सा.का.नि. 155.—राष्ट्रपति, संविधान के अनुच्छेद 309 के परंतुक द्वारा प्रदत्त शक्तियों का उपयोग करते हुए और पूर्वोत्तर पुलिस अकादमी, बारापानी (समूह 'ग' पद) भर्ती नियम, 2013, के अधिक्रमण में, जहां तक उनका संबंध कांस्टेबल (जनरल ड्यूटी), कांस्टेबल (बैंड) और कांस्टेबल (मोटर यातायात) के पदों से संबंधित हैं, उन बातों के सिवाय अधिक्रान्त करते हुए जिन्हें ऐसे अधिक्रमण से पहले किया गया है या करने का लोप किया गया है। गृह मंत्रालय के अधीन पूर्वोत्तर पुलिस अकादमी, बारापानी शिलोंग में कांस्टेबल (जनरल ड्यूटी), कांस्टेबल (बैंड) और कांस्टेबल (मोटर यातायात) के पद पर भर्ती की पद्धति का विनियमन करते हुए निम्नलिखित नियम बनाती हैं, अर्थात् :—

(967)968 THE GAZETTE OF INDIA : OCTOBER 22, 2022/ASVINA 30, 1944 [PART II—SEC. 3(i)] 1. संक्षिप्त नाम और प्रारंभ.– (1) इन नियमों का संक्षिप्त नाम गृह मंत्रालय, पूर्वोत्तर पुलिस अकादमी, बारापानी शिलोंग में कांस्टेबल (जनरल ड्यूटी), कांस्टेबल (बैंड) और कांस्टेबल (मोटर यातायात) समूह 'ग' भर्ती नियम 2022 है।
(2) ये राजपत्र में इनके प्रकाशन की तारिख से लागू होंगे ।
2. लागू होना- ये नियम इससे उपाबंध अनुसूची के स्तंभ (1) में विनिर्दिष्ट पदों पर लागू होंगे।
3. पदों की संख्या, वर्गीकरण और वेतन मैट्रिक्स में स्तर.–पदों की संख्या, उनका वर्गीकरण और इससे संलग्न वेतन मैट्रिक्स में स्तर, उपरोक्त अनुसूची के स्तंभ (2) से (4) में यथा विनिर्दिष्ट होंगे।
4. भर्ती की पद्धति, आयु-सीमा, अर्हता, आदि.– भर्ती की पद्धति, आयु-सीमा, अर्हताएं और इससे संबंधित अन्य मामलें उक्त अनुसूची के स्तंभ (5) से (13) में यथा विनिर्दिष्ट होंगे।
5. अयोग्यता.—ऐसा कोई व्यक्ति,-
(क) जिसने ऐसे व्यक्ति के साथ विवाह किया है या विवाह का अनुबंध किया है जिसका जीवन साथी जीवित है;
या
(ख) जिसने अपने जीवन साथी के जीवित रहते हुए, किसी व्यक्ति के साथ विवाह किया है या विवाह का अनुबंध किया है,
उक्त पदों पर नियुक्ति के लिए पात्र नहीं होगा:
बशर्ते कें द्र सरकार, अगर संतुष्ट हो कि इस तरह के विवाह को ऐसे व्यक्ति और विवाह के दूसरे पक्ष पर लागू व्यक्तिगत कानून (पर्सनल लॉ) के तहत अनुमति है, और ऐसा करने के लिए आधार मौजूद हैं, तो किसी भी व्यक्ति को इस नियम के लागू होने से छू ट दी जा सकती है।
6. शिथिल करने की शक्ति.—जहां कें द्रीय सरकार का यह मत है कि ऐसा करना आवश्यक या समीचीन है, वह आदेश द्वारा, और इसके कारणों को लिखित रूप में दर्ज करते हुए, किसी भी वर्ग या श्रेणी के व्यक्ति के संबंध में इन नियमों के किसी भी उपबंध को शिथिल कर सकती है। ।
7. व्यावृत्ति.—इन नियमों में कु छ भी अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़े वर्गों, भूतपूर्व सैनिकों और अन्य विशेष श्रेणियों के व्यक्तियों को इस संबंध में कें द्र सरकार द्वारा समय-समय पर जारी आदेशों के अनुसार प्रदत्त आरक्षण, आयु-सीमा में छू ट और अन्य रियायतों को प्रभावित नहीं करेगा।

टिप्पण: आयु-सीमा निर्धारित करने की महत्वपूर्ण तारीख आवेदन प्राप्त करने की अंतिम तारीख होगी, न कि असम, मेघालय, अरुणाचल प्रदेश, मिजोरम, मणिपुर, नागालैंड, त्रिपुरा, सिक्किम, लाहौल और स्पीति जिले और हिमाचल प्रदेश के चंबा जिले के पांगी उप-मंडल, अंडमान और निकोबार द्वीप संघ राज्य क्षेत्र, लक्षद्वीप संघ राज्य क्षेत्र और लद्दाख संघ राज्य क्षेत्र के लिए निर्धारित अंतिम तारीख होगी।

G.S.R. 155.—In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the North Eastern Police Academy, Barapani(Group 'C' Posts) Recruitment Rules, 2013, in so far as they relate to the posts of Constable (General Duty), Constable (Band) and Constable (Motor Transport),except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the post of Constable (General Duty), Constable (Band) and Constable (Motor Transport) in the North Eastern Police Academy, Barapani, Shillong under the Ministry of Home Affairs, namely :-
1. Short title and commencement.—(1) These rules may be called the Ministry of Home Affairs, North Eastern Police Academy, Barapani, Shillong, Constable (General Duty), Constable (Band) and Constable (Motor Transport) Group 'C' Recruitment Rules, 2022.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. Application.—These rules shall apply to the posts specified in Column (1) of the Schedule annexed to these rules.
3. Number of post, classification and level in the pay matrix.—The number of posts, their classification and level in the pay matrix attached thereto, shall be as specified in Columns (2) to (4) of the aforesaidSchedule.
4. Method of recruitment, age-limit, qualifications, etc.– The method of recruitment, age-limit, qualifications and other matters relating thereto shall be as specified in Columns (5) to (13) of the said Schedule.
5. Disqualification. - No person,-
(a) who has entered into or contracted a marriage with a person having a spouse living; or
(b) who, having a spouse living, has entered into or contracted a marriage with any person,
shall be eligible for appointment to the said posts:
Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage, and that there are grounds, for so doing, exempt any person from the operation of this rule.
6. Power to relax.– Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, and for the reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of person.
7. Saving.– Nothing in these rules shall affect reservation, relaxation of age-limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, theOther Backward classes , the Ex- servicemen and the other special categories of persons, in accordance with the orders issued by the Central Government from time to time in this regard.

सा.का.नि. 156.—राष्ट्रपति संविधान के अनुच्छेद 309 के परंतुक और अनुच्छेद 148 के खंड (5) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, तथा भारतीय लेखा परीक्षा और लेखा विभाग में सेवारत व्यक्तियों के संबंध में भारत के नियंत्रक और महालेखापरीक्षक के परामर्श के पश्चात्, कें द्रीय सिविल सेवा (वर्गीकरण, नियंत्रण और अपील) नियम, 1965 का और संशोधन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात: -
1. संक्षिप्त नाम और प्रारंभ:—(1) इन नियमों का संक्षिप्त नाम के न्द्रीय सिविल सेवा (वर्गीकरण, नियंत्रण और अपील) संशोधन नियम, 2022 है।
(2) ये राजपत्र में इनके प्रकाशन की तारीख को प्रभावी होंगे।
2. कें द्रीय सिविल सेवा (वर्गीकरण, नियंत्रण और अपील) नियम, 1965 में, नियम 10 में, उप-नियम (7) में, परंतुक के स्थान पर, निम्नलिखित परंतुक रखा जाएगा, अर्थात -
"परंतु उप-नियम (2) के अधीन मानित निलंबन की दशा में निलंबन का ऐसा कोई पुनर्विलोकन आवश्यक नहीं होगा, यदि सरकारी सेवक का निरुद्ध रहना जारी रहता है और ऐसी दशा में नब्बे दिनों की अवधि की संगणना उस तारीख[भाग II—खण्ड 3(i)] भारत का राजपत्र : अक्तूबर 22, 2022/आश्विन 30, 1944 987 से की जाएगी जिसको अभिरक्षा में निरुद्ध सरकारी सेवक को निरोध से निमु र्क्त कर दिया जाता है या जिस तारीख को निरोध से उसकी निमु र्क्ति के तथ्य की सूचना उसके नियुक्ति प्राधिकारी को दी जाती है, जो भी पश्चातवर्ती हो:
परंतु यह और कि ऐसे मामले में जहाँ इन नियमों के अधीन कोई आरोप-पत्र जारी नहीं किया गया है, यथास्थिति निलंबन या मानित निलंबन, जिसके अंतर्गत उपनियम (6) के निबंधनों के अनुसार कोई विस्तारित अवधि भी है, के अधीन कु ल अवधि निम्न से अधिक नहीं होगी –
(क) यदि सरकारी सेवक को उपनियम (1) के खंड (क) के निबंधनों के अनुसार निलंबित रखा गया है, तो निलंबन आदेश की तारीख से दो सौ सत्तर दिन; या
(ख) यदि सरकारी सेवक को उपनियम (1) के यथास्थिति खंड (कक) या खंड (ख), के निबंधनों के अनुसार निलंबित रखा गया है तो निलंबन आदेश की तारीख से दो वर्ष; या
(ग) उप-नियम (2) के अधीन मानित निलंबन की दशा में उस तारीख से जिसको अभिरक्षा में निरूद्ध सरकारी सेवक निमु र्क्त होता है या उस तारीख से जिसको निरोध से उसकी निमु र्क्ति के तथ्य की सूचना उसके नियुक्ति प्राधिकारी को दी जाती है, जो भी पश्चातवर्ती हो, दो वर्ष।"

G.S.R. 156.—In exercise of the powers conferred by proviso to article 309 and clause (5) of article 148 of the Constitution, and after consultation with the Comptroller and Auditor General of India in relation to persons serving in the Indian Audit and Accounts Department, the President hereby makes the following rules further to amend the Central Civil Services (Classification, Control and Appeal) Rules, 1965, namely: –
1. Short title and commencement: – (1) These rules may be called the Central Civil Services (Classification, Control and Appeal) Amendment Rules, 2022.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Central Civil Services (Classification, Control and Appeal) Rules, 1965, in rule 10, in sub-rule (7), for the proviso, the following provisos shall be substituted, namely: –
"Provided that no such review of suspension shall be necessary in the case of deemed suspension under sub-rule (2), if the Government servant continues to be under detention and in such case the ninety days' period shall be computed from the date the Government servant detained in custody is released from detention or the date on which the fact of his release from detention is intimated to his appointing authority, whichever is later:
Provided further that in a case where no charge sheet is issued under these rules, the total period under suspension or deemed suspension, as the case may be, including any extended period in terms of sub-rule (6) shall not exceed,–988 THE GAZETTE OF INDIA : OCTOBER 22, 2022/ASVINA 30, 1944 [PART II—SEC. 3(i)] (a) two hundred seventy days from the date of order of suspension, if the Government servant is placed under suspension in terms of clause (a) of sub-rule (1); or
(b) two years from the date of order of suspension, if the Government servant is placed under suspension in terms of clause (aa) or clause (b) of sub-rule (1) as the case may be; or
(c) two years from the date the Government servant detained in custody is released or the date on which the fact of his release from detention is intimated to his appointing authority, whichever is later, in the case of deemed suspension under sub-rule (2).".
