आ.अ. 1.—यतः, भारत निर्वाचन आयोग द्वारा दिनांक 4 सितंबर, 2021 की अधिसूचना सं. 100/ओ आर - एल ए/3/2021 दिनांक 04 सितंबर, 2021, के जरिए उड़ीसा के 110-पिपिली विधान सभा निर्वाचन क्षेत्र के लिए उप निर्वाचन, 2021 की घोषणा की गई थी; और

यत:, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 78 के अनुसार, निर्वाचन लड़ने वाले प्रत्येक अभ्यर्थी को निर्वाचित अभ्यर्थी के निर्वाचन की तारीख से 30 दिनों के भीतर, जिला चुनाव अधिकारी के पास अपने चुनाव खर्च का लेखा-जोखा प्रस्तुत करेगा जो उक्त अधिनियम की धारा 77 के तहत उसके या उसके चुनाव एजेंट द्वारा रखे गए खाते की सही प्रति होगी; और

(1)² THE GAZETTE OF INDIA : JANUARY ²¹, ²⁰²³/MAGHA ¹, ¹⁹⁴⁴ [PART II—SEC. ³(iii)] यतः, 110-पिपिली विधान सभा निर्वाचन क्षेत्र के निर्वाचन परिणाम रिर्टनंिग अधिकारी द्वारा 3 अक्टूबर, 2021 को घोषित किया गया था और इस प्रकार निर्वाचन व्यय के लेखे दाखिल करने की अन्तिम तारीख 2 नवम्बर, 2021 थी;

और

यतः, जिला निर्वाचन अधिकारी एवं कलेक्टर, पुरी की दिनांक 2 नवंबर, 2021 की रिपोर्ट के अनुसार, निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (1) के तहत, सीईओ, ओडिशा से प्राप्त उनके पत्र संख्या वीई (ए)-28/2021-7353/ इएलइसी. दिनांक 17 दिसंबर, 2021, श्री पिंकलिन मोहंती, जो उड़ीसा के 110-पिपिली विधान सभा, निर्वाचन क्षेत्र, 2021 में निर्वाचन लड़ने वाले अभ्यर्थी हैं, विधि द्वारा यथापेक्षित रीति से अपने निर्वाचन व्यय का लेखा दाखिल करने में असफल रहे हैं; और

यतः, जिला निर्वाचन अधिकारी की उक्त रिपोर्ट के आधार पर, भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (5) के अंतर्गत श्री पिंकलिन मोहंती, को अपने निर्वाचन व्यय के लेखे प्रस्तुत नहीं करने के लिए कारण बताओ नोटिस सं.76/ ओ डी-एल ए/2021 (उप निर्वाचन)/सीईएमएस-IV दिनांक 21 फरवरी, 2022 जारी किया गया था; और

यत:, उपयु र्क्त कारण बताओ नोटिस के माध्यम से और निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप- नियम (6) के अंतर्गत, श्री पिंकलिन मोहंती, को लेखा प्रस्तुत न किए जाने संबंधी कारणों को स्पष्ट करते हुए आयोग को अपना अभ्यावेदन लिखित रूप में प्रस्तुत करने और नोटिस के प्राप्त होने की तारीख से 20 दिनों के अंदर जिला निर्वाचन अधिकारी एवं कलेक्टर, पुरी, उड़ीसा को अपने निर्वाचन व्यय का लेखा भी प्रस्तुत करने का निदेश दिया गया था; और

यत:, जिला निर्वाचन अधिकारी एवं कलेक्टर, पुरी, उड़ीसा ने अपने पत्र दिनांक 04.06.2022 के माध्यम से बताया है कि उक्त नोटिस को विशेष संदेशवाहक द्वारा तीन दौरे किए जाने के पश्चात पते पर अभ्यर्थी एवं उनके परिवार के न मिलने के कारण मोहल्ले में जिम्मेदार व्यक्तियों की उपस्थिति में सहजदृश्य स्थान (गाँव का कोठा घर ) पर प्रर्दर्शत किया गया था ; और

यत:, जिला निर्वाचन अधिकारी एवं कलेक्टर, पुरी, ने अपनी अनुपूरक रिपोर्ट सं. IX-08/2022-618/ इएलइसी.

दिनांक 02, सितंबर, 2022 में यह बताया है कि श्री पिंकलिन मोहंती ने निर्वाचन व्यय का लेखा प्रस्तुत नहीं किया है।

इसके अतिरिक्त, विशेष संदेशवाहक द्वारा तीन दौरे किए जाने के पश्चात पते पर अभ्यर्थी एवं उनके परिवार के न मिलने के कारण मोहल्ले में जिम्मेदार व्यक्तियों की उपस्थिति में सहजदृश्य स्थान (गाँव का कोठा घर ) पर नोटिस को प्रर्दर्शत किए जाने के पश्चात, श्री पिंकलिन मोहंती ने विधि के अंतर्गत यथा-विहित लेखे प्रस्तुत करने में अपनी असफलता के लिए भारत निर्वाचन आयोग को न तो कोई कारण बताया है और न ही कोई स्पष्टीकरण दिया है; और

यत:, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में यह उपबंधित किया गया है कि:-

''यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति-

(क) निर्वाचन व्ययों का लेखा उस समय के भीतर और उस रीति में जैसी इस अधिनियम के द्वारा या अधीन अपेक्षित है, दाखिल करने में असफल रहा है; तथा

(ख) उस असफलता के लिए कोई अच्छा कारण या न्यायोचित्य नहीं रखता है,

तो निर्वाचन आयोग शासकीय राजपत्र में प्रकाशित आदेश द्वारा उसको निर्रर्हत घोषित करेगा और ऐसा व्यक्ति उस आदेश की तारीख से तीन वर्ष की कालावधि के लिए निर्रर्हत होगा।";

यत:, तथ्यों और उपलब्ध अभिलेखों के आधार पर आयोग का यह समाधान हो गया है कि श्री पिंकलिन मोहंती अपने निर्वाचन व्यय का लेखा दाखिल करने में असफल रहे हैं और उनके पास ऐसा करने में असफल रहने के लिए कोई भी उचित कारण अथवा औचित्य नहीं है; और

अत:, अब, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अनुसरण में, भारत निर्वाचन आयोग एतद्द्वारा घोषणा करता है कि उप निर्वाचन,2021 में उड़ीसा राज्य के 110-पिपिली विधान सभा निर्वाचन क्षेत्र से निर्वाचन लड़ने वाले अभ्यर्थी, श्री पिंकलिन मोहंती पी.ओ. - दंडमुकु ं दपुर, करणसाही, पी.एस. - पिपिली, जिला- पुरी, उड़ीसा –[भाग II—खण्ड 3(iii)] भारत का राजपत्र : जनवरी ²¹, ²⁰²²/माघ ¹, ¹⁹⁴⁴ ³ 752104, इस आदेश की तारीख से तीन वर्ष की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य-

क्षेत्र की विधान सभा अथवा विधान परिषद का सदस्य चुने जाने अथवा होने के लिए निर्रर्हत होंगे।

ORDER

New Delhi, the 22nd December, 2022

O.N. 1.—WHEREAS, the Bye Election for 110- Pipili Assembly Constituency of Odisha, 2021 was held in pursuance of the Election Commission of India Notification No. 100/OR-LA/3/2021 dated 4th September, 2021; and

WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate at an election shall, within 30 days from the date of election of the returned candidate, lodge with the District Election Officer, an account of his election expenses which shall be true copy of the account kept by him or his election agent under Section 77 of the said act; and

WHEREAS, the result of the election for 110- Pipili Assembly Constituency of Odisha, was declared by the Returning Officer on 3rd October, 2021 and hence the last date for lodging the account of Election Expenses was 2nd November, 2021; and

WHEREAS, as per the report dated 2nd November, 2021 of the DEO & Collector, Puri, under sub-rule (1) of Rule 89 of the Conduct of Elections Rules, 1961, received from the CEO, Odisha vide his letter no. VE (A)- 28/2021-7353/Elec. dated 17th December, 2021, Sh. Pinklin Mohanty, a contesting candidate from 110- Pipili Assembly Constituency of Odisha, 2021 has failed to lodge account of election expenses, as required under law; and

WHEREAS, on the basis of the said reports of the District Election Officer, a Show-Cause notice No. 76/OD-LA/2021(Bye)/CEMS-IV, dated 21st February, 2022 was issued under sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India to Sh. Pinklin Mohanty, for not lodging of account of Election Expenses; and

WHEREAS, through the above said Show Cause Notice and under sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, Sh. Pinklin Mohanty, was directed to submit representation in writing to the Commission explaining the reason for not lodging the account and also to lodge account of election expenses with the District Election Officer & Collector, Puri, within 20 days from the date of receipt of the notice; and

WHEREAS, the District Election Officer & Collector, Puri, Odisha vide his letter dated 04.06.2022 has reported that the said notice was displayed at a conspicuous place (Kotha Ghar of the Village) in the presence of responsible persons in the locality due to absence of the candidates and his family at the address after three visits by SpI. Messenger; and

WHEREAS, the District Election Officer & Collector, Puri, in his Supplementary Report No. IX-08/2022- 618/Elec. dated 2nd September, 2022 reported stated that Sh. Pinklin Mohanty, has not submitted account of election expenses. Further, after notice has been displayed at a conspicuous place (Kotha Ghar of the Village) in the presence of responsible persons in the locality due to absence of the candidates and his family at the address after three visits by SpI. Messenger.; Sh. Pinklin Mohanty, has neither furnished any reason nor explanation to the Election Commission of India, for failure to lodge the account as prescribed under law; and

WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that:-

"If the Election Commission is satisfied that a person-

(a) has failed to lodge an account of election expenses within the time and in the manner required by or under

this Act; and

(b) has no good reason or justification for the failure,

the Election Commission shall, by order published in the Official Gazette, declare him to be disqualified and any

such person shall be disqualified for a period of three years from the date of the order.";

WHEREAS, on the basis of facts and available records, the Commission is satisfied that Sh. Pinklin Mohanty has failed to lodge account of election expenses and has not furnished any reason or justification for the failure to do so; and⁴ THE GAZETTE OF INDIA : JANUARY ²¹, ²⁰²³/MAGHA ¹, ¹⁹⁴⁴ [PART II—SEC. ³(iii)] NOW, THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission of India hereby declares Sh. Pinklin Mohanty, P.O. – Dandamukundapur, Karansahi, P.S. – Pipili, District- Puri, Odisha – 752104 and a contesting candidate from 110- Pipili, Assembly Constituency of the State of Odisha in the Bye Election, 2021 to be disqualified for being chosen as and for being a member of either House of Parliament or the Legislative Assembly or Legislative Council of a State or Union Territory for a period of three years from the date of this order.

आ.अ. 2.—यतः, भारत निर्वाचन आयोग की दिनांक 28 मार्च, 2019 की अधिसूचना सं. 464/ईपीएस/2019(3) के अनुसरण में के रल के 11-चालाकु डी संसदीय निर्वाचन क्षेत्र के लिए लोक सभा का साधारण निर्वाचन 2019 आयोजित किया गया था।

यत:, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 78 के अनुसार, किसी भी निर्वाचन में निर्वाचन लड़ने वाला प्रत्येक अभ्यर्थी, निर्वाचित अभ्यर्थी के निर्वाचन की तारीख से 30 दिनों के भीतर अपने निर्वाचन व्यय के लेखे जिला निर्वाचन अधिकारी के पास दाखिल करवाएगा जो उक्त अधिनियम की धारा 77 के तहत उसके या उसके निर्वाचन अभिकर्ता द्वारा रखे गए लेखे की एक सत्य प्रति होगी; और

यतः, के रल के 11- चालाकु डी संसदीय निर्वाचन क्षेत्र के लिए निर्वाचन, 2019 का परिणाम, रिर्टनंिग अधिकारी द्वारा दिनांक 23 मई, 2019 को घोषित किया गया था और इस प्रकार निर्वाचन व्यय के लेखे दाखिल करने की अन्तिम तारीख 22 जून, 2019 थी; और

यतः, मुख्य निर्वाचन अधिकारी, के रल के पत्र सं. 4535/ ईएल1/ 2019- ईएलईसी., दिनांक 05.11.2019 के तहत उनसे प्राप्त जिला निर्वाचन अधिकारी, एरनाकु लम द्वारा प्रस्तुत दिनांक 24.06.2019 की रिपोर्ट के अनुसार, फ्रे डी जैक्सन परेरा, जो के रल के 11- चालाकु डी संसदीय निर्वाचन क्षेत्र, 2019 से निर्वाचन लड़ने वाले अभ्यर्थी हैं, निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (1) के तहत, विधि के अंतर्गत यथा अपेक्षित निर्वाचन व्यय का लेखा दाखिल करने में असफल रहे हैं; और

यतः, जिला निर्वाचन अधिकारी, एरनाकु लम की उक्त रिपोर्ट के आधार पर, भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (5) के अंतर्गत निर्वाचन व्यय के लेखे प्रस्तुत नहीं करने के लिए फ्रे डी जैक्सन परेरा को कारण बताओ नोटिस सं. 76/के एल-एचपी/11/2019, दिनांक 29 नवंबर, 2019 जारी किया गया था; और

यतः, उपयु र्क्त कारण बताओ नोटिस के जरिए और निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप- नियम (6) के अंतर्गत, फ्रे डी जैक्सन परेरा को लेखे दाखिल नहीं करने के कारणों को स्पष्ट करते हुए आयोग को लिखित में अभ्यावेदन प्रस्तुत करने तथा नोटिस प्राप्त होने की तारीख से 20 दिनों के अंदर जिला निर्वाचन अधिकारी, एरनाकु लम को निर्वाचन व्ययों का लेखा प्रस्तुत करने का भी निदेश दिया गया था; और

यतः, जिला निर्वाचन अधिकारी, एरनाकु लम जिला ने बताया है कि फ्रे डी जैक्सन परेरा को उक्त नोटिस दिनांक 16.12.2019 को तामील किया गया था; और

यतः, जिला निर्वाचन अधिकारी, एरनाकु लम ने पत्र सं. डीईसीके एम / 7343 / एन1, दिनांक 05.11.2022 के जरिए अपनी अनुपूरक रिपोर्ट में यह सूचित किया कि फ्रे डी जैक्सन परेरा ने कोई अभ्यावेदन या अपना लेखा प्रस्तुत नहीं किया है। इसके अतिरिक्त, उक्त नोटिस के प्राप्त होने के बाद फ्रे डी जैक्सन परेरा ने विधि के तहत यथा निर्धारित लेखा दाखिल करने में असफल रहने के लिए भारत निर्वाचन आयोग को न तो कोई कारण बताया है और न ही कोई स्पष्टीकरण दिया है; और

यत:, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में यह उपबंधित किया गया है कि:-

यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति-

(क) निर्वाचन व्ययों का लेखा उस समय के भीतर और उस रीति में, जैसी इस अधिनियम के द्वारा या अधीन अपेक्षित है, दाखिल करने में असफल रहा है; तथा

(ख) उस असफलता के लिए कोई अच्छा कारण या न्यायोचित्य नहीं रखता है,

यत:, तथ्यों और उपलब्ध अभिलेखों के आधार पर आयोग का यह समाधान हो गया है कि फ्रे डी जैक्सन परेरा, निर्वाचन व्यय के लेखे दाखिल करने में असफल रहे हैं और उनके पास ऐसा करने में असफल रहने के लिए कोई भी उचित कारण अथवा औचित्य नहीं है; और

अत:, अब, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अनुसरण में, भारत निर्वाचन आयोग एतद्द्वारा घोषणा करता है कि के रल के 11 - चालाकु डी संसदीय निर्वाचन क्षेत्र के लिए लोक सभा का साधारण निर्वाचन 2019 से निर्वाचन लड़ने वाले अभ्यर्थी फ्रे डी जैक्सन परेरा, निवासी पालकापरम्बिल विदु, पश्चिम चालक्कु डी, चालक्कु डी डाकघर त्रिस्सूर -680307 इस आदेश की तारीख से तीन वर्ष की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य-क्षेत्र की विधान सभा अथवा विधान परिषद का सदस्य चुने जाने अथवा होने के लिए निर्रर्हत होंगे।

O.N. 2.—WHEREAS, the General Election to the House of People of Kerala, 2019 for 11-Chalakudy Parliamentary Constituency was held in pursuance of the Election Commission of India Notification No. 464/EPS/2019(3), dated 28th March, 2019; and

WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate at an election shall, within 30 days from the date of election of the returned candidate, lodge with the District Election Officer an account of his election expenses which shall be a true copy of the account kept by him or his election agent under Section 77 of the said act; and

WHEREAS, the result of the election for 11-Chalakudy Parliamentary Constituency of Kerala, 2019 was declared by the Returning Officer on 23rd May, 2019 and hence the last date for lodging the account of Election Expenses was 22nd June, 2019; and

WHEREAS, as per the report dated 24.06.2019 submitted by DEO, Ernakulam under sub-rule (1) of Rule 89 of the Conduct of Elections Rules, 1961 received through the CEO, Kerala vide his letter no. 4535/EL1/2019/Elec., dated 05.11.2019 stating that Fredy Jackson Pereira, a contesting candidate from 11-Chalakudy Parliamentary Constituency of Kerala, 2019 has failed to lodge his account of election expenses, as required under law; and WHEREAS, on basis of the said report of District Election Officer, Ernakulam a Show-Cause Notice no. 76/KL-HP/11/2019, dated 29th November, 2019 was issued under sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India to Fredy Jackson Pereira, for not lodging of the account of election expenses; and

WHEREAS, through the above said Show Cause Notice and under sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, Fredy Jackson Pereira was directed to submit a representation in writing to the Commission explaining the reasons for not lodging the account and also to lodge the account of election expenses with the District Election Officer, Ernakulam within 20 days from the date of receipt of the notice; and

WHEREAS, the District Election Officer, Ernakulam District has reported that the said notice was served to Freddy Jackson Pereira on 16.12.2019; and

WHEREAS, the District Election Officer, Ernakulam in his Supplementary Report vide letter no. DECKM/7343/N1, dated 05.11.2022 reported that Fredy Jackson Pereira has not submitted any representation or⁶ THE GAZETTE OF INDIA : JANUARY ²¹, ²⁰²³/MAGHA ¹, ¹⁹⁴⁴ [PART II—SEC. ³(iii)] lodged his accounts. Further, after receipt of the said notice, Fredy Jackson Pereira neither furnished any reason nor any explanation to the Election Commission of India, for failure to lodge the account as prescribed under law; and WHEREAS, the Section 10A of the Representation of the People Act, 1951 provides that:-

"If the Election Commission is satisfied that a person:-

(a) has failed to lodge an account of election expenses, within the time and in the manner required by or under this

Act, and

(b) has no good reason or justification for the failure,

the Election Commission shall, by order published in the Official Gazette, declare him to be disqualified and any such

person shall be disqualified for a period of three years from the date of the order.";

WHEREAS, on basis of the facts and available records, the Commission is satisfied that Fredy Jackson Pereira has failed to lodge his account of election expenses and has no good reason or justification for the failure to do so; and

NOW, THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission of India hereby declares Fredy Jackson Pereira, resident of – Palackaparambil Veedu, West Chalakkudy Chalakkudy P O Thrissur -680307 and a contesting candidate from 11-Chalakudy Parliamentary Constituency in General Elections to the House of People of Kerala, 2019 to be disqualified for being chosen as and for being a member of either House of the Parliament or the Legislative Assembly or the Legislative Council of a State or Union Territory for a period of three years from the date of this order.

यत:, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 78 के अनुसार, किसी भी निर्वाचन में निर्वाचन लड़ने वाला प्रत्येक अभ्यर्थी, निर्वाचित अभ्यर्थी के निर्वाचन की तारीख से 30 दिनों के भीतर अपने निर्वाचन व्यय के लेखे जिला निर्वाचन अधिकारी के पास दाखिल करेगा, जो उक्त अधिनियम की धारा 77 के तहत उसके द्वारा या उसके निर्वाचन अभिकर्ता द्वारा रखे गए लेखे की एक सत्य प्रति होगी; और

यतः, के रल के 62-कु न्नामकु लम विधान सभा निर्वाचन क्षेत्र के लिए निर्वाचन, 2021 का परिणाम, रिर्टनंिग अधिकारी द्वारा दिनांक 02 मई, 2021 को घोषित किया गया था और इस प्रकार निर्वाचन व्यय के लेखे दाखिल करने की अन्तिम तारीख 01 जून, 2021 थी; और

यतः, आयोग ने कोविड-19 की तत्कालीन वैकिि महामारी की स्थिति को ध्यान में रखते हुए अभ्यर्थी द्वारा 31 जुलाई, 2021 तक विलंब से लेखा प्रस्तुत करने की किसी भी घटना को माफ करने का निर्णय लिया; और

यतः, निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (1) के तहत, मुख्य निर्वाचन अधिकारी, के रल से उनके पत्र सं. ईएल1/2/2021-ईएलईसी, दिनांक 24.08.2021 के तहत प्राप्त जिला निर्वाचन अधिकारी, त्रिस्सूर की दिनांक 30.06.2021 की रिपोर्ट के अनुसार, मोईद्दीन के . एम. पुत्र मुहम्मद, जो के रल के साधारण निर्वाचन के 62-कु न्नामकु लम विधान सभा क्षेत्र 2021 से निर्वाचन लड़ने वाले अभ्यर्थी हैं, विधि के अंतर्गत यथा अपेक्षित रीति से अपने निर्वाचन व्यय के लेखे दाखिल करने में असफल रहे हैं; और

यतः, जिला निर्वाचन अधिकारी की उक्त रिपोर्ट के आधार पर, भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (5) के अंतर्गत मोईद्दीन के . एम. पुत्र मुहम्मद को अपने निर्वाचन व्यय के लेखे प्रस्तुत नहीं करने के लिए कारण बताओ नोटिस सं. 76/के एल-एलए/2021/सीईएमएस-II, दिनांक 06 अक्तू बर, 2021 जारी किया गया था; और[भाग II—खण्ड 3(iii)] भारत का राजपत्र : जनवरी ²¹, ²⁰²²/माघ ¹, ¹⁹⁴⁴ ⁷ यतः, उपयु र्क्त उक्त कारण बताओ नोटिस के जरिए और निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप- नियम (6) के अंतर्गत, मोईद्दीन के . एम. पुत्र मुहम्मद को लेखा दाखिल नहीं किए जाने संबंधी कारणों को स्पष्ट करते हुए आयोग को लिखित में अपना अभ्यावेदन प्रस्तुत करने तथा नोटिस प्राप्त होने की तारीख से 20 दिनों के अंदर जिला निर्वाचन अधिकारी, त्रिस्सूर जिला को अपने निर्वाचन व्यय के लेखे प्रस्तुत करने का निदेश दिया गया था; और

यतः, मोईद्दीन के . एम. पुत्र मुहम्मद को उक्त नोटिस दिनांक 25.02.2022 को तामील किया गया था; और

यतः, जिला निर्वाचन अधिकारी, त्रिस्सूर की अभ्यर्थी के संबंध में अनुपूरक रिपोर्ट दिनांक 02.11.2022 में यह सूचित किया कि मोईद्दीन के . एम. पुत्र मुहम्मद ने निर्वाचन व्यय के सही लेखे का कोई विवरण या अभ्यावेदन प्रस्तुत नहीं किया है। इसके अतिरिक्त, उक्त नोटिस मिलने के बाद मोईद्दीन के . एम. पुत्र मुहम्मद ने विधि के तहत यथा निर्धारित लेखे दाखिल करने में असफल रहने के लिए भारत निर्वाचन आयोग को न तो कोई कारण बताया है और न ही कोई स्पष्टीकरण दिया है; और

यत:, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में यह उपबंधित किया गया है कि:-

यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व् यक्ति-

(ख) उस असफलता के लिए कोई अच्छा कारण या न्यायोचित्य नहीं रखता है,

तो निर्वाचन आयोग शासकीय राजपत्र में प्रकाशित आदेश द्वारा उसको निर्रर्हत घोषित करेगा और ऐसा व् यक्ति उस आदेश की तारीख से तीन वर्ष की कालावधि के लिए निर्रर्हत होगा।";

यत:, तथ्यों और उपलब्ध अभिलेखों के आधार पर आयोग का यह समाधान हो गया है कि मोईद्दीन के . एम. पुत्र मुहम्मद अपने निर्वाचन व्यय के लेखे दाखिल करने में असफल रहे हैं और उनके पास ऐसा करने में असफल रहने के लिए कोई भी उचित कारण अथवा औचित्य नहीं है; और

अत:, अब, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अनुसरण में, भारत निर्वाचन आयोग एतद्द्वारा घोषणा करता है कि के रल के 62-कु न्नामकु लम विधान सभा निर्वाचन क्षेत्र के लिए साधारण निर्वाचन, 2021 से निर्वाचन लड़ने वाले अभ्यर्थी मोईद्दीन के . एम. पुत्र मुहम्मद, निवासी कु न्नथुपीडिकाईल वेदू, डाकघर- वारावुर पिन- 680585 इस आदेश की तारीख से तीन वर्ष की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य-क्षेत्र की विधान सभा अथवा विधान परिषद का सदस्य चुने जाने अथवा होने के लिए निर्रर्हत होंगे।

O.N. 3.—WHEREAS, the General Election to Legislative Assembly of Kerala, 2021 for 62-Kunnamkulam Assembly Constituency was held in pursuance of the Election Commission of India Notification No. 464/KL- LA/2021, dated 12th March, 2021; and

WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate at an election shall, within 30 days from the date of election of the returned candidate, lodge with the District Election Officer an account of his election expenses which shall be a true copy of the account kept by him or his election agent under Section 77 of the said act; and

WHEREAS, the result of the election for 62- Kunnamkulam Assembly Constituency of Kerala, 2021 was declared by the Returning Officer on 02nd May, 2021 and hence the last date for lodging the account of Election Expenses was 01st June, 2021; and

WHEREAS, the Commission having regard to the then prevailing pandemic situation of Covid-19, decided to condone any incidence of late submission of account by candidate till 31st July, 2021; and⁸ THE GAZETTE OF INDIA : JANUARY ²¹, ²⁰²³/MAGHA ¹, ¹⁹⁴⁴ [PART II—SEC. ³(iii)] WHEREAS, as per the report dated 30.06.2021 of the DEO, Thrissur under sub-rule (1) of the Rule 89 of the Conduct of Elections Rules, 1961 received through CEO, Kerala vide his letter no. EL1/2/2021-ELEC, dated 24.08.2021 stating that Moideen K.M. S/o Muhammed, a contesting candidate from 62- Kunnamkulam Assembly Constituency in General Election to Legislative Assembly of Kerala, 2021 has failed to lodge his account of election expenses, as required under law; and

WHEREAS, on basis of the said report of District Election Officer, Thrissur a Show-Cause notice No. 76/KL-LA/2021/CEMS-II, dated 06th October, 2021 was issued under sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India to Moideen K.M. S/o Muhammed, for not lodging of account of Election Expenses; and

WHEREAS, through the above said Show Cause Notice and under sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, Moideen K.M. S/o Muhammed was directed to submit a representation in writing to the Commission explaining the reasons for not lodging the account and also to lodge account of election expenses with the District Election Officer, Thrissur District within 20 days from the date of receipt of the notice; and

WHEREAS, the said Show Cause Notice was served to Moideen K.M. S/o Muhammed on 25.02.2022;

and

WHEREAS, the District Election Officer, Thrissur in his Supplementary Report on account of the candidate dated 02.11.2022, has reported that Moideen K.M. S/o Muhammed has not submitted any representation or statement of correct account of election expenses. Besides, after receipt of the said notice, Moideen K.M. S/o Muhammed has neither furnished any reason nor any explanation to the Election Commission of India, for failure to lodge the account as prescribed under law; and

WHEREAS, Section 10A of the Representation of the People Act, 1951 provides that:-

"If the Election Commission is satisfied that a person-

(a) has failed to lodge an account of election expenses within the time and in the manner required by or under this

Act, and

(b) has no good reason or justification for the failure,

the Election Commission shall, by order published in the Official Gazette, declare him to be disqualified and any such

person shall be disqualified for a period of three years from the date of the order.";

WHEREAS, on basis of the facts and available records, the Commission is satisfied that Moideen K.M. S/o Muhammed has failed to lodge his account of election expenses and has no good reason or justification for the failure to do so; and

NOW, THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission of India hereby declares Moideen K.M. S/o Muhammed, resident of-Kunnathupeedikayil Veedu, Varavur- PO, Pin- 680585 and a contesting candidate in 62-Kunnamkulam Assembly Constituency of Kerala, 2021, to be disqualified for being chosen as and for being a member of either House of the Parliament or the Legislative Assembly or the Legislative Council of a State or Union Territory for a period of three years from the date of this order.

यतः, जिला निर्वाचन अधिकारी की उक्त रिपोर्ट के आधार पर, भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (5) के अंतर्गत वी. बिंदु पत्नी रामचंरन को अपने निर्वाचन व्यय के लेखे प्रस्तुत नहीं करने के लिए कारण बताओ नोटिस सं. 76/के एल-एलए/2021/सीईएमएस-।।, दिनांक 06 अक्तू बर, 2021 जारी किया गया था; और

यतः, उपयु र्क्त कारण बताओ नोटिस के जरिए और निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप- नियम (6) के अंतर्गत, वी. बिंदु पत्नी रामचंरन को लेखे दाखिल नहीं किए जाने संबंधी कारणों को स्पष्ट करते हुए आयोग को लिखित में अभ्यावेदन प्रस्तुत करने तथा नोटिस प्राप्त होने की तारीख से 20 दिनों के अंदर जिला निर्वाचन अधिकारी, त्रिस्सूर जिला को निर्वाचन व्यय के लेखे प्रस्तुत करने का निदेश दिया गया था; और

यतः, जिला निर्वाचन अधिकारी, त्रिस्सूर जिला ने बताया है कि वी. बिंदु पत्नी रामचंरन को उक्त नोटिस, उनके स्थाई आवासीय पते 14/219- पर सुब्रमन्यन पुत्र बाला. कायापुरथ और अभिलाश पुत्र ससि. ईक्कानदमपारामबिल की उपस्थिति में चस्पा करके दिनांक 20.05.2022 को तामील किया गया था, क्योंकि उसने नोटिस लेने से मना कर दिया था;

और

यतः, जिला निर्वाचन अधिकारी, त्रिस्सूर की अभ्यर्थी के संबंध में अनुपूरक रिपोर्ट दिनांक 02.11.2022 में यह सूचित किया है कि वी. बिंदु पत्नी रामचंरन ने निर्वाचन व्यय के सही लेखे का कोई विवरण या अभ्यावेदन प्रस्तुत नहीं किया है। इसके अतिरिक्त, उपयु र्क्त नोटिस के प्राप्त होने के बाद वी. बिंदु पत्नी रामचंरन ने विधि के तहत यथा निर्धारित लेखे¹² THE GAZETTE OF INDIA : JANUARY ²¹, ²⁰²³/MAGHA ¹, ¹⁹⁴⁴ [PART II—SEC. ³(iii)] दाखिल करने में असफल रहने के लिए भारत निर्वाचन आयोग को न तो कोई कारण बताया है और न ही कोई स्पष्टीकरण दिया है; और

यत:, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में यह उपबंधित किया गया है कि:-

''यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व् यक्ति-

(क) निर्वाचन व्ययों का लेखा उस समय के भीतर और उस रीति में जैसी इस अधिनियम के द्वारा या अधीन अपेक्षित है ,दाखिल करने में असफल रहा है ; तथा

(ख) उस असफलता के लिए कोई अच्छा कारण या न्यायोचित्य नहीं रखता है ,

तो निर्वाचन आयोग शासकीय राजपत्र में प्रकाशित आदेश द्वारा उसको निर्रर्हत घोषित करेगा और ऐसा व् यक्ति उस आदेश की तारीख से तीन वर्ष की कालावधि के लिए निर्रर्हत होगा।";

यत:, तथ्यों और उपलब्ध रिकाडों के आधार पर आयोग का यह समाधान हो गया है कि वी. बिंदु पत्नी रामचंरन निर्वाचन व्यय के लेखे दाखिल करने में असफल रही हैं और उनके पास ऐसा करने में असफल रहने के लिए कोई भी उचित कारण अथवा औचित्य नहीं है; और

अत:, अब, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अनुसरण में, भारत निर्वाचन आयोग एतद्द्वारा घोषणा करता है कि के रल के 70-इरिन्जालाकु डा विधान सभा निर्वाचन क्षेत्र के लिए साधारण निर्वाचन, 2021 से निर्वाचन लड़ने वाली अभ्यर्थी वी. बिंदु पत्नी रामचंरन निवासी-तेक्किल हाउस, वेल्लानी, करालम इस आदेश की तारीख से तीन वर्ष की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य-क्षेत्र की विधान सभा अथवा विधान परिषद का सदस्य चुने जाने अथवा होने के लिए निर्रर्हत होंगी।

O.N. 5.—WHEREAS, the General Election to Legislative Assembly of Kerala, 2021 for 70- Irinjalakuda Assembly Constituency was held in pursuance of the Election Commission of India Notification No. 464/KL- LA/2021, dated 12th March, 2021; and

WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate at an election shall, within 30 days from the date of election of the returned candidate, lodge with the District Election Officer an account of his/her election expenses which shall be a true copy of the account kept by him/her or his/her election agent under Section 77 of the said act; and

WHEREAS, the Commission having regard to the then prevailing pandemic situation of Covid-19, decided to condone any incidence of late submission of account by candidate till 31st July, 2021; and

WHEREAS, as per the report dated 29.06.2021 of the DEO, Thrissur, under sub-rule (1) of the Rule 89 of the Conduct of Elections Rules, 1961 received through CEO, Kerala vide his letter no. EL1/2/2021-ELEC, dated 24.08.2021 stating that V. Bindu W/o Ramachandran, a contesting candidate from 70- Irinjalakuda Assembly Constituency in General Election to Legislative Assembly of Kerala, 2021 has failed to lodge her account of election expenses, as required under law; and

WHEREAS, on basis of the said report of District Election Officer, Thrissur a Show-Cause notice No. 76/KL-LA/2021/CEMS-II, dated 06th October, 2021 was issued under sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India to V. Bindu W/o Ramachandran, for not lodging of account of Election Expenses; and

WHEREAS, through the above said Show Cause Notice and under sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, V. Bindu W/o Ramachandran was directed to submit a representation in writing to the[भाग II—खण्ड 3(iii)] भारत का राजपत्र : जनवरी ²¹, ²⁰²²/माघ ¹, ¹⁹⁴⁴ ¹³ Commission explaining the reasons for not lodging the account and also to lodge the account of election expenses with the District Election Officer, Thrissur District within 20 days from the date of receipt of the notice; and WHEREAS, the District Election Officer, Thrissur District reported that the said notice was served to V. Bindu W/o Ramachandran on 20.05.2022 via affixing the notice at her permanent residential address–XIV- 219 in the presence of Subramanyan S/o Bala. Kayapurath and Abhilash S/o of Sasi. Ikkandamparambil as she refused to accept the notice; and

WHEREAS, the District Election Officer, Thrissur in his Supplementary Report on account of the candidate dated 02.11.2022, has reported that V. Bindu W/o Ramachandran has not submitted any representation or statement of correct account of the election expenses. Besides, after receipt of the said notice, V. Bindu W/o Ramachandran has neither furnished any reason nor any explanation to the Election Commission of India, for failure to lodge the account as prescribed under law; and

WHEREAS, Section 10A of the Representation of the People Act, 1951 provides that:-

"If the Election Commission is satisfied that a person-

(a) has failed to lodge an account of election expenses within the time and in the manner required by or under this

Act; and

(b) has no good reason or justification for the failure,

the Election Commission shall, by order published in the Official Gazette, declare him to be disqualified and any such

person shall be disqualified for a period of three years from the date of the order.";

WHEREAS, on basis of the facts and available records, the Commission is satisfied that V. Bindu W/o Ramachandran has failed to lodge her account of election expenses and has no good reason or justification for the failure to do so; and

NOW, THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission of India hereby declares V. Bindu W/o Ramachandran, resident of - Thekkil House, Vellani, Karalam and a contesting candidate in 70- Irinjalakuda Assembly Constituency of Kerala, 2021 to be disqualified for being chosen as and for being a member of either House of the Parliament or the Legislative Assembly or the Legislative Council of a State or Union Territory for a period of three years from the date of this order.

आ.अ. 6.—यतः, भारत निर्वाचन आयोग की दिनांक 12 मार्च, 2021 की अधिसूचना सं. 464/के एल- एलए/2021 के अनुसरण में 65-वडक्कान्चेरी विधान सभा निर्वाचन क्षेत्र के लिए के रल विधान सभा का साधारण निर्वाचन 2021 आयोजित किया गया था; और

यत:, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 78 के अनुसार, किसी भी निर्वाचन में निर्वाचन लड़ने वाला प्रत्येक अभ्यर्थी, निर्वाचित अभ्यर्थी के निर्वाचन की तारीख से 30 दिनों के भीतर अपने निर्वाचन व्यय के लेखे जिला निर्वाचन अधिकारी के पास दाखिल करेगा, जो उक्त अधिनियम की धारा 77 के तहत उसके द्वारा या उसके निर्वाचन अभिकर्ता द्वारा रखे गए लेखे की एक सत्य प्रति होगी; और

यतः, के रल के 65-वडक्कान्चेरी विधान सभा निर्वाचन क्षेत्र के लिए निर्वाचन, 2021 का परिणाम, रिर्टनंिग अधिकारी द्वारा दिनांक 02 मई, 2021 को घोषित किया गया था और इस प्रकार निर्वाचन व्यय के लेखे दाखिल करने की अन्तिम तारीख 01 जून, 2021 थी; और

यतः, निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (1) के तहत, मुख्य निर्वाचन अधिकारी, के रल से उनके पत्र सं. ईएल1/2/2021-ईएलईसी, दिनांक 24.08.2021 के तहत प्राप्त जिला निर्वाचन¹⁴ THE GAZETTE OF INDIA : JANUARY ²¹, ²⁰²³/MAGHA ¹, ¹⁹⁴⁴ [PART II—SEC. ³(iii)] अधिकारी, त्रिस्सूर की दिनांक 29.05.2021 की रिपोर्ट के अनुसार, हाजी अबुबकर कु ं डुकादन, जो के रल के साधारण निर्वाचन के 65-वडक्कान्चेरी विधान सभा क्षेत्र 2021 से निर्वाचन लड़ने वाले अभ्यर्थी हैं, विधि के अंतर्गत यथा अपेक्षित रीति से अपने निर्वाचन व्यय के लेखे दाखिल करने में असफल रहे हैं; और

यतः, जिला निर्वाचन अधिकारी की उक्त रिपोर्ट के आधार पर, भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (5) के अंतर्गत हाजी अबुबकर कु ं डुकादन को अपने निर्वाचन व्यय के लेखे प्रस्तुत नहीं करने के लिए कारण बताओ नोटिस सं. 76/के एल-एलए/2021/सीईएमएस-II, दिनांक 06 अक्तू बर, 2021 जारी किया गया था; और

यतः, उपयु र्क्त उक्त कारण बताओ नोटिस के जरिए और निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप- नियम (6) के अंतर्गत, हाजी अबुबकर कु ं डुकादन को लेखा दाखिल नहीं किए जाने संबंधी कारणों को स्पष्ट करते हुए आयोग को लिखित में अपना अभ्यावेदन प्रस्तुत करने तथा नोटिस प्राप्त होने की तारीख से 20 दिनों के अंदर जिला निर्वाचन अधिकारी, त्रिस्सूर जिला को अपने निर्वाचन व्यय के लेखे प्रस्तुत करने का निदेश दिया गया था; और

यतः,हाजी अबुबकर कु ं डुकादन को उक्त नोटिस दिनांक 25.10.2021 को तामील किया गया था; और

यतः, जिला निर्वाचन अधिकारी, त्रिस्सूर की अभ्यर्थी के संबंध में अनुपूरक रिपोर्ट दिनांक 02.11.2022 में यह सूचित किया कि हाजी अबुबकर कु ं डुकादन ने निर्वाचन व्यय के सही लेखे का कोई विवरण या अभ्यावेदन प्रस्तुत नहीं किया है। इसके अतिरिक्त, उक्त नोटिस मिलने के बाद हाजी अबुबकर कु ं डुकादन ने विधि के तहत यथा निर्धारित लेखे दाखिल करने में असफल रहने के लिए भारत निर्वाचन आयोग को न तो कोई कारण बताया है और न ही कोई स्पष्टीकरण दिया है; और

यत:, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में यह उपबंधित किया गया है कि:-

यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व् यक्ति-

अत:, अब, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अनुसरण में, भारत निर्वाचन आयोग एतद्द्वारा घोषणा करता है कि के रल के 65-वडक्कान्चेरी विधान सभा निर्वाचन क्षेत्र के लिए साधारण निर्वाचन, 2021 से निर्वाचन लड़ने वाले अभ्यर्थी हाजी अबुबकर कु ं डुकादन, निवासी पुवाथींगल वेद, डाकघर – परलीक्कड इस आदेश की तारीख से तीन वर्ष की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य-क्षेत्र की विधान सभा अथवा विधान परिषद का सदस्य चुने जाने अथवा होने के लिए निर्रर्हत होंगे।

WHEREAS, on basis of the said report of District Election Officer, Thrissur a Show-Cause notice No. 76/KL-LA/2021/CEMS-II, dated 06th October, 2021 was issued under sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India to Haji Aboobaker Kundukadan, for not lodging of account of Election Expenses; and

WHEREAS, through the above said Show Cause Notice and under sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, Haji Aboobaker Kundukadan was directed to submit a representation in writing to the Commission explaining the reasons for not lodging the account and also to lodge the account of election expenses with the District Election Officer, Thrissur District within 20 days from the date of receipt of the notice; and

WHEREAS, the said Show Cause Notice was served to Haji Aboobaker Kundukadan on 25.10.2021; and

WHEREAS, the District Election Officer, Thrissur in his Supplementary Report on account of the candidate dated 02.11.2022, has reported that Haji Aboobaker Kundukadan has not submitted any representation or statement of correct account of election expenses. Besides, after receipt of the said notice, Haji Aboobaker Kundukadan has neither furnished any reason nor any explanation to the Election Commission of India, for failure to lodge the account as prescribed under law; and
