सं.10-4/2019-यू3(ए)—बिनक, क(cid:7286) (cid:7076) सरकार को र्न(cid:7393)र्न(cid:7378)ालय अनुदान आयोग (यूीिसी) अनधननयम, 1956 की धारा 3 के तहत, नकसी उ(cid:7340) न(cid:6979)ण सं(cid:7021)ान को यूीिसी की सलाह पर सर्मत र्न(cid:7393)र्न(cid:7378)ालय घोनषत करने का अनधकार है।

2. और बिनक, क(cid:7286) (cid:7076) सरकार ने, यूीिसी अनधननयम, 1956 की धारा 3 (cid:7367)ारा (cid:7079)द(cid:7275) न(cid:7334)य(cid:7298) का (cid:7079)योग करते (cid:7263)ए, यूीिसी की सलाह पर, नदनांक 26 अ(cid:7079)ैल, 2001 की अनधसूचना सं(cid:6990)या 9-7/98-यू.3 के तहत नमुगा आ(cid:6999)स(cid:6981), साइंस, टे(cid:7331)ोलोीि एंड नरसच(cid:6981) एके डमी (एसएएसटीआरए), र्तंािुर, तनमलनाडु को सर्मत र्न(cid:7393)र्न(cid:7378)ालय घोनषत नकया ा।

3. और इसके बाद बिनक, डॉ.र् ै(cid:7378)सु(cid:7081)म(cid:7003)यम, कु लपनत, एसएएसटीआरए (सर्मत र्न(cid:7393)र्न(cid:7378)ालय), र्तंािुर, तनमलनाडु से चे(cid:7382)ई म(cid:7286) एक ऑ-क(cid:7289) पस क(cid:7286) (cid:7076) की (cid:7021)ापना हेतु आय प(cid:7074) (एलओआई) ािरी करने के नलए एक र्आेदन नदनांक 22.05.2019 को (cid:7079)ा(cid:7385) (cid:7263)आ ा। इसे र्न(cid:7393)र्न(cid:7378)ालय अनुदान आयोग (सर्मत र्न(cid:7393)र्न(cid:7378)ालय सं(cid:7021)ान) र्नननयम, 2019 के अनुसार ािंच और सलाह के नलए 04.06.2019 को यूीिसी को भेाि गया ा।

4. और बिनक, यूीिसी ने नदनांक 18.06.2019 के अपने प(cid:7074) सं(cid:6990)या 1-5/2018 (सीपीपी- I/डीयू) के मा(cid:7007)यम से सूनचत नकया नक यूीिसी के अ(cid:7007)य(cid:6979) ने र्आेदन की ािंच करने और अपनी सं(cid:7021)तुनतयां देने के नलए (cid:7079)ोे सरर् ी एस चौहान, (cid:7079)ोे सर सुषमा यार्द, (cid:7079)ोे सर आर सी कु हा और (cid:7079)ोे सर इं(cid:7076) मोहन कापनत को ानमल करते (cid:7263)ए एक र्नेष(cid:6980) सनमनत का गठन नकया। सनमनत ने र्आेदन की ािंच की और नसानर की नक कनतपय त(cid:7300) को पूरा करने के अ(cid:7007)यधीन चे(cid:7382)ई म(cid:7286) एक ऑ-क(cid:7289) पस क(cid:7286) (cid:7076) (cid:7021)ानपत करने के नलए एसएएसटीआरए (सर्मत र्न(cid:7393)र्न(cid:7378)ालय), र्तंािुर, तनमलनाडु को आय प(cid:7074) ािरी नकया ाि सकता है।

5. और बिनक, यूीिसी की सलाह को (cid:7007)यान म(cid:7286) रखते (cid:7263)ए, मं(cid:7074)ालय ने नन(cid:7388)नलनखत त(cid:7300) को पूरा करने के नलए एसएएसटीआरए को नदनांक 04.10.2019 को आय प(cid:7074) ािरी नकया:

i. सं(cid:7021)ान यूीिसी (सर्मत र्न(cid:7393)र्न(cid:7378)ालय सं(cid:7021)ान) र्नननयम, 2019 के अनुसार अपने संगम (cid:6980)ापन/ननयम(cid:7298) म(cid:7286) संोधन और पंीिकरण करेगा।

ii. सं(cid:7021)ान हिां भी लागू हो, संबंनधत सांर्ननधक पनरषद(cid:7298) का अनुमोदन (cid:7079)ा(cid:7385) करेगी।

iii. (cid:7079)(cid:7021)तार्नत ऑ क(cid:7289) पस म(cid:7286) न(cid:6979)क-छा(cid:7074) अनुपात 1:20 से कम नह(cid:7277) होगा और संबंनधत र्ैधाननक पनरषद(cid:7298) के मानदंड(cid:7298) के अनुसार होगा।

iv. संबंनधत सांर्ननधक पनरषद(cid:7298) के मानदंड(cid:7298) के अनुसार संकाय की सं(cid:6990)या 25 से कम नह(cid:7277) होनी चानहए।

v. ननयनमत (cid:6989)लास (cid:7272)म मोड के तहत (cid:7008)यूनतम 500 छा(cid:7074)(cid:7298) को रोल पर होना चानहए ननिम(cid:7286) से कम से कम 1/3 पीीि/ोध छा(cid:7074) ह(cid:7298)।

vi. (cid:7079)(cid:7021)तार्नत ऑ-क(cid:7289) पस क(cid:7286) (cid:7076) म(cid:7286) कम से कम 3 पीीि र्नभाग होने चानहए।

vii. नननम(cid:6981)त (cid:6979)े(cid:7074) (cid:7079)नत छा(cid:7074) 30 र्ग(cid:6981)मीटर से कम नह(cid:7277) होना चानहए नसिम(cid:7286) ै(cid:6979)नणक र्भन, पु(cid:7021)तकालय, (cid:7390)ा(cid:6990)यान क(cid:6979), (cid:7079)योगालाएं, छा(cid:7074र्)ाास, संकाय नर्नास, (cid:7021र्)ा(cid:7021)(cid:7005)य देखभाल, सामा(cid:7008)य सुर्नधाएं और मनोरंनि सुर्नधाएं ानमल ह(cid:7289)।

6. और इसके बाद बिनक, सर्मत र्न(cid:7393)र्न(cid:7378)ालय (cid:7367)ारा नदनांक 03.10.2022 के अपने प(cid:7074) (cid:7367)ारा (cid:7079)(cid:7021)तुत आय प(cid:7074) की त(cid:7300) के संबंध म(cid:7286) अनुपालन नरपोट(cid:6981), स(cid:7004)यापन हेतु और इस मं(cid:7074)ालय को अपनी र्नन(cid:7397) सलाह देने के नलए यूीिसी को अ(cid:7061)ेनषत की गई ी नक (cid:6989)या ै(cid:6979)नणकर् ष(cid:6981) 2022-2023 से चे(cid:7382)ई म(cid:7286) एक ऑ-क(cid:7289) पस क(cid:7286) (cid:7076) ु(cid:7272) करने के नलए सर्मत र्न(cid:7393)र्न(cid:7378)ालय को अनुमोदन नदया ाि सकता है।

7. और इसके बाद बिनक, यूीिसी ने नदनांक 1 र्नंबर, 2022 के अपने प(cid:7074) सं(cid:6990)या 40-10/2019 (सीपीपी-I/डीयू) के मा(cid:7007)यम से यह सूनचत नकया ा नक सर्मत र्न(cid:7393)र्न(cid:7378)ालय ने प प(cid:7074) (cid:7079)(cid:7021)तुत नकया है नक चे(cid:7382)ई म(cid:7286) (cid:7079)(cid:7021)तार्नत ऑ-क(cid:7289) पस म(cid:7286) न(cid:6979)क-छा(cid:7074) अनुपात, संकाय सं(cid:6990)या, छा(cid:7074)(cid:7298) की सं(cid:6990)या, पीीि/अनुसंधान काय(cid:6981)(cid:7059)म(cid:7298) की सं(cid:6990)या, (cid:7079)नत छा(cid:7074) नननम(cid:6981)त (cid:6979)े(cid:7074), अकादनमक र्भन, पु(cid:7021)तकालय, (cid:7390)ा(cid:6990)यान क(cid:6979), (cid:7079)योगालाएं, छा(cid:7074र्)ाास, संकाय नर्नास, (cid:7021र्)ा(cid:7021)(cid:7005)य र्सेा, खेल के नलए (cid:7021)ान, सामा(cid:7008)य और मनोरंकि सुर्नधाएं यूीिसी (सर्मत र्न(cid:7393)र्न(cid:7378)ालय सं(cid:7021)ान) र्नननयम, 2019 म(cid:7286) ननधा(cid:6981)नरत (cid:7079र्)ाधान(cid:7298) के अनुसार उपल(cid:7011)ध की ािएंगी। सर्मत र्न(cid:7156र्)र्न(cid:7378)ालय ने यह प प(cid:7074) भी नदया है नक (cid:7079)दान नकए ािनेर् ाले काय(cid:6981)(cid:7059)म(cid:7298) को संगत सांर्ननधक ननकाय ((cid:7312)) (cid:7367)ारा अनुमोनदत नकया ािएगा और ऐसे ननकाय(cid:7298) के मानदंड(cid:7298) का पालन नकया ािएगा।

8. अब, इसनलए, र्न(cid:7393)र्न(cid:7378)ालय अनुदान आयोग अनधननयम, 1956 की धारा 3 (cid:7367)ारा (cid:7079)द(cid:7275) न(cid:7334)य(cid:7298) का (cid:7079)योग करते (cid:7263)ए क(cid:7286) (cid:7076) सरकार र्न(cid:7393)र्न(cid:7378)ालय अनुदान आयोग की सलाह पर नन(cid:7388)नलनखत त(cid:7300) के अ(cid:7007)यधीन नमुगा आ(cid:6999)स(cid:6981), साइंस, टे(cid:7331)ोलोीि एंड नरसच(cid:6981) एके डमी (एसएचएएसटीआरए) (सर्मत र्न(cid:7393)र्न(cid:7378)ालय), र्तंािुर, तनमलनाडु को चे(cid:7382)ई म(cid:7286) एक ऑ-क(cid:7289) पस क(cid:7286) (cid:7076) ु(cid:7272) करने की अनुमनत (cid:7079)दान करता है:

i. सर्मत र्न(cid:7393)र्न(cid:7378)ालय यूीिसी (सर्मत र्न(cid:7393)र्न(cid:7378)ालय सं(cid:7021)ान) र्नननयम, 2019 म(cid:7286) ननधा(cid:6981)नरत (cid:7079र्)ाधान(cid:7298) के अनुसार आय प(cid:7074) की त(cid:7300) की पूनत(cid:6981) नरपोट(cid:6981) (cid:7079)(cid:7021)तुत करेगा।

ii. र्ननध र्नभाग के तहत (cid:7401)ातको(cid:7275)र काय(cid:6981)(cid:7059)म – अंतरा(cid:6981)(cid:7398)ीय (cid:7390)ापार और र्ानणन(cid:6996)यक कानून/ कॉप(cid:7299)रेट और कर कानून म(cid:7286) एलएलएम संबंनधतर् ैधाननक पनरषद ((cid:7312)) के अनुमोदन के बाद ही ु(cid:7272) नकया ािएगा।

iii. उ(cid:7334) ऑ क(cid:7289) पस म(cid:7286) नए पा(cid:7353)(cid:7059)म यूीिसी के मौूिदा र्नननयम(cid:7298) के (cid:7079र्)ाधान(cid:7298) के अनुसार ु(cid:7272) नकए ािएंगे।

9. सरकार (cid:7367)ारा अनधसूचना की तारीख से पांचर् ष(cid:6981) की र्अनध के बाद आयोग (cid:7367)ारा उ(cid:7334) ऑ-क(cid:7289) पस की समी(cid:6979)ा की ािएगी। यह अनुमनत यूीिसी (सर्मत र्न(cid:7393)र्न(cid:7378)ालय सं(cid:7021)ान) र्नननयम, 2019 और क(cid:7286) (cid:7076) सरकार, यूीिसी और अ(cid:7008)य सांर्ननधक पनरषद(cid:7298) (cid:7367)ारा समय-समय पर ािरी अ(cid:7008)य (cid:7079)ासंनगक मानदंड(cid:7298)/ननयम(cid:7298)/र्नननयम(cid:7298)/ननद(cid:7287)(cid:7298) के अनुपालन के अ(cid:7007)यधीन है।

No. 10-4/2019-U3(A)—Whereas, the Central Government is empowered under Section 3 of the University Grants Commission (UGC) Act, 1956 to declare, on the advice of the UGC, an institution of higher learning as an Institution deemed to be University.

2. And whereas, in exercise of the powers conferred by Section 3 of the UGC Act, 1956, the Central Government, vide Notification No. 9-7/98-U.3 dated 26th April, 2001, on the advice of UGC, had declared Shanmugha Arts, Science, Technology & Research Academy (SHASTRA), Thanjavur, Tamil Nadu as an Institution deemed to be University.

3. And further whereas, an application dated 22.05.2019 was received from Dr. Vaidhyasubramaniam, Vice Chancellor, SASTRA (Deemed to be University), Thanjavur, Tamil Nadu for issuance of Letter of Intent (LoI) for establishment of an off-campus centre at Chennai. The same was forwarded to UGC on 04.06.2019 for examination and advice as per the UGC (Institutions Deemed to be Universities) Regulations, 2019.

4. And whereas, UGC vide its letter No.1-5/2018 (CPP-I/DU) dated 18.06.2019 informed that the Chairman, UGC constituted an Expert Committee consisting of Prof. V. S. Chauhan, Prof. Sushma Yadav, Prof. R. C. Kuhad & Prof. Inder Mohan Kapathy to examine the application and give its recommendations. The Committee examined the application and recommended that LoI may be issued to SASTRA (Deemed to be University), Thanjavur, Tamil Nadu for setting up an Off- Campus Centre at Chennai subject to the fulfillment of the certain conditions.

5. And whereas, taking into consideration the advice of UGC, the Ministry issued Letter of Intent on 04.10.2019 to SASTRA for fulfillment of the following conditions:

i. Institution will amend and register its MoA / Rules in accordance with the UGC (Institutions Deemed to be Universities) Regulations, 2019.

ii. Institution will obtain approval of the concerned Statutory Council(s), wherever applicable.

iii. Teacher-student ratio at the proposed off campus will not be less than 1:20 and as per the norms of the concerned Statutory Councils.

iv. The faculty strength should not be less than 25 and as per the norms of the concerned Statutory Councils.

v. Minimum 500 students should be on roll under regular class room mode of which not less than 1/3 being PG/Research students.

vi. There shall be at least 3 PG Departments at the proposed off-campus centre.

vii. The built up area should not be less than 30 sqm per student which includes Academic Building, Library, Lecture Hall, Labs, Hostels, Faculty residence, Health Care, Common Facilities and recreational facilities.

6. And further whereas, the compliance report in respect of conditions of LoI, as submitted by the deemed to be University vide its letter dated 03.10.2022, was forwarded to UGC for verification and furnishing its specific advice to this Ministry whether approval may be given to the Deemed to be University to start an Off-Campus Centre at Chennai from the academic year 2022-2023.

7. And further whereas, UGC, vide its letter No.40-10/2019 (CPP-I/DU) dated 1st November, 2022, has conveyed that it has observed that the Deemed to be University has submitted undertakings that teacher-student ratio, faculty strength, number of students, no. of PG/research programmes, built up area per student, academic building, library, lecture halls, labs, hostels, faculty residence, healthcare, area for play, common and recreational facilities at the proposed off-campus at Chennai shall be available as per the provisions stipulated in the UGC (Institutions Deemed to be Universities) Regulations, 2019. The Deemed to be University has also submitted undertaking that the programmes to be offered shall be approved by the relevant statutory body(ies) and shall follow the norms of such bodies.

8. Now, therefore, in exercise of the powers conferred by Section 3 of the UGC Act, 1956, the Central Government, on the advice of the UGC, do hereby permits Shanmugha Arts, Science, Technology & Research Academy (SHASTRA) (Deemed to be University), Thanjavur, Tamil Nadu to start an off-campus centre at Chennai subject to the following conditions:

i. The Deemed to be University shall submit fulfilment report of the conditions of LoI as per the provisions stipulated in the UGC (Institutions Deemed to be Universities) Regulations, 2019.

ii. Post Graduate Programme under Law Department – LLM in International Trade & Commercial Law / Corporate & Tax Law shall be started only after the approval of the concerned Statutory council(s).

iii. The new Courses at the said off Campus shall be started in accordance with the provisions of the extant Regulations of UGC.

9. The said off-campus shall be reviewed by the Commission after a period of five years from the date of Notification by the Government. This permission is subject to the compliance of the UGC (Institutions Deemed to be Universities) Regulations, 2019 and other relevant Norms/Rules/Regulations/Directions issued by the Central Government, UGC and other Statutory Councils, from time to time.

FUNCTIONS OF THE COMMITTEE

The functions of the Comittee are to render advice regarding implementation of the provisions relating to Official Language contined in the Constitution, Official Languages Act and Rules, Policy decisions of the Kendriya Hindi Samiti, instructions issued by the Ministry of Home Affairs/Department of Official Lanuage relating to Official Language Hindi and also the progressive use of Hindi in the Ministry of Information and Broadcasting.

TENURE

The tenure of members of the Committee will ordinarily be three years from the date of notification of the Committee provided that:—

1. Members of the Parliament, who are members of the Committee, shall cease to be Members of the Committee as soon as they cease to be Members of the Parliament.

2. The ex-officio members of the Committee shall continue as members so long as they hold office by virtue of which they are members of the Committee and

3. If a vacancy arises in the Committee due to resignation or death of a member, the appointee to that vacancy shall hold office for the residual period of the tenure of three years.

GENERAL

1. The Headquarter of the Committee shall be at New Delhi.

2. Non-Official members of the Committee will be paid travelling allowance and daily allowance for attending the meetings of the Committee at the instructions prescribed as per O.M. No. II/20034/4/86-O.L. (A-2) dated 22.1.1987 of Department of Official Language and in accordance with the prescribed rates and rules as amended from time to time by the Government of India.
