अत:, अब के न्द्रीय सरकार, कोयला धारक क्षेत्र (अर्जन और विकास) अधिनियम, 1957 (1957 का 20) (जिसे इसमें इसके पश्चात् उक्त अधिनियम कहा गया है) की धारा 4 की उप-धारा (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, उक्त अनुसूची में वर्णित भूमि में कोयले का पूर्वेक्षण करने के अपने आशय की सूचना देती है ;

उक्त अनुसूची में वर्णित भूमि में हितबद्ध कोई व्यक्ति –

(i) भूमि के संपूर्ण या किसी भाग या उक्त भूमि में या उसके ऊपर किसी अधिकार के अर्जन के प्रति आक्षेप कर सके गा; या

(ii) उक्त अधिनियम की धारा 4 की उप-धारा (3) के अधीन की गई किसी कार्रवाई से हुई या होने वाली संभावित किसी नुकसान के लिए उक्त अधिनियम की धारा 6 के अधीन प्रतिकर का दावा कर सके गा ;

या

(ii) उक्त अधिनियम की धारा 13 की उप-धारा (1) के अधीन पूर्वेक्षण अनुज्ञप्तियों के प्रभावहीन होने के संबंध में या उक्त अधिनियम की धारा 13 की उप-धारा (4) के अधीन खनन पट्टे प्रभावहीन होने के लिए प्रतिकर का दावा कर सके गा और उसे उक्त अधिनयम की धारा 13 की उपधारा (1) के खंड (i) से खंड (iv) तक में विनिर्दिष्ट मदों की बाबत उपगत व्यय को दर्शाने के लिए पूर्वोक्त भूमि से संबंधित सभी मानचित्रों, चार्टों और अन्य दस्तावेजों को परिदत्त कर सके गा,

इस अधिसूचना के राजपत्र में प्रकाशन की तारीख से नब्बे दिन की अवधि के भीतर, कार्यपालक अभियंता – (सिविल) डिवी-I/कार्यपालक अभियंता – (सिविल) डिवी-II/अतिरिक्त मुख्य अभियंता (सिविल), छत्तीसगढ़ राज्य पावर जनरेशन कं पनी लिमिटेड, सीएसपीजीसीएल कोल ब्लॉक,कटघोरा, एचटीपीएस कोरबा वेस्ट, जिला कोरबा (छत्तीसगढ़)- 495450 के कार्यालय में को भेज सके गा ।

बिन्दु ए-बी रेखा बिन्दु 'ए' वन कमपाटर्मेंट संख्या पी-367 में राष्ट्रीय राजमार्ग संख्या 130 के समीप से आरंभ होती है और मदनपुर ग्राम में रेखा बिन्दु 'बी' पर मिलती है ।

बिन्दु बी-सी रेखा बिन्दु 'बी' नेशनल हाईवे 130 के समीप मदनपुर ग्राम से आरंभ होती है और ग्राम पतुरिया डांड में रेखा बिन्दु 'सी' पर मिलती है ।

बिन्दु सी-डी रेखा बिन्दु 'सी' ग्राम पतुरिया डांड से आरंभ होती है और उत्तर दिशा की ओर से रेखा बिन्दु 'डी' पर मिलती है ।

बिन्दु डी-ई रेखा बिन्दु 'डी' ग्राम पतुरिया डांड से आरंभ होती है और दक्षिण-पूर्व दिशा में मुड़कर ग्राम पतुरिया डांड में रेखा बिन्दु 'ई' पर मिलती है ।

बिन्दु ई-एफ रेखा बिन्दु 'ई' ग्राम पतुरिया डांड के पश्चिम की ओर से आरंभ होती है और उत्तर दिशा में वन कम्पाटर्मंट संख्या पी-433 में रेखा बिन्दु 'एफ' पर मिलती है ।

बिन्दु एफ-जी रेखा बिन्दु 'एफ' ग्राम गिधमुड़ी के उत्तरी भाग से आरंभ होती है और ग्राम गिधमुड़ी के दक्षिणी भाग से घूमकर रेखा बिन्दु 'जी' पर मिलती है ।

बिन्दु जी-एच रेखा बिन्दु 'जी' ग्राम गिधमुड़ी के दक्षिणी भाग से आरंभ होती है और पश्चिम दिशा की ओर जाकर रेखा बिन्दु 'एच' पर मिलती है ।

बिन्दु एच-आई रेखा बिन्दु 'एच' ग्राम गिधमुड़ी से आरंभ होती है और दक्षिण की ओर वन कम्पाटर्मेंट संख्या पी-436 में बिन्दु बिन्दु 'आई' पर मिलती है ।

बिन्दु आई-जे रेखा बिन्दु 'आई' वन कम्पाटर्मेंट संख्या पी-436 से आरंभ होती है और दक्षिण-पश्चिम दिशा की ओर ग्राम उछलेंगा में रेखा बिन्दु 'जे' पर मिलती है ।

S.O. 348.—Whereas, it appears to the Central Government that coal is likely to be obtained from the land in the locality described in the Schedule annexed hereto;

And, whereas, the plan bearing number CSPGCL/G&P/CBA/4/1, dated the 24th November,2020 containing details of the areas of land described in the said Schedule may be inspected at the office of the Chief General Manager (Exploration Division), Central Mine Planning and Design Institute Limited, Gondwana Place, Kanke Road, Ranchi (Jharkhand) Pincode-834031 or at the office of the Coal Controller, 1, Council House Street, Kolkata-700001 or at the office the Executive Engineer – (Civil) Dn- I / Executive Engineer - (Civil) Dn- II / Additional Chief Engineer (Civil), Chhattisgarh State Power Generation Company Limited, CSPGCL Coal Block Katghora at HTPS Korba Weat, District Korba (C.G.) - 495450 or at the office of District Collector, District Korba (Chhattisgarh);

Now, therefore, in exercise of the powers conferred by sub-section (1) of section 4 of the Coal Bearing Areas (Acquisition and Development) Act, 1957 (20 of 1957), (hereinafter referred to as the said Act), the Central Government hereby gives notice of its intention to prospect for coal from the land described in the said Schedule;

Any person interested in the land described in the said schedule may –

(i) object to the acquisition of the whole or any part of the land or of any rights in or over such land;

or

(ii) claim compensation under section 6 of the said Act for any damage caused or likely to be caused by any action taken under sub-section (3) of section 4 thereof; or

(iii) claim compensation under sub-section (1) of section 13 of the said Act in respect of prospecting licenses ceasing to have effect or under sub-section (4) of section 13 of the said Act for mining lease ceasing to have effect and deliver all maps, charts and other documents relating to the aforesaid land to show the expenditure incurred in respect of items specified in clauses (i) to (iv) of sub-section (1) of section 13 of the said Act,

to the officer of the Executive Engineer – (Civil) Dn- I / Executive Engineer - (Civil) Dn- II/Additional Chief Engineer (Civil) CSPGCL Coal Block Katghora at HTPS Korba Weat, District Korba (C.G.) - 495450 within a period of ninety days from the date of publication of this notification in the Official Gazette.
