4) अ(cid:7007)याय XIII - उपननयम (1) B - पंचाट का संदभ(cid:6981) - सद(cid:7021)य(cid:7298) और अनधकृ त (cid:7390)न(cid:7334)य(cid:7298) के बीच और अनधकृ त (cid:7390)न(cid:7334)य(cid:7298) और घटक(cid:7298) के बीच ,ए(cid:6989)सच(cid:7286) िके उपननयम(cid:7298) , ननयम(cid:7298) और र्नननयम(cid:7298) के अधीन या नकसी आकन(cid:7021)मक उपचार के संदभ(cid:6981) म(cid:7286) या उसके बाद या उनकीर् ैधता, अा(cid:6981)(cid:7008)र्यन, (cid:7390)ा(cid:6990)या, पूनत(cid:6981) या अनधकार(cid:7298) से संबंनधत, दानय(cid:7004र्)(cid:7298) और देनदानरय(cid:7298) के संदभ(cid:6981) म(cid:7286) नकए गए, सौदे,अनुबंध और लेन-देन के संबंध म(cid:7286) या उससे उ(cid:7004)प(cid:7382) होनेर् ाले सभी र्दाे, मतभेद या र्र्नाद, और इस तरह के सौदे, लेनदेन और अनुबंध(cid:7298) म(cid:7286) (cid:7021र्)ीकृ नत नकया गया है या नह(cid:7277) इसके नकसी भी र्साल सनहत, इन उपचुर्ना(cid:7298) और ननयम(cid:7298) के (cid:7079र्)ाधान(cid:7298) के अनुसार म(cid:7007)य(cid:7021)ता को (cid:7079)(cid:7021)तुत नह(cid:7277) नकया ािएगा।

5) अ(cid:7007)याय XIII - उपननयम (18) - मा(cid:7007)य(cid:7021)म पंचाट का काया(cid:6981)(cid:7008र्)यन - उपननयम(cid:7298) म(cid:7286) नकसी बात की होते (cid:7263)ए भी, ऐसे मामल(cid:7298) म(cid:7286) हिां मा(cid:7007)य(cid:7021)म पंचाट या अपीलीय मा(cid:7007)य(cid:7021)म पंचाट एक (cid:7069)ेनडंग सद(cid:7021)य और / या उसके अनधकृ त (cid:7390)न(cid:7334) के नखला और एक घटक के प(cid:6979) म(cid:7286) पानरत नकया ािता है, ए(cid:6989)सच(cid:7286),ि ए(cid:6989)सच(cid:7286) ि के सा पी (cid:7069)ेनडंग सद(cid:7021)य के मिा या अ(cid:7008)य पैसे से डेनबट करेगा, ोि पुर(cid:7021)कार के नलए देय पुर(cid:7021)कार की रान, (cid:7011)या िसनहत देय है, यनद कोई है, डेनबट की तारीख तक और उ(cid:7334) रान को अलग-अलग खाते म(cid:7286) इस तरह से ननपटा कर रख(cid:7286) ैिसा नक उप-ननयम 19 म(cid:7286) उन(cid:7016)लनखत है।
बत(cid:7287), हिां पुर(cid:7021)कार (cid:7079)नतभूनतय(cid:7298) की नडर्लीरी के नलए है, ए(cid:6989)सच(cid:7286) िैिसे नक पंचाट की तारीख या इस तरह की अ(cid:7008)य तारीख पर, ए(cid:6989)सच(cid:7286) िम(cid:7286) ऐसी (cid:7079)नतभूनतय(cid:7298) के समापन मू(cid:7016)य पर र्नचार कर सकता है, नसिके नलए संबंनधत (cid:7079)ानधकरण, ऐसी (cid:7079)नतभूनतय(cid:7298) और पुर(cid:7021)कार रान के मू(cid:7016)य पर प(cid:7263)ंचने के उनचत कारण(cid:7298) को बताते (cid:7263)ए नननद(cid:6981)(cid:7397) कर सकता है।
6) अ(cid:7007)याय XIII - उपननयम (19) (ए) - घटक(cid:7298) को डेनबट अकाउं ट का भुगतान : मा(cid:7007)य(cid:7021)म पंचाट : - हिां (cid:7069)ेनडंग म(cid:7286)बर / अनधकृ त (cid:7390)न(cid:7334) इन उपननयम के तहत नदए गए समय के भीतर अपील नह(cid:7277) करने को (cid:7079)ानमकता दी ािती , तो उपननयम 18 के तहत , डेनबट की गई रान का भुगतान अन(िcid:6981)त (cid:7011)या िके सा पंचाटी (awardee) को कर नदया ािएगा।

2) Chapter V – Rule 1.13 - Discontinuation of concept of Sub-Broker: Nothing contained in the Circular dated 3rd August, 2018, issued by the Securities and Exchange Board of India with regard to discontinuation of Sub – Brokers as market intermediaries with effect from 1st April, 2019, shall affect the rights and obligations which have accrued or have arisen or which may arise in future or any proceedings which are pending or which may be initiated in future, either in relation to the sub-broker, any activity of a sub-broker or dealings through sub-broker, and all such rights, obligations and/or proceedings shall continue to be governed by the Rules, Bye-laws and Regulations of the Exchange relating to sub- broker, its activity or its dealings which may be applicable at the relevant time.
Bye-laws of BSE 3) Chapter VI - Bye-law 2(i) - Conditions for admission - A trading member shall not deal with an Authorised Person who is not registered with the Exchange nor allow operation of its trading terminal at any office other than its registered office, branch offices and the offices of its registered Authorised Person or such permitted places, in the manner prescribed by the Exchange.
4) Chapter XIII - Bye-law (1) B - Reference to Arbitration - All claims, differences or disputes between the members and Authorised Persons and between Authorised Persons and Constituents arising out of or in relation to dealings, contracts and transactions made subject to the Bye-laws, Rules and Regulations of the Exchange or with reference to anything incidental thereto or in pursuance thereof or relating to their validity, construction, interpretation, fulfilment or the rights, obligations and liabilities of the parties thereto and including any question of whether such dealings, transactions and contracts have been entered into or not shall be submitted to arbitration in accordance with the provisions of these Bye- laws and Regulations. Provided however, in case of claims, differences and disputes to which an Authorised Person is a party, the member with whom such Authorised Person is associated shall be made a party to the proceedings along with the Authorised Person. Explanation: For the purpose of these Bye-laws, an Authorised Person will have the meaning assigned to the term in the Rules, Bye-laws and Regulations of the Exchange.
5) Chapter XIII - Bye-law (18) - Implementation of Arbitral Award - Notwithstanding anything contained in the Bye-laws, in cases where the arbitral award or appellate arbitral award is passed against a trading member and/or its Authorised Person and in favour of a Constituent, the Exchange shall debit from the deposits or other monies of the trading member lying with the Exchange, the amount of award payable to the awardee together with interest payable, if any, till the date of debit and keep aside the said amount in a separate account to be dealt with in such manner as mentioned in Bye-law 19. Provided that, where the award is for the delivery of securities, the Exchange may consider the closing price of such securities on the Exchange as on the date of the award or such other date the relevant authority may specify to be reasonable, stating reasons for arriving at the value of such securities and award amount.
6) Chapter XIII - Bye-law (19) (a) - Payment of Debit Account to Constituent's - Arbitral Award: - Where the trading member/ Authorised Person chose not to prefer an appeal under these Bye-law within the time permissible there under, the amount debited under Bye-law 18 shall be paid, together with the interest earned thereon, to the awardee.
7) Chapter XIII - Bye-law (19) (b) - Payment of Debit Account to Constituent's - Appellate Arbitral Award: - Where an appeal is preferred by the trading member/ Authorised Person under these Bye-law and the appellate arbitral tribunal makes an appellate arbitral award against the trading member/ Authorised Person the Exchange shall pay the awarded amount to the awardee from the amount debited under Bye-law 18: -
(i) where no application is made by the trading member/ Authorised Person under Section 34 of the Arbitration and Conciliation Act, 1996 to challenge such arbitral award within the limitation period for making such application, upon expiry of such limitation period.
