आ.अ. 162.—यतः, उत्तराखण्ड राज्य की 49-सल्ट विधान सभा क्षेत्र के साधारण निर्वाचन, 2022 अधिसूचना नं. 464/उत्तरा0-वि0स0/2022 दिनांक 21.01.2022 के जरिए की गई थी।

यतःलोक प्रतिनिधित्व अधिनियम, 1951 की धारा 78 के अनुसार, निर्वाचन लड़ने वाले प्रत्येक अभ्यर्थी को, निर्वाचित अभ्यर्थी के निर्वाचन की तारीख से 30 दिनों के भीतर निर्वाचन व्यय के अपने लेखे की सही प्रति जिला निर्वाचन अधिकारी को दाखिल करनी होती है; और

यतः 49-सल्ट विधान सभा निर्वाचन क्षेत्र के रिर्टनंिग अधिकारी द्वारा उक्त निर्वाचन का परिणाम10मार्च, 2022 को घोषित किया गया था। इस प्रकार, निर्वाचन व्यय का लेखा दाखिल करने की अन्तिम तारीख 09 अप्रैल, 2022 थी; और यतः, जिला निर्वाचन अधिकारी, अल्मोङा, उत्तराखण्ड के द्वारा प्रस्तुत और मुख्य निर्वाचन अधिकारी, उत्तराखण्ड द्वारा पत्र सं. 2782/XXV-53/2022 देहरादून के जरिए अग्रेषित दिनांक 22/04/2022 की रिपोर्ट के अनुसार श्री भोले 7619 GI/2023

(391)392 THE GAZETTE OF INDIA : DECEMBER 23, 2023/PAUSHA 2, 1945 [PART II—SEC. 3(iii)] शंकर आर्या (एडवोके ट) जो उत्तराखण्ड विधान सभा का साधारण निर्वाचन 2022 के निर्वाचन क्षेत्र 49-सल्ट से लड़ने वाले अभ्यर्थी हैं, विधि द्वारा यथापेक्षित रीति से अपने निर्वाचन व्यय का कोई भी लेखा दाखिल करने में विफल रहे हैं; और,

यतः, निर्वाचनों का संचालन नियम 1961 के नियम 89 के उप-नियम (6) के अनुसार, दिनांक 20 अक्टूबर, 2022 के उपयु र्क्त कारण बताओ नोटिस के जरिए श्री भोले शंकर आर्या (एडवोके ट) को निदेश दिया गया था कि वे इस नोटिस के प्राप्त होने के 20 दिनों के अंदर लेखा न प्रस्तुत कर पाने के कारणों को स्पष्ट करते हुए लिखित रूप में अपना अभ्यावेदन प्रस्तुत करें और साथ ही, निर्वाचन व्यय का अपना लेखा दाखिल करें; और

यतः, जिला निर्वाचन अधिकारी, अल्मोङा द्वारा अपने दिनांक 16.02.2023 के पत्र संख्या 88/29-निर्वाचन व्यय लेखा (वि0स0सा0नि0-2022) के जरिए आयोग को सूचना दी गई की उक्त नोटिस अभ्यर्थी द्वारा दिनांक 17.11.2022 को प्राप्त किया गया था; और,

इसके अतिरिक्त उन्होंने भारत निर्वाचन आयोग का सम्यक् नोटिस मिलने के उपरांत भी उक्त विफलता के लिए न तो कोई कारण बताया है और न ही कोई स्पष्टीकरण दिया है;और,

यतः, आयोग का यह समाधान हो गया है कि श्री भोले शंकर आर्या (एडवोके ट) निर्वाचन खचों का लेखा दाखिल करने में विफल रहे हैं और उनके पास इस विफलता के लिए कोई भी उचित कारण अथवा औचित्य नहीं है; और

यत:, लोक प्रतिनिधित्व अधिनियम,1951 की धारा 10क में अनुबंधित किया गया है कि:-

"यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति -

(क) निर्वाचन व्ययों का लेखा उस समय के भीतर और उस रीति में जैसी इस अधिनियम के द्वारा या अधीन अपेक्षित है, दाखिल करने में असफल रहा है; तथा

(ख) उस असफलता के लिए कोई अच्छा कारण या न्यायोचित्य नहीं रखता है, तो निर्वाचन आयोग शासकीय राजपत्र में प्रकाशित आदेश द्वारा उसको निर्रर्हत घोषित करेगा और ऐसा व्यक्ति उस आदेश की तारीख से तीन वर्ष की कालावधि के लिए निर्रर्हत होगा;

अतः, अब लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अनुसरण में भारत निर्वाचन आयोग एतद्द्वारा घोषणा करता है कि उत्तराखण्ड राज्य के 49-सल्ट विधान सभा निर्वाचन क्षेत्र से उत्तराखण्ड राज्य में विधान सभा के साधारण निर्वाचन, 2022 में निर्वाचन लड़ने वाले अभ्यर्थी श्री भोले शंकर आर्या (एडवोके ट) निवासी पुत्र श्री साधो राम आर्या, ग्राम-नैकणा, पोस्ट ऑफिस-पैसिया, तहसील-सल्ट, जिला-अल्मोड़ा, को इस आदेश की तारीख से तीन वर्ष की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य-क्षेत्र की विधान सभा अथवा विधान परिषद् का सदस्य चुने जाने अथवा होने के लिए निर्रर्हत है।

O.N. 162.—WHEREAS, the General Election to 49-Salt Legislative Assembly of Uttarakhand, 2022 was held vide Notification No. 464/ Uttarakhand - LA /2022 dated 21st January, 2022.

WHEREAS, the result of the said election along with 49-Salt Assembly Constituency was declared by the concerned Returning Officer on 10th March, 2022. Hence, the last date for lodging the account of Election Expenses was 09th April, 2022; and,

WHEREAS, on the basis of the reports of the District Election Officer Almora, Uttarakhand and the Chief Electoral Officer, Uttarakhand, a Show-Cause notice, 76/ Uttarakhand -LA /2022/49/CEMS-III dated 20.10.2022 was issued under sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India to Sh. Bhole Shankar Arya (Advocate) for not lodging the account of Election Expenses; and,

WHEREAS, As per the sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, through the above said Show-Cause Notice, dated 20.10.2022, Sh. Bhole Shankar Arya (Advocate) was directed to submit his representation in writing with explaining the reasons for not lodging the account and to lodge account of election expenses within 20 days from the date of receipt of the notice; and,

WHEREAS, the said notice was received by the candidate on 17.11.2022. The acknowledgment receipt has been submitted to the Commission by the District Election Officer, Almora, vide its letter No. पत्र संख्या 88/29-

निर्वाचन व्यय लेखा (वि0स0सा0नि0-2022) dated 16.02.2023; and,

WHEREAS, the District Election Officer, Almora in his Supplementary Report date 15.02.2023 vide its letter No. 16.02.2023 के पत्र संख्या 88/29-निर्वाचन व्यय लेखा (वि0स0सा0नि0-2022) has reported that Sh. Bhole Shankar Arya (Advocate) has neither submitted any representation nor any statement of account of election expenses. Further, after receipt of the due notice of the Election Commission of India, he has furnished neither any reason nor explanation for the said failure; and,

WHEREAS, the Commission is satisfied that Sh. Bhole Shankar Arya (Advocate) has failed to lodge the account of election expenses and has no good reason or justification for the failure,

WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that:-

"If the Election Commission is satisfied that a person-

(a) has failed to lodge an account of election expenses, within the time and in the manner required by or under this Act, and

(b) has no good reason or justification for the failure,

the Election Commission shall, by order published in the Official Gazette, declare him to be disqualified and any such person shall be disqualified for a period of three years from the date of the order";

NOW, THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission of India hereby declares Sh. Bhole Shankar Arya (Advocate) resident of S/O Sadho Ram Arya, Village- Naikana, Post Office- Pesiya, Tehsil- Salt, District- Almora, a contesting candidate from 49-Salt Assembly Constituency of the State of Uttarakhand in the General Election to the Legislative Assembly 2022 to be disqualified for being chosen as and for being a member of either House of the Parliament or the Legislative Assembly or the Legislative Council of a State or Union Territory for a period of three years from the date of this order.

यतः, जिला निर्वाचन अधिकारी, अल्मोङा द्वारा दिनांक 16.02.2023 के पत्र संख्या 88/29-निर्वाचन व्यय लेखा (वि0स0सा0नि0-2022) के जरिए भेजी गई अनुपूरक संवीक्षा रिपोर्ट दिनांक 15.02.2023 में यह बताया गया है कि श्री ललित मोहन सिंह ने न तो कोई भी अभ्यावेदन और न ही अपने निर्वाचन व्यय का लेखा दाखिल किया है। इसके अतिरिक्त उन्होंने भारत निर्वाचन आयोग का सम्यक् नोटिस मिलने के उपरांत भी उक्त विफलता के लिए न तो कोई कारण बताया है और न ही कोई स्पष्टीकरण दिया है;और,

WHEREAS, the District Election Officer, Almora in his Supplementary Report date 15.02.2023 forward vide its letter No. 16.02.2023 के पत्र संख्या 88/29-निर्वाचन व्यय लेखा (वि0स0सा0नि0-2022) has reported that Sh. Lalit Mohan Singh has neither submitted any representation nor any statement of account of election expenses. Rakesh Nath, a contesting candidate of Uttarakhand from 49-Salt Assembly Constituency of Uttarakhand, has failed to lodge account of his election expenses, in the manner, as required under law; and, WHEREAS, on the basis of the reports of the District Election Officer Almora, Uttarakhand and the Chief Electoral Officer, Uttarakhand, a Show-Cause notice, 76/ Uttarakhand -LA /2022/49/CEMS-III dated 20.10.2022 was issued under sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India to Sh. Rakesh Nath, for not lodging the account of Election Expenses; and,

WHEREAS, As per the sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, through the above said Show-Cause Notice, dated 20.10.2022, Sh. Rakesh Nath, was directed to submit his representation in writing with explaining the reasons for not lodging the account and to lodge account of election expenses within 20 days from the date of receipt of the notice; and, WHEREAS, the said notice was received by the candidate on 28.11.2022. यतः 53-जागेश्वर विधान सभा निर्वाचन क्षेत्र के रिर्टनंिग अधिकारी द्वारा उक्त निर्वाचन का परिणाम 10 मार्च, 2022 को घोषित किया गया था। इस प्रकार, निर्वाचन व्यय का लेखा दाखिल करने की अन्तिम तारीख 09 अप्रैल, 2022 थी; और

यतः, जिला निर्वाचन अधिकारी, अल्मोङा, उत्तराखण्ड, और मुख्य निर्वाचन अधिकारी, उत्तराखण्ड की उक्त रिपोटों के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम 1961 के नियम 89 के उप नियम (5) के अंतर्गत निर्वाचन व्यय प्रस्तुत नहीं करने के लिए श्री मनीष सिंह नेगी, को कारण बताओ नोटिस सं. 76/उत्तराखण्ड- वि.स./53/2022/सी.ई.एम.एस.-III, दिनांक 20 अक्टूबर, 2022 जारी किया गया था; और399 [भाग II—खण्ड 3(iii)] भारत का राजपत्र : दिसम्बर 23, 2023/पौष 2, 1945 यतः, निर्वाचनों का संचालन नियम 1961 के नियम 89 के उप-नियम (6) के अनुसार, दिनांक 20अक्टूबर, 2022 के उपयु र्क्त कारण बताओ नोटिस के जरिए श्री मनीष सिंह नेगी, को निदेश दिया गया था कि वे इस नोटिस के प्राप्त होने के 20 दिनों के अंदर लेखा न प्रस्तुत कर पाने के कारणों को स्पष्ट करते हुए लिखित रूप में अपना अभ्यावेदन प्रस्तुत करें और साथ ही, निर्वाचन व्यय का अपना लेखा दाखिल करें; और

यतः, जिला निर्वाचन अधिकारी, अल्मोङा द्वारा अपने दिनांक 28.02.2023 के पत्र संख्या 110/29- व्यय लेखा/2023 के जरिए आयोग को सूचना दी गई की उक्त नोटिस अभ्यर्थी द्वारा दिनांक 26.11.2022 को प्राप्त किया गया था; और,

यतः, आयोग का यह समाधान हो गया है कि श्री मनीष सिंह नेगी, निर्वाचन खचों का लेखा दाखिल करने में विफल रहे हैं और उनके पास इस विफलता के लिए कोई भी उचित कारण अथवा औचित्य नहीं है; और

यत:, लोक प्रतिनिधित्व अधिनियम,1951 की धारा 10क में अनुबंधित किया गया है कि:-

"यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति -

अतः, अब लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अनुसरण में भारत निर्वाचन आयोग एतद्द्वारा घोषणा करता है कि उत्तराखण्ड राज्य के 53-जागेश्वर विधान सभा निर्वाचन क्षेत्र से उत्तराखण्ड राज्य में विधान सभा के साधारण निर्वाचन, 2022 में निर्वाचन लड़ने वाले अभ्यर्थी श्री मनीष सिंह नेगी, निवासी एच0 एन0 09, चक पनुवानौला, पो0- पनुवानौला, तहसील- भनोली, जिला-अल्मोड़ा। को इस आदेश की तारीख से तीन वर्ष की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य-क्षेत्र की विधान सभा अथवा विधान परिषद् का सदस्य चुने जाने अथवा होने के लिए निर्रर्हत है।

O.N. 165.—WHEREAS, the General Election to 53-Jageshwar Legislative Assembly of Uttarakhand, 2022 was held vide Notification No. 464/ Uttarakhand - LA /2022 dated 21st January, 2022.

WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate at an election has to, within 30 days from the date of election of the returned candidate, lodge a true copy of the account of his election expenses with the District Election Officer; and,400 THE GAZETTE OF INDIA : DECEMBER 23, 2023/PAUSHA 2, 1945 [PART II—SEC. 3(iii)] WHEREAS, the result of the said election along with 53-Jageshwar Assembly Constituency was declared by the concerned Returning Officer on 10th March, 2022. Hence, the last date for lodging the account of Election Expenses was 09th April, 2022; and,

WHEREAS, on the basis of the reports of the District Election Officer Almora, Uttarakhand and the Chief Electoral Officer, Uttarakhand, a Show-Cause notice, 76/ Uttarakhand -LA /2022/53/CEMS-III dated 20.10.2022 was issued under sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India to Sh. Manish Singh Negi, for not lodging the account of Election Expenses; and,

WHEREAS, As per the sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, through the above said Show-Cause Notice, dated 20.10.2022, Sh. Manish Singh Negi, was directed to submit his representation in writing with explaining the reasons for not lodging the account and to lodge account of election expenses within 20 days from the date of receipt of the notice; and,

WHEREAS, the said notice was received by the candidate on 26.11.2022. The acknowledgment receipt has been submitted to the Commission by the District Election Officer, Almora, vide its letter No. 110/29- व्यय लेखा/2023 dated 28.02.2023; and,

WHEREAS, the District Election Officer, Almora, in his Supplementary DEO's Scrutiny Report date 15.02.2023 vide its letter No. 16.02.2023 के पत्र संख्या 88/29-निर्वाचन व्यय लेखा (वि0स0सा0नि0-2022) has reported that Sh. Manish Singh Negi, has neither submitted any representation nor any statement of account of election expenses. O.N. 167.—WHEREAS, the General Election to 37-Pauri (SC) Legislative Assembly of Uttarakhand, 2022 was held vide Notification No. 464/Uttarakhand -LA/2022 dated 21st January, 2022.

WHEREAS, the result of the said election along with 37-Pauri (SC) Assembly Constituency was declared by the concerned Returning Officer on 10th March, 2022. Hence, the last date for lodging the account of Election Expenses was 09th April, 2022; and,

WHEREAS, as per the report submitted by the District Election Officer, Pauri Garhwal, Uttarakhand and forwarded by the Chief Electoral Officer, Uttarakhand vide their letter No. 2782/XXV-53/2022, dated 22th April, 2021, Sh. Hari Kumar, a contesting candidate of Uttarakhand from 37-Pauri (SC) Assembly Constituency of Uttarakhand, has failed to lodge account of his election expenses, in the manner, as required under law; and, WHEREAS, on the basis of the reports of the District Election Officer Pauri Garhwal, Uttarakhand and the Chief Electoral Officer, Uttarakhand, a Show-Cause notice, 76/Uttarakhand -LA/2022/37/CEMS-III dated 20.10.2022 was issued under sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India to Sh. Hari Kumar, for not lodging the account of Election Expenses; and,

WHEREAS, As per the sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, through the above said Show-Cause Notice, dated 20.10.2022, Sh. Hari Kumar, was directed to submit his representation in writing with explaining the reasons for not lodging the account and to lodge account of election expenses within 20 days from the date of receipt of the notice; and, WHEREAS, the said notice was received by the candidate's brother Sh. Ganesh Lal, on 07.11.2022. Hari Kumar has neither submitted any representation nor any statement of account of election expenses. Further, after receipt of the due notice of the Election Commission of India, he has furnished neither any reason nor explanation for the said failure; and,

WHEREAS, the Commission is satisfied that Sh. Hari Kumar, has failed to lodge the account of election expenses and has no good reason or justification for the failure,

WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that:-

"If the Election Commission is satisfied that a person-

(a) has failed to lodge an account of election expenses, within the time and in the manner required by or under this Act, and

(b) has no good reason or justification for the failure,

NOW, THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission of India hereby declares Sh. Hari Kumar resident of Village- Singori, P.O. यतः, जिला निर्वाचन अधिकारी, हरिद्वार, उत्तराखण्ड के द्वारा प्रस्तुत और मुख्य निर्वाचन अधिकारी,उत्तराखण्ड द्वारा पत्र सं. 2782/XXV-53/2022 देहरादून के जरिए अग्रेषित दिनांक 22/04/2022 की रिपोर्ट के अनुसार श्री अजय कु मार, जो उत्तराखण्ड विधान सभा का साधारण निर्वाचन 2022 के निर्वाचन क्षेत्र 26-बी.एच.ई.एल. रानीपुर से लड़ने वाले अभ्यर्थी हैं, विधि द्वारा यथापेक्षित रीति से अपने निर्वाचन व्यय का कोई भी लेखा दाखिल करने में विफल रहे हैं; और,

यतः, निर्वाचनों का संचालन नियम 1961 के नियम 89 के उप-नियम (6) के अनुसार, दिनांक 20 अक्टूबर, 2022 के उपयु र्क्त कारण बताओ नोटिस के जरिए श्री अजय कु मार, को निदेश दिया गया था कि वे इस नोटिस के प्राप्त होने के 20 दिनों के अंदर लेखा न प्रस्तुत कर पाने के कारणों को स्पष्ट करते हुए लिखित रूप में अपना अभ्यावेदन प्रस्तुत करें और साथ ही, निर्वाचन व्यय का अपना लेखा दाखिल करें; और

यतः, जिला निर्वाचन अधिकारी, हरिद्वार द्वारा अपने पत्र संख्या 347/29-40-(निर्वाचन व्यय लेखा)/2022 दिनांक 12.04.2023 जो मुख्य निर्वाचन अधिकारी के पत्र सं0 891/XXV-22(II)/2008 दिनांक15.06.2023 के द्वारा अग्रेषित कर आयोग को सूचना दी गई कि उक्त नोटिस अभ्यर्थी की पत्नी श्रीमती रिचा चौहान, द्वारा दिनांक 03.11.2022 को प्राप्त किया गया था; और,

यतः, जिला निर्वाचन अधिकारी, हरिद्वार द्वारा अपने पत्र संख्या 347/29-40-(निर्वाचन व्यय लेखा)/2022 दिनांक 12.04.2023 जो मुख्य निर्वाचन अधिकारी पत्र सं0 891/XXV-22(II)/2008 दिनांक15.06.2023 के द्वारा अग्रेषित कर भेजी गई अनुपूरक रिपोर्ट दिनांक 11.04.2023 में यह बताया गया है कि श्री अजय कु मार, ने न तो कोई भी अभ्यावेदन और न ही अपने निर्वाचन व्यय का लेखा दाखिल किया है। इसके अतिरिक्त उन्होंने भारत निर्वाचन आयोग का411 [भाग II—खण्ड 3(iii)] भारत का राजपत्र : दिसम्बर 23, 2023/पौष 2, 1945 सम्यक् नोटिस मिलने के उपरांत भी उक्त विफलता के लिए न तो कोई कारण बताया है और न ही कोई स्पष्टीकरण दिया है;और,

यतः, आयोग का यह समाधान हो गया है कि श्री अजय कु मार, निर्वाचन खचों का लेखा दाखिल करने में विफल रहे हैं और उनके पास इस विफलता के लिए कोई भी उचित कारण अथवा औचित्य नहीं है; और

यत:, लोक प्रतिनिधित्व अधिनियम,1951 की धारा 10क में अनुबंधित किया गया है कि:-

"यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति -

O.N. 170.—WHEREAS, the General Election to 26-B.H.E.L Ranipur Legislative Assembly of Uttarakhand, 2022 was held vide Notification No. 464/Uttarakhand -LA/2022 dated 21st January, 2022.

WHEREAS, the result of the said election along with 26-B.H.E.L Ranipur Assembly Constituency was declared by the concerned Returning Officer on 10th March, 2022. Hence, the last date for lodging the account of Election Expenses was 09th April, 2022; and,

WHEREAS, as per the report submitted by the District Election Officer, Haridwar, Uttarakhand and forwarded by the Chief Electoral Officer, Uttarakhand vide their letter No. 2782/XXV-53/2022, dated 22th April, 2021, Sh. Ajay Kumar, a contesting candidate of Uttarakhand from 26-B.H.E.L Ranipur Assembly Constituency of Uttarakhand, has failed to lodge account of his election expenses, in the manner, as required under law; and, WHEREAS, on the basis of the reports of the District Election Officer Haridwar, Uttarakhand and the Chief Electoral Officer, Uttarakhand, a Show-Cause notice,76/Uttarakhand -LA/2022/26/CEMS-III dated 20.10.2022 was issued under sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India to Sh. Ajay Kumar, for not lodging the account of Election Expenses; and,

WHEREAS, As per the sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, through the above said Show-Cause Notice, dated 20.10.2022, Sh. Ajay Kumar, was directed to submit his representation in writing with explaining the reasons for not lodging the account and to lodge account of election expenses within 20 days from the date of receipt of the notice; and,412 THE GAZETTE OF INDIA : DECEMBER 23, 2023/PAUSHA 2, 1945 [PART II—SEC. 3(iii)] WHEREAS, the said notice was received by the candidate's wife Smt. WHEREAS, the District Election Officer, Haridwar, in his Supplementary Report dated 11.04.2023 vide its letter No. 347/29-40-(निर्वा0 व्यय लेखा)/2022 dated 12.04.2023 forwarded by Chief Electoral Officer, Uttarakhand, letter no. 891/XXV-22(II)/2008 dated 15.06.2023 has reported that Sh. Ajay Kumar has neither submitted any representation nor any statement of account of election expenses. Further, after receipt of the due notice of the Election Commission of India, he has furnished neither any reason nor explanation for the said failure; and, WHEREAS, the Commission is satisfied that Sh. Ajay Kumar, has failed to lodge the account of election expenses and has no good reason or justification for the failure,

WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that:-

"If the Election Commission is satisfied that a person-

(a) has failed to lodge an account of election expenses, within the time and in the manner required by or under this Act, and

(b) has no good reason or justification for the failure,

NOW, THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission of India hereby declares Sh. Ajay Kumar resident of Village- Rawali Mehdood, Post- Bahadrabad, Tehsil & District- Haridwar, a contesting candidate from 26-B.H.E.L Ranipur Assembly Constituency of the State of Uttarakhand in the General Election to the Legislative Assembly 2022 to be disqualified for being chosen as and for being a member of either House of the Parliament or the Legislative Assembly or the Legislative Council of a State or Union Territory for a period of three years from the date of this order.

WHEREAS, the District Election Officer, Haridwar, in his Supplementary Report dated 11.04.2023 vide its letter No. 347/29-40-(निर्वा.व्यय-लेखा)/2022 dated 12.04.2023 forwarded by Chief Electoral Officer, Uttarakhand, letter no. 891/XXV-22(II)/2008 dated 15.06.2023 has reported that Shri Gulbahar has neither submitted any representation nor any statement of account of election expenses. Further, after receipt of the due notice of the Election Commission of India, he has furnished neither any reason nor explanation for the said failure; and,

WHEREAS, the Commission is satisfied that Shri Gulbahar, has failed to lodge the account of election expenses and has no good reason or justification for the failure,

WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that:-

"If the Election Commission is satisfied that a person-

(a) has failed to lodge an account of election expenses, within the time and in the manner required by or under this Act, and

(b) has no good reason or justification for the failure,

NOW, THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission of India hereby declares Shri Gulbahar, Village- Iqbalpur Kamelpur, P.O. Salempur Rajputan, Tehsil- Roorkee a contesting candidate from 31-Roorkee Assembly Constituency of the State of Uttarakhand in the General Election to the Legislative Assembly 2022 to be disqualified for being chosen as and for being a member of either House of the Parliament or the Legislative Assembly or the Legislative Council of a State or Union Territory for a period of three years from the date of this order.

आ.अ. 173.—यतः, उत्तराखण्ड राज्य की 45-गंगोलीहाट (अ0जा0) विधान सभा क्षेत्र के साधारण निर्वाचन 2022 अधिसूचना नं. 464/उत्तरा0-वि0स0/2022 दिनांक 21.01.2022 के जरिए की गई थी।

यतः 45-गंगोलीहाट (अ0जा0) विधान सभा निर्वाचन क्षेत्र के रिर्टनंिग अधिकारी द्वारा उक्त निर्वाचन का परिणाम10 मार्च, 2022 को घोषित किया गया था। इस प्रकार, निर्वाचन व्यय का लेखा दाखिल करने की अन्तिम तारीख 09 अप्रैल, 2022 थी; और

यतः, जिला निर्वाचन अधिकारी, पिथौरागढ़, उत्तराखण्ड के द्वारा प्रस्तुत और मुख्य निर्वाचन अधिकारी, उत्तराखण्ड द्वारा पत्र सं. 2782/XXV-53/2022 देहरादून के जरिए अग्रेषित दिनांक 22/04/2022 की रिपोर्ट के अनुसार श्रीमती रेखा, जो उत्तराखण्ड विधान सभा का साधारण निर्वाचन 2022 के निर्वाचन क्षेत्र 45-गंगोलीहाट (अ0जा0) से लड़ने वाले अभ्यर्थी हैं, विधि द्वारा यथापेक्षित रीति से अपने निर्वाचन व्यय का कोई भी लेखा दाखिल करने में विफल रहे हैं; और,

यतः, जिला निर्वाचन अधिकारी, पिथौरागढ़, उत्तराखण्ड, और मुख्य निर्वाचन अधिकारी, उत्तराखण्ड की उक्त रिपोटों के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम 1961 के नियम 89 के उप नियम (5) के अंतर्गत निर्वाचन व्यय प्रस्तुत नहीं करने के लिए श्रीमती रेखा, को कारण बताओ नोटिस सं. 76/उत्तराखण्ड- वि.स./45/2022/सी.ई.एम.एस.-III, दिनांक 20 अक्तूबर, 2022 जारी किया गया था; और

यतः, निर्वाचनों का संचालन नियम 1961 के नियम 89 के उप-नियम (6) के अनुसार, दिनांक 20 अक्तूबर, 2022 के उपयु र्क्त कारण बताओ नोटिस के जरिए श्रीमती रेखा, को निदेश दिया गया था कि वे इस नोटिस के प्राप्त होने के 20 दिनों के अंदर लेखा न प्रस्तुत कर पाने के कारणों को स्पष्ट करते हुए लिखित रूप में अपना अभ्यावेदन प्रस्तुत करें और साथ ही, निर्वाचन व्यय का अपना लेखा दाखिल करें; और

यतः, जिला निर्वाचन अधिकारी, पिथौरागढ़ द्वारा अपने पत्र संख्या 1256/29-(निर्वाचन व्यय लेखा)/2022 दिनांक 17.09.2022 जो मुख्य निर्वाचन अधिकारी के पत्र सं0 891/XXV-22(II)/2008 दिनांक15.06.2023 के द्वारा अग्रेषित कर आयोग को सूचना दी गई कि उक्त नोटिस दिनांक 04.11.2022 को अभ्यर्थी के घर पर कोई भी मौजूद नही होने के कारण मकान के सहज दृश्य भाग पर नोटिस चस्पा कर साथ ही नोटिस की सूचना अभ्यर्थी के मो0 7466824255 पर व्हाटसप के माध्यम से भी भेज दिया गया था।; और,

यतः, जिला निर्वाचन अधिकारी, पिथौरागढ़ द्वारा अपने पत्र संख्या 484/29--(निर्वाचन व्यय लेखा)/2022 दिनांक 13.09.2023 के द्वारा अग्रेषित कर भेजी गई अनुपूरक रिपोर्ट में यह बताया गया है कि श्रीमती रेखा, ने न तो कोई418 THE GAZETTE OF INDIA : DECEMBER 23, 2023/PAUSHA 2, 1945 [PART II—SEC. 3(iii)] भी अभ्यावेदन और न ही अपने निर्वाचन व्यय का लेखा दाखिल किया है। इसके अतिरिक्त उन्होंने भारत निर्वाचन आयोग का सम्यक् नोटिस मिलने के उपरांत भी उक्त विफलता के लिए न तो कोई कारण बताया है और न ही कोई स्पष्टीकरण दिया है; और,

यतः, आयोग का यह समाधान हो गया है कि श्रीमती रेखा, निर्वाचन खचों का लेखा दाखिल करने में विफल रहे हैं और उनके पास इस विफलता के लिए कोई भी उचित कारण अथवा औचित्य नहीं है; और

यत:, लोक प्रतिनिधित्व अधिनियम,1951 की धारा 10क में अनुबंधित किया गया है कि:-

"यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति -

अतः, अब लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अनुसरण में भारत निर्वाचन आयोग एतद्द्वारा घोषणा करता है कि उत्तराखण्ड राज्य के 45-गंगोलीहाट (अ0जा0) विधान सभा निर्वाचन क्षेत्र से उत्तराखण्ड राज्य में विधान सभा के साधारण निर्वाचन, 2022 में निर्वाचन लड़ने वाले अभ्यर्थी श्रीमती रेखा, निवासी ग्राम- पलतोङी, पोस्ट - बनकोट, तहसील- गणाई, पिथौरागढ़, को इस आदेश की तारीख से तीन वर्ष की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य-क्षेत्र की विधान सभा अथवा विधान परिषद् का सदस्य चुने जाने अथवा होने के लिए निर्रर्हत है।

O.N. 173.—WHEREAS, the General Election to 45-Gangolihat (SC) Legislative Assembly of Uttarakhand, 2022 was held vide Notification No. 464/Uttarakhand -LA/2022 dated 21st January, 2022.

WHEREAS, the result of the said election along with 45-Gangolihat (SC) Assembly Constituency was declared by the concerned Returning Officer on 10th March, 2022. Hence, the last date for lodging the account of Election Expenses was 09th April, 2022; and,

WHEREAS, as per the report submitted by the District Election Officer, Pithoragarh, Uttarakhand and forwarded by the Chief Electoral Officer, Uttarakhand vide their letter No. 2782/XXV-53/2022, dated 22th April, 2021, Smt. Rekha, a contesting candidate of Uttarakhand from 45-Gangolihat (SC) Assembly Constituency of Uttarakhand, has failed to lodge account of his election expenses, in the manner, as required under law; and, WHEREAS, on the basis of the reports of the District Election Officer Pithoragarh, Uttarakhand and the Chief Electoral Officer, Uttarakhand, a Show-Cause notice,76/Uttarakhand -LA/2022/45/CEMS-III dated 20.10.2022 was issued under sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India to Smt. Rekha, for not lodging the account of Election Expenses; and,

WHEREAS, As per the sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, through the above said Show-Cause Notice, dated 20.10.2022, Smt. Rekha, was directed to submit his representation in writing with explaining the reasons for not lodging the account and to lodge account of election expenses within 20 days from the date of receipt of the notice; and,419 [भाग II—खण्ड 3(iii)] भारत का राजपत्र : दिसम्बर 23, 2023/पौष 2, 1945 WHEREAS, the said notice was pasted on 04.11.2022 in front of the candidate house as no one was present in his house and notice was also served through whatsapp no. 7466824255. The acknowledgment receipt has been submitted to the Commission by the District Election Officer, Pithoragarh, vide its letter No.1256/29-(निर्वा.व्यय- लेखा)/2022 dated 17.09.2022; forwarded by Chief Electoral Officer, Uttarakhand, letter no.891/XXV-22(II)/2008 date15.06.2023; and,

WHEREAS, the District Election Officer, Pithoragarh, in his Supplementary Report forwarded vide its letter No. 484/29-(निर्वा.व्यय-लेखा)/2022 dated 13.09.2023 reported that Smt. Rekha, neither submitted any representation nor any statement of account of election expenses. Further, after receipt of the due notice of the Election Commission of India, he neither furnished any reason nor explanation for the said failure; and,

WHEREAS, the Commission is satisfied that Smt. Rekha, has failed to lodge the account of election expenses and has no good reason or justification for the failure,

WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that:-

"If the Election Commission is satisfied that a person-

(a) has failed to lodge an account of election expenses, within the time and in the manner required by or under this Act, and

(b) has no good reason or justification for the failure,
