486 THE GAZETTE OF INDIA : APRIL 10, 2021/CHAITRA 20, 1943 [PART II—SEC. 3(i)]दिनांक 30 सितंबर, 2009 का का.आ. 2494(अ), दिनांक 30 सितंबर, 2009 का का.आ. 2495(अ) दिनांक 08 फरवरी, 2010 का का.आ. 287(अ) और पूर्ववर्ती जल संसाधन, नदी विकास और गंगा संरक्षण मंत्रालय के दिनांक 29 सितंबर, 2014 का का.आ. 2539(अ) को निरस्त करते हुए, ऐसे निरस्तीकरण से पहले की बातों या किए गए कार्यों को हटाने के अलावा, के न्द्र सरकार ने दिनांक 07.10.2016 की अधिसूचना संख्या का.आ. 3187(अ) के माध्यम से गंगा नदी (पुनरुद्धार, संरक्षण और प्रबंधन) प्राधिकरण आदेश, 2016 को अधिसूचित किया था जिसमें अन्य बातों के साथ-साथ राष्ट्रीय स्वच्छ गंगा मिशन को प्राधिकरण के रूप में गठित किया गया।
और जबकि, गंगा नदी (पुनरुद्धार, संरक्षण और प्रबंधन) प्राधिकरण आदेश, 2016 की धारा 37 के अंतर्गत कार्यकारी निदेशक (तकनीकी) की नियुक्ति प्राधिकारी के न्द्र सरकार है और के न्द्र सरकार कार्यकारी निदेशक (तकनीकी) की नियुक्ति के निबंधन और शर्तों को निर्धारित करने में सक्षम है। और इसलिए, के न्द्र सरकार एतदद्वारा राष्ट्रीय स्वच्छ गंगा मिशन में कार्यकारी निदेशक (तकनीकी) के पदों की भर्ती प्रक्रिया को विनियमित करने के लिए निम्नलिखित नियमों को बनाती है:
1. लघु शीर्षक और आरंभ.— (i) इन नियमों को राष्ट्रीय स्वच्छ गंगा मिशन (प्राधिकरण): कार्यकारी निदेशक (तकनीकी) भर्ती नियम, 2021 कहा जाएगा।
(ii) ये तत्काल प्रभाव से लागू होंगे।
2. प्रयोज्यता.—ये नियम, इन नियमों के अनुसार संलग्न अनुसूची के कॉलम (1) में निर्दिष्ट पद पर लागू होंगे।
3. पदों की संख्या, वर्गीकरण और वेतनमान.—उक्त पद की संख्या, इसका वर्गीकरण और इसके साथ जुड़े वेतन मैट्रिक्स में लेवल, इन नियमों के साथ संलग्न अनुसूची के कॉलम (2) से (4) में यथा निर्दिष्ट होंगे।
4. भर्ती की पद्धति, आयु सीमा, अर्हताएं इत्यादि.—उक्त पदों से संबंधित भर्ती पद्धति, आयु सीमा, अर्हताएं और अन्य संबंधित मामलों को अनुसूची के कॉलम (5) से (13) में यथा विनिर्दिष्ट होंगी।
5. कार्यकारी निदेशक (तकनीकी) के पद का कार्यकाल.—राष्ट्रीय स्वच्छ गंगा मिशन के कार्यकारी निदेशक (तकनीकी) का पद प्रतिनियुक्ति पर भरा जाएगा और सेवारत अधिकारी का कार्यकाल पांच वर्ष की अवधि के लिए या सेवानिवृत्ति की आयु प्राप्त करने तक, जो भी पहले हो, होगा।
6. अयोग्यता.—कोई व्यक्ति -
(क) जिसने ऐसे व्यक्ति से जिसका पति या पत्नी जीवित है, विवाह किया है या विवाह की संविदा की है;
या
(ख) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है, या विवाह की संविदा की है,
उक्त पद पर नियुक्ति का पात्र नहीं होगा :
बशर्ते के न्द्र सरकार इस बात से संतुष्ट हो कि इस तरह का विवाह ऐसे व्यक्ति और विवाह के पक्षों पर लागू व्यैक्तिक कानूनों के अंतर्गत और ऐसा करने के अन्य आधार पर अनुमति प्राप्त हो या इस नियम के लागू होने से किसी व्यक्ति को छू ट प्राप्त हो।
7. छू ट देने की शक्ति.—जहां के न्द्र सरकार का विचार हो कि ऐसा करना आवश्यक या समीचीन है तो यह इस आदेश द्वारा या लिखित रूप में कारण दर्ज करते हुए और मंत्री (जल शक्ति) के अनुमोदन से व्यक्तियों के किसी भी वर्ग या श्रेणी के संबंध में इन नियमों के प्रावधानों में से किसी को भी छू ट प्रदान कर सकती है।
8. सिवाय.—इन नियमों में, अनुसूचित जाति, अनुसूचित जनजाति, भूतपूर्व सैनिक, अन्य पिछड़ा वर्ग और विशेष श्रेणियों के अन्य व्यक्तियों को आरक्षण, आयु सीमा में छू ट और प्रदान की जाने वाली अन्य अपेक्षित रियायतों पर के न्द्र सरकार द्वारा समय-समय पर इस संबंध में जारी आदेशों के अनुपालन में कोई प्रभाव नहीं पड़ेगा।

G.S.R. 47 .—Whereas, in exercise of the powers conferred by sub-section (1), read with clauses (i), (ii), (v), (vi), (vii), (viii), (ix), (x), (xii) and (xiii) of sub-section (2) and (3) of section 3 and sections 4,5,9,10,11, 19, 20 and 23 of the Environment (Protection) Act, 1986 (29 of 1986) and in supersession of the notifications of the Government of India in the erstwhile Ministry of Environment and Forests numbers S.O.1111(E), dated the 30th September, 2009, S.O. 2493 (E), dated the 30th September, 2009, S.O. 2494 (E), dated the 30th September 2009, S.O. 2495 (E), dated the 30th September 2009, S.O. 287 (E) dated the 8th February, 2010 and in the erstwhile Ministry of Water Resources, River Development and Ganga Rejuvenation No. S.O. 2539 (E), dated the 29th September 2014, except as respects things done or omitted to be done before such supersession, the Central Government had notified vide notification number S.O. 3187(E) dated 07.10.2016 the River Ganga (Rejuvenation, Protection and Management) Authorities Order, 2016, inter alia, constituting the National Mission for Clean Ganga as Authority. And whereas under section 37 of the River Ganga (Rejuvenation, Protection and Management) Authorities Order, 2016, the appointing authority for Executive Director (Technical) is the Central Government and the Central Government is competent to determine the terms and conditions of appointment of Executive Director (Technical). And therefore, the Central Government hereby makes the following rules regulating the method of recruitment to the posts of Executive Director(Technical) in the National Mission for Clean Ganga, namely :-

1. Short title and commencement.— (i) These rules may be called the National Mission for Clean Ganga (Authority) : Executive Director(Technical) Recruitment Rules, 2021.
(ii) They shall come into force with immediate effect.
2. Application.—These rules shall apply to the post specified in Column (1) of the Schedule annexed to these rules.
3. Number of post, classification and scales of pay.—The number of the said post, its classification and the level in the pay matrix attached thereto, shall be as specified in column (2) to (4) of the Schedule annexed to these rules.
4. Method of recruitment, age limit, qualifications, etc.—The method of recruitment, age limit, qualifications and other matters relating to the said posts shall be as specified in columns (5) to (13) of the Schedule.
5. Tenure of the post of Executive Director(Technical) .—The post of Executive Director(Technical) of the National Mission for Clean Ganga shall be filled on Deputation and the serving officer shall hold office for a period of five years or until he/she attains the age of superannuation, whichever is earlier:-
6. Disqualification.—No person –
a. Who has entered into or contracted a marriage with a person having a spouse living,
Or
b. Who, having a spouse living, has entered into or contracted a marriage with any person
Shall be eligible for appointment to any of the said posts:
Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.
7. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient to do so, it may, by order and for reasons to be recorded in writing and with the approval of the Minister (Jal Shakti), relax any of the provisions of these rules with respect to any class or category of persons.
8. Saving.— Nothing in these rules shall affect reservation, relaxation of age-limit and other concessions required to be provided for persons belonging to the Scheduled Castes, the Scheduled Tribes, the Ex-Servicemen, Other Backward Classes and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

Desirable:- M.E./M.Tech in Environment Engineering/Public Health Engineering/River & Lake conservation/Water Resources/Hydrology/STP Note 1: The maximum age-limit for appointment on deputation shall not be exceeding 56 years as on the closing date for receipt of application. Note 2: The term of Executive Director (Technical) will normally be five years or till the age of superannuation, whichever is earlier. | |
