सा.का.नि. 36.—लोक सभा सचिवालय (भर्ती और सेवा शतें) नियम, 1955 के नियम 19 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, अध्यक्ष एतद्द्वारा लोक सभा सचिवालय (आचरण) नियम, 1955 में और संशोधन करने हेतु निम्नलिखित नियम बनाते हैं, अर्थातः-
1. (i) इन नियमों को लोक सभा सचिवालय (आचरण) संशोधन नियम, 2023 कहा जाएगा ।
(ii) ये तत्काल प्रभाव से लागू होंगे।
2. लोक सभा सचिवालय (आचरण) नियम, 1955 के नियम 21 के उप नियम (1) में "...रेडियो प्रसारण…" शब्दों के पश्चात "...या इलेक्ट्रॉनिक अथवा किसी अन्य मीडिया में.." शब्द अंत:स्थापित किए जाएंगे।

सरकार की आलोचना - (1.) कोई भी अधिकारी रेडियो प्रसारण में या इलेक्ट्रॉनिक अथवा किसी अन्य मीडिया में या अपने नाम से अथवा गुमनाम अथवा छद्म नाम से अथवा किसी अन्य व्यक्ति के नाम से प्रकाशित किसी लेख में या प्रेस को दी गई किसी सूचना में या किसी सार्वजनिक भाषण में किसी भी ऐसे तथ्य का कथन नहीं करेगा या अपनी राय नहीं देगा –
(i) जिससे कें र सरकार या किसी राज्य सरकार की किसी वतर्मान या हाल की नीति या कार्रवाई की प्रतिकू ल आलोचना हो; या
(ii) जो संसद, कें र सरकार या किसी राज्य सरकार और भारत की जनता अथवा उसके किसी वर्ग के बीच संबंधों को खराब करने वाली हो;
(iii) जो कें र सरकार और किसी अन्य देश की सरकार के बीच संबंधों को खराब करने वाली हो ।
(2) कोई भी अधिकारी जिसका आशय अपने नाम से ऐसे किसी दस्तावेज को प्रकाशित करने या किसी ऐसे कथन से युक्त सार्वजनिक भाषण देना हो, जिसके संबंध में इस नियम द्वारा लगाए गए प्रतिबंधों के लागू होने के बारे में कोई संदेह उत्पन्न हो, तो, वह अधिकारी महासचिव को उस दस्तावेज, जिसे वह प्रकाशित करने का आशय रखता हो, या जो भाषण देने का आशय रखता हो, की एक प्रति अथवा प्रारूप महासचिव को प्रस्तुत करेगा और महासचिव की अनुमति के बिना एवं महासचिव द्वारा निदेशित परिवर्तनों, यदि कोई हों, को शामिल किए बिना उक्त दस्तावेज को प्रकाशित नहीं करेगा या उक्त भाषण नहीं देगा ।

G.S.R. 36.—In exercise of the powers conferred by Rule 19 of the Lok Sabha Secretariat (Recruitment and Conditions of Service) Rules, 1955, the Speaker hereby makes the following Rules further to amend the Lok Sabha Secretariat (Conduct) Rules, 1955, namely:-
1 (i) These Rules shall be called the Lok Sabha Secretariat (Conduct) Amendment Rules, 2023.
(ii) They shall come into force with immediate effect.
2. In sub-rule (1) of Rule 21 of the Lok Sabha Secretariat (Conduct) Rules, 1955, the words "….or in any media, electronic or otherwise…", shall be inserted after the extant words "….radio broadcast….".
3. The amended Rule 21 of the Lok Sabha Secretariat (Conduct) Rules, 1955 will read as follows:-
Criticism of Government – (1) No Officer shall, in any radio broadcast or in any media, electronic or otherwise or in any document published in his own name or anonymously, pseudonymously or in the name of any other person or in any communication to the press or in any public utterance, make any statement of fact or opinion –
(i) which has the effect of any adverse criticism of any current or recent policy or action of the Central Government or a State Government; or
(ii) which is capable of embarrassing the relations between the Parliament, the Central Government or the Government of any State and the people of India or any section thereof; or
(iii) which is capable of embarrassing the relations between the Central Government and the Government of any foreign state.

सा.का.नि. 37.—राष्ट्रपति, संविधान के अनुच्छेद 309 के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए विज्ञान और प्रौद्योगिकी मंत्रालय, विज्ञान और प्रौद्योगिकी विभाग के अधीन भारतीय सवेक्षण विभाग में स्टाफ कार ड्राइवर (विशेष श्रेणी) के पद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थातः-
1. संक्षिप्त नाम और प्रारंभ: - (i) इन नियमों का संक्षिप्त नाम भारतीय सवेक्षण विभाग, स्टाफ कार ड्राइवर (विशेष श्रेणी) भर्ती नियम, 2023 है।
(ii) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे।
2. आरंभिक गठन:- इन नियमों के प्रारंभ से पूर्व विज्ञान और प्रौद्योगिकी विभाग के अधीन भारतीय सवेक्षण विभाग में नियमित आधार पर स्टाफ कार ड्राइवर (विशेष श्रेणी) के पदधारी इन नियमों के उपबंधों के अनुसार नियुक्त किए गए समझे जाएंगे।
3. पद-संख्या, वर्गीकरण और वेतन मैट्रिक्स में स्तर: - उक्त पदों की संख्या, उनका वर्गीकरण, और वेतन मैट्रिक्स में स्तर वे होंगे जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ (2) से स्तंभ (4) में विर्निर्दष्ट हैं।
4. भर्ती की पद्धति, आयु-सीमा और अन्य अर्हताएं आदि: - उक्त पदों पर भर्ती की पद्धति, आयु सीमा, अर्हताएं और उनसे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ (5) से स्तंभ (13) में विर्निर्दष्ट हैं।
5. निरर्हता: - वह व्यक्ति -
(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है या विवाह की संविदा की है;
या
(ख) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है, या विवाह की संविदा की है,
उक्त पदों पर नियुक्ति का पात्र नहीं होगा:
परन्तु यदि के न्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह उस व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छू ट दे सके गी।
6. शिथिल करने की शक्ति: - जहाँ के न्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहाँ वह उसके लिए जो कारण हैं, उन्हें लेखबद्ध करके , इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सके गी।
7. व्यावृत्ति: - इन नियमों की कोई बात, ऐसे आरक्षण, आयु-सीमा में छू ट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका के न्रीय सरकार द्वारा इस संबंध में समय-समय पर जारी किए गए आदेशों के अनुसार अनुसूचित जातियों,210 THE GAZETTE OF INDIA : APRIL 15, 2023/CHAITRA 25, 1945 [PART II—SEC. 3(i)] अनुसूचित जनजातियों, अन्य पिछड़े वगों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है।

G.S.R. 37.—In exercise of the powers conferred by the proviso to article 309 of the Constitution, the President hereby makes the following rules regulating the method of recruitment to the Staff Car Driver (Special Grade) in the Survey of India, Department of Science and Technology under Ministry of Science and Technology, namely:-
1. Short title and commencement. – (1) These rules may be called the Survey of India Staff Car Driver (Special Grade) Recruitment Rules, 2023.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. Initial Constitution.-The incumbents to the post of Staff Car Driver (Special Grade) in Survey of India under Department of Science and Technology on regular basis before commencement of these rules shall be deemed to have been appointed in accordance with the provisions of these rules.
3. Number of posts, classification, level in pay matrix or pay scale. – The number of the said posts, their classification and the level in the pay matrix attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.
4. Method of recruitment, age-limit and other qualifications, etc. – The method of recruitment, age-limit, qualifications and other matters relating to the said posts shall be as specified in columns (5) to (13) of the said Schedule.
5. Disqualification.– No person, –
(a) who has entered into or contracted a marriage with a person having a spouse living, or
(b) who, having a spouse living, has entered into or contracted a marriage with any person,
shall be eligible for appointment to the said post.

6. Power to relax. – Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons.
7. Saving. – Nothing in these rules shall affect reservation, relaxation of age-limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, the other Backward Classes, the Ex-servicemen and other special categories of persons, in accordance with the orders issued by the Central Government from time to time in this regard.

सा.का.नि. 39.—राष्ट्रपति ,संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, और राष्ट्रीय एटलस एवं थिमैटिक मानचित्रण संगठन, कैं टीन कर्मचारी समूह 'ग' और समूह 'घ' पद भर्ती नियम, २००२ को, जहाँ तक इसका संबंध लिपिक (कू पन, किचन, कार्यालय, लेखा, साधारण कत्र्तव्य और विक्रय), चाय/ काफी बनाने वाला और वाश बॉय पद से है, उन बातों के सिवाय अधिक्रांत करते हुए, जिन्हें ऐसे अधिक्रमण से पूर्व किया गया है या करने का लोप किया गया है, राष्ट्रीय एटलस एवं थिमैटिक मानचित्रण संगठन, विज्ञान और प्रौद्योगिकी विभाग, विज्ञान और प्रौद्योगिकी मंत्रालय में लिपिक और कै न्टीन सहायक पदों पर भर्ती की पद्धति का विनियमन करने के लिये निम्नलिखित नियम बनाते हैं ,अर्थात :-

परंतु यदि के न्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह उस व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिये अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छू ट दे सके गी ।
6. शिथिल करने की शक्ति - जहां के न्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिये जो कारण हैं, उन्हें लेखबद्ध करके , इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सके गी I
7. व्यावृत्ति - इन नियमों की कोई बात, ऐसे आरक्षणों, आयु-सीमा में छू ट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका के न्रीय सरकार द्वारा इस संबंध में समय-समय पर जारी किये गये आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछडे वगों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिये उपबंध करना अपेक्षित है ।

G.S.R. 39.—In exercise of the powers conferred by the proviso to article 309 of the Constitution, and in supersession of the National Atlas and Thematic Mapping Organisation, Canteen Employees Group 'C' and Group 'D' posts Recruitment Rules, 2002, in so far as it relates to the posts of Clerk (Coupon, Kitchen, Office, Accounts, General Duties and Sales), Tea/Coffee Maker and Wash Boy, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the post of Clerk and Canteen Attendant in the National Atlas and Thematic Mapping Organisation, Department of Science and Technology, Ministry of Science and Technology, namely:-
1. Short title and commencement. — (1) These rules may be called the Ministry of Science & Technology, National Atlas and Thematic Mapping Organisation, Clerk and Canteen Attendant (Group 'C' Posts) Recruitment Rules, 2023.
(2) They shall come into force on the date of their publication in the Official Gazette.

(b) who, having a spouse living, has entered into or contracted a marriage with any person,
shall be eligible for appointment to the said post:
Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.
6. Power to relax. —Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, and for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons.
7. Saving. — Nothing in these rules shall affect reservation, relaxation of age-limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, the Other Backward Classes, the Ex-servicemen and other special categories of persons, in accordance with the orders issued by the Central Government from time to time in this regard.
