सं. ए-12(11)3/2015-स्था.1.--कर्मचारी राज्य बीमा अधिनियम, 1948 (1948 का 34) की धारा 97 की उप-धारा (2) के खण्ड (XXI) और उक्त धारा की उप-धारा (2क) के साथ पठित उप-धारा (1) और धारा 17 की उप-धारा (2) के खंड (क) के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए तथा कर्मचारी राज्य बीमा निगम, क्षेत्रीय निदेशक ग्रेड 'ए'/निदेशक भर्ती विनियम, 2013 के अधिक्रमण में, ऐसे अधिक्रमण से पहले की गई अथवा किए जाने से छूट गई बातों के अलावा कर्मचारी राज्य बीमा निगम, केन्द्रीय सरकार के अनुमोदन से, एतद्द्वारा, कर्मचारी राज्य बीमा निगम में क्षेत्रीय निदेशक ग्रेड 'ए'/निदेशक के पद पर भर्ती की पद्धति को विनियमित करने हेतु निम्नलिखित विनियम बनाता है, नामतः-
1. संक्षिप्त नाम और प्रारम्भ.--(1) ये विनियम कर्मचारी राज्य बीमा निगम, क्षेत्रीय निदेशक ग्रेड 'ए'/निदेशक (समूह 'क' पद) भर्ती विनियम, 2021 कहे जायेंगे।
(2) ये शासकीय राजपत्र में इनके प्रकाशन की तारीख से लागू होंगे।
2. पद की संख्या, वर्गीकरण और वेतन मैट्रिक्स में लेवल.--उक्त पद की संख्या, उसका वर्गीकरण अर उससेे सम्बद्ध वेतन मैट्रिक्स में लेवल इन विनियमों के साथ संलग्न अनुसूची के कॉलम (2) से (4) में यथाविनिर्दिष्ट होंगे।
3. भर्ती की पद्धति, आयु सीमा, अर्हताएं आदि.--भर्ती की पद्धति, आयु सीमा, अर्हताएं और उक्त पद से संबन्धित अन्य मामले उक्त अनुसूची के कॉलम (5) से (13) में यथाविनिर्दिष्ट होंगे।

4. निरर्हता.- ऐसा कोई व्यक्ति -
(क) जिसने ऐसे व्यक्ति से विवाह किया है या विवाह करने का करार किया है जिसका विवाहिती जीवित है; अथवा (ख) जिसने अपने विवाहिती के जीवित रहते हुए किसी व्यक्ति से विवाह किया है अथवा विवाह करने का करार किया है, उक्त पद पर नियुक्ति का पात्र नहीं होगा।
परन्तु यदि कर्मचारी राज्य बीमा निगम के महानिदेशक इस बात से संतुष्ट हैं कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वे किसी व्यक्ति को इस विनियम के प्रचालन से छूट दे सकेंगे।
5. शिथिल करने की शक्ति.- जहाँ कर्मचारी राज्य बीमा निगम के महानिदेशक की राय में ऐसा करना आवश्यक अथवा समीचीन है तो वे तत्संबंधी कारणों को लेखबद्ध करके केन्द्र सरकार का पूर्व अनुमोदन लेकर तथा संघ लोक सेवा आयोग के परामर्श से किसी श्रेणी अथवा वर्ग के व्यक्तियों के संबंध में इन विनियमों के किसी भी उपबंध में आदेश द्वारा शिथिलता दे सकते हैं।
6. व्यावृति.- इन विनियमों की कोई बात, ऐसे आरक्षण, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय-समय पर जारी किए गए आदेशों के अनुरूप अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़े वर्गों, भूतपूर्व सैनिकों तथा अन्य विशिष्ट वर्गों के व्यक्तियों के लिए उपबंध करना अपेक्षित है।

| पदोन्नति : क्षेत्रीय निदेशक ग्रेड 'बी'/संयुक्त निदेशक वेतन मैट्रिक्स के लेवल-12 (रु. 78800-209200) में पाँच वर्षों की नियमित सेवा सहित । टिप्पणी 1ः पदोन्नति, कर्मचारी राज्य बीमा निगम द्वारा समूह 'क' अधिकारियों के लिए तैयार किये गए 'ग' लेवल के प्रशिक्षण के समापन की शर्त के अधीन होगी। टिप्पणी 2ः विभागीय पदोन्नति समिति की बैठक की तिथि से पहले पदोन्नति के लिए जिन व्यक्तियों ने प्रशिक्षण पूरा नहीं किया है, उन पर भी इस शर्ताधीन विचार किया जाएगा कि विभागीय पदोन्नति समिति की बैठक की तिथि के एक वर्ष के भीतर अपेक्षित प्रशिक्षण पूरा कर लिया जाएगा। टिप्पणी 3ः दो वर्ष के भीतर सेवानिवृत्त होने वाले व्यक्तियों को पदोन्नति हेतु इस प्रशिक्षण को पूरा करने से छूट होगी। |

टिप्पणी 4ः जहाँ पदोन्नति के लिए अपनी अर्हक या पात्रता सेवा पूरी कर चुके कनिष्ठों पर विचार किया जा रहा है, वहाँ उनके वरिष्ठों की पदोन्नति पर भी विचार किया जाएगा बशर्ते कि अपनी अपेक्षित अर्हक या पात्रता सेवा ऐसी अर्हक या पात्रता सेवा के आधे से अधिक अथवा दो वर्ष, जो भी कम हो, से कम न हो तथा उन्होंने ऐसी अर्हक अथवा पात्रता सेवा पहले ही पूरी कर चुके अपने कनिष्ठों के साथ अगले उच्च ग्रेड में पदोन्नति के लिए अपनी परिवीक्षा अवधि सफलतापूर्वक पूरी कर ली हो ।
प्रतिनियुक्ति (अल्पावधि संविदा सहित)ः
केंद्रीय सरकार या राज्य सरकारों या संघ राज्य प्रशासनों या सार्वजनिक क्षेत्र के उपक्रमों या सांविधिक और स्वायत्त निकायों के अंतर्गत अधिकारीः-
(क) (i) मूल संवर्ग अथवा विभाग में नियमित आधार पर स–श पदधारी; अथवा
(ii) मूल संवर्ग या विभाग में वेतन मैट्रिक्स के लेवल-12 (रु. 78800-209200) में या उसके समकक्ष पदों में नियुक्ति के पश्चात नियमित आधार पर पाँच वर्ष की सेवा; और
(ख) वित्तीय अथवा प्रशासनिक मामलों अथवा सामाजिक सुरक्षा योजना अथवा श्रम कानूनों से संबंधित कार्य में दस वर्षों के अनुभव के साथ किसी मान्यता प्राप्त विश्वविद्यालय से स्नातक डिग्री।
टिप्पणी 1ः फीडर श्रेणी के विभागीय अधिकारी जो पदोन्नति की सीधी पंक्ति में है, प्रतिनियुक्ति पर नियुक्ति के विचारार्थ पात्र नहीं होंगे। इसी प्रकार, प्रतिनियुक्त पदोन्नति द्वारा नियुक्ति के विचार हेतु पात्र नहीं होंगे ।
टिप्पणी 2ः प्रतिनियुक्ति (अल्पावधि संविदा सहित) की अवधि इस नियुक्ति से तत्काल पूर्व इसी या केंद्रीय सरकार के किसी अन्य संगठन या विभाग में अन्य संवर्ग बाह्य पद पर प्रतिनियुक्ति (अल्पावधि संविदा सहित) की अवधि सहित सामान्यतः पाँच वर्षों से अधिक नहीं होगी ।
टिप्पणी 3ः प्रतिनियुक्ति (अल्पावधि संविदा सहित) द्वारा नियुक्ति के लिए अधिकतम आयु सीमा आवेदनों की प्राप्ति की अंतिम तिथि को छप्पन वर्षों से अधिक नहीं होगी ।

(EMPLOYEES' STATE INSURANCE CORPORATION)
New Delhi, the 26th March 2021
No. A-12(11)3/2015-Estt. I.―In exercise of the powers conferred by sub-section (1) of section 97 read with clause (xxi) of sub-section (2) and sub-section (2A) of that section and proviso to clause (a) of sub-section (2) of section 17 of the Employees' State Insurance Act, 1948 (34 of 1948) and in supersession of the Employees' State Insurance Corporation, Regional Director Grade 'A'/Director Recruitment Regulations, 2013, except as respects things done or omitted to be done before such supersession, the Employees' State Insurance Corporation hereby makes, with the approval of the Central Government, the following regulations regulating the method of recruitment to the post of Regional Director Grade 'A'/Director in the Employees' State Insurance Corporation, namely:—
1. Short title and commencement.― (1) These regulations may be called the Employees' State Insurance Corporation, Regional Director Grade 'A'/Director (Group 'A' Post) Recruitment Regulations, 2021.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. Number of post, classification and level in pay matrix.― The number of the said post, its classification and level in the pay matrix attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these regulations.
3. Method of recruitment, age-limit, qualifications, etc.― The method of recruitment, age-limit, qualifications and other matters relating to the said post shall be as specified in columns (5) to (13) of the said Schedule.
4. Disqualification.― No person, ―
(a) who has entered into or contracted a marriage with a person having spouse living; or
(b) who, having a spouse living, has entered into or contracted a marriage with any person,
shall be eligible for appointment to the said post:
Provided that the Director General of the Employees' State Insurance Corporation may, if satisfied that such marriage is permissible under the personal law applicable to such person and to the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this regulation.
5. Power to relax.― Where the Director General of the Employees' State Insurance Corporation is of the opinion that it is necessary or expedient so to do, he may after taking prior approval of the Central Government, by order, for reasons to be recorded in writing and in consultation with the Union Public Service Commission, relax any of the provisions of these regulations, with respect to any class or category of persons.
6. Savings.― Nothing in these regulations shall affect reservation, relaxation of age-limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, the Other Backward Classes, the Ex- servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

| Promotion: Regional Director Grade 'B' /Joint Director in level-12 in the pay matrix (Rs. 78800-209200) with five years' regular service in the grade. Note 1: Promotion shall be subject to completion of level 'C' training for Group 'A' officers devised by the Employees' State Insurance Corporation. Note 2: Those persons who have not completed training for promotion before the date of meeting of Departmental Promotion Committee will also be considered subject to the condition that the required training will be completed within one year of the date of meeting of Departmental Promotion Committee. Note 3: Those persons who are due to retire within two years will be exempted from completion of such training for promotion. Note 4: Where juniors who have completed their qualifying or eligibility service are being considered for promotion, their seniors would also be considered provided they are not short of the requisite qualifying or eligibility service by more than half of such qualifying or eligibility service or two years, whichever is less, and have successfully completed their probation period for promotion to the next higher grade along with their juniors who have already completed such qualifying or eligibility service. Deputation (Including short-term contract): Officers under Central Government or State Governments or Union territory Administrations or public sector undertakings or statutory and autonomous bodies,― (a) (i) holding analogous post on regular basis in the parent cadre or department; or (ii) with five years' service in the grade rendered after appointment thereto on a regular basis in posts in level -12 in the pay matrix (Rs. 78800- 209200) or equivalent in the parent cadre or department; and (b) possessing bachelor's degree of a recognised University with ten years' experience in financial or administrative matters or dealing with social security scheme or labour laws. Note 1: The departmental officers in the feeder category who are in direct line of promotion will not be eligible for consideration for appointment on deputation. Similarly, deputationists shall not be eligible for consideration for appointment by promotion. Note 2: The period of deputation (including short-term contract) including period of deputation (including short-term contract) in another Ex-cadre post held immediately preceding this appointment in the same or some other organisation or department of the Central Government shall ordinarily not to exceed five years. Note 3: The maximum age-limit for appointment by deputation (including short-term contract) shall be not exceeding fifty-six years as on the closing date of receipt of applications. |
