आ.अ. 88.—यतः, भारत निर्वाचन आयोग द्वारा दिनांक 10 मार्च, 2019 के प्रेस नोट सं. ईसीआई/ पीएन/23/2019 के तहत आंध्र प्रदेश विधान सभा, 2019 के 166-चंद्रागिरि विधानसभा निर्वाचन क्षेत्र के लिए साधारण निर्वाचन की घोषणा की गई थी; और
यत:, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 78 के अनुसार, निर्वाचन लड़ने वाले प्रत्येक अभ्यर्थी को निर्वाचित अभ्यर्थी के निर्वाचन की तारीख से 30 दिनों के भीतर अपने निर्वाचन व्यय के लेखे की एक सत्य प्रति संबंधित जिला निर्वाचन अधिकारी के पास दाखिल करनी होती है; और

(219)220 THE GAZETTE OF INDIA : JUNE 25, 2022/ASADHA 4, 1944 [PART II—SEC. 3(iii)] यतः, 166-चंद्रागिरि विधान सभा निर्वाचन क्षेत्र के लिए निर्वाचन का परिणाम, रिटर्निंग अधिकारी द्वारा दिनांक 23 मई, 2019 को घोषित किया गया था और इस प्रकार निर्वाचन व्यय के लेखे दाखिल करने की अन्तिम तारीख 22, जून, 2019 थी; और
यतः, जिला निर्वाचन अधिकारी, चित्तूर जिला, आंध्र प्रदेश, द्वारा प्रस्तुत दिनांक 29 जून, 2019 की रिपोर्ट के अनुसार, श्री/श्रीमती/कु ./सुश्री पलडुगु सुरेश, जो आंध्र प्रदेश के 166-चंद्रागिरि विधान सभा निर्वाचन क्षेत्र, 2019 से निर्वाचन लड़ने वाले अभ्यर्थी हैं, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 78 के तहत यथा अपेक्षित निर्वाचन के परिणाम की घोषणा की तारीख से 30 दिनों की निर्धारित अवधि के भीतर निर्वाचन व्यय का लेखा दाखिल करने में असफल रहे हैं (5 दिन का विलंब); और
यतः, जिला निर्वाचन अधिकारी चित्तूर की उक्त रिपोर्टों के आधार पर, भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (5) के अंतर्गत, श्री/श्रीमती/कु ./सुश्री पलडुगु सुरेश को विधि के अंतर्गत यथा विहित निर्धारित समय के भीतर निर्वाचन व्यय के लेखे प्रस्तुत नहीं करने के लिए कारण बताओ नोटिस सं. 76/एपी- एलए/2020/166, दिनांक 22 फरवरी, 2021 जारी किया गया था; और
यत:, उपयु र्क्त कारण बताओ नोटिस के जरिए और निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप- नियम (6) के अंतर्गत, श्री/श्रीमती/कु ./सुश्री पलडुगु सुरेश को नोटिस के प्राप्त होने की तारीख से 20 दिनों के अंदर जिला निर्वाचन अधिकारी, चित्तूर को विधि के अंतर्गत यथाविहित निर्धारित अवधि के भीतर लेखा प्रस्तुत न किए जाने संबंधी कारणों को स्पष्ट करते हुए आयोग को लिखित में अभ्यावेदन प्रस्तुत करने हेतु निदेश दिया गया था; और
यत:, जिला निर्वाचन अधिकारी, चित्तूर ने बताया है कि श्री/श्रीमती/कु ./सुश्री पलडुगु सुरेश को उक्त नोटिस दिनांक 10.03.2021 को तामील किया गया था; और
यत:, जिला निर्वाचन अधिकारी, चित्तूर ने अपनी दिनांक 19.08.2021 की अनुपरक रिपोर्ट में सूचित किया कि श्री/श्रीमती/कु ./सुश्री पलडुगु सुरेश ने विधि के अंतर्गत यथा विहित निर्धारित अवधि के भीतर निर्वाचन व्यय का लेखा दाखिल करने में असफल रहने के लिए भारत निर्वाचन आयोग को न तो कोई कारण बताया है और न ही कोई स्पष्टीकरण दिया है; और
यतः, श्री/श्रीमती/कु ./सुश्री पलडुगु सुरेश को आयोग का दिनांक 23.03.2022 का पत्र प्राप्त होने के 20 दिनों के भीतर आयोग के दिनांक 22.02.2021 के कारण बताओ नोटिस का उत्तर देने के लिए एक अंतिम अवसर दिया गया था जिसमें विफल रहने पर अभ्यर्थी लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अंतर्गत निरर्हित किए जाने हेतु दायी होगी।
यतः, जिला निर्वाचन अधिकारी, चित्तूर ने दिनांक 28.05.2022 को सूचित किया है कि आयोग का दिनांक 23.03.2022 का उक्त पत्र श्री/श्रीमती/कु ./सुश्री पलडुगु सुरेश को दिनांक 23.03.2022 को तामील किया गया था और जिला निर्वाचन अधिकारी, चित्तूर की दिनांक 28.05.2022 की अनुपूरक रिपोर्ट के अनुसार, श्री/श्रीमती/कु ./सुश्री पलडुगु सुरेश ने आयोग के दिनांक 22.02.2021 के नोटिस के जवाब में कोई लिखित स्पष्टीकरण नहीं दिया है; और
यत:, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में यह उपबंधित किया गया है कि:-
''यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व् यक्ति-
(क) निर्वाचन व्ययों का लेखा उस समय के भीतर और उस रीति में जैसी इस अधिनियम के द्वारा या अधीन अपेक्षित है, दाखिल करने में असफल रहा है; तथा
(ख) उस असफलता के लिए कोई अच्छा कारण या न्यायोचित्य नहीं रखता है,[भाग II—खण्ड 3(iii)] भारत का राजपत्र : जून 25, 2022/आषाढ़ 4, 1944 221 तो निर्वाचन आयोग शासकीय राजपत्र में प्रकाशित आदेश द्वारा उसको निरर्हित घोषित करेगा और ऐसा व् यक्ति
उस आदेश की तारीख से तीन वर्ष की कालावधि के लिए निरर्हित होगा।";
यत:, तथ्यों और उपलब्ध रिकार्डों के आधार पर आयोग का यह समाधान हो गया है कि श्री/श्रीमती/कु ./सुश्री
पलडुगु सुरेश विधि के अंतर्गत यथा विहित निर्धारित अवधि के भीतर निर्वाचन व्यय के लेखे दाखिल करने में असफल रहे हैं
और उनके पास ऐसा करने में असफल रहने के लिए कोई भी उचित कारण अथवा औचित्य नहीं है; और
अत:, अब, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अनुसरण में, भारत निर्वाचन आयोग एतद्द्वारा
घोषणा करता है कि विधान सभा के साधारण निर्वाचन, 2019 में आंध्र प्रदेश राज्य के 166-चंद्रागिरि विधान सभा
निर्वाचन क्षेत्र से निर्वाचन लड़ने वाले अभ्यर्थी, श्री/श्रीमती/कु ./सुश्री पलडुगु सुरेश, निवासी डी.नं. 3-4 कम्मापल्ली ग्राम
और पोस्ट, रामचंद्रपुरम मंडल, चित्तूर जिला, आंध्र प्रदेश इस आदेश की तारीख से तीन वर्ष की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य-क्षेत्र की विधान सभा अथवा विधान परिषद का सदस्य चुने जाने अथवा होने के लिए निरर्हित होंगे।

ELECTION COMMISSION OF INDIA
ORDER
New Delhi, the 16th June, 2022
O.N. 88.—WHEREAS, the General Election for 166-Chandragiri Assembly Constituency of Andhra Pradesh Legislative Assembly, 2019 was announced by the Election Commission of India vide Press Note No. ECI/PN/23/2019, dated 10th March, 2019; and
WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate has to lodge a true copy of his account of election expenses within 30 days with the concerned District Election Officer, from the date of election of the returned candidate; and
WHEREAS, the result of the election for 166-Chandragiri Assembly Constituency was declared by the Returning Officer on 23rd May, 2019 and hence the last date for lodging the account of Election Expenses was 22nd June, 2019; and
WHEREAS, as per the report dated 29th June, 2019 submitted by the District Election Officer, Chittoor District, Andhra Pradesh, Shri/Smt/Km/Ms. Paladugu Suresh, a contesting candidate from 166-Chandragiri Assembly Constituency, 2019 from Andhra Pradesh has failed to lodge account of election expenses, within the stipulated time of 30 days from the date of declaration of result of election as required under section 78 of the Representation of the People Act, 1951 (delay of 5 days); and
WHEREAS, on the basis of the said reports of the District Election Officer, Chittoor, a Show-Cause notice No. 76/AP-LA/2020/166, dated 22nd February, 2021 was issued under sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India to Shri/Smt/Km/Ms. Paladugu Suresh, for not lodging of account of Election Expenses within the stipulated time as prescribed under law; and
WHEREAS, through the above said Show Cause Notice and under sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, Shri/Smt/Km/Ms. Paladugu Suresh, was directed to submit representation in writing to the Commission explaining the reason for not lodging the account within the stipulated time as prescribed under law with the District Election Officer, Chittoor within 20 days from the date of receipt of the notice; and
WHEREAS, the District Election Officer, Chittoor, has reported that the said notice was served to Shri/Smt/Km/Ms. Paladugu Suresh , on 10.03.2021 ; and
WHEREAS, the District Election Officer, Chittoor in his supplementary report, dated 19.08.2021 reported that Shri/Smt/Km/Ms. Paladugu Suresh, has neither furnished any reason nor explanation to the Election Commission of India, for failure to lodge the account within the stipulated time as prescribed under law; and222 THE GAZETTE OF INDIA : JUNE 25, 2022/ASADHA 4, 1944 [PART II—SEC. 3(iii)] WHEREAS, a final opportunity was given to Shri/Smt/Km/Ms. Paladugu Suresh to furnish a reply to the Commission's Show Cause Notice dated 22.02.2021, within 20 days of the receipt of Commission's letter dated 23.03.2022, failing which the candidate will be liable to be disqualified u/s 10 A of the Representation of People Act, 1951; and
WHEREAS, the District Election Officer, Chittoor has reported on 28.05.2022 that the Commission's aforesaId letter dated 23.03.2022 was served to Shri/Smt/Km/Ms. Paladugu Suresh on 27.03.2022 and as per the District Election Officer, Chittoor's supplementary report dated 28.05.2022, Shri/Smt/Km/Ms. Paladugu Suresh has not furnished any written explanation in response to Commission's Notice dated 22.02.2021; and
WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that:-
"If the Election Commission is satisfied that a person-
(a) has failed to lodge an account of election expenses, within the time and in the manner required by or
under this Act, and
(b) has no good reason or justification for the failure, the Election Commission shall, by order published
in the Official Gazette, declare him to be disqualified and any such person shall be disqualified for a
period of three years from the date of the order.";
WHEREAS, on the basis of facts and available records, the Commission is satisfied that Shri/Smt/Km/Ms. Paladugu Suresh, has failed to lodge account of election expenses within the stipulated time as prescribed under law and has no good reason or justification for delay in lodge of account; and
NOW, THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission of India hereby declares Shri/Smt/Km/Ms. Paladugu Suresh, D. No. 3-4, Kammapalli Village & Post, Ramachandrapuram Mandal, Chittoor District, Andhra Pradesh and a contesting candidate from 166-Chandragiri Assembly Constituency of the State of Andhra Pradesh in the General Election to Legislative Assembly, 2019 to be disqualified for being chosen as and for being a member of either House of Parliament or the Legislative Assembly or Legislative Council of a State or Union Territory for a period of three years from the date of this order.
