Medical Category defined as under:-

(i) medical classification done by the Medical Officer after assessing fitness of the officer under given factors indicated by the code letters SHAPE, which represent the following function:-

S - Psychological

H - Hearing

A - Appendages

P - Physical Capacity

E - Eye-Sight;

(ii) functional capacity of an officer under each factor shall be denoted by numeral 1 to 5 against each code letter, indicating declining functional efficiency. The numerals shall be written next to the code letter, except that where an officer is in Grade-I in all factors, his category may be denoted by writing SHAPE-I instead of writing S1H1A1P1E1. General evaluation of these numerals is as under:-

Havildar (Operator Radio and Line),

(a) fit for all duties anywhere;

(b) fit for all duties but may have limitations as to type of duties and areas of employability depending on whether the duties involve severe stress or demand acuity of hearing or vision of both ears or eyes;

(c) excepting "S" factor, fit for routine or sedentary duties but may have limitations of employability at high altitude (above 2,700 meters) extreme cold areas or hilly terrain and for long assignments;

(d) temporarily unfit for duties on account of hospitalisation or sick leave;

(e) permanently unfit for duties.

6. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, and for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons.

7. Saving.— Nothing in these rules shall affect reservation, relaxation of age-limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, the other backward classes, Ex-Servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

केन्द्रीय सरकार, सीमा सुरक्षा बल अधिनियम, 1968 (1968 का 47) की धारा 141 की उपधारा (2) के खण्ड (ख) और (ग) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, और सीमा सुरक्षा बल, निरीक्षक (पुस्तकालयाध्यक्ष) योधक अराजपत्रित समूह 'ख' पद भर्ती नियम, 2012 को, उन बातों के सिवाय अधिक्रांत करते हुए, जिन्हें ऐसे अधिक्रमण से पहले किया गया है या करने का लोप किया गया है, सीमा सुरक्षा बल, निरीक्षक (पुस्तकालयाध्यक्ष) के पदों पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थातः-

.-(1) इन नियमों का संक्षिप्त नाम सीमा सुरक्षा बल, निरीक्षक 1. (पुस्तकालयाध्यक्ष) (योधक, अराजपत्रित समूह 'ख' पद ) भर्ती नियम, 2020 है।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे।

ः- उक्त पदों की संख्या, उनका वर्गीकरण तथा वेतन मैट्रिक्स मेें स्तर के होंगे, जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ (2) से स्तंभ (4) में विनिर्दिष्ट हैं।

ः- भर्ती की पद्धति, आयु सीमा, अर्हताएं और उनसे 3. संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ (5) से स्तंभ (13) में विनिर्दिष्ट हैं।

4. - - (क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है विवाह किया है या विवाह की संविदा की है; या

(ख) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है या विवाह की संविदा की है;

उक्त पदों पर नियुक्ति का पात्र नहीं होगाः[भाग II—खण्ड ³(i)] भारत का राजपत्र : जनवरी ¹⁶, ²⁰²¹/पौष ²⁶, ^{1942 17} परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी।

5. ः- इन नियमों में अन्तर्विष्ट किसी बात के होते हुए भी, केवल वे व्यक्ति, जो चिकित्सा प्रवर्ग शेप-। में है, इन नियमों के उपबंधों के अधीन नियुक्ति के लिए पात्र होंगे।

'शेप-। से यथा नीचे परिभाषित चिकित्सा प्रवर्ग अभिप्रेत हैः-

(i) कोड अक्षर शेप जो निम्नलिखित कृत्यों का प्रतिनिधित्व करते हैं, द्वारा उपदर्षित दिए गए कारकों के अधीन अधिकारी की उपयुक्तता निर्धारित करने के पश्चात्‌ चिकित्सा अधिकारी द्वारा किया गया चिकित्सा वर्गीकरणः- एस- मनोवैज्ञानिक

एच- श्रवण शक्ति

ए - उपांग (अपैन्डेजेस)

पी - शारीरिक क्षमता

ई - दृष्टि शक्ति

(ii) प्रत्येक कारक के अधीन, किसी अधिकारी की कार्यात्मक क्षमता, प्रत्येक कोड अक्षर के सामने अंक 1 से 5 की कार्यक्षमता उपदर्शित करते हुए दर्शाई जाएगी। कोड अक्षर के पश्चात्‌ अंक लिखे जाएंगे सिवाय उसके जहां कोई अधिकारी सभी कारकों में श्रेणी-। में हैं वहां उसका प्रवर्ग एस1 एच1 ए1 पी1 ई1 लिखने के बजाए शेप-। लिखकर दर्शाया जा सकेगा। इन अंकों का साधारण मूल्यांकन निम्नानुसार हैः-

(1) कहीं भी सभी कर्तव्यों के लिए योग्य।

(2) सभी कर्तव्यों के लिए योग्य किन्तु क्या कर्तव्यों में तीव्र कठिनाई या कानों-ऑखों की श्रवण शक्ति/दृष्टि की तीक्ष्णता की मांग अन्तगर््रस्त है या नहीं, पर निर्भर करते हुए कर्तव्यों के प्रकार और नियोजन योग्यता क्षेत्रों के अनुसार परिसीमाएं हो सकती हैं।

(3) ''एस'' कारक को छोड़कर, नेमी या निष्क्रिय कर्तव्यों के योग्य किन्तुु उच्च स्थान (2700 मीटर से अधिक) अत्यधिक ठंडे क्षेत्रोें या पहाड़ी भूखंडों पर और दीर्घ कर्तव्य भारों के लिए नियोजन योग्यता की परिसीमाएं हो सकती है।

(4) अस्पताल में भर्ती या बीमारी की छुट्‌टी के कारण कर्तव्यों के लिए अस्थायी रूप से अयोग्य।

(5) कर्तव्यों के लिए स्थायी रूप से अयोग्य।

6. ः- कोई व्यक्ति, जो भारत का नागरिक नहीं है, लिखित रूप में संज्ञापित केन्द्रीय सरकार की पूर्व अनुमति के सिवाय, इन नियमों के अधीन नियुक्त या नियोजित नहीं किया जाएगा।

परन्तु इन नियमों में अंतर्विष्ट किसी बात के होते हुए भी इन नियमों के अधीन नेपाल या भूटान के नागरिकों की नियुक्ति, नामांकन और नियोजन पर विवर्जित नहीं किया जाएगा।

7. - (1) इन नियमों के अधीन नियुक्त किया गया कोई कार्मिक उस माह के, जिसमें वह साठ वर्ष की आयु पूर्ण करता है, अन्तिम दिन के अपराह्‌न में सेवानिवृत्त होगाः

परन्तु वह व्यक्ति जिसके जन्म की तारीख किसी माह की पहली तारीख होगी, साठ वर्ष की आयु पूर्ण करने के पूर्ववर्ती माह के अंतिम दिन के अपराह्‌न में सेवानिवृत्त होगा।

(2) किसी व्यक्ति को साठ वर्ष की सेवा निवृत्ति की आयु के पश्चात्‌ सेवा विस्तारण प्रदान नहीं किया जाएगा।

8. .- जहाँ केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहाँ वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके, इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बावत्‌, आदेश द्वारा शिथिल कर सकेगी।

(ii) जिन्होंने मूल काडर या विभाग में नियमित आधार पर नियुक्ति के बाद वेतन मैट्रिक्स के स्तर- 6 में 35400-112400 रू0 या समतुल्य में पांच वर्ष नियमित सेवा की हो और (ख) स्तंभ (7) के अधीन सीधी भर्ती के लिए विहित अर्हताए रखते हों।

प्रतिनियुक्ति की अवधि, जिसके अंतर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन या विभाग में इस नियुक्ति से ठीक पहले धारित किसी अन्य काडर बाह्‌य पद पर प्रतिनियुक्ति की अवधि है साधारणतया तीन वर्ष से अधिक नहीं होगी।

प्रतिनियुक्ति द्वारा नियुक्ति के लिए अधिकतम आयु सीमा आवेदन प्राप्त करने की अंतिम तारीख को 52 वर्ष से अधिक नहीं होगी।

G.S.R. 03.— In exercise of the powers conferred by clauses (b) and (c) of sub- section (2) of section 141 of the Border Security Force Act, 1968 (47 of 1968), and in supersession of the Border Security Force Inspector (Librarian) (Combatised, Non-Gazetted, Group 'B' posts) Recruitment Rules, 2012 except as respect things done or omitted to be done before such supersession, the Central Government hereby makes the following rules regulating the method of recruitment to the posts of Inspector (Librarian) in the Border Security Force, namely:-

1. Short title and commencement.— (1) These rules may be called the Border Security Force Inspector (Librarian) (Combatised, Non-Gazetted, Group 'B' Posts) Recruitment Rules, 2020.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of post, classification and level in the pay matrix.—The number of post, its classification and level in the pay matrix attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

3. Method of recruitment, age-limit and other qualifications, etc.—The method of recruitment, age- limit, qualifications and other matters relating to the said post shall be as specified in columns (5) to (13) of the aforesaid Schedule.

Provided that nothing contained in these rules shall debar the appointment, enrollment or employment of a subject of a Nepal and Bhutan under these rules.

7. Superannuation.— (1) A person appointed under the provisions of these rules shall retire from service on the afternoon of the last day of the month in which he attains the age of sixty years:

Provided that the person whose date of birth is the first of a month shall retire from service on the afternoon of the last day of the preceding month on attaining the age of sixty years.

(2) No person shall be granted extension in service beyond the age of retirement of sixty years.

8. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, for reasons, to be recorded in writing, relax any of the provisions of these rules in respect of any class or category of persons.

सा.का.नि. 04.— राष्ट्रपति, संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और वित्त मंत्रालय, व्यय विभाग (सिविल), (वर्ग - 3 और वर्ग - 4 पद) भर्ती नियम, 2006 को, जहां तक उसका संबंध स्टाफ कार चालक विशेष श्रेणी के पद से है, उन बातों के सिवाय अधिक्रांत करते हुए, जिन्हें ऐसे अधिक्रमण से पहले किया गया है या करने का लोप किया गया है, वित्त मंत्रालय, व्यय विभाग में स्टाफ कार चालक (विशेष श्रेणी) के पद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम हैं, अर्थात्:-

1. संक्षिप्त नाम और प्रारंभ.—(1) इन नियमों का संक्षिप्त नाम वित्त मंत्रालय, व्यय विभाग, स्टाफ कार चालक (विशेष श्रेणी) (समूह 'ख' पद) भर्ती नियम, 2020 है ।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद संख्या, वर्गीकरण और वेतन मैट्रिक्स में स्तर.— पद संख्या, उसका वर्गीकरण, और इससे संलग्न वेतन मैट्रिक्स में स्तर वह होगा, जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ (2) से स्तंभ (4) में विनिर्दिष्ट हैं ।

3. भर्ती की पद्धति, आयु सीमा, और अन्य अर्हताएं, आदि .—भर्ती की पद्धति, आयु सीमा, अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ (5) से (13) में विनिर्दिष्ट हैं ।

4. निरर्हता.—वह व्यक्ति-

(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित हैं, विवाह किया है, या विवाह की संविदा की है; या

(ख) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,या विवाह की संविदा की है,

उक्त पद पर नियुक्ति का पात्र नहीं होगाः

परन्तु यदि के न्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छू ट दे सके गी ।

5. शिथिल करने की शक्ति.—जहां के न्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं, उन्हें लेखबद्ध करके , तथा संघ लोक सेवा आयोग से परामर्श करके , इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सके गी ।

6. व्यावृत्ति.—इन नियमों की कोई बात, ऐसे आरक्षण, आयु-सीमा में छू ट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका के न्द्रीय सरकार द्वारा इस संबंध में समय-समय पर जारी किए गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

G.S.R. 04.— In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Ministry of Finance, Department of Expenditure (Civil), (Class-III and Class - IV posts) Recruitment Rules, 2006, in so far as they relate to the post of Staff Car Driver Special Grade, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the post of the Staff Car Driver (Special Grade) in the Department of Expenditure, Ministry of Finance, namely :-

1. Short title and commencement.—(1) These rules may be called the Ministry of Finance, Department of Expenditure, Staff Car Driver (Special Grade) (Group 'B' Post) Recruitment Rules, 2020.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of post, classification and level in the pay matrix.— The number of post, its classification and the pay level in the pay matrix attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

3. Method of recruitment, age-limit, and other qualifications, etc.—The method of recruitment, age-limit, qualifications and other matters relating thereto shall be as specified in columns (5) to (13) of the said Schedule.

4. Disqualification.—No person, -

(a) who has entered into or contracted a marriage with a person having a spouse living, or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for the appointment to the said post:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

5. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order and for reasons to be recorded in writing and in consultation with the Union Public Service Commission, relax any of the provisions of these rules with respect to any class or category of persons.

6. Saving.—Nothing in these rules shall affect reservation, relaxation of age-limit and other concessions required to be provided for persons belonging to the Scheduled Castes, the Scheduled Tribes, ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.
