आ.अ. 37.—यतः, वर्ष 2018 में आयोजित राजस्थान विधान सभा के साधारण निर्वाचन में 66-अलवर शहर विधान सभा निर्वाचन क्षेत्र से निर्वाचन लड़ने वाले अभ्यर्थी, श्री अजय कु मार पूनियां को लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अंतर्गत अपने निर्वाचन व्यय का लेखा दर्ज करने में असफल रहने के लिए आयोग के आदेश सं. 76/राज.-एल.ए./2018, दिनांक 12.11.2021 के जरिए उक्त आदेश की तिथि से तीन वर्ष की अवधि के लिए संसद केकिसी भी सदन अथवा राज्य की विधान सभा अथवा विधान परिषद का सदस्य चुने जाने अथवा होने के लिए निर्रर्हत कर दिया गया था। 3021 GI/2022 (95) ⁹⁶ THE GAZETTE OF INDIA : MAY ¹⁴, ²⁰²²/VAISAKHA ²⁴, ¹⁹⁴⁴ [PART II—SEC. ³(iii)] यतः, श्री अजय कु मार पूनियां ने आयोग को अभ्यावेदन दिनांक 23 फरवरी, 2022 प्रस्तुत किया है जिसमें, अन्य बातों के साथ-साथ, कहा गया है कि उन्होंने अपर जिला मजिस्ट्रेट, अलवर को अपना निर्वाचन व्यय का लेखा-जोखा दिनांक 11.01.2019 (निर्धारित समय के भीतर) प्रस्तुत कर दिया था और इसलिए, आयोग से अनुरोध किया था कि उन पर अधिरोपित निरर्हता हटा दी जाए।

यत: उनके द्वारा दिए गए निवेदन तथा जिला निर्वाचन अधिकारी, अलवर की अनुवर्ती रिपोटों और इस मामले के सभी अन्य तथ्यों और परिस्थितियों पर विचार करने के बाद अपीलीय प्राधिकारी ने 2 मई, 2022 को यह सकारण आदेश पारित किया है कि आदेश दिनांक 12.11.2021 के तहत उन पर अधिरोपित निरर्हता उक्त आदेश की अवधि की तारीख तक, जिसमें वह तारीख भी सम्मिलित है, कम कर दी जाए।

अब, इसलिए, श्री अजय कु मार पूनियां का नाम, जो आयोग के उक्त आदेश सं. 76/राज.-एल.ए./2018, दिनांक 12.11.2021 के क्रम संख्या 3 पर प्रकट है और जो भारत सरकार के राजपत्र तथा राजस्थान राज्य सरकार के राजपत्र में प्रकाशित है, उस अधिसूचना से दिनांक 3 मई, 2022 से हट जाएगा।

ELECTION COMMISSION OF INDIA

ORDER

New Delhi, the 2nd May, 2022

O.N. 37.—Whereas, Sh. Ajay Kumar Puniya contested candidate from 66-Alwar City Assembly Constituency for the General Election to the Legislative Assembly of Rajasthan, 2018 was disqualified vide Commission's order No. 76/RJ-LA/2018, dated 12.11.2021 for a period of three years from the date of said order for being chosen as, and for being a member of either House of Parliament or of the Legislative Assembly or Legislative Council of a State under Section 10A of the Reorientation of the People Act, 1951 for failure to the lodge his account of election expenses.

Whereas, Sh. Ajay Kumar Puniya has submitted a representation dated 23rd February, 2022 to the Commission stating inter-alia that he had submitted his election expenses to Additional District Magistrate, Alwar on 11.01.2019 (well within the stipulated time) and hence, requested the Commission to remove disqualification imposed on him.

Whereas, after considering the submission made by him and the subsequent reports of the District Election Officer, Alwar and all other facts and circumstances of the case, the appellate authority has passed a speaking order dated 2nd May 2022 that the disqualification imposed on him vide order dated 12.11.2021 be reduced to the period upto and including the date of the said order.

Now, therefore, the name of Shri Ajay Kumar Puniya appeared at Serial Number 3 of the Commission's said Order No. 76/RJ-LA/2018, dated 12.11.2021, published in the Gazette of Government of India as well as the Gazette of State Government of Rajasthan shall stand deleted from that notification with effect from 3rdMay, 2022.
