Order No. 03.
1. This matter is taken up through hybrid arrangement (virtual/physical) mode.
2. This Application has been filed by the Election Commission of India (ECI) through the Collector and District Election Officer Balasore seeking permission for opening the strong room where the EVMs and VVPATS used in the election held on 29.04.2019 for the Member of Lok Sabha for the Balasore Parliamentary Constituency have been kept preserved and to transport those to appropriate places as per the requirement. The move is in view of the letter dated 11.10.2021, received from the Secretary, ECI.
3. Heard Mr. Gopal Kumar Agrawal, learned counsel for the Election Commission of India (ECI).
4. None appears on behalf of the Petitioner in FLPET No 08 of 2019 when the matter is called. This was also the situation on the earlier date.
5. Considering the submissions made and on going through the averments taken in the Application and on perusal of the letter annexed to the Application, as this Court finds that the EVMs and VVPATS have no concern or nexus with the grounds taken in the Election Petition in challenging the Election and thus are not needed for verification for the adjudication, the prayers as advanced in the Application are hereby allowed.
