के न्द्रीय अधिकारियों (संघ राज्यक्षेत्र प्रशासनों को छोड़कर) द्वारा जारी किए गए साधारण आदेश और अधिसूचनाएं Orders and Notifications issued by the Central Authorities (Other than the Administrations of Union Territories) नई दिल्ली, 8 फरवरी, 2021 08.— यतः भारत निर्वाचन आयोग द्वारा बिहार राज्य से लोक सभा का साधारण निर्वाचन 2019 की घोशणा प्रेस नोट संख्या ईसीआई/प्रे.नो./23/2019 दिनांक 10 मार्च, 2019 के जरिए की गई थी । कार्यक्रम के अनुसार, मतगणना की तारीख 23 मई, 2019 थी ।
लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 78 के अनुसार, निर्वाचन लडने वाले प्रत्येक अभ्यर्थी को, निर्वाचित अभ्यर्थी के निर्वाचन की तारीख से 30 दिनों के भीतर निर्वाचन व्यय के अपने लेखे की सही प्रति जिला निर्वाचन अधिकारी को दाखिल करनी होती है
ः, लोक सभा निर्वाचन क्षेत्र सहित संबंधित रिटर्निग अधिकारी द्वारा उक्त निर्वाचन के परिणाम 23 मई, 2019 को घोशित किए गए थे । इस प्रकार, निर्वाचन व्यय के लेखे दाखिल करने की अंन्तिम तारीख 22 जून, 2019 थी;

(19)20 THE GAZETTE OF INDIA : FEBRUARY 13, 2021/MAGHA 24, 1942 [PART II—SEC. 3(iii)] ः, जिला निर्वाचन अधिकारी, मधुबनी जिला, बिहार द्वारा प्रस्तुत और मुख्य निर्वाचन अधिकारी, बिहार द्वारा अपने दिनांक 9 जुलाई, 2019 के पत्र सं. Exp-09/2019/(Part-26)-5756 के जरिए अग्रेशित दिनांक 29 जून, 2019 की रिपोर्ट के अनुसार , जो बिहार के लोकसभा निर्वाचन क्षेत्र से निर्वाचन लडने वाले निर्दलीय अभ्यर्थी हैं, विधि द्वारा यथापेक्षित रीति से अपने निर्वाचन व्यय का कोई भी लेखा दाखिल करने में विफल रहे हैं ।
ः, जिला निर्वाचन अधिकारी, मधुबनी जिला, बिहार और मुख्य निर्वाचन अधिकारी, बिहार की रिपोर्टो के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम 1961 के नियम 89 के उप नियम (5) के अंतर्गत निर्वाचन व्यय प्रस्तुत नहीं करने के लिए को कारण बताओ नोटिस दिनांक 21 जनवरी, 2020 जारी किया गया था;
ः, निर्वाचनों का संचालन नियम 1961 के नियम 89 के उप-नियम (6) के अनुसार, दिनांक 21 जनवरी, 2020 के उपयुक्त कारण बताओ नोटिस के जरिए को निदेष दिया गया था कि वे इस नोटिस के प्राप्त होने के 20 दिनों के अंदर लेखे न प्रस्तुत कर पाने के कारणों को स्पश्ट करते हुए लिखित रूप में अपना अभ्यावेदन प्रस्तुत करें और साथ ही, निर्वाचन व्यय का अपना लेखा दाखिल करें;
ः, उक्त नोटिस द्वारा 16 फरवरी, 2020 को प्राप्त किया था। अभ्यर्थी से प्राप्त पावती रसीद जिला निर्वाचन अधिकारी, मधुबनी द्वारा अपने दिनांक 18 फरवरी, 2020 के पत्र सं0 238/जि.निर्वा., मधुबनी के जरिए आयोग को प्रस्तुत कर दी गई है ;
जिला निर्वाचन अधिकारी, मधुबनी द्वारा अपने दिनांक 29 जुलाई, 2020 के पत्र सं. 828/जि.निर्वा. के जरिए प्रस्तुत की गई अनुपूरक रिपोर्ट में यह बताया गया है कि ने आज की तारीख तक न तो कोई भी अभ्यावेदन और न ही अपने निर्वाचन व्यय का लेखा दाखिल किया है । इसके अतिरिक्त उन्होंने भारत निर्वाचन आयोग का सम्यक नोटिस मिलने के उपरांत भी उक्त विफलता के लिए न तो कोई कारण बताया है और न ही कोई स्पश्टीकरण दिया है ;
ः, आयोग का यह समाधान हो गया है कि निर्वाचन खर्चो का लेखा दाखिल करने मेें विफल रहे हैं और उनके पास इस विफलता के लिए कोई भी उचितकारण अथवा औचित्य नही है,
ः, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में अनुबंधित किया गया है कि :-
"यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति-
(i) निर्वाचन व्ययों का लेखा उस समय के भीतर और उस रीति में जैसी इस अधिनियम के द्वारा या अधीन उपेक्षित है, दाखिल करने में असफल रहा हैः तथा
(ii) उस असफलता के लिए कोई अच्छा कारण या न्यायोचित्य नहीं रखता है, तो निर्वाचन आयोग शासकीय राजपत्र में प्रकाषित आदेष द्वारा उसको निरर्हित घोशित करेगा और ऐसा व्यक्ति उस आदेष की तारीख से तीन वर्श की कालावधि के लिए निरर्हित होगा;
अतः, अब लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अनुसरण में भारत निर्वाचन आयोग एतद्द्वारा घोशणा करता है कि बिहार राज्य के लोकसभा निर्वाचन क्षेत्र से बिहार राज्य में लोक सभा के साधारण निर्वाचन, 2019 में निर्वाचन लडने वाले निर्दलीय अभ्यर्थी , निवासी ग्राम एवं पोस्ट आफिस बसैठ, प्रखण्ड-बेनीपट्टी, जिला-मधुबनी, बिहार, इस आदेष की तारीख से तीन वर्श की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य-क्षेत्र की विधान सभा अथवा विधान परिशद का सदस्य चुने जाने अथवा होने के लिए निरर्हित है ।

ORDER
New Delhi, the 8th February, 2021
O.N. 08.—WHEREAS, the General Election to Lok Sabha of Bihar, 2019 was announced by Election Commission of India vide Press Note No. ECI/PN/23/2019 dated 10th March, 2019. As per the schedule, Date of Counting was 23rd May, 2019.
[भाग II—खण्ड 3(iii)] भारत का राजपत्र : फरवरी 13, 2021/माघ 24, 1942 21AND WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate has to lodge a true copy of his account of election expenses within 30 days with the District Election Officer, from the date of election of returned candidate;
AND WHEREAS, the result of the said election was declared by the concerned Returning Officer including 06-Madhubani Parliamentary Constituency on 23rd May, 2019. As such the last date for lodging of account of election expenses was 22nd June, 2019.
AND WHEREAS, as per the report dated 29th June, 2019 submitted by the District Election Officer, Madhubani District, Bihar and forwarded by Chief Electoral Officer, Bihar vide letter No.Exp-09/2019(Part-26)-5756, dated 9th July, 2019, Shri Anil Kumar Sah, Independent contesting candidate from 06-Madhubani Parliamentary Constituency of Bihar, has failed to lodge any account of his election expenses as required by law.
AND WHEREAS, on the basis of the reports of the District Election Officer, Madubani District, Bihar and the Chief Electoral Officer, Bihar, a Show Cause Notice, dated 21st January, 2020 was issued by Election Commission of India under Sub Rule (5) of Rule 89 of the Conduct of Election Rules, 1961 to Shri Anil Kumar Sah for non- submission of Election expenses;
AND WHEREAS, as per Sub Rule (5) of Rule 89 of the Conduct of Election Rules, 1961, through the above said Show Cause Notice, dated 21st January, 2020, Shri Anil Kumar Sah was directed to submit his representation in writing in the Commission explaining the reason for non-submission of accounts and also to lodge his accounts of election expenses/rectify the defects in his accounts and submit the same the District Election Officer concerned within 20 days from the date of receipt of the notice;
AND WHEREAS, the said notice was received by Shri Anil Kumar Sah on 16th February, 2020. Acknowledgment receipt obtained from the candidate have been submitted to the Commission by District Election Officer, Madhubani vide his letter No. 238/जि0निर्वा0 मधुबनी dated 18th February, 2020.
AND WHEREAS, in the supplementary report submitted by District Election Officer, Madhubani vide his letter No. 828/जि0निर्वा0 dated 29th July, 2020 has stated that Shri Anil Kumar Sah, has not submitted any representation or his account of election expenses, duly signed along with original vouchers etc. till date. Further, he has furnished neither any reason nor explanation for the said failure even after receipt of the due notice to the Election Commission of India as well;
AND WHEREAS, the Commission satisfied that Shri Anil Kumar Sah has failed to lodge an account of election expenses and has no good reason or justification for the failure;
AND WHEREAS, Section 10A of the Representation of the People Act, 1951 stipulates that:-
"If the Election Commission is satisfied that a person:
(a) Has failed to lodge an account of election expenses within the time and in the manner required by law or under this Act, and
(b) Has no good reason or justification for the failure the Election Commission shall by order published in the Official Gazette, declare him to be disqualified and any such person shall be disqualified for a period of three years from date of the under;
NOW THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission of India hereby declares Shri Anil Kumar Sah, resident of Village and Post Office Basath, Block- Benipatti, District-Madhubani, Bihar and the contesting Independent candidate for General Election to Lok Sabha of Bihar, 2019 from 06-Madhubani Parliamentary Constituency of the state of Bihar to be disqualified for being chosen as and for being a member of either House of Parliament or the Legislative Parliamentary or legislative Council of a State or Union Territory for a period of three years from the date of this order.
