पर्यावरण, वन और जलवायु परिवर्तन मंत्रालय

सं. 3-19/2022-SU—जबकि भारत सरकार, देश में दायित्वपूर्ण काष्ठ उत्पादन और उपभोग को प्रोत्साहित करने के उद्देश्य से संधारणीय वन प्रबंधन और कृ षि वानिकी को बढ़ावा देने के लिए एक स्वैच्छिक, बाजार-आधारित, तृतीय-पक्षकार द्वारा प्रमाणन पहल के रूप में भारतीय वन और काष्ठ प्रमाणन स्कीम संबंधी दिशानिर्देश जारी किए हैं;

और भारत सरकार ने राष्ट्रीय कार्य योजना संहिता, 2023 जारी की है, जिसमें देश भर के सभी वन प्रभागों में कार्य योजनाएं तैयार करने के लिए एक मार्गदर्शक दस्तावेज के रूप में संधारणीय वन प्रबंधन के सिद्धांतों का पालन किया जाता है;

और राष्ट्रीय कार्य योजना संहिता, 2023 में भारतीय वन प्रबंधन मानक को निगरानी के लिए आधार के रूप में शामिल किया गया है तथा पर्यावरणीय, आर्थिक और सामाजिक उद्देश्यों को समाविष्ट करते हुए वनों के बहु-आयामी लक्ष्यों को पहचानते हुए मानदंडों, संके तकों और सत्यापनकर्ताओं के समग्र कार्यढांचे के संदर्भ में संधारणीय वन प्रबंधन संबंधी दिशानिर्देश निर्धारित किए गए हैं। संधारणीय वन प्रबंधन संबंधी यह मानक, भारत में वैज्ञानिक वन प्रबंधन में दीर्घकालिक और व्यापक अनुभव पर आधारित है तथा मानदंडों और संके तकों की विकसित हो रही अंतरराष्ट्रीय प्रणालियों के अनुरूप है;

और भारतीय वन और काष्ठ प्रमाणन स्कीम में वन प्रबंधन प्रमाणन, वन के बाहर वृक्ष प्रमाणन और अभिरक्षा श्रृ ंखला प्रमाणन नामक घटक शामिल होंगे;

इसलिए, कें द्रीय सरकार एतदद्वारा भारतीय वन और काष्ठ प्रमाणन स्कीम के कार्यान्वयन हेतु मार्गदर्शन और निगरानी करने के लिए भारतीय वन और काष्ठ प्रमाणन परिषद की स्थापना करती है :—

1. भारतीय वन और काष्ठ प्रमाणन परिषद में निम्नलिखित सदस्य होंगे :

2. भारतीय वन और काष्ठ प्रमाणन परिषद निम्नलिखित कार्यों के लिए उत्तरदायी होगी :

क. एक उपयुक्त संगठनात्मक संरचना और शासन कार्यतंत्र के माध्यम से भारतीय वन और काष्ठ प्रमाणन स्कीम के संचालन और प्रशासन का समग्र उत्तरदायित्व।

ख. मानक अंगीकरण समिति, जो एक बहु-हितधारक परामर्शी प्रक्रिया का पालन करेगी, की संस्तुति पर वन प्रबंधन प्रमाणन, वन के बाहर वृक्ष प्रमाणन और अभिरक्षा श्रृ ंखला प्रमाणन से युक्त प्रमाणन संबंधी मानकों का अनुमोदन।

ग. प्रमाणन मानकों, प्रमाणन प्रक्रियाओं आदि के संबंध में सलाह देने और संस्तुति करने के लिए तकनीकी समितियों का गठन।

घ. वन प्रबंधन प्रमाणन, वन के बाहर वृक्ष प्रमाणन और अभिरक्षा श्रृ ंखला प्रमाणन के लिए प्रमाणन प्रक्रिया का अनुमोदन।

ङ. संधारणीय वन प्रबंधन, वन के बाहर वृक्ष संबंधी प्रबंधन और अभिरक्षा श्रृ ंखला में संगत विशेषज्ञता रखने वाली प्रमाणन निकायों के प्रत्यायन का अनुमोदन तथा प्रमाणन निकायों और लेखा परीक्षकों के लिए अपेक्षाएं और मानक निर्धारित करना।

च. स्कीम के तहत प्रमाणपत्र धारकों को प्रमाणन, नवीकरण, ट्रेडमार्क उपयोग एवं लाइसेंस जारी करने का प्रबंधन और निगरानी।

छ. भारतीय वन और काष्ठ प्रमाणन स्कीम के अनुसार प्रमाणन निकायों के अनुपालन की समीक्षा करना और अनुपालन न करने पर प्रत्यायन के निलंबन या रद्द करने सहित समुचित कार्रवाई करना।

3. इस स्कीम को निर्दिष्ट स्कीम प्रचालन अभिकरण के रूप में भारतीय वन प्रबंध संस्थान, भोपाल द्वारा संचालित किया जाएगा।

5. और जबकि, माननीय न्यायालय के आदेशों का पालन करते हुए, जैन सम विश्वविद्यालय, बेंगलुरु द्वारा अधिकृ त संयुक्त रजिस्ट्रार ने अपने दिनांक 31.03.2023 के लिखित अभ्यावेदन के माध्यम से सचिव (एचई) के समक्ष निवेदन किया।

6. और जबकि, जब तक यह मामला मंत्रालय में विचाराधीन था, यूजीसी ने पूर्ववर्ती यूजीसी विनियम, 2019 के अधिक्रमण में नए यूजीसी (सम विश्वविद्यालय संस्थान) विनियम, 2023 अधिसूचित किए। इसके अलावा, यूजीसी विनियम, 2023 के खंड 30.0 के अनुसार, सम विश्वविद्यालय ने एक शपथ पत्र प्रस्तुत किया जिसमें कहा गया कि उसके आवेदन पर यूजीसी विनियम, 2023 के अनुसार पुनर्विचार किया जा सकता है। तदनुसार, यूजीसी से अनुरोध किया गया था कि वह यूजीसी विनियम, 2023 के अनुसार मामले की जांच करे और इस मंत्रालय को अपनी सलाह प्रस्तुत करे।

7. और आगे जबकि, यूजीसी ने अपने पत्र संख्या 26-4/2019 (सीपीपी-आई/डीयू) दिनांक 15.11.2023 के माध्यम से सूचित किया कि विशेषज्ञ समिति द्वारा आवेदन की जांच की गई है। समिति द्वारा कु छेक कमियों की ओर इशारा करते हुए, अन्य बातों के साथ-साथ सिफारिश की गई कि यूजीसी शिक्षा मंत्रालय को सलाह दे सकती है कि "कोच्चि में जैन (समविश्वविद्यालय) के ऑफ-कैं पस की कार्योत्तर मंजूरी और 2019-20 बैच में प्रवेशित छात्रों को प्रदान की जाने वाली डिग्रियों की मान्यता पर के वल तभी विचार किया जा सकता है यदि संस्थान उपयु र्क्त कमियों को दूर करता है"। आयोग ने यूजीसी विशेषज्ञ समिति की रिपोर्ट पर विचार किया और दिनांक 03.11.2023 को आयोजित अपनी 574वीं बैठक (मद संख्या 2.15) में सिफारिशों को मंजूरी दी।

8. और जबकि, जैन समविश्वविद्यालय ने पत्र संख्या जेयू/जेआर/एसओ-1/कोच्चि-कैं पस/2023/268 दिनांक 23.11.2023 के माध्यम से यूजीसी विशेषज्ञ समिति द्वारा बताई गई कमियों को सुधारते हुए इस मंत्रालय को अनुपालन रिपोर्ट प्रस्तुत की।

9. अब, इसलिए, यूजीसी अधिनियम, 1956 की धारा 3 के तहत प्रदत्त शक्तियों का प्रयोग करते हुए, कें द्र सरकार, यूजीसी की सलाह पर एतदद्वारा जैन समविश्वविद्यालय, बैंगलोर, कर्नाटक को शैक्षणिक वर्ष 2019-20 बैच में कोच्चि परिसर में प्रवेशित छात्रों की डिग्री को विधिवत मान्यता प्रदान करते हुए कोच्चि, के रल में ऑफ-कैं पस सेंटर शुरू करने के लिए कार्योत्तर मंजूरी प्रदान करती है। यह अनुमोदन निम्नलिखित शर्तों के अध्यधीन होगा:

i. समविश्वविद्यालय समय-समय पर यूजीसी द्वारा जारी दिशानिर्देशों के अनुरूप अपने पाठ्यक्रम और क्रे डिट संरचना का निर्माण करेगा, ताकि भविष्य में शिक्षा और प्रदान की जाने वाली डिग्री के मानक को बनाए रखा जा सके ।

ii. समविश्वविद्यालय यूजीसी द्वारा अनुमोदित परिभाषा के अनुसार 'क्रे डिट' शब्द परिभाषित करेगा।

iii. समविश्वविद्यालय यूजीसी के मानदंडों और मानकों के अनुसार कोच्चि परिसर में खेल का मैदान, कैं टीन, स्वास्थ्य कें द्र इत्यादि जैसी कतिपय सुविधाओं में वृद्धि करेगा।

iv. समविश्वविद्यालय को उक्त पैराग्राफ 8 में संदर्भित अपनी अनुपालन रिपोर्ट दिनांक 23 नवंबर 2023 यूजीसी द्वारा समयबद्ध तरीके से सत्यापित करानी होगी।

10. इस मंत्रालय की पिछली अधिसूचना (ओं) के साथ-साथ समय-समय पर जारी यूजीसी और अन्य सांविधिक परिषदों के नियमों/विनियमों में उल्लिखित अन्य सभी शर्तों का 'जैन', बैंगलोर, कर्नाटक द्वारा लगातार पालन किया जाता रहेगा।

MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE

New Delhi, the 12th December 2023

No. 3-19/2022-SU—WHEREAS the Government of India has released the guidelines for the Indian Forest and Wood Certification Scheme as a voluntary, market-based, third-party certification initiative to promote sustainable forest management and agroforestry, aiming to incentivize responsible wood production and consumption in the country;

AND WHEREAS the Government of India has released the National Working Plan Code 2023, which follows the principles of Sustainable Forest Management as a guiding document for the preparation of working plans in all forest divisions across the country;

AND WHEREAS the National Working Plan Code, 2023 incorporates the Indian Forest Management Standard as a basis for monitoring and provides guidelines for sustainable forest management, in terms of comprehensive framework of criteria, indicators, and verifiers, recognizing the multi-dimensional goals of forests, encompassing environmental, economic and social objectives. The standard for sustainable forest management is based on long term and extensive experience in scientific forest management in India and aligns with evolving international systems of criteria and indicators;

AND WHEREAS the Indian Forest and Wood Certification Scheme shall include components namely Forest Management Certification, Trees outside Forest Certification and Chain of Custody Certification;

NOW THEREFORE, the Central Government hereby establishes the Indian Forest and Wood Certification Council for guiding and monitoring the implementation of the Indian Forest and Wood Certification Scheme: -

1. Indian Forest and Wood Certification Council shall comprise of the following members:

2. Indian Forest and Wood Certification Council shall be responsible for the following functions

a. Overall responsibility of governance and administration of the Indian Forest and Wood Certification Scheme through an appropriate organizational structure and governance mechanism.

b. Approval of Certification Standards comprising Forest Management Certification, Trees Outside Forests Certification, and Chain of Custody Certification on the recommendation of standard adoption committee, which will follow a multi-stakeholder consultative process.

c. Constitution of technical committees for advising and recommending certification standards, certification processes etc.

d. Approval of certification process for Forest Management Certification, Trees Outside Forests Certification, and Chain of Custody Certification.

e. Approval of accreditation of Certification Bodies having relevant expertise in Sustainable Forest Management, Trees Outside Forests management and Chain of Custody and setting requirements and standards for certification bodies and auditors.

f. Managing and monitoring the issuance of certification, renewals, trademarks usage, licenses to certificate holders under the scheme.

g. Review the compliance of the Certification Bodies as per the Indian Forest and Wood Certification Scheme and take appropriate action including suspension or cancellation of accreditation, for non-compliance.

3. The Scheme shall be operated by the Indian Institute of Forest Management, Bhopal as the designated Scheme Operating Agency.

No. 10/6/2019-U3(A)—Whereas, Jain (Deemed to be University), Bengaluru, Karnataka had submitted an application on 20th August, 2019 for starting its Off-Campus Centre at Kochi from the academic year 2019-20.

2. And whereas, the application of Jain Deemed to be University was examined by UGC through its Expert Committees in accordance with UGC (Institutions Deemed to be Universities) Regulations, 2019. Further, the Commission considered the reports of UGC Expert Visiting Committee and UGC Compliance Verification Committee in its 547th meeting held on 29.05.2020 and resolved that "the Commission considered the report of the UGC Expert Visiting Committee and decide to recommend to MHRD for off-campus centre at Kochi by Jain (Deemed to be University), Bengaluru, subject to the condition that Deemed to be University shall fulfil all the conditions stipulated in the UGC (Institutions Deemed to be Universities) Regulations, 2019 with regard to off-campus at Kochi."

3. And whereas, the recommendation of UGC was examined in the Ministry in accordance with the UGC Regulations, 2019 and proposal of Jain (Deemed to be University), Karnataka to start an Off-Campus at Kochi was rejected vide this Ministry's Order No.10/6/2019-U3(A) dated 21.09.2022 on the ground that the recommendation of UGC dated 29.05.2020 lacks legal sanctity of its own regulations.

4. And further whereas, the rejection Order dated 21.09.2022 of this Ministry was challenged by the Deemed to be University in the Hon'ble High Court of Kerala by Writ Petition (Civil) No.31538 of 2022. The Hon'ble Court, vide Order dated 13.10.2022, allowed the above WP and set aside this Ministry's order dated 21.09.2022 with a consequential direction to the competent authority of the Government of India to reconsider the petitioner's request, after affording them an opportunity of being heard and pass an appropriate order within a period of four months from the date of receipt of a copy of judgment.

5. And whereas, following to the Orders of Hon'ble Court, Joint Registrar authorized by Jain Deemed to be University, Bangalore made submissions before the Secretary (HE) through his written representation dated 31.03.2023.

6. And whereas, while the matter was under consideration in the Ministry, UGC notified the new UGC (Institutions Deemed to be Universities) Regulations, 2023 in supersession of earlier UGC Regulations, 2019. Further, as per Clause 30.0 of the UGC Regulations, 2023, the Deemed to be University submitted an undertaking stating that its application may be reconsidered as per the UGC Regulations, 2023. Accordingly, UGC was requested to examine the matter as per the UGC Regulations, 2023 and submit its advice to this Ministry.

7. And further whereas, UGC, vide its letter No.26-4/2019 (CPP-I/DU) dated 15.11.2023, informed that the application has been examined through an Expert Committee. The Committee, while pointing out certain shortcomings, inter- alia recommended that the UGC may advise the Ministry of Education that "the ex-post facto approval of the off-campus of the Jain (Deemed to be University) at Kochi and validation of the degrees awarded to the students admitted in 2019-20 batch only may be considered if it rectifies the above-mentioned deficiencies". The Commission considered the report of the UGC Expert Committee and approved the recommendations in its 574th meeting (Item No.2.15) held on 03.11.2023.

8. And whereas, the Jain Deemed to be University, vide letter No. JU/JR/SO-1/Kochi-Campus/2023/268 dated 23.11.2023, submitted compliance report to this Ministry rectifying the deficiencies pointed out by the UGC Expert Committee.

9. Now, therefore, in exercise of the powers conferred under Section 3 of the UGC Act, 1956, the Central Government, on the advice of UGC, hereby accords ex-post facto approval to Jain Deemed to be University, Bangalore, Karnataka for680 THE GAZETTE OF INDIA, DECEMBER 16, 2023 (AGRAHAYANA 25, 1945) [PART I—Sec.1 starting Off-Campus Centre at Kochi, Kerala duly validating the degrees of the students admitted in Kochi Campus in Academic Year 2019-20 batch. This approval shall be subject to the following conditions:

i. The Deemed to be University shall align its course curriculum and credit structure in consonance with the Guidelines issued by the UGC, from time to time, so as to maintain the standard of education and degree to be awarded in the future.

ii. The Deemed to be University shall align the term 'credit' in accordance with the definition approved by the UGC.

iii. The Deemed to be University shall augment certain facilities such as playground, canteen, health centre, etc. at Kochi Campus as per the norms and standards of UGC.

iv. The Deemed to be University shall get their compliance report dated 23rd November 2023, referred at paragraph 8 above, verified by the UGC in a time bound manner.

10. All other conditions mentioned in the earlier Notification(s) of this Ministry as well as the Rules / Regulations of UGC and other Statutory Councils, issued from time to time, shall continue to be adhered by 'Jain', Bangalore, Karnataka.
