का.आ. 585.—बैंककारी विनियमन अधिनियम, 1949 (1949 का 10) की धारा 53 की उप-धारा (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, के न्द्रीय सरकार, भारतीय रिजर्व बैंक की सिफारिश पर, एतद्द्वारा, यह घोषणा करती है कि उक्त अधिनियम की धारा 19 की उप-धारा (2) के उपबंध पंजाब नैशनल बैंक पर लागू नहीं होंगे, जहां तक इसका संबंध मिलेनियम सिटी एक्सप्रेसवेज प्राइवेट लिमिटेड की चुकता पू ंजी के 30% से अधिक की राशि की इसकी शेयरधारिता से है।

2. यह छू ट 31 मार्च, 2023 या इसके प्रतिसंहरित होने तक, जो भी पहले हो, लागू होगी।

2. This exemption shall be in force until 31st March, 2023 or till its revocation, whichever is earlier.

S.O. 589.—In exercise of the powers conferred by sub-section (1) of section 5 read with section 6 of the Delhi Special Police Establishment Act, 1946 (25 of 1946), the Central Government with the consent of the State Government of Uttar Pradesh, issued vide Notification No. 1691(5)/6-P-11-2021-12(116)B/2020 dated 16 December, 2021, Home (Police) Section-11, Lucknow, hereby extends the powers and jurisdiction of the members of the Delhi Special Police Establishment to the whole State of Uttar Pradesh for investigation into the offences(s) under section 67-B of the Information Technology Act, 2000 (21 of 2000) alleged to have been committed by Shri Rambhawan S/o Late Chunna Prasad R/o Jawahar Nagar, Naraini, District Banda, Uttar Pradesh working as Junior Engineer in Irrigation Department of Government of Uttar Pradesh at Chitrakoot, Uttar Pradesh by indulging in immoral practices of publishing/ transmitting obscene material including the material depicting children in sexually explicit act in electronic form over the internet in connivance with one Shri Sawkare Rajkumar Hemkant, R/o Jalgaon, Maharashtra from the year 2015-16 onwards and any attempt, abetment and/or conspiracy, in relation to or in connection with such offence(s) and/or for any other offence committed in the course of the same transaction or arising out of the same facts.

—केन्द्रीय सरकार ने, पेट्रोलियम और खनिज पाइपलाइन (भूमि में उपयोग के अधिकार का अर्र्र्र्जन) अधिनियम, 1962 (1962 का 50) (जिसे इसमें इसके पश्चात उक्त अधिनियम कहा गया है) की धारा 3 की उपधारा (1) के अधीन जारी की गई शरत सरकार के पेट्रोलियम और प्राकृतिक गैस मंत्रालय की अधिसूचना संख्या का.आ. 1326 तारीख 11 जुलाई 2019, जो शरत के राजपत्र क्रमांक 30, ता. 27 जुलाई 2019 ओर, का.आ. 9 ता. 05 जनवरी 2021, जो शरत के राजपत्र क्रमांक 01, ता. 09 जनवरी 2021 में प्रकाशित की गई थी उस अधिसूचना से संलग्न अनुसूची में विनिर्दिष्ट भूमि में हाइडे्राकार्बन के परिवहन के लिए मुन्द्रा भटिंडा विस्तृतिकरण पाइपलाइन त्रगडी सें गुंदाला तक के मार्ग मे अेच. पी. सी. अेल. - मित्तल पाइपलाइन्स लिमिटेड, मुन्द्रा जिल्ला कच्छ गुजरात राज्य द्वारा पाइपलाइन बिछाने के प्रयोजन के लिए उपयोग के अधिकार के अर्जन के अपने आशय की घोषणा की थी :

और उक्त राजपत्र अधिसूचना की प्रतियॉं जनता को तारीख 5 अक्तूबर, 2019 और 15 जुन 2021 तक उपलब्ध करा दी गई थी ;

और सक्षम अधिकारी द्वारा पाइपलाइन बिछाने के विरुद्ध जनता से प्राप्त आपत्तियों पर विचार करने के बाद स्वीकार किया और निरस्त कर दिया ;

और सक्षम अधिकारी ने उक्त अधिनियम की धारा 6 की उप-धारा (1) के आधिन केन्द्रीय सरकार को रीपोर्ट दे दी है।

और केन्द्रीय सरकार ने उक्त रीपोर्ट पर विचार करने के पश्चात और यह समाधान हो जाने पर कि उक्त भूमि हाइडे्राकार्बन के परिवहन के लिए मुन्द्रा भटिंडा विस्तृतिकरण पाइपलाइन त्रगडी सें गुंदाला तक के लिए अपेक्षित है, उसमें उपयोग के अधिकार का अर्जन करने का निश्चय किया है ;

अतः अब, केन्द्रीय सरकार, उक्त अधिनियम की धारा 6 की उप-धारा (1) द्वारा प्रदत शक्तियों का प्रयोग करते हुए यह घोषित करती है कि इस अधिसूचना से संलग्न अनुसूची में विनिर्दिष्ट उक्त भूमि हाइडे्राकार्बन के परिवहन मुन्द्रा भटिंडा विस्तृतिकरण पाइपलाइन के लिए उपयोग का अधिकार का अर्जन किया जाए ;

और केन्द्रीय सरकार, उक्त धारा अधिनियम की धारा 6 की उप-धारा (4) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, यह निर्देश देती है के उक्त भूमि में उपयोग का अधिकार, ईस घोषणा के प्रकाशन की तारीख से केन्द्रीय सरकार मे निहित होने की बजाय, सभी विल्लंगमों से मुक्त हो कर अेच. पी. सी. अेल. - मित्तल पाइपलाइन्स लिमिटेड, मुन्द्रा जिल्ला कच्छ गुजरात राज्य में निहित होगा ।

पेट्रोलियम और खनीज पाइपलाइन अधिनियम, 1962 की धारा 10 के आधीन किसी भी क्षतिपुर्ति के लिए अेच. पी. सी. अेल. - मित्तल पाइपलाइन्स लिमिटेड, मुन्द्रा जिल्ला कच्छ गुजरात राज्य, पूर्णतया उत्तरदाई होगी और पाइपलाइन से संबंधित किसी भी मामले पर केन्द्रीय सरकार के विरुद्ध कोई वाद दावा या कानुनी कार्यवाही नही हो सकेगी ।

S.O. 607.—Whereas by the notification of the Government of India in the Ministry of Petroleum and Natural Gas vide S.O. No. 1326 , dated 11th July, 2019 and S.O. No 9 dated 5th January 2021, issued under subsection (1) of section 3 of the Petroleum and Minerals Pipelines (Acquisition of Right of User in Land) Act, 1962 (50 of 1962), (hereinafter referred to as the said Act), Published in the Gazette of India No. 30 dated 27th July 2019, and No. 01 deted 9th January 2021. The Central Government declared its intention to acquire the right of user in the land specified in the Schedule appended to the notification for the purpose of the transportation of Hydrocarbon through Mundra - Bhatinda extension pipeline from village Tragadi, Taluka Mandvi, District Kutch to Gundala route taluka Mundra, District Kutch, State Gujarat through HPCL Mittal Pipelines Limited, Mundra, District Kutch of Gujarat state.

And whereas the copies of the said Gazette notification were made available to the public up to 5th Oct, 2019 & 15th June, 2021;

And whereas, the objections received from the public to the pipeline have been considered and disallowed by the Competent Authority,

And whereas the Competent Authority has under sub-section (1) of section 6 of the said Act submitted his report to the Central Government;

And where as the central Government, after considering the said report and on being satisfied that the said land is required for the purpose of transportation of Hydrocarbon through Mundra-Bhatinda extension pipeline from village Tragadi, Taluka Mandvi, District Kutch to Gundala taluka Mundra, District Kutch, State Gujarat has decided to acquire right of user therein;

Now, therefore, in exercise of the powers conferred by sub-section (1) of the section 6 of the said Act, the Central Government hereby declares that the rights of user in land specified in the Schedule appended to this notification is hereby required for the purpose of transportation of Hydrocarbon through Mundra - Bhatinda extension pipeline;

And further in exercise of the powers conferred by sub-section (4) of section 6 of the said Act, the Central Government hereby directs that the right of user in the said land required for the purpose of transportation of Hydrocarbon through Mundra - Bhatinda extension pipeline from village Tragadi, Taluka Mandvi, District Kutch to Gundala taluka Mundra, District Kutch, State Gujarat, pipeline shall, instead of vesting in the Central Government, vest on the date of publication of the declaration, in the HPCL Mittal Pipeline Limited, Mundra, District Kutch of Gujarat state, free from all encumbrances.

HPCL Mittal Pipelines Limited, Mundra, District Kutch of Gujarat state shall be exclusively liable for any compensation in terms of Section 10 of the P & MP Act, 1962 and no suit, claim or legal proceeding would lie against the Central Government on any matter relating to the pipeline.

1. On receipt of the Order No. L-20012/445/95-IR(C-I) dt.02.01.1997 of the reference from the Government of India, Ministry of Labour & Employment, New Delhi for adjudication of the dispute, it was registered as Reference case No. 07 of 1997 on 31.01.1997 and awaiting for Written Statement of Claim for filing by the Union which was filed on 04.08.1997 to enable the Tribunal to start proceeding.

2. Consequent upon filing of the written statement of Claim so staked by the Union on the matter under Reference the proceeding was set rolling before the Tribunal for proceeding .Ld. Advocate for the management also filed counter claim on the matter on behalf of the Management .With this matter advanced further for adjudication .In course of the hearing both sides exhibited documents in context of their respective claim and filed relevant documents out of which some stand exhibited whereas some remained unexhibited. Workmen side representation was not noticed since 30.04.2008. But proceeding abruptly stalled over evidence of the management which remain inconclusive till passing of this Award under Reference.

3. The brief fact of the matter as per written statement of claim filed by workman side is simply that the workmen concerned as per reference of the instant Industrial Dispute Case have not been prompted to higher Grade/Pay Sale despite they are eligible and entitled for such promotion .

4. Contrary to the claim of the workmen the Management side through their written statement –cum- rejoinder have put forward their justification for not promoting the concerned workmen to higher Grade with following submission/explanation

I) The concerned workmen were promoted to Grade D during July to October,1988 from their Grade E on the basis of recommendation made by Departmental Promotion Committee to fill up the Grade –III Post in Excavation Grade.

II) For the purpose of adjudging suitability for promotion from Grade III workmen in excavation Cadre to Grade II workers, a Departmental Promotion Committee is constituted and a trade test are conducted. And after observing the results they are considered for their selection in order of merit by assessing Seniority, suitability and merit of the different candidates.

III) As per existing number of vacancies in Grade C such number of excavation workers in Grade III are considered promoted to fill up such vacant posts. Accordingly to availability of vacancies in Grade C and considering all eligible candidates .The selection is made according to the different categories fixed for preparation of the list of such candidates in striatum. The Senor Most person in the list are selected and promoted and rest of the persons mentioned in the panel are not promoted.

IV) The concerned workmen has not made any grievance against any Departmental Promotion Committee, violation of any Cadre Scheme, any grievance against any member of the DPC and any grievance on their suppression. The only grievance presently is for their promotion after completion of minimum eligibility period.

V) The demand of the Sponsoring Union is obviously absurd and contrary to all the existing norms with regard to promotion of excavation worker in Grade III to Grade II and as such the demand is liable to be summarily rejected.

5. Against the counter submission made by Management side the workmen side has simply blamed the Management that the employer has adopted unfair labour practice by promoting undeserving junior candidates. It is wrong to suggest that employer followed any criteria in selecting workmen for promotion. The concerned workmen have always raised for violation of Cadre Selection .i.e., that of against the Departmental promotion Committee.

6. Although witness from the Management side have been examined and cross examined but of any conclusive finding.

7. The Exhibited documents from the workmen side as available in the case file W-1 to W-3 are not relevant as they are the copies of Office Orders on regularization/promotion from one Grade to another. These do not substantiate their claim of any unfair labour practice by the Management.

8. The Management side has also filed list of documents copy of the office orders for promotion/regularization and dispute raised before Asstt. Labour commissioner (C) on regularization and promotion.

9. The witness and documents filed by the workmen side have not been able to substantiate their claim and counter to the submissions made by the management side. In that workmen side has not been able to prove that the Management does not follow any established norms for promotion through Departmental Promotion committee and that they have made any representation to the management against their non-promotion citing the copies of promotion orders filed and exhibited.

10. In contrast to the claim of the workmen ,the Management has been able to prove their submission that the promotion are made on recommendation of the Departmental Promotion Committee after considering the required factors as Exhibited through the copies of promotion orders filed.

11. It has also been found the failure of the representation by the workmen side as the matter proceeded for ex-parte hearing. However, on representation of the workmen side, the Tribunal proceeded for hearing and evidence from both sides on 07.10.2002 again.

12. Despite giving opportunity to the workmen side for hearing the workmen side instead of proceeding ex- parte.the workmen side has failed to appear and represent in the proceedings after 2008.They remained absent also on the last date of hearing on 26.08.2021.

13. On the face of non-representation by the workmen side for more than 13 years on several dates of hearing despite giving opportunity to them and also notices issued through Registered posts and that the Tribunal does not think fit to interfere in the responsibility, duties, powers and function of the Departmental Promotion committee in the absence of any finding on malafide of the DPC. the claim of the workmen lacks merit.

14. Accordingly, it is decided that the workmen concerned with the instant Industrial Dispute Reference No. 07/1997 do not deserve any relief and so awarded no relief.

If not, to what relief is the concerned workman entitled to?

1. On receipt of the Order No. L-20012/432/96-IR (Coal-I) dt.20.02.1998 of the reference from the Government of India, Ministry of Labour & Employment, New Delhi for adjudication of the dispute, it was registered as Reference case No. 49 of 1998 on 16.03.1998 and accordingly an order to that effect was passed to issue notices through the Registered Post to the parties concerned, directing them to appear before the Tribunal on the date fixed and to file their written statements along with the relevant documents.

2. Consequent upon registration of the Industrial Dispute as Ref. No. 49 of 1998 as referred by the Government of India vide its No. L-20012/432/96-IR(Coal-I) dated 20.02.1998 the case was set in rolling on with filing of the Written Statement and subsequent counter claim by the Management of Govindpur Area No. III of M/s BCCL, Dhanbad, on 15.06.1998 and 02.08.1999 respectively , which was followed by rejoinders .The matter advanced on merit after holding the domestic enquiry as fell short of fair and proper. .But the proceeding came to halt over the evident of the Management since 01.09.2005.As evident from the record of the proceeding it went almost unrepresented by either side of the parties as barely made a few scanty appearances. Even after fresh revival attempt by the Tribunal failed to serve the purpose before it had closed for final order in the event of default so as to answer the Reference.

3. Neither the workman nor the Representative of the management appeared on fixed date 26.08,2021 to deal with issue relating to evidence of the Management hanging since long back with no sign of progress in sight. The case was fixed for hearing on merit on 26.08.2021 but both the parties remained absent as for all the past dates. Neither the parties nor their Ld. Advocates appeared for further proceedings in the case for past several dates. Sufficient opportunity was given to the parties to proceed with final hearing of the case but of no good.

4. It is apparently clear from the records that even after sufficient suo motu adjournments granted likewise on 24.06.2008,30.04.2013 27.06.2013 and ,29.07.2013 on the same matter and, in fresh revival attempts on 18.04.2019 and 08.5.2019, no further proceeding could take place and, based on available facts and materials on record the hearing was concluded on 26.08.2021.

The case being belated one is related to alleged dismissal of the workman ( (S.R.Tiwari ) by the Management of the General Manager, Govindpur Area No. III of the M/s BCCL seeking relief by the workman challenging the alleged action of the management through adjudication.

The case matter needs of paramount settlement as the matter was already placed twice before the Lok Adalat on 25.02.2008 and 27.5.2013 for out of Court Settlement but no fruitful result could be achieved nor did the matter move even an inch despite best efforts. Notable to mention here the Tribunal vide its order dt 01.09.2005 had declared the domestic enquiry so conducted against the workman by the Management null and void as the O.P./Management failed to prove the fact with any documents. Despite the same, the matter attributed to the sheer disinterestedness of the workman which led the Industrial Dispute as non-existent on merit whatsoever.

5. Having gone through the materials on record and lack of merits attributed to sheer disinterestedness of the workman in a shark contradiction to the fact that the Tribunal vide its order dt. 01.09.2005 declared the domestic enquiry conducted against the workman was not fair and proper as the O.P./Management failed to prove the alleged enquiry with relevant document . Despite above favourite position for workman was failed to take this situation to logical end for him getting relief. In such condition Tribunal has no alternative but to conclude that let this case be disposed of on the line of the decision that there exists no dispute between the parties at present.

6. With the Instant Industrial Dispute hovering over same issue for years together, there is no longer justification being felt to continue/sustain the proceedings specifically in the absence of appearances , as the case has been rolling out on the same status since 01.09.2005. The matter badly delayed deserves to be closed in the line of the natural justice in the light of ample adjournments granted suomottus over one stage and even fresh revival of the case on 18.04.2019 and on 08.05.2019 has almost proved of no use. The Industrial Dispute appears to have lost its merits or the footing on which issue has been raised. The dispute is thus disposed of accordingly as the Industrial Dispute by and between the parties is no more and as being treated as non-existent .The entire proceedings stand disposed of forthwith with no relief appears to be seeking for redressal from the Management.

On receipt of the Order No. L-20012/603/97 I.R.(C-I) dated 13.04.1998 of the reference from the Government of India, Ministry of Labour & Employment, New Delhi for adjudication of the dispute, it was registered as Reference1230 THE GAZETTE OF INDIA : JUNE 25, 2022/ASADHA 4, 1944 [PART II—SEC. 3(ii)] case No. 109 of 1998 on 23.04.1998 and accordingly an order to that effect was passed to issue notices for 12.01.199 for further proceedings.

3. The matter proceeded with filing of claim by the workman side and countering the claim of the workman side by the O.P./Management along with relevant documents in support of their contention .During the proceeding deposition was also recorded by the workman and cross examined by the Management side .The proceeding remained stalled after 26.03.2008 and resumed only on 18.04.2019. No development for the proceeding is found available on record meaning thereby the workman side might have lost interest to proceed with their claim otherwise the matter would have taken up for hearing during gap of the more than eleven years, On 18.05.2019 on the date of resumed hearing after long gap Mr.Dilip Chakrabotry ,Area Secretary of the Sponsoring Union appeared and made submission that the concerned workman has already retired from service in the years 2002 and is not interested to proceed with hearing of the case any further.

4. Although the workman side was directed to file written petition to the effect of statement given by Area Secretary of the Sponsoring Union but no such petition in writing could be filed by the workman side. The matter was again taken up for hearing on 03.12.2019, 15.01.2020 and 26.08.2021 after issue of notices to both the parties for hearing in the matter. However, none appeared nor any representation received from the workman side in the matter. Similar was situation with the O.P./Management side.

5. Under the circumstances as narrated above when the workman side did not show interest in appearance or representing their case matter despite opportunities provided shows truthness to the statement given by the Area Secretary of the Sponsoring Union that the workman is not interested for further proceeding in the matter as he has already retired in the year 2002.

6. As such it can be safely concluded that the dispute as per reference Industrial Dispute No. 109/98 has lost its status as dispute to exist anymore and so deserves to be awarded as no claim and so no claim award is passed.

7. Let the copy of the Award be sent to the Appropriate Government as required under the Act for publication.

In pursuance of the said order, notices by the Registered Post were sent to the parties concerned for submission of claim statement as per provisions of the said reference.

The fact from the record transpires in the written statement of claim submitted by the workman through sponsoring Union that Satrughan Bouri, M/Loader was working at Ena Colliery under Kustore Area of M/s Bharat Coking Coal Ltd. on permanent vacancy. On account of his illness the workman stopped attending duty and remained absent for more than four months. As stated in the claim the Management initiated necessary proceedings and dismissed the workman from service w.e.f. 08.05.1992 even after unblemished service track of record against which this Industrial Dispute raised. As there were several irregularities found in conducting the said inquiry followed by several representations to the Local and Area Managements for the resumption of duty by the workman but of no use. In conciliation the Management did not allow the workman for resumption of duty which has resulted in failure of conciliation and subsequent birth of the Reference..The workman pray for resumption for duty with all consequential reliefs with fringe benefits from the date of dismissal.

4. Whereas the O.P./management counter claim in the petition stated that the present dispute of the workman are false, unfounded, improper and unjustified. With categorically denials of the claim point wise by the O.P./Management with specific statement that the workman was absenting from duty w.e.f. 21.1.1991 without any information or any sanctioned leave prior to absenting his duty which constitute the misconduct on the part of a workman. Further submission in the Written Statement of the O.P./Management is that the workman did not turn up to participate in the said enquiry either personally or through his representative which tantamount the wilful negligence of the workman as the workman was the habitual absentee. Due to his habitual absentism he was issued charge sheets earlier also dated 07.05.1990,19.06.1990 and 17.04.1991 for the same alleged charges for absenting from duty without any permission, leave and information to Controlling Authority .On each such occasion of proceeding on his request minor penalty was given on leniency and allowed him to continue in the service. So the workman is not entitled for any direction for resumption of duty as well as any relief like full wages from the date of dismissal.

6. No document relating to the case matter to counter the contention with documentary support of the Management was filed either by the workman or by the Union itself till closing of hearing in this Case.

7. Ever since 2015 the representation of the workman was not noticed as workman did not take any initiative nor he was able to substantiate his contention stopped participating into the proceedings in regular course.

As the workman side failed to represent since 2015 in regular course of hearing the Tribunal finds no need to go further in interfering the matter of the cause of action under Sec. 11- A of the I.D. Act 1947 which apparently show that either the workman has no point to prove his claim or workman is not interested to contest on merit. The Tribunal does not find any merit in the claim of the written statement of claim as made out by the workman in the background of the submissions made by the Management with documentary evidences. Under the facts and materials available on record there is no convincing evidence /materials of the Union/petitioner for which the claim could be held justifiable .The conduct and gesture and inaction on the part of the workman for last several years assume significance that the workman lost the interest to proceed with the case .

9. In view of the above foregoing factual position, the Tribunal is constrained to hold that adjudication is not pending any more, when the petitioner is no longer interested. The Industrial Dispute between the parties to this case has turned meritless. So the instant proceedings stands disposed of by virtue of sheer reluctance of the workman. Notably the workman does not qualify to get any relief in the instant Reference No. 09-1998 and so awarded no relief.
