आ.अ. 31.—यत:, वर्ष 2019 में आयोजित 1-पुदुच्चेरी संसदीय निर्वाचन क्षेत्र से लोक सभा के साधारण निर्वाचन, 2019 के लिए निर्वाचन लड़ने वाले अभ्यर्थी श्री एस. भास्करन, निवासी नंबर-51, सेकें ड क्रॉस, स्ट्रीट सेल्वा नगर, ऊरुवैयार पुदुच्चेरी-605110 को लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अंतर्गत आयोग के आदेश सं. 76/पीयूडीयू- एचपी/2019, दिनांक 6 दिसंबर, 2019 के तहत विधि द्वारा यथापेक्षित रूप में अपने निर्वाचन व्यय का लेखा दर्ज न करने के लिए 6 दिसंबर, 2019 से तीन वर्ष की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य क्षेत्र की विधान सभा अथवा विधान परिषद का सदस्य चुने जाने अथवा होने के लिए निरहित कर दिया गया था; और
यत:, अभ्यर्थी ने लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 11 के अंतर्गत निर्रहरता हटाने के लिए अपीलीय प्राधिकारी के समक्ष अपील (आयोग में 14 जुलाई, 2020 और 19 फरवरी 2021 को प्राप्त) की है, जिसमें निर्रहरता हटाए

जाने के कारणों का उल्लेख है; और यत: उक्त श्री एस. भास्करन वीडियो कांफ्रें स के माध्यम से 15 मार्च, 2021 को अपीलीय प्राधिकारी के समक्ष स्वयं उपस्थित हुए थे और निर्रहरता हटाने के लिए मामले में अपना पक्ष रखा था; और
यत: दिनांक 14 जुलाई, 2020 और 19 फरवरी, 2021 के उनके अभ्यावेदनों और व्यक्तिगत सुनवाई के दौरान उनके द्वारा प्रस्तुत तथ्यों तथा अन्य सभी संगत तथ्यों और परिस्थितियों पर विचार करने के उपरांत अपीलीय प्राधिकारी ने दिनांक 15 मार्च, 2021 को एक मौखिक आदेश पारित किया है कि श्री एस. भास्करन पर उक्त अधिनियम की धारा 10क के अंतर्गत 6 दिसंबर, 2019 को अधिरोपित निर्रहरता को उक्त आदेश की तारीख को शामिल उक्त अवधि तक और इसके सहित तक कम कर दिया जाए।
अब इसलिए, भारत सरकार के राजपत्र के साथ-साथ राज्य सरकार के राजपत्र में प्रकाशित आयोग के आदेश सं. 76/पीयूडीयू-लोस/2019, दिनांक 06 दिसंबर, 2019 के क्रम सं. 1 पर निर्गत श्री एस. भास्करन का नाम उस अधिसूचना से दिनांक 16 मार्च, 2021 से विलोपित हो जाएगा।

ORDER
New Delhi, the 16th March, 2021
O.N. 31.—Whereas, Shri S. Baskaran, No-51, Second Cross, Street Selva Nagar, Uruvaiyar Puducherry-605110, a contesting candidate for the General Election to the Lok Sabha, 2019 from 1- Puducherry Parliamentary Constituency, held in the year 2019 was disqualified under Section 10A of the Representation of the People Act, 1951, vide Commission's Order No. 76/PUDU-HP/2019 dated 6th December, 2019, for being chosen as, and for being, a member of either House of the Parliament or of Legislative Assembly or Legislative Council of a state for a period of three years from 6th December, 2019 for not lodging his account of election expenses in the manner required by law; and
Whereas, the candidate has preferred an appeal (received in the Commission on 14th July, 2020 & 19th February 2021) under Section 11 of the Representation of the People Act, 1951 before the Appellate Authority for the removal of the disqualification for the reasons stated therein; and whereas, the said Shri S. Baskaran appeared in person before the Appellate Authority on 15th March, 2021 through Video Conference and pleaded his case for removal of disqualification: and
Whereas, after considering the submission made by him in his representations dated 14th July, 2020 & 19th February, 2021 and during the personal hearing and all other relevant facts and circumstances, the Appellate Authority has passed a speaking order dated 15th March, 2021, that the disqualification imposed on 6th December, 2019, under Section 10A of the said Act, on Shri S. Baskaran be reduced to the period up to and including the date of the said order.
Now, therefore, the name of Shri S. Baskaran which appeared at Sl.No 1 of the Commission's Order No. 76/PUDU-HP/2019 dated 06 December, 2019, published in the gazette of government India as well as State Government gazette shall stand deleted from that notification with effect from 16th March, 2021.

आ.अ. 32.—लोक प्रतिनिधित्व अधिनियम, 1950 (1950 का 43) की धारा 13-क की उप-धारा (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए भारत निर्वाचन आयोग मिजोरम राज्य सरकार के परामर्श से एतद्द्वारा, श्री आशीष कु न्द्रा, आई.ए.एस. के स्थान पर श्री पी. जवाहर, आई. ए. एस. (एजीएमयूटी 2007) को उनके कार्यभार ग्रहण करने की तारीख से आगामी आदेशों तक के लिए मिजोरम राज्य के मुख्य निर्वाचन अधिकारी के रूप में नामित करता है।
2. श्री पी. जवाहर, मिजोरम सरकार के अधीन सभी पदभार या किसी कार्य के पदभारों को तत्काल सौंप देंगे या धारण करना समाप्त कर देंगे, जो कि वे ऐसा पदभार ग्रहण करने से पहले धारण कर रहे थे।
2. श्री पी. जवाहर, मुख्य निर्वाचन अधिकारी, मिजोरम के रूप में कार्य करते हुए मिजोरम सरकार के अधीन किसी भी प्रकार का कोई अतिरिक्त कार्यभार ग्रहण नहीं करेंगे सिवाय इसके कि उनको राज्य सचिवालय में निर्वाचन विभाग के प्रभारी, सरकार के सचिव पदाभिहित किया जाएगा।

O.N. 32 .—In exercise of the powers conferred by sub-section (1) of section 13A of the Representation of the People Act, 1950 (43 of 1950), the Election Commission of India in consultation with the Government of Mizoram hereby designates Shri P. Jawahar, IAS, (AGMUT:2007) as the Chief Electoral Officer for the State of Mizoram with effect from the date he takes over charge and until further orders in place of Shri Ashish Kundra, IAS.
2. Shri P. Jawahar shall cease to hold and hand over forthwith the charge of all or any charges of work under the Government of Mizoram, which he may be holding before such assumption of office.
3. Shri P. Jawahar while functioning as the Chief Electoral Officer, Mizoram shall not hold any additional charge whatsoever under the Government of Mizoram except that he should be designated Secretary to the Government in charge of Election Department in the State Secretariat.
