आ.अ. 138.—निर्वाचक रजिस्ट्रीकरण नियम, 1960 के नियम 23 के उप नियम (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और इसकी तारीख 10 अक्टूबर, 2006 की अधिसूचना संख्या 429/बिहार/2006 (अपील) का अधिक्रमण करते हुए निर्वाचन आयोग एतदद्वारा, बिहार राज्य में, प्रत्येक जिले के जिला निर्वाचन अधिकारी-सह-जिला मजिस्ट्रेस्ट, जैसा भी मामला हो, को ऐसे अपीलीय ऑफिसर के रूप मे पदाभिहीत करता है जिसके पास उक्त नियमों के नियम 20, नियम 21 अथवा नियम 21क के अधीन, उस जिले मे समाहित प्रत्येक विधान सभा क्षेत्रों के रजिस्ट्रीकरण ऑफिसर के किसी भी विनिश्चय के विरुद्ध अपील की जाएगी।

O.N. 138.—In exercise of the powers conferred by sub-rule (1) of rule 23 of the Registration of Electors Rules, 1960 and in supersession of its Notification No.429/BR/2006(Appeal), dated 10th October, 2006, the Election Commission hereby designates District Election Officer-cum-District Magistrate of each districts as the case may be, in the State of Bihar as the Appellate Officer to whom an appeal shall lie, from any decision, of the Registration Officer under rule 20, rule 21 or rule 21 A of the said Rules, of each of the Assembly Constituencies comprised within that district.

आ.अ. 139.—यतः, भारत निर्वाचन आयोग की अधिसूचना सं. 464/टीएन-एलए/2021 दिनांक 12 मार्च, 2021 के अनुसरण में 209-पैरामकु ड़ी (अ.जा.) विधान सभा निर्वाचन क्षेत्र के लिए तमिलनाडु विधान सभा का साधारण निर्वाचन, 2021 आयोजित किया गया था; और

यत:, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 78 के अनुसार, किसी भी निर्वाचन में निर्वाचन लड़ने वाला प्रत्येक अभ्यर्थी, निर्वाचित अभ्यर्थी के निर्वाचन की तारीख से 30 दिनों के भीतर अपने निर्वाचन व्यय के लेखे जिला निर्वाचन अधिकारी के पास दाखिल करेगा जो उक्त अधिनियम की धारा 77 के अन्तर्गत उसके द्वारा या उसके निर्वाचन अभिकर्ता द्वारा रखे गए लेखे की एक सत्य प्रति होगी; और

यतः, तमिलनाडु के 209-पैरामकु ड़ी (अ.जा.) विधानसभा निर्वाचन क्षेत्र के लिए निर्वाचन, 2021 का परिणाम, रिर्टनंिग अधिकारी द्वारा 02 मई, 2021 को घोषित किया गया था और इस प्रकार निर्वाचन व्यय के लेखे दाखिल करने की अन्तिम तारीख 01 जून, 2021 थी; और³³² THE GAZETTE OF INDIA : OCTOBER ¹⁴, ²⁰²³/ASVINA ²², ¹⁹⁴⁵ [PART II—SEC. ³(iii)] यतः, आयोग ने कोविड-19 की तत्कालीन वैश्विक महामारी की स्थिति को ध्यान में रखते हुए, अभ्यर्थी द्वारा 31 जुलाई, 2021 तक विलंब से लेखा प्रस्तुत करने की किसी भी घटना को क्षमा करने का निर्णय लिया; और

यतः, निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (1) के अंतर्गत, मुख्य निर्वाचन अधिकारी, तमिलनाडु से उनके दिनांक 16.08.2021 के पत्र सं. 8339/ईएलई-4/2021-11 के तहत प्राप्त जिला निर्वाचन अधिकारी, रामानाथपुरम की रिपोर्ट दिनांक 02.06.2021 के अनुसार, के . मुरुके शन जो तमिलनाडु के 209-पैरामकु ड़ी (अ.जा.) विधान सभा निर्वाचन क्षेत्र, 2021 से निर्वाचन लड़ने वाले अभ्यर्थी हैं, विधि के अंतर्गत यथापेक्षित रीति से अपने निर्वाचन व्यय के लेखे दाखिल करने में असफल रही हैं; और

यतः, जिला निर्वाचन अधिकारी, तिरुपूर की उक्त रिपोर्ट के आधार पर, भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (5) के अंतर्गत के . मुरुके शन को अपने निर्वाचन व्यय के लेखे प्रस्तुत नहीं करने के लिए कारण बताओ नोटिस सं. 76/टीएन-एलए/2021/सीईएमएस-II, दिनांक 17 सितंबर, 2021 जारी किया गया था; और

यत:, उपयु र्क्त उक्त कारण बताओ नोटिस के जरिए और निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (6) के अंतर्गत, के . मुरुके शन को लेखा दाखिल न किए जाने संबंधी कारणों को स्पष्ट करते हुए आयोग को अपना अभ्यावेदन लिखित रूप में प्रस्तुत करने और नोटिस के प्राप्त होने की तारीख से 20 दिनों के भीतर जिला निर्वाचन अधिकारी, रामानाथपुरम जिला को अपने निर्वाचन व्यय के लेखे प्रस्तुत करने का निदेश दिया गया था; और

यत:, जिला निर्वाचन अधिकारी, रामानाथपुरम जिला ने अपनी रिपोर्ट सं. डी1/46458/2021 दिनांक 12.07.2022 में सूचित किया है कि उक्त कारण बताओ नोटिस के . मुरुके शन को दिनांक 22.06.2022 को तामील किया गया था; और

यत:, जिला निर्वाचन अधिकारी, रामानाथपुरम के अभ्यर्थी के संबंध में अनुपूरक रिपोर्ट जोकि पत्र सं.

डी1/46458/2021 दिनांक 23.08.2023 में सूचित किया कि के . मुरुके शन ने निर्वाचन व्यय के लेखे का कोई विवरण या अभ्यावेदन प्रस्तुत नहीं किया है। इसके अतिरिक्त, उक्त नोटिस मिलने के उपरांत, के . मुरुके शन ने विधि के अंतर्गत यथा- विहित लेखे दाखिल करने में अपनी असफलता के लिए भारत निर्वाचन आयोग को न तो कोई कारण बताया है और न ही कोई स्पष्टीकरण दिया है; और

यत:, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में यह उपबंधित किया गया है कि:-

''यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व् यक्ति-

(क) निर्वाचन व्ययों का लेखा उस समय के भीतर और उस रीति में जैसी इस अधिनियम के द्वारा या अधीन अपेक्षित है, दाखिल करने में असफल रहा है; तथा

(ख) उस असफलता के लिए कोई अच्छा कारण या न्यायोचित्य नहीं रखता है,

तो निर्वाचन आयोग शासकीय राजपत्र में प्रकाशित आदेश द्वारा उसको निर्रर्हत घोषित करेगा और ऐसा व् यक्ति उस आदेश की तारीख से तीन वर्ष की कालावधि के लिए निर्रर्हत होगा।";

यत:, तथ्यों और उपलब्ध रिकाडों के आधार पर, आयोग का यह समाधान हो गया है कि के . मुरुके शन अपने निर्वाचन व्यय के लेखे दाखिल करने में असफल रही हैं और उनके पास ऐसा करने में असफल रहने के लिए कोई भी उचित कारण अथवा औचित्य नहीं है; और

अत:, अब, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अनुसरण में, भारत निर्वाचन आयोग एतद्द्वारा घोषणा करता है कि तमिल नाडू के 209-पैरामकु ड़ी (अ.जा.) विधान सभा निर्वाचन क्षेत्र के लिए साधारण निर्वाचन, 2021 में निर्वाचन लड़ने वाले अभ्यर्थी, के . मुरुके शन, निवासी- 2/4ए, उत्तर गली, वैनगलुर डाकघर, पैरामकु डी तालुक, इस आदेश की तारीख से तीन वर्ष की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य क्षेत्र की विधान सभा अथवा विधान परिषद का सदस्य चुने जाने अथवा होने के लिए निर्रर्हत होंगी।

ORDER

New Delhi, the 10th October, 2023

O.N. 139.—WHEREAS, the General Election to Legislative Assembly of Tamil Nadu, 2021 for 209- Paramakudi (SC) Assembly Constituency was held in pursuance of the Election Commission of India Notification No. 464/TN-LA/2021, dated 12th March, 2021; and

WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate at an election shall, within 30 days from the date of election of the returned candidate, lodge with the District Election Officer an account of his election expenses which shall be a true copy of the account kept by him or his election agent under Section 77 of the said act; and

WHEREAS, the result of the election for 209-Paramakudi (SC) Assembly Constituency of Tamil Nadu, 2021 was declared by the Returning Officer on 02nd May, 2021 and hence the last date for lodging the account of Election Expenses was 01st June, 2021; and

WHEREAS, the Commission having regard to the then prevailing pandemic situation of Covid-19, decided to condone any incidence of late submission of account by candidate till 31st July, 2021; and

WHEREAS, as per the report dated 02.06.2021of the DEO, Ramanathapuram under sub-rule (1) of Rule 89 of the Conduct of Elections Rules, 1961 received through the CEO, Tamil Nadu vide his letter no. 8339/Ele-IV/2021- 11, dated 16.08.2021 stating that K. Murukesan, a contesting candidate from 209-Paramakudi (SC) Assembly Constituency in General Election to Legislative Assembly of Tamil Nadu, 2021 has failed to lodge the account of his election expenses, as required under law; and

WHEREAS, on basis of the said report of the District Election Officer, Ramanathapuram, a Show-Cause notice No. 76/TN-LA/2021/CEMS-II, dated 17th September, 2021 was issued under sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India to K. Murukesan, for not lodging of the account of Election Expenses; and

WHEREAS, through the above said Show Cause Notice and under sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, K. Murukesan was directed to submit representation in writing to the Commission explaining the reasons for not lodging the account and also to lodge the account of his election expenses with the District Election Officer, Ramanathapuram District within 20 days from the date of receipt of the notice; and

WHEREAS, the DEO, Ramanathapuram in his report no. D1/46458/2021; dated 12.07.2022 has reported that the said Show Cause Notice was served to K. Murukesan on 22.06.2022; and

WHEREAS, the District Election Officer, Ramanathapuram in his Supplementary Report received through vide letter no. D1/46458/2021; dated 23.08.2023 on account of the candidate, reported that K. Murukesan has not submitted any representation or statement of account of election expenses. Further, after receipt of the said notice, K. Murukesan has neither furnished any reason nor explanation to the Election Commission of India for failure to lodge the account of his election expenses as prescribed under law; and

WHEREAS, Section 10A of the Representation of the People Act, 1951 provides that:-

"If the Election Commission is satisfied that a person-

(a) has failed to lodge an account of election expenses within the time and in the manner required by or

under this Act, and

(b) has no good reason or justification for the failure,

the Election Commission shall, by order published in the Official Gazette, declare him to be disqualified and

any such person shall be disqualified for a period of three years from the date of the order.";

WHEREAS, on basis of the facts and available records, the Commission is satisfied that K. Murukesan has failed to lodge the account of his election expenses and has no good reason or justification for the failure to do so; and

NOW, THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission of India hereby declares K. Murukesan, resident of – 2/4A North Street, Vengalur Post, Paramakudi Taluk and a contesting candidate from 209-Paramakudi (SC) Assembly Constituency in General Election to Legislative Assembly of Tamil Nadu, 2021, to be disqualified for being chosen as and for being a member of either House of the Parliament or the Legislative Assembly or the Legislative Council of a State or Union Territory for a period of three years from the date of this order.

निर्वाचन लड़ने वाले अभ्यर्थी, वी. जयप्रकाश, निवासी- 1/62, इंदरा नगर, उथिरागौसमंई डाकघर, कै लाकरी तालुक,

जिला रामानाथपुरम इस आदेश की तारीख से तीन वर्ष की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा

संघ राज्य क्षेत्र की विधान सभा अथवा विधान परिषद का सदस्य चुने जाने अथवा होने के लिए निर्रर्हत होंगी।

Jayaprakash has not submitted any representation or statement of account of election expenses. Further, after receipt of the said notice, V. Jayaprakash has neither furnished any reason nor explanation to the Election Commission of India for failure to lodge the account of his election expenses as prescribed under law; and

WHEREAS, Section 10A of the Representation of the People Act, 1951 provides that:-

"If the Election Commission is satisfied that a person-

(a) has failed to lodge an account of election expenses within the time and in the manner required by

or under this Act, and

(b) has no good reason or justification for the failure,

the Election Commission shall, by order published in the Official Gazette, declare him to be disqualified and

any such person shall be disqualified for a period of three years from the date of the order.";

WHEREAS, on basis of the facts and available records, the Commission is satisfied that V. Jayaprakash has failed to lodge the account of his election expenses and has no good reason or justification for the failure to do so; and NOW, THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission of India hereby declares V. Jayaprakash, resident of – 1/62, Indhira Nagar, Uthiragosamangai Post, Keelakarai Taluk Ramanathapuram District and a contesting candidate from 211-Ramanathapuram Assembly Constituency in General Election to Legislative Assembly of Tamil Nadu, 2021, to be disqualified for being chosen as and for being a member of either House of the Parliament or the Legislative Assembly or the Legislative Council of a State or Union Territory for a period of three years from the date of this order.

1. Heard Shri Akhilesh Kumar Dwivedi in person on Delay Condonation Application No.2 of 2023 filed along

with this election petition.

2. As per report of the stamp reporter, this election petition has been filed beyond time by 1458 days.

3. As per Section 81 of The Representation of People Act, 1951 (hereinafter referred to as 'The Act, 1951'),

election petition has to be presented within 45 days.

4. In Election Petition No.1 of 2014 (Mohan Lal And Another vs. State Of U.P. through Secretary to The Chairman And 7 Others) decided on 18.04.2014 and in Election Petition No.2 of 2021 (Ram Nath Priyadarshi Suman vs. The Chief Election Commissioner Of India And 3 Others) decided on 23.07.2021, it has been held that an election petition presented beyond the period of limitation provided under Section 81 of The Act, 1951, is a petition which does not comply with the statutory provisions of Section 81 of The Act, 1951 and, consequently, it is liable to be dismissed. It has also been held that the provisions of the Limitation Act shall not apply to an election petition.

5. The judgement in the Election Petition No.1 of 2014 (Mohan Lal And Another vs. State Of U.P. through

Secretary to The Chairman And 7 Others) decided on 18.04.2014 is reproduced below:

"The petition was adjourned on the last date.

No one appears for the petitioners even today even though the name of the counsel is printed in the cause list.

I have perused the petition.

This is an election petition filed by two petitioners for quashing the order dated 16.2.2013 declaring the election of Smt. Laxmi Gautam, respondent No.4 from the 31 Legislative Assembly (Reserve Constituency) Chandausi, U.P.

The election petition was presented on 13.2.2014.

The petition as per the office report dated 23.1.2014 is beyond time by 1 year 278 days. There is no objection against the said report.

Section 81 of the Act provides for presenting an election petition on the pecified grounds within forty five days of the election of the returned candidate or if there are more than one returned candidate and the dates of their election are different, the later of those two dates.

The petitioners in paragraph 6 of the petition states the election result was declared on 6.3.2012 and the respondent No.4 (wrongly mentioned as respondent No.5) was placed at serial No.1 meaning to have been declared elected.

The petition is therefore clearly beyond time as reported.

An election petition is not an action in common law or in equity but under a statute which provides that no election to the Parliament or to any State Legislature can be called in question except by an election petition presented in accordance with the Representation of the People Act, 1951. Therefore, the rule of statutory limitation applies to election petitions.

The election petition which is in the nature of original proceedings has to be presented strictly within the limitation contained in the Act. There is no provision in the Act to condone the delay in its filing. The Act is a complete and a self contained code which does not admit introduction of the principles or the provisions of law contained in the Limitation Act and, therefore, the limitation Act is not applicable to the election petitions vide K. Venkereswara Rao and another Vs. Bekkam Narsimha Reddi and others AIR 1969 SC 872.

In Hukumdev Narain Yadav Vs. Lalit Narain Misra AIR 1974 SC 480 it has been held that even if the special law i.e. Representation of Peoples Act, 1951 does not specifically exclude the provisions of Section 4 to 24 of the Limitation Act nonetheless as the Act is a complete code in itself the provisions of the Limitation Act must be held to be necessarily excluded. Therefore, as the Limitation Act is not applicable to the election petitions under the Act, the delay in presentation of election petition isnot liable to be condoned.

The Court otherwise also has no power to condone any delay in the filing of the election petition.

Section 86(1) of the Representatives of Peoples Act, 1951 provides that the High Court shall dismiss an election petition for non compliance of provisions of Section 81 or Section 82 or Section 117 and the order dismissing the election petition under this sub-section shall be deemed to be an order made under clause (1) of Section 98 of the Act which is liable to be dismissed under Section 86(1) of the Act.

In view of the above, as the election petition has been presented beyond the period of limitation provided under Section 81 of the Act, it is a petition which does not comply with the statutory provision of Section 81 of the Act.

Accordingly, the petition is dismissed summarily under Section 86 of the Act for non compliance of provisions of Section 81 of the Act."

6. The other judgement in the Election Petition No.2 of 2021 (Ram Nath

Priyadarshi Suman vs. The Chief Election Commissioner Of India And 3 Others)decided on 23.07.2021 is reproduced below:

"Shri Vidya Sagar, Advocate has filed his appearance on behalf of the petitioner in this election petition. The same is taken on record.

Heard learned counsel for the petitioner and Shri Tarun Agrawal, who appears for the State Election Commission.

This is an election petition filed by two petitioner for quashing the order dated 25.05.2019 declaring Smt. Keshari Devi Patel, respondent No.4 as elected from the Phoolpur Lok Sabha Constituency No. 51, Prayagraj, Uttar Pradesh.

The election petition was presented on 25.03.2021.

The petition as per the office report dated 23.1.2014 is beyond time by 626 days. There is no objection against the said report.

The petition is therefore clearly beyond time as reported.

The election petition which is in the nature of original proceedings has to be presented strictly within the limitation contained in the Act. There is no provision in the Act to condone the delay in its filing. The Act is a complete and a self contained code which does not admit introduction of the principles or the provisions of law contained in the Limitation Act and, therefore, the limitation Act is not applicable to the election petitions vide K. Venkereswara Rao and another Vs. Bekkam Narsimha Reddi & others AIR 1969 SC 872.
