सं. 5(3)-बी(पी.डी.)/2023—आम जानकारी के लिए यह घोषित किया जाता है कि वर्ष 2023-2024 के दौरान सामान्य भविष्य निधि तथा उसी प्रकार की अन्य निधियों के अभिदाताओं की कु ल जमा रकमों पर दी जाने वाली ब्याज दर 1 अक्तूबर, 2023 से 31 दिसंबर, 2023 तक 7.1% (सात दशमलव एक प्रतिशत) होगी। यह दर 1 अक्तूबर, 2023 से लागू होगी। संबंधित निधियां निम्नलिखित हैं:—
1. सामान्य भविष्य निधि (कें द्रीय सेवाएं)।
2. अंशदायी भविष्य निधि (भारत)।
3. अखिल भारतीय सेवा भविष्य निधि।
4. राज्य रेलवे भविष्य निधि।

सं. 9-17/1989-यू.3/यू.3(ए)-V-III—जबकि, विश्वविद्यालय अनुदान आयोग (यूजीसी) अधिनियम, 1956 की धारा 3 के तहत प्रदत्त शक्तियों का प्रयोग करते हुए, कें द्र सरकार ने यूजीसी की सलाह पर दिनांक 24.10.2022 की अधिसूचना संख्या 9-17/89-यू.3 के माध्यम से भातखंडे संगीत संस्थान, लखनऊ को उपरोक्त अधिनियम के प्रयोजनार्थ एक समवत विश्वविद्यालय संस्थान घोषित किया था।
2. और जबकि, रजिस्ट्रार, भातखंडे संस्कृ ति विश्वविद्यालय (पूर्व में भातखंडे संगीत संस्थान), लखनऊ ने दिनांक 15.05.2023 के पत्र संख्या 124 बीएसयू-1(11)/2023 द्वारा सूचित किया कि उत्तर प्रदेश राज्य सरकार ने दिनांक 03.06.2022 के विधायी अनुभाग-1, अधिसूचना संख्या 296/79/वी-1-2022-1-ए-1-2022 के तहत भातखंडे संगीत संस्थान, लखनऊ के दर्जे को समवत विश्वविद्यालय से भातखंडे संस्कृ ति 612

[भाग I—खण्ड 1
विश्वविद्यालय, लखनऊ के नाम पर राज्य विश्वविद्यालय में परिवर्तित कर दिया है। तदनुसार, उन्होंने भातखंडे संगीत संस्थान, लखनऊ को समवत विश्वविद्यालय की सूची से गैर-अधिसूचित करने का अनुरोध किया।
3. और जबकि, चू ंकि भातखंडे संगीत संस्थान, लखनऊ ने स्वयं को समवत विश््रवविद्यालय से राज्य निजी विश््रवविद्यालय में परिवर्तित करने से पूर्व के न्द्र सरकार का पूर्व अनुमोदन प्राप्त नहीं किया था, इसलिए इस मामले को विश्वविद्यालय अनुदान आयोग को उनकी सलाह के लिए भेजा गया था।
4. और जबकि, यूजीसी ने दिनांक 07.07.2023 के अपने पत्र संख्या 5-19/85 (सीपीपी-1/डीयू) के माध्यम से सूचित किया कि मंत्रालय भातखंडे संगीत संस्थान, लखनऊ को समवत विश््रवविद्यालय के दर्जे से गैर-अधिसूचित करने के लिए अधिसूचना जारी कर सकता है।
5. इसलिए, अब, यह मंत्रालय विश््रवविद्यालय अनुदान आयोग अधिनियम, 1956 की धारा 3 के अधीन प्रदत्त शक्ति का प्रयोग करते हुए विश््रवविद्यालय अनुदान आयोग की सलाह पर निम्नलिखित शर्तों के साथ दिनांक 24-10-2000 की अधिसूचना संख्या 9-17/89-यू3 द्वारा भातखंडे संगीत संस्थान, लखनऊ को दिए गए समवत विश््रवविद्यालय संस्थान का दर्जा वापस लेता है:—
(i) भातखंडे संस्कृ ति विश्वविद्यालय, भातखंडे संगीत संस्थान, लखनऊ में नामांकित छात्रों के अंतिम बैच के हितों की रक्षा करेगा।
(ii) भातखंडे संस्कृ ति विश्वविद्यालय, भातखंडे संगीत संस्थान, लखनऊ से पहले ही उत्तीर्ण हो चुके छात्रों के अभिलेखों/सामग्री को संरक्षित करेगा।
(iii) भातखंडे संस्कृ ति विश्वविद्यालय भातखंडे संगीत संस्थान, लखनऊ से संबंधित आधिकारिक पत्रों/शिकायतों को प्राप्त/स्वीकार करेगा।
(iv) भातखंडे संस्कृ ति विश्वविद्यालय, भातखंडे संगीत संस्थान, लखनऊ से संबद्ध संकाय कर्मचारियों और गैर-संकाय कर्मचारियों के हितों की भी रक्षा करेगा।
(v) भातखंडे संगीत संस्थान, लखनऊ के नाम पर कानूनी और वित्तीय स्थिति सहित सभी परिसंपत्तियां और देनदारियां भातखंडे संस्कृ ति विश्वविद्यालय को हस्तांतरित और निहित की जाएंगी।
(vi) भातखंडे संस्कृ ति विश्वविद्यालय, विश्वविद्यालयों और कॉलेजों में शिक्षकों और अन्य शैक्षणिक कर्मचारियों की नियुक्ति के लिए न्यूनतम योग्यता और उच्च शिक्षा में मानकों के रखरखाव के लिए उपाय, 2018 संबंधी समय-समय पर यथासंशोधित यूजीसी विनियमों का पालन करेगा और कें द्र सरकार के अन्य लागू नियमों/विनियमों का पालन करेगा।
6. यह अधिसूचना उस तारीख से प्रभावी होगी जब उत्तर प्रदेश राज्य सरकार द्वारा पैरा 5 में उल्लिखित शर्तों के अनुपालन को अधिसूचित किया जाएगा।

सं. 9-21/2000-यू3(ए)—जबकि, विश्वविद्यालय अनुदान आयोग (यूजीसी) अधिनियम, 1956 की धारा 3 में अन्य बातों के साथ-साथ यह प्रावधान किया गया है कि के न्द्र सरकार, आयोग की सलाह पर, राजपत्र में अधिसूचना द्वारा यह घोषणा कर सकती है कि विश्वविद्यालय के अतिरिक्त उच्च शिक्षा के लिए कोई भी संस्थान उक्त अधिनियम के प्रयोजनार्थ समवत विश्वविद्यालय माना जाएगा।
2. और जबकि, यूजीसी अधिनियम, 1956 की धारा 3 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, कें द्र सरकार ने यूजीसी की सलाह पर दिनांक 20.06.2002 की अधिसूचना संख्या 9-21/2000-यू.3 के तहत पद्मश्री डॉ. डी.वाई. पाटिल विद्यापीठ, नेरुल, नवी मु ंबई, महाराष्ट्र को पांच साल बाद समीक्षा के अध्यधीन एक समवत विश्वविद्यालय संस्थान घोषित किया था। इसके अतिरिक्त, इस मंत्रालय की दिनांक 06.06.2018 और 06.05.2019 की अधिसूचना संख्या 9-21/2000-यू.3 (पार्ट 1) के तहत इसके समवत विश्वविद्यालय के दर्जे की अवधि को दिनांक 30.06.2020 तक बढ़ा दिया गया था।
3. और इसके बाद जबकि, समवत विश्वविद्यालय ने मौजूदा 'पद्मश्री डॉ. डी. वाई. पाटिल विद्यापीठ', नवी मु ंबई, महाराष्ट्र का नाम बदलकर 'डीवाई पाटिल', नवी मु ंबई, महाराष्ट्र करने का अनुरोध किया था।
4. और जबकि, सरकार ने दिनांक 03.01.2018 के अपने पत्र संख्या 12-13/2014-यू3 (ए) के माध्यम से 'पद्मश्री डॉ. डी. वाई. पाटिल विद्यापीठ', नवी मु ंबई, महाराष्ट्र का नाम बदलकर 'डी. वाई. पाटिल', नवी मु ंबई, महाराष्ट्र करने के लिए निम्नलिखित शर्तों के अध्यधीन अपनी सैद्धांतिक मंजूरी दी है:—
i. समवत विश्वविद्यालय अपने नाम के साथ 'विश्वविद्यालय' शब्द का प्रयोग नहीं करेगा।
ii. नए नाम और शैली में एक अलग सोसायटी/ट्रस्ट बनाना होगा।

iii. समवत विश्वविद्यालय की सभी परिसंपत्तियों (चल और अचल) को कानूनी रूप से नए नाम पर स्थानांतरित करना होगा।
iv. समवत विश्वविद्यालय के कॉर्पस फं ड (मूल निधि) को नए नाम पर स्थानांतरित करना होगा।
v. समवत विश्वविद्यालय के संगम ज्ञापन/नियम नये नाम से होने चाहिए।
5. और इसके बाद जबकि, संस्थान ने दिनांक 14.02.2023 को अपनी अनुपालन रिपोर्ट प्रस्तुत की जिसे सत्यापन और सलाह हेतु यूजीसी को भेजा गया था। अनुपालन रिपोर्ट के सत्यापन के बाद, यूजीसी ने दिनांक 18.07.2023 के अपने पत्र संख्या 6-30/2000 (सीपीपी- 1/डीयू) के माध्यम से सिफारिश की कि मंत्रालय समवत विश्वविद्यालय का नाम बदलने के अनुरोध पर विचार कर सकता है।
6. इसलिए अब, 'विश्वविद्यालय अनुदान आयोग अधिनियम, 1956 की धारा 3 के अंतर्गत प्रदत्त शक्तियों का प्रयोग करते हुए के न्द्र सरकार, विश्वविद्यालय अनुदान आयोग की सलाह पर निम्नलिखित शर्तों के साथ 'पद्मश्री डॉ. डी. वाई. पाटिल विद्यापीठ', नवी मु ंबई, महाराष्ट्र का नाम बदलकर 'डी. वाई. पाटिल', नवी मु ंबई, महाराष्ट्र करने के लिए अपनी स्वीकृ ति प्रदान करती है:—
i. संस्थान 'विश्वविद्यालय' शब्द का प्रयोग नहीं करेगा, लेकिन उसे अपने नाम के साथ 'समवत विश्वविद्यालय' शब्द का प्रयोग करने की अनुमति है।
ii. संस्थान के नाम में परिवर्तन का अर्थ यह नहीं लगाया जाना चाहिए कि दिनांक 30.06.2020 से आगे इसके समवत विश्वविद्यालय के दर्जे का विस्तार किया जा सकता है।
iii. इसके समवत विश्वविद्यालय की स्थिति के विस्तार या अन्यथा संबंधी निर्णय यूजीसी की सलाह प्राप्त होने पर मंत्रालय द्वारा लिया जाएगा।
7. इस मंत्रालय की पूर्व अधिसूचनाओं में उल्लिखित अन्य सभी शर्तों के साथ-साथ समय-समय पर जारी यूजीसी और संबंधित सांविधिक परिषद के मानदंड/विनियम अपरिवर्तित रहेंगे और डी वाई पाटिल, नवी मु ंबई, महाराष्ट्र द्वारा ईमानदारी से उनका पालन किया जाएगा।

RESOLUTION
No. 5(3)-B(PD)/2023—It is announced for general information that during the year 2023-2024, accumulations at the credit of subscribers to the General Provident Fund and other similar funds shall carry interest at the rate of 7.1% (Seven point one percent) w.e.f. 1 October, 2023 to 31 December, 2023. This rate will be in force w.e.f. 1 October, 2023. The funds concerned are:—
1. The General Provident Fund (Central Services).
2. The Contributory Provident Fund (India).
3. The All India Services Provident Fund.
4. The State Railway Provident Fund.
5. The General Provident Fund (Defence Services).
6. The Indian Ordnance Department Provident Fund.
7. The Indian Ordnance Factories Workmen's Provident Fund.
8. The Indian Naval Dockyard Workmen's Provident Fund.
9. The Defence Services Officers Provident Fund.
10. The Armed Forces Personnel Provident Fund.

No. 9-17/1989-U.3/U.3(A)-V-III—Whereas, in exercise of the powers conferred under Section 3 of the University Grants Commission (UGC) Act 1956, the Central Government vide Notification No.9-17/89-U.3 dated 24.10.2022, on the advice of the UGC, had declared Bhatkhande Music Institute, Lucknow as an Institution deemed to be University for the purpose of the aforesaid Act.
2. And whereas, the Registrar, Bhakhande Sanskriti Vishwavidyalaya (formerly Bhatkhande Music Institute), Lucknow, vide letter No.124 BSU-1(11)/2023 dated 15.05.2023, informed that the State Government of Uttar Pradesh vide Legislative Section-1, Notification No.296/79/V-1-2022-1-A-1-2022 dated 03.06.2022 converted the status of Bhatkhande Music Institute, Lucknow from Deemed to be University to State University in the name of Bhatkhande Sanskriti Vishwavidyalaya, Lucknow. Accordingly, he requested to de-notify the Bhatkhande Music Institute, Lucknow from the list of deemed to be University.
3. And whereas, since Bhatkhande Music Institute, Lucknow had not obtained prior approval of the Central Government before converting itself from Deemed to be University to State Private University, the matter was referred to UGC for their advice.
4. And whereas, UGC, vide its letter No.5-19/85 (CPP-I/DU) dated 07.07.2023, conveyed that the Ministry may issue notification to de-notify the Bhatkhande Music Institute, Lucknow from the deemed to be University status.
5. Now, therefore, in exercise of the power conferred under Section 3 of the UGC Act, 1956, this Ministry, on the advice of UGC, hereby withdraws the status of an Institution deemed to be University given to Bhatkhande Music Institute, Lucknow vide the notification No.9-17/89-U.3 dated 24.10.2000 with the following conditions:—
(i) Bhatkhande Sanskriti Vishwavidyalaya will safeguard the interest of the last batch of students enrolled with Bhatkhande Music Institute, Lucknow.
(ii) Bhatkhande Sanskriti Vishwavidyalaya will preserve the records / materials of already passed out students from Bhatkhande Music Institute, Lucknow.
PART I—Sec.1] THE GAZETTE OF INDIA, OCTOBER 7, 2023 (ASVINA 15, 1945) 615(iii) Bhatkhande Sanskriti Vishwavidyalaya will receive / acknowledge the official communications/grievances related to Bhatkhande Music Institute, Lucknow.
(iv) Bhatkhande Sanskriti Vishwavidyalaya will also safeguard the interest of faculty staff and non-faculty staff who are associated with Bhatkhande Music Institute, Lucknow.
(v) All the assets and liabilities including legal and financial standing in the name of Bhatkhande Music Institute, Lucknow shall be transferred to and vest in the Bhatkhande Sanskriti Vishwavidyalaya.
(vi) Bhatkhande Sanskriti Vishwavidyalaya will comply with the UGC Regulations on Minimum Qualifications for Appointment of Teachers and Other Academic Staff in Universities and Colleges and Measures for the Maintenance of Standard in Higher Education, 2018, as amended from time to time and other applicable rules/regulations of Central Government.
6. This Notification will become effective from the date when the compliance of the conditions mentioned in Para 5 is notified by the State Government of Uttar Pradesh.

No. 9-21/2000-U3(A)—Whereas, Section 3 of the University Grants Commission (UGC) Act, 1956 provides inter-alia that the Central Government may, on the advice of the Commission, declare by notification in the Official Gazette, that any Institution for higher education, other than a University, shall be deemed to be a University for purpose of the said Act.
2. And whereas, in exercise of the powers conferred by Section 3 of the UGC Act, 1956, the Central Government, vide Notification No.9-21/2000-U.3 dated 20.06.2002, on the advice of UGC, had declared Padmashree Dr. D. Y. Patil Vidyapeeth, Nerul, Navi Mumbai, Maharashtra as an Institution deemed to be University subject to review after five years. Further, its deemed to be University status was extended upto 30.06.2020 vide this Ministry's Notification No. 9-21/2000-U.3 (Pt.1) dated 06.06.2018 & 06.05.2019.
3. And further whereas, the deemed to be University submitted its request to rechristen the name of existing 'Padmashree Dr. D. Y. Patil Vidyapeeth', Navi Mumbai, Maharashtra to 'D. Y. Patil', Navi Mumabi, Maharashtra.
4. And whereas, the Government, vide its letter No. 12-13/2014-U3(A) dated 03.01.2018, conveyed its in-principle approval for change of the name of 'Padmashree Dr. D. Y. Patil Vidyapeeth', Navi Mumbai, Maharashtra to 'D. Y. Patil', Navi Mumabi, Maharashtra subject to fulfilment of the following conditions:—
i. The Deemed to be University shall not use the word 'University' with its name.
ii. A separate Society/Trust has to be created in the name and style of new name.
iii. All the assets (moveable & immoveable) of the Deemed to be University have to be legally transferred in the new name.
iv. Corpus Fund of the Deemed to be University has to be transferred in the new name.
v. The MoA/Rules of the Deemed to be University should be in the new name.
5. And further whereas, the Institution submitted its compliance report on 14.02.2023 that was sent to UGC for verification and advice. After verification of the compliance report, UGC vide its letter No. 6-30/2000 (CPP-I/DU) dated 18.07.2023 recommended that the Ministry may consider the request for change of name of the deemed to be University.
6. Now, therefore, in exercise of the powers conferred under Section 3 of the UGC Act, 1956, the Central Government, on the advice of the UGC, do hereby convey its approval for change the name of 'Padmashree Dr. D. Y. Patil Vidyapeeth', Navi Mumbai, Maharashtra to 'D. Y. Patil', Navi Mumabi, Maharashtra with the following conditions:—
i. The Institution shall not use the word 'University' but it is allowed to use the word 'deemed to be University' with its name.
ii. The change of name of the Institution should not be construed for the extension of its deemed to be University status beyond 30.06.2020.
iii. The decision for extension of its deemed to be University status or otherwise shall be taken by the Ministry on receipt of the advice of UGC.
