आ. अ. 38.—यतः, भारत निर्वाचन आयोग की दिनांक 12 मार्च, 2021 की अधिसूचना सं. 464/के एल- एलए/2021 के अनुसरण में 70-इरिन्जालाकु डा विधान सभा निर्वाचन क्षेत्र के लिए के रल विधान सभा का साधारण निर्वाचन, 2021 आयोजित किया गया था; और

यत:, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 78 के अनुसार, किसी भी निर्वाचन में निर्वाचन लड़ने वाला प्रत्येक अभ्यर्थी, निर्वाचित अभ्यर्थी के निर्वाचन की तारीख से 30 दिनों के भीतर अपने निर्वाचन व्यय के लेखे जिला निर्वाचन अधिकारी के पास दाखिल करेगा जो उक्त अधिनियम की धारा 77 के तहत उसके या उसके निर्वाचन अभिकर्ता द्वारा रखे गए लेखे की एक सत्य प्रति होगी; और

यतः, के रल के 70-इरिन्जालाकु डा विधान सभा निर्वाचन क्षेत्र के लिए निर्वाचन, 2021 का परिणाम, रिर्टनंिग अधिकारी द्वारा दिनांक 02 मई, 2021 को घोषित किया गया था और इस प्रकार निर्वाचन व्यय के लेखे दाखिल करने की अन्तिम तारीख 01, जून, 2021 थी; और

(83)⁸⁴ THE GAZETTE OF INDIA : MARCH ⁴, ²⁰²³/PHALGUNA ¹³, ¹⁹⁴⁴ [PART II—SEC. ³(iii)] यतः, आयोग ने कोविड-19 की तत्कालीन व्याप्त वैकिि महामारी की स्थिति को ध्यान में रखते हुए, अभ्यर्थी द्वारा 31 जुलाई, 2021 तक विलंब से लेखा प्रस्तुत करने के किसी भी मामले को माफ करने का निर्णय लिया; और

70-इरिन्जालाकु डा विधान सभा निर्वाचन क्षेत्र, 2021 से निर्वाचन लड़ने वाली अभ्यर्थी हैं, विधि के अंतर्गत यथा अपेक्षित रीति से अपने निर्वाचन व्यय का लेखा दाखिल करने में असफल रही हैं; और

यतः, जिला निर्वाचन अधिकारी की उक्त रिपोर्ट के आधार पर, भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (5) के अंतर्गत एम.बिंधु पत्नी सिवदासन को निर्वाचन व्यय के लेखे प्रस्तुत नहीं करने के लिए कारण बताओ नोटिस सं. 76/के एल-एलए/2021/सीईएमएस-II, दिनांक 06 अक्तू बर, 2021 जारी किया गया था; और

यतः, उपयु र्क्त उक्त कारण बताओ नोटिस के जरिए और निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (6) के अंतर्गत, एम.बिंधु पत्नी सिवदासन को लेखे दाखिल नहीं किए जाने संबंधी कारणों को स्पष्ट करते हुए आयोग को लिखित में अभ्यावेदन प्रस्तुत करने तथा नोटिस प्राप्त होने की तारीख से 20 दिनों के अंदर जिला निर्वाचन अधिकारी, त्रिस्सूर जिला को निर्वाचन व्यय के लेखे प्रस्तुत करने का निदेश दिया गया था; और

यतः, एम.बिंधु पत्नी सिवदासन को उक्त नोटिस दिनांक 25.10.2021 को तामील किया गया था; और

यतः, जिला निर्वाचन अधिकारी, त्रिस्सूर की अभ्यर्थी के संबंध में अनुपूरक रिपोर्ट दिनांक 02.11.2022 में यह

र्क्त नोटिस के प्राप्त होने के बाद एम.बिंधु पत्नी सिवदासन ने विधि के तहत यथा निर्धारित सूचित किया है कि एम.बिंधु पत्नी सिवदासन ने निर्वाचन व्यय के सही लेखे का कोई विवरण या अभ्यावेदन प्रस्तुत नहीं किया है। इसके अतिरिक्त, उपयु

लेखे दाखिल करने में असफल रहने के लिए भारत निर्वाचन आयोग को न तो कोई कारण बताया है और न ही कोई स्पष्टीकरण दिया है; और

यत:, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में यह उपबंधित किया गया है कि:-

''यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति-

(क) निर्वाचन व्ययों का लेखा उस समय के भीतर और उस रीति में जैसी इस अधिनियम के द्वारा या अधीन अपेक्षित है, दाखिल करने में असफल रहा है; तथा

(ख) उस असफलता के लिए कोई अच्छा कारण या न्यायोचित्य नहीं रखता है,

तो निर्वाचन आयोग शासकीय राजपत्र में प्रकाशित आदेश द्वारा उसको निर्रर्हत घोषित करेगा और ऐसा व्यक्ति उस आदेश की तारीख से तीन वर्ष की कालावधि के लिए निर्रर्हत होगा।";

यत:, तथ्यों और उपलब्ध रिकाडों के आधार पर आयोग का यह समाधान हो गया है कि एम.बिंधु पत्नी शिवदासन निर्वाचन व्यय के लेखे दाखिल करने में असफल रही हैं और उनके पास ऐसा करने में असफल रहने के लिए कोई भी उचित कारण अथवा औचित्य नहीं है; और

अत:, अब, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अनुसरण में, भारत निर्वाचन आयोग एतद्द्वारा घोषणा करता है कि के रल के 70-इरिन्जालाकु डा विधान सभा निर्वाचन क्षेत्र के लिए साधारण निर्वाचन, 2021 से निर्वाचन लड़ने वाली अभ्यर्थी एम.बिंधु पत्नी सिवदासन निवासी-मनियादन हाउस, वेल्लििाप्पारा डाकघर कन्नमकु झी, अथिरापिल्ली (वीआईए) चालकु डी इस आदेश की तारीख से तीन वर्ष की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य-क्षेत्र की विधान सभा अथवा विधान परिषद का सदस्य चुने जाने अथवा होने के लिए निर्रर्हत होंगी।

ELECTION COMMISSION OF INDIA

ORDER

New Delhi, the 16th January, 2023

O.N. 38.—WHEREAS, the General Election to Legislative Assembly of Kerala, 2021 for 70- Irinjalakuda Assembly Constituency was held in pursuance of the Election Commission of India Notification No. 464/KL- LA/2021, dated 12th March, 2021; and

WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate at an election shall, within 30 days from the date of election of the returned candidate, lodge with the District Election Officer an account of his/her election expenses which shall be a true copy of the account kept by him/her or his/her election agent under Section 77 of the said act; and

WHEREAS, the result of the election for 70- Irinjalakuda Assembly Constituency of Kerala, 2021 was declared by the Returning Officer on 02nd May, 2021 and hence the last date for lodging the account of election expenses was 01st June, 2021; and

WHEREAS, the Commission having regard to the then prevailing pandemic situation of Covid-19, decided to condone any incidence of late submission of the account by the candidate till 31st July, 2021; and

WHEREAS, as per the report dated 29.06.2021 of the DEO, Thrissur under sub-rule (1) of the Rule 89 of the Conduct of Elections Rules, 1961 received through CEO, Kerala vide his letter no. EL1/2/2021-ELEC, dated 24.08.2021 stating that M. Bindhu W/o Sivadasan, a contesting candidate from 70- Irinjalakuda Assembly Constituency in General Election to Legislative Assembly of Kerala, 2021 has failed to lodge her account of election expenses, as required under law; and

WHEREAS, through the above said Show Cause Notice and under sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, M. Bindhu W/o Sivadasan was directed to submit a representation

in writing to the Commission explaining the reasons for not lodging the account and also to lodge the account of election expenses with the District Election Officer, Thrissur District within 20 days from the date of receipt of the notice; and

WHEREAS, the said Show Cause Notice was served to M. Bindhu W/o Sivadasan on 25.10.2021; and

WHEREAS, the District Election Officer, Thrissur in his Supplementary Report on account of the candidate dated 02.11.2022, has reported that M. Bindhu W/o Sivadasan has not submitted any representation or statement of correct account of the election expenses. Besides, after receipt of the said notice, M. Bindhu W/o Sivadasan has neither furnished any reason nor any explanation to the Election Commission of India, for failure to lodge the account as prescribed under law; and

WHEREAS, Section 10A of the Representation of the People Act, 1951 provides that:-

"If the Election Commission is satisfied that a person-

(a) has failed to lodge an account of election expenses within the time and in the manner required by or under this

Act, and

(b) has no good reason or justification for the failure,

the Election Commission shall, by order published in the Official Gazette, declare him to be disqualified and any such

person shall be disqualified for a period of three years from the date of the order.";

WHEREAS, on basis of the facts and available records, the Commission is satisfied that M. Bindhu⁸⁶ THE GAZETTE OF INDIA : MARCH ⁴, ²⁰²³/PHALGUNA ¹³, ¹⁹⁴⁴ [PART II—SEC. ³(iii)] W/o Sivadasan has failed to lodge her account of election expenses and has no good reason or justification for the failure to do so; and

NOW, THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission of India hereby declares M. Bindhu W/o Sivadasan, resident of - Maniyadan House, Vettillappara P.O. Kannamkuzhi, Athirapilly (VIA), Chalkudy and a contesting candidate in 70- Irinjalakuda Assembly Constituency of Kerala, 2021, to be disqualified for being chosen as and for being a member of either House of the Parliament or the Legislative Assembly or the Legislative Council of a State or Union Territory for a period of three years from the date of this order.

आ. अ. 39.—यतः, भारत निर्वाचन आयोग की दिनांक 12 मार्च, 2021 की अधिसूचना सं. 464/के एल- एलए/2021 के अनुसरण में 70-इरिन्जालाकु डा विधान सभा निर्वाचन क्षेत्र के लिए के रल विधान सभा का साधारण निर्वाचन, 2021 आयोजित किया गया था; और

यतः, निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (1) के तहत, मुख्य निर्वाचन अधिकारी, के रल से उनके पत्र सं. ईएल1/2/2021-ईएलईसी, दिनांक 24.08.2021 के तहत प्राप्त जिला निर्वाचन अधिकारी, त्रिस्सूर की दिनांक 29.06.2021 की रिपोर्ट के अनुसार, वी. बिंदु पत्नी रामचंरन, जो के रल के साधारण निर्वाचन के 70-इरिन्जालाकु डा विधान सभा निर्वाचन क्षेत्र, 2021 से निर्वाचन लड़ने वाली अभ्यर्थी हैं, विधि के अंतर्गत यथा अपेक्षित निर्वाचन व्यय के लेखे दाखिल करने में असफल रही हैं; और

यतः, जिला निर्वाचन अधिकारी की उक्त रिपोर्ट के आधार पर, भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (5) के अंतर्गत वी. बिंदु पत्नी रामचंरन को अपने निर्वाचन व्यय के लेखे प्रस्तुत नहीं करने के लिए कारण बताओ नोटिस सं. 76/के एल-एलए/2021/सीईएमएस-II, दिनांक 06 अक्तू बर, 2021 जारी किया गया था; और

यतः, उपयु र्क्त कारण बताओ नोटिस के जरिए और निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप- नियम (6) के अंतर्गत, वी. बिंदु पत्नी रामचंरन को लेखे दाखिल नहीं किए जाने संबंधी कारणों को स्पष्ट करते हुए आयोग को लिखित में अभ्यावेदन प्रस्तुत करने तथा नोटिस प्राप्त होने की तारीख से 20 दिनों के अंदर जिला निर्वाचन अधिकारी, त्रिस्सूर जिला को निर्वाचन व्यय के लेखे प्रस्तुत करने का निदेश दिया गया था; और

यतः, जिला निर्वाचन अधिकारी, त्रिस्सूर जिला ने बताया है कि वी. बिंदु पत्नी रामचंरन को उक्त नोटिस, उनके स्थाई आवासीय पते 14/219- पर सुब्रमन्यन पुत्र बाला. कायापुरथ और अभिलाश पुत्र ससि. ईक्कानदमपारामबिल की उपस्थिति में चस्पा करके दिनांक 20.05.2022 को तामील किया गया था, क्योंकि उसने नोटिस लेने से मना कर दिया था; और[भाग II—खण्ड 3(iii)] भारत का राजपत्र : मार्च ⁴, ²⁰²³/फाल्गुन ¹³, ¹⁹⁴⁴ ⁸⁷ यतः, जिला निर्वाचन अधिकारी, त्रिस्सूर की अभ्यर्थी के संबंध में अनुपूरक रिपोर्ट दिनांक 02.11.2022 में यह

र्क्त नोटिस के प्राप्त होने के बाद वी. बिंदु पत्नी रामचंरन ने विधि के तहत यथा निर्धारित लेखे सूचित किया है कि वी. बिंदु पत्नी रामचंरन ने निर्वाचन व्यय के सही लेखे का कोई विवरण या अभ्यावेदन प्रस्तुत नहीं किया है। इसके अतिरिक्त, उपयु

दाखिल करने में असफल रहने के लिए भारत निर्वाचन आयोग को न तो कोई कारण बताया है और न ही कोई स्पष्टीकरण दिया है; और

यत:, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में यह उपबंधित किया गया है कि:-

अत:, अब, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अनुसरण में, भारत निर्वाचन आयोग एतद्द्वारा घोषणा करता है कि के रल के 70-इरिन्जालाकु डा विधान सभा निर्वाचन क्षेत्र के लिए साधारण निर्वाचन, 2021 से निर्वाचन लड़ने वाली अभ्यर्थी वी. बिंदु पत्नी रामचंरन निवासी-तेक्किल हाउस, वेल्लानी, करालम इस आदेश की तारीख से तीन वर्ष की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य-क्षेत्र की विधान सभा अथवा विधान परिषद का सदस्य चुने जाने अथवा होने के लिए निर्रर्हत होंगी।

WHEREAS, on basis of the said report of District Election Officer, Thrissur a Show-Cause notice No. 76/KL- LA/2021/CEMS-II, dated 06th October, 2021 was issued under sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India to V. Bindu W/o Ramachandran, for not lodging of account of Election Expenses; and⁸⁸ THE GAZETTE OF INDIA : MARCH ⁴, ²⁰²³/PHALGUNA ¹³, ¹⁹⁴⁴ [PART II—SEC. ³(iii)] WHEREAS, through the above said Show Cause Notice and under sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, V. Bindu W/o Ramachandran was directed to submit a representation in writing to the Commission explaining the reasons for not lodging the account and also to lodge the account of election expenses with the District Election Officer, Thrissur District within 20 days from the date of receipt of the notice; and WHEREAS, the District Election Officer, Thrissur District reported that the said notice was served to V. Bindu W/o Ramachandran on 20.05.2022 via affixing the notice at her permanent residential address–XIV- 219 in the presence of Subramanyan S/o Bala. Kayapurath and Abhilash S/o of Sasi. Ikkandamparambil as she refused to accept the notice; and

WHEREAS, the District Election Officer, Thrissur in his Supplementary Report on account of the candidate dated 02.11.2022, has reported that V. Bindu W/o Ramachandran has not submitted any representation or statement of correct account of the election expenses. Besides, after receipt of the said notice, V. Bindu W/o Ramachandran has neither furnished any reason nor any explanation to the Election Commission of India, for failure to lodge the account as prescribed under law; and

यत:, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 78 के अनुसार, किसी भी निर्वाचन में निर्वाचन लड़ने वाला प्रत्येक अभ्यर्थी, निर्वाचित अभ्यर्थी के निर्वाचन की तारीख से 30 दिनों के भीतर अपने निर्वाचन व्यय के लेखे जिला निर्वाचन अधिकारी के पास दाखिल करेगा, जो उक्त अधिनियम की धारा 77 के तहत उसके द्वारा या उसके निर्वाचन अभिकर्ता द्वारा रखे गए लेखे की एक सत्य प्रति होगी; और

यतः, निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (1) के तहत, मुख्य निर्वाचन अधिकारी, के रल से उनके पत्र सं. ईएल1/2/2021-ईएलईसी, दिनांक 24.08.2021 के तहत प्राप्त जिला निर्वाचन अधिकारी, त्रिस्सूर की दिनांक 29.05.2021 की रिपोर्ट के अनुसार, हाजी अबुबकर कु ं डुकादन, जो के रल के साधारण निर्वाचन के 65-वडक्कान्चेरी विधान सभा क्षेत्र 2021 से निर्वाचन लड़ने वाले अभ्यर्थी हैं, विधि के अंतर्गत यथा अपेक्षित रीति से अपने निर्वाचन व्यय के लेखे दाखिल करने में असफल रहे हैं; और

यतः, जिला निर्वाचन अधिकारी की उक्त रिपोर्ट के आधार पर, भारत निर्वाचन आयोग द्वारा निर्वाचनों का

ं डुकादन को अपने निर्वाचन व्यय के संचालन नियम, 1961 के नियम 89 के उप-नियम (5) के अंतर्गत हाजी अबुबकर कु

लेखे प्रस्तुत नहीं करने के लिए कारण बताओ नोटिस सं. 76/के एल-एलए/2021/सीईएमएस-II, दिनांक 06 अक्तू बर, 2021 जारी किया गया था; और

यतः, उपयु र्क्त उक्त कारण बताओ नोटिस के जरिए और निर्वाचनों का संचालन नियम, 1961 के नियम 89 के

ं डुकादन को लेखा दाखिल नहीं किए जाने संबंधी कारणों को स्पष्ट करते हुए उप-नियम (6) के अंतर्गत, हाजी अबुबकर कु

आयोग को लिखित में अपना अभ्यावेदन प्रस्तुत करने तथा नोटिस प्राप्त होने की तारीख से 20 दिनों के अंदर जिला निर्वाचन अधिकारी, त्रिस्सूर जिला को अपने निर्वाचन व्यय के लेखे प्रस्तुत करने का निदेश दिया गया था; और

यतः,हाजी अबुबकर कु ं डुकादन को उक्त नोटिस दिनांक 25.10.2021 को तामील किया गया था; और

यतः, जिला निर्वाचन अधिकारी, त्रिस्सूर की अभ्यर्थी के संबंध में अनुपूरक रिपोर्ट दिनांक 02.11.2022 में यह सूचित किया कि हाजी अबुबकर कु ं डुकादन ने निर्वाचन व्यय के सही लेखे का कोई विवरण या अभ्यावेदन प्रस्तुत नहीं किया

ं डुकादन ने विधि के तहत यथा निर्धारित लेखे दाखिल है। इसके अतिरिक्त, उक्त नोटिस मिलने के बाद हाजी अबुबकर कु

करने में असफल रहने के लिए भारत निर्वाचन आयोग को न तो कोई कारण बताया है और न ही कोई स्पष्टीकरण दिया है;

और

यत:, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में यह उपबंधित किया गया है कि:-

यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व् यक्ति-

(क) निर्वाचन व्ययों का लेखा उस समय के भीतर और उस रीति में, जैसी इस अधिनियम के द्वारा या अधीन अपेक्षित है, दाखिल करने में असफल रहा है; तथा

(ख) उस असफलता के लिए कोई अच्छा कारण या न्यायोचित्य नहीं रखता है,

तो निर्वाचन आयोग शासकीय राजपत्र में प्रकाशित आदेश द्वारा उसको निर्रर्हत घोषित करेगा और ऐसा व् यक्ति उस आदेश की तारीख से तीन वर्ष की कालावधि के लिए निर्रर्हत होगा।";

यत:, तथ्यों और उपलब्ध अभिलेखों के आधार पर आयोग का यह समाधान हो गया है कि हाजी अबुबकर कु ं डुकादन अपने निर्वाचन व्यय के लेखे दाखिल करने में असफल रहे हैं और उनके पास ऐसा करने में असफल रहने के लिए कोई भी उचित कारण अथवा औचित्य नहीं है; और

अत:, अब, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अनुसरण में, भारत निर्वाचन आयोग एतद्द्वारा घोषणा करता है कि के रल के 65-वडक्कान्चेरी विधान सभा निर्वाचन क्षेत्र के लिए साधारण निर्वाचन, 2021 से निर्वाचन लड़ने वाले अभ्यर्थी हाजी अबुबकर कु ं डुकादन, निवासी पुवाथींगल वेद, डाकघर – परलीक्कड इस आदेश की तारीख से तीन वर्ष की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य-क्षेत्र की विधान सभा अथवा विधान परिषद का सदस्य चुने जाने अथवा होने के लिए निर्रर्हत होंगे।

O.N. 40.—WHEREAS, the General Election to Legislative Assembly of Kerala, 2021 for 65- Wadakkanchery Assembly Constituency was held in pursuance of the Election Commission of India Notification No. 464/KL- LA/2021, dated 12th March, 2021; and

WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate at an election shall, within 30 days from the date of election of the returned candidate, lodge with the District Election Officer an account of his election expenses which shall be a true copy of the account kept by him or his election agent under Section 77 of the said act; and

WHEREAS, the result of the election for 65- Wadakkanchery Assembly Constituency of Kerala, 2021 was declared by the Returning Officer on 02nd May, 2021 and hence the last date for lodging the account of election expenses was 01st June, 2021; and

WHEREAS, the Commission having regard to the then prevailing pandemic situation of Covid-19, decided to condone any incidence of late submission of account by candidate till 31st July, 2021; and

WHEREAS, as per the report dated 29.05.2021 of the DEO, Thrissur, under sub-rule (1) of the Rule 89 of the Conduct of Elections Rules, 1961 received through CEO, Kerala vide his letter no. EL1/2/2021-ELEC, dated 24.08.2021 stating that Haji Aboobaker Kundukadan, a contesting candidate from 65- Wadakkanchery Assembly Constituency in General Election to Legislative Assembly of Kerala, 2021 has failed to lodge his account of election expenses, as required under law; and

WHEREAS, through the above said Show Cause Notice and under sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, Haji Aboobaker Kundukadan was directed to submit a representation in writing to the Commission explaining the reasons for not lodging the account and also to lodge the account of election expenses with the District Election Officer, Thrissur District within 20 days from the date of receipt of the notice; and

WHEREAS, the said Show Cause Notice was served to Haji Aboobaker Kundukadan on 25.10.2021; and

WHEREAS, the District Election Officer, Thrissur in his Supplementary Report on account of the candidate dated 02.11.2022, has reported that Haji Aboobaker Kundukadan has not submitted any representation or statement of correct account of election expenses. Besides, after receipt of the said notice, Haji Aboobaker Kundukadan has neither furnished any reason nor any explanation to the Election Commission of India, for failure to lodge the account as prescribed under law; and

WHEREAS, Section 10A of the Representation of the People Act, 1951 provides that:-

"If the Election Commission is satisfied that a person-

(a) has failed to lodge an account of election expenses within the time and in the manner required by or under this

Act, and

(b) has no good reason or justification for the failure,

the Election Commission shall, by order published in the Official Gazette, declare him to be disqualified and any such

person shall be disqualified for a period of three years from the date of the order.";

WHEREAS, on basis of the facts and available records, the Commission is satisfied that Haji Aboobaker Kundukadan has failed to lodge his account of election expenses and has no good reason or justification for the failure to do so; and

NOW, THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission of India hereby declares Haji Aboobaker Kundukadan, resident of Poovathingal Veed,

P.O. Parlikkad and a contesting candidate in 65- Wadakkanchery Assembly Constituency of Kerala, 2021, to be disqualified for being chosen as and for being a member of either House of the Parliament or the Legislative Assembly or the Legislative Council of a State or Union Territory for a period of three years from the date of this order.

यत:, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 78 के अनुसार, किसी भी निर्वाचन में निर्वाचन लड़ने वाला प्रत्येक अभ्यर्थी, निर्वाचित अभ्यर्थी के निर्वाचन की तारीख से 30 दिनों के भीतर अपने निर्वाचन व्यय के लेखे जिला निर्वाचन अधिकारी के पास दाखिल करेगा, जो उक्त अधिनियम की धारा 77 के तहत उसके द्वारा या उसके निर्वाचन अभिकर्ता द्वारा रखे गए लेखे की एक सत्य प्रति होगी; और

यतः, के रल के 62-कु न्नामकु लम विधान सभा निर्वाचन क्षेत्र के लिए निर्वाचन, 2021 का परिणाम, रिर्टनंिग अधिकारी द्वारा दिनांक 02 मई, 2021 को घोषित किया गया था और इस प्रकार निर्वाचन व्यय के लेखे दाखिल करने की अन्तिम तारीख 01 जून, 2021 थी; और

यतः, आयोग ने कोविड-19 की तत्कालीन वैकिि महामारी की स्थिति को ध्यान में रखते हुए अभ्यर्थी द्वारा 31 जुलाई, 2021 तक विलंब से लेखा प्रस्तुत करने की किसी भी घटना को माफ करने का निर्णय लिया; और

O.N. 42.—WHEREAS, the General Election to Legislative Assembly of Kerala, 2021 for 118-Kunnathur(SC) Assembly Constituency was held in pursuance of the Election Commission of India Notification No. 464/KL- LA/2021, dated 12th March, 2021; and

WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate at an election shall, within 30 days from the date of election of the returned candidate, lodge with the District Election Officer an account of his election expenses which shall be a true copy of the account kept by him or his election agent under Section 77 of the said act; and

WHEREAS, the result of the election for 118-Kunnathur(SC) Assembly Constituency of Kerala, 2021 was declared by the Returning Officer on 02nd May, 2021 and hence the last date for lodging the account of Election Expenses was 01st June, 2021; and

WHEREAS, the Commission having regard to the then prevailing pandemic situation of Covid-19, decided to condone any incidence of late submission of account by candidate till 31st July, 2021; and

WHEREAS, as per the report dated 04.06.2021 of the DEO, Kollam, under sub-rule (1) of Rule 89 of the Conduct of Elections Rules, 1961, received through the CEO, Kerala vide his letter no. EL1/2/2021-ELEC, dated 24.08.2021 stating that Arunkumar S Uliyacovil, a contesting candidate from 118-Kunnathur(SC) Assembly Constituency of General Election to Legislative Assembly of Kerala, 2021 has failed to lodge his account of election expenses, as required under law; and

WHEREAS, on the basis of the said report of the District Election Officer, Kollam a Show-Cause Notice No. 76/KL-LA/2021/CEMS-II, dated 06th October, 2021 was issued under sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India to Arunkumar S Uliyacovil, for not lodging the account of Election Expenses; and

WHEREAS, through the above said Show Cause Notice and under sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, Arunkumar S Uliyacovil was directed to submit a representation in writing to the Commission[भाग II—खण्ड 3(iii)] भारत का राजपत्र : मार्च ⁴, ²⁰²³/फाल्गुन ¹³, ¹⁹⁴⁴ ⁹⁵ explaining the reasons for not lodging the account and also to lodge account of election expenses with the District Election Officer, Kollam District within 20 days from the date of receipt of the notice; and

WHEREAS, the said Show Cause Notice was served to Arunkumar S Uliyacovil on 09.11.2021; and WHEREAS, the District Election Officer, Kollam in his Supplementary Report on account of the candidate dated 01.10.2022 has reported that Arunkumar S Uliyacovil has not submitted any representation or statement of correct account of election expenses. Besides, after receipt of the said notice, Arunkumar S Uliyacovil has neither furnished any reason nor explanation to the Election Commission of India, for failure to lodge the account as prescribed under law; and

WHEREAS, Section 10A of the Representation of the People Act, 1951 provides that:-

"If the Election Commission is satisfied that a person-

(a) has failed to lodge an account of election expenses within the time and in the manner required by or under this

Act, and

(b) has no good reason or justification for the failure,

the Election Commission shall, by order published in the Official Gazette, declare him to be disqualified and any such

person shall be disqualified for a period of three years from the date of the order.";

WHEREAS, on basis of facts and available records, the Commission is satisfied that Arunkumar S Uliyacovil has failed to lodge his account of election expenses and has no good reason or justification for the failure to do so; and

NOW, THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission of India hereby declares Arunkumar S Uliyacovil, resident of - M. G. Colony, Uliyacovil P.O, Kollam and a contesting candidate in 118-Kunnathur(SC) Assembly Constituency of Kerala, 2021, to be disqualified for being chosen as and for being a member of either House of the Parliament or the Legislative Assembly or the Legislative Council of a State or Union Territory for a period of three years from the date of this order.

यतः, के रल के 121-पुनालुर विधान सभा निर्वाचन क्षेत्र के लिए निर्वाचन, 2021 का परिणाम, रिर्टनंिग अधिकारी द्वारा दिनांक 02 मई, 2021 को घोषित किया गया था और इस प्रकार निर्वाचन व्यय के लेखे दाखिल करने की अन्तिम तारीख 01, जून, 2021 थी; और

यतः, निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (1) के तहत, मुख्य निर्वाचन अधिकारी, के रल से उनके पत्र सं. ईएल1/2/2021-ईएलईसी, दिनांक 24.08.2021 के तहत प्राप्त जिला निर्वाचन अधिकारी, कोल्लम की दिनांक 04.06.2021 की रिपोर्ट के अनुसार, शिबु.एम.स्कारिया, जो के रल के साधारण निर्वाचन के 121-पुनालुर⁹⁶ THE GAZETTE OF INDIA : MARCH ⁴, ²⁰²³/PHALGUNA ¹³, ¹⁹⁴⁴ [PART II—SEC. ³(iii)] विधान सभा निर्वाचन क्षेत्र, 2021 से निर्वाचन लड़ने वाले अभ्यर्थी हैं, विधि के अंतर्गत यथा अपेक्षित रीति से अपने निर्वाचन व्यय के लेखे दाखिल करने में असफल रहे हैं; और

यतः, जिला निर्वाचन अधिकारी, कोल्लम की उक्त रिपोर्ट के आधार पर, भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (5) के अंतर्गत शिबु.एम.स्कारिया को अपने निर्वाचन व्यय के लेखे प्रस्तुत नहीं करने के लिए कारण बताओ नोटिस सं. 76/के एल-एलए/2021/सीईएमएस-II, दिनांक 06 अक्तू बर, 2021 जारी किया गया था; और

यतः, उपयु र्क्त उक्त कारण बताओ नोटिस के जरिए और निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप- नियम (6) के अंतर्गत, शिबु.एम.स्कारिया को लेखा दाखिल नहीं किए जाने संबंधी कारणों को स्पष्ट करते हुए आयोग को लिखित में अपना अभ्यावेदन प्रस्तुत करने तथा नोटिस प्राप्त होने की तारीख से 20 दिनों के अंदर जिला निर्वाचन अधिकारी, कोल्लम जिला को अपने निर्वाचन व्यय के लेखे प्रस्तुत करने का निदेश दिया गया था; और

यतः, शिबु.एम.स्कारिया को उक्त नोटिस दिनांक 12.11.2021 को तामील किया गया था; और

यतः, जिला निर्वाचन अधिकारी, कोल्लम की अभ्यर्थी के संबंध में अनुपूरक रिपोर्ट दिनांक 01.10.2022 यह सूचित किया है कि शिबु.एम.स्कारिया ने निर्वाचन व्यय के सही लेखे का कोई विवरण या अभ्यावेदन प्रस्तुत नहीं किया है।

इसके अतिरिक्त, उपयु र्क्त नोटिस मिलने के बाद शिबु.एम.स्कारिया ने विधि के तहत यथा निर्धारित लेखे दाखिल करने में असफल रहने के लिए भारत निर्वाचन आयोग को न तो कोई कारण बताया है और न ही कोई स्पष्टीकरण दिया है; और यत:, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में यह उपबंधित किया गया है कि:-

''यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व् यक्ति-

(ख) उस असफलता के लिए कोई अच्छा कारण या न्यायोचित्य नहीं रखता है,

तो निर्वाचन आयोग शासकीय राजपत्र में प्रकाशित आदेश द्वारा उसको निर्रर्हत घोषित करेगा और ऐसा व् यक्ति उस आदेश की तारीख से तीन वर्ष की कालावधि के लिए निर्रर्हत होगा।";

यत:, तथ्यों और उपलब्ध रिकाडों के आधार पर आयोग का यह समाधान हो गया है कि शिबु.एम.स्कारिया अपने निर्वाचन व्यय के लेखे दाखिल करने में असफल रहे हैं और उनके पास ऐसा करने में असफल रहने के लिए कोई भी उचित कारण अथवा औचित्य नहीं है; और

अत:, अब, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अनुसरण में, भारत निर्वाचन आयोग एतद्द्वारा घोषणा करता है कि के रल के 121-पुनालुर विधान सभा निर्वाचन क्षेत्र के लिए साधारण निर्वाचन 2021 से निर्वाचन लड़ने वाले अभ्यर्थी शिबु.एम.स्कारिया, निवासी- क्षेत्रागिरि वीडू, प्लाचेरी, डाकघर, एडमॉन, पुनालुर, कोल्लम इस आदेश की तारीख से तीन वर्ष की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य-क्षेत्र की विधान सभा अथवा विधान परिषद का सदस्य चुने जाने अथवा होने के लिए निर्रर्हत होंगे।

र्क्त नोटिस के प्राप्त होने के बाद रजनीश बाबू ने विधि के तहत यथा निर्धारित लेखा दाखिल करने में यह सूचित किया कि रजनीश बाबू ने निर्वाचन व्यय के सही लेखे का कोई विवरण या कोई अभ्यावेदन प्रस्तुत नहीं किया है। इसके अतिरिक्त, उपयु असफल रहने के लिए भारत निर्वाचन आयोग को न तो कोई कारण बताया है और न ही कोई स्पष्टीकरण दिया है; और

WHEREAS, the said Show Cause Notice was served to Rajaneesh Babu on 03.03.2022; and

WHEREAS, the District Election Officer, Ernakulam in his Summary/Supplementary Report on account of the candidate dated 20.04.2022, has reported that Rajaneesh Babu has not submitted any representation or statement of correct account of election expenses. आ. अ. 45.—यतः, भारत निर्वाचन आयोग की दिनांक 12 मार्च, 2021 की अधिसूचना सं. 464/के एल- एलए/2021 के अनुसरण में 119-कोािराक्कारा विधान सभा निर्वाचन क्षेत्र के लिए के रल विधान सभा का साधारण निर्वाचन, 2021 आयोजित किया गया था; और

यतः, के रल के 119-कोािराक्कारा विधान सभा निर्वाचन क्षेत्र के लिए निर्वाचन, 2021 का परिणाम, रिर्टनंिग अधिकारी द्वारा दिनांक 02 मई, 2021 को घोषित किया गया था और इस प्रकार निर्वाचन व्यय के लेखे दाखिल करने की अन्तिम तारीख 01, जून, 2021 थी; और

यतः, निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (1) के तहत, मुख्य निर्वाचन अधिकारी, के रल से उनके पत्र सं. ईएल1/2/2021-ईएलईसी, दिनांक 24.08.2021 के तहत प्राप्त जिला निर्वाचन अधिकारी, कोल्लम की दिनांक 04.06.2021 की रिपोर्ट के अनुसार, जैनींरन.टी जो के रल के साधारण निर्वाचन के 119- कोािराक्कारा विधान सभा निर्वाचन क्षेत्र, 2021 से निर्वाचन लड़ने वाले अभ्यर्थी हैं, विधि के अंतर्गत यथा अपेक्षित रीति से अपने निर्वाचन व्यय के लेखे दाखिल करने में असफल रहे हैं; और

यतः, जिला निर्वाचन अधिकारी, कोल्लम की उक्त रिपोर्ट के आधार पर, भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (5) के अंतर्गत जैनींरन.टी को अपने निर्वाचन व्यय के लेखे प्रस्तुत नहीं करने के लिए कारण बताओ नोटिस सं. 76/के एल-एलए/2021/सीईएमएस-II, दिनांक 06 अक्तू बर, 2021 जारी किया गया था; और

यतः, उपयु र्क्त उक्त कारण बताओ नोटिस के जरिए और निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (6) के अंतर्गत, जैनींरन.टी को लेखे दाखिल नहीं किए जाने संबंधी कारणों को स्पष्ट करते हुए आयोग को लिखित में अपना अभ्यावेदन प्रस्तुत करने तथा नोटिस प्राप्त होने की तारीख से 20 दिनों के अंदर जिला निर्वाचन अधिकारी, कोल्लम जिला को अपने निर्वाचन व्यय के लेखे प्रस्तुत करने का निदेश दिया गया था; और

यतः, जैनींरन.टी को उक्त नोटिस दिनांक 03.11.2021 को तामील किया गया था; और

र्क्त नोटिस मिलने के बाद जैनींरन.टी ने विधि के तहत यथा निर्धारित लेखे दाखिल करने में असफल रहने के सूचित किया कि जैनींरन.टी ने निर्वाचन व्यय के सही लेखे का कोई विवरण या अभ्यावेदन प्रस्तुत नहीं किया है। इसके अतिरिक्त, उपयु लिए भारत निर्वाचन आयोग को न तो कोई कारण बताया है और न ही कोई स्पष्टीकरण दिया है; और

यत:, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में यह उपबंधित किया गया है कि:-

''यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व् यक्ति-[भाग II—खण्ड 3(iii)] भारत का राजपत्र : मार्च ⁴, ²⁰²³/फाल्गुन ¹³, ¹⁹⁴⁴ ¹⁰¹ (क) निर्वाचन व्ययों का लेखा उस समय के भीतर और उस रीति में जैसी इस अधिनियम के द्वारा या अधीन अपेक्षित है, दाखिल करने में असफल रहा है; तथा

(ख) उस असफलता के लिए कोई अच्छा कारण या न्यायोचित्य नहीं रखता है,

तो निर्वाचन आयोग शासकीय राजपत्र में प्रकाशित आदेश द्वारा उसको निर्रर्हत घोषित करेगा और ऐसा व् यक्ति उस आदेश की तारीख से तीन वर्ष की कालावधि के लिए निर्रर्हत होगा।";

यत:, तथ्यों और उपलब्ध रिकाडों के आधार पर आयोग का यह समाधान हो गया है कि जैनींरन.टी अपने निर्वाचन व्यय के लेखे दाखिल करने में असफल रहे हैं और उनके पास ऐसा करने में असफल रहने के लिए कोई भी उचित कारण अथवा औचित्य नहीं है; और

अत:, अब, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अनुसरण में, भारत निर्वाचन आयोग एतद्द्वारा घोषणा करता है कि के रल के 119-कोािराक्कारा विधान सभा निर्वाचन क्षेत्र के लिए साधारण निर्वाचन 2021 से निर्वाचन लड़ने वाले अभ्यर्थी जैनींरन.टी निवासी-कु न्नाथुविला पडींजत्तातिल, सदानंदपुरम (डाकघर) कोािराक्कारा, पिन- 691531 इस आदेश की तारीख से तीन वर्ष की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य- क्षेत्र की विधान सभा अथवा विधान परिषद का सदस्य चुने जाने अथवा होने के लिए निर्रर्हत होंगे।

O.N. 45.—WHEREAS, the General Election to Legislative Assembly of Kerala, 2021 for 119- Kottarakkara Assembly Constituency was held in pursuance of the Election Commission of India Notification No. 464/KL- LA/2021, dated 12th March, 2021; and

WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate at an election shall, within 30 days from the date of election of the returned candidate, lodge with the District Election Officer an account of his election expenses which shall be true a copy of the account kept by him or his election agent under Section 77 of the said act; and

WHEREAS, the result of the election for 119- Kottarakkara Assembly Constituency of Kerala, 2021 was declared by the Returning Officer on 02nd May, 2021 and hence the last date for lodging the account of Election Expenses was 01st June, 2021; and

WHEREAS, the Commission having regard to the then prevailing pandemic situation of Covid-19, decided to condone any incidence of late submission of account by candidate till 31st July, 2021; and

WHEREAS, as per the report dated 04.06.2021 of the DEO, Kollam, under sub-rule (1) of Rule 89 of the Conduct of Elections Rules, 1961, received through the CEO, Kerala vide his letter no. EL1/2/2021-ELEC, dated 24.08.2021 stating that Jaineendran. T, a contesting candidate from 119- Kottarakkara Assembly Constituency of General Election to Legislative Assembly of Kerala, 2021 has failed to lodge his account of election expenses, as required under law; and

WHEREAS, on basis of the said report of the District Election Officer, Kollam a Show-Cause Notice No. 76/KL-LA/2021/CEMS-II, dated 06th October, 2021 was issued under sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India to Jaineendran. T, for not lodging of account of the Election Expenses; and

WHEREAS, through the above said Show Cause Notice and under sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, Jaineendran. T was directed to submit a representation in writing to the Commission explaining the reasons for not lodging the account and also to lodge account of election expenses with the District Election Officer, Kollam District within 20 days from the date of receipt of the notice; and

WHEREAS, the said Show Cause Notice was served to Jaineendran. T on 03.11.2021; and

WHEREAS, the District Election Officer, Kollam in his Supplementary Report on account of the candidate dated 01.10.2022 has reported that Jaineendran. T has not submitted any representation or statement of correct account of election expenses. Besides, after receipt of the said notice, Jaineendran. T has neither furnished any reason nor explanation to the Election Commission of India, for failure to lodge the account as prescribed under law; and¹⁰² THE GAZETTE OF INDIA : MARCH ⁴, ²⁰²³/PHALGUNA ¹³, ¹⁹⁴⁴ [PART II—SEC. ³(iii)] WHEREAS, Section 10A of the Representation of the People Act, 1951 provides that:-

"If the Election Commission is satisfied that a person-

(a) has failed to lodge an account of election expense, within the time and in the manner required by or under this

Act, and

(b) has no good reason or justification for the failure,

the Election Commission shall, by order published in the Official Gazette, declare him to be disqualified and any such

person shall be disqualified for a period of three years from the date of the order.";

WHEREAS, on basis of facts and available records, the Commission is satisfied that Jaineendran. T has failed to lodge his account of election expenses and has no good reason or justification for the failure to do so; and

NOW, THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission of India hereby declares Jaineendran. T, resident of Kunnathuvila Padinjattathil, Sadanandapuram (PO) Kottarakkara, Pin- 691531 and a contesting candidate in 119- Kottarakkara Assembly Constituency of Kerala, 2021, to be disqualified for being chosen as and for being a member of either House of the Parliament or the Legislative Assembly or the Legislative Council of a State or Union Territory for a period of three years from the date of this order.

यतः, के रल के 92-पीरूमेड विधान सभा निर्वाचन क्षेत्र के लिए निर्वाचन, 2021 का परिणाम, रिर्टनंिग अधिकारी द्वारा दिनांक 02 मई, 2021 को घोषित किया गया था और इस प्रकार निर्वाचन व्यय के लेखे दाखिल करने की अन्तिम तारीख 01, जून, 2021 थी; और

यतः, आयोग ने कोविड-19 की तत्कालीन वैकिि महामारी की स्थिति को ध्यान में रखते हुए, अभ्यर्थी द्वारा

31 जुलाई, 2021 तक विलंब से लेखा प्रस्तुत करने के किसी भी मामले को माफ करने का निर्णय लिया; और

यतः, निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (1) के तहत, मुख्य निर्वाचन अधिकारी, के रल से उनके पत्र सं. ईएल1/2/2021-ईएलईसी, दिनांक 24.08.2021 के तहत प्राप्त जिला निर्वाचन अधिकारी, इडुक्की की दिनांक 30.06.2021 की रिपोर्ट के अनुसार, सोमन, जो के रल के साधारण निर्वचान के 92-पीरूमेड विधान सभा निर्वाचन क्षेत्र, से निर्वाचन लड़ने वाले अभ्यर्थी हैं, विधि के अंतर्गत यथा अपेक्षित निर्वाचन व्यय के लेखे दाखिल करने में असफल रहे हैं; और

यतः, जिला निर्वाचन अधिकारी की उक्त रिपोर्ट के आधार पर, भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (5) के अंतर्गत सोमन को अपने निर्वाचन व्यय के लेखे प्रस्तुत नहीं करने के लिए कारण बताओ नोटिस सं. 76/के एल-एलए/2021/सीईएमएस-II, दिनांक 06 अक्तू बर, 2021 जारी किया गया था;

और

यतः, उपयु र्क्त कारण बताओ नोटिस के जरिए और निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप- नियम (6) के अंतर्गत, सोमन को लेखा दाखिल नहीं किए जाने संबंधी कारणों को स्पष्ट करते हुए आयोग को लिखित में[भाग II—खण्ड 3(iii)] भारत का राजपत्र : मार्च ⁴, ²⁰²³/फाल्गुन ¹³, ¹⁹⁴⁴ ¹⁰³ अपना अभ्यावेदन प्रस्तुत करने तथा नोटिस प्राप्त होने की तारीख से 20 दिनों के अंदर जिला निर्वाचन अधिकारी, इडुक्की जिला को निर्वाचन व्यय का लेखा प्रस्तुत करने का निदेश दिया गया था; और

यतः, सोमन को उक्त नोटिस दिनांक 15.11.2021 को तामील किया गया था; और

यतः, जिला निर्वाचन अधिकारी, इडुक्की ने अपनी दिनांक 01.11.2022 की अभ्यर्थी के संबंध में अनुपूरक रिपोर्ट सं. डीसीआईडीके /1433/2021-एफ3 में यह सूचित किया कि सोमन ने निर्वाचन व्यय

के सही लेखे का कोई विवरण या अभ्यावेदन प्रस्तुत नहीं किया है। इसके अतिरिक्त, उपयु र्क्त नोटिस मिलने के बाद सोमन ने विधि के तहत यथा निर्धारित लेखे दाखिल करने में असफल रहने के लिए भारत निर्वाचन आयोग को न तो कोई कारण बताया है और न ही कोई स्पष्टीकरण दिया है; और

यत:, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में यह उपबंधित किया गया है कि:-

EL1/2/2021-ELEC, dated 24.08.2021 stating that Soman, a contesting candidate from 92- Peerumade Assembly Constituency in General¹⁰⁴ THE GAZETTE OF INDIA : MARCH ⁴, ²⁰²³/PHALGUNA ¹³, ¹⁹⁴⁴ [PART II—SEC. ³(iii)] Election to Legislative Assembly of Kerala, 2021 has failed to lodge his account of election expenses, as required under law; and

WHEREAS, on basis of the said report of the District Election Officer, Idukki a Show-Cause Notice No. 76/KL-LA/2021/CEMS-II, dated 06th October, 2021 was issued under sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India to Soman, for not lodging of the account of Election Expenses; and

WHEREAS, through the above said Show Cause Notice and under sub rule (6) of Rule

89 of the Conduct of Elections Rules, 1961, Soman was directed to submit a representation in writing to the Commission explaining the reasons for not lodging the account and also to lodge the account of election expenses with the District Election Officer, Idukki District within 20 days from the date of receipt of the notice; and

WHEREAS, the said Show Cause Notice was served to Soman on 15.11.2021; and

WHEREAS, the District Election Officer, Idukki in his Summary/Supplementary Report No. DCIDK/1433/ 2021-F3, dated 01.11.2022 on account of the candidate, has reported that Soman has not submitted any representation or statement of correct account of election expenses. Besides, after receipt of the said notice, Soman has neither furnished any reason nor explanation to the Election Commission of India, for failure to lodge the account as prescribed under law; and

WHEREAS, Section 10A of the Representation of the People Act, 1951 provides that:-

"If the Election Commission is satisfied that a person-

(a) has failed to lodge an account of election expenses within the time and in the manner required by or under this

Act, and

(b) has no good reason or justification for the failure,

the Election Commission shall, by order published in the Official Gazette, declare him to be disqualified and any

such person shall be disqualified for a period of three years from the date of the order.";

WHEREAS, on basis of the facts and available records, the Commission is satisfied that Soman has failed to lodge his account of election expenses and has no good reason or justification for the failure to do so; and

NOW, THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission of India hereby declares Soman, resident of - Mattathil House, Pullikkanam PO, Vagamon and a contesting candidate in 92- Peerumade Assembly Constituency of Kerala, 2021 to be disqualified for being chosen as and for being a member of either House of the Parliament or the Legislative Assembly or the Legislative Council of a State or Union Territory for a period of three years from the date of this order.
