आ.अ. 21.—यतः भारत निर्वाचन आयोग द्वारा बिहार राज्य से लोक सभा का साधारण निर्वाचन 2019 की घोशणा प्रेस नोट संख्या ईसीआई/प्रे.नो./23/2019 दिनांक 10 मार्च, 2019 के जरिए की गई थी । अनुसूची के अनुसार मतगणना की तारीख 23 मई, 2019 थीं ।
और यतः लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 78 के अनुसार, निर्वाचन लड़ने वाले प्रत्येक अभ्यर्थी को, निर्वाचित अभ्यर्थी के निर्वाचन की तारीख से 30 दिनों के भीतर निर्वाचन व्यय के अपने लेखे की सही प्रति जिला निर्वाचन अधिकारी को दाखिल करनी होती है
और यतः 02-पष्चिम चम्पारण लोक सभा निर्वाचन क्षेत्र सहित संबंधित रिटर्निग अधिकारी द्वारा उक्त निर्वाचन के परिणाम 23 मई, 2019 को घोशित किए गए थे । इस प्रकार, निर्वाचन व्यय के लेखे दाखिल करने की अंन्तिम तारीख 22 जून, 2019 थी,
और यतः, जिला निर्वाचन अधिकारी सह जिला पदाधिकारी, पश्चिम चम्पारण, बेतिया, बिहार द्वारा प्रस्तुत और मुख्य निर्वाचन अधिकारी, बिहार द्वारा अपने 5 जुलाई, 2019 के पत्र सं. EXP-09/2019(Part-26)-5704 के जरिए अग्रेशित दिनांक 25 जून, 2019 की रिपोर्ट के अनुसार

(49)50 THE GAZETTE OF INDIA : MARCH 6, 2021/PHALGUNA 15, 1942 [PART II—SEC. 3(iii)] श्री राकेश कुमार जो बिहार के 02-पश्चिम चम्पारण संसदीय निर्वाचन क्षेत्र से निर्वाचन लड़ने वाले बहुजन समाज पार्टी के अभ्यर्थी हैं, विधि द्वारा यथापेक्षित रीति से अपने निर्वाचन व्यय का कोई भी लेखा दाखिल करने में विफल रहे है।
और यतः, जिला निर्वाचन अधिकारी, पश्चिम चम्पारण जिला, बिहार और मुख्य निर्वाचन अधिकारी, बिहार की रिपोर्टों के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम 1961 के नियम 89 के उप नियम (5) के अंतर्गत निर्वाचन व्यय प्रस्तुत नहीं करने के लिए श्री राकेश कुमार, को कारण बताओ नोटिस दिनांक 12 फरवरी, 2020 जारी किया गया था;
और यतः, निर्वाचनों का संचालन नियम 1961 के नियम 89 के उप-नियम (5) के अनुसार, दिनांक 12 फरवरी, 2020 के उपयुक्त कारण बताओ नोटिस के जरिए श्री राकेश कुमार, को निदेश दिया गया था कि वे इस नोटिस के प्राप्त होने के 20 दिनों के अंदर लेखे न प्रस्तुत कर पाने के कारणों को स्पश्ट करते हुए लिखित रूप में अपना अभ्यावेदन प्रस्तुत करें और साथ ही, निर्वाचन व्यय का अपना लेखा दाखिल करें;
और यतः, उक्त नोटिस श्री राकेश कुमार द्वारा 09 मार्च, 2020 को प्राप्त किया था । अभ्यर्थी से प्राप्त पावती रसीद जिला निर्वाचन अधिकारी, पश्चिम चम्पारण, बेतिया द्वारा अपने दिनांक 21 अप्रैल, 2020 के पत्र सं. 274/निर्वा0 के जरिए आयोग को प्रस्तुत कर दी गई है :
और यतः, जिला निर्वाचन अधिकारी सह जिला पदाधिकारी द्वारा अपने 21 अप्रैल, 2020 के पत्र सं0 274/निर्वा0 के जरिए प्रस्तुत की गई अनुपूरक रिपोर्ट में यह बताया गया है कि श्री राकेश कुमार ने आज की तारीख तक न तो कोई भी अभ्यावेदन और न ही अपने निर्वाचन व्यय का लेखा दाखिल किया है । इसके अतिरिक्त उन्होंने भारत निर्वाचन आयोग का सम्यक नोटिस मिलने के उपरांत भी उक्त विफलता के लिए न तो कोई कारण बताया है और न ही कोई स्पश्टीकरण दिया है ;
और यतः, आयोग का यह समाधान हो गया है कि श्री राकेश कुमार निर्वाचन खर्चो का लेखा दाखिल करने में विफल रहे हैं और उनके पास इस विफलता के लिए कोई भी उचितकारण अथवा औचित्य नहीं है,
और यतः, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में अनुबंधित किया गया है कि :-
"यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति-
i. निर्वाचन व्ययों का लेखा उस समय के भीतर और उस रीति में जैसी इस अधिनियम के द्वारा या अधीन उपेक्षित है, दाखिल करने में असफल रहा हैः तथा
ii. उस असफलता के लिए कोई अच्छा कारण या न्यायोचित्य नहीं रखता है, तो निर्वाचन आयोग शासकीय राजपत्र में प्रकाषित आदेष द्वारा उसको निरर्हित घोशित करेगा और ऐसा व्यक्ति उस आदेष की तारीख से तीन वर्श की कालावधि के लिए निरर्हित होगा;
अतः, अब लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अनुसरण में भारत निर्वाचन आयोग एतद्द्वारा घोशणा करता है कि बिहार राज्य के 02-पष्चिम चम्पारण संसदीय निर्वाचन क्षेत्र से बिहार राज्य में लोक सभा के साधारण निर्वाचन, 2019 में निर्वाचन लडने वाले बहुजन समाज पार्टी के अभ्यर्थी श्री राकेष कुमार, निवासी हरिवाटिका, पोखरा, बेतिया, पो. बेतिया, जिला-पष्चिम चम्पारण, बिहार, इस आदेष की तारीख से तीन वर्श की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संध राज्य-क्षेत्र की विधान सभा अथवा विधान परिशद का सदस्य चुने जाने अथवा होने के लिए निरर्हित है ।

New Delhi, the 1st March, 2021
O.N. 21.—WHEREAS, the General Election to Lok Sabha of Bihar, 2019 was announced by Election Commission of India vide Press Note No. ECI/PN/23/2019 dated 10thMarch, 2019. As per the schedule, Date of Counting was 23rd May, 2019.
AND WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate has to lodge a true copy of his account of election expenses within 30 days with the District Election Officer, from the date of election of returned candidate;
AND WHEREAS, the result of the said election was declared by the concerned Returning Officer including 02-Paschim Champaran Parliamentary Constituency on 23rd May, 2019. As such the last date for lodging of account of election expenses was 22nd June, 2019.
[भाग II—खण्ड 3(iii)] भारत का राजपत्र : मार्च6, 2021/फाल्गुन 15, 1942 51AND WHEREAS, as per the report dated 25th June, 2019 submitted by the District Election Officer, Paschim Champaran, Bettiah District, forwarded by Chief Electoral Officer, Bihar vide letter No. EXP-09/2019 (Part-26)-5704, dated 5th July, 2019, Shri Rakesh Kumar contesting candidate of Bahujan Samaj Party from 02-Paschim Champaran Parliamentary Constituency of Bihar, has failed to lodge any account of his election expenses as required by law.
AND WHEREAS, on the basis of the reports of the District Election Officer, Paschim Champaran District, Bihar and the Chief Electoral Officer, Bihar a Show Cause Notice dated 12th February, 2020 was issued by Election Commission of India under Sub Rule (5) of Rule 89 of the Conduct of Election Rules, 1961 to Shri Rakesh Kumar for non-submission of Election expenses;
AND WHEREAS, as per Sub Rule(5) of Rule 89 of the Conduct of Election Rules, 1961, through the above said Show Cause Notice, dated 12th February, 2020, Shri Rakesh Kumar was directed to submit his representation in writing in the Commission explaining the reason for non-submission of accounts and also to lodge his accounts of election expenses/rectify the defects in his accounts and submit the same the District Election Officer concerned within 20 days from the date of receipt of the notice;
AND WHEREAS, the said notice was received by Shri Rakesh Kumar on 9th March, 2020. Acknowledgment receipt obtained from the candidate have been submitted to the Commission by District Election Officer, Paschim Champaran, Bettiah vide his letter 274/Ele-dated 21st April, 2020.
AND WHEREAS, in the supplementary report submitted by District Election Officer, Bilaspur vide his letter No. 274/निर्वा. dated dated 21st April, 2020 has stated that Shri Rakesh Kumar has not submitted any representation or his account of election expenses, duly signed along with original vouchers etc. till date. Further, he has furnished neither any reason nor explanation for the said failure even after receipt of the due notice to the Election Commission of India as well;
AND WHEREAS, the Commission satisfied that Shri Rakesh Kumar failed to lodge an account of election expenses and has no good reason or justification for the failure;
AND WHEREAS, Section 10A of the Representation of the People Act, 1951 stipulates that :-
''If the Election Commission is satisfied that a person:
(a) Has failed to lodge an account of election expenses within the time and in the manner required by law or under this Act, and
(b) Has no good reason or justification for the failure the Election Commission shall by order published in the Official Gazette, declare him to be disqualified and any such person shall be disqualified for a period of three years from date of the order;
NOW THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission of India hereby declares Sh Rakesh Kumar, R/o Hariwatika, Pokhra, Bettiah, Post-Bettiah, Dist- West Champaran and the contesting candidate of Bahujan Samaj Party for General Election to Lok Sabha of Bihar 2019 from 02-Paschim Champaran Parliamentary Constituency of the state of Bihar to be disqualified for being chosen as and for being a member of either House of Parliament or the Legislative Parliamentary or legislative Council of a State or Union Territory for a period of three years from the date of this order.

52 THE GAZETTE OF INDIA : MARCH 6, 2021/PHALGUNA 15, 1942 [PART II—SEC. 3(iii)]और यतः, जिला निर्वाचन अधिकारी, बलरामपुर छत्तीसगढ़ द्वारा प्रस्तुत और मुख्य निर्वाचन अधिकारी, छत्तीसगढ़ द्वारा अपने दिनांक 29 जनवरी, 2019 के पत्र सं. 21/चार/वि.स.चु./ई.ई.एम/2019/85 के जरिए अग्रेशित दिनांक 15 जनवरी, 2019 की रिपोर्ट के अनुसार श्री श्यामलाल मरकाम जो छत्तीसगढ़ के 7-रामानुजगंज विधान सभा निर्वाचन क्षेत्र से निर्वाचन लडने वाले निर्दलीय अभ्यर्थी हैं, विधि द्वारा यथापेक्षित रीति से अपने निर्वाचन व्यय का कोई भी लेखा दाखिल करने में विफल रहे है ।

[भाग II—खण्ड 3(iii)] भारत का राजपत्र : मार्च6, 2021/फाल्गुन 15, 1942 53ई.एम./2019/85, dated 29th January, 2019, Sh. Shyamlal Markam Independent contesting candidate from 7-Ramanujganj Assembly Constituency of Chhattisgarh, has failed to lodge any account of his election expenses as required by law.
AND WHEREAS, on the basis of the reports of the District Election Officer, Balrampur District, Chhattisgarh and the Chief Electoral Officer, Chhattisgarh, a Show Cause Notice, dated 23rd August, 2019 was issued by Election Commission of India under Sub Rule (5) of Rule 89 of the Conduct of Election Rules,1961 to, Sh. Shyamlal Markam,for non-submission of Election expenses;
AND WHEREAS, as per Sub Rule(5) of Rule 89 of the Conduct of Election Rules, 1961, through the above said Show Cause Notice, dated 23rd August, 2019, Sh. और यतः, जिला निर्वाचन अधिकारी, बलरामपुर छत्तीसगढ़ द्वारा प्रस्तुत और मुख्य निर्वाचन अधिकारी, छत्तीसगढ़ द्वारा अपने दिनांक 29 जनवरी, 2019 के पत्र सं. 21/चार/वि.स.चु./ई.ई.एम/2019/85 के जरिए अग्रेशित दिनांक 15 जनवरी, 2019 की रिपोर्ट के अनुसार श्री दयानन्द सिंह जो छत्तीसगढ़ के 7-रामानुजगंज विधान सभा निर्वाचन क्षेत्र से निर्वाचन लडने वाले निर्दलीय अभ्यर्थी हैं, विधि द्वारा यथापेक्षित रीति से अपने निर्वाचन व्यय का कोई भी लेखा दाखिल करने में विफल रहे है ।
और यतः, जिला निर्वाचन अधिकारी, बलरामपुर जिला, छत्तीसगढ़ और मुख्य निर्वाचन अधिकारी, छत्तीसगढ़ की रिपोर्टो के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम 1961 के नियम 89 के उप नियम (5) के अंतर्गत निर्वाचन व्यय प्रस्तुत नहीं करने के लिए श्री दयानन्द सिंह को कारण बताओ नोटिस दिनांक 23 अगस्त, 2019 को जारी किया गया था;
और यतः, निर्वाचनों का संचालन नियम 1961 के नियम 89 के उप-नियम (6) के अनुसार, दिनांक 23 अगस्त, 2019 के उपयुक्त कारण बताओ नोटिस के जरिए श्री दयानन्द सिंह को निदेष दिया गया था कि वे इस नोटिस के प्राप्त होने के 20 दिनों के अंदर लेखे न प्रस्तुत कर पाने के कारणों को स्पश्ट करते हुए लिखित रूप में अपना अभ्यावेदन प्रस्तुत करें और साथ ही, निर्वाचन व्यय का अपना लेखा दाखिल करें;
और यतः, उक्त नोटिस श्री दयानन्द सिंह द्वारा दिनांक 11 सितम्बर, 2020 को प्राप्त किया था। अभ्यर्थी से प्राप्त पावती रसीद जिला निर्वाचन अधिकारी, बलरामपुर द्वारा अपने दिनांक 6 अक्तूबर, 2020 के पत्र सं0 838/निर्वा.स्था./2020 के जरिए आयोग को प्रस्तुत कर दी गई है ;
और यतः, जिला निर्वाचन अधिकारी, बलरामपुर द्वारा अपने दिनांक 6 अक्तूबर, 2020 के पत्र सं0 838/निर्वा.स्था./2020 के जरिए प्रस्तुत की गई अनुपूरक रिपोर्ट में यह बताया गया है कि श्री दयानन्द सिंह ने आज की तारीख तक न तो कोई भी अभ्यावेदन और न ही अपने निर्वाचन व्यय का लेखा दाखिल किया है । इसके अतिरिक्त उन्होंने भारत निर्वाचन आयोग का सम्यक नोटिस मिलने के उपरांत भी उक्त विफलता के लिए न तो कोई कारण बताया है और न ही कोई स्पश्टीकरण दिया है ;
और यतः, आयोग का यह समाधान हो गया है कि श्री दयानन्द सिंह निर्वाचन खर्चो का लेखा दाखिल करने मेें विफल रहे हैं और उनके पास इस विफलता के लिए कोई भी उचितकारण अथवा औचित्य नही है,
और यतः, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में अनुबंधित किया गया है कि :-
"यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति-
(i) निर्वाचन व्ययों का लेखा उस समय के भीतर और उस रीति में जैसी इस अधिनियम के द्वारा या अधीन उपेक्षित है, दाखिल करने में असफल रहा हैः तथा
(ii) उस असफलता के लिए कोई अच्छा कारण या न्यायोचित्य नहीं रखता है, तो निर्वाचन आयोग शासकीय राजपत्र में प्रकाषित आदेष द्वारा उसको निरर्हित घोशित करेगा और ऐसा व्यक्ति उस आदेष की तारीख से तीन वर्श की कालावधि के लिए निरर्हित होगा;
अतः, अब लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अनुसरण में भारत निर्वाचन आयोग एतद्द्वारा घोशणा करता है कि छत्तीसगढ़ राज्य 7-रामानुजगंज विधान सभा निर्वाचन क्षेत्र से छत्तीसगढ राज्य में विधान सभा के साधारण निर्वाचन, 2018 में निर्वाचन लडने वाले निर्दलीय अभ्यर्थी श्री दयानन्द सिंह, ग्राम-इन्दावतीपुर, पोस्ट व थाना-सनावल, तहसील-रामानुजगंज, जिला-बलरामपुर, रामानुजगंज, छत्तीसगढ़ को इस आदेष की तारीख से तीन वर्श की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संध राज्य-क्षेत्र की विधान सभा अथवा विधान परिशद का सदस्य चुने जाने अथवा होने के लिए निरर्हित है ।

O.N. 23.— WHEREAS, the General Election to Legislative Assembly of Chhattisgarh, 2018 was announced by Election Commission of India vide Press Note No. ECI/PN/66/2018 dated 6th October, 2018. As per the schedule, Date of Counting was 11th December, 2018.
AND WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate has to lodge a true copy of his account of election expenses within 30 days with the District Election Officer, from the date of election of returned candidate;
AND WHEREAS, the result of the said election was declared by the concerned Returning Officer including 7-Ramanujganj Constituency on 11th December, 2018. As such the last date for lodging of account of election expenses was 10th January, 2019.

Dayanand Singh. Independent contesting candidate from 7-Ramanujganj Assembly Constituency of Chhattisgarh, has failed to lodge any account of his election expenses as required by law.
AND WHEREAS, on the basis of the reports of the District Election Officer, Balrampur District, Chhattisgarh and the Chief Electoral Officer, Chhattisgarh, a Show Cause Notice, dated 23rd August, 2019 was issued by Election Commission of India under Sub Rule (5) of Rule 89 of the Conduct of Election Rules,1961 to, Sh. Dayanand Singh, for non-submission of Election expenses;
AND WHEREAS, as per Sub Rule(5) of Rule 89 of the Conduct of Election Rules, 1961, through the above said Show Cause Notice, dated 23rd August, 2019, Sh. Dayanand Singh, was directed to submit his representation in writing in the Commission explaining the reason for non-submission of accounts and also to lodge his accounts of election expenses/rectify the defects in his accounts and submit the same the District Election Officer concerned within 20 days from the date of receipt of the notice;
AND WHEREAS, the said notice was received by Sh. Dayanand Singh, on 11th September, 2020. Acknowledgment receipt obtained from the candidate have been submitted to the Commission by District Election Officer, Balrampur vide his letter No.838/निर्वा.स्था./2020 dated 6th October, 2020.
AND WHEREAS, in the supplementary report submitted by District Election Officer, Balrampur vide his letter No. 838/निर्वा.स्था./2020 dated 6th October, 2020, has stated that Sh. Dayanand Singh, has not submitted any representation or his account of election expenses, duly signed along with original vouchers etc. till date. Further, he has furnished neither any reason nor explanation for the said failure even after receipt of the due notice to the Election Commission of India as well;
AND WHEREAS, the Commission satisfied that Sh. Dayanand Singh, has failed to lodge an account of election expenses and has no good reason or justification for the failure;
AND WHEREAS, Section 10A of the Representation of the People Act, 1951 stipulates that :-
"If the Election Commission is satisfied that a person:
(a) Has failed to lodge an account of election expenses within the time and in the manner required by law or under this Act, and
(b) Has no good reason or justification for the failure the Election Commission shall by order published in the Official Gazette, declare him to be disqualified and any such person shall be disqualified for a period of three years from date of the under;
NOW THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission of India hereby declares Sh. Dayanand Singh, resident of Village- Indrawatipur, Po-Sanawal Police Station-Sanawal, Tahsil-Ramanujganj, District-Balrmapur-Ramanujganj (C.G.) and the contesting Independent candidate for General Election to Legislative Assembly of Chhattisgarh, 2018 from 7-Ramanujganj Constituency of the state of Chhattisgarh to be disqualified for being chosen as and for being a member of either House of Parliament or the Legislative Parliamentary or legislative Council of a State or Union Territory for a period of three years from the date of this order.

और यतः, नजला निर्ााचि अनधकारी, बिलासपुर नजला, छत्तीसगढ़ और मुख्य निर्ााचि अनधकारी, छत्तीसगढ़ की ररपोटों के आधार पर भारत निर्ााचि आयोग द्वारा निर्ााचिों का संचालि नियम 1961 के नियम 89 के उप नियम (5) के अंतगात निर्ााचि व्यय प्रस्तुत िहीं करिे के नलए श्री संजय टण्डन को कारण बताओ िोनटस नििांक 30 जनवरी , 2020 जारी नकया गया था;
ाक्त कारण बताओ िोनटस और यतः, निर्ााचिों का संचालि नियम 1961 के नियम 89 के उप-नियम (6) के अिुसार, नििांक 8 अगस्त,2019 के उपयु
के जररए श्री संजय टण्डन को नििेश निया गया था नक र्े इस िोनटस के प्राप्त होिे के 20 नििों के अंिर लेखे ि प्रस्तुत कर पािे के कारणों को स्पष्ट करते हुए नलनखत रूप में अपिा अभ्यार्ेिि प्रस्तुत करें और साथ ही, निर्ााचि व्यय का अपिा लेखा िानखल करें;
और यतः, उक्त िोनटस श्री संजय टण्डन, द्वारा 01 जुलाई, 2020 को प्राप्त नकया था । अभ्यथी से प्राप्त पार्ती रसीि नजला निर्ााचि अनधकारी, बिलासपुर द्वारा अपिे नििांक 05 अगस्त, 2020 के पत्र संख्या नि. प. /वि. स. नि./व्यय लेखा /2020/182 के जररए आयोग को प्रस्तुत कर िी गई है;
और यतः, नजला निर्ााचि अनधकारी, बिलासपुर द्वारा अपिे नििांक 25 अगस्त, 2020 के पत्र संख्या नि. प. /वि. स. नि./व्यय लेखा /2020 के जररए प्रस्तुत की गई अिुपूरक ररपोटा में यह बताया गया है नक श्री संजय टण्डन िे आज की तारीख तक ि तो कोई भी अभ्यार्ेिि और ि ही अपिे निर्ााचि व्यय का लेखा िानखल नकया है । इसके अनतररक्त उतहोंिे भारत निर्ााचि आयोग का सम्यक िोनटस नमलिे के उपरांत भी उक्त नर्फलता के नलए ि तो कोई कारण बताया है और ि ही कोई स्पष्टीकरण निया है;
और यतः, आयोग का यह समाधाि हो गया है नक श्री संजय टण्डन निर्ााचि खचों का लेखा िानखल करि में नर्फल रहे हैं और उिके पास इस नर्फलता के नलए कोई भी उनचत कारण अथर्ा औनचत्य िहीं है,
और यत:, लोक प्रनतनिनधत्र् अनधनियम, 1951 की धारा 10क में अिुबंनधत नकया गया है नक :-
