आ.अ. 246.—भारत निर्वाचन आयोग द्वारा दिनांक 27 जुलाई, 2017 के प्रेस नोट सं. ईसीआई/पीएन/64/2017 के तहत आंध्र प्रदेश विधान सभा के 139-नन्दयाल विधान सभा निर्वाचन क्षेत्र के लिए उप-निर्वाचन, 2017 की घोषणा की गई थी; और

यत:, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 78 के अनुसार, निर्वाचन लड़ने वाले प्रत्येक अभ्यर्थी को, निर्वाचित अभ्यर्थी के निर्वाचन की तारीख से 30 दिनों के भीतर अपने निर्वाचन व्यय के लेखों की सही प्रति संबद्ध जिला निर्वाचन अधिकारी को प्रस्तुत करनी होती है; और

यतः, 139-नन्दयाल विधान सभा निर्वाचन क्षेत्र के उप-निर्वाचन का परिणाम रिटर्निंग अधिकारी द्वारा 28 अगस्त, 2017 को घोषित किया गया था और इस प्रकार निर्वाचन व्यय के लेखे दाखिल करने की अंतिम तारीख 27 सितम्बर, 2017 थी; और

(577)⁵⁷⁸ THE GAZETTE OF INDIA : OCTOBER ²², ²⁰²²/ASVINA ³⁰, ¹⁹⁴⁴ [PART II—SEC. ³(iii)] यतः, जिला निर्वाचन अधिकारी, कु रनूल जिला, आंध्र प्रदेश द्वारा प्रस्तुत दिनांक 04 अक्तू बर, 2017 की रिपोर्ट के अनुसार श्री/श्रीमती/कु मारी/सुश्री बाला सुब्बैया. ए, जो आंध्र प्रदेश के 139-नन्दयाल विधान सभा निर्वाचन क्षेत्र के उप-निर्वाचन के लिए निर्वाचन लड़ने वाले अभ्यर्थी हैं, विधि द्वारा यथापेक्षित रीति से अपने निर्वाचन व्यय का लेखा दाखिल करने में असफल रहे हैं; और

यतः, जिला निर्वाचन अधिकारी, कु रनूल की उक्त रिपोर्ट के आधार पर, भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप नियम (5) के अंतर्गत श्री/श्रीमती/कु मारी/सुश्री बाला सुब्बैया. ए, को अपने निर्वाचन व्यय के लेखे प्रस्तुत नहीं करने के लिए दिनांक 7 जून, 2018 को कारण-बताओ नोटिस सं. 100/एपी- एलए/139/2017 जारी किया गया था; और

यत:, उपयु र्क्त कारण बताओ नोटिस के जरिए निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप नियम (6) के अंतर्गत, श्री/श्रीमती/कु मारी/सुश्री बाला सुब्बैया. ए, को लेखा प्रस्तुत न किए जाने संबंधी कारणों को स्पष्ट करते हुए आयोग को अपना अभ्यावेदन लिखित रूप में प्रस्तुत करने और नोटिस के प्राप्त होने के 20 दिनों के भीतर जिला निर्वाचन अधिकारी, कु रनूल को अपने निर्वाचन व्ययों के लेखे प्रस्तुत करने का निदेश दिया गया था; और

यत:, जिला निर्वाचन अधिकारी, कु रनूल ने अपने दिनांक 12.09.2022 के पत्र सं. आरसी.

एच1/1251(2017)/22 के जरिए बताया कि श्री/श्रीमती/कु मारी/सुश्री बाला सुब्बैया. ए, को उक्त नोटिस दिनांक 12.03.2021 एवं 20.05.2021 को तामील किया गया था; और

यत:, जिला निर्वाचन अधिकारी, कु रनूल ने दिनांक 12.09.2022 की अपनी अनुपूरक रिपोर्ट सं.

एच1/1251(2017)/22 में यह बताया कि श्री/श्रीमती/कु मारी/सुश्री बाला सुब्बैया. ए, ने निर्वाचन व्यय के लेखे विवरण प्रस्तुत नहीं किए हैं। इसके अतिरिक्त, उक्त नोटिस के प्राप्त होने के पश्चात, श्री/श्रीमती/कु मारी/सुश्री बाला सुब्बैया. ए, ने विधि के अंतर्गत यथा-विहित लेखे प्रस्तुत करने में अपनी असफलता के लिए भारत निर्वाचन आयोग को न तो कोई कारण बताया है और न ही कोई स्पष्टीकरण दिया है; और

यत:, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में यह उपबंधित किया गया है कि:-

''यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व् यक्ति-

(क) निर्वाचन व्ययों का लेखा उस समय के भीतर और उस रीति में जैसी इस अधिनियम के द्वारा या अधीन अपेक्षित है, दाखिल करने में असफल रहा है; तथा

(ख) उस असफलता के लिए कोई अच्छा कारण या न्यायोचित्य नहीं रखता है,

तो निर्वाचन आयोग शासकीय राजपत्र में प्रकाशित आदेश द्वारा उसको निरर्हित घोषित करेगा और ऐसा व् यक्ति उस आदेश की तारीख से तीन वर्ष की कालावधि के लिए निरर्हित होगा।";

यत:, तथ्यों और उपलब्ध रिकार्डों के आधार पर, आयोग का यह समाधान हो गया है कि श्री/श्रीमती/कु मारी/सुश्री बाला सुब्बैया. ए, अपने निर्वाचन व्यय के लेखे दाखिल करने में असफल रहे हैं और उनके पास ऐसा करने में असफल रहने के लिए कोई भी उचित कारण अथवा औचित्य नहीं है; और

अत:, अब, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अनुसरण में, भारत निर्वाचन आयोग एतद्द्वारा घोषणा करता है कि आंध्र प्रदेश राज्य के 139-नन्दयाल विधान सभा निर्वाचन क्षेत्र के उप-निर्वाचन के लिए निर्वाचन लड़ने वाले अभ्यर्थी श्री/श्रीमती/कु मारी/सुश्री बाला सुब्बैया. ए, मकान संख्या 29-7/एफ.बी, टेक्के , नन्दयाल शहर, कु रनूल जिला, आंध्र प्रदेश, इस आदेश की तारीख से तीन वर्ष की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य क्षेत्र की विधान सभा अथवा विधान परिषद का सदस्य चुने जाने अथवा होने के लिए निरर्हित होंगे।

New Delhi, the 10th October, 2022

O.N. 246.—WHEREAS, the Bye- Election for 139- Nandyal Assembly Constituency of Andhra Pradesh Legislative Assembly, 2017 was announced by the Election Commission of India vide Press Note No. ECI/PN/64/2017, dated 27th July, 2017; and

WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate has to lodge a true copy of his account of election expenses within 30 days with the concerned District Election Officer, from the date of election of the returned candidate; and

WHEREAS, the result of the bye-election for 139- Nandyal Assembly Constituency was declared by the

Returning Officer on 28th August, 2017 and hence the last date for lodging the account of Election Expenses was 27th September, 2017; and

WHEREAS, as per the report dated 04th October, 2017 submitted by the District Election Officer, Kurnool District, Andhra Pradesh, Shri/Smt/Km/Ms. Bala Subbaiah. A, a contesting candidate for bye-election to 139- Nandyal Assembly Constituency of Andhra Pradesh has failed to lodge account of election expenses, as required under law; and

WHEREAS, on the basis of the said report of the District Election Officer, Kurnool a Show-Cause notice No. 100/AP-LA/139/2017, dated 07th June, 2018 was issued under sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India to Shri/Smt/Km/Ms. Bala Subbaiah. A, for not lodging of account of Election Expenses; and

WHEREAS, under sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, Shri/Smt/Km/Ms. Bala Subbaiah. A, was directed to submit representation in writing to the Commission explaining the reason for not lodging the account and also to lodge account of election expenses with the District Election Officer, Kurnool within 20 days from the date of receipt of the notice; and

WHEREAS, the District Election Officer, Kurnool, vide his letter no. Rc. H1/1251(2017)/22 dated 12.09.2022 reported that the said notice was served to Shri/Smt/Km/Ms. Bala Subbaiah. A, on 12.03.2021 and 20.05.2021 ; and

WHEREAS, the District Election Officer, Kurnool in his Supplementary report no. Rc. H1/1251(2017)/22 dated 12.09.2022, reported that Shri/Smt/Km/Ms. Bala Subbaiah. A, has not submitted account of election expenses. Further, after receipt of the said notice, Shri/Smt/Km/Ms. Bala Subbaiah. A, has neither furnished any reason nor explanation to the Election Commission of India, for failure to lodge the account as prescribed under law; and

WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that:-

"If the Election Commission is satisfied that a person-

(a) has failed to lodge an account of election expenses, within the time and in the manner required by or

under this Act, and

(b) has no good reason or justification for the failure,

the Election Commission shall, by order published in the Official Gazette, declare him to be disqualified and any such

person shall be disqualified for a period of three years from the date of the order.";

WHEREAS, on the basis of facts and available records, the Commission is satisfied that Shri/Smt/Km/Ms. Bala Subbaiah. A, has failed to lodge account of election expenses and has no good reason or justification for the failure to do so; and

NOW, THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission of India hereby declares Shri/Smt/Km/Ms. Bala Subbaiah. A, H. No 29-7/F.B, Tekke, Nandyal Town, Kurnool District, Andhra Pradesh and a contesting candidate for bye-election to 139- Nandyal Assembly Constituency of the State of Andhra Pradesh, to be disqualified for being chosen as and for being a member of either House of Parliament or the Legislative Assembly or Legislative Council of a State or Union Territory for a period of three years from the date of this order.

घोषणा करता है कि आंध्र प्रदेश राज्य के 139-नन्दयाल विधान सभा निर्वाचन क्षेत्र के उप-निर्वाचन के लिए निर्वाचन लड़ने

वाले अभ्यर्थी श्री/श्रीमती/कु मारी/सुश्री भावनासी पुलैया, 2-111, पुसुलुरू ग्राम, नन्दयाल मंडल, कु रनूल जिला, आंध्र प्रदेश,

इस आदेश की तारीख से तीन वर्ष की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य क्षेत्र की

विधान सभा अथवा विधान परिषद का सदस्य चुने जाने अथवा होने के लिए निरर्हित होंगे।

WHEREAS, the result of the bye-election for 139- Nandyal Assembly Constituency was declared by the Returning Officer on 28th August, 2017 and hence the last date for lodging the account of Election Expenses was 27th September, 2017; and

WHEREAS, as per the report dated 04th October, 2017 submitted by the District Election Officer, Kurnool District, Andhra Pradesh, Shri/Smt/Km/Ms. Bhavanasi Pullaiah, a contesting candidate for bye-election to 139- Nandyal Assembly Constituency of Andhra Pradesh has failed to lodge account of election expenses, as required under law; and

WHEREAS, on the basis of the said reports of the District Election Officer, Kurnol a Show-Cause notice No. 100/AP-LA/139/2017, dated 07th June, 2018 was issued under sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India to Shri/Smt/Km/Ms. Bhavanasi Pullaiah, for not lodging of account of Election Expenses; and

WHEREAS, under sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, Shri/Smt/Km/Ms. Bhavanasi Pullaiah, was directed to submit representation in writing to the Commission explaining the reason for not lodging the account and also to lodge account of election expenses with the District Election Officer, Kurnool within 20 days from the date of receipt of the notice; and

WHEREAS, the District Election Officer, Kurnool, vide his letter no. Rc. H1/1251(2017)/22 dated 12.09.2022 reported that the said notice was served to Shri/Smt/Km/Ms. Bhavanasi Pullaiah, on 12.03.2021 ; and

WHEREAS, the District Election Officer, Kurnool in his supplementary report no. Rc. H1/1251(2017)/22 dated 12.09.2022, reported that Shri/Smt/Km/Ms. Bhavanasi Pullaiah, has not submitted account of election expenses. Further, after receipt of the said notice, Shri/Smt/Km/Ms. Bhavanasi Pullaiah, has neither furnished any reason nor explanation to the Election Commission of India, for failure to lodge the account as prescribed under law; and

WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that:-

"If the Election Commission is satisfied that a person-

WHEREAS, on the basis of facts and available records, the Commission is satisfied that Shri/Smt/Km/ Ms. Bhavanasi Pullaiah, has failed to lodge account of election expenses and has no good reason or justification for the failure to do so; and

NOW, THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission of India hereby declares Shri/Smt/Km/Ms. Bhavanasi Pullaiah, 2-111, Pusuluru village, Nandyal Mandal, Kurnool District, Andhra Pradesh and a contesting candidate for bye-election to 139- Nandyal Assembly Constituency of the State of Andhra Pradesh, to be disqualified for being chosen as and for being a member of either House of Parliament or the Legislative Assembly or Legislative Council of a State or Union Territory for a period of three years from the date of this order.
