आ.अ. 9.— यतः, निर्वाचन आयोग का यह समाधान हो गया है कि नीचे तालिका के स्तंभ (2) में यथा-विनिर्दिष्ट विधान सभा के साधारण निर्वाचन, 2018 में तालिका के स्तंभ (4) में विनिर्दिष्ट निर्वाचन लड़ने वाले प्रत्येक अभ्यर्थी, जो तालिका के स्तंभ (3) में अपने नाम के सामने निर्वाचन-क्षेत्र से निर्वाचन लड़े थे, लोक प्रतिनिधित्व अधिनियम, 1951 तथा उसके अधीन बनाए गए नियमों और आदेश के अन्तर्गत यथापेक्षित रीति जैसा कि उक्त सारणी के स्तम्भ (5) में दर्शाया गया है, से अपने निर्वाचन व्यय का लेखा दाखिल करने में विफल रहे हैं; और

यतः, उक्त अभ्यर्थियों ने निर्वाचन आयोग द्वारा सम्यक् नोटिस दिए जाने के बावजूद, उक्त विफलता के लिए कोई कारण व स्पष्टीकरण नहीं दिया है और निर्वाचन आयोग का यह समाधान हो गया है कि उक्त विफलता के लिए उनके पास कोई उपयुक्त या न्यायोचित कारण नहीं है;

O.N. 9.—Whereas, the Election Commission is satisfied that each of the contesting candidates specified in column (4) of the Table below at the General Election to the Legislative Assembly, 2018 as specified in Column (2) held from the constituency specified in column (3) against his/her name, has failed to lodge an account of election expenses as required by the Representation of the People Act, 1951 and Rules and Order made there under; as shown in column (5) of the said Table; and

Whereas, the said candidates have not furnished any reason or explanation for the said failure even after due notice and the Election Commission is thus satisfied that they have no good reason or justification for the said failure;

Now, therefore, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission hereby declares the persons specified in column (4) of the table below to be disqualified for being chosen as, and for being, a member of either House of the Parliament or of the Legislative Assembly or Legislative Council of a State for a period of three years from the date of this order: -

यतः भारत निर्वाचन आयोग द्वारा बिहार राज्य से लोक सभा का साधारण निर्वाचन 2019 की घोशणा प्रेस नोट संख्या ईसीआई/प्रे.नो./23/2019 दिनांक 10 मार्च, 2019 के जरिए की गई थी । कार्यक्रम के अनुसार, मतगणना की तारीख 23 मई, 2019 थी ।

लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 78 के अनुसार, निर्वाचन लडने वाले प्रत्येक अभ्यर्थी को, निर्वाचित अभ्यर्थी के निर्वाचन की तारीख से 30 दिनों के भीतर निर्वाचन व्यय के अपने लेखे की सही प्रति जिला निर्वाचन अधिकारी को दाखिल करनी होती है ः, 28-मुंगेर लोक सभा निर्वाचन क्षेत्र सहित संबंधित रिटर्निग अधिकारी द्वारा उक्त निर्वाचन के परिणाम 23 मई, 2019 को घोशित किए गए थे । इस प्रकार, निर्वाचन व्यय के लेखे दाखिल करने की अंन्तिम तारीख 22 जून, 2019 थी;

ः, जिला निर्वाचन अधिकारी, मुंगेर जिला, बिहार द्वारा प्रस्तुत और मुख्य निर्वाचन अधिकारी, बिहार द्वारा अपने दिनांक 29 जून, 2019 के पत्र सं. Exp-09/2019/(Part-28)-5873 के जरिए अग्रेशित दिनांक 16 जुलाई, 2019 की रिपोर्ट के अनुसार , जो बिहार के 28- लोकसभा निर्वाचन क्षेत्र से निर्वाचन लडने वाले झारखण्ड मुक्ति मोर्चा अभ्यर्थी हैं, विधि द्वारा यथापेक्षित रीति से अपने निर्वाचन व्यय का कोई भी लेखा दाखिल करने में विफल रहे है ।

ः, जिला निर्वाचन अधिकारी, मुंगेर जिला, बिहार और मुख्य निर्वाचन अधिकारी, बिहार की रिपोर्टो के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम 1961 के नियम 89 के उप नियम (5) के अंतर्गत निर्वाचन व्यय प्रस्तुत नहीं करने के लिए को कारण बताओ नोटिस दिनांक 4 फरवरी, 2020 जारी किया गया था;

ः, निर्वाचनों का संचालन नियम 1961 के नियम 89 के उप-नियम (6) के अनुसार, दिनांक 4 फरवरी, 2020 के उपयुक्त कारण बताओ नोटिस के जरिए को निदेष दिया गया था कि वे इस नोटिस के प्राप्त होने के 20 दिनों के अंदर लेखे न प्रस्तुत कर पाने के कारणों को स्पश्ट करते हुए लिखित रूप में अपना अभ्यावेदन प्रस्तुत करें और साथ ही, निर्वाचन व्यय का अपना लेखा दाखिल करें;

ः, उक्त नोटिस द्वारा 27 फरवरी, 2020 को प्राप्त किया था। अभ्यर्थी से प्राप्त पावती रसीद जिला निर्वाचन अधिकारी, मुंगेर द्वारा अपने दिनांक 22 सितम्बर, 2020 के पत्र सं0 796, मुंगेर के जरिए आयोग को प्रस्तुत कर दी गई है ;

जिला निर्वाचन अधिकारी, मुंगेर द्वारा अपने दिनांक 23 जुलाई, 2020 के पत्र सं0 390/निर्वा0 के जरिए प्रस्तुत की गई अनुपूरक रिपोर्ट में यह बताया गया है कि ने आज की तारीख तक न तो कोई भी अभ्यावेदन और न ही अपने निर्वाचन व्यय का लेखा दाखिल किया है । इसके अतिरिक्त उन्होंने भारत निर्वाचन आयोग का सम्यक नोटिस मिलने के उपरांत भी उक्त विफलता के लिए न तो कोई कारण बताया है और न ही कोई स्पश्टीकरण दिया है ;

ः, आयोग का यह समाधान हो गया है कि निर्वाचन खर्चो का लेखा दाखिल करने मेें विफल रहे हैं और उनके पास इस विफलता के लिए कोई भी उचितकारण अथवा औचित्य नहीं है,

ः, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में अनुबंधित किया गया है कि :-

"यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति-

(i) निर्वाचन व्ययों का लेखा उस समय के भीतर और उस रीति में जैसी इस अधिनियम के द्वारा या अधीन

उपेक्षित है, दाखिल करने में असफल रहा हैः तथा

(ii) उस असफलता के लिए कोई अच्छा कारण या न्यायोचित्य नहीं रखता है, तो निर्वाचन आयोग शासकीय

राजपत्र में प्रकाषित आदेष द्वारा उसको निरर्हित घोशित करेगा और ऐसा व्यक्ति उस आदेष की तारीख से

तीन वर्श की कालावधि के लिए निरर्हित होगा;

अतः, अब लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अनुसरण में भारत निर्वाचन आयोग एतद्‌द्वारा घोशणा करता है कि बिहार राज्य के 28- लोकसभा निर्वाचन क्षेत्र से बिहार राज्य में लोक सभा के साधारण निर्वाचन, 2019 में निर्वाचन लडने वाले झारखण्ड मुक्ति मोर्चा , इस आदेष की अभ्यर्थी तारीख से तीन वर्श की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संध राज्य-क्षेत्र की विधान सभा अथवा विधान परिशद का सदस्य चुने जाने अथवा होने के लिए निरर्हित है ।

ORDER

New Delhi, the 17th February, 2021

O.N. 10.—WHEREAS, the General Election to Lok Sabha of Bihar, 2019 was announced by Election Commission of India vide Press Note No. ECI/PN/23/2019 dated 10th March, 2019. As per the schedule, Date of Counting was 23rd May, 2019.

AND WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate has to lodge a true copy of his account of election expenses within 30 days with the District Election Officer, from the date of election of returned candidate;

AND WHEREAS, the result of the said election was declared by the concerned Returning Officer including 28- Munger Parliamentary Constituency on 23rd May, 2019. As such the last date for lodging of account of election expenses was 22nd June, 2019.

AND WHEREAS, as per the report dated 29th June, 2019 submitted by the District Election Officer, Munger District, Bihar and forwarded by Chief Electoral Officer, Bihar vide letter No.Exp-09/2019(Part-28)-5873, dated 16th July, 2019, Shri Ajit Kumar, Jharkhand Mukti Morcha contesting candidate from 28-Munger Parliamentary Constituency of Bihar, has failed to lodge any account of his election expenses as required by law.

AND WHEREAS, on the basis of the reports of the District Election Officer, Munger District, Bihar and the Chief Electoral Officer, Bihar, a Show Cause Notice, dated 4th February, 2020 was issued by Election Commission of India under Sub Rule (5) of Rule 89 of the Conduct of Election Rules,1961 to Shri Ajit Kumar for non-submission of Election expenses;

AND WHEREAS, as per Sub Rule(5) of Rule 89 of the Conduct of Election Rules, 1961, through the above said Show Cause Notice, dated 4th February, 2020, Shri Ajit Kumar was directed to submit his representation in writing in the Commission explaining the reason for non-submission of accounts and also to lodge his accounts of election expenses/rectify the defects in his accounts and submit the same the District Election Officer concerned within 20 days from the date of receipt of the notice;

AND WHEREAS, the said notice was received by Shri Ajit Kumar on 27th February, 2020. Acknowledgment receipt obtained from the candidate have been submitted to the Commission by District Election Officer, Munger vide his letter No.796 dated 22nd September, 2020.

AND WHEREAS, in the supplementary report submitted by District Election Officer, Munger vide his letter No.390/fu0 dated 23rd July, 2020 has stated that Shri Ajit Kumar, has not submitted any representation or his account of election expenses, duly signed along with original vouchers etc. till date. Further, he has furnished neither any reason nor explanation for the said failure even after receipt of the due notice to the Election Commission ofI ndia as well;

AND WHEREAS, the Commission satisfied that Shri Ajit Kumar has failed to lodge an account of election expenses and has no good reason or justification for the failure;

AND WHEREAS, Section 10A of the Representation of the People Act, 1951 stipulates that:-

"If the Election Commission is satisfied that a person:

(a) Has failed to lodge an account of election expenses within the time and in the manner required by law or under this Act, and

(b) Has no good reason or justification for the failure the Election Commission shall by order published in the Official Gazette, declare him to be disqualified and any such person shall be disqualified for a period of three years from date of the under;

NOW THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission of India hereby declares Shri Ajit Kumar, resident of Village-Kala Tola, Bariyarpur Post+P.S.- Bariyarpur, District-Munger, Bihar 811211 and the contesting Jharkhand Mukti Morcha candidate for General Election to Lok Sabha of Bihar, 2019 from 28-Munger Parliamentary Constituency of the state of Bihar to be disqualified for being chosen as and for being a member of either House of Parliament or the Legislative Parliamentary or legislative Council of a State or Union Territory for a period of three years from the date of this order.

आ.अ. 11.— लोक प्रतिनिधित्व अधिनियम, 1950 (1950 का 43) की धारा 13-क की उप-धारा (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए भारत निर्वाचन आयोग महाराष्ट्र राज्य सरकार के परामर्श से एतद्द्वारा, श्री बलदेव सिंह, आई.ए.एस. के स्थान पर श्री एस. एम. देशपांडे, आई. ए. एस. (एम एचः 1991) को उनके कार्यभार ग्रहण करने की तारीख से आगामी आदेशों तक के लिए महाराष्ट्र राज्य के मुख्य निर्वाचन अधिकारी के रूप में नामित करता है।

2. श्री एस. एम. देशपांडे, महाराष्ट्र सरकार के अधीन सभी पदभार या किसी कार्य के पदभारों को तत्काल सौंप देंगे या धारण करना समाप्त कर देंगे, जो कि वे ऐसा पदभार ग्रहण करने से पहले धारण कर रहे थे।

3. श्री एस. एम. देशपांडे, मुख्य निर्वाचन अधिकारी, महाराष्ट्र के रूप में कार्य करते हुए महाराष्ट्र सरकार के अधीन किसी भी प्रकार का कोई अतिरिक्त कार्यभार ग्रहण नहीं करेंगे सिवाय इसके कि उनको राज्य सचिवालय में निर्वाचन विभाग के प्रभारी, सरकार के सचिव पदाभिहित किया जाएगा।

O.N. 11.— In exercise of the powers conferred by sub-section (1) of section 13A of the Representation of the People Act, 1950 (43 of 1950), the Election Commission of India in consultation with the Government of Maharashtra hereby designates Shri S. M. Deshpande, IAS (MH:1991) as the Chief Electoral Officer for the State of Maharashtra with effect from the date he takes over charge and until further orders in place of Shri Baldev Singh, IAS.

2. Shri S. M. Deshpande shall cease to hold and hand over forthwith the charge of all or any charges of work under the Government of Maharashtra, which he may be holding before such assumption of office.

3. Shri S. M. Deshpande while functioning as the Chief Electoral Officer, Maharashtra shall not hold any additional charge whatsoever under the Government of Maharashtra except that he should be designated Secretary to the Government in charge of Election Department in the State Secretariat.
