आ.अ. 76.—यतः, भारत निर्वाचन आयोग द्वारा बिहार राज्य मे विधान सभा के साधारण निर्वाचन 2020 की घोषणा प्रेस नोट संख्या ईसीआई/पी0.एन0./64/2020 दिनांक 25 सितम्बर, 2020 के जरिए की गई थी। कार्यक्रम के अनुसार, मतगणना की तारीख 10 नवंबर, 2020 थी।

और यतः लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 78 के अनुसार, निर्वाचन लड़ने वाले प्रत्येक अभ्यर्थी को, निर्वाचित अभ्यर्थी के निर्वाचन की तारीख से 30 दिनों के भीतर निर्वाचन व्यय के अपने लेखे की सही प्रति जिला निर्वाचन अधिकारी को दाखिल करनी होती है;

और यतः, जिला निर्वाचन अधिकारी, पूर्वी चम्पारण, बिहार द्वारा प्रस्तुत और संयुक्त मुख्य निर्वाचन अधिकारी, बिहार द्वारा अपने दिनांक 04 जनवरी, 2021 के पत्र सं.व्यय-21/2020(खंड-10)रक्सौल-46 के जरिए अग्रेषित दिनांक 10 दिसंबर, 2020 की रिपोर्ट के अनुसार श्री देवेंर कु मार सिंह, जो बिहार के 10– रक्सौल विधान सभा निर्वाचन क्षेत्र से निर्वाचन लड़ने वाले बिहार के राष्ट्र सेवा दल के अभ्यर्थी हैं, विधि द्वारा यथापेक्षित रीति से अपने निर्वाचन व्यय का कोई भी लेखा दाखिल करने में विफल रहे हैं।

और यतः, जिला निर्वाचन अधिकारी, पूर्वी चम्पारण, बिहार, और मुख्य निर्वाचन अधिकारी, बिहार की रिपोटों के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम 1961 के नियम 89 के उप नियम (5) के अंतर्गत निर्वाचन व्यय प्रस्तुत नहीं करने के लिए श्री देवेंर कु मार सिंह, को कारण बताओ नोटिस दिनांक 25 जून, 2021 जारी किया गया था;

और यतः, निर्वाचनों का संचालन नियम 1961 के नियम 89 के उप-नियम (6) के अनुसार, दिनांक 25 जून, 2021 के उपयु र्क्त कारण बताओ नोटिस के जरिए श्री देवेंर कु मार सिंह, को निदेश दिया गया था, कि वे इस नोटिस के प्राप्त होने के 20 दिनों के अंदर लेखा न प्रस्तुत कर पाने के कारणों को स्पष्ट करते हुए लिखित रूप में अपना अभ्यावेदन प्रस्तुत करें और साथ ही, निर्वाचन व्यय का अपना लेखा दाखिल करें;

और यतः, उक्त नोटिस श्री देवेंर कु मार सिंह, द्वारा दिये गये पते पर उनके भाई के द्वारा दिनांक 17 जुलाई, 2021 को प्राप्त किया गया था। पावती रसीद जिला निर्वाचन अधिकारी, पूर्वी चम्पारण, द्वारा अपने दिनांक 23 नवंबर, 2021 के पत्र संख्या 99/जिला0 निर्वा0 के जरिए आयोग को प्रस्तुत कर दी गई है;

और यतः, जिला निर्वाचन अधिकारी, पूर्वी चम्पारण, द्वारा अपने दिनांक 06 दिसंबर, 2021 के पत्र संख्या 113/निर्वा0 के जरिए प्रस्तुत की गई अनुपूरक रिपोर्ट में यह बताया गया है कि श्री देवेंर कु मार सिंह, ने आज की तारीख तक न तो कोई भी अभ्यावेदन और न ही अपने निर्वाचन व्यय का लेखा दाखिल किया है। इसके अतिरिक्त उन्होंने भारत निर्वाचन आयोग का सम्यक नोटिस मिलने के उपरांत भी उक्त विफलता के लिए न तो कोई कारण बताया है और न ही कोई स्पष्टीकरण दिया है;

और यतः, आयोग का यह समाधान हो गया है कि श्री देवेंर कु मार सिंह, निर्वाचन खचों का लेखा दाखिल करने में विफल रहे हैं और उनके पास इस विफलता के लिए कोई भी उचित कारण अथवा औचित्य नहीं है,

और यत:, लोक प्रतिनिधित्व अधिनियम,1951 की धारा 10क में अनुबंधित किया गया है कि:-

"यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति -

i. निर्वाचन व्ययों का लेखा उस समय के भीतर और उस रीति में जैसी इस अधिनियम के द्वारा या अधीन अपेक्षित है, दाखिल करने में असफल रहा है; तथा

ii. उस असफलता के लिए कोई अच्छा कारण या न्यायोचित्य नहीं रखता है, तो निर्वाचन आयोग शासकीय राजपत्र में प्रकाशित आदेश द्वारा उसको निर्रर्हत घोषित करेगा और ऐसा व्यक्ति उस आदेश की तारीख से तीन वर्ष की कालावधि के लिए निर्रर्हत होगा;

अतः, अब लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अनुसरण में भारत निर्वाचन आयोग एतद्द्वारा घोषणा करता है कि बिहार राज्य के 10- रक्सौल विधान सभा निर्वाचन क्षेत्र से बिहार राज्य में विधान सभा के साधारण निर्वाचन, 2020 में निर्वाचन लड़ने वाले बिहार राष्ट्र सेवा दल, के अभ्यर्थी श्री देवेंर कु मार सिंह, निवासी ग्राम- फु लवार गम्हरिया, पोस्ट आँफिस- फु लवार, थाना- बंजरिया, जिला- पूर्वी चम्पारण, बिहार। इस आदेश की तारीख से तीन वर्ष की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य-क्षेत्र की विधान सभा अथवा विधान परिषद का सदस्य चुने जाने अथवा होने के लिए निर्रर्हत है।

ELECTION COMMISSION OF INDIA

ORDER

New Delhi, the 17th May, 2022

O.N. 76.—WHEREAS, the General Election to the Legislative Assembly of Bihar, 2020 was announced by the Election Commission of India vide Press Note No. ECI/PN/64/2020, dated 25 September, 2020. As per the schedule, the date of counting of votes was 10 November, 2020.

AND, WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate at an election has to, within 30 days from the date of election of the returned candidate, lodge a true copy of the account of his election expenses with the District Election Officer;

AND, WHEREAS, the result of the said election along with 10-Raxual Assembly Constituency was declared by the concerned Returning Officer on 10th November, 2020. Hence, the last date for lodging the account of Election Expenses was 10th December, 2020;

AND WHEREAS, As per the report dated 10th December, 2020, submitted by the District Election Officer, East Champaran, Bihar and forwarded by the Joint Chief Electoral Officer, Bihar vide their letter No. Expenditure- 21/2020(Vol.-10)Raxual-46, dated 04 January, 2021, Shri Devendar Kumar Singh a contesting candidate of Rashtra Seva Dal of Bihar from 10-Raxual Assembly Constituency of Bihar, has failed to lodge account of his election expenses, in the manner, as required under law;

AND WHEREAS, on the basis of the reports of the District Election Officer, East Champaran, Bihar and the Chief Electoral Officer, Bihar, a Show-Cause notice, dated 25th June, 2021 was issued under sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India to Shri Devendar Kumar Singh, for not lodging the account of Election Expenses;

AND WHEREAS, As per the sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, through the above said Show-Cause Notice, dated 25th June, 2021, Shri Devendar Kumar Singh was directed to submit his representation in writing with explaining the reasons for not lodging the account and to lodge account of election expenses within 20 days from the date of receipt of the notice;

AND WHEREAS, the said notice was received by his brother on 17th July, 2021, at the address given by Shri Devendar Kumar Singh, The acknowledgment receipt has been submitted to the Commission by the District Election Officer, East Champaran, vide its letter no. 99/District.Nirva, dated 23 November, 2021;

AND WHEREAS, the District Election Officer, East Champaran, in his Supplementary Report, vide its letter No.113/Nirva., dated 06 December, 2021 has reported that Shri Devendar Kumar Singh, has neither submitted any representation nor any statement of account of election expenses till date. Further, after receipt of the due notice of the Election Commission of India, he has furnished neither any reason nor explanation for the said failure;

AND WHEREAS, the Commission is satisfied that Shri Devendar Kumar Singh, has failed to lodge the account of election expenses and has no good reason or justification for the failure,

AND WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that:-

"If the Election Commission is satisfied that a person-

i. has failed to lodge an account of election expenses, within the time and in the manner required by or under this

Act, and

ii. has no good reason or justification for the failure,

the Election Commission shall, by order published in the Official Gazette, declare him to be disqualified and

any such person shall be disqualified for a period of three years from the date of the order";

NOW, THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission of India hereby declares Shri Devendar Kumar Singh, resident of Village- Gamhariya, PO -Phulwar, Police station - Banjariya, District - East Champaran, Bihar and a contesting candidate from General Election to the Assembly Constituency of Bihar, 2020 of Rashtra Seva Dal, Bihar in 10-Raxual Assembly Constituency of the state of Bihar, to be disqualified for being chosen as and for being a member of either House of the Parliament or the Legislative Assembly or the Legislative Council of a State or Union Territory for a period of three years from the date of this order.

और यतः, जिला निर्वाचन अधिकारी, पूर्वी चम्पारण, बिहार, और मुख्य निर्वाचन अधिकारी, बिहार की रिपोटों के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम 1961 के नियम 89 के उप नियम (5) के अंतर्गत निर्वाचन व्यय प्रस्तुत नहीं करने के लिए उमंग कु मार गुप्ता, को कारण बताओ नोटिस दिनांक 25 जून, 2021 जारी किया गया था;

और यतः, जिला निर्वाचन अधिकारी, पूर्वी चम्पारण, बिहार द्वारा प्रस्तुत और संयुक्त मुख्य निर्वाचन अधिकारी, बिहार द्वारा अपने दिनांक 11 जनवरी, 2021 के पत्र सं.व्यय-21/2020(खंड-11)सुगौली-287 के जरिए अग्रेषित दिनांक 10 दिसंबर, 2020 की रिपोर्ट के अनुसार श्रीमती आशा देवी जो बिहार के 11– सुगौली विधान सभा निर्वाचन क्षेत्र से निर्वाचन लड़ने वाले बिहार के (हिन्दु समाज पार्टी) के अभ्यर्थी हैं, विधि द्वारा यथापेक्षित रीति से अपने निर्वाचन व्यय का कोई भी लेखा दाखिल करने में विफल रहे हैं।

और यतः, जिला निर्वाचन अधिकारी, पूर्वी चम्पारण, द्वारा अपने दिनांक 06 दिसंबर, 2021 के पत्र संख्या 114/निर्वा0 के जरिए प्रस्तुत की गई अनुपूरक रिपोर्ट में यह बताया गया है कि श्रीमती आशा देवी, ने आज की तारीख तक न तो कोई भी अभ्यावेदन और न ही अपने निर्वाचन व्यय का लेखा दाखिल किया है। इसके अतिरिक्त उन्होंने भारत निर्वाचन आयोग का सम्यक नोटिस मिलने के उपरांत भी उक्त विफलता के लिए न तो कोई कारण बताया है और न ही कोई स्पष्टीकरण दिया है;

Aasha Devi, has neither submitted any representation nor any statement of account of election expenses till date. Further, after receipt of the due notice of the Election Commission of India, he has furnished neither any reason nor explanation for the said failure;

और यतः, उक्त नोटिस श्री सत्यम यादव, द्वारा दिये गये पते पर उनके पिता जी से दिनांक 14 जुलाई, 2021 को प्राप्त किया गया था। पावती रसीद जिला निर्वाचन अधिकारी, पूर्वी चम्पारण, द्वारा अपने दिनांक 23 नवंबर, 2021 के पत्र संख्या 117/जिला0 निर्वा0 के जरिए आयोग को प्रस्तुत कर दी गई है;

और यतः, जिला निर्वाचन अधिकारी, पूर्वी चम्पारण, द्वारा अपने दिनांक 06 दिसंबर, 2021 के पत्र संख्या 103/निर्वा0 के जरिए प्रस्तुत की गई अनुपूरक रिपोर्ट में यह बताया गया है कि श्री सत्यम यादव, ने आज की तारीख तक न तो कोई भी अभ्यावेदन और न ही अपने निर्वाचन व्यय का लेखा दाखिल किया है। इसके अतिरिक्त उन्होंने भारत निर्वाचन आयोग का सम्यक नोटिस मिलने के उपरांत भी उक्त विफलता के लिए न तो कोई कारण बताया है और न ही कोई स्पष्टीकरण दिया है;

AND WHEREAS, on the basis of the reports of the District Election Officer, East Champaran, Bihar and the Chief Electoral Officer, Bihar, a Show-Cause notice, dated 25th June, 2021 was issued under sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India to Shri Satyam Yadav, for not lodging the account of Election Expenses;

AND WHEREAS, As per the sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, through the above said Show-Cause Notice, dated 25th June, 2021, Shri Satyam Yadav was directed to submit his representation in writing with explaining the reasons for not lodging the account and to lodge account of election expenses within 20 days from the date of receipt of the notice;

और यतः, जिला निर्वाचन अधिकारी, पूर्वी चम्पारण, द्वारा अपने दिनांक 06 दिसंबर, 2021 के पत्र संख्या 120/निर्वा0 के जरिए प्रस्तुत की गई अनुपूरक रिपोर्ट में यह बताया गया है कि श्री राज वंशी महतो, ने आज की तारीख तक न तो कोई भी अभ्यावेदन और न ही अपने निर्वाचन व्यय का लेखा दाखिल किया है। इसके अतिरिक्त उन्होंने भारत निर्वाचन आयोग का सम्यक नोटिस मिलने के उपरांत भी उक्त विफलता के लिए न तो कोई कारण बताया है और न ही कोई स्पष्टीकरण दिया है;

AND WHEREAS, As per the sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, through the above said Show-Cause Notice, dated 25th June, 2021, Shri Raj Vanshi Mahto was directed to submit his representation in writing with explaining the reasons for not lodging the account and to lodge account of election expenses within 20 days from the date of receipt of the notice;

AND WHEREAS, The notice was pasted on 18.07.2021 at his house by the office attendant on asking the villager at the address given by Shri. Raj Vanshi Mahto for not staying here. The acknowledgment receipt has been submitted to the Commission by the District Election Officer, East Champaran, vide its letter no. 106/District.Nirva, dated 23 November, 2021;

AND WHEREAS, the District Election Officer, East Champaran, in his Supplementary Report, vide its letter No.120/Nirva., dated 06 December, 2021 has reported that Shri Raj Vanshi Mahto , has neither submitted any representation nor any statement of account of election expenses till date. Further, after receipt of the due notice of the Election Commission of India, he has furnished neither any reason nor explanation for the said failure;

AND WHEREAS, the Commission is satisfied that Shri Raj Vanshi Mahto, has failed to lodge the account of election expenses and has no good reason or justification for the failure,

AND WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that:-

और यतः 21– ढाका विधान सभा निर्वाचन क्षेत्र सहित संबंधित रिर्टनंिग अधिकारी द्वारा उक्त निर्वाचन के परिणाम 10 नवंबर, 2020 को घोषित किए गए थे। इस प्रकार, निर्वाचन व्यय के लेखे दाखिल करने की अन्तिम तारीख 10 दिसम्बर, 2020 थी;

और यतः, जिला निर्वाचन अधिकारी, पूर्वी चम्पारण, बिहार द्वारा प्रस्तुत और संयुक्त मुख्य निर्वाचन अधिकारी, बिहार द्वारा अपने दिनांक 04 जनवरी, 2021 के पत्र सं.व्यय-21/2020(खंड-21)ढाका-44 के जरिए अग्रेषित दिनांक 10 दिसंबर, 2020 की रिपोर्ट के अनुसार एम.डी. कासिम अंसारी जो बिहार के 21– ढाका विधान सभा निर्वाचन क्षेत्र से निर्वाचन लड़ने वाले बिहार के निर्दलीय के अभ्यर्थी हैं, विधि द्वारा यथापेक्षित रीति से अपने निर्वाचन व्यय का कोई भी लेखा दाखिल करने में विफल रहे हैं।

और यतः, जिला निर्वाचन अधिकारी, पूर्वी चम्पारण, बिहार, और मुख्य निर्वाचन अधिकारी, बिहार की रिपोटों के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम 1961 के नियम 89 के उप नियम (5) के अंतर्गत निर्वाचन व्यय प्रस्तुत नहीं करने के लिए एम.डी. कासिम अंसारी, को कारण बताओ नोटिस दिनांक 25 जून, 2021 जारी किया गया था;

और यतः, निर्वाचनों का संचालन नियम 1961 के नियम 89 के उप-नियम (6) के अनुसार, दिनांक 25 जून, 2021 के उपयु र्क्त कारण बताओ नोटिस के जरिए एम.डी.कासिम अंसारी, को निदेश दिया गया था, कि वे इस नोटिस के प्राप्त होने के 20 दिनों के अंदर लेखा न प्रस्तुत कर पाने के कारणों को स्पष्ट करते हुए लिखित रूप में अपना अभ्यावेदन प्रस्तुत करें और साथ ही, निर्वाचन व्यय का अपना लेखा दाखिल करें;

और यतः, उक्त नोटिस एम.डी. कासिम अंसारी, द्वारा दिये गये पते पर उनके बङे पिता से दिनांक 18 जुलाई, 2021 को प्राप्त किया गया था। पावती रसीद जिला निर्वाचन अधिकारी, पूर्वी चम्पारण, द्वारा अपने दिनांक 23 नवंबर, 2021 के पत्र संख्या 107/जिला0 निर्वा0 के जरिए आयोग को प्रस्तुत कर दी गई है;

और यतः, जिला निर्वाचन अधिकारी, पूर्वी चम्पारण, द्वारा अपने दिनांक 06 दिसंबर, 2021 के पत्र संख्या 121/निर्वा0 के जरिए प्रस्तुत की गई अनुपूरक रिपोर्ट में यह बताया गया है कि एम.डी. कासिम अंसारी, ने आज की तारीख तक न तो कोई भी अभ्यावेदन और न ही अपने निर्वाचन व्यय का लेखा दाखिल किया है। इसके अतिरिक्त उन्होंने भारत निर्वाचन आयोग का सम्यक नोटिस मिलने के उपरांत भी उक्त विफलता के लिए न तो कोई कारण बताया है और न ही कोई स्पष्टीकरण दिया है;

और यतः, आयोग का यह समाधान हो गया है कि एम.डी. कासिम अंसारी, निर्वाचन खचों का लेखा दाखिल करने में विफल रहे हैं और उनके पास इस विफलता के लिए कोई भी उचित कारण अथवा औचित्य नहीं है,

और यत:, लोक प्रतिनिधित्व अधिनियम,1951 की धारा 10क में अनुबंधित किया गया है कि :-

"यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति —

O.N. 86.—WHEREAS, the General Election to the Legislative Assembly of Bihar, 2020 was announced by the Election Commission of India vide Press Note No. ECI/PN/64/2020, dated 25 September, 2020. As per the schedule, the date of counting of votes was 10 November, 2020;

AND, WHEREAS, the result of the said election along with 21-Dhaka Assembly Constituency was declared by the concerned Returning Officer on 10th November, 2020. Hence, the last date for lodging the account of Election Expenses was 10th December, 2020;

AND WHEREAS, As per the report dated 10th December, 2020, submitted by the District Election Officer, East Champaran, Bihar and forwarded by the Joint Chief Electoral Officer, Bihar vide their letter No. Expenditure- 21/2020(Vol.-21) Dhaka-44, dated 04 January, 2021, M.D. Kasim Ansari, a contesting candidate of Independent of Bihar from 21-Dhaka Assembly Constituency of Bihar, has failed to lodge account of his election expenses, in the manner, as required under law;

AND WHEREAS, on the basis of the reports of the District Election Officer, East Champaran, Bihar and the Chief Electoral Officer, Bihar, a Show-Cause notice, dated 25th June, 2021 was issued under sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India to M.D. Kasim Ansari, for not lodging the account of Election Expenses;

AND WHEREAS, As per the sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, through the above said Show-Cause Notice, dated 25th June, 2021, M.D. Kasim Ansari was directed to submit his representation in writing with explaining the reasons for not lodging the account and to lodge account of election expenses within 20 days from the date of receipt of the notice;

AND WHEREAS, the said notice was received by his big father on 18th July, 2021, at the address given by M.D. Kasim Ansari, The acknowledgment receipt has been submitted to the Commission by the District Election Officer, East Champaran, vide its letter no. 107/District.Nirva, dated 23 November, 2021;

AND WHEREAS, the District Election Officer, East Champaran, in his Supplementary Report, vide its letter No.121/Nirva., dated 06 December, 2021 has reported that M.D. Kasim Ansari, has neither submitted any representation nor any statement of account of election expenses till date. Further, after receipt of the due notice of the Election Commission of India, he has furnished neither any reason nor explanation for the said failure;

AND WHEREAS, the Commission is satisfied that M.D. Kasim Ansari, has failed to lodge the account of election expenses and has no good reason or justification for the failure,

AND WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that—

"If the Election Commission is satisfied that a person —

i. has failed to lodge an account of election expenses, within the time and in the manner required by or under

this Act, and

ii. has no good reason or justification for the failure,

the Election Commission shall, by order published in the Official Gazette, declare him to be disqualified and any such
