के न्द्रीय अधिकारियों (संघ राज्यक्षेत्र प्रशासनों को छोड़कर) द्वारा जारी किए गए साधारण आदेश और अधिसूचनाएं Orders and Notifications issued by the Central Authorities (Other than the Administrations of Union Territories) नई दिल्ली, 8 मार्च, 2021 .-यतः भारत निर्वाचन आयोग द्वारा छत्तीसगढ़ राज्य से विधान सभा का साधारण निर्वाचन 2018 की घोशणा प्रेस नोट संख्या ईसीआई/प्रे.नो./66/2018 दिनांक 6 अक्टूबर, 2018 के जरिए की गई थी । कार्यक्रम के अनुसार, मतगणना की तारीख 11 दिसम्बर, 2018 थी ।

लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 78 के अनुसार, निर्वाचन लडने वाले प्रत्येक अभ्यर्थी को, निर्वाचित अभ्यर्थी के निर्वाचन की तारीख से 30 दिनों के भीतर निर्वाचन व्यय के अपने लेखे की सही प्रति जिला निर्वाचन अधिकारी को दाखिल करनी होती है ः, विधान सभा निर्वाचन क्षेत्र सहित संबंधित रिटर्निग अधिकारी द्वारा उक्त निर्वाचन के परिणाम 11 दिसम्बर, 2018 को घोशित किए गए थे । इस प्रकार, निर्वाचन व्यय के लेखे दाखिल करने की अंन्तिम तारीख 10 जनवरी, 2019 थी;

ः, जिला निर्वाचन अधिकारी, छत्तीसगढ़ द्वारा प्रस्तुत और मुख्य निर्वाचन अधिकारी, छत्तीसगढ़ द्वारा अपने दिनांक 29 जनवरी, 2019 के पत्र सं. 21/चार/वि.स.चु./ई.ई.एम/2019/85 के जरिए अग्रेशित दिनांक 11 जनवरी, 2019 की रिपोर्ट के अनुसार जो छत्तीसगढ़ के विधान सभा निर्वाचन क्षेत्र से निर्वाचन लडने वाले निर्दलीय अभ्यर्थी हैं, विधि द्वारा यथापेक्षित रीति से अपने निर्वाचन व्यय का कोई भी लेखा दाखिल करने में विफल रहे है ।

(59)⁶⁰ THE GAZETTE OF INDIA : MARCH ¹³, ²⁰²¹/PHALGUNA ²², ¹⁹⁴² [PART II—SEC. ³(iii)] ः, जिला निर्वाचन अधिकारी, जिला, छत्तीसगढ़ और मुख्य निर्वाचन अधिकारी, छत्तीसगढ़ की रिपोर्टो के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम 1961 के नियम 89 के उप नियम (5) के अंतर्गत निर्वाचन व्यय प्रस्तुत नहीं करने के लिए को कारण बताओ नोटिस दिनांक को जारी किया गया था;

ः, निर्वाचनों का संचालन नियम 1961 के नियम 89 के उप-नियम (6) के अनुसार, दिनांक के उपयुक्त कारण बताओ नोटिस के जरिए को निदेष दिया गया था कि वे इस नोटिस के प्राप्त होने के 20 दिनों के अंदर लेखे न प्रस्तुत कर पाने के कारणों को स्पश्ट करते हुए लिखित रूप में अपना अभ्यावेदन प्रस्तुत करें और साथ ही, निर्वाचन व्यय का अपना लेखा दाखिल करें;

ः, उक्त नोटिस द्वारा दिनांक को प्राप्त किया था। अभ्यर्थी से प्राप्त पावती रसीद जिला निर्वाचन अधिकारी, रायपुर द्वारा अपने दिनांक 2 सितम्बर, 2020 के पत्र सं0 8051/निर्वा./नि.प./2020 के जरिए आयोग को प्रस्तुत कर दी गई है ;

जिला निर्वाचन अधिकारी, द्वारा अपने दिनांक 2 सितम्बर, 2020 के पत्र सं0 8051/निर्वा./नि.प./2020 के जरिए प्रस्तुत की गई अनुपूरक रिपोर्ट में यह बताया गया है कि ने आज की तारीख तक न तो कोई भी अभ्यावेदन और न ही अपने निर्वाचन व्यय का लेखा दाखिल किया है । इसके अतिरिक्त उन्होंने भारत निर्वाचन आयोग का सम्यक नोटिस मिलने के उपरांत भी उक्त विफलता के लिए न तो कोई कारण बताया है और न ही कोई स्पश्टीकरण दिया है ;

ः, आयोग का यह समाधान हो गया है कि निर्वाचन खर्चो का लेखा दाखिल करने मेें विफल रहे हैं और उनके पास इस विफलता के लिए कोई भी उचितकारण अथवा औचित्य नही है,

ः, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में अनुबंधित किया गया है कि :-

"यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति-

(i) निर्वाचन व्ययों का लेखा उस समय के भीतर और उस रीति में जैसी इस अधिनियम के द्वारा या अधीन उपेक्षित है, दाखिल करने में असफल रहा हैः तथा

(ii) उस असफलता के लिए कोई अच्छा कारण या न्यायोचित्य नहीं रखता है, तो निर्वाचन आयोग शासकीय राजपत्र में प्रकाषित आदेष द्वारा उसको निरर्हित घोशित करेगा और ऐसा व्यक्ति उस आदेष की तारीख से तीन वर्श की कालावधि के लिए निरर्हित होगा;

अतः, अब लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अनुसरण में भारत निर्वाचन आयोग एतद्‌द्वारा घोशणा करता है कि छत्तीसगढ़ राज्य विधान सभा निर्वाचन क्षेत्र से छत्तीसगढ राज्य में विधान सभा के साधारण निर्वाचन, 2018 में निर्वाचन लडने वाले को इस आदेष की तारीख निर्दलीय अभ्यर्थी से तीन वर्श की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संध राज्य-क्षेत्र की विधान सभा अथवा विधान परिशद का सदस्य चुने जाने अथवा होने के लिए निरर्हित है ।

O. N. 25.—WHEREAS, the General Election to Legislative Assembly of Chhattisgarh, 2018 was announced by Election Commission of India vide Press Note No. ECI/PN/66/2018 dated 6th October, 2018. As per the schedule, Date of Counting was 11th December, 2018.

AND WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate has to lodge a true copy of his account of election expenses within 30 days with the District Election Officer, from the date of election of returned candidate;

AND WHEREAS, the result of the said election was declared by the concerned Returning Officer including 49-Raipur Nagar West Constituency on 11th December, 2018. As such the last date for lodging of account of election expenses was 10th January, 2019.

AND WHEREAS, as per the report dated 11th January, 2019 submitted by the District Election Officer, Raipur District, Chhattisgarh and forwarded by Chief Electoral Officer, Chhattisgarh vide letter No.21/4/LAEle./EEM/2019/85, dated 29th January, 2019, Pradeep Singh Thakur, contesting candidate of Shiv Sena from 49-Raipur Nagar West Assembly Constituency of Chhattisgarh, has failed to lodge any account of his election expenses as required by law.

AND WHEREAS, on the basis of the reports of the District Election Officer, Raipur District, Chhattisgarh and the Chief Electoral Officer, Chhattisgarh, a Show Cause Notice, dated 2nd March, 2020 was issued by Election Commission of India under Sub Rule (5) of Rule 89 of the Conduct of Election Rules,1961 to , Pradeep Singh Thakur,for non-submission of Election expenses;

AND WHEREAS, as per Sub Rule(5) of Rule 89 of the Conduct of Election Rules, 1961, through the above said Show Cause Notice, dated 2nd March, 2020, Pradeep Singh Thakur,was directed to submit his representation in writing in the Commission explaining the reason for non-submission of accounts and also to lodge his accounts of election expenses/rectify the defects in his accounts and submit the same the District Election Officer concerned within 20 days from the date of receipt of the notice;

AND WHEREAS, the said notice was received by Pradeep Singh Thakur,on 5th July, 2020, Acknowledgment receipt obtained from the candidate have been submitted to the Commission by District Election Officer, Raipur vide his letter No.8051/निर्वा./नि.प./2020 dated 2nd September, 2020.

AND WHEREAS, in the supplementary report submitted by District Election Officer, Raipur vide his letter No. 8051/निर्वा./नि.प./2020 dated 2nd September, 2020 has stated that Pradeep Singh Thakur, has not submitted any representation or his account of election expenses, duly signed along with original vouchers etc. till date. Further, he has furnished neither any reason nor explanation for the said failure even after receipt of the due notice to the Election Commission of India as well;

AND WHEREAS, the Commission satisfied that Pradeep Singh Thakur, has failed to lodge an account of election expenses and has no good reason or justification for the failure;

AND WHEREAS, Section 10A of the Representation of the People Act, 1951 stipulates that :-

"If the Election Commission is satisfied that a person:

(a) Has failed to lodge an account of election expenses within the time and in the manner required by law or under this Act, and

(b) Has no good reason or justification for the failure the Election Commission shall by order published in the Official Gazette, declare him to be disqualified and any such person shall be disqualified for a period of three years from date of the under;

NOW THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission of India hereby declares Pradeep Singh Thakur, resident of H.No 10/886 Naya Mangal Bazar, Gidiyari Raipur, Chhattisgarh and the contesting Contesting Candidate of Shiv Sena for General Election to Legislative Assembly of Chhattisgarh, 2018 from 49-Raipur Nagar West Assembly Constituency of the state of Chhattisgarh to be disqualified for being chosen as and for being a member of either House of Parliament or the Legislative Parliamentary or legislative Council of a State or Union Territory for a period of three years from the date of this order.

आ. अ. 29.—लोक प्रतिनिधित्व अधिनियम, 1950 (1950 का 43) की धारा 13-क की उप-धारा (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए भारत निर्वाचन आयोग त्रिपुरा राज्य सरकार के परामर्श से एतद्द्वारा, श्री श्रीराम तरनीकांति, आई.ए.एस. के स्थान पर श्रीमती सौम्या गुप्ता, आई.ए.एस. (टी.आर 2004) को उनके कार्यभार ग्रहण करने की तारीख से आगामी आदेशों तक के लिए त्रिपुरा राज्य के मुख्य निर्वाचन अधिकारी के रूप में नामित करता है।

2. श्रीमती सौम्या गुप्ता, त्रिपुरा सरकार के अधीन सभी पदभार या किसी कार्य के पदभारों को तत्काल सौंप देंगी या धारण करना समाप्त कर देंगी, जो कि वे ऐसा पदभार ग्रहण करने से पहले धारण कर रही थी।

3. श्रीमती सौम्या गुप्ता, मुख्य निर्वाचन अधिकारी,त्रिपुरा के रूप में कार्य करते हुए त्रिपुरा सरकार के अधीन किसी भी प्रकार का कोई अतिरिक्त कार्यभार ग्रहण नहीं करेंगी सिवाय इसके कि उनको राज्य सचिवालय में निर्वाचन विभाग के प्रभारी, सरकार के सचिव पदाभिहित किया जाएगा।

N. 29.—In exercise of the powers conferred by sub-section (1) of section 13A of the Representation of the People Act, 1950 (43 of 1950), the Election Commission of India in consultation with the Government of Tripura hereby designates Smt. Saumya Gupta, IAS, (TR:2004) as the Chief Electoral Officer for the State of Tripura with effect from the date she takes over charge and until further orders in place of Shri Sriram Taranikanti, IAS.

2. Smt. Saumya Gupta shall cease to hold and hand over forthwith the charge of all or any charges of work under the Government of Tripura, which she may be holding before such assumption of office.

3. Smt. Saumya Gupta while functioning as the Chief Electoral Officer, Tripura shall not hold any additional charge whatsoever under the Government of Tripura except that she should be designated Secretary to the Government in charge of Election Department in the State Secretariat.

(जी.जे.: 2000) को उनके कार्यभार ग्रहण करने की तारीख से आगामी आदेशों तक के लिए गुजरात राज्य के मुख्य निर्वाचन अधिकारी के रूप में नामित करता है।

2. श्री अनुपम आनन्द, गुजरात सरकार के अधीन सभी पदभार या किसी कार्य के पदभारों को तत्काल सौंप देंगे या धारण करना समाप्त कर देंगे, जो कि वे ऐसा पदभार ग्रहण करने से पहले धारण कर रहे थे।

Murali Krishna, IAS.

2. Shri Anupam Anand shall cease to hold and hand over forthwith the charge of all or any charges of work under the Government of Gujarat, which he may be holding before such assumption of office.

3. Shri Anupam Anand while functioning as the Chief Electoral Officer, Gujarat shall not hold any additional charge whatsoever under the Government of Gujarat except that he should be designated Secretary to the Government in charge of Election Department in the State Secretariat.
