आ.अ. 47.—यतः, भारत निर्वाचन आयोग की दिनांक 12 मार्च, 2021 की अधिसूचना सं. 464/के एल- एलए/2021 के अनुसरण में 39-मन्कडा विधान सभा निर्वाचन क्षेत्र के लिए के रल विधान सभा का साधारण निर्वाचन, 2021 आयोजित किया गया था; और

यत:, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 78 के अनुसार, किसी भी निर्वाचन में निर्वाचन लड़ने वाला प्रत्येक अभ्यर्थी, निर्वाचित अभ्यर्थी के निर्वाचन की तारीख से 30 दिनों के भीतर अपने निर्वाचन व्यय के लेखे जिला निर्वाचन अधिकारी के पास दाखिल करेगा जो उक्त अधिनियम की धारा 77 के अन्तर्गत उसके द्वारा या उसके निर्वाचन अभिकर्ता द्वारा रखे गए लेखे की एक सत्य प्रति होगी; और

यतः, के रल के 39-मन्कडा विधानसभा निर्वाचन क्षेत्र के लिए निर्वाचन, 2021 का परिणाम, रिर्टनंिग अधिकारी द्वारा 02 मई, 2021 को घोषित किया गया था और इस प्रकार निर्वाचन व्यय के लेखे दाखिल करने की अन्तिम तारीख 01 जून, 2021 थी; और

(105)¹⁰⁶ THE GAZETTE OF INDIA : APRIL ²⁹, ²⁰²³/VAISAKHA ⁹, ¹⁹⁴⁵ [PART II—SEC. ³(iii)] यतः, आयोग ने कोविड-19 की तत्कालीन वैकिि महामारी की स्थिति को ध्यान में रखते हुए, अभ्यर्थी द्वारा 31 जुलाई, 2021 तक विलंब से लेखा प्रस्तुत करने की किसी भी घटना को क्षमा करने का निर्णय लिया; और

यतः, निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (1) के अंतर्गत, मुख्य निर्वाचन अधिकारी, के रल से उनके दिनांक 24.08.2021 के पत्र सं. ईएल1/2/2021-ईएलईसी के तहत प्राप्त जिला निर्वाचन अधिकारी, मलप्पुरम की दिनांक 04.06.2021 की रिपोर्ट के अनुसार, एम. अली, जो के रल के 39-मन्कडा विधान सभा निर्वाचन क्षेत्र, 2021 से निर्वाचन लड़ने वाले अभ्यर्थी हैं, विधि के अंतर्गत यथापेक्षित रीति से अपने निर्वाचन व्यय के लेखे दाखिल करने में असफल रहे हैं; और

यतः, जिला निर्वाचन अधिकारी की उक्त रिपोर्ट के आधार पर, भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (5) के अंतर्गत एम. अली को अपने निर्वाचन व्यय के लेखे प्रस्तुत नहीं करने के लिए कारण बताओ नोटिस सं. 76/के एल-एलए/2021/सीईएमएस-II, दिनांक 06 अक्तू बर, 2021 जारी किया गया था; और

यत:, उपयु र्क्त उक्त कारण बताओ नोटिस के जरिए और निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (6) के अंतर्गत, एम. अली को लेखा दाखिल न किए जाने संबंधी कारणों को स्पष्ट करते हुए आयोग को अपना अभ्यावेदन लिखित रूप में प्रस्तुत करने और नोटिस के प्राप्त होने की तारीख से 20 दिनों के भीतर जिला निर्वाचन अधिकारी, मलप्पुरम जिला को अपने निर्वाचन व्यय के लेखे प्रस्तुत करने का निदेश दिया गया था; और

यत:, जिला निर्वाचन अधिकारी, मलप्पुरम जिला ने अपनी रिपोर्ट सं. पी1/9752/2022 दिनांक 06.10.2022 में सुचित किया है कि उक्त कारण बताओ नोटिस एम. अली को दिनांक 09.11.2021 को तामील किया गया था; और

यत:, जिला निर्वाचन अधिकारी, मलप्पुरम की अभ्यर्थी के संबंध में अनुपूरक रिपोर्ट दिनांक 02.11.2022 में सूचित किया कि एम. अली ने निर्वाचन व्यय के लेखे का कोई विवरण या अभ्यावेदन प्रस्तुत नहीं किया है। इसके अतिरिक्त, उक्त नोटिस मिलने के उपरांत, एम. अली ने विधि के अंतर्गत यथा-विहित लेखे दाखिल करने में अपनी असफलता के लिए भारत निर्वाचन आयोग को न तो कोई कारण बताया है और न ही कोई स्पष्टीकरण दिया है; और

यत:, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में यह उपबंधित किया गया है कि:-

''यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व् यक्ति-

(क) निर्वाचन व्ययों का लेखा उस समय के भीतर और उस रीति में जैसी इस अधिनियम के द्वारा या अधीन अपेक्षित है ,दाखिल करने में असफल रहा है; तथा

(ख) उस असफलता के लिए कोई अच्छा कारण या न्यायोचित्य नहीं रखता है ,

तो निर्वाचन आयोग शासकीय राजपत्र में प्रकाशित आदेश द्वारा उसको निर्रर्हत घोषित करेगा और ऐसा व् यक्ति उस आदेश की तारीख से तीन वर्ष की कालावधि के लिए निर्रर्हत होगा।";

यत:, तथ्यों और उपलब्ध रिकाडों के आधार पर, आयोग का यह समाधान हो गया है कि एम. अली अपने निर्वाचन व्यय के लेखे दाखिल करने में असफल रहे हैं और उनके पास ऐसा करने में असफल रहने के लिए कोई भी उचित कारण अथवा औचित्य नहीं है; और

अत:, अब, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अनुसरण में, भारत निर्वाचन आयोग एतद्द्वारा घोषणा करता है कि के रल के 39-मन्कडा विधान सभा निर्वाचन क्षेत्र के लिए साधारण निर्वाचन, 2021 में निर्वाचन लड़ने वाले अभ्यर्थी, एम. अली, निवासी-मलप्पुरम वेदू, डाकघर पेरिनतरििी, मलप्पुरम जिला-676507, इस आदेश की तारीख से तीन वर्ष की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य क्षेत्र की विधान सभा अथवा विधान परिषद का सदस्य चुने जाने अथवा होने के लिए निर्रर्हत होंगे।

ELECTION COMMISSION OF INDIA

ORDER

New Delhi, the 14th March, 2023

O.N. 47.—WHEREAS, the General Election to Legislative Assembly of Kerala, 2021 for 39- Mankada Assembly Constituency was held in pursuance of the Election Commission of India Notification No. 464/KL- LA/2021, dated 12th March, 2021; and

WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate at an election shall, within 30 days from the date of election of the returned candidate, lodge with the District Election Officer an account of his election expenses which shall be a true copy of the account kept by him or his election agent under Section 77 of the said act; and

WHEREAS, the result of the election for 39- Mankada Assembly Constituency of Kerala, 2021 was declared by the Returning Officer on 02nd May, 2021 and hence the last date for lodging the account of Election Expenses was 01st June, 2021; and

WHEREAS, the Commission having regard to the then prevailing pandemic situation of Covid-19, decided to condone any incidence of late submission of account by candidate till 31st July, 2021; and

WHEREAS, as per the report dated 04.06.2021 of the DEO, Malappuram under sub-rule (1) of Rule 89 of the Conduct of Elections Rules, 1961 received through the CEO, Kerala vide his letter no. EL1/2/2021-ELEC, dated 24.08.2021 stating that M. Ali, a contesting candidate from 39- Mankada Assembly Constituency in General Election to Legislative Assembly of Kerala, 2021 has failed to lodge the account of his election expenses, as required under law; and

WHEREAS, through the above said Show Cause Notice and under sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, M. Ali was directed to submit a representation in writing to the Commission explaining the reasons for not lodging the account and also to lodge the account of his election expenses with the District Election Officer, Malappuram District within 20 days from the date of receipt of the notice; and

WHEREAS, the DEO, Malappuram in his report no. P1/9752/2022; dated 06.10.2022 has reported that the said Show Cause Notice was served to M. Ali on 09.11.2021; and

WHEREAS, the District Election Officer, Malappuram in his Supplementary Report on account of the candidate dated 02.11.2022 has reported that M. Ali has not submitted any representation or statement of account of election expenses. Further, after receipt of the said notice, M. Ali has neither furnished any reason nor explanation to the Election Commission of India for failure to lodge the account of his election expenses as prescribed under law; and

WHEREAS, Section 10A of the Representation of the People Act, 1951 provides that:-

"If the Election Commission is satisfied that a person-

(a) has failed to lodge an account of election expenses, within the time and in the manner required by or

under this Act, and

(b) has no good reason or justification for the failure,

the Election Commission shall, by order published in the Official Gazette, declare him to be

disqualified and any such person shall be disqualified for a period of three years from the date of the

order.";

WHEREAS, on basis of the facts and available records, the Commission is satisfied that M. Ali has failed to lodge the account of his election expenses and has no good reason or justification for the failure to do so; and

NOW, THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission of India hereby declares M. Ali, resident of - Mylappuram Veedu, Perinthattiri PO, Malappuram District- 676507 and a contesting candidate in 39- Mankada Assembly Constituency of Kerala, 2021, to be disqualified for being chosen as and for being a member of either House of the Parliament or the Legislative Assembly or the Legislative Council of a State or Union Territory for a period of three years from the date of this order.

यत:, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 78 के अनुसार, किसी भी निर्वाचन में निर्वाचन लड़ने वाला प्रत्येक अभ्यर्थी, निर्वाचित अभ्यर्थी के निर्वाचन की तारीख से 30 दिनों के भीतर अपने निर्वाचन व्यय के लेखे जिला निर्वाचन अधिकारी के पास दाखिल करेगा, जो उक्त अधिनियम की धारा 77 के तहत उसके द्वारा या उसके निर्वाचन अभिकर्ता द्वारा रखे गए लेखे की एक सत्य प्रति होगी; और

यतः, निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (1) के तहत, मुख्य निर्वाचन अधिकारी, के रल से उनके पत्र सं. ईएल1/2/2021-ईएलईसी., दिनांक 24.08.2021 के तहत प्राप्त जिला निर्वाचन अधिकारी, मलप्पुरम की दिनांक 04.06.2021 की रिपोर्ट के अनुसार, आइशा, जो के रल के 46-कोक्किल विधान सभा क्षेत्र 2021 से निर्वाचन लड़ने वाली अभ्यर्थी हैं, विधि के अंतर्गत यथा अपेक्षित रीति से अपने निर्वाचन व्यय के लेखे दाखिल करने में असफल रही हैं; और

यतः, जिला निर्वाचन अधिकारी की उक्त रिपोर्ट के आधार पर, भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (5) के अंतर्गत आइशा को अपने निर्वाचन व्यय के लेखे प्रस्तुत नहीं करने के लिए कारण बताओ नोटिस सं. 76/के एल-एलए/2021/सीईएमएस-II, दिनांक 06 अक्तू बर, 2021 जारी किया गया था;

और

यतः, उपयु र्क्त उक्त कारण बताओ नोटिस के जरिए और निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (6) के अंतर्गत, आइशा को लेखा दाखिल नहीं किए जाने संबंधी कारणों को स्पष्ट करते हुए आयोग को लिखित में अपना अभ्यावेदन प्रस्तुत करने तथा नोटिस प्राप्त होने की तारीख से 20 दिनों के अंदर जिला निर्वाचन अधिकारी, मलप्पुरम जिला को अपने निर्वाचन व्यय के लेखे प्रस्तुत करने का निदेश दिया गया था; और

यत:, जिला निर्वाचन अधिकारी, मलप्पुरम जिला ने अपनी रिपोर्ट सं. पी1/9752/2022 दिनांक 06.10.2022 में सूचित किया है कि उक्त कारण बताओ नोटिस अभ्यर्थी के घर पर दिनांक 13.11.2021 को चस्पा कर गया क्योकि अभ्यर्थी और उसका परिवार विदेश में था; और

यत:, जिला निर्वाचन अधिकारी, मलप्पुरम की अभ्यर्थी के संबंध में अनुपूरक रिपोर्ट दिनांक 02.11.2022 में सूचित किया कि आइशा ने निर्वाचन व्यय के लेखे का कोई विवरण या अभ्यावेदन प्रस्तुत नहीं किया है। इसके अतिरिक्त, उक्त नोटिस मिलने के उपरांत, आइशा ने विधि के अंतर्गत यथा-विहित लेखे दाखिल करने में अपनी असफलता के लिए भारत निर्वाचन आयोग को न तो कोई कारण बताया है और न ही कोई स्पष्टीकरण दिया है; और

यत:, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में यह उपबंधित किया गया है कि:-

अत:, अब, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अनुसरण में, भारत निर्वाचन आयोग एतद्द्वारा

घोषणा करता है कि के रल के 46-कोक्किल विधान सभा निर्वाचन क्षेत्र के लिए साधारण निर्वाचन, 2021 से निर्वाचन लड़ने

वाली अभ्यर्थी आइशा, निवासी कालोडी हाउस, डाकघर- चेरूशोला, पिन- 676510 इस आदेश की तारीख से तीन वर्ष की

अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य-क्षेत्र की विधान सभा अथवा विधान परिषद का

सदस्य चुने जाने अथवा होने के लिए निर्रर्हत होंगे।

Besides, after receipt of the said notice, Ayisha has neither furnished any reason nor explanation to the Election Commission of India, for failure to lodge the account of her election expenses as prescribed under law; and

WHEREAS, Section 10A of the Representation of the People Act, 1951 provides that:-

"If the Election Commission is satisfied that a person-

यतः, निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (1) के तहत, मुख्य निर्वाचन अधिकारी, के रल से उनके पत्र सं. ईएल1/2/2021-ईएलईसी., दिनांक 24.08.2021 के तहत प्राप्त जिला निर्वाचन अधिकारी, मलप्पुरम की दिनांक 04.06.2021 की रिपोर्ट के अनुसार, अबुबकर सिकिि, जो के रल के 45-तिरूर विधान सभा क्षेत्र 2021 से निर्वाचन लड़ने वाले अभ्यर्थी हैं, विधि के अंतर्गत यथा अपेक्षित रीति से अपने निर्वाचन व्यय के लेखे दाखिल करने में असफल रहे हैं; और

यतः, जिला निर्वाचन अधिकारी की उक्त रिपोर्ट के आधार पर, भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (5) के अंतर्गत अबुबकर सिकिि को अपने निर्वाचन व्यय के लेखे प्रस्तुत नहीं करने के लिए कारण बताओ नोटिस सं. 76/के एल-एलए/2021/सीईएमएस-II, दिनांक 06 अक्तू बर, 2021 जारी किया गया था; और

यतः, उपयु र्क्त उक्त कारण बताओ नोटिस के जरिए और निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (6) के अंतर्गत, अबुबकर सिकिि को लेखा दाखिल नहीं किए जाने संबंधी कारणों को स्पष्ट करते हुए आयोग को लिखित में अपना अभ्यावेदन प्रस्तुत करने तथा नोटिस प्राप्त होने की तारीख से 20 दिनों के अंदर जिला निर्वाचन अधिकारी, मलप्पुरम जिला को अपने निर्वाचन व्यय के लेखे प्रस्तुत करने का निदेश दिया गया था; और

यत:, जिला निर्वाचन अधिकारी, मलप्पुरम जिला ने अपनी रिपोर्ट सं. पी1/9752/2022 दिनांक 06.10.2022 में सुचित किया है कि उक्त कारण बताओ नोटिस अबुबकर सिकिि को दिनांक 09.11.2021 को तामील किया गया था; और[भाग II—खण्ड 3(iii)] भारत का राजपत्र : अप्रैल ²⁹, ²⁰²³/वैशाख ⁹, ¹⁹⁴⁵ ¹¹¹ यत:, जिला निर्वाचन अधिकारी, मलप्पुरम की अभ्यर्थी के संबंध में अनुपूरक रिपोर्ट दिनांक 02.11.2022 में सूचित किया कि अबुबकर सिकिि ने निर्वाचन व्यय के लेखे का कोई विवरण या अभ्यावेदन प्रस्तुत नहीं किया है। इसके अतिरिक्त, उक्त नोटिस मिलने के उपरांत, अबुबकर सिकिि ने विधि के अंतर्गत यथा-विहित लेखे दाखिल करने में अपनी असफलता के लिए भारत निर्वाचन आयोग को न तो कोई कारण बताया है और न ही कोई स्पष्टीकरण दिया है; और

यत:, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में यह उपबंधित किया गया है कि:-

यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व् यक्ति-

(ख) उस असफलता के लिए कोई अच्छा कारण या न्यायोचित्य नहीं रखता है,

यत:, तथ्यों और उपलब्ध अभिलेखों के आधार पर आयोग का यह समाधान हो गया है कि अबुबकर सिकिि अपने निर्वाचन व्यय के लेखे दाखिल करने में असफल रहे हैं और उनके पास ऐसा करने में असफल रहने के लिए कोई भी उचित कारण अथवा औचित्य नहीं है; और

अत:, अब, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अनुसरण में, भारत निर्वाचन आयोग एतद्द्वारा घोषणा करता है कि के रल के 45-तिरूर विधान सभा निर्वाचन क्षेत्र के लिए साधारण निर्वाचन, 2021 से निर्वाचन लड़ने वाले अभ्यर्थी अबुबकर सिकिि, निवासी चेरूपराम्बील हाउस, डाकघर- तिरूनावाया, मलप्पुरम- 676301 इस आदेश की तारीख से तीन वर्ष की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य-क्षेत्र की विधान सभा अथवा विधान परिषद का सदस्य चुने जाने अथवा होने के लिए निर्रर्हत होंगे।

O.N. 49.—WHEREAS, the General Election to Legislative Assembly of Kerala, 2021 for 45-Tirur Assembly Constituency was held in pursuance of the Election Commission of India Notification No. 464/KL- LA/2021, dated 12th March, 2021; and

WHEREAS, the result of the election for 45-Tirur Assembly Constituency of Kerala, 2021 was declared by the Returning Officer on 02nd May, 2021 and hence the last date for lodging the account of Election Expenses was 01st June, 2021; and

WHEREAS, the Commission having regard to the then prevailing pandemic situation of Covid-19, decided to condone any incidence of late submission of account by candidate till 31st July, 2021; and

WHEREAS, as per the report dated 04.06.2021 of the DEO, Malappuram, under sub-rule (1) of Rule 89 of the Conduct of Elections Rules, 1961, received from the CEO, Kerala vide his letter no. EL1/2/2021-ELEC, dated 24.08.2021 stating that Aboobacker Sidheek, a contesting candidate from 45-Tirur Assembly Constituency in General Election to Legislative Assembly of Kerala, 2021 has failed to lodge the account of his election expenses, as required under law; and

WHEREAS, on basis of the said report of the District Election Officer, Malappuram a Show-Cause notice No. 76/KL-LA/2021/CEMS-II, dated 06th October, 2021 was issued under sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India to Aboobacker Sidheek, for not lodging of the account of Election Expenses; and¹¹² THE GAZETTE OF INDIA : APRIL ²⁹, ²⁰²³/VAISAKHA ⁹, ¹⁹⁴⁵ [PART II—SEC. ³(iii)] WHEREAS, through the above said Show Cause Notice and under sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, Aboobacker Sidheek was directed to submit a representation in writing to the Commission explaining the reasons for not lodging the account and also to lodge the account of his election expenses with the District Election Officer, Malappuram District within 20 days from the date of receipt of the notice; and

WHEREAS, the DEO, Malappuram in his report no. P1/9752/2022; dated 06.10.2022 has reported that the said Show Cause Notice was served to Aboobacker Sidheek on 09.11.2021; and

WHEREAS, the District Election Officer, Malappuram in his Supplementary Report on account of the candidate dated 02.11.2022 has reported Aboobacker Sidheek has not submitted any representation or statement of correct account of election expenses. Besides, after receipt of the said notice, Aboobacker Sidheek has neither furnished any reason nor explanation to the Election Commission of India, for failure to lodge the account of his election expenses as prescribed under law; and

WHEREAS, Section 10A of the Representation of the People Act, 1951 provides that:-

"If the Election Commission is satisfied that a person-

(a) has failed to lodge an account of election expenses, within the time and in the manner required by or

under this Act, and

(b) has no good reason or justification for the failure,

the Election Commission shall, by order published in the Official Gazette, declare him to be

disqualified and any such person shall be disqualified for a period of three years from the date of the

order.";

WHEREAS, on basis of the facts and available records, the Commission is satisfied that Aboobacker Sidheek has failed to lodge the account of his election expenses and has no good reason or justification for the failure to do so; and

NOW, THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission of India hereby declares Aboobacker Sidheek , resident of Cheruparambil House, Thirunavaya PO, Malappuram-676301 and a contesting candidate in 45-Tirur Assembly Constituency of Kerala, 2021, to be disqualified for being chosen as and for being a member of either House of the Parliament or the Legislative Assembly or the Legislative Council of a State or Union Territory for a period of three years from the date of this order.

यत:, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 78 के अनुसार, किसी भी निर्वाचन में निर्वाचन लड़ने वाला प्रत्येक अभ्यर्थी, निर्वाचित अभ्यर्थी के निर्वाचन की तारीख से 30 दिनों के भीतर अपने निर्वाचन व्यय का लेखा जिला निर्वाचन अधिकारी के पास दाखिल करेगा जो उक्त अधिनियम की धारा 77 के अन्तर्गत उसके द्वारा या उसके निर्वाचन अभिकर्ता द्वारा रखे गए लेखे की एक सत्य प्रति होगी; और

WHEREAS, the Commission having regard to the then prevailing pandemic situation of Covid-19, decided to condone any incidence of late submission of account by candidate till 31st July, 2021; and

WHEREAS, as per the report dated 04.06.2021 of the DEO, Malappuram, under sub-rule (1) of Rule 89 of the Conduct of Elections Rules, 1961, received through the CEO, Kerala vide his letter no. WHEREAS, as per the report dated 04.06.2021 of the DEO, Malappuram, under sub-rule (1) of Rule 89 of the Conduct of Elections Rules, 1961, received through the CEO, Kerala vide his letter no. EL1/2/2021-ELEC, dated 24.08.2021 stating that Moideen Valiyakath, a contesting candidate from 45-Tirur Assembly Constituency in General Election to Legislative Assembly of Kerala, 2021 has failed to lodge the account of his election expenses, as required under law; and

WHEREAS, through the above said Show Cause Notice and under sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, Moideen Valiyakath was directed to submit a representation in writing to the Commission explaining the reasons for not lodging the account and also to lodge the account of election expenses with the District Election Officer, Malappuram District within 20 days from the date of receipt of the notice; and

WHEREAS, the DEO, Malappuram in his report no. P1/9752/2022; dated 06.10.2022 has reported that the said Show Cause Notice was served to Moideen Valiyakath on 06.11.2021; and

WHEREAS, the District Election Officer, Malappuram in his Supplementary Report on account of the candidate dated 02.11.2022 has reported that Moideen Valiyakath has not submitted any representation or statement of correct account of election expenses. Besides, after receipt of the said notice, Moideen Valiyakath has neither furnished any reason nor explanation to the Election Commission of India, for failure to lodge the account of his election expenses as prescribed under law; and

WHEREAS, Section 10A of the Representation of the People Act, 1951 provides that:-

"If the Election Commission is satisfied that a person-

(a) has failed to lodge an account of election expenses, within the time and in the manner required by or

under this Act, and

(b) has no good reason or justification for the failure,

the Election Commission shall, by order published in the Official Gazette, declare him to be

disqualified and any such person shall be disqualified for a period of three years from the date of the

order.";

WHEREAS, on basis of the facts and available records, the Commission is satisfied that Moideen Valiyakath has failed to lodge the account of his election expenses and has no good reason or justification for the failure to do so; and

NOW, THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission of India hereby declares Moideen Valiyakath, resident of Valiyakath House, Vadikkal Mangalam PO, Koottayi-676562 and a contesting candidate in 45-Tirur Assembly Constituency of Kerala, 2021, to be disqualified for being chosen as and for being a member of either House of the Parliament or the Legislative Assembly or the Legislative Council of a State or Union Territory for a period of three years from the date of this order.
