आ.अ. 133.—यतः, भारत निर्वाचन आयोग द्वारा मध्य प्रदेश राज्य की लोकसभा के साधारण निर्वाचन, 2019 की घोषणा प्रेस नोट संख्या ईसीआई/प्रे.नो./23/2019 दिनांक 10.03.2019 के जरिए की गई थी। कार्यक्रम के अनुसार, मतगणना की तारीख 23.05.2019 थी।

और यत:, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 78 के अनुसार, निर्वाचन लड़ने वाले प्रत्येक अभ्यर्थी को, निर्वाचित अभ्यर्थी के निर्वाचन की तारीख से 30 दिनों के भीतर निर्वाचन व्यय के अपने लेखे की सही प्रति जिला निर्वाचन अधिकारी को दाखिल करनी होती है;

और यतः, मुख्य निर्वाचन अधिकारी, मध्य प्रदेश के दिनांक 26.06.2019 के पत्र सं. 10-क/लो.स.2019/ चार/निर्वा.व्यय/सीधी/13598 द्वारा अग्रेषित जिला निर्वाचन अधिकारी, सीधी जिला, मध्य प्रदेश द्वारा दिनांक 25.06.2019 को प्रस्तुत रिपोर्ट के अनुसार श्री धीरेन्द्र कु मार, मध्य प्रदेश के 11-सीधी लोकसभा निर्वाचन क्षेत्र से निर्वाचन लड़ने वाले निर्दलीय अभ्यर्थी, अपने निर्वाचन व्यय का कोई भी लेखा दाखिल करने में असफल रहे ।

और यतः, जिला निर्वाचन अधिकारी, सीधी जिला, मध्य प्रदेश की रिपोर्ट के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप नियम (5) के अंतर्गत निर्वाचन व्यय प्रस्तुत नहीं करने के लिए श्री धीरेन्द्र कु मार को कारण बताओ नोटिस दिनांक 25.09.2019 को जारी किया गया था;

और यत:, निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (6) के अनुसार, दिनांक 25.09.2019 के उपयु र्क्त कारण बताओ नोटिस के जरिए श्री धीरेन्द्र कु मार को निदेश दिया गया था कि वे इस नोटिस के प्राप्त होने के 20 दिनों के अंदर आयोग में लेखे न प्रस्तुत कर पाने के कारणों को स्पष्ट करते हुए लिखित रूप में अपना अभ्यावेदन प्रस्तुत करें और साथ ही, पूर्ण निर्वाचन व्यय का लेखा संबंधित जिला निर्वाचन अधिकारी को प्रस्तुत करें;

और यत:, उक्त नोटिस उनके द्वारा 28.02.2020 को प्राप्त किया गया था । अभ्यर्थी से प्राप्त पावती रसीद जिला निर्वाचन अधिकारी, सीधी द्वारा दिनांक 27.02.2020 के पत्र संख्या 149/निर्वाचन/2020-21 द्वारा आयोग को प्रस्तुत कर दी गई थी;

और यत:, जिला निर्वाचन अधिकारी, सीधी द्वारा अपने दिनांक 03.02.2021 के पत्र सं. 68/निर्वाचन/2020-21 के तहत प्रस्तुत की गई अनुपूरक रिपोर्ट में यह बताया गया है कि श्री धीरेन्द्र कु मार ने आज की तारीख तक न तो कोई भी अभ्यावेदन और न ही मूल वाउचरों आदि के साथ विधिवत रूप से हस्ताक्षरित अपने निर्वाचन व्यय के सही लेखे का विवरण प्रस्तुत किया है। इसके अतिरिक्त, उन्होंने भारत निर्वाचन आयोग का सम्यक् नोटिस मिलने के उपरांत भी उक्त असफलता के लिए न तो कोई कारण बताया है और न ही कोई स्पष्टीकरण दिया है;

और यत:, आयोग का यह समाधान हो गया है कि श्री धीरेन्द्र कु मार, निर्वाचन व्यय का लेखा दाखिल करने में असफल रहे हैं और उनके पास इस असफलता के लिए कोई भी उचित कारण अथवा न्यायोचित्य नहीं है;

और यत:, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में अनुबंधित किया गया है कि:-

''यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति-

(क) निर्वाचन व्ययों का लेखा उस समय के भीतर और उस रीति में जैसी इस अधिनियम के द्वारा या अधीन अपेक्षित है, दाखिल करने में असफल रहा है; तथा

(ख) उस असफलता के लिए कोई अच्छा कारण या न्यायोचित्य नहीं रखता है, तो निर्वाचन आयोग शासकीय राजपत्र में प्रकाशित आदेश द्वारा उसको निरर्हित घोषित करेगा और ऐसा व्यक्ति उस आदेश की तारीख से तीन वर्ष की कालावधि के लिए निरर्हित होगा;

अत:, अब लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अनुसरण में भारत निर्वाचन आयोग एतद्द्वारा, मध्य प्रदेश राज्य की विधान सभा के साधारण निर्वाचन, 2018 के 11-सीधी विधान सभा निर्वाचन क्षेत्र से निर्वाचन लड़ने वाले निर्दलीय अभ्यर्थी, श्री धीरेन्द्र कु मार, निवासी ग्राम – हिरवार, पोस्ट – कु ऑ, तहसील – ब्यौहारी, जिला – शहडोल, (म.प्र.), को संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य क्षेत्र की विधानसभा अथवा विधान परिषद् के लिए सदस्य चुने जाने अथवा होने के लिए इस आदेश की तारीख से तीन वर्ष की अवधि के लिए निरर्हित घोषित करता है।

ELECTION COMMISSION OF INDIA

ORDER

New Delhi, the 20th May, 2022

O.N. 133.—WHEREAS, the General Election to the Lok Sabha in the state of Madhya Pradesh, 2019 was announced by Election Commission of India vide Press Note No ECI/PN/23/2019 dated 10.03.2019. As per the schedule, the Date of Counting of votes was 23.05.2019.

AND WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate has to lodge a true copy of his account of election expenses within 30 days with the District Election Officer, from the date of election of returned candidate;

AND WHEREAS, the result of 11-Sidhi Parliamentry Constituency was declared by the Returning Officer concerned on 23.05.2019. As such the last date for lodging of account of election expenses was 22.06.2019.

AND WHEREAS, as per the report dated 25.06.2019 submitted by the District Election Officer, Sidhi District, Madhya Pradesh and forwarded by Chief Electoral Officer, Madhya Pradesh vide letter No.10-A/ HP2019/Four/ Elec.Expenditure/Sidhi/13598 dated 26.06.2019, Shri Dheerendra Kumar, contesting Independent candidate from 11-Sidhi Parliamentry Constituency of Madhya Pradesh, failed to lodge any account of his election expenses.

AND WHEREAS, on the basis of the report of the District Election Officer, Sidhi District, Madhya Pradesh, a Show Cause notice dated 25.09.2019 was issued by the Election Commission of India under Sub Rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 to Shri Dheerendra Kumar for non submission of accounts of Election expenses;

AND WHEREAS, as per Sub Rule(6) of Rule 89 of the Conduct of Elections Rules, 1961, through the above said Show Cause Notice dated 25.09.2019, Shri Dheerendra Kumar was directed to submit his representation in writing to the Commission explaining the reason for non submission of accounts and also to lodge his complete accounts of election expenses to the District Election Officer concerned within 20 days from the date of receipt of the notice;

AND WHEREAS, the said notice was received by him on 28.02.2020. Acknowledgment receipt obtained from the candidate have been submitted to the Commission by District Election Officer, Sidhi vide his letter No. 149/Election/2020-21 dated 27.02.2020.

AND WHEREAS, in the supplementary report submitted by District Election Officer, Sidhi vide his letter No. 68/Election/2020-21 dated 03.02.2021 it has been stated that Shri Dheerendra Kumar has not submitted any representation or a statement of correct account of his election expenses, duly signed along with original vouchers etc. till date. Further, he has neither furnished any reason nor explanation for the said failure even after receipt of the due notice to the Election Commission of India as well;

AND WHEREAS, Commission is satisfied that Shri Dheerendra Kumar has failed to lodge an account of election expenses and has no good reason or justification for the failure;

AND WHEREAS, Section 10A of the Representation of the People Act, 1951 stipulates that :-

"If the Election Commission is satisfied that a person-

(a) has failed to lodge an account of election expenses within the time and in the manner required by law or under this Act; and

(b) has no good reason or justification for the failure, the Election Commission shall by order published in the Official Gazette, declare him to be disqualified and any such person shall be disqualified for a period of three years from the date of the order;

NOW THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission of India hereby declares Shri Dheerendra Kumar, resident of Village – Hirwar, Post – Kunwa, Tahsil – Beohari, Dist. - Shahdol (M.P.), the contesting Independent candidate for the General Election to the House of the People of Madhya Pradesh, 2019 from 11-Sidhi Parliament Constituency, to be disqualified for being chosen as and for being a member of either House of Parliament or the Legislative Assembly or Legislative Council of a State or Union Territory for a period of three years from the date of this order.

और यतः, जिला निर्वाचन अधिकारी, सीधी जिला, मध्य प्रदेश की रिपोर्ट के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप नियम (5) के अंतर्गत निर्वाचन व्यय प्रस्तुत नहीं करने के लिए श्री राम कृ पाल बसोर को कारण बताओ नोटिस दिनांक 25.09.2019 को जारी किया गया था;

और यत:, जिला निर्वाचन अधिकारी, सीधी द्वारा अपने दिनांक 03.02.2021 के पत्र सं. 68/निर्वाचन/2020-21 के तहत प्रस्तुत की गई अनुपूरक रिपोर्ट में यह बताया गया है कि श्री राम कृ पाल बसोर ने आज की तारीख तक न तो कोई भी अभ्यावेदन और न ही मूल वाउचरों आदि के साथ विधिवत रूप से हस्ताक्षरित अपने निर्वाचन व्यय के सही लेखे का विवरण प्रस्तुत किया है। इसके अतिरिक्त, उन्होंने भारत निर्वाचन आयोग का सम्यक् नोटिस मिलने के उपरांत भी उक्त असफलता के लिए न तो कोई कारण बताया है और न ही कोई स्पष्टीकरण दिया है;

आ.अ. 135.—यतः, भारत निर्वाचन आयोग द्वारा मध्य प्रदेश राज्य की विधान सभा के साधारण निर्वाचन, 2018 की घोषणा प्रेस नोट संख्या ईसीआई/प्रे.नो./66/2018 दिनांक 06.10.2018 के जरिए की गई थी। कार्यक्रम के अनुसार, मतगणना की तारीख 11.12.2018 थी।

और यतः, संबंधित रिटर्निंग अधिकारी 155-हुजूर विधान सभा निर्वाचन क्षेत्र के परिणाम 11.12.2018 को घोषित किए गए थे। इस प्रकार, निर्वाचन व्यय के लेखा दाखिल करने की अन्तिम तारीख 10.01.2019 थी।

और यतः, मुख्य निर्वाचन अधिकारी, मध्य प्रदेश के दिनांक 19.01.2019 के पत्र सं. 10-क/चार/निर्वा.व्यय लेखा/34- भोपाल/2019/898 द्वारा अग्रेषित जिला निर्वाचन अधिकारी, भोपाल जिला, मध्य प्रदेश द्वारा दिनांक 17.01.2019 को प्रस्तुत रिपोर्ट के अनुसार श्री राजीव वर्मा (वंशकार), मध्य प्रदेश के 155-हुजूर विधान सभा निर्वाचन क्षेत्र से निर्वाचन लड़ने वाले शिवसेना अभ्यर्थी, अपने निर्वाचन व्यय का कोई भी लेखा दाखिल करने में असफल रहे ।

और यतः, जिला निर्वाचन अधिकारी, भोपाल जिला, मध्य प्रदेश की रिपोर्ट के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप नियम (5) के अंतर्गत निर्वाचन व्यय प्रस्तुत नहीं करने के लिए श्री राजीव वर्मा (वंशकार) को कारण बताओ नोटिस दिनांक 08.08.2019 को जारी किया गया था;

और यत:, निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (6) के अनुसार, दिनांक 08.08.2019 के उपयु र्क्त कारण बताओ नोटिस के जरिए श्री राजीव वर्मा (वंशकार) को निदेश दिया गया था कि वे इस नोटिस के प्राप्त होने के 20 दिनों के अंदर आयोग में लेखे न प्रस्तुत कर पाने के कारणों को स्पष्ट करते हुए लिखित रूप में अपना अभ्यावेदन प्रस्तुत करें और साथ ही, पूर्ण निर्वाचन व्यय का लेखा संबंधित जिला निर्वाचन अधिकारी को प्रस्तुत करें;

और यत:, उक्त नोटिस उनके द्वारा 30.08.2019 को प्राप्त किया गया था । अभ्यर्थी से प्राप्त पावती रसीद जिला निर्वाचन अधिकारी, भोपाल द्वारा दिनांक 01.11.2019 के पत्र संख्या 6867/वि.स.निर्वा./2018 द्वारा आयोग को प्रस्तुत कर दी गई थी;

और यत:, जिला निर्वाचन अधिकारी, भोपाल द्वारा अपने दिनांक 03.06.2022 के पत्र सं. 642/वि.स. निर्वा./2018/2020 के तहत प्रस्तुत की गई अनुपूरक रिपोर्ट में यह बताया गया है कि श्री राजीव वर्मा (वंशकार) ने आज की तारीख तक न तो कोई भी अभ्यावेदन और न ही मूल वाउचरों आदि के साथ विधिवत रूप से हस्ताक्षरित अपने निर्वाचन व्यय के सही लेखे का विवरण प्रस्तुत किया है। इसके अतिरिक्त, उन्होंने भारत निर्वाचन आयोग का सम्यक् नोटिस मिलने के उपरांत भी उक्त असफलता के लिए न तो कोई कारण बताया है और न ही कोई स्पष्टीकरण दिया है;

और यत:, आयोग का यह समाधान हो गया है कि श्री राजीव वर्मा (वंशकार), निर्वाचन व्यय का लेखा दाखिल करने में असफल रहे हैं और उनके पास इस असफलता के लिए कोई भी उचित कारण अथवा न्यायोचित्य नहीं है;

और यत:, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में अनुबंधित किया गया है कि:-

''यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति-

(क) निर्वाचन व्ययों का लेखा उस समय के भीतर और उस रीति में जैसी इस अधिनियम के द्वारा या अधीन अपेक्षित है,

दाखिल करने में असफल रहा है; तथा

राज्य की विधान सभा के साधारण निर्वाचन, 2018 के 155-हुजूर विधान सभा निर्वाचन क्षेत्र से निर्वाचन लड़ने वाले शिवसेना

अभ्यर्थी, श्री राजीव वर्मा (वंशकार), निवासी म.न. 204, विन्डसर अरालिया, रसूलिया जागीर, कोलार रोड़, हुजूर, भोपाल, मध्य प्रदेश को संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य क्षेत्र की विधानसभा अथवा विधान परिषद् के लिए सदस्य चुने जाने अथवा होने के लिए इस आदेश की तारीख से तीन वर्ष की अवधि के लिए निरर्हित घोषित करता है।

ORDER

New Delhi, the 30th August, 2022

O.N. 135.—WHEREAS, the General Election to the Legislative Assembly of Madhya Pradesh, 2018 was announced by Election Commission of India vide Press Note No ECI/PN/66/2018 dated 06.10.2018. As per the schedule, the Date of Counting of votes was 11.12.2018.

AND WHEREAS, the result of 155-Huzur Assembly Constituency was declared by the Returning Officer concerned on 11.12.2018. As such the last date for lodging of account of election expenses was 10.01.2019.

AND WHEREAS, as per the report dated 17.01.2019 submitted by the District Election Officer, Bhopal District, Madhya Pradesh and forwarded by Chief Electoral Officer, Madhya Pradesh vide letter No.10- A/Four/Elec.Expenditure Account/34-Bhopal/2019/898 dated 19.01.2019, Shri Rajiv Varma (Vanshkar), contesting candidate of Shiv Sena from 155-Huzur Assembly Constituency of Madhya Pradesh, failed to lodge any account of his election expenses.

AND WHEREAS, on the basis of the report of the District Election Officer, Bhopal District, Madhya Pradesh, a Show Cause notice dated 08.08.2019 was issued by the Election Commission of India under Sub Rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 to Shri Rajiv Varma (Vanshkar) for non submission of accounts of Election expenses;

AND WHEREAS, as per Sub Rule(6) of Rule 89 of the Conduct of Elections Rules, 1961, through the above said Show Cause Notice dated 08.08.2019, Shri Rajiv Varma (Vanshkar) was directed to submit his representation in writing to the Commission explaining the reason for non submission of accounts and also to lodge his complete accounts of election expenses to the District Election Officer concerned within 20 days from the date of receipt of the notice;

AND WHEREAS, the said notice was received by him on 30.08.2019. Acknowledgment receipt obtained from the candidate have been submitted to the Commission by District Election Officer, Bhopal vide his letter No. 6867/L.A. Elec./2018 dated 01.11.2019.

AND WHEREAS, in the supplementary report submitted by District Election Officer, Bhopal vide his letter No. 642/L.A. Elec./2018/2020 dated 03.06.2022 it has been stated that Shri Rajiv Varma (Vanshkar) has not submitted any representation or a statement of correct account of his election expenses, duly signed along with³³⁴ THE GAZETTE OF INDIA : SEPTEMBER ¹⁰, ²⁰²²/BHADRA ¹⁹, ¹⁹⁴⁴ [PART II—SEC. ³(iii)] original vouchers etc. till date. Further, he has neither furnished any reason nor explanation for the said failure even after receipt of the due notice to the Election Commission of India as well;

AND WHEREAS, Commission is satisfied that Shri Rajiv Varma (Vanshkar) has failed to lodge an account of election expenses and has no good reason or justification for the failure;

AND WHEREAS, Section 10A of the Representation of the People Act, 1951 stipulates that :-

"If the Election Commission is satisfied that a person-

(a) has failed to lodge an account of election expenses within the time and in the manner required by law or under this Act; and

NOW THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission of India hereby declares Shri Rajiv Varma (Vanshkar), resident of H.NO. 204, Windsar Araliya, Rasuliya, Jagir Kolar Road, Huzur, Bhopal, MadhyaPradsh, contesting candidate of Shiv Sena for the General Election to the Legislative Assembly of Madhya Pradesh, 2018 from 155-Huzur Assembly Constituency, to be disqualified for being chosen as and for being a member of either House of Parliament or the Legislative Assembly or Legislative Council of a State or Union Territory for a period of three years from the date of this order.
