आ.अ. 158.—यतः, भारत निर्वाचन आयोग की दिनांक 12 मार्च, 2021 की अधिसूचना सं. 464/ एएस-एलए/2021 के अनुसरण में 93-बोकाखाट विधान सभा निर्वाचन क्षेत्र के लिए आसाम विधानसभा का साधारण निर्वाचन, 2021 आयोजित किया गया था; और
यत:, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 78 के अनुसार, किसी निर्वाचन में, निर्वाचन लड़ने वाला प्रत्येक अभ्यर्थी, निर्वाचित अभ्यर्थी के निर्वाचन की तारीख से 30 दिनों के भीतर अपने निर्वाचन व्यय का लेखा जिला निर्वाचन अधिकारी के पास दाखिल करेगा जो उक्त अधिनियम की धारा 77 के अन्तर्गत उसके द्वारा या उसके निर्वाचन अभिकर्ता (एजेंट) द्वारा रखे गए लेखे की एक सत्य प्रति होगी; और
यतः, आसाम के 93-बोकाखाट विधान सभा निर्वाचन क्षेत्र के लिए निर्वाचन, 2021 का परिणाम रिर्टनंिग अधिकारी द्वारा 02 मई, 2021 को घोषित किया गया था और इस प्रकार निर्वाचन व्यय के लेखे दाखिल करने की अन्तिम तारीख 01 जून, 2021 थी; और

(375)376 THE GAZETTE OF INDIA : NOVEMBER 4, 2023/KARTIKA 13, 1945 [PART II—SEC. 3(iii)] यतः, आयोग ने कोविड-19 की तत्कालीन वैकिि महामारी की स्थिति को ध्यान में रखते हुए, अभ्यर्थी द्वारा 31 जुलाई, 2021 तक विलंब से लेखा प्रस्तुत करने के किसी भी मामले को माफ करने का निर्णय लिया; और
यतः, निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (1) के अंतर्गत, मुख्य निर्वाचन अधिकारी, आसाम से उनके पत्र सं0 ईएलई.323/2021/291 दिनांक 11.04.2022 के द्वारा प्राप्त जिला निर्वाचन अधिकारी की दिनांक 21-3-2022 की रिपोर्ट के अनुसार, श्री दुलाल बोरा, जो आसाम के 93-बोकाखाट विधान सभा निर्वाचन क्षेत्र, 2021 से निर्वाचन लड़ने वाले अभ्यर्थी हैं, विधि द्वारा यथापेक्षित रीति से अपने निर्वाचन व्यय के लेखे दाखिल करने में असफल रहे हैं; और
यतः, जिला निर्वाचन अधिकारी की उक्त रिपोर्ट के आधार पर, भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (5) के अंतर्गत श्री दुलाल बोरा, को अपने निर्वाचन व्यय के लेखे प्रस्तुत नहीं करने के लिए कारण बताओ नोटिस सं. सं0 76/एएस-एलए/2021/सीईएमएस-I दिनांक 27 मई, .2022 जारी किया गया था; और
यत:, उपयु र्क्त कारण बताओ नोटिस के जरिए और निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप- नियम (6) के अंतर्गत, श्री दुलाल बोरा, को लेखा प्रस्तुत न किए जाने संबंधी कारणों को स्पष्ट करते हुए आयोग को अपना अभ्यावेदन लिखित रूप में प्रस्तुत करने और नोटिस के प्राप्त होने की तारीख से 20 दिनों के भीतर जिला निर्वाचन अधिकारी, बोकाखाट जिला को अपने निर्वाचन व्यय का लेखा प्रस्तुत करने का भी निदेश दिया गया था;और
यत:, जिला निर्वाचन अधिकारी, बोकाखाट जिला ने अपनी पत्र सं0 बीईएल.3/2022/73 दिनांक 27.06.2022 में सूचित किया है कि उक्त कारण बताओ नोटिस श्री दुलाल बोरा, को दिनांक 24.06.2022 को तामील किया गया था; और
यत:, मुख्य निर्वाचन अधिकारी, आसाम ने पत्र सं. ईएलई.323/2021/453, दिनांक 17.08.2022 के द्वारा जिला निर्वाचन अधिकारी, बोकाखाट की अनूपरक रिपोर्ट सं. बीईएल.17/2022/6 दिनांक 28.06.2022 अग्रेषित किया और बताया कि श्री दुलाल बोरा, ने निर्वाचन व्यय का लेखा प्रस्तुत नहीं किया है। इसके अतिरिक्त, उक्त नोटिस की पावती के उपरांत, श्री दुलाल बोरा, ने विधि के अंतर्गत यथा विहित लेखा दाखिल करने में अपनी असफलता के लिए भारत निर्वाचन आयोग को न तो कोई कारण बताया है और न ही कोई स्पष्टीकरण दिया है; और
यत:, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में यह उपबंधित किया गया है कि:-
''यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति- (क)निर्वाचन व्ययों का लेखा उस समय के भीतर और उस रीति में जैसी इस अधिनियम के द्वारा या अधीन अपेक्षित है, दाखिल करने में असफल रहा है; तथा
(ख)उस असफलता के लिए कोई अच्छा कारण या न्यायोचित्य नहीं रखता है, तो निर्वाचन आयोग शासकीय राजपत्र में प्रकाशित आदेश द्वारा उसको निर्रर्हत घोषित करेगा और ऐसा व्यक्ति उस आदेश की तारीख से तीन वर्ष की कालावधि के लिए निर्रर्हत होगा।";
यत:, तथ्यों और उपलब्ध रिकाडों के आधार पर, आयोग का यह समाधान हो गया है कि श्री दुलाल बोरा, अपने निर्वाचन व्यय के लेखे दाखिल करने में असफल रहे हैं और उनके पास ऐसा करने में असफल रहने के लिए कोई भी उचित कारण अथवा औचित्य नहीं है; और
अत:, अब, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अनुसरण में, भारत निर्वाचन आयोग एतद्द्वारा घोषणा करता है कि हिमाचल प्रदेष राज्य के 93-बोकाखाट विधान सभा निर्वाचन क्षेत्र के लिए साधारण-निर्वाचन, 2021 में निर्वाचन लड़ने वाले अभ्यर्थी, श्री दुलाल बोरा, राजीबगांधी पथ, कैनाधरा, खानपारा, गुवाहाटी इस आदेश की तारीख से तीन वर्ष की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य क्षेत्र की विधान सभा अथवा विधान परिषद का सदस्य चुने जाने अथवा होने के लिए निर्रर्हत होंगे।

ELECTION COMMISSION OF INDIA
ORDER
New Delhi, the 10th March, 2023
O.N. 158.—WHEREAS, the General Election to Legislative Assembly of Assam, 2021 for 93-Bokakhat Assembly Constituency was held in pursuance of the Election Commission of India vide Notification No. 464/AS- LA/2021, dated 12th March, 2021; and
WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate at an election shall, within 30 days from the date of election of the returned candidate, lodge with the District Election Officer an account of his election expenses which shall be true copy of the account kept by him or his election agent under Section 77 of the said act; and
WHEREAS, the result of the election for 93-Bokakhat Assembly Constituency of Assam, 2021 was declared by the Returning Officer on 02nd May, 2021 and hence the last date for lodging the account of Election Expenses was 01st June,, 2021; and
WHEREAS, as per the report no.BEL.6/2019 dated 21-03-2022 of the District Election Officer Bokakhat, under sub-rule (1) of Rule 89 of the Conduct of Elections Rules, 1961, received from the CEO, Assam vide his letter no. ELE.323/2021/291, dated 11.04.2022, Shri Dulal Bora, a contesting candidate from 93-Bokakhat Assembly Constituency of Assam, 2021 has failed to lodge account of election expenses, as required under law; and
WHEREAS, on the basis of the said report of the District Election Officer, a Show-Cause notice No. 76/AS- LA/2021/CEMS-I, dated 27th May, 2022 was issued under sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India to Shri Dulal Bora, for not lodging of account of Election Expenses; and
WHEREAS, through the above said Show Cause Notice and under sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, Shri Dulal Bora, was directed to submit representation in writing to the Commission explaining the reasons for not lodging the account and also to lodge account of election expenses with the District Election Officer, Bokakhat District within 20 days from the date of receipt of the notice; and
WHEREAS, the District Election Officer, Bokakhat District, vide his letter no.BEL.3/2022/73 dated 27.06.2022 has reported that the said notice was served to Shri Dulal Bora, on 24.06.2022; and
WHEREAS, the CEO, Assam vide letter no ELE.323/2021/453, dated 17.08.2022 forwarded the District Election Officer, Bokakhat Supplementary Report No.BEL-17/2022/6 dated 28.06.2022 and reported that Shri Dulal Bora has not submitted account of election expenses. Further, after receipt of the said notice, Shri Dulal Bora, has neither furnished any reason nor explanation to the Election Commission of India, for failure to lodge the account as prescribed under law; and
WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that:-
"If the Election Commission is satisfied that a person-
(a) has failed to lodge an account of election expenses, within the time and in the manner required by or under this Act, and
(b) has no good reason or justification for the failure, the Election Commission shall, by order published in the Official Gazette, declare him to be disqualified and any such person shall be disqualified for a period of three years from the date of the order.";
WHEREAS, on the basis of facts and available records, the Commission is satisfied that Shri Dulal Bora, has failed to lodge account of election expenses and has no good reason or justification for the failure to do so; and
NOW, THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission of India hereby declares Shri Dulal Bora, Rajib Gandhi Path, Kainadhara Khanapara, Guwahati and a contesting candidate in 93-Bokakhat Assembly Constituency of General Election to the Legislative Assembly of Assam, 2021, to be disqualified for being chosen as and for being a member of either House of the Parliament or the Legislative Assembly or the Legislative Council of a State or Union Territory for a period of three years from the date of this order.

आ.अ. 159.—यतः, भारत निर्वाचन आयोग की दिनांक 01 अक्तू बर, 2021 की अधिसूचना सं. 100/ एच0पी0-एच0पी0/2021 के अनुसरण में हिमाचल प्रदेष के 02-मंडी लोक सभा निर्वाचन क्षेत्र के लिए उप-निर्वाचन, 2021 आयोजित किया गया था; और
यत:, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 78 के अनुसार, किसी निर्वाचन में, निर्वाचन लड़ रहा प्रत्येक अभ्यर्थी, निर्वाचित अभ्यर्थी के निर्वाचन की तारीख से 30 दिनों के भीतर अपने निर्वाचन व्यय का लेखा जिला निर्वाचन अधिकारी के पास दाखिल करेगा जो उक्त अधिनियम की धारा 77 के अन्तर्गत उसके द्वारा या उसके निर्वाचन अभिकर्ता (एजेंट) द्वारा रखे गए लेखे की एक सत्य प्रति होगी; और

यतः, निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (1) के अंतर्गत, मुख्य निर्वाचन अधिकारी, हिमाचल प्रदेष से दिनांक 15.12.2021 के पत्र सं. 3-18/2021-ईएलएन-1 के द्वारा प्राप्त जिला निर्वाचन अधिकारी की दिनांक 03-12-2021 की रिपोर्ट के अनुसार, श्री अनिल कुमार, जो हिमाचल प्रदेष के 02-मंडी लोक सभा निर्वाचन क्षेत्र, 2021 से निर्वाचन लड़ने वाले अभ्यर्थी हैं, विधि द्वारा यथापेक्षित रीति से अपने निर्वाचन व्यय के लेखे दाखिल करने में असफल रहे हैं; और
यतः, जिला निर्वाचन अधिकारी की उक्त रिपोर्ट के आधार पर, भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (5) के अंतर्गत श्री अनिल कुमार, को अपने निर्वाचन व्यय के लेखे प्रस्तुत नहीं करने के लिए कारण बताओ नोटिस सं. सं0 76/हिमा0-लो0स0/02/2021(उप0) दिनांक 07 जनवरी, .2022 जारी किया गया था; और
यत:, उपयु र्क्त कारण बताओ नोटिस के जरिए और निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप- नियम (6) के अंतर्गत, श्री अनिल कुमार, को लेखा प्रस्तुत न किए जाने संबंधी कारणों को स्पष्ट करते हुए आयोग को अपना अभ्यावेदन लिखित रूप में प्रस्तुत करने और नोटिस के प्राप्त होने की तारीख से 20 दिनों के भीतर जिला निर्वाचन अधिकारी, मंडी जिला को अपने निर्वाचन व्यय का लेखा प्रस्तुत करने का भी निदेश दिया गया था; और
यत:, जिला निर्वाचन अधिकारी, मंडी जिला ने अपनी पत्र सं.ईएलएन-एमएनडी-एफ(2)-20/2021-498-99-डीईओ, मंडी-175001 दिनांक 04.02.2022 में सूचित किया है कि उक्त कारण बताओ नोटिस श्री अनिल कुमार, को दिनांक 20.01.2022 को तामील किया गया था; और
यत:, मुख्य निर्वाचन अधिकारी, हिमाचल प्रदेष ने पत्र सं. 3-5/2022-ईएलएन-ईईएम-1, दिनांक 16.09.2022 के द्वारा जिला निर्वाचन अधिकारी, मंडी की अनूपरक रिपोर्ट सं. ईएलएन-एमएनडी-एफ(2)-20/2021 दिनांक 12.09.2022 अग्रेषित किया और बताया कि श्री अनिल कुमार, ने निर्वाचन व्यय का लेखा प्रस्तुत नहीं किया है। इसके अतिरिक्त, उक्त नोटिस की पावती के उपरांत, श्री अनिल कुमार, ने विधि के अंतर्गत यथा विहित लेखा दाखिल करने में अपनी असफलता के लिए भारत निर्वाचन आयोग को न तो कोई कारण बताया है और न ही कोई स्पष्टीकरण दिया है; और
यत:, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में यह उपबंधित किया गया है कि:-

[भाग II—खण्ड 3(iii)] भारत का राजपत्र : नवम्बर 4, 2023/र्कार्तक 13, 1945 379यत:, तथ्यों और उपलब्ध रिकाडों के आधार पर, आयोग का यह समाधान हो गया है कि श्री अनिल कुमार, अपने निर्वाचन व्यय के लेखे दाखिल करने में असफल रहे हैं और उनके पास ऐसा करने में असफल रहने के लिए कोई भी उचित कारण अथवा औचित्य नहीं है; और
अत:, अब, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अनुसरण में, भारत निर्वाचन आयोग एतद्द्वारा घोषणा करता है कि हिमाचल प्रदेष राज्य के 02-मंडी लोक सभा निर्वाचन क्षेत्र के लिए उप-निर्वाचन, 2021 में निर्वाचन लड़ने वाले अभ्यर्थी, श्री अनिल कुमार, गांव व डाकघर-चल्हारग, तहसील- जोगिन्दरनगर, जिला-मण्डी, हिमाचल प्रदेष इस आदेश की तारीख से तीन वर्ष की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य क्षेत्र की विधान सभा अथवा विधान परिषद का सदस्य चुने जाने अथवा होने के लिए निर्रर्हत होंगे।

O.N. 159.—WHEREAS, the Bye-Election to House of the People of Himachal Pradesh, 2021 for 02-Mandi Parliamentary Constituency was held in pursuance of the Election Commission of India Notification No.100/HP- HP/2021 , dated 01st October, 2021; and
WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate at an election shall, within 30 days from the date of election of the returned candidate, lodge with the District Election Officer an account of his election expenses which shall be true copy of the account kept by him or his election agent under Section 77 of the said act; and
WHEREAS, the result of the bye-election for 02-Mandi Parliamentary Constituency of Himachal Pradesh, 2021 was declared by the Returning Officer on 02nd November, 2021 and hence the last date for lodging the account of Election Expenses was 02 December, 2021; and
WHEREAS, as per the report dated 03-12-2021 of the DEO, Mandi under sub-rule (1) of Rule 89 of the Conduct of Elections Rules, 1961, received from the CEO, Himachal Pradesh vide his letter no.3-18/2021-ELN-I, dated 15.12.2021, Shri Anil Kumar, a contesting candidate from 02-Mandi Parliamentary Constituency of Himachal Pradesh, 2021 has failed to lodge account of election expenses, as required under law; and
WHEREAS, on the basis of the said report of the District Election Officer, a Show-Cause notice No. 76/HP- LC/2021/CEMS-I(Bye), dated 07th January, 2022 was issued under sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India to Shri Anil Kumar, for not lodging of account of Election Expenses; and
WHEREAS, through the above said Show Cause Notice and under sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, Shri Anil Kumar, was directed to submit representation in writing to the Commission explaining the reasons for not lodging the account and also to lodge account of election expenses with the District Election Officer, Mandi District within 20 days from the date of receipt of the notice; and
WHEREAS, the District Election Officer, Mandi District, vide his letter no. ELN-MND-F(2)-20/2021-498- 99-DEO,Mandi-175001 dated 4.02.2022 has reported that the said notice was served to Shri Anil Kumar, on 20.01.2022; and
WHEREAS, the CEO, Himachal Pradesh vide letter no 3-5/2022-ELN-EEM-1, dated 16.09.2022 forwarded the District Election Officer, Mandi, Supplementary Report No.ELN-MND-F(2)-20/2021 dated 12.09.2022 wherein the DEO, Mandi reported that Shri Anil Kumar, has not submitted account of election expenses. Further, after receipt of the said notice, Shri Anil Kumar, has neither furnished any reason nor explanation to the Election Commission of India, for failure to lodge the account as prescribed under law; and
WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that:-
"If the Election Commission is satisfied that a person-

WHEREAS, on the basis of facts and available records, the Commission is satisfied that Shri Anil Kumar, has failed to lodge account of election expenses and has no good reason or justification for the failure to do so; and
NOW, THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission of India hereby declares Shri Anil Kumar, VPO Chalharag, Tehsil Jogindernagar, Distt. Mandi, Himachal Pradesh and a contesting candidate in 02-Mandi Parliamentary Constituency Bye Election of the State of Himachal Pradesh to be disqualified for being chosen as and for being a member of either House of the Parliament or the Legislative Assembly or the Legislative Council of a State or Union Territory for a period of three years from the date of this order.

यत:, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 78 के अनुसार, निर्वाचन लड़ने वाले प्रत्येक अभ्यर्थी को निर्वाचित अभ्यर्थी के निर्वाचन की तारीख से 30 दिनों के भीतर, जिला चुनाव अधिकारी के पास अपने चुनाव खर्च का लेखा-जोखा प्रस्तुत करेगा जो उक्त अधिनियम की धारा 77 के तहत उसके या उसके चुनाव एजेंट द्वारा रखे गए खाते की सही प्रति होगी; और
यतः, 105 - भावनगर (पमिि) विधान सभा निर्वाचन क्षेत्र के निर्वाचन परिणाम रिर्टनंिग अधिकारी द्वारा 08 दिसम्बर, 2022 को घोषित किया गया था और इस प्रकार निर्वाचन व्यय के लेखे दाखिल करने की अन्तिम तारीख 07 जनवरी, 2023 थी; और
यतः, जिला निर्वाचन अधिकारी, भावनगर के द्वारा प्रस्तुत और मुख्य निर्वाचन अधिकारी, गुजरात द्वारा पत्र सं .ELC/2922/LA-37/CHH (Exp.) दिनांक 30.01.2023 के जरिए अग्रेषित की गई रिपोर्ट के अनुसार श्री बारैया गोबरभाई कानजीभाई ,जो गुजरात विधान सभा का साधारण निर्वाचन 2202 के निर्वाचन क्षेत्र 105 – भावनगर (पमिि) से लड़ने वाले अभ्यर्थी हैं, विधि द्वारा यथापेक्षित रीति से अपने निर्वाचन व्यय का कोई भी लेखा दाखिल करने में विफल रहे हैं ;और
यतः, जिला निर्वाचन अधिकारी की उक्त रिपोर्ट के आधार पर, भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम )5 ( के अंतर्गत श्री बारैया गोबरभाई कानजीभाई, को अपने निर्वाचन व्यय के लेखे प्रस्तुत नहीं करने के लिए कारण बताओ नोटिस सं. 76/GJ-LA/18(105)/2023/CEMS-IV दिनांक 26.06.2023 जारी किया गया था; और
यत:, उपयु र्क्त कारण बताओ नोटिस के माध्यम से और निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम )6 ( के अंतर्गत, श्री बारैया गोबरभाई कानजीभाई, को लेखा प्रस्तुत न किए जाने संबंधी कारणों को स्पष्ट करते हुए आयोग को अपना अभ्यावेदन लिखित रूप में प्रस्तुत करने और नोटिस के प्राप्त होने की तारीख से 20 दिनों के अंदर जिला निर्वाचन अधिकारी ,भावनगर को अपने निर्वाचन व्यय का लेखा भी प्रस्तुत करने का निदेश दिया गया था; और
यत:, मुख्य निर्वाचन अधिकारी, गुजरात ने अपने पत्र संख्या ELC/2922/AC-105-CHH (Exp) दिनांक 29 सितम्बर, 2023 के माध्यम से सूचित किया है कि उक्त नोटिस उम्मीदवार को 14.07.2023 को प्राप्त हुआ है; और
यत:, जिला निर्वाचन अधिकारी ,भावनगर, द्वारा अपनी अनुपूरक रिपोर्ट दिनांक 15.09.2023 जो मुख्य निर्वाचन अधिकारी, गुजरात पत्र सं 0 ELC/2922/AC-105-CHH (Exp) दिनांक 29 सितम्बर, 2023 के द्वारा अग्रेषित कर भेजी गई रिपोर्ट में यह बताया गया है कि श्री बारैया गोबरभाई कानजीभाई ,ने भारत निर्वाचन आयोग के दिनांक[भाग II—खण्ड 3(iii)] भारत का राजपत्र : नवम्बर 4, 2023/र्कार्तक 13, 1945 381 26.06.2023 के कारण बताओ नोटिस की प्राप्ति के बाद भी न तो कोई अभ्यावेदन और न ही अपने निर्वाचन व्यय के खाते का कोई विवरण प्रस्तुत किया है; और
यत:, उक्त नोटिस प्राप्त होने के बाद, श्री बारैया गोबरभाई कानजीभाई ने कानून के तहत निर्धारित खाते को दर्ज करने में विफलता के लिए भारत के चुनाव आयोग को न तो कोई कारण और न ही कोई स्पष्टीकरण प्रस्तुत किया है; और
यत:, तथ्यों और उपलब्ध अभिलेखों के आधार पर आयोग का यह समाधान हो गया है कि श्री बारैया गोबरभाई कानजीभाई अपने निर्वाचन व्यय का लेखा दाखिल करने में असफल रहे हैं और उनके पास इस विफलता के लिए कोई भी उचित कारण अथवा औचित्य नहीं है; और
यत:, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10 क में यह उपबंधित किया गया है कि :-
''यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति-
(क) निर्वाचन व्ययों का लेखा उस समय के भीतर और उस रीति में जैसी इस अधिनियम के द्वारा या अधीन अपेक्षित है, दाखिल करने में असफल रहा है; तथा
(ख) उस असफलता के लिए कोई अच्छा कारण या न्यायोचित्य नहीं रखता है,तो निर्वाचन आयोग शासकीय राजपत्र में प्रकाशित आदेश द्वारा उसको निर्रर्हत घोषित करेगा और ऐसा व्यक्ति उस आदेश की तारीख से तीन वर्ष की कालावधि के लिए निर्रर्हत होगा।"
अत:, अब, लोक प्रतिनिधित्व अधिनियम, 5119 की धारा 10 क के अनुसरण में, भारत निर्वाचन आयोग एतद्द्वारा घोषणा करता है कि गुजरात राज्य के 105 - भावनगर (पमिि) विधान सभा निर्वाचन क्षेत्र से गुजरात राज्य में विधान सभा के साधारण निर्वाचन, 2022 में निर्वाचन लड़ने वाले अभ्यर्थी, श्री बारैया गोबरभाई कानजीभाई, निवासी गाँव - खूना, तहसील - धोलेरा, जिला – अहमदाबाद - 382455, को इस आदेश की तारीख से तीन वर्ष की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य-क्षेत्र की विधान सभा अथवा विधान परिषद का सदस्य चुने जाने अथवा होने के लिए निर्रर्हत होंगे।

ORDER
New Delhi, the 19th October, 2023
O.N. 160.—WHEREAS, the General Election for 105-Bhavnagar (West) Assembly Constituency of Gujarat, 2022 was held in pursuance of the Election Commission of India Notification No. 464/GJ-LA/2022 dated 5th November, 2022; and
WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate at an election shall, within 30 days from the date of election of the returned candidate, lodge with the District Election Officer, an account of his election expenses which shall be true copy of the account kept by him or his election agent under Section 77 of the said act; and
WHEREAS, the result of the election for 105-Bhavnagar (West) Assembly Constituency of Gujarat, was declared by the Returning Officer on 8th December, 2022 and hence the last date for lodging the account of Election Expense was 7th January, 2023; and
WHEREAS, as per the report submitted by the District Election Officer, Bhavnagar and forwarded by the Chief Electoral Officer, Gujarat vide their letter no. ELC/2922/LA-37/CHH(Exp.) dated 30th January, 2023, Sh. Baraiya Gobarbhai Kanjibhai, a contesting candidate from 105-Bhavnagar (West) Assembly Constituency of Gujarat, 2022 has failed to lodge account of his election expenses, as required under law; and
WHEREAS, on the basis of the said reports of the District Election Officer, a Show-Cause notice No. 76/GJ-LA/18(105)/2023/CEMS-IV, dated 26th June, 2023 was issued under sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India to Sh. Baraiya Gobarbhai Kanjibhai, for not lodging of account of Election Expenses; and382 THE GAZETTE OF INDIA : NOVEMBER 4, 2023/KARTIKA 13, 1945 [PART II—SEC. 3(iii)] WHEREAS, through the above said Show Cause Notice and under sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, Sh. Baraiya Gobarbhai Kanjibhai, was directed to submit his representation in writing to the Commission explaining the reason for not lodging the account and also to lodge account of election expenses with the District Election Officer, Bhavnagar within 20 days from the date of receipt of the notice; and
WHEREAS, the Chief Electoral Officer, Gujarat vide his letter no. ELC/2922/AC-105-CHH (Exp) dated 29th September, 2023 has informed that the said notice was served to the candidate on 14.07.2023; and
WHEREAS, the District Election Officer, Bhavnagar in his supplementary report dated 15.09.2023 forwarded by the Chief Electoral Officer, Gujarat, vide letter no. ELC/2922/AC-105-CHH(Exp) 29th September, 2023 has reported that Sh. Baraiya Gobarbhai Kanjibhai has neither submitted any representation nor any statement of account of election expenses even after receipt of the Show Cause Notice dated 26.06.2023 of the Election Commission of India; and
WHEREAS, after receipt of the said notice, Sh. Baraiya Gobarbhai Kanjibhai has neither furnished any reason nor any explanation to the Election Commission of India, for failure to lodge the account of election expenses as prescribed under law; and
WHEREAS, on the basis of facts and available records, the Commission is satisfied that Sh. Baraiya Gobarbhai Kanjibhai has failed to lodge his account of election expenses and has not furnished any reason or justification for the failure to do so; and
WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that:-
"If the Election Commission is satisfied that a person-
(a) has failed to lodge an account of election expenses, within the time and in the manner required by or under this Act, and
(b) has no good reason or justification for the failure, the Election Commission shall, by order published in the Official Gazette, declare him to be disqualified and any such person shall be disqualified for a period of three years from the date of the order."
NOW, THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission of India hereby declares Sh. Baraiya Gobarbhai Kanjibhai resident of VI. Khuna, TA Dholera, DI. Ahmedabad-382455, a contesting candidate from 105-Bhavnagar (West) Assembly Constituency of the State of Gujarat in the General Election to the Legislative Assembly, 2022 to be disqualified for being chosen as and for being a member of either House of Parliament or the Legislative Assembly or Legislative Council of a State or Union Territory for a period of three years from the date of this order.
