No. 4422(E) dated 09-12-2019, published in Gazette of India on 10-12-2019 namely:—
In the said notification, for the words "Shri Shivaji Davbhat, Deputy Collector, Government of Maharashtra to perform the functions of Competent Authority in the State of Maharashtra under the said Act for laying of Pipelines for Uran Chakan Shikrapur LPG Pipelines (UCSPL) by M/s. Hindustan Petroleum Corporation Limited" the words "Smt. Supriya Karmarkar, Deputy Collector, Government of Maharashtra to perform the functions of Competent Authority in the State of Maharashtra under the said Act for laying of Pipelines for Uran Chakan Shikrapur LPG Pipeline (USCPL) by M/s. Hindustan Petroleum Corporation Limited" shall be substituted.

इससे पुर्ब एस.ओ. संख्या 211 दिनांक 11.12.2017 के अंतर्गत भारत के राजपत्र में दिनांक 03.02.2018 प्रकाशित राजस्थान राज्य में इंडियन ऑयल कॉर्पोरेशन लिमिटेड के लिए पहले अधिसूचित सक्षम प्राधिकारी श्री बींजा राम सीरवी, प्रचालन प्रबंधक, को डी- नोटिफ़ाइड समझा जाए।
यह अधिसूचना इसके जारी होने की तारीख से प्रभावी होगी।

S.O. 1751.—In Pursuance of sub-section (a) of section 2 of the Petroleum and Minerals Pipeline (Acquisition of Right of Users in Land) Act, 1962 (50 of 1962), (hereinafter called the said act), the Central Government hereby authorizes the person mentioned in column (1) of the table given below to perform the functions of the Competent authority under the said Act for IndianOil Corporation Limited in respect of areas mentioned in column (2) for its operational petroleum pipelines laid under the said Act mentioned in column (3) of the said Table:—

और के न्द्रीय सरकार को ऐसा प्रतीत होता है कि ऐसी पाइपलाइन बिछाने के प्रयोजन के लिए, इस अधिसूचना के साथ संलग्न अनुसूची में वर्णित भूमि में उपयोगकर्ता का अधिकार प्राप्त करना आवश्यक है;

उक्त अनुसूची में वर्णित भूमि में रुचि रखनेवाला कोई भी व्यक्ति भारत के राजपत्र में प्रकाशित इस असाधारण अधिसूचना की प्रतियाँ आम जनता को उपलब्ध कराने की दिनांक से 21 दिनों के भीतर लिखित रूप में अधिग्रहण पर आपत्ति जता सकता है, उसमें उपयोगकर्ता के अधिकार या भूमि के नीचे पाइपलाइन बिछाने का अधिकार सक्षम अधिकारी को, सक्षम अधिकारी, आई. एम. सी. लिमिटेड, काकीनाडा-विजयवाड़ा-नेल्लोर प्राकृ तिक गैस पाइपलाइन परियोजना, क.नं. 66-9-2/1, पहली मंजिल, कमलेंद्रनाथ स्ट्रीट, नरसन्ना नगर, काकीनाडा- 533003, आंध्रप्रदेश में भेज सके गा।

S.O. 1752.—Whereas, it appears to the Central Government, that it is necessary a pipeline should be laid by the IMC Limited, through the specified lands in Dr. B.R. Ambedkar Konaseema District in Andhra Pradesh state, in the public interest for the transportation of Natural Gas from Kakinada–Vijaywada– Nellore (KVNPL).
And whereas, it appears that for the purpose of laying such pipeline, it is necessary to acquire the Right of User in land described in the Schedule annexed to this Notification.
Now, therefore, in exercise of the powers conferred by Sub-section (1) of Section 3 of the Petroleum and Minerals Pipeline (Acquisition of Right of User in the Land) Act, 1962 (50 of 1962), the Central Government hereby declares its intention to acquire the Right of User therein.
Any person interested in the land described in the said Schedule may within 21 days from the date on which the copies of the Extra-ordinary notification, as published in the Gazette of India, are made available to the General Public object in writing to the acquisition of the Right of User therein or laying of the pipeline under the land to the Competent Authority, Kakinada – Vijayawada – Nellore Natural Gas Pipeline Project, of IMC Limited, D.No. 66-9-2/1, 1st Floor, Kamalendranath Street, Narasanna Nagar, Kakinada – 533003, Andhra Pradesh.

का.आ. 1753.—पेट्रोलियम और खनिज पाइपलाइन (भूमि में प्रयोक्ता के अधिकार का अर्जन) अधिनियम, 1962 (1962 का 50) (इसमें इसके बाद उक्त अधिनियम कहा गया है) की धारा 2 के खंड (क) के अनुसरण में भारत सरकार एतदद्वारा, झारखंड राज्य में मैसर्स गेल (इंडिया) लिमिटेड की सभी प्राकृ तिक गैस पाइपलाइन परियोजनाओं के लिए पेट्रोलियम और खनिज पाइपलाइन (भूमि में प्रयोक्ता के अधिकार का अर्जन) अधिनियम, 1962 के तहत श्री बीर प्रकाश प्रसाद, उप समाहर्ता (सेवानिवृत्त), झारखंड राज्य प्रशासनिक सेवा को, प्रतिनियुक्ति के आधार पर, सक्षम प्राधिकारी के कार्यो का निर्वहन करने के लिये प्राधिकृ त करती है I

.—भारत सरकार ने पेट्रोलियम और खनिज पाइपलाइन (भूमि में उपयोग के अधिकार का अर्जन) अधिनियम, 1962 (1962 का 50) (जिसे इसमें इसके पश्चात उक्त अधिनियम कहा गया है) की धारा 3 की उपधारा (1) के अधीन जारी भारत सरकार के पेट्रोलियम और प्रा—तिक गैस मंत्रालय की अधिसूचना संख्या 1608 क्रमशः 28.03.2023 उस अधिसूचना से संलग्न अनुसूची में विनिर्दिष्ट भूमि में गेल (इण्डिया) लिमिटेड द्वारा पश्चिम बंगाल राज्य में
के माध्यम से प्रा—
– तिक गैस के परिवहन के लिए पाइप लाइन बिछाने के प्रयोजन के लिए उपयोग के अधिकार का अर्जन करने के अपने आशय की घोषणा की थी;
और उक्त राजपत्रित अधिसूचना की प्रतियां जनता को उपलब्ध करा दी गई थी;
और, सक्षम प्राधिकार ने, उक्त अधिनियम की धारा 6 की उप-धारा (1) के अधीन भारत सरकार को अपनी रिपोर्ट दे दी है;
और भारत सरकार ने, उक्त रिपोर्ट पर विचार करने के पश्चात और यह संतुष्ट हो जाने पर कि उक्त भूमि पाइपलाइनें बिछाने के लिए अपेक्षित है, उस में उपयोग के अधिकार का अर्जन करने का विनिश्चय किया है;
अतः अब, भारत सरकार, उक्त अधिनियम की धारा 6 की उप-धारा (1) द्वारा प्रदत्त्त शक्तियों का प्रयोग करते हुये, यह घोषणा करती है कि इस अधिसूचना से संलग्न अनुसूची में विनिर्दिष्ट भूमि में पाइपलाइनें बिछाने के लिए उपयोग के अधिकार का अर्जन किया जाता है;
और भारत सरकार, उक्त अधिनियम कि धारा 6 कि उप-धारा (4) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुये, निर्देश देती है कि पाइपलाइनें बिछाने के लिए भूमि में उपयोग का अधिकार, इस घोषणा के प्रकाशन की तारीख को, भारत सरकार में निहित होने के बजाए, पाइपलाइनें बिछाने का प्रस्ताव करने वाली गेल (इण्डिया) लिमिटेड में निहित होगा और तदुपरि, भूमि में ऐसे उपयोग का अधिकार, इस प्रकार अधिरोपित निबंधनों और शर्तों के अधीन रहते हुये, सभी विल्लंगमों से मुक्त, गेल (इण्डिया) लिमिटेड में निहित होगा।

S.O. 1754.—Whereas by the notification of Government of India in Ministry of Petroleum and Natural Gas published vide S.O No: 1608 (E) Dated 28.03.2023 issued under sub- section (1) of section 3 of the Petroleum and Minerals Pipeline ( Acquisition of Right of Users in Land ) Act, 1962 (50 of 1962) (hereinafter referred to as the said Act), Government of India declared its intention to acquire the Right of User in the land specified in the Schedule appended to that notification for the purpose of laying pipeline for transportation of natural gas through Jagdishpur – Haldia – Bokaro – Dhamra Pipeline (JHBDPL) & Spur Pipeline in the State of West Bengal by GAIL (India) Limited;
And whereas copies of the said Gazette notification were made available to the public;
And, whereas the Competent Authority has, under sub-section (1) of Section 6 of the said Act, submitted his report to Government of India;
And whereas Government of India after considering the said report and on being satisfied that the said land is required for laying the pipelines, has decided to acquire the Right of User therein;
Now, therefore, in exercise of the powers conferred by sub-section (1) of section 6 of the said Act, Government of India hereby declares that the Right of User in the land specified in the Schedule appended to this notification is hereby acquired for laying the pipeline;
And, further, in exercise of the powers conferred by sub-section (4) of Section 6 of the said Act, Government of India hereby directs that the Right of User in the land for laying the pipeline shall, instead of vesting in Government of India, vest, on this date of the publication of the declaration, in the GAIL (India) Limited, free from all encumbrances.

AWARD
The Government of India in the Ministry of Labour & Employment, New Delhi have referred the present dispute existing between the employers in relation to the Management of Bharat Petroleum Corporation Ltd., and their workmen at LPG Plant of M/s. BPCL, Khurda represented through Bharat Petroleum Corporation Ltd., Employees Union under Clause (d) of Sub-Section (1) and Sub-Section (2A) of Section 10 of the Industrial Dispute Act, 1947 (14 of 1947) vide their order No. L-30011/11/2016-IR(M) dated 13.6.2016 to this Tribunal for adjudication to the following effect.
SCHEDULE
"Whether the demand of the union to bear the expenditure on labour cost by the management
of Khurda LPG Plant of M/s BPCL towards running the canteen in the establishment in stead of
revising the canteen subsidy amount to Rs. 1600/- p.m. per employee is legal and/or justified. If so,
what relief the employees of the union are entitled to?"
2. After receipt of the schedule of reference and the Statement of Claim filed by the 2nd Party-Union notice was issued to the 1st Party-Managements for filing of their Written Statements to which the 1st Party-Managements have duly filed during course of adjudication.
3. The 2nd Party-Union in its Statement of Claim has raised objections against the introduction of canteen cafeteria facility instead of the practice of canteen subsidy extended to the regular employees of the Management at its LPG Plant, Khurda and prayed to declare the action of the Management as illegal and violative of applicable statutes / law, etc.
4. On the other hand, the 1st Party-Managements in their Written Statement inter-alia have tried to justify their action of introducing the provisions of canteen cafeteria facility in place of the existing canteen subsidy extended to the regular employees at their LPG Plant, Khurda and denied all the allegations made by the 2nd Party-Union in their Statement of Claim.
5. However, during the course of adjudication, both the parties have settled the present dispute out of court and filed original copy of their Memorandum of Settlement in Form – H containing 02 (two) numbers of terms and conditions as agreed between them in this dispute. Submitting their Memorandum of Settlement, both parties have prayed the Tribunal to close this case in terms of the settlement arrived at between them. The terms of Memorandum of Settlement executed between Shri Girish Sonawane, Territory Manager (LPG), M/s. BPCL, Khurda and Shri Ramesh Nayak, Authorised Representative of the 2nd Party-Union are as under.
"1. That pursuant to the execution of agreement on wages and other matters with 1st party M/s. Bharat Petroleum Corporation Ltd on 28.3.2023, the 2nd party has settled the disputes with the Management under the settlement and accordingly the 2nd party union does not want to proceed further with the present case.
2. That it is further agreed between the parties to submit the Memorandum of Settlement before the Presiding Officer, Central Govt. Labour Court, Bhubaneswar in I.D. Case No. 35 of 2016 as a measure of mutual settlement."
6. Considering the facts and circumstance and the submissions of the stake holders of this case, the Tribunal is of the opinion that whatever dispute was existing between the 1st Party-Management and the 2nd Party-Union, the same have already been settled and no further adjudication is required under the Act. Hence this award is passed in terms of the Memorandum of Settlement arrived at between the 1st Party-Management and the 2nd Party-Union. The Memorandum of Settlement filed by the parties in this case forms part of the award.

By order No. L-31011/7/2006 (IR(B-II)) dated 13.09.2006, the Central Government, Ministry of Labour in exercise of the power conferred under section 10(1)(d) and (2A) of the Industrial Disputes Act, 1947 has referred the following issues to this Tribunal for adjudication.
"Whether the action of the management of M/s. ATC (Clearing & Shipping) Pvt. Ltd., Mumbai in imposing the punishment of dismissal from services of Shri Jeevan Pawar w.e.f. 21.10.2005 is justified? If not, what relief the workman Shri Jeevan Pawar is entitled to?"
The facts giving rise to the reference in brief are that the concerned workman was appointed as Clerk in the establishment of M/s. ATC (Clearing & Shipping) Pvt. Ltd., Mumbai in the year 1981. In due course, he was promoted as a Sr. Clerk.
That sometime in the year 2005, he was placed under suspension for committing misconduct of misappropriation of the funds of the Company. Later, he was charge sheeted for committing misconduct under clause 22(a), 22(d) and 22(i) of Model Standing Order framed under the Industrial Employment Standing Order Act, 1946 on 24.03.2005 i.e. for inflating bills of mobile phone sets worth Rs.5,800/- and Rs.7150/- as Rs.15,800/- and Rs.17,150/-, purchased for official use from Coral Trading Company and M/s. Om Sai Electronics and Gift Articles, Santacruz and thereby misappropriating a sum of Rs.20,000/- and which was corroborated by Mr. Salim & Mr. Javed, the suppliers of those two mobile sets.

Inquiry Officer considering both oral and documentary evidence which were produced before him, found the concerned workman guilty to the charges. The disciplinary authority concurring with the finding of the Inquiry Officer proposed punishment of 'removal from service'. Accordingly, the concerned workman was terminated from the services w.e.f. 21.10.2005.
Challenging the order of dismissal of service, the concerned workman raised an industrial dispute before the appropriate authority and who in turn referred the matter to this tribunal for adjudication.
Record shows the predecessor of this tribunal passed a preliminary award on 01.02.2013 holding the domestic enquiry conducted by the employer / management of M/s. ATC (Clearing & Shipping) Pvt. Ltd., Mumbai against the concerned workman not to be fair and proper and findings given by the Inquiry Officer to be totally perverse. Therefore, in view of provisions of section 11A of the I.D. Act, extended the management / employer to prove the charge against the concerned workman by adducing further evidence.
The management / employer challenged the preliminary award dated 01.02.2013 before the Hon'ble High Court of Bombay and filed the writ petition No. 7386 / 2013. The Hon'ble High Court of Bombay affirmed the preliminary award dated 01.02.2013 and dismissed the writ petition.
The management in order to prove the charge which it has brought against the concerned workman for misappropriation of Rs.20,000/- by inflating the bills of two mobile sets examined its following officials / staff:-
1. Shri Prashant Sharad Moghe, its Manager who was working as Dy. Manager [A/cs. Dept.] in the year 2005,
2. Shri Girish Achut Gadre, Chief Manager [A/cs.],
3. Shri Ganesh Narayan Karandikar, Head of Export Dept. of the management and
4. Shri Arvind Krishanji Kunte, ex-employee of the company.
Now, let me see whether the management of the employer has been able to prove the charge that has been brought against the concerned workman.
The charge sheet dated 24.03.2005 shows that while conducting statutory audit by M/s. H.T. Patel and Company, Chartered Accountant engaged by the employer for the financial year 2004 – 2005, it was found certain mobile phones were purchased for use of the staff and for making gift to the guest of the organization and bills raised to be doubtful. On queries, it was reported by Shri Prashant Sharad Moghe that a mobile set worth Rs.15,800/- was purchased by the company for use of Mr. Somesh Vaidya, Custom Clerk and invoice for the purchase of such mobile was sanctioned by Mr. Navroz, Administrative Manager. Mr. Navroz on queries informed Mr. Moghe mobile set worth Rs.5,800/- was actually purchased for use of Mr. S. Vaidya. It was found that said mobile phone was purchased from M/s. Coral Trading Company vide Invoice No. 93 EB.
It has been alleged in the charge sheet, the concerned workman was the one who wrote the price of mobile set as Rs.15,800/- in place of Rs.5,800/- and wrote and drew a cheque worth Rs.15,800/- in favour of M/s. Coral Trading Company. That management called Mr. Salim and Mr. Javed two representatives of M/s. Coral Trading Company to clarify on the matter and who informed Mr. Navroz, that they were influenced by the concerned workman to alter the amount by adding certain figures on invoice. Mr. Javed furnished a written statement to that effect before Mr. A.K. Kunte, Dy. Manager of the company on 25.02.2005.
It further shows that another mobile phone set of Nokia was purchased from M/s. Om Sai Electronics and Gift Articles, situated at 212, Hanuman Bldg., Vakola, Santacruz [East], Mumbai – 400 055. The said set was supplied by Mr. Javed and Mr. Salim through bill No. 394 dated 09.04.2004. The actual price of the said set was Rs.7150/- but the concerned workman by influencing Mr. Salim and Mr. Javed altered the bill for Rs.17,150/- and managed to issue cheque No. 673059 dated 19.10.2004 drawn on Corporation Bank, Fort branch and thereby managed to misappropriate Rs.10,000/- by influencing Mr. Salim and Mr. Javed.
Therefore, the management considering the above conduct of the concerned workman to be grave in nature causing financial loss to the establishment by practicing fraud for his own financial gain charge sheeted him under clause 22 (a), 22(d) and 22(i) of Model Standing Order, framed under the Industrial Employment Standing Order Act, 1946 on 24.03.2005.
Shri Prashant Sharad Moghe in his evidence in chief on affidavit stated that being Dy. Management [A/cs. Dept.] he used to work as an Internal Auditor though the company had engaged M/s. H.T. Patel & Co. Chartered Accountant as its statutory auditor. That during the internal audit and on scrutiny of mobile purchased bills, he found Bill No. 394:93EV:50:46A doubtful as amount mentioned in those bills being altered. He has further stated that the amount mentioned in those 4 bills was much more than the actual price of purchased mobile phone sets. He has also stated that different pens with different colours of ink being used in the preparation of those 4 bills. He found that figure '1' being written in different colour of ink in those bills. He questioned Shri Ganesh Narayan Karandikar and[भाग II—खण्ड 3(ii)] भारत का राजपत्र : नवम्बर 11, 2023/कार्तिक 20, 1945 4043 Mr. Navroz Langrana, the two persons who had sanctioned and approved those bills and who have stated alteration in those two bills.
He has stated that he was informed by Mr. Navroz Langrana that he sanctioned bill for Rs.5,800/- and not for Rs.15,800/- against the purchase of mobile set. Then he submitted his Internal Audit Report to Shri Girish Achut Gadre, Chief Manager [A/cs.] for further action along with copies of bills.
He has also stated that at the relevant time the concerned workman Shri Jeevan Pawar was working as a Sr. Clerk in A/cs. Dept. and who has to make entries of the approved bills in the books of accounts and based on which payments used to be released. It was the duty of Mr. Jeevan Pawar to issue cheques to the parties after approval.
But, during cross examination, he has admitted that during the internal audit he did not notice any discrepancy in the bills before the statutory audit. He was unable to say the models and price of those mobile phones that were purchased under those two disputed bills.
He further admitted that no charge was brought against the concerned workman for over writing or causing alteration in the bills. That he is not a hand writing expert and he has no authority to certify the difference of colour in the ink. He has also admitted that when he examined those disputed bills, the amounts on the disputed bills were written in words. There was no discrepancy in the amounts written in figures and in words in those disputed bills. He has also admitted in his internal audit report submitted before Shri Girish Achut Gadre, he did not brought any allegation against the concerned workman for alteration in those disputed bills.
Therefore, such evidence of Shri Prashant Sharad Moghe made during cross examination totally discredit what he has stated against the concerned workman in his evidence in chief on affidavit. Infact, his admission creates a doubt about the allegations and charge that have been brought against the concerned workman and prove the charges that have been brought against the concerned workman was / is not proper and supported by any documentary evidence.
Similarly, Shri Girish Achut Gadre, Chief Manager [A/cs.] in his evidence in chief has stated that on receiving report from Shri Prashant Sharad Moghe Dy. Manager [A/cs.], he called for comments from Shri Ganesh Narayan Karandikar and Mr. Navroz Langrana about the discrepancy in the disputed bills which they had sanctioned and approved. He has stated that Mr. Navroz Langrana used to verify the product with the bills and used to hand over the set to the concerned workman for whom the mobile phone was ordered. He has also stated that Mr. Navroz Langrana informed him many times the column meant for mentioning amounts in words in the invoice / bill used to be left blank as price mentioned on the mobile cover box used to match with the amount mentioned in the figure in the bills. Mr. Navroz Langrana used to ignore such blank column while sanctioning and approving the bill.
That he reported such incidence to his senior Mr. Shantanu S. Bhadkamka, M.D. and who directed him to investigate and initiate the disciplinary action against the culprit.
That he called Mr. Javed, the supplier of the mobile phone and Mr. Javed in presence of Mr. A.K. Kunte, Sr. Dy. Manager admitted inflating the bills at the instance of concerned workman and Mr. Javed gave his statement in writing. Therefore, he on the basis of the written statement of Mr. Javed, initiated disciplinary action against concerned workman as per the directions of Mr. Shantanu s. Bhadkamka, M.D. and placed the workman under suspension on 25.02.2005. Then enquiry was started against the workman. Mr. Javed was noticed during the departmental enquiry but who refused to appear, rather he brought a false allegation against the company for putting pressure on him for giving false statement against the workman in writing.
He has also stated at the relevant time the concerned workman was working as a Sr. Clerk in A/cs. Dept. and whose duty was to make entries of approved bills in books of accounts and on the basis of which payment used to be released after his approval. It was the duty of concerned workman to issue cheque to the parties after approval. Further, he during his examination in chief under oath before the tribunal he has proved the charge sheet, suspension order, disputed bills etc.
However, during the cross examination he has admitted that he has not charge sheeted or brought any charge against the concerned workman for modification and fabrication of disputed mobile bills. Further, he has admitted that he acted on the report of Mr. Moghe, Dy. Manager [A/cs.] and who reported that there was alteration and modification in the mobile bills. But Shri Prashant Sharad Moghe in his cross examination discussed above admitted that he did not notice any discrepancy in the bills and did not find any discrepancy in between written figures and amount written in the words in those disputed bills.
He has further admitted that Mr. Jeevan Pawar, the concerned workman has no authority to sign on the cheque for payment of bills. That bills are also produced before the concerned officer who signed the cheque. The cheque is prepared and signed after the bill is approved by the concerned officer. He has further admitted in his cross examination that Shri Ganesh Narayan Karandikar and Mr. Navroz Langrana were the approving and sanctioning authorities of those disputed bills. The concerned workman used to prepare the cheques on the basis of approved bills4044 THE GAZETTE OF INDIA : NOVEMBER 11, 2023/KARTIKA 20, 1945 [PART II—SEC. 3(ii)] signed by Shri Ganesh Narayan Karandikar and Mr. Navroz Langrana. He has further admitted that he and Mr. Lagoo, the joint authorized signatories signed on those disputed cheques issued against disputed bills. At the time of signing the cheque, the amount mentioned therein was rechecked and re-verified with the relevant invoices.
Therefore, from cross examination of this witness it is seen that Shri Ganesh Narayan Karandikar and Mr. Navroz Langrana were approving and sanctioning authorities of the disputed bills and not the concerned workman.
He has further admitted during cross examination that Mr. Javed through his letters dated 05.07.2005 and 13.07.2005 brought allegations against him for coercing him to give statement before Mr. A.K. Kunte, Sr. Dy. Manager on 25.02.2005, otherwise his other pending bills would be withheld. Such statement further makes the allegation that the concerned workman had influenced Mr. Javed, the vendor to inflate the disputed mobile bills appears to be doubtful.
From the evidence of Shri Girish Achut Gadre, it appears that it is he and Mr. Lagoo were the authorized signatories of the cheque and not the concerned workman at the relevant time. Further, it is seen Shri Ganesh Narayan Karandikar and Mr. Navroz Langrana were the two officials, who were responsible to approve the bills and check the invoices and it was not the concerned workman. So it is not known how this concerned workman who was neither the approving authority of the bills nor the signatory of the cheque could manipulate the dispued bills and invoices.
Thus, from the evidence of Shri Prashant Sharad Moghe and Shri Girish Achut Gadre, it appears that after the approval of bills and invoices by Shri Ganesh Narayan Karandikar and Mr. Navroz Langrana, cheque was prepared and signed by Shri Girish Achut Gadre and Mr. Lagoo, the joint signatories and who too before putting their signatures on the cheques used to verify and check the invoices.
The management has also examined Shri Ganesh Narayan Karandikar. He in his evidence in chief on affidavit stated that the establishment used to buy mobile sets for official purpose from M/s. Om Sai Electronics and Gift Articles, Santacruz [East], Mumbai – 400 055. Mr. Javed, the Proprietor of M/s. Om Sai Electronics and Gift Articles, Santacruz, used to personally deliver the mobile set along with bills to him. That Mr. Javed submitted the bill for Rs.7150/- for the mobile set. That he took the delivery of mobile set and signed on the bill having an amount of Rs.7150/- and at that time Mr. Navroz Langrana was the administration in-charge was present. He never received or approved any bill against the said mobile phone for Rs.17150/-. Later he was enquired about the bill by Shri Prashant Sharad Moghe and he was shocked to find that the bill was for Rs.17,150/- instead of Rs.7150/-.
However, during his cross examination he has stated that in the bill there is a column for writing amount in words or letters that he did not ask Mr. Javed to fill the said blank column and that he approved the bill leaving the said column blank, but at the same time he has admitted that he did mention in his report that there was alteration or modification in the bills and did not state that such modification and alteration was done by the concerned workman. He has stated it is the duty of the concerned workman to prepare cheque and present the same before the signatories for signatures.
Shri Arvind Krishanji Kunte, ex-employee of the management in his evidence in chief on affidavit stated that in his presence Mr. Javed admitted that out of 4 bills submitted by him he has altered 2 bills bearing No. 394 and 93EV as per the instructions of the concerned workman who was in need of money. That Mr. Javed further admitted that he handed over the inflated the amount of Rs.20,000/- against those two disputed bills to concerned workman Shri Jeevan Pawar. He has stated that he obtained the statement of Mr. Javed without any coercion and under duress.
Surprisingly, this witness during his cross examination admitted there is line of signature of the approving authority on the amount written in words on those bills. So a question may arise, then how there can be manipulation in the column meant for writing the amount in words / letters, when the signature of approving authority appears over the amounts written in words. His such evidence further makes the statement given by Mr. Moghe and Mr. Gadre that column meant for writing the amount of bill in words were always kept blank doubtful. Further, this witness has admitted that Mr. Javed had filed an application alleging he had obtained his statement incriminating the concerned workman for inflating the bills under pressure and under coercion.
It is very interesting to note the management for reason best known to it has failed to produce the main witness Mr. Javed on whose statement recorded by Mr. Kunte, the management has acted and put the concerned workman under suspension and thereafter charge sheeted him. In order to prove incriminatory statement given by Mr. Javed against the concerned workman, the management ought to have produced him and prove his incriminating statement given against the workman before the tribunal and which the management has failed to do so. Therefore, in the eyes of law the uncorroborated incriminating statement of Mr. Javed is of no value and cannot be used against the concerned workman.
Further, the management for reason best known to it has failed to produce and examine Mr. Navroz Langrana, a vital witness to this case.
Therefore, in view of the evidence of the above four witnesses of the management and as discussed leaves no room for doubt the management has failed to bring home charge of manipulation of bills and thereby misappropriation of Rs. 20,000/- against the concerned workman beyond preponderance of probability.
[भाग II—खण्ड 3(ii)] भारत का राजपत्र : नवम्बर 11, 2023/कार्तिक 20, 1945 4045Infact, it appears that management of ATC (Clearing & Shipping) Pvt. Ltd. and especially Shri Girish Achut Gadre in order to save the high rank officers, the real culprits who were involved or indulged in the scam of looting the company financially by preparing inflated bills during audit appears to have made a Sr. Clerk Mr. Pawar a scapegoat. The concerned workman appears to have been victimized by the management and a victim of unfair labour practices probably to save its official namely Shri Ganesh Narayan Karandikar and Mr. Navroz Langrana, the two officials who were responsible in approving those disputed bills and Mr. Girish Achut Gadre and Mr. Lagoo, the two signatories of the cheques.
Therefore, this tribunal holds the management has failed to prove the charge of misappropriation against the concerned workman beyond preponderance of probabilities. Consequentially the order of dismissal of Shri Jeevan Pawar, Sr. Clerk w.e.f. 21.10.2005 is held to be illegal.
It has come on record the concerned workman was 63 years old on 06.01.2020, the day he gave evidence before this tribunal. Therefore, it appears he has already been superannuated from the service on his attaining the age of superannuation either at the age of 58 years or at the age of 60 years, whichever is applicable to him. Therefore, the question of his reinstatement in service does not arise, but he is entitled to get full back wages from the day he was placed under suspension i.e. on 25.02.2005 till his superannuation from the service. He is further entitled to get all the service benefits to which a retired employee of ATC (Clearing and Shipping) Pvt. Ltd. is entitled to i.e. pension, gratuity, leave encashment, P.F. and other statutory entitlements.
Management of ATC (Clearing and Shipping) Pvt. Ltd. is hereby directed to pay all the entire back wages along with interest @ 12% p.a. along with pensionary benefits to the concerned workman within six months from the date hereof failing which the concerned workman shall be entitled to recover or realise the same as per rules and laws.
Accordingly, a final award is hereby passed in favour of Shri Jeevan S. Pawar, a Sr. Clerk holding his termination to be illegal. Reference No. CGIT-1 / 31 of 2006 is hereby disposed of.
