आ.अ. 204.—यतः निर्वाचन आयोग द्वारा झारखण्ड राज्य के विधान सभा के साधारण निर्वाचन 2019 की घोशणा प्रेस नोट संख्या ईसीआई/प्रे.नो./102/2019 दिनांक 1 नवम्बर, 2019 के जरिए की गई थी । कार्यक्रम के अनुसार, मतगणना की तारीख 23 दिसम्बर, 2019 थी ।

(431)⁴³² THE GAZETTE OF INDIA : JULY ³¹, ²⁰²¹/SRAVANA ⁹, ¹⁹⁴³ [PART II—SEC. ³(iii)] और यतः, 76-डालटेनगंज विधान सभा निर्वाचन क्षेत्र सहित संबंधित रिटर्निग अधिकारी द्वारा उक्त निर्वाचन के परिणाम 23 दिसम्बर, 2019 को घोशित किए गए थे । इस प्रकार, निर्वाचन व्यय के लेखे दाखिल करने की अंतिम तारीख 22 जनवरी, 2020 थी;

और यतः, जिला निर्वाचन अधिकारी, पलामू, झारखण्ड द्वारा दिनांक 29 जनवरी, 2020 के पत्र सं 61/निर्वा॰ द्वारा प्रस्तुत और मुख्य निर्वाचन अधिकारी, झारखण्ड द्वारा अपने दिनांक 3 फरवरी, 2020 के पत्र स0 01/निर्वा-ई.ई.एम-को. -42/2019/201, के जरिए अग्रेशित रिपोर्ट के अनुसार श्री जगन्नाथ प्रसाद ससंह जो झारखण्ड के 76-डालटेनगंज विधान सभा निर्वाचन क्षेत्र से निर्वाचन लडने वाले बहुजन समाज पाटी के अभ्यर्थी हैं, विधि द्वारा आपेक्षित रीति से अपने निर्वाचन व्यय का कोई भी लेखा दाखिल करने में विफल रहे है ।

और यतः, जिला निर्वाचन अधिकारी, पलामू झारखण्ड़ और मुख्य निर्वाचन अधिकारी, झारखण्ड की रिपोर्ट के आधार पर निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम 1961 के नियम 89 के उप नियम (5) के अंतर्गत निर्वाचन व्यय प्रस्तुत नहीं करने के लिए श्री जगन्नाथ प्रसाद ससंह को कारण बताओ नोटिस दिनांक 3 मार्च, 2021 को जारी किया गया था;

और यतः, निर्वाचनों का संचालन नियम 1961 के नियम 89 के उप-नियम (6) के अनुसार, दिनांक 3 मार्च, 2021 के उपयुक्त कारण बताओ नोटिस के जरिए श्री जगन्नाथ प्रसाद ससंह को निदेष दिया गया था कि वे इस नोटिस के प्राप्त होने के 20 दिनों के अंदर लेखे न प्रस्तुत कर पाने के कारणों को स्पश्ट करते हुए लिखित रूप में अपना अभ्यावेदन प्रस्तुत करें और साथ ही, निर्वाचन व्यय का अपना लेखा दाखिल करें;

और यतः, उक्त नोटिस श्री जगन्नाथ प्रसाद ससंह के द्वारा दिनांक 19 मार्च, 2021 को प्राप्त किया था। अभ्यर्थी से प्राप्त पावती रसीद जिला निर्वाचन अधिकारी, पलामू द्वारा अपने दिनांक 14 जून, 2021 के पत्र सं0 402/निर्वा० के जरिए आयोग को प्रस्तुत कर दी गई है ;

और यतः, जिला निर्वाचन अधिकारी, पलामू द्वारा अपने दिनांक 28 जून, 2021 के पत्र सं0 470/निर्वा० के जरिए प्रस्तुत की गई अनुपूरक रिपोर्ट में यह बताया गया है कि श्री जगन्नाथ प्रसाद ससंह ने आज की तारीख तक न तो कोई भी अभ्यावेदन और न ही अपने निर्वाचन व्यय का लेखा दाखिल किया है। इसके अतिरिक्त उन्होंने निर्वाचन आयोग का सम्यक नोटिस मिलने के उपरांत भी उक्त विफलता के लिए न तो कोई कारण बताया है और न ही कोई स्पश्टीकरण दिया है ;

और यतः, आयोग का यह समाधान हो गया है कि श्री जगन्नाथ प्रसाद ससंह निर्वाचन व्यय का लेखा दाखिल करने मेें विफल रहे हैं और उनके पास इस विफलता के लिए कोई भी उचित कारण अथवा औचित्य नही है,

और यतः, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में अनुबंधित किया गया है कि :-

"यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति-

(क) निर्वाचन व्ययों का लेखा उस समय के भीतर और उस रीति में जैसी इस अधिनियम के द्वारा या अधीन उपेक्षित है, दाखिल करने में असफल रहा हैः तथा

(ख) उस असफलता के लिए कोई अच्छा कारण या न्यायोचित्य नहीं रखता है,

निर्वाचन आयोग शासकीय राजपत्र में प्रकाषित आदेष द्वारा उसको निरर्हित घोशित करेगा और ऐसा व्यक्ति उस आदेष की तारीख से तीन वर्श की कालावधि के लिए निरर्हित होगा"

अतः, अब लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अनुसरण में निर्वाचन आयोग एतद्‌द्वारा घोशणा करता है कि झारखण्ड राज्य के 76-डालटेनगंज विधान सभा निर्वाचन क्षेत्र से विधान सभा के साधारण निर्वाचन, 2019 में निर्वाचन लडने वाले बहुजन समाज पाटी के अभ्यर्थी श्री जगन्नाथ प्रसाद ससंह, आदर्श नगर ग्राम बैररया, पो0-सुदना, थाना-र्हर मेसदनीनगर, सजला-पलामू, सपन-822102, झारखण्ड को़ इस आदेष की तारीख से तीन वर्श की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संध राज्य-क्षेत्र की विधान सभा अथवा विधान परिशद का सदस्य चुने जाने अथवा होने के लिए निरर्हित है ।

ELECTION COMMISSION OF INDIA

ORDER

New Delhi, the 26th July, 2021

O. N. 204.—WHEREAS, the General Election to Jharkhand Legislative Assembly 2019 was announced by Election Commission vide Press Note No. ECI/PN/102/2019 dated 1st November, 2019. As per the schedule, the date of Counting was 23rd December, 2019.

AND WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate has to lodge a true copy of his account of election expenses within 30 days with the District Election Officer, concerned from the date of election of returned candidate;

AND WHEREAS, the result of the said election was declared by the concerned Returning Officer including 76-Daltonganj Assembly Constituency in Jharkhand State on 23rd December, 2019. As such the last date for lodging of account of election expenses was 22nd January, 2020.

AND WHEREAS, as per the report vide letter No. 61/निर्वा॰ dated 29th January, 2020 submitted by the

District Election Officer, Palamu Jharkhand and forwarded by Chief Electoral Officer, Jharkhand vide letter No.01/निर्वा-ई.ई.एम-को.-42/2019/201, dated 3rd February, 2020, Sh. Jagannath Prasad Singh, contesting candidate of Bahujan Samaj Party from 76-Daltonganj Assembly Constituency in Jharkhand State, has failed to lodge any account of his election expenses as required by law.

AND WHEREAS, on the basis of the reports of the District Election Officer Palamu, Jharkhand and the Chief Electoral Officer, Jharkhand, a Show Cause Notice, dated 3rd March, 2021 was issued by Election Commission under Sub Rule (5) of Rule 89 of the Conduct of Election Rules, 1961 to Sh. Jagannath Prasad Singh for non-submission of Election expenses;

AND WHEREAS, as per Sub Rule(6) of Rule 89 of the Conduct of Election Rules, 1961, through the above said Show Cause Notice, dated 3rd March, 2021, Sh. Jagannath Prasad Singh, was directed to submit his representation in writing to the Commission explaining the reason for non-submission of accounts and also to lodge his accounts of election expenses/rectify the defects in his accounts and submit the same to the District Election Officer concerned within 20 days from the date of receipt of the notice;

AND WHEREAS, the said notice was received by Sh. Jagannath Prasad Singh, on 19th March, 2021. Acknowledgment receipt obtained from the candidate have been submitted to the Commission by District Election Officer, Palamu vide his letter 402/निर्वा० dated 14th June, 2021.

AND WHEREAS, in the supplementary report submitted by District Election Officer, Palamu vide his letter 470/निर्वा० dated 28th June, 2021 it has been stated that Sh. Jagannath Prasad Singh, has not submitted any representation or his account of election expenses, duly signed along with original vouchers etc. till date. Further, he has furnished neither any reason nor explanation for the said failure even after receipt of the due notice to the Election Commission of India as well;

AND WHEREAS, the Commission is satisfied that Sh. Jagannath Prasad Singh, has failed to lodge an account of election expenses and has no good reason or justification for the failure;

AND WHEREAS, Section 10A of the Representation of the People Act, 1951 stipulates that :-

"If the Election Commission is satisfied that a person-

(a) has failed to lodge an account of election expenses within the time and in the manner required by law or under this Act, and

(b) has no good reason or justification for the failure,

Election Commission shall, by order published in the Official Gazette, declare him to be disqualified and any such person shall be disqualified for a period of three years from date of the order."

NOW THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission hereby declares Sh. Jagannath Prasad Singh, Ardash Nagar Village Bairiya, Po- Sudna, Ps-Town Medininagar, District- Palamu, Jharkhand and Bahujan Samaj Party contesting candidate for General Election to Legislative Assembly of Jharkhand, 2019 from 76-Daltonganj Assembly Constituency of the State of Jharkhand to be disqualified for being chosen as and for being a member of either House of Parliament or the Legislative Assembly or Legislative Council of a State or Union Territory for a period of three years from the date of this order.

और यतः, निर्वाचनों का संचालन नियम 1961 के नियम 89 के उप-नियम (6) के अनुसार, दिनांक 3 मार्च, 2021 के उपयुक्त कारण बताओ नोटिस के जरिए श्री व्रजेर् कु मार को निदेष दिया गया था कि वे इस नोटिस के प्राप्त होने के 20 दिनों के अंदर लेखे न प्रस्तुत कर पाने के कारणों को स्पश्ट करते हुए लिखित रूप में अपना अभ्यावेदन प्रस्तुत करें और साथ ही, निर्वाचन व्यय का अपना लेखा दाखिल करें;

और यतः, उक्त नोटिस ित्र श्री व्रजेर् कु मार द्वारा दिनांक 04 जून, 2021 को प्राप्त किया था। अभ्यर्थी से प्राप्त पावती रसीद जिला निर्वाचन अधिकारी, पलामू द्वारा अपने दिनांक 14 जून, 2021 के पत्र सं0 402/निर्वा० के जरिए आयोग को प्रस्तुत कर दी गई है ;

और यतः, जिला निर्वाचन अधिकारी, पलामू द्वारा अपने दिनांक 28 जून, 2021 के पत्र सं0 470/निर्वा० के जरिए प्रस्तुत की गई अनुपूरक रिपोर्ट में यह बताया गया है कि श्री व्रजेर् कु मार ने आज की तारीख तक न तो कोई भी अभ्यावेदन और न ही अपने निर्वाचन व्यय का लेखा दाखिल किया है। इसके अतिरिक्त उन्होंने निर्वाचन आयोग का सम्यक नोटिस मिलने के उपरांत भी उक्त विफलता के लिए न तो कोई कारण बताया है और न ही कोई स्पश्टीकरण दिया है ;

और यतः, आयोग का यह समाधान हो गया है कि श्री व्रजेर् कु मार निर्वाचन व्यय का लेखा दाखिल करने मेें विफल रहे हैं और उनके पास इस विफलता के लिए कोई भी उचित कारण अथवा औचित्य नही है,

और यतः, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में अनुबंधित किया गया है कि :-

"यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति-

उपेक्षित है, दाखिल करने में असफल रहा हैः तथा

(ख) उस असफलता के लिए कोई अच्छा कारण या न्यायोचित्य नहीं रखता है,

अतः, अब लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अनुसरण में भारत निर्वाचन आयोग एतद्‌द्वारा घोशणा करता है कि झारखण्ड राज्य के 76-डालटेनगंज विधान सभा निर्वाचन क्षेत्र से विधान सभा के साधारण निर्वाचन, 2019 में निर्वाचन लडने वाले सनदशलीय अभ्यर्थी श्री व्रजेर् कु मार, ग्राम-मसझगांवा, पो-नरससंहपुर पथरा, थाना- चैनपुर, सजला-पलामू, सपन-822110, झारखण्ड को़ इस आदेष की तारीख से तीन वर्श की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संध राज्य-क्षेत्र की विधान सभा अथवा विधान परिशद का सदस्य चुने जाने अथवा होने के लिए निरर्हित है ।

O.N. 206.—WHEREAS, the General Election to Jharkhand Legislative Assembly 2019 was announced by Election Commission vide Press Note No. ECI/PN/102/2019 dated 1st November, 2019. As per the schedule, the date of Counting was 23rd December, 2019.

AND WHEREAS, as per the report vide letter No. 61/ dated 29th January, 2020 submitted by the District Election Officer, Palamu Jharkhand and forwarded by Chief Electoral Officer, Jharkhand vide letter No. , dated 3rd February, 2020, Sh. Brajesh Kumar, an Independent contesting candidate from 76-Daltonganj Assembly Constituency in Jharkhand State, has failed to lodge any account of his election expenses as required by law.

AND WHEREAS, on the basis of the reports of the District Election Officer Palamu, Jharkhand and the Chief Electoral Officer, Jharkhand a Show Cause Notice, dated 3rd March, 2021 was issued by Election Commission under Sub Rule (5) of Rule 89 of the Conduct of Election Rules, 1961 to, Sh. Brajesh Kumar, for non-submission of Election expenses;

AND WHEREAS, as per Sub Rule (6) of Rule 89 of the Conduct of Election Rules, 1961, through the above said Show Cause Notice, dated 3rd March, 2021, Sh. Brajesh Kumar, was directed to submit his representation in⁴³⁸ THE GAZETTE OF INDIA : JULY ³¹, ²⁰²¹/SRAVANA ⁹, ¹⁹⁴³ [PART II—SEC. ³(iii)] writing to the Commission explaining the reason for non-submission of accounts and also to lodge his accounts of election expenses/rectify the defects in his accounts and submit the same to the District Election Officer concerned within 20 days from the date of receipt of the notice;

AND WHEREAS, the said notice was received by Sh. Brajesh Kumar, on 04th June, 2021. Acknowledgment receipt obtained from the candidate have been submitted to the Commission by District Election Officer, Palamu vide his letter 402 ० dated 14th June, 2021.

AND WHEREAS, in the supplementary report submitted by District Election Officer, Palamu vide his letter 470 ० -dated 28th June, 2021 it has been stated that Sh. Brajesh Kumar, has not submitted any representation or his account of election expenses, duly signed along with original vouchers etc. till date. Further, he has furnished neither any reason nor explanation for the said failure even after receipt of the due notice to the Election Commission of India as well;

AND WHEREAS, the Commission is satisfied that Sh. Brajesh Kumar, has failed to lodge an account of election expenses and has no good reason or justification for the failure;

AND WHEREAS, Section 10A of the Representation of the People Act, 1951 stipulates that :-

"If the Election Commission is satisfied that a person-

(a) has failed to lodge an account of election expenses within the time and in the manner required by law or under this Act, and

(b) has no good reason or justification for the failure,

Election Commission shall, by order published in the Official Gazette, declare him to be disqualified and any such person shall be disqualified for a period of three years from date of the order." NOW THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission of India hereby declares Sh. आ.अ. 207.—यतः, भारत निर्वाचन आयोग द्वारा प्रेस नोट सं. ईसीआई/पीएन/23/2019 दिनांक 10 मार्च, 2019 के तहत आंध्र प्रदेश के 12 – विजयवाड़ा संसदीय निर्वाचन क्षेत्र के लिए लोक सभा के साधारण निर्वाचन, 2019 की घोषणा की गई थी; और

यत:, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 78 के अनुसार, निर्वाचन लड़ने वाले प्रत्येक अभ्यर्थी को, निर्वाचित अभ्यर्थी के निर्वाचन की तारीख से 30 दिनों के भीतर अपने निर्वाचन व्यय के लेखे की सही प्रति संबंधित जिला निर्वाचन अधिकारी को प्रस्तुत करनी होती है; और

यतः, 12 - विजयवाड़ा संसदीय निर्वाचन क्षेत्र के परिणाम रिटर्निंग ऑफिसर द्वारा 23 मई, 2019 को घोषित किए गए थे और इस प्रकार निर्वाचन व्यय के लेखे दाखिल करने की अन्तिम तारीख 22 जून, 2019 थी; और

यतः, जिला निर्वाचन अधिकारी, कृ ष्णा जिला, आंध्र प्रदेश द्वारा प्रस्तुत दिनांक 22 जून, 2020 की रिपोर्ट के अनुसार मोहम्मद ईशाक, जो आंध्र प्रदेश के 12 – विजयवाड़ा संसदीय निर्वाचन क्षेत्र, 2019 से निर्वाचन लड़ने वाले अभ्यर्थी हैं, अपने निर्वाचन व्यय का लेखा विधि द्वारा यथापेक्षित रीति से दाखिल करने में विफल रहे हैं; और[भाग II—खण्ड 3(iii)] भारत का राजपत्र : जुलाई ³¹, ²⁰²¹/श्रावण ⁹, ¹⁹⁴³ 439 यतः, जिला निर्वाचन अधिकारी की उक्त रिपोर्ट के आधार पर, भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (5) के अंतर्गत मोहम्मद ईशाक को अपने निर्वाचन व्यय के लेखे प्रस्तुत नहीं करने के लिए कारण - बताओ नोटिस सं. 76/एपी-एच पी/2019/ 12 दिनांक 20 फरवरी, 2021 जारी किया गया था; और

यत:, उपयु र्क्त कारण बताओ नोटिस के जरिए और निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (6) के अंतर्गत, मोहम्मद ईशाक को इस नोटिस के प्राप्त होने की तारीख से 20 दिनों के अंदर अपना अभ्यावेदन, जिसमें लेखा दर्ज न करने के कारणों को स्पष्ट किया गया हो, आयोग को लिखित रूप में प्रस्तुत करने और जिला निर्वाचन अधिकारी, कृ ष्णा को निर्वाचन व्यय का संपूर्ण लेखा दर्ज करने का निदेश दिया गया था; और

यत:, जिला निर्वाचन अधिकारी, कृ ष्णा ने बताया है कि मोहम्मद ईशाक को उक्त नोटिस दिनांक 23.03.2021 को तामील किया गया था; और

यत:, जिला निर्वाचन अधिकारी, कृ ष्णा ने दिनांक 20.04.2021 की अपनी अनुपूरक रिपोर्ट में यह बताया कि मोहम्मद ईशाक ने निर्वाचन व्यय का लेखा प्रस्तुत नहीं किया है। इसके अतिरिक्त, उक्त नोटिस मिलने के उपरांत भी मोहम्मद ईशाक ने विधि के अंतर्गत यथा-विहित रीति से लेखे प्रस्तुत करने में अपनी विफलता के लिए भारत निर्वाचन आयोग को न तो कोई कारण बताया है और न ही कोई स्पष्टीकरण दिया है; और

यत:, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में यह उपबंधित किया गया है कि:

''यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व् यक्ति-

(क) इस अधिनियम के द्वारा अथवा इसके अधीन अपेक्षित समय के भीतर और रीति में निर्वाचन व् यय लेखा दाखिल करने में विफल रहा है; और

(ख) उसके पास इस विफलता का कोई उचित कारण अथवा औचित् य नहीं है,

तो, निर्वाचन आयोग, सरकारी राजपत्र में आदेश प्रकाशित करके उसे निरर्ह घोषित करेगा और ऐसा कोई भी व् यक्ति इस आदेश की तारीख से तीन वर्ष की अवधि के लिए निरर्ह रहेगा।'' ;

यत:, तथ्यों और उपलब्ध रिकार्डों के आधार पर, आयोग का यह समाधान हो गया है कि मोहम्मद ईशाक अपने निर्वाचन व्यय के लेखे दाखिल करने में विफल रहे हैं और उनके पास ऐसा करने में विफल रहने के लिए कोई भी उचित कारण अथवा औचित्य नहीं है;

और

अत:, अब लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अनुसरण में, भारत निर्वाचन आयोग एतद्द्वारा घोषणा करता है कि लोक सभा के साधारण निर्वाचन, 2019 में आंध्र प्रदेश राज्य के 12 – विजयवाड़ा संसदीय निर्वाचन क्षेत्र से निर्वाचन लड़ने वाले अभ्यर्थी, मोहम्मद ईशाक निवासी-मकान नं. एफएफ7, कोडुरू एन्कलेव, पितचैय्या स्ट्रीट, लब्बीपेट, विजयवाड़ा, आंध्र प्रदेश, इस आदेश की तारीख से तीन वर्ष की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य क्षेत्र की विधान सभा अथवा विधान परिषद का सदस्य चुने जाने अथवा होने के लिए निरर्ह होंगे।

WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate has to lodge a true copy of his account of election expenses within 30 days with the concerned District Election Officer, from the date of election of the returned candidate; and⁴⁴⁰ THE GAZETTE OF INDIA : JULY ³¹, ²⁰²¹/SRAVANA ⁹, ¹⁹⁴³ [PART II—SEC. ³(iii)] WHEREAS, the result of the election for 12-Vijaywada Parliamentary Constituency was declared by the Returning Officer on 23rd May, 2019 and hence the last date for lodging the account of Election Expenses was 22nd June, 2019 ; and

WHEREAS, as per the report dated 22nd June, 2020 submitted by the District Election Officer, Krishna District, Andhra Pradesh, Mohammed Ishaq, a contesting candidate from 12-Vijaywada Parliamentary Constituency of Andhra Pradesh, 2019, has failed to lodge account of election expenses, as required under law; and

WHEREAS, on the basis of the said report of the District Election Officer, a Show-Cause notice No. 76/AP- HP/2019/12, dated 20th February, 2021 was issued under sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India to Mohammed Ishaq for not lodging of account of Election Expenses; and

WHEREAS, through the above said Show Cause Notice and under sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, Mohammed Ishaq was directed to submit representation in writing to the Commission explaining the reason for not lodging the account and also to lodge account of election expenses with the District Election Officer, Krishna within 20 days from the date of receipt of the notice; and

WHEREAS, the District Election Officer, Krishna, has reported that the said notice was served to Mohammed Ishaq on 23.03.2021; and

WHEREAS, the District Election Officer, Krishna in his supplementary report dated 20.04.2021, reported that Mohammed Ishaq has not submitted account of election expenses. Further, after receipt of the said notice, Mohammed Ishaq has neither furnished any reason nor explanation to the Election Commission of India, for failure to lodge the account as prescribed under law; and

WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that:-

"If the Election Commission is satisfied that a person-

(a) has failed to lodge an account of election expenses, within the time and in the manner required by or under

this Act, and

(b) has no good reason or justification for the failure,

the Election Commission shall, by order published in the Official Gazette, declare him to be disqualified and any such

person shall be disqualified for a period of three years from the date of the order.";

WHEREAS, on the basis of facts and available records, the Commission is satisfied that Mohammed Ishaq has failed to lodge account of election expenses and has no good reason or justification for the failure to do so; and

NOW, THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission of India hereby declares Mohammed Ishaq, resident of H. Exp-09/2019/(Part-39) नवादा -5773 के जरिए अग्रेशित की रिपोर्ट के अनुसार श्री राकेष रौषन जो बिहार के 39-नवादा लोकसभा निर्वाचन क्षेत्र से निर्वाचन लडने वाले भारतीय निर्दलीय अभ्यर्थी हैं, विधि द्वारा आपेक्षित रीति से अपने निर्वाचन व्यय का कोई भी लेखा दाखिल करने में विफल रहे है ।

और यतः, जिला निर्वाचन अधिकारी, नवादा जिला, बिहार और मुख्य निर्वाचन अधिकारी, बिहार की रिपोर्ट के आधार पर निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम 1961 के नियम 89 के उप नियम (5) के अंतर्गत निर्वाचन व्यय प्रस्तुत नहीं करने के लिए श्री राकेष रौषन को कारण बताओ नोटिस दिनांक 3 फरवरी, 2020 जारी किया गया था;

और यतः, जिला निर्वाचन अधिकारी, नवादा द्वारा अपने दिनांक 13 अप्रैल, 2021 के पत्र सं0 485/निर्वा. के जरिए प्रस्तुत की गई अनुपूरक रिपोर्ट में यह बताया गया है कि श्री राकेष रौषन ने आज की तारीख तक न तो कोई भी अभ्यावेदन और न ही अपने निर्वाचन व्यय का लेखा दाखिल किया है । इसके अतिरिक्त उन्होंने भारत निर्वाचन आयोग का सम्यक नोटिस मिलने के उपरांत भी उक्त विफलता के लिए न तो कोई कारण बताया है और न ही कोई स्पश्टीकरण दिया है ;

AND WHEREAS, as per Sub Rule(6) of Rule 89 of the Conduct of Election Rules, 1961, through the above said Show Cause Notice, dated 3rd February, 2020, Sh. Rakesh Raushan, was directed to submit his representation in writing to the Commission explaining the reason for non-submission of accounts and also to lodge his accounts of election expenses/rectify the defects in his accounts and submit the same to the District Election Officer concerned within 20 days from the date of receipt of the notice;

AND WHEREAS, the said notice was received by Sh. Rakesh Raushan, on 13th March, 2021. Acknowledgment receipt obtained from the candidate have been submitted to the Commission by District Election Officer, Nawada vide his letter No.485/Ele. dated 13th April, 2021.

AND WHEREAS, in the supplementary report submitted by District Election Officer, Nawada vide his letter No.485/Ele. dated 13th April, 2021. It has been stated that Sh. Rakesh Raushan, has not submitted any representation or his account of election expenses, duly signed along with original vouchers etc. till date. Further, he has furnished neither any reason nor explanation for the said failure even after receipt of the due notice to the Election Commission of India as well;

AND WHEREAS, the Commission is satisfied that Sh. Rakesh Raushan, has failed to lodge an account of election expenses and has no good reason or justification for the failure;

AND WHEREAS, Section 10A of the Representation of the People Act, 1951 stipulates that :-

"If the Election Commission is satisfied that a person-

(a) has failed to lodge an account of election expenses within the time and in the manner required by law or under this Act, and

(b) has no good reason or justification for the failure,

"Election Commission shall, by order published in the Official Gazette, declare him to be disqualified and any such person shall be disqualified for a period of three years from date of the order."

NOW THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission hereby declares Sh. और यतः, जिला निर्वाचन अधिकारी, बिलासपुर जिला, छत्तीसगढ़ और मुख्य निर्वाचन अधिकारी, छत्तीसगढ़ की रिपोर्टो के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम 1961 के नियम 89 के उप नियम (5) के अंतर्गत निर्वाचन व्यय प्रस्तुत नहीं करने के लिए श्री खेलन सिंह कोर्चे को कारण बताओ नोटिस दिनांक 3 सितम्बर, 2019 जारी किया गया था;

और यतः, निर्वाचनों का संचालन नियम 1961 के नियम 89 के उप-नियम (6) के अनुसार, दिनांक 3 सितम्बर, 2019 के उपयुक्त कारण बताओ नोटिस के जरिए श्री खेलन सिंह कोर्चे को निदेष दिया गया था कि वे इस नोटिस के प्राप्त होने के 20 दिनों के अंदर लेखे न प्रस्तुत कर पाने के कारणों को स्पश्ट करते हुए लिखित रूप में अपना अभ्यावेदन प्रस्तुत करें और साथ ही, निर्वाचन व्यय का अपना लेखा दाखिल करें;

और यतः, उक्त नोटिस श्री खेलन सिंह कोर्चे द्वारा 7 नवम्बर, 2019 को प्राप्त किया था। अभ्यर्थी से प्राप्त पावती रसीद जिला निर्वाचन अधिकारी, बिलासपुर द्वारा अपने दिनांक 8 जनवरी, 2020 के पत्र सं0 नि.प./वि.स.नि.-2018/व्यय लेखा/2020/4402 के जरिए आयोग को प्रस्तुत कर दी गई है ;

और यतः, जिला निर्वाचन अधिकारी, बिलासपुर द्वारा अपने दिनांक 7 जुलाई, 2020 के पत्र सं0 नि.प./वि.स.नि/व्यय लेखा/2019/141 के जरिए प्रस्तुत की गई अनुपूरक रिपोर्ट में यह बताया गया है कि श्री खेलन सिंह कोर्चे ने आज की तारीख तक न तो कोई भी अभ्यावेदन और न ही अपने निर्वाचन व्यय का लेखा दाखिल किया है । इसके अतिरिक्त उन्होंने भारत निर्वाचन आयोग का सम्यक नोटिस मिलने के उपरांत भी उक्त विफलता के लिए न तो कोई कारण बताया है और न ही कोई स्पश्टीकरण दिया है ;

और यतः, आयोग का यह समाधान हो गया है कि श्री खेलन सिंह कोर्चे निर्वाचन खर्चो का लेखा दाखिल करने मेें विफल रहे हैं और उनके पास इस विफलता के लिए कोई भी उचितकारण अथवा औचित्य नही है,

और यतः, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में अनुबंधित किया गया है कि :-

"यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति-

उपेक्षित है, दाखिल करने में असफल रहा हैः तथा

(ii) उस असफलता के लिए कोई अच्छा कारण या न्यायोचित्य नहीं रखता है, तो निर्वाचन आयोग शासकीय

और यतः, उक्त नोटिस श्री गुलाब सिंह पैंकरा द्वारा 7 नवम्बर, 2019 को प्राप्त किया था। अभ्यर्थी से प्राप्त पावती रसीद जिला निर्वाचन अधिकारी, बिलासपुर द्वारा अपने दिनांक 8 जनवरी, 2020 के पत्र सं0 नि.प./वि.स.नि.-2018/व्यय लेखा/2020/4402 के जरिए आयोग को प्रस्तुत कर दी गई है ;

और यतः, जिला निर्वाचन अधिकारी, बिलासपुर द्वारा अपने दिनांक 7 जुलाई, 2020 के पत्र सं0 नि.प./वि.स.नि/व्यय लेखा/2019/141 के जरिए प्रस्तुत की गई अनुपूरक रिपोर्ट में यह बताया गया है कि श्री गुलाब सिंह पैंकरा ने आज की तारीख तक न तो कोई भी अभ्यावेदन और न ही अपने निर्वाचन व्यय का लेखा दाखिल किया है । इसके अतिरिक्त उन्होंने भारत निर्वाचन आयोग का सम्यक नोटिस मिलने के उपरांत भी उक्त विफलता के लिए न तो कोई कारण बताया है और न ही कोई स्पश्टीकरण दिया है ;

और यतः, आयोग का यह समाधान हो गया है कि श्री गुलाब सिंह पैंकरा निर्वाचन खर्चो का लेखा दाखिल करने मेें विफल रहे हैं और उनके पास इस विफलता के लिए कोई भी उचितकारण अथवा औचित्य नही है,

और यतः, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में अनुबंधित किया गया है कि :-

"यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति-

उपेक्षित है, दाखिल करने में असफल रहा हैः तथा

राजपत्र में प्रकाषित आदेष द्वारा उसको निरर्हित घोशित करेगा और ऐसा व्यक्ति उस आदेष की तारीख से

Gulab Singh Paikra, Independent, contesting candidate from 24-Marwahi(ST)Assembly Constituency of Chhattisgarh, has failed to lodge any account of his election expenses as required by law.

AND WHEREAS, on the basis of the reports of the District Election Officer, Bilaspur District, Chhattisgarh and the Chief Electoral Officer, Chhattisgarh, a Show Cause Notice, dated 3rd September, 2019 was issued by Election Commission of India under Sub Rule (5) of Rule 89 of the Conduct of Election Rules,1961 to Sh.Gulab Singh Paikra, for non-submission of Election expenses;

AND WHEREAS, as per Sub Rule(5) of Rule 89 of the Conduct of Election Rules, 1961, through the above said Show Cause Notice, dated 3rd September, 2019, Sh. Gulab Singh Paikra, was directed to submit his representation in writing in the Commission explaining the reason for non-submission of accounts and also to lodge his accounts of election expenses/rectify the defects in his accountsp and submit the same the District Election Officer concerned within 20 days from the date of receipt of the notice;

AND WHEREAS, the said notice was received by Sh. Gulab Singh Paikra, on 7th November, 2019. Acknowledgment receipt obtained from the candidate have been submitted to the Commission by District Election Officer, Bilaspur vide his letter No. No.Ele.P./LAEle.-2018/Exp./2020/4402 dated 8th January, 2020.

AND WHEREAS, in the supplementary report submitted by District Election Officer, Bilaspur vide his letter No. Ele.P./LAEle/Exp./2019/141 dated 7th July, 2020 has stated that Sh. Gulab Singh Paikra, has not submitted any representation or his account of election expenses, duly signed along with original vouchers etc. till date. Further, he has furnished neither any reason nor explanation for the said failure even after receipt of the due notice to the Election Commission of India as well;

AND WHEREAS, the Commission satisfied that Sh. Gulab Singh Paikra, has failed to lodge an account of election expenses and has no good reason or justification for the failure;

AND WHEREAS, Section 10A of the Representation of the People Act, 1951 stipulates that :-

"If the Election Commission is satisfied that a person:

(i) Has failed to lodge an account of election expenses within the time and in the manner required by law or under this Act, and

NOW THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission of India hereby declares Sh. O.N. 213.—WHEREAS, the General Election to Legislative Assembly of Chhattisgarh, 2018 was announced by Election Commission of India vide Press Note No. ECI/PN/66/2018 dated 6th October, 2018. As per the schedule, Date of Counting was 11th December, 2018.

AND WHEREAS, as per the report dated 11th January, 2019 submitted by the District Election Officer, Bilaspur District, Chhattisgarh and forwarded by Chief Electoral Officer, Chhattisgarh vide letter No.21/4/LAEle/EEM/2019/85, dated 29th January, 2019, Sh. Umend Singh Pottam, Shiv Sena, contesting candidate from 24-Marwahi (ST) Assembly Constituency of Chhattisgarh, has failed to lodge any account of his election expenses as required by law.

AND WHEREAS, on the basis of the reports of the District Election Officer, Bilaspur District, Chhattisgarh and the Chief Electoral Officer, Chhattisgarh, a Show Cause Notice, dated 3rd September, 2019 was issued by Election Commission of India under Sub Rule (5) of Rule 89 of the Conduct of Election Rules,1961 to Sh.Umend Singh Pottam, for non-submission of Election expenses;

AND WHEREAS, as per Sub Rule(5) of Rule 89 of the Conduct of Election Rules, 1961, through the above said Show Cause Notice, dated 3rd September, 2019, Sh. Umend Singh Pottam, was directed to submit his representation in writing in the Commission explaining the reason for non-submission of accounts and also to lodge his accounts of election expenses/rectify the defects in his accounts and submit the same the District Election Officer concerned within 20 days from the date of receipt of the notice;

AND WHEREAS, the said notice was received by Sh. Umend Singh Pottam,on 7th November, 2019. Acknowledgment receipt obtained from the candidate have been submitted to the Commission by District Election Officer, Bilaspur vide his letter No.Ele.P./LAEle.-2018/Exp./2020/4402 dated 8th January, 2020.

AND WHEREAS, in the supplementary report submitted by District Election Officer, Bilaspur vide his letter No. Ele.P./LAEle/Exp./2019/141 dated 7th July, 2020 has stated that Sh.Umend Singh Pottam, has not submitted any representation or his account of election expenses, duly signed along with original vouchers etc. till date. Further, he has furnished neither any reason nor explanation for the said failure even after receipt of the due notice to the Election Commission of India as well;

AND WHEREAS, the Commission satisfied that Sh. Umend Singh Pottam, has failed to lodge an account of election expenses and has no good reason or justification for the failure;

AND WHEREAS, Section 10A of the Representation of the People Act, 1951 stipulates that :-

"If the Election Commission is satisfied that a person:

और यतः, 44-कसडोल विधान सभा निर्वाचन क्षेत्र सहित संबंधित रिटर्निग अधिकारी द्वारा उक्त निर्वाचन के परिणाम 11 दिसम्बर, 2018 को घोशित किए गए थे । इस प्रकार, निर्वाचन व्यय के लेखे दाखिल करने की अंन्तिम तारीख 10 जनवरी, 2019 थी;

और यतः, जिला निर्वाचन अधिकारी, बलौदाबाजार-भाटापारा जिला, छत्तीसगढ़ द्वारा प्रस्तुत और मुख्य निर्वाचन अधिकारी, छत्तीसगढ़ द्वारा अपने दिनांक 29 जनवरी, 2019 के पत्र सं. 21/चार/वि.स.चु./ई.ई.एम/2019/85 के जरिए अग्रेशित दिनांक 10 जनवरी, 2019 की रिपोर्ट के अनुसार सुश्री शकुनतला साहू, जो छत्तीसगढ़ के 44-कसडोल विधान सभा निर्वाचन क्षेत्र से निर्वाचन लडने वाले नेषनलिस्ट कांग्रेस पार्टी के अभ्यर्थी हैं, विधि द्वारा यथापेक्षित रीति से अपने निर्वाचन व्यय का कोई भी लेखा दाखिल करने में विफल रहे है ।

और यतः, जिला निर्वाचन अधिकारी, बलौदाबाजार-भाटापारा जिला, छत्तीसगढ़ और मुख्य निर्वाचन अधिकारी, छत्तीसगढ़ की रिपोर्टो के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम 1961 के नियम 89 के उप नियम (5) के अंतर्गत निर्वाचन व्यय प्रस्तुत नहीं करने के लिए सुश्री शकुनतला साहू, को कारण बताओ नोटिस दिनांक 10 फरवरी, 2020 जारी किया गया था;

और यतः, निर्वाचनों का संचालन नियम 1961 के नियम 89 के उप-नियम (6) के अनुसार, दिनांक 10 फरवरी, 2020 के उपयुक्त कारण बताओ नोटिस के जरिए सुश्री शकुनतला साहू, को निदेष दिया गया था कि वे इस नोटिस के प्राप्त होने के 20 दिनों के अंदर लेखे न प्रस्तुत कर पाने के कारणों को स्पश्ट करते हुए लिखित रूप में अपना अभ्यावेदन प्रस्तुत करें और साथ ही, निर्वाचन व्यय का अपना लेखा दाखिल करें;

और यतः, उक्त नोटिस सुश्री शकुनतला साहू द्वारा 27 फरवरी, 2020 को प्राप्त किया था। अभ्यर्थी से प्राप्त पावती रसीद जिला निर्वाचन अधिकारी, बलौदाबाजार-भाटापारा द्वारा अपने दिनांक 15 मई, 2020 के पत्र सं0 127/सा.नि./नि.प. /2020 के जरिए आयोग को प्रस्तुत कर दी गई है ;

और यतः, जिला निर्वाचन अधिकारी, बलौदाबाजार-भाटापारा द्वारा अपने दिनांक 5 अगस्त, 2020 के पत्र सं0 229/सा.

नि./निर्वाचन व्यय/2020 के जरिए प्रस्तुत की गई अनुपूरक रिपोर्ट में यह बताया गया है कि सुश्री शकुनतला साहू, ने आज की तारीख तक न तो कोई भी अभ्यावेदन और न ही अपने निर्वाचन व्यय का लेखा दाखिल किया है । इसके अतिरिक्त उन्होंने[भाग II—खण्ड 3(iii)] भारत का राजपत्र : जुलाई ³¹, ²⁰²¹/श्रावण ⁹, ¹⁹⁴³ 455 भारत निर्वाचन आयोग का सम्यक नोटिस मिलने के उपरांत भी उक्त विफलता के लिए न तो कोई कारण बताया है और न ही कोई स्पश्टीकरण दिया है ;

और यतः, आयोग का यह समाधान हो गया है कि सुश्री शकुनतला साहू, निर्वाचन खर्चो का लेखा दाखिल करने मेें विफल रहे हैं और उनके पास इस विफलता के लिए कोई भी उचितकारण अथवा औचित्य नही है,

और यतः, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में अनुबंधित किया गया है कि :-

"यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति-

अतः, अब लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अनुसरण में भारत निर्वाचन आयोग एतद्‌द्वारा घोशणा करता है कि छत्तीसगढ़ राज्य के 44-कसडोल विधान सभा निर्वाचन क्षेत्र से छत्तीसगढ राज्य में विधान सभा के साधारण निर्वाचन, 2018 में निर्वाचन लडने वाले नेषनलिस्ट कांग्रेस पार्टी के अभ्यर्थी सुश्री शकुनतला साहू, म.न. 189 बाजार चौक लवन, जिला-बलौदाबाजार-भाटापारा, छत्तीसगढ, को इस आदेष की तारीख से तीन वर्श की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संध राज्य-क्षेत्र की विधान सभा अथवा विधान परिशद का सदस्य चुने जाने अथवा होने के लिए निरर्हित है ।

और यतः, जिला निर्वाचन अधिकारी, बलौदाबाजार-भाटापारा जिला, छत्तीसगढ़ द्वारा प्रस्तुत और मुख्य निर्वाचन अधिकारी, छत्तीसगढ़ द्वारा अपने दिनांक 29 जनवरी, 2019 के पत्र सं. 21/चार/वि.स.चु./ई.ई.एम/2019/85 के जरिए अग्रेशित दिनांक 10 जनवरी, 2019 की रिपोर्ट के अनुसार श्री गोविंद साहू, जो छत्तीसगढ़ के 44-कसडोल विधान सभा निर्वाचन क्षेत्र से निर्वाचन लडने वाले निर्दलीय अभ्यर्थी हैं, विधि द्वारा यथापेक्षित रीति से अपने निर्वाचन व्यय का कोई भी लेखा दाखिल करने में विफल रहे है ।

और यतः, जिला निर्वाचन अधिकारी, बलौदाबाजार-भाटापारा जिला, छत्तीसगढ़ और मुख्य निर्वाचन अधिकारी, छत्तीसगढ़ की रिपोर्टो के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम 1961 के नियम 89 के उप नियम (5) के अंतर्गत निर्वाचन व्यय प्रस्तुत नहीं करने के लिए श्री गोविंद साहू, को कारण बताओ नोटिस दिनांक 10 फरवरी, 2020 जारी किया गया था;

और यतः, निर्वाचनों का संचालन नियम 1961 के नियम 89 के उप-नियम (6) के अनुसार, दिनांक 10 फरवरी, 2020 के उपयुक्त कारण बताओ नोटिस के जरिए श्री गोविंद साहू, को निदेष दिया गया था कि वे इस नोटिस के प्राप्त होने के 20 दिनों के अंदर लेखे न प्रस्तुत कर पाने के कारणों को स्पश्ट करते हुए लिखित रूप में अपना अभ्यावेदन प्रस्तुत करें और साथ ही, निर्वाचन व्यय का अपना लेखा दाखिल करें;

और यतः, उक्त नोटिस श्री गोविंद साहू द्वारा 27 फरवरी, 2020 को प्राप्त किया था। अभ्यर्थी से प्राप्त पावती रसीद जिला निर्वाचन अधिकारी, बलौदाबाजार-भाटापारा द्वारा अपने दिनांक 15 मई, 2020 के पत्र सं0 127/सा.नि./नि.प./2020 के जरिए आयोग को प्रस्तुत कर दी गई है ;

नि./निर्वाचन व्यय/20208 के जरिए प्रस्तुत की गई अनुपूरक रिपोर्ट में यह बताया गया है कि श्री गोविंद साहू, ने आज की तारीख तक न तो कोई भी अभ्यावेदन और न ही अपने निर्वाचन व्यय का लेखा दाखिल किया है । इसके अतिरिक्त उन्होंने भारत निर्वाचन आयोग का सम्यक नोटिस मिलने के उपरांत भी उक्त विफलता के लिए न तो कोई कारण बताया है और न ही कोई स्पश्टीकरण दिया है ;

और यतः, आयोग का यह समाधान हो गया है कि श्री गोविंद साहू, निर्वाचन खर्चो का लेखा दाखिल करने मेें विफल रहे हैं और उनके पास इस विफलता के लिए कोई भी उचितकारण अथवा औचित्य नही है,

और यतः, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में अनुबंधित किया गया है कि :-

"यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति-

अतः, अब लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अनुसरण में भारत निर्वाचन आयोग एतद्‌द्वारा घोशणा करता है कि छत्तीसगढ़ राज्य के 44-कसडोल विधान सभा निर्वाचन क्षेत्र से छत्तीसगढ राज्य में विधान सभा के साधारण निर्वाचन, 2018 में निर्वाचन लडने वाले निर्दलीय अभ्यर्थी श्री गोविंद साहू, ग्राम-सकरी, पोस्ट-ससहा-तहसील-पलारी, जिला-बलौदाबाजार-भाटापारा, छत्तीसगढ, को इस आदेष की तारीख से तीन वर्श की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संध राज्य-क्षेत्र की विधान सभा अथवा विधान परिशद का सदस्य चुने जाने अथवा होने के लिए निरर्हित है ।

O.N. 216.—WHEREAS, the General Election to Legislative Assembly of Chhattisgarh, 2018 was announced by Election Commission of India vide Press Note No. ECI/PN/66/2018 dated 6th October, 2018. As per the schedule, Date of Counting was 11th December, 2018.

AND WHEREAS, as per the report dated 10th January, 2019 submitted by the District Election Officer, Balodabazar Bhatapara District, Chhattisgarh and forwarded by Chief Electoral Officer, Chhattisgarh vide letter No.21/4/LAEle./EEM/2019/85, dated 29th January, 2019, Sh.Govind Sahu, Independent contesting candidate from 44-Kasdol Assembly Constituency of Chhattisgarh, has failed to lodge any account of his election expenses as required by law.

AND WHEREAS, on the basis of the reports of the District Election Officer, Balodabazar Bhatapara District, Chhattisgarh and the Chief Electoral Officer, Chhattisgarh, a Show Cause Notice, dated 10th February, 2020 was issued by Election Commission of India under Sub Rule (5) of Rule 89 of the Conduct of Election Rules,1961 to Sh.Govind Sahu, for non-submission of Election expenses;

AND WHEREAS, as per Sub Rule(6) of Rule 89 of the Conduct of Election Rules, 1961, through the above said Show Cause Notice, dated 10th February, 2020, Sh.Govind Sahu, was directed to submit his representation in writing in the Commission explaining the reason for non-submission of accounts and also to lodge his accounts of election expenses/rectify the defects in his accounts and submit the same the District Election Officer concerned within 20 days from the date of receipt of the notice;

AND WHEREAS, the said notice was received by Sh. Govind Sahu, on 27th February, 2020. Acknowledgment receipt obtained from the candidate have been submitted to the Commission by District Election Officer, Balodabazar Bhatapara vide his letter No.127/Ele./Exp.Sec./2020 dated 15th May, 2020.

AND WHEREAS, in the supplementary report submitted by District Election Officer, Balodabazar Bhatapara vide his letter No.229/Ele./Ele.Exp./2020 dated 5th August, 2020 has stated that Sh.Govind Sahu, has not submitted any representation or his account of election expenses, duly signed along with original vouchers etc. till date. Further, he has furnished neither any reason nor explanation for the said failure even after receipt of the due notice to the Election Commission of India as well;

AND WHEREAS, the Commission satisfied that Sh.Govind Sahu, has failed to lodge an account of election expenses and has no good reason or justification for the failure;

AND WHEREAS, Section 10A of the Representation of the People Act, 1951 stipulates that :-

"If the Election Commission is satisfied that a person:

(i) Has failed to lodge an account of election expenses within the time and in the manner required by law or under this Act, and

NOW THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission of India hereby declares Sh.Govind Sahu, resident of Village-Sakari, Post-Sasha, Tahsil- Palari, District-Balodabazar Bhatapara, Chhattisgarh and the contesting Independent candidate for General Election to Legislative Assembly of Chhattisgarh, 2018 from 44-Kasdol Assembly Constituency of the state of Chhattisgarh to be disqualified for being chosen as and for being a member of either House of Parliament or the Legislative Assembly or Legislative Council of a State or Union Territory for a period of three years from the date of this order.
