आ.अ. 110.—यतः, उत्तर प्रदेश राज्य की 45-हस्तिनापुर (अ0जा0) विधान सभा क्षेत्र के साधारण निर्वाचन 2022 अधिसूचना नं. 28/61-2022 दिनांक 14.01.2022 के जरिए की गई थी।

यतः लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 78 के अनुसार, निर्वाचन लड़ने वाले प्रत्येक अभ्यर्थी को, निर्वाचित अभ्यर्थी के निर्वाचन की तारीख से 30 दिनों के भीतर निर्वाचन व्यय के अपने लेखे की सही प्रति जिला निर्वाचन अधिकारी को दाखिल करनी होती है; और

यतः 45-हस्तिनापुर (अ0जा0) विधान सभा निर्वाचन क्षेत्र के रिटनिग अधिकारी द्वारा उक्त निर्वाचन का परिणाम 10 मार्च, 2022 को घोषित किया गया था। इस प्रकार, निर्वाचन व्यय का लेखा दाखिल करने की अन्तिम तारीख 09 अप्रैल, 2022 थी; और

यतः, जिला निर्वाचन अधिकारी, मेरठ, उत्तर प्रदेश, और मुख्य निर्वाचन अधिकारी, उत्तर प्रदेश की उक्त रिपोर्टों के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम 1961 के नियम 89 के उप नियम (5) के अंतर्गत निर्वाचन व्यय प्रस्तुत नहीं करने के लिए श्री अनमोल को कारण बताओ नोटिस सं. 76/उत्तरप्रदेश/वि.स./ 2022/सीईएमएस-III, दिनांक 13.12.2022 जारी किया गया था; और

यतः, निर्वाचनों का संचालन नियम 1961 के नियम 89 के उप-नियम (6) के अनुसार, दिनांक 13.12.2022 के उपयु र्क्त कारण बताओ नोटिस के जरिए श्री अनमोल को निदेश दिया गया था कि वे इस नोटिस के प्राप्त होने के 20 दिनों के अंदर लेखा न प्रस्तुत कर पाने के कारणों को स्पष्ट करते हुए लिखित रूप में अपना अभ्यावेदन प्रस्तुत करें और साथ ही, निर्वाचन व्यय का अपना लेखा दाखिल करें; और

यतः, जिला निर्वाचन अधिकारी,मेरठ द्वारा अपने दिनांक 21.02.2023 के पत्र संख्या 156/29-1490 के जरिए आयोग को सूचना दी गई की उक्त नोटिस अभ्यर्थी द्वारा दिनांक 01.01.2023 को प्राप्त किया गया था; और,

यतः, जिला निर्वाचन अधिकारी,मेरठ द्वारा दिनांक 10.04.2023 के पत्र संख्या 311/29-1490 के जरिए प्रस्तुत की गई अनुपूरक संवीक्षा रिपोर्ट में यह बताया गया है कि श्री अनमोल ने न तो कोई भी अभ्यावेदन और न ही अपने निर्वाचन व्यय का लेखा दाखिल किया है। इसके अतिरिक्त उन्होंने भारत निर्वाचन आयोग का सम्यक् नोटिस मिलने के उपरांत उक्त विफलता के लिए न तो कोई कारण बताया है और न ही कोई स्पष्टीकरण दिया है; और,

यतः, आयोग का यह समाधान हो गया है कि श्री अनमोल निर्वाचन खर्चों का लेखा दाखिल करने में विफल रहे हैं और उनके पास इस विफलता के लिए कोई भी उचितकारण अथवा औचित्य नहीं है; और

यत:, लोक प्रतिनिधित्व अधिनियम,1951 की धारा 10क में अनुबंधित किया गया है कि:-

"यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति -

(क) निर्वाचन व्ययों का लेखा उस समय के भीतर और उस रीति में जैसी इस अधिनियम के द्वारा या अधीन अपेक्षित है, दाखिल करने में असफल रहा है; तथा

(ख) उस असफलता के लिए कोई अच्छा कारण या न्यायोचित्य नहीं रखता है, तो निर्वाचन आयोग शासकीय राजपत्र में प्रकाशित आदेश द्वारा उसको निरहित घोषित करेगा और ऐसा व्यक्ति उस आदेश की तारीख से तीन वर्ष की कालावधि के लिए निरहित होगा।

अतः, अब लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अनुसरण में भारत निर्वाचन आयोग एतद्द्वारा घोषणा करता है कि उत्तर प्रदेश राज्य के 45-हस्तिनापुर (अ0जा0) विधान सभा निर्वाचन क्षेत्र से उत्तर प्रदेश राज्य में विधान सभा के साधारण निर्वाचन, 2022 में निर्वाचन लड़ने वाले अभ्यर्थी श्री अनमोल निवासी मोहल्ला-गंधार दरवाजा किला परीक्षितगढ़, तहसील-मवाना, मेरठ, को इस आदेश की तारीख से तीन वर्ष की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य-क्षेत्र की विधान सभा अथवा विधान परिषद् का सदस्य चुने जाने अथवा होने के लिए निरहित है।

O.N. 110.—WHEREAS, the General Election to 45- Hastinapur(SC) Legislative Assembly of Uttar Pradesh, 2022 was conducting Notification No. 28/61-2022 dated 14th January, 2022.

WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate at an election has to, within 30 days from the date of election of the returned candidate, lodge a true copy of the account of his election expenses with the District Election Officer; and,[भाग II—खण्ड 3(iii)] भारत का राजपत्र : जुलाई ²², ²⁰²³/आषाढ़ ³¹, ¹⁹⁴⁵ ²⁵⁵ WHEREAS, the result of the said election along with 45- Hastinapur(SC) Assembly Constituency was declared by the concerned Returning Officer on 10th March, 2022. Hence, the last date for lodging the account of Election Expenses was 09th April, 2022; and,

WHEREAS, as per the scrutiny report dt. 08.04.2022 submitted by the District Election Officer, Meerut, Uttar Pradesh and forwarded by the Joint Chief Electoral Officer, Uttar Pradesh vide their letter No. 287/Nirvachan Vayy Cell/GE-LA/2022/Patra-01/2021, dated 27th April, 2021, Shri Anmol, a contesting candidate of Uttar Pradesh from 45- Hastinapur(SC) Assembly Constituency of Uttar Pradesh, has failed to lodge account of his election expenses, in the manner, as required under law; and,

WHEREAS, on the basis of the reports of the District Election Office, Meerut, Uttar Pradesh and the Chief Electoral Officer, Uttar Pradesh, a Show-Cause notice, 76/UP/LA/2022/CEMS-III dated 13.12.2022 was issued under sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India to Shri Anmol for not lodging the account of Election Expenses; and,

WHEREAS, As per the sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, through the above said Show-Cause Notice, dated 13.12.2022, Shri Anmol was directed to submit his representation in writing with explaining the reasons for not lodging the account and to lodge account of election expenses within 20 days from the date of receipt of the notice; and,

WHEREAS, the said notice was received by the candidate on 01.01.2023. The acknowledgment receipt has been submitted to the Commission by the District Election Officer, Meerut, vide its letter no. 156/29-1490 dt. 21.02.2023; and,

WHEREAS, the District Election Officer, Meerut in his Supplementary Report, vide its letter 311/29-1490 dt. 10.04.2023 has reported that Shri Anmol has neither submitted any representation nor any statement of account of election expenses. Further, after receipt of the due notice of the Election Commission of India, he has furnished neither any reason nor explanation for the said failure; and,

WHEREAS, the Commission is satisfied that Shri Anmol has failed to lodge the account of election expenses and has no good reason or justification for the failure,

WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that:-

"If the Election Commission is satisfied that a person-

(a) has failed to lodge an account of election expenses, within the time and in the manner required by or

under this Act, and

(b) has no good reason or justification for the failure,

the Election Commission shall, by order published in the Official Gazette, declare him to be disqualified and

any such person shall be disqualified for a period of three years from the date of the order";

NOW, THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission of India hereby declares Shri Shri Anmol resident of Mohalla Gandhaar Darwaja kila Prikshtigarh, Tehshil- Mawana, Meerut, a contesting candidate from 45- Hastinapur(SC) Assembly Constituency of the State of Uttar Pradesh in the General Election to the Legislative Assembly 2022 to be disqualified for being chosen as and for being a member of either House of the Parliament or the Legislative Assembly or the Legislative Council of a State or Union Territory for a period of three years from the date of this order.

आ.अ. 111.—यतः, उत्तर प्रदेश राज्य की 162-बांगरमऊ विधान सभा क्षेत्र के साधारण निर्वाचन 2022

अधिसूचना नं. 68/61-2022 दिनांक 27.01.2022 के जरिए की गई थी।

यतः लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 78 के अनुसार, निर्वाचन लड़ने वाले प्रत्येक अभ्यर्थी को,

यतः, जिला निर्वाचन अधिकारी,उन्नाव, उत्तर प्रदेश के द्वारा प्रस्तुत संवीक्षा रिपोर्ट दिनांक 10.04.2022 और संयुक्त मुख्य निर्वाचन अधिकारी, उत्तर प्रदेश द्वारा पत्र सं. 287/निर्वाचन व्यय सेल/वि0स0सा0नि0-2022/पत्रा0- 01/2021 के जरिए अग्रेषित दिनांक 27/04/2022 की रिपोर्ट के अनुसार अब्दुल रज़्ज़ाक मंसूरी जो उत्तर प्रदेश विधान सभा का साधारण निर्वाचन 2022 के निर्वाचन क्षेत्र 162-बांगरमऊ से लड़ने वाले अभ्यर्थी हैं, विधि द्वारा यथापेक्षित रीति से अपने निर्वाचन व्यय का कोई भी लेखा दाखिल करने में विफल रहे हैं; और,

यतः, जिला निर्वाचन अधिकारी, उन्नाव, उत्तर प्रदेश, और मुख्य निर्वाचन अधिकारी, उत्तर प्रदेश की उक्त रिपोर्टों के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम 1961 के नियम 89 के उप नियम (5) के अंतर्गत निर्वाचन व्यय प्रस्तुत नहीं करने के लिए अब्दुल रज़्ज़ाक मंसूरी को कारण बताओ नोटिस सं. 76/उत्तरप्रदेश-वि.स./2022/ सी.ई.एम.एस.-III, दिनांक 14.11.2022 जारी किया गया था; और

यतः, निर्वाचनों का संचालन नियम 1961 के नियम 89 के उप-नियम (6) के अनुसार, दिनांक 14.11.2022 के उपयु र्क्त कारण बताओ नोटिस के जरिए अब्दुल रज़्ज़ाक मंसूरी को निदेश दिया गया था कि वे इस नोटिस के प्राप्त होने के 20 दिनों के अंदर लेखा न प्रस्तुत कर पाने के कारणों को स्पष्ट करते हुए लिखित रूप में अपना अभ्यावेदन प्रस्तुत करें और साथ ही, निर्वाचन व्यय का अपना लेखा दाखिल करें; और

यतः, उप जिला निर्वाचन अधिकारी,उन्नाव द्वारा अपने दिनांक 19.02.2023 के पत्र संख्या 629/29- नि.व्यय.ले.-2022 के जरिए आयोग को सूचना दी गई की उक्त नोटिस अभ्यर्थी द्वारा दिनांक 14.12.2022 को प्राप्त किया गया था; और,

यतः, जिला निर्वाचन अधिकारी,उन्नाव द्वारा दिनांक 16.05.2023 के पत्र संख्या 123/29- नि.व्यय.ले.-2023 के जरिए प्रस्तुत की गई अनुपूरक संवीक्षा रिपोर्ट में यह बताया गया है कि अब्दुल रज़्ज़ाक मंसूरी ने न तो कोई भी अभ्यावेदन और न ही अपने निर्वाचन व्यय का लेखा दाखिल किया है। इसके अतिरिक्त उन्होंने भारत निर्वाचन आयोग का सम्यक् नोटिस मिलने के उपरांत उक्त विफलता के लिए न तो कोई कारण बताया है और न ही कोई स्पष्टीकरण दिया है; और,

WHEREAS, the result of the said election along with 162- Bangarmau Assembly Constituency was declared by the concerned Returning Officer on 10th March, 2022. Hence, the last date for lodging the account of Election Expenses was 09th April, 2022; and,

WHEREAS, on the basis of the reports of the District Election Office, Unnao, Uttar Pradesh and the Chief Electoral Officer, Uttar Pradesh, a Show-Cause notice, 76/UP-LA/2022/CEMS-III dated 14.11.2022 was issued under sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India to Abdul Razzaq Mansoori for not lodging the account of Election Expenses; and,

WHEREAS, As per the sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, through the above said Show-Cause Notice, dated 14.11.2022, Abdul Razzaq Mansoori was directed to submit his representation in writing with explaining the reasons for not lodging the account and to lodge account of election expenses within 20 days from the date of receipt of the notice; and,

WHEREAS, the said notice was received by the candidate on 14.12.2022. The acknowledgment receipt has been submitted to the Commission by the Deputy District Election Officer, Unnao, vide its letter no. 629/29-

नि.व्यय.ले.-2022 dt. 19.12.2022; and,

WHEREAS, the District Election Officer, Unnao in his Supplementary Report, vide its letter 123/29-

नि.व्यय.ले.-2023 dt. 16.05.2023 has reported that Abdul Razzaq Mansoori has neither submitted any representation nor any statement of account of election expenses. Further, after receipt of the due notice of the Election Commission of India, he has furnished neither any reason nor explanation for the said failure; and,

WHEREAS, the Commission is satisfied that Abdul Razzaq Mansoori has failed to lodge the account of election expenses and has no good reason or justification for the failure,

यतः 164-मोहान (अ.जा.) विधान सभा निर्वाचन क्षेत्र के रिटनिग अधिकारी द्वारा उक्त निर्वाचन का परिणाम 10 मार्च, 2022 को घोषित किया गया था। इस प्रकार, निर्वाचन व्यय का लेखा दाखिल करने की अन्तिम तारीख 09 अप्रैल, 2022 थी; और

यतः, उप जिला निर्वाचन अधिकारी,उन्नाव द्वारा अपने दिनांक 09.02.2023 के पत्र संख्या 43/29 नि.व्यय.ले.- 2022 के जरिए आयोग को सूचना दी गई की उक्त नोटिस दिनांक 06.02.2023 को उक्त पत्ते पर अभ्यर्थी के उपलब्ध न होने के कारण एवं उनके परिवार द्वारा नोटिस न लेने के कारण अभ्यर्थी द्वारा दिए गए पते पर चस्पा किया गया था; और,

यतः, जिला निर्वाचन अधिकारी,उन्नाव द्वारा दिनांक 16.05.2023 के पत्र संख्या 123/29- नि.व्यय.ले.-2023 के जरिए प्रस्तुत की गई अनुपूरक संवीक्षा रिपोर्ट में यह बताया गया है कि श्री अच्छे लाल ने न तो कोई भी अभ्यावेदन और न ही अपने निर्वाचन व्यय का लेखा दाखिल किया है। इसके अतिरिक्त उन्होंने भारत निर्वाचन आयोग का सम्यक् नोटिस मिलने के उपरांत उक्त विफलता के लिए न तो कोई कारण बताया है और न ही कोई स्पष्टीकरण दिया है; और,

यतः, आयोग का यह समाधान हो गया है कि श्री अच्छे लाल निर्वाचन खर्चों का लेखा दाखिल करने में विफल रहे हैं और उनके पास इस विफलता के लिए कोई भी उचितकारण अथवा औचित्य नहीं है; और

यत:, लोक प्रतिनिधित्व अधिनियम,1951 की धारा 10क में अनुबंधित किया गया है कि:-

"यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति -

O.N. 112.—WHEREAS, the General Election to 164- Mohan (SC) Legislative Assembly of Uttar Pradesh, 2022 was conducting Notification No. 68/61-2022 dated 27th January, 2022.

WHEREAS, the result of the said election along with 164- Mohan(SC) Assembly Constituency was declared by the concerned Returning Officer on 10th March, 2022. Hence, the last date for lodging the account of Election Expenses was 09th April, 2022; and,

WHEREAS, as per the scrutiny report dt. 10.04.2022 submitted by the District Election Officer, Unnao, Uttar Pradesh and forwarded by the Joint Chief Electoral Officer, Uttar Pradesh vide their letter No. 287/Nirvachan Vayy Cell/GE-LA/2022/Patra-01/2021, dated 27th April, 2021, Shri Achhey Lal, a contesting candidate of Uttar Pradesh from 164- Mohan(SC) Assembly Constituency of Uttar Pradesh, has failed to lodge account of his election expenses, in the manner, as required under law; and,

WHEREAS, on the basis of the reports of the District Election Office, Unnao, Uttar Pradesh and the Chief Electoral Officer, Uttar Pradesh, a Show-Cause notice, 76/UP-LA/2022/CEMS-III dated 14.11.2022 was issued under sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India to Shri Achhey Lal for not lodging the account of Election Expenses; and,

WHEREAS, As per the sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, through the above said Show-Cause Notice, dated 14.11.2022, Shri Achhey Lal was directed to submit his representation in writing with explaining the reasons for not lodging the account and to lodge account of election expenses within 20 days from the date of receipt of the notice; and,

WHEREAS, the said notice was pasted at the address given by the candidate on 06.02.2023 due to non- availability of the Candidate at given address and denying the family members to receive notice. The acknowledgment receipt has been submitted to the Commission by the District Election Officer, Unnao, vide its letter no. 43/29

नि.व्यय.ले.-2022 dt. 09.02.2023; and,

WHEREAS, the District Election Officer, Unnao in his Supplementary Report, vide its letter 123/29-

नि.व्यय.ले.-2023 dt. 16.05.2023 has reported that Shri Achhey Lal has neither submitted any representation nor any statement of account of election expenses. Further, after receipt of the due notice of the Election Commission of India, he has furnished neither any reason nor explanation for the said failure; and,

WHEREAS, the Commission is satisfied that Shri Achhey Lal has failed to lodge the account of election expenses and has no good reason or justification for the failure,

WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that:-

"If the Election Commission is satisfied that a person-

(a) has failed to lodge an account of election expenses, within the time and in the manner required by or

under this Act, and

(b) has no good reason or justification for the failure,

the Election Commission shall, by order published in the Official Gazette, declare him to be

disqualified and any such person shall be disqualified for a period of three years from the date of the

order";

आ.अ. 113.—यतः, उत्तर प्रदेश राज्य की 366-जौनपुर विधान सभा क्षेत्र के साधारण निर्वाचन 2022 अधिसूचना नं. 99/61-2022 दिनांक 10.02.2022 के जरिए की गई थी।

यतः 366-जौनपुर विधान सभा निर्वाचन क्षेत्र के रिटनिग अधिकारी द्वारा उक्त निर्वाचन का परिणाम 10 मार्च, 2022 को घोषित किया गया था। इस प्रकार, निर्वाचन व्यय का लेखा दाखिल करने की अन्तिम तारीख 09 अप्रैल, 2022 थी; और

यतः, जिला निर्वाचन अधिकारी,जौनपुर, उत्तर प्रदेश के द्वारा प्रस्तुत संवीक्षा रिपोर्ट दिनांक 09.04.2022 और संयुक्त मुख्य निर्वाचन अधिकारी, उत्तर प्रदेश द्वारा पत्र सं. 287/निर्वाचन व्यय सेल/वि0स0सा0नि0-2022/पत्रा0- 01/2021 के जरिए अग्रेषित दिनांक 27/04/2022 की रिपोर्ट के अनुसार श्री दिनेश सिह (रिकू भईया) जो उत्तर प्रदेश विधान सभा का साधारण निर्वाचन 2022 के निर्वाचन क्षेत्र 366-जौनपुर से लड़ने वाले अभ्यर्थी हैं, विधि द्वारा यथापेक्षित रीति से अपने निर्वाचन व्यय का कोई भी लेखा दाखिल करने में विफल रहे हैं; और,

यतः, जिला निर्वाचन अधिकारी, जौनपुर, उत्तर प्रदेश, और मुख्य निर्वाचन अधिकारी, उत्तर प्रदेश की उक्त रिपोर्टों के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम 1961 के नियम 89 के उप नियम (5) के अंतर्गत निर्वाचन व्यय प्रस्तुत नहीं करने के लिए श्री दिनेश सिह (रिकू भईया) को कारण बताओ नोटिस सं. 76/उत्तरप्रदेश/ वि.स./2022/सीईएमएस-III, दिनांक 23.11.2022 जारी किया गया था; और

यतः, निर्वाचनों का संचालन नियम 1961 के नियम 89 के उप-नियम (6) के अनुसार, दिनांक 23.11.2022 के उपयु र्क्त कारण बताओ नोटिस के जरिए श्री दिनेश सिह (रिकू भईया) को निदेश दिया गया था कि वे इस नोटिस के प्राप्त होने के 20 दिनों के अंदर लेखा न प्रस्तुत कर पाने के कारणों को स्पष्ट करते हुए लिखित रूप में अपना अभ्यावेदन प्रस्तुत करें और साथ ही, निर्वाचन व्यय का अपना लेखा दाखिल करें; और

यतः, जिला निर्वाचन अधिकारी,जौनपुर द्वारा अपने दिनांक 20.05.2023 के पत्र संख्या 101/ निर्वाचन-2023 के जरिए आयोग को सूचना दी गई की उक्त नोटिस अभ्यर्थी के पिता श्री लाल जी द्वारा दिनांक 03.01.2023 को प्राप्त किया गया था; और,

यतः, जिला निर्वाचन अधिकारी,जौनपुर द्वारा दिनांक 20.05.2023 के पत्र संख्या 101/ निर्वाचन-2023 के जरिए प्रस्तुत की गई अनुपूरक संवीक्षा रिपोर्ट में यह बताया गया है कि श्री दिनेश सिह (रिकू भईया) ने न तो कोई भी अभ्यावेदन और न ही अपने निर्वाचन व्यय का लेखा दाखिल किया है। इसके अतिरिक्त उन्होंने भारत निर्वाचन आयोग का सम्यक् नोटिस मिलने के उपरांत उक्त विफलता के लिए न तो कोई कारण बताया है और न ही कोई स्पष्टीकरण दिया है; और,

WHEREAS, As per the sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, through the above said Show-Cause Notice, dated 13.12.2022, Shri Dinesh Singh (Rinku Bhaiya) was directed to submit his representation in writing with explaining the reasons for not lodging the account and to lodge account of election expenses within 20 days from the date of receipt of the notice; and,

WHEREAS, the said notice was received by his father Shri Lal Ji on 03.01.2023. The acknowledgment receipt

has been submitted to the Commission by the District Election Officer, Jaunpur, vide its letter no. 101/निर्वाचि-2023 dt. 20.05.2023; and,

WHEREAS, the District Election Officer, Jaunpur in his Supplementary Report, vide its letter 311/29-1490 dt. 10.04.2023 has reported that Shri Dinesh Singh (Rinku Bhaiya) has neither submitted any representation nor any statement of account of election expenses. Further, after receipt of the due notice of the Election Commission of India, he has furnished neither any reason nor explanation for the said failure; and,

WHEREAS, the Commission is satisfied that Shri Dinesh Singh (Rinku Bhaiya) has failed to lodge the account of election expenses and has no good reason or justification for the failure,

WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that:-

आ.अ. 114.— यतः, उत्तर प्रदेश राज्य की 144-मोहम्मदी विधान सभा क्षेत्र के साधारण निर्वाचन 2022 घोषणा अधिसूचना नं. 68/61-2022 दिनांक 27.01.2022 के जरिए की गई थी।

यतः, निर्वाचनों का संचालन नियम 1961 के नियम 89 के उप-नियम (6) के अनुसार, दिनांक 29.11.2022 के उपयु र्क्त कारण बताओ नोटिस के जरिए श्री रवीकांत को निदेश दिया गया था कि वे इस नोटिस के प्राप्त होने के 20 दिनों के अंदर लेखा न प्रस्तुत कर पाने के कारणों को स्पष्ट करते हुए लिखित रूप में अपना अभ्यावेदन प्रस्तुत करें और साथ ही, निर्वाचन व्यय का अपना लेखा दाखिल करें; और

यतः, उप जिला निर्वाचन अधिकारी, खीरी द्वारा अपने दिनांक 30.05.2023 के पत्र संख्या 857/वि.स.सा.निर्वा.- 2022-संवीक्षा रिपोर्ट के जरिए आयोग को सूचना दी गई की उक्त नोटिस अभ्यर्थी द्वारा दिनांक 20.12.2022 को प्राप्त किया गया था; और,

यतः, जिला निर्वाचन अधिकारी, खीरी द्वारा दिनांक 21.03.2023 के पत्र संख्या 727/वि.स.सा.नि.-2022- संवीक्षा रिपोर्ट के जरिए प्रस्तुत की गई अनुपूरक संवीक्षा रिपोर्ट में यह बताया गया है कि श्री रवीकांत ने न तो कोई भी अभ्यावेदन और न ही अपने निर्वाचन व्यय का लेखा दाखिल किया है। इसके अतिरिक्त उन्होंने भारत निर्वाचन आयोग का सम्यक् नोटिस मिलने के उपरांत उक्त विफलता के लिए न तो कोई कारण बताया है और न ही कोई स्पष्टीकरण दिया है;

और,

WHEREAS, As per the sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, through the above said Show-Cause Notice, dated 29.11.2022, Shri Ravikant was directed to submit his representation in writing with explaining the reasons for not lodging the account and to lodge account of election expenses within 20 days from the date of receipt of the notice; and,

WHEREAS, the said notice was received by the candidate on 20.12.2022. The acknowledgment receipt has been submitted to the Commission by the Deputy District Election Officer, Kheri, vide its letter no. 857/वर्.स.सव.निर्वा.-2022-संर्ीक्षव रिपोर्ा, dt. 30.05.2023; and,

यतः 47- मेरठ(कैं ट) विधान सभा निर्वाचन क्षेत्र के रिटनिग अधिकारी द्वारा उक्त निर्वाचन का परिणाम 10 मार्च, 2022 को घोषित किया गया था। इस प्रकार, निर्वाचन व्यय का लेखा दाखिल करने की अन्तिम तारीख 09 अप्रैल, 2022 थी; और

यतः, जिला निर्वाचन अधिकारी,मेरठ, उत्तर प्रदेश के द्वारा प्रस्तुत संवीक्षा रिपोर्ट दिनांक 08.04.2022 और संयुक्त मुख्य निर्वाचन अधिकारी, उत्तर प्रदेश द्वारा पत्र सं. 287/निर्वाचन व्यय सेल/वि0स0सा0नि0-2022/पत्रा0- 01/2021 के जरिए अग्रेषित दिनांक 27/04/2022 की रिपोर्ट के अनुसार श्री दीपक सिरोही जो उत्तर प्रदेश विधान सभा का साधारण निर्वाचन 2022 के निर्वाचन क्षेत्र 47- मेरठ(कैं ट) से लड़ने वाले अभ्यर्थी हैं, विधि द्वारा यथापेक्षित रीति से अपने निर्वाचन व्यय का कोई भी लेखा दाखिल करने में विफल रहे हैं; और,

यतः, जिला निर्वाचन अधिकारी, मेरठ, उत्तर प्रदेश, और मुख्य निर्वाचन अधिकारी, उत्तर प्रदेश की उक्त रिपोर्टों के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम 1961 के नियम 89 के उप नियम (5) के अंतर्गत निर्वाचन व्यय प्रस्तुत नहीं करने के लिए श्री दीपक सिरोही को कारण बताओ नोटिस सं. 76/उत्तरप्रदेश- वि.स./2022/सीईएमएस-III, दिनांक 13.12.2022 जारी किया गया था; और

यतः, निर्वाचनों का संचालन नियम 1961 के नियम 89 के उप-नियम (6) के अनुसार, दिनांक 13.12.2022 के उपयु र्क्त कारण बताओ नोटिस के जरिए श्री दीपक सिरोही को निदेश दिया गया था कि वे इस नोटिस के प्राप्त होने के 20 दिनों के अंदर लेखा न प्रस्तुत कर पाने के कारणों को स्पष्ट करते हुए लिखित रूप में अपना अभ्यावेदन प्रस्तुत करें और साथ ही, निर्वाचन व्यय का अपना लेखा दाखिल करें; और

यतः, जिला निर्वाचन अधिकारी,मेरठ द्वारा अपने दिनांक 21.02.2023 के पत्र संख्या 156/29-1490 के जरिए आयोग को सूचना दी गई की उक्त नोटिस अभ्यर्थी द्वारा दिनांक 16.01.2023 को प्राप्त किया गया था; और,[भाग II—खण्ड 3(iii)] भारत का राजपत्र : जुलाई ²², ²⁰²³/आषाढ़ ³¹, ¹⁹⁴⁵ ²⁶⁵ यतः, जिला निर्वाचन अधिकारी,मेरठ द्वारा दिनांक 07.06.2023 के पत्र संख्या 445/29-1490 के जरिए प्रस्तुत की गई अनुपूरक संवीक्षा रिपोर्ट में यह बताया गया है कि श्री दीपक सिरोही ने न तो कोई भी अभ्यावेदन और न ही अपने निर्वाचन व्यय का लेखा दाखिल किया है। इसके अतिरिक्त उन्होंने भारत निर्वाचन आयोग का सम्यक् नोटिस मिलने के उपरांत उक्त विफलता के लिए न तो कोई कारण बताया है और न ही कोई स्पष्टीकरण दिया है; और,

यतः, आयोग का यह समाधान हो गया है कि श्री दीपक सिरोही निर्वाचन खर्चों का लेखा दाखिल करने में विफल रहे हैं और उनके पास इस विफलता के लिए कोई भी उचितकारण अथवा औचित्य नहीं है; और

यत:, लोक प्रतिनिधित्व अधिनियम,1951 की धारा 10क में अनुबंधित किया गया है कि:-

"यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति -

अतः, अब लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अनुसरण में भारत निर्वाचन आयोग एतद्द्वारा घोषणा करता है कि उत्तर प्रदेश राज्य के 47- मेरठ(कैं ट) विधान सभा निर्वाचन क्षेत्र से उत्तर प्रदेश राज्य में विधान सभा के साधारण निर्वाचन, 2022 में निर्वाचन लड़ने वाले अभ्यर्थी श्री दीपक सिरोही निवासी ज्वालापुरी, आर.के . पुरम,मेरठ, को इस आदेश की तारीख से तीन वर्ष की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य-क्षेत्र की विधान सभा अथवा विधान परिषद् का सदस्य चुने जाने अथवा होने के लिए निरहित है।

O.N. 115.—WHEREAS, the General Election to 47- Meerut(Cantt) Legislative Assembly of Uttar Pradesh, 2022 was conducting Notification No. 28/61-2022 dated 14th January, 2022.

WHEREAS, the result of the said election along with 47- Meerut(Cantt) Assembly Constituency was declared by the concerned Returning Officer on 10th March, 2022. Hence, the last date for lodging the account of Election Expenses was 09th April, 2022; and,

WHEREAS, as per the scrutiny report dt. 08.04.2022 submitted by the District Election Officer, Meerut, Uttar Pradesh and forwarded by the Joint Chief Electoral Officer, Uttar Pradesh vide their letter No. 287/Nirvachan Vayy Cell/GE-LA/2022/Patra-01/2021, dated 27th April, 2021, Shri Deepak Sirohi, a contesting candidate of Uttar Pradesh from 47- Meerut(Cantt) Assembly Constituency of Uttar Pradesh, has failed to lodge account of his election expenses, in the manner, as required under law; and,

WHEREAS, on the basis of the reports of the District Election Office, Meerut, Uttar Pradesh and the Chief Electoral Officer, Uttar Pradesh, a Show-Cause notice, 76/UP/LA/2022/CEMS-III dated 13.12.2022 was issued under sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India to Shri Deepak Sirohi for not lodging the account of Election Expenses; and,

WHEREAS, As per the sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, through the above said Show-Cause Notice, dated 13.12.2022, Shri Deepak Sirohi was directed to submit his representation in writing with explaining the reasons for not lodging the account and to lodge account of election expenses within 20 days from the date of receipt of the notice; and,²⁶⁶ THE GAZETTE OF INDIA : JULY ²², ²⁰²³/ASHADHA ³¹, ¹⁹⁴⁵ [PART II—SEC. ³(iii)] WHEREAS, the said notice was received by the candidate on 16.01.2023. WHEREAS, the District Election Officer, Meerut in his Supplementary Report, vide its letter 445/29-1490 dt. 07.06.2023 has reported that Shri Deepak Sirohi has neither submitted any representation nor any statement of account of election expenses. Further, after receipt of the due notice of the Election Commission of India, he has furnished neither any reason nor explanation for the said failure; and,

WHEREAS, the Commission is satisfied that Shri Deepak Sirohi has failed to lodge the account of election expenses and has no good reason or justification for the failure,

यतः, जिला निर्वाचन अधिकारी, कौशाम्बी द्वारा दिनांक 18.04.2023 के पत्र संख्या 83/निर्वाचन-29 (वि.स.सा.नि.-2022) व्यय-लेखा के जरिए प्रस्तुत की गई आगे की संवीक्षा रिपोर्ट में यह बताया गया है कि श्री विजय कु मार, ने न तो कोई अभ्यावेदन और न ही अपने निर्वाचन व्यय का लेखा दाखिल किया है। इसके अतिरिक्त उन्होंने भारत निर्वाचन आयोग का सम्यक् नोटिस मिलने के उपरांत भी उक्त विफलता के लिए न तो कोई कारण बताया है और न ही कोई स्पष्टीकरण दिया है; और

यतः, जिला निर्वाचन अधिकारी, फतेहपुर द्वारा दिनांक 21.02.2023 के पत्र संख्या 3710/29-34 (वि.स.)/2022 के जरिए प्रस्तुत की गई अनुपूरक संवीक्षा रिपोर्ट में यह बताया गया है कि श्री बृजेन्द्र कु मार ने न तो कोई भी अभ्यावेदन और न ही अपने निर्वाचन व्यय का लेखा दाखिल किया है। इसके अतिरिक्त उन्होंने भारत निर्वाचन आयोग का सम्यक् नोटिस मिलने के उपरांत उक्त विफलता के लिए न तो कोई कारण बताया है और न ही कोई स्पष्टीकरण दिया है;

O.N. 117.—WHEREAS, the General Election to 238-Jahanabad Legislative Assembly of Uttar Pradesh, 2022 was announced by Notification No. 68/61-2022 dated 27th January, 2022.

WHEREAS, the result of the said election along with 238-Jahanabad Assembly Constituency was declared by the concerned Returning Officer on 10th March, 2022. Hence, the last date for lodging the account of Election Expenses was 09th April, 2022; and,

WHEREAS, as per the scrutiny report submitted by the District Election Officer, Fatehpur, Uttar Pradesh and forwarded by the Joint Chief Electoral Officer, Uttar Pradesh vide their letter No. 287/Nirvachan Vayy Cell/GE- LA/2022/Patra-01/2021, dated 27th April, 2021, Shri Brijendra Kumar, a contesting candidate of Uttar Pradesh from 238-Jahanabad Assembly Constituency of Uttar Pradesh, has failed to lodge account of his election expenses, in the manner, as required under law; and,

WHEREAS, on the basis of the reports of the District Election Office, Fatehpur, Uttar Pradesh and the Chief Electoral Officer, Uttar Pradesh, a Show-Cause notice, 76/UP/LA/2022/CEMS-III dated 11.11.2022 was issued under sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India to Shri Brijendra Kumar for not lodging the account of Election Expenses; and,

WHEREAS, As per the sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, through the above said Show-Cause Notice, dated 11.11.2022, Shri Brijendra Kumar was directed to submit his representation in writing with explaining the reasons for not lodging the account and to lodge account of election expenses within 20 days from the date of receipt of the notice; and,

WHEREAS, the said notice was received by the candidate on 01.12.2022. The acknowledgment receipt has been submitted to the Commission by the District Election Officer, Fatehpur, vide its letter no. 3971/29-34

(वर्.स.)/2022 dt. 01.06.2023; and,

WHEREAS, the District Election Officer, Fatehpur in his Supplementary Report, vide its letter 3710/29-

34 (वर्.स.)/2022 dt. 21.02.2023 has reported that Shri Brijendra Kumar has neither submitted any representation nor any statement of account of election expenses. Further, after receipt of the due notice of the Election Commission of India, he has furnished neither any reason nor explanation for the said failure; and,

WHEREAS, the Commission is satisfied that Shri Brijendra Kumar has failed to lodge the account of election expenses and has no good reason or justification for the failure,

WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that:-

"If the Election Commission is satisfied that a person-

(a) has failed to lodge an account of election expenses, within the time and in the manner required by or under

this Act, and

(b) has no good reason or justification for the failure,

the Election Commission shall, by order published in the Official Gazette, declare him to be disqualified and any such

person shall be disqualified for a period of three years from the date of the order";

NOW, THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission of India hereby declares Shri Brijendra Kumar resident of Vill – Nyori Jalalpur, Post – Budhwan, Tehshil- Bindki, Dist - Fatehpur a contesting candidate from 238-Jahanabad Assembly Constituency of the State of Uttar Pradesh in the General Election to the Legislative Assembly 2022 to be disqualified for being chosen as and for being a member of either House of the Parliament or the Legislative Assembly or the Legislative Council of a State or Union Territory for a period of three years from the date of this order.

यतः, जिला निर्वाचन अधिकारी, फतेहपुर, उत्तर प्रदेश के द्वारा प्रस्तुत संवीक्षा रिपोर्ट और संयुक्त मुख्य निर्वाचन अधिकारी, उत्तर प्रदेश द्वारा पत्र सं. 287/निर्वाचन व्यय सेल/वि0स0सा0नि0-2022/पत्रा0-01/2021 के जरिए अग्रेषित दिनांक 27/04/2022 की रिपोर्ट के अनुसार श्री राम सरन साहू जो उत्तर प्रदेश विधान सभा का साधारण निर्वाचन 2022 के निर्वाचन क्षेत्र 238-जहानाबाद से लड़ने वाले अभ्यर्थी हैं, विधि द्वारा यथापेक्षित रीति से अपने निर्वाचन व्यय का कोई भी लेखा दाखिल करने में विफल रहे हैं; और,

यतः, जिला निर्वाचन अधिकारी, फतेहपुर, उत्तर प्रदेश, और मुख्य निर्वाचन अधिकारी, उत्तर प्रदेश की उक्त रिपोर्टों के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम 1961 के नियम 89 के उप नियम (5) के अंतर्गत निर्वाचन व्यय प्रस्तुत नहीं करने के लिए श्री राम सरन साहू को कारण बताओ नोटिस सं. 76/उत्तरप्रदेश/ वि.स./2022/सीईएमएस-III, दिनांक 11.11.2022 जारी किया गया था; और

यतः, निर्वाचनों का संचालन नियम 1961 के नियम 89 के उप-नियम (6) के अनुसार, दिनांक 11.11.2022 के उपयु र्क्त कारण बताओ नोटिस के जरिए श्री राम सरन साहू को निदेश दिया गया था कि वे इस नोटिस के प्राप्त होने के 20 दिनों के अंदर लेखा न प्रस्तुत कर पाने के कारणों को स्पष्ट करते हुए लिखित रूप में अपना अभ्यावेदन प्रस्तुत करें और साथ ही, निर्वाचन व्यय का अपना लेखा दाखिल करें; और

यतः, जिला निर्वाचन अधिकारी, फतेहपुर द्वारा दिनांक 21.02.2023 के पत्र संख्या 3710/29-34 (वि.स.)/2022 के जरिए प्रस्तुत की गई अनुपूरक संवीक्षा रिपोर्ट में यह बताया गया है कि श्री राम सरन साहू ने न तो कोई भी अभ्यावेदन और न ही अपने निर्वाचन व्यय का लेखा दाखिल किया है। इसके अतिरिक्त उन्होंने भारत निर्वाचन आयोग का सम्यक् नोटिस मिलने के उपरांत उक्त विफलता के लिए न तो कोई कारण बताया है और न ही कोई स्पष्टीकरण दिया है; और,

यतः, आयोग का यह समाधान हो गया है कि श्री राम सरन साहू निर्वाचन खर्चों का लेखा दाखिल करने में विफल रहे हैं और उनके पास इस विफलता के लिए कोई भी उचितकारण अथवा औचित्य नहीं है; और

यत:, लोक प्रतिनिधित्व अधिनियम,1951 की धारा 10क में अनुबंधित किया गया है कि:-

यतः, जिला निर्वाचन अधिकारी, फतेहपुर द्वारा अपने दिनांक 01.06.2023 के पत्र संख्या 3971/29-34 (वि.स.)/2022 के जरिए आयोग को सूचना दी गई की उक्त नोटिस अभ्यर्थी द्वारा दिनांक 07.12.2022 को प्राप्त किया गया था; और,²⁷⁶ THE GAZETTE OF INDIA : JULY ²², ²⁰²³/ASHADHA ³¹, ¹⁹⁴⁵ [PART II—SEC. ³(iii)] यतः, जिला निर्वाचन अधिकारी, फतेहपुर द्वारा दिनांक 21.02.2023 के पत्र संख्या 3710/29-34 (वि.स.)/2022 के जरिए प्रस्तुत की गई अनुपूरक संवीक्षा रिपोर्ट में यह बताया गया है कि श्रीमती हेमलता ने न तो कोई भी अभ्यावेदन और न ही अपने निर्वाचन व्यय का लेखा दाखिल किया है। इसके अतिरिक्त उन्होंने भारत निर्वाचन आयोग का सम्यक् नोटिस मिलने के उपरांत उक्त विफलता के लिए न तो कोई कारण बताया है और न ही कोई स्पष्टीकरण दिया है;

यतः, आयोग का यह समाधान हो गया है कि श्रीमती हेमलता निर्वाचन खर्चों का लेखा दाखिल करने में विफल रहे हैं और उनके पास इस विफलता के लिए कोई भी उचितकारण अथवा औचित्य नहीं है; और

यत:, लोक प्रतिनिधित्व अधिनियम,1951 की धारा 10क में अनुबंधित किया गया है कि:-

"यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति -

O.N. 120.—WHEREAS, the General Election to 241-Ayahshah Legislative Assembly of Uttar Pradesh, 2022 was announced by Notification No. 68/61-2022 dated 27th January, 2022.

WHEREAS, as per the scrutiny report submitted by the District Election Officer, Fatehpur, Uttar Pradesh and forwarded by the Joint Chief Electoral Officer, Uttar Pradesh vide their letter No. 287/Nirvachan Vayy Cell/GE- LA/2022/Patra-01/2021, dated 27th April, 2021, Smt. Hemlata, a contesting candidate of Uttar Pradesh from 241-Ayahshah Assembly Constituency of Uttar Pradesh, has failed to lodge account of his election expenses, in the manner, as required under law; and,

WHEREAS, on the basis of the reports of the District Election Office, Fatehpur, Uttar Pradesh and the Chief Electoral Officer, Uttar Pradesh, a Show-Cause notice, 76/UP/LA/2022/CEMS-III dated 11.11.2022 was issued under sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India to Smt. Hemlata for not lodging the account of Election Expenses; and,

WHEREAS, As per the sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, through the above said Show-Cause Notice, dated 11.11.2022, Smt. Hemlata was directed to submit his representation in writing with[भाग II—खण्ड 3(iii)] भारत का राजपत्र : जुलाई ²², ²⁰²³/आषाढ़ ³¹, ¹⁹⁴⁵ ²⁷⁷ explaining the reasons for not lodging the account and to lodge account of election expenses within 20 days from the date of receipt of the notice; and,

WHEREAS, the said notice was received by the candidate on 07.12.2022. The acknowledgment receipt has been submitted to the Commission by the District Election Officer, Fatehpur, vide its letter no. 3971/29-34 (वर्.स.)/2022 dt. 01.06.2023; and,

WHEREAS, the District Election Officer, Fatehpur in his Supplementary Report, vide its letter 3710/29- 34 (वर्.स.)/2022 dt. 21.02.2023 has reported that Smt. Hemlata has neither submitted any representation nor any statement of account of election expenses. Further, after receipt of the due notice of the Election Commission of India, he has furnished neither any reason nor explanation for the said failure; and,

WHEREAS, the Commission is satisfied that Smt. Hemlata has failed to lodge the account of election expenses and has no good reason or justification for the failure,

WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that:-

"If the Election Commission is satisfied that a person-

(a) has failed to lodge an account of election expenses, within the time and in the manner required by or

under this Act, and

(b) has no good reason or justification for the failure,

the Election Commission shall, by order published in the Official Gazette, declare him to be disqualified and

any such person shall be disqualified for a period of three years from the date of the order";

NOW, THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission of India hereby declares Smt. Hemlata resident of Vill - Sujanpur Bahua Dehat, Post – Bahua, Fatehpur a contesting candidate from 241-Ayahshah Assembly Constituency of the State of Uttar Pradesh in the General Election to the Legislative Assembly 2022 to be disqualified for being chosen as and for being a member of either House of the Parliament or the Legislative Assembly or the Legislative Council of a State or Union Territory for a period of three years from the date of this order.

यतः, निर्वाचनों का संचालन नियम 1961 के नियम 89 के उप-नियम (6) के अनुसार, दिनांक 11.11.2022 के उपयु र्क्त कारण बताओ नोटिस के जरिए श्रीमती शीलम देवी को निदेश दिया गया था कि वे इस नोटिस के प्राप्त होने के 20 दिनों के अंदर लेखा न प्रस्तुत कर पाने के कारणों को स्पष्ट करते हुए लिखित रूप में अपना अभ्यावेदन प्रस्तुत करें और साथ ही, निर्वाचन व्यय का अपना लेखा दाखिल करें; और

आ.अ. 123.—यतः, उत्तर प्रदेश राज्य की 243-खागा (अ.जा.) विधान सभा क्षेत्र के साधारण निर्वाचन 2022 अधिसूचना नं. 68/61-2022 दिनांक 27.01.2022 के जरिए की गई थी।

यतः 243-खागा (अ.जा.) विधान सभा निर्वाचन क्षेत्र के रिटनिग अधिकारी द्वारा उक्त निर्वाचन का परिणाम 10 मार्च, 2022 को घोषित किया गया था। इस प्रकार, निर्वाचन व्यय का लेखा दाखिल करने की अन्तिम तारीख 09 अप्रैल, 2022 थी; और

यतः, जिला निर्वाचन अधिकारी, फतेहपुर, उत्तर प्रदेश के द्वारा प्रस्तुत संवीक्षा रिपोर्ट और संयुक्त मुख्य निर्वाचन अधिकारी, उत्तर प्रदेश द्वारा पत्र सं. 287/निर्वाचन व्यय सेल/वि0स0सा0नि0-2022/पत्रा0-01/2021 के जरिए अग्रेषित दिनांक 27/04/2022 की रिपोर्ट के अनुसार श्री अजय चौधरी जो उत्तर प्रदेश विधान सभा का साधारण निर्वाचन 2022 के निर्वाचन क्षेत्र 243-खागा (अ.जा.) से लड़ने वाले अभ्यर्थी हैं, विधि द्वारा यथापेक्षित रीति से अपने निर्वाचन व्यय का कोई भी लेखा दाखिल करने में विफल रहे हैं; और,

यतः, जिला निर्वाचन अधिकारी, फतेहपुर, उत्तर प्रदेश, और मुख्य निर्वाचन अधिकारी, उत्तर प्रदेश की उक्त रिपोर्टों के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम 1961 के नियम 89 के उप नियम (5) के अंतर्गत निर्वाचन व्यय प्रस्तुत नहीं करने के लिए श्री अजय चौधरी को कारण बताओ नोटिस सं. 76/उत्तरप्रदेश/वि.स./ 2022/सीईएमएस-III, दिनांक 11.11.2022 जारी किया गया था; और

यतः, निर्वाचनों का संचालन नियम 1961 के नियम 89 के उप-नियम (6) के अनुसार, दिनांक 11.11.2022 के उपयु र्क्त कारण बताओ नोटिस के जरिए श्री अजय चौधरी को निदेश दिया गया था कि वे इस नोटिस के प्राप्त होने के 20 दिनों के अंदर लेखा न प्रस्तुत कर पाने के कारणों को स्पष्ट करते हुए लिखित रूप में अपना अभ्यावेदन प्रस्तुत करें और साथ ही, निर्वाचन व्यय का अपना लेखा दाखिल करें; और

यतः, जिला निर्वाचन अधिकारी, फतेहपुर द्वारा अपने दिनांक 21.02.2023 के पत्र संख्या 3710/29-34 (वि.स.)/2022 के जरिए आयोग को सूचना दी गई की उक्त नोटिस अभ्यर्थी की पत्नी श्रीमती अनीता द्वारा दिनांक 06.12.2022 को प्राप्त किया गया था; और,

यतः, जिला निर्वाचन अधिकारी, फतेहपुर द्वारा दिनांक 21.02.2023 के पत्र संख्या 3710/निर्वाचन-नि.व्यय प्रको./2023 के जरिए प्रस्तुत की गई अनुपूरक संवीक्षा रिपोर्ट में यह बताया गया है कि श्री अजय चौधरी ने न तो कोई भी अभ्यावेदन और न ही अपने निर्वाचन व्यय का लेखा दाखिल किया है। इसके अतिरिक्त उन्होंने भारत निर्वाचन आयोग का सम्यक् नोटिस मिलने के उपरांत उक्त विफलता के लिए न तो कोई कारण बताया है और न ही कोई स्पष्टीकरण दिया है;

और,

यतः, आयोग का यह समाधान हो गया है कि श्री अजय चौधरी निर्वाचन खर्चों का लेखा दाखिल करने में विफल रहे हैं और उनके पास इस विफलता के लिए कोई भी उचितकारण अथवा औचित्य नहीं है; और

यत:, लोक प्रतिनिधित्व अधिनियम,1951 की धारा 10क में अनुबंधित किया गया है कि:-

"यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति -

अतः, अब लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अनुसरण में भारत निर्वाचन आयोग एतद्द्वारा घोषणा करता है कि उत्तर प्रदेश राज्य के 243-खागा (अ.जा.) विधान सभा निर्वाचन क्षेत्र से उत्तर प्रदेश राज्य में विधान[भाग II—खण्ड 3(iii)] भारत का राजपत्र : जुलाई ²², ²⁰²³/आषाढ़ ³¹, ¹⁹⁴⁵ ²⁸³ सभा के साधारण निर्वाचन, 2022 में निर्वाचन लड़ने वाले अभ्यर्थी श्री अजय चौधरी निवासी म.सं. 93, मझटेनी, पोस्ट-

टेनी, थाना-कोतवाली खागा, तहसील –खागा, जिला-फतेहपुर को इस आदेश की तारीख से तीन वर्ष की अवधि के लिए

संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य-क्षेत्र की विधान सभा अथवा विधान परिषद् का सदस्य चुने जाने

अथवा होने के लिए निरहित है।

O.N. 123.—WHEREAS, the General Election to 243-Khaga (SC) Legislative Assembly of Uttar Pradesh, 2022 was announced by Notification No. 68/61-2022 dated 27th January, 2022.

WHEREAS, the result of the said election along with 243-Khaga (SC) Assembly Constituency was declared by the concerned Returning Officer on 10th March, 2022. Hence, the last date for lodging the account of Election Expenses was 09th April, 2022; and,

WHEREAS, as per the scrutiny report submitted by the District Election Officer, Fatehpur, Uttar Pradesh and forwarded by the Joint Chief Electoral Officer, Uttar Pradesh vide their letter No. 287/Nirvachan Vayy Cell/GE- LA/2022/Patra-01/2021, dated 27th April, 2021, Shri Ajay Chaudhary, a contesting candidate of Uttar Pradesh from 243-Khaga (SC) Assembly Constituency of Uttar Pradesh, has failed to lodge account of his election expenses, in the manner, as required under law; and,

WHEREAS, on the basis of the reports of the District Election Office, Fatehpur, Uttar Pradesh and the Chief Electoral Officer, Uttar Pradesh, a Show-Cause notice, 76/UP/LA/2022/CEMS-III dated 11.11.2022 was issued under sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India to Shri Ajay Chaudhary for not lodging the account of Election Expenses; and,

WHEREAS, As per the sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, through the above said Show-Cause Notice, dated 11.11.2022, Shri Ajay Chaudhary was directed to submit his representation in writing with explaining the reasons for not lodging the account and to lodge account of election expenses within 20 days from the date of receipt of the notice; and,

WHEREAS, the said notice was received by Smt. Aneeta wife of the candidate on 06.12.2022. The acknowledgment receipt has been submitted to the Commission by the District Election Officer, Fatehpur, vide its

letter no. 3710/29-34 (वर्.स.)/2022 dt. 21.02.2023; and,

WHEREAS, the District Election Officer, Fatehpur in his Supplementary Report, vide its letter 3710/29-

34 (वर्.स.)/2022dt. 21.02.2023 has reported that Shri Ajay Chaudhary has neither submitted any representation nor any statement of account of election expenses. Further, after receipt of the due notice of the Election Commission of India, he has furnished neither any reason nor explanation for the said failure; and,

WHEREAS, the Commission is satisfied that Shri Ajay Chaudhary has failed to lodge the account of election expenses and has no good reason or justification for the failure,

WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that:-

"If the Election Commission is satisfied that a person-

(a) has failed to lodge an account of election expenses, within the time and in the manner required by or

under this Act, and

(b) has no good reason or justification for the failure,

the Election Commission shall, by order published in the Official Gazette, declare him to be disqualified and

any such person shall be disqualified for a period of three years from the date of the order";

NOW, THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission of India hereby declares Shri Ajay Chaudhary resident of 93, Majhteni, Post – Teni, Thana Kotwali Khaga, Tehsil – Khaga, Dist - Fatehpur a contesting candidate from 243-Khaga (SC) Assembly Constituency of the State of Uttar Pradesh in the General Election to the Legislative Assembly 2022 to be disqualified for being chosen as and for being a member of either House of the Parliament or the Legislative Assembly or the Legislative Council of a State or Union Territory for a period of three years from the date of this order.

यतः, जिला निर्वाचन अधिकारी, फतेहपुर द्वारा दिनांक 21.02.2023 के पत्र संख्या 3710/29-34 (वि.स.)/2022 के जरिए प्रस्तुत की गई अनुपूरक संवीक्षा रिपोर्ट में यह बताया गया है कि श्री के शन लाल ने न तो कोई भी अभ्यावेदन और न ही अपने निर्वाचन व्यय का लेखा दाखिल किया है। इसके अतिरिक्त उन्होंने भारत निर्वाचन आयोग का सम्यक् नोटिस मिलने के उपरांत उक्त विफलता के लिए न तो कोई कारण बताया है और न ही कोई स्पष्टीकरण दिया है;

WHEREAS, on the basis of the reports of the District Election Office, Fatehpur, Uttar Pradesh and the Chief Electoral Officer, Uttar Pradesh, a Show-Cause notice, 76/UP/LA/2022/CEMS-III dated 11.11.2022 was issued²⁸⁸ THE GAZETTE OF INDIA : JULY ²², ²⁰²³/ASHADHA ³¹, ¹⁹⁴⁵ [PART II—SEC. ³(iii)] under sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India to Shri Maikoo Lal for not lodging the account of Election Expenses; and,

WHEREAS, As per the sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, through the above said Show-Cause Notice, dated 11.11.2022, Shri Maikoo Lal was directed to submit his representation in writing with explaining the reasons for not lodging the account and to lodge account of election expenses within 20 days from the date of receipt of the notice; and,

WHEREAS, the District Election Officer, Fatehpur in his Supplementary Report, vide its letter 3710/29- 34 (वर्.स.)/2022dt. 21.02.2023 has reported that Shri Maikoo Lal has neither submitted any representation nor any statement of account of election expenses. Further, after receipt of the due notice of the Election Commission of India, he has furnished neither any reason nor explanation for the said failure; and,

WHEREAS, the Commission is satisfied that Shri Maikoo Lal has failed to lodge the account of election expenses and has no good reason or justification for the failure,

WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that:-

"If the Election Commission is satisfied that a person-

(a) has failed to lodge an account of election expenses, within the time and in the manner required by or

under this Act, and

(b) has no good reason or justification for the failure,

the Election Commission shall, by order published in the Official Gazette, declare him to be disqualified and

any such person shall be disqualified for a period of three years from the date of the order";

NOW, THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission of India hereby declares Shri Maikoo Lal resident of Bichiyawan Alampur Geriya, Tehsil Khaga, Tehsil - Khaga, Dist - Fatehpur a contesting candidate from 243-Khaga (SC) Assembly Constituency of the State of Uttar Pradesh in the General Election to the Legislative Assembly 2022 to be disqualified for being chosen as and for being a member of either House of the Parliament or the Legislative Assembly or the Legislative Council of a State or Union Territory for a period of three years from the date of this order.

यतः, जिला निर्वाचन अधिकारी, फतेहपुर, उत्तर प्रदेश के द्वारा प्रस्तुत संवीक्षा रिपोर्ट और संयुक्त मुख्य निर्वाचन अधिकारी, उत्तर प्रदेश द्वारा पत्र सं. 287/निर्वाचन व्यय सेल/वि0स0सा0नि0-2022/पत्रा0-01/2021 के जरिए अग्रेषित दिनांक 27/04/2022 की रिपोर्ट के अनुसार श्री विजय कु मार जो उत्तर प्रदेश विधान सभा का साधारण निर्वाचन 2022 के[भाग II—खण्ड 3(iii)] भारत का राजपत्र : जुलाई ²², ²⁰²³/आषाढ़ ³¹, ¹⁹⁴⁵ ²⁸⁹ निर्वाचन क्षेत्र 243-खागा (अ.जा.) से लड़ने वाले अभ्यर्थी हैं, विधि द्वारा यथापेक्षित रीति से अपने निर्वाचन व्यय का कोई भी लेखा दाखिल करने में विफल रहे हैं; और,

यतः, जिला निर्वाचन अधिकारी, फतेहपुर, उत्तर प्रदेश, और मुख्य निर्वाचन अधिकारी, उत्तर प्रदेश की उक्त रिपोर्टों के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम 1961 के नियम 89 के उप नियम (5) के अंतर्गत निर्वाचन व्यय प्रस्तुत नहीं करने के लिए श्री विजय कु मार को कारण बताओ नोटिस सं. 76/उत्तरप्रदेश/ वि.स./2022/सीईएमएस-III, दिनांक 11.11.2022 जारी किया गया था; और

यतः, निर्वाचनों का संचालन नियम 1961 के नियम 89 के उप-नियम (6) के अनुसार, दिनांक 11.11.2022 के उपयु र्क्त कारण बताओ नोटिस के जरिए श्री विजय कु मार को निदेश दिया गया था कि वे इस नोटिस के प्राप्त होने के 20 दिनों के अंदर लेखा न प्रस्तुत कर पाने के कारणों को स्पष्ट करते हुए लिखित रूप में अपना अभ्यावेदन प्रस्तुत करें और साथ ही, निर्वाचन व्यय का अपना लेखा दाखिल करें; और

यतः, जिला निर्वाचन अधिकारी, फतेहपुर द्वारा अपने दिनांक 01.06.2023 के पत्र संख्या 3971/29-34 (वि.स.)/2022 के जरिए आयोग को सूचना दी गई की उक्त नोटिस अभ्यर्थी के बाबा श्री बाबूलाल द्वारा दिनांक 13.12.2022 को प्राप्त किया गया था; और,

यतः, जिला निर्वाचन अधिकारी, फतेहपुर द्वारा दिनांक 12.04.2023 के पत्र संख्या 3848/निर्वाचन-नि.व्यय प्रको./2023 के जरिए प्रस्तुत की गई अनुपूरक संवीक्षा रिपोर्ट में यह बताया गया है कि श्री विजय कु मार ने न तो कोई भी अभ्यावेदन और न ही अपने निर्वाचन व्यय का लेखा दाखिल किया है। इसके अतिरिक्त उन्होंने भारत निर्वाचन आयोग का सम्यक् नोटिस मिलने के उपरांत उक्त विफलता के लिए न तो कोई कारण बताया है और न ही कोई स्पष्टीकरण दिया है;

और,

यतः, आयोग का यह समाधान हो गया है कि श्री विजय कु मार निर्वाचन खर्चों का लेखा दाखिल करने में विफल रहे हैं और उनके पास इस विफलता के लिए कोई भी उचितकारण अथवा औचित्य नहीं है; और

यत:, लोक प्रतिनिधित्व अधिनियम,1951 की धारा 10क में अनुबंधित किया गया है कि:-

"यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति -

अतः, अब लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अनुसरण में भारत निर्वाचन आयोग एतद्द्वारा घोषणा करता है कि उत्तर प्रदेश राज्य के 243-खागा (अ.जा.) विधान सभा निर्वाचन क्षेत्र से उत्तर प्रदेश राज्य में विधान सभा के साधारण निर्वाचन, 2022 में निर्वाचन लड़ने वाले अभ्यर्थी श्री विजय कु मार निवासी ग्राम-बरईखुर्द, पो. – बिलन्दा, जिला-फतेहपुर को इस आदेश की तारीख से तीन वर्ष की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य-क्षेत्र की विधान सभा अथवा विधान परिषद् का सदस्य चुने जाने अथवा होने के लिए निरहित है।

WHEREAS, on the basis of the reports of the District Election Office, Fatehpur, Uttar Pradesh and the Chief Electoral Officer, Uttar Pradesh, a Show-Cause notice, 76/UP/LA/2022/CEMS-III dated 11.11.2022 was issued under sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India to Shri Vijay Kumar for not lodging the account of Election Expenses; and,

यतः, जिला निर्वाचन अधिकारी, सोनभद्र द्वारा दिनांक 30.06.2023 के पत्र संख्या 319/29-निर्वाचन-2023 के जरिए प्रस्तुत की गई अनुपूरक संवीक्षा रिपोर्ट में यह बताया गया है कि श्री उमाशंकर खरवार ने न तो कोई भी अभ्यावेदन और न ही अपने निर्वाचन व्यय का लेखा दाखिल किया है। इसके अतिरिक्त उन्होंने भारत निर्वाचन आयोग का सम्यक् नोटिस मिलने के उपरांत उक्त विफलता के लिए न तो कोई कारण बताया है और न ही कोई स्पष्टीकरण दिया है;

WHEREAS, As per the sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, through the above said Show-Cause Notice, dated 13.12.2022, Shri Umashankar Kharwar was directed to submit his representation in writing with explaining the reasons for not lodging the account and to lodge account of election expenses within 20 days from the date of receipt of the notice; and,

WHEREAS, the said notice was received by the candidate on 24.12.2022. The acknowledgment receipt has

यतः, जिला निर्वाचन अधिकारी, सोनभद्र द्वारा दिनांक 30.06.2023 के पत्र संख्या 319/29-निर्वाचन-2023 के जरिए प्रस्तुत की गई अनुपूरक संवीक्षा रिपोर्ट में यह बताया गया है कि श्री हृदय कु मार ने न तो कोई भी अभ्यावेदन और न ही अपने निर्वाचन व्यय का लेखा दाखिल किया है। इसके अतिरिक्त उन्होंने भारत निर्वाचन आयोग का सम्यक् नोटिस मिलने के उपरांत उक्त विफलता के लिए न तो कोई कारण बताया है और न ही कोई स्पष्टीकरण दिया है; और,

यतः, आयोग का यह समाधान हो गया है कि श्री हृदय कु मार निर्वाचन खर्चों का लेखा दाखिल करने में विफल रहे हैं और उनके पास इस विफलता के लिए कोई भी उचितकारण अथवा औचित्य नहीं है; और

यत:, लोक प्रतिनिधित्व अधिनियम,1951 की धारा 10क में अनुबंधित किया गया है कि:-

अतः, अब लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अनुसरण में भारत निर्वाचन आयोग एतद्द्वारा घोषणा करता है कि उत्तर प्रदेश राज्य के 403-दुद्धी (अ.ज.जा.) विधान सभा निर्वाचन क्षेत्र से उत्तर प्रदेश राज्य में विधान सभा के साधारण निर्वाचन, 2022 में निर्वाचन लड़ने वाले अभ्यर्थी श्री हृदय कु मार निवासी ग्राम व पोस्ट महुली, थाना – विण्ढ़मगंज, तहसील- दुद्धी, सोनभद्र को इस आदेश की तारीख से तीन वर्ष की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य-क्षेत्र की विधान सभा अथवा विधान परिषद् का सदस्य चुने जाने अथवा होने के लिए निरहित है।

ORDER

New Delhi, the 14th July, 2023

O.N. 128.—WHEREAS, the General Election to 403-Duddhi (ST) Legislative Assembly of Uttar Pradesh, 2022 was announced by Notification No. 99/61-2022 dated 10.02.2022.

WHEREAS, the result of the said election along with 403-Duddhi (ST) Assembly Constituency was declared by the concerned Returning Officer on 10th March, 2022. Hence, the last date for lodging the account of Election Expenses was 09th April, 2022; and,

WHEREAS, as per the scrutiny report dated 09.04.2022 submitted by the District Election Officer, Sonbhadra, Uttar Pradesh and forwarded by the Joint Chief Electoral Officer, Uttar Pradesh vide their letter No. 287/Nirvachan Vayy Cell/GE-LA/2022/Patra-01/2021, dated 27th April, 2021, Shri Hriday Kumar, a contesting candidate of Uttar Pradesh from 403-Duddhi (ST) Assembly Constituency of Uttar Pradesh, has failed to lodge account of his election expenses, in the manner, as required under law; and,

WHEREAS, on the basis of the reports of the District Election Office, Sonbhadra, Uttar Pradesh and the Chief Electoral Officer, Uttar Pradesh, a Show-Cause notice, 76/UP/LA/2022/CEMS-III dated 13.12.2022 was issued under sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India to Shri Hriday Kumar for not lodging the account of Election Expenses; and,

WHEREAS, As per the sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, through the above said Show-Cause Notice, dated 13.12.2022, Shri Hriday Kumar was directed to submit his representation in writing with explaining the reasons for not lodging the account and to lodge account of election expenses within 20 days from the date of receipt of the notice; and,

WHEREAS, the said notice was received by the candidate on 26.12.2022. The acknowledgment receipt has been submitted to the Commission by the District Election Officer, Sonbhadra, vide its letter no. 319/29-निर्वाचि- 2023 dt. 30.06.2023; and,

WHEREAS, the District Election Officer, Sonbhadra in his Supplementary Report, vide its letter 319/29- निर्वाचि-2023 dt. 30.06.2023 has reported that Shri Hriday Kumar has neither submitted any representation nor any statement of account of election expenses. Further, after receipt of the due notice of the Election Commission of India, he has furnished neither any reason nor explanation for the said failure; and,[भाग II—खण्ड 3(iii)] भारत का राजपत्र : जुलाई ²², ²⁰²³/आषाढ़ ³¹, ¹⁹⁴⁵ ²⁹⁵ WHEREAS, the Commission is satisfied that Shri Hriday Kumar has failed to lodge the account of election expenses and has no good reason or justification for the failure,

WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that:-

"If the Election Commission is satisfied that a person-

(a) has failed to lodge an account of election expenses, within the time and in the manner required by or

under this Act, and

(b) has no good reason or justification for the failure,

the Election Commission shall, by order published in the Official Gazette, declare him to be disqualified and

any such person shall be disqualified for a period of three years from the date of the order";

NOW, THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission of India hereby declares Shri Hriday Kumar resident of Village & Post – Mahuli, Thana – Wyndhamganj, Tehsil – Duddhi, Sonbhadra a contesting candidate from 403-Duddhi (ST) Assembly Constituency of the State of Uttar Pradesh in the General Election to the Legislative Assembly 2022 to be disqualified for being chosen as and for being a member of either House of the Parliament or the Legislative Assembly or the Legislative Council of a State or Union Territory for a period of three years from the date of this order.
