के न्द्रीय अधिकारियों (संघ राज्यक्षेत्र प्रशासनों को छोड़कर) द्वारा जारी किए गए साधारण आदेश और अधिसूचनाएं Orders and Notifications issued by the Central Authorities (Other than the Administrations of Union Territories) नई दिल्ली, 23 जून, 2021 39.-यतः भारत निर्वाचन आयोग द्वारा छत्तीसगढ़ राज्य से विधान सभा का साधारण निर्वाचन 2018 की घोशणा प्रेस नोट संख्या ईसीआई/प्रे.नो./66/2018 दिनांक 6 अक्टूबर, 2018 के जरिए की गई थी । कार्यक्रम के अनुसार, मतगणना की तारीख 11 दिसम्बर, 2018 थी ।

और यतः, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 78 के अनुसार, निर्वाचन लडने वाले प्रत्येक अभ्यर्थी को, निर्वाचित अभ्यर्थी के निर्वाचन की तारीख से 30 दिनों के भीतर निर्वाचन व्यय के अपने लेखे की सही प्रति जिला निर्वाचन अधिकारी को दाखिल करनी होती है

और यतः, 71- पंडरिया विधान सभा निर्वाचन क्षेत्र सहित संबंधित रिटर्निग अधिकारी द्वारा उक्त निर्वाचन के परिणाम 11 दिसम्बर, 2018 को घोशित किए गए थे । इस प्रकार, निर्वाचन व्यय के लेखे दाखिल करने की अंन्तिम तारीख 10 जनवरी, 2019 थी;

(89)⁹⁰ THE GAZETTE OF INDIA : JUNE ²⁶, ²⁰²¹/ASHADHA ⁵, ¹⁹⁴³ [PART II—SEC. ³(iii)] और यतः, जिला निर्वाचन अधिकारी, राजनांदगांव, छत्तीसगढ़ द्वारा प्रस्तुत और मुख्य निर्वाचन अधिकारी, छत्तीसगढ़ द्वारा अपने दिनांक 29 जनवरी, 2019 के पत्र सं. 21/चार/वि.स.चु./ई.ई.एम/2019/85 के जरिए अग्रेशित दिनांक 10 जनवरी, 2019 की रिपोर्ट के अनुसार श्री धर्मेंद्र कुमार जो छत्तीसगढ़ के 71- पंडरिया विधान सभा निर्वाचन क्षेत्र से निर्वाचन लडने वाले बहुजन समाज पार्टी के अभ्यर्थी हैं, विधि द्वारा यथापेक्षित रीति से अपने निर्वाचन व्यय का कोई भी लेखा दाखिल करने में विफल रहे है ।

और यतः, जिला निर्वाचन अधिकारी, कबीरधाम जिला, छत्तीसगढ़ और मुख्य निर्वाचन अधिकारी, छत्तीसगढ़ की रिपोर्टो के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम 1961 के नियम 89 के उप नियम (5) के अंतर्गत निर्वाचन व्यय प्रस्तुत नहीं करने के लिए श्री धर्मेंद्र कुमार को कारण बताओ नोटिस दिनांक 04 मार्च, 2020 को जारी किया गया था;

और यतः, निर्वाचनों का संचालन नियम 1961 के नियम 89 के उप-नियम (6) के अनुसार, दिनांक 04 मार्च, 2020 के उपयुक्त कारण बताओ नोटिस के जरिए श्री धर्मेंद्र कुमार को निदेष दिया गया था कि वे इस नोटिस के प्राप्त होने के 20 दिनों के अंदर लेखे न प्रस्तुत कर पाने के कारणों को स्पश्ट करते हुए लिखित रूप में अपना अभ्यावेदन प्रस्तुत करें और साथ ही, निर्वाचन व्यय का अपना लेखा दाखिल करें;

और यतः, उक्त नोटिस श्री धर्मेंद्र कुमार द्वारा दिनांक 20 मार्च, 2020 को प्राप्त किया था। अभ्यर्थी से प्राप्त पावती रसीद जिला निर्वाचन अधिकारी, कबीरधाम द्वारा अपने दिनांक 30 अप्रैल, 2020 के पत्र सं0 88/व्यय-लेखा/ सा ़निर्वा/2020 के जरिए आयोग को प्रस्तुत कर दी गई है ;

और यतः, जिला निर्वाचन अधिकारी, राजनांदगांव द्वारा अपने दिनांक 17 अगस्त, 2020 के पत्र सं0 157/ सा ़निर्वा ़/नि ़ व्यय ़ अनु/2020 के जरिए प्रस्तुत की गई अनुपूरक रिपोर्ट में यह बताया गया है कि श्री धर्मेंद्र कुमार ने आज की तारीख तक न तो कोई भी अभ्यावेदन और न ही अपने निर्वाचन व्यय का लेखा दाखिल किया है । इसके अतिरिक्त उन्होंने भारत निर्वाचन आयोग का सम्यक नोटिस मिलने के उपरांत भी उक्त विफलता के लिए न तो कोई कारण बताया है और न ही कोई स्पश्टीकरण दिया है ;

और यतः, आयोग का यह समाधान हो गया है कि श्री धर्मेंद्र कुमार निर्वाचन खर्चो का लेखा दाखिल करने मेें विफल रहे हैं और उनके पास इस विफलता के लिए कोई भी उचित कारण अथवा औचित्य नही है,

और यतः, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में अनुबंधित किया गया है कि :-

"यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति-

(i) निर्वाचन व्ययों का लेखा उस समय के भीतर और उस रीति में जैसी इस अधिनियम के द्वारा या अधीन उपेक्षित है, दाखिल करने में असफल रहा हैः तथा

(ii) उस असफलता के लिए कोई अच्छा कारण या न्यायोचित्य नहीं रखता है, तो निर्वाचन आयोग शासकीय राजपत्र में प्रकाषित आदेष द्वारा उसको निरर्हित घोशित करेगा और ऐसा व्यक्ति उस आदेष की तारीख से तीन वर्श की कालावधि के लिए निरर्हित होगा;

अतः, अब लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अनुसरण में भारत निर्वाचन आयोग एतद्‌द्वारा घोशणा करता है कि छत्तीसगढ़ राज्य 71- पंडरिया विधान सभा निर्वाचन क्षेत्र से छत्तीसगढ राज्य में विधान सभा के साधारण निर्वाचन, 2018 में निर्वाचन लडने वाले निर्दलीय अभ्यर्थी श्री धर्मेंद्र कुमार, बैरागपारा, वार्ड नं 12, पंडरिया, छत्तीसगढ़ को इस आदेष की तारीख से तीन वर्श की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संध राज्य-क्षेत्र की विधान सभा अथवा विधान परिशद का सदस्य चुने जाने अथवा होने के लिए निरर्हित है ।

O. N. 39 .—WHEREAS, the General Election to Legislative Assembly of Chhattisgarh, 2018 was announced by Election Commission of India vide Press Note No. ECI/PN/66/2018 dated 6th October, 2018. As per the schedule, Date of Counting was 11th December, 2018.

AND WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate has to lodge a true copy of his account of election expenses within 30 days with the District Election Officer, from the date of election of returned candidate;

AND WHEREAS, the result of the said election was declared by the concerned Returning Officer including 71- Pandariya Constituency on 11th December, 2018. As such the last date for lodging of account of election expenses was 10th January, 2019.

AND WHEREAS, as per the report dated 10th January, 2019 submitted by the District Election Officer, Kabirdham District, Chhattisgarh and forwarded by Chief Electoral Officer, Chhattisgarh vide letter No. 21/चार/वि. स.चु./ई.ई.एम./2019/85, dated 29th January, 2019, Sh. Dharmendra Kumar, independent candidate from 71- Pandariya Assembly Constituency of Chhattisgarh, has failed to lodge any account of his election expenses as required by law.

AND WHEREAS, on the basis of the reports of the District Election Officer, Kabirdham District, Chhattisgarh and the Chief Electoral Officer, Chhattisgarh, a Show Cause Notice, dated 04th March, 2020 was issued by Election Commission of India under Sub Rule (5) of Rule 89 of the Conduct of Election Rules,1961 to, Sh. Dharmendra Kumar for non-submission of Election expenses;

AND WHEREAS, as per Sub Rule (6) of Rule 89 of the Conduct of Election Rules, 1961, through the above said Show Cause Notice, dated 04th March, 2020, Sh. Dharmendra Kumar, was directed to submit his representation in writing in the Commission explaining the reason for non-submission of accounts and also to lodge his accounts of election expenses/rectify the defects in his accounts and submit the same the District Election Officer concerned within 20 days from the date of receipt of the notice;

AND WHEREAS, the said notice was received by Sh. Dharmendra Kumar, on 20th March, 2020. Acknowledgment receipt obtained from the candidate have been submitted to the Commission by District Election Officer, Kabirdham vide his letter No. 88/व्यय-लेखा/सा ़निर्वा/2020 dated, 30th April, 2020.

AND WHEREAS, in the supplementary report submitted by District Election Officer, Rajnandgaon vide his letter No. 157/सा ़निर्वा ़/नि ़ व्यय ़ अनु/2020 dated 17th August, 2020, has stated that Sh. Dharmendra Kumar, has not submitted any representation or his account of election expenses, duly signed along with original vouchers etc. till date. Further, he has furnished neither any reason nor explanation for the said failure even after receipt of the due notice to the Election Commission of India as well;

AND WHEREAS, the Commission satisfied that Sh. Dharmendra Kumar, has failed to lodge an account of election expenses and has no good reason or justification for the failure;

AND WHEREAS, Section 10A of the Representation of the People Act, 1951 stipulates that :-

"If the Election Commission is satisfied that a person:

(a) Has failed to lodge an account of election expenses within the time and in the manner required by law or under this Act, and

(b) Has no good reason or justification for the failure the Election Commission shall by order published in the Official Gazette, declare him to be disqualified and any such person shall be disqualified for a period of three years from date of the under;

NOW THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission of India hereby declares Sh. Sh. Dharmendra Kumar, resident of Bairagpara, Ward No. 12, Pandariya, Chhattisgarh and the contesting Independent candidate for General Election to Legislative Assembly of Chhattisgarh, 2018 from 71- Pandariya Constituency of the state of Chhattisgarh to be disqualified for being chosen as and for being a member of either House of Parliament or the Legislative Parliamentary or legislative Council of a State or Union Territory for a period of three years from the date of this order.

और यतः, उक्त नोटिस श्री रूपदास कुर्रे द्वारा दिनांक 25 अक्तूबर, 2019 को प्राप्त किया था। अभ्यर्थी से प्राप्त पावती रसीद जिला निर्वाचन अधिकारी, बिलासपुर द्वारा अपने दिनांक 26 नवम्बर, 2019 के पत्र सं0 नि.पर्य./वि.स.नि.-18/व्यय लेखा/2019/4306 के जरिए आयोग को प्रस्तुत कर दी गई है ;

और यतः, जिला निर्वाचन अधिकारी, बिलासपुर द्वारा अपने दिनांक 27 जुलाई, 2020 के पत्र सं0 नि.प./वि.स.नि./व्यय लेखा/2019/141 के जरिए प्रस्तुत की गई अनुपूरक रिपोर्ट में यह बताया गया है कि श्री रूपदास कुर्रे ने आज की तारीख तक न तो कोई भी अभ्यावेदन और न ही अपने निर्वाचन व्यय का लेखा दाखिल किया है । इसके अतिरिक्त उन्होंने भारत निर्वाचन आयोग का सम्यक नोटिस मिलने के उपरांत भी उक्त विफलता के लिए न तो कोई कारण बताया है और न ही कोई स्पश्टीकरण दिया है ;

AND WHEREAS, as per the report dated 11th January, 2019 submitted by the District Election Officer, Bilaspur District, Chhattisgarh and forwarded by Chief Electoral Officer, Chhattisgarh vide letter No.21/4/LAEle./EEM/2019/85, dated 29th January, 2019, Sh. Roopdas Kurrey, Independent candidate from 29-Bilha Assembly Constituency of Chhattisgarh, has failed to lodge any account of his election expenses as required by law.

AND WHEREAS, on the basis of the reports of the District Election Officer, Bilaspur District, Chhattisgarh and the Chief Electoral Officer, Chhattisgarh, a Show Cause Notice, dated 9th October, 2019 was issued by Election Commission of India under Sub Rule (5) of Rule 89 of the Conduct of Election Rules,1961 to , Sh. Roopdas Kurrey,for non-submission of Election expenses;

AND WHEREAS, as per Sub Rule(6) of Rule 89 of the Conduct of Election Rules, 1961, through the above said Show Cause Notice, dated 9th October, 2019, Sh. और यतः, उक्त नोटिस श्री लहरगंगा सोनी द्वारा दिनांक 19 अक्तूबर, 2019 को प्राप्त किया था। अभ्यर्थी से प्राप्त पावती रसीद जिला निर्वाचन अधिकारी, बिलासपुर द्वारा अपने दिनांक 26 नवम्बर, 2019 के पत्र सं0 नि.पर्य./वि.स.नि.-18/व्यय लेखा/2019/4306 के जरिए आयोग को प्रस्तुत कर दी गई है ;

और यतः, जिला निर्वाचन अधिकारी, बिलासपुर द्वारा अपने दिनांक 27 जुलाई, 2020 के पत्र सं0 नि.प./वि.स.नि./व्यय लेखा/2019/141 के जरिए प्रस्तुत की गई अनुपूरक रिपोर्ट में यह बताया गया है कि श्री लहरगंगा सोनी ने आज की तारीख तक न तो कोई भी अभ्यावेदन और न ही अपने निर्वाचन व्यय का लेखा दाखिल किया है । इसके अतिरिक्त उन्होंने भारत निर्वाचन आयोग का सम्यक नोटिस मिलने के उपरांत भी उक्त विफलता के लिए न तो कोई कारण बताया है और न ही कोई स्पश्टीकरण दिया है ;

और यतः, आयोग का यह समाधान हो गया है कि श्री लहरगंगा सोनी निर्वाचन खर्चो का लेखा दाखिल करने मेें विफल रहे हैं और उनके पास इस विफलता के लिए कोई भी उचितकारण अथवा औचित्य नही है,

और यतः, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में अनुबंधित किया गया है कि :-

AND WHEREAS, the result of the said election was declared by the concerned Returning Officer including 29- Bilha Constituency on 11th December, 2018. As such the last date for lodging of account of election expenses was 10th January, 2019.

AND WHEREAS, as per the report dated 11th January, 2019 submitted by the District Election Officer, Bilaspur District, Chhattisgarh and forwarded by Chief Electoral Officer, Chhattisgarh vide letter No.21/4/LAEle./EEM/2019/85, dated 29th January, 2019, Sh. Laharganga Soni, Independent candidate from 29- Bilha Assembly Constituency of Chhattisgarh, has failed to lodge any account of his election expenses as required by law.

AND WHEREAS, on the basis of the reports of the District Election Officer, Bilaspur District, Chhattisgarh and the Chief Electoral Officer, Chhattisgarh, a Show Cause Notice, dated 9th October, 2019 was issued by Election Commission of India under Sub Rule (5) of Rule 89 of the Conduct of Election Rules,1961 to , Sh. Laharganga Soni ,for non-submission of Election expenses;

AND WHEREAS, as per Sub Rule(6) of Rule 89 of the Conduct of Election Rules, 1961, through the above said Show Cause Notice, dated 9th October, 2019, Sh. Laharganga Soni ,was directed to submit his representation in writing in the Commission explaining the reason for non-submission of accounts and also to lodge his accounts of election expenses/rectify the defects in his accounts and submit the same the District Election Officer concerned within 20 days from the date of receipt of the notice;

AND WHEREAS, the said notice was received by Sh. Laharganga Soni,on 19th October, 2019. Acknowledgment receipt obtained from the candidate have been submitted to the Commission by District Election Officer, Bilaspur vide his letter No. नि.पर्य./वि.स.नि.-18/व्यय लेखा/2019/4306 dated 26th November, 2019.

AND WHEREAS, in the supplementary report submitted by District Election Officer, Bilaspur vide his letter No. 141 dated 7th July, 2020 has stated that Sh. Laharganga Soni, has not submitted any representation or his account of election expenses, duly signed along with original vouchers etc. till date. Further, he has furnished neither any reason nor explanation for the said failure even after receipt of the due notice to the Election Commission of India as well;

AND WHEREAS, the Commission satisfied that Sh. Laharganga Soni, has failed to lodge an account of election expenses and has no good reason or justification for the failure;

AND WHEREAS, Section 10A of the Representation of the People Act, 1951 stipulates that :-

और यतः, जिला निर्वाचन अधिकारी, बिलासपुर जिला, छत्तीसगढ़ और मुख्य निर्वाचन अधिकारी, छत्तीसगढ़ की रिपोर्टो के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम 1961 के नियम 89 के उप नियम (5) के अंतर्गत निर्वाचन व्यय प्रस्तुत नहीं करने के लिए श्री देवराम साहू को कारण बताओ नोटिस दिनांक 9 अक्तूबर, 2019 को जारी किया गया था;

AND WHEREAS, the Commission satisfied that Sh. Ashok Verma, has failed to lodge an account of election expenses and has no good reason or justification for the failure;

AND WHEREAS, Section 10A of the Representation of the People Act, 1951 stipulates that :-

"If the Election Commission is satisfied that a person:

(a) Has failed to lodge an account of election expenses within the time and in the manner required by law or under this Act, and

NOW THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission of India hereby declares Sh. Ashok Verma, resident of Village- Thakurtola, Post- Ramola, Tehsil - Dongargarh, District- Rajnandgaon and the contesting Independent candidate for General Election to Legislative Assembly of Chhattisgarh, 2018 from 76- Dongargaon Constituency of the state of Chhattisgarh to be disqualified for being chosen as and for being a member of either House of Parliament or the Legislative Parliamentary or legislative Council of a State or Union Territory for a period of three years from the date of this order.
