आ.अ. 2.—यतः, भारत निर्वाचन आयोग द्वारा अधिसूचना सं .464/ गुजरात- वि .स ./2022 दिनांक 05 नवम्बर, 2022 , के जरिए गुजरात के 107-बोटाद विधान निर्वाचन क्षेत्र के लिए साधारण निर्वाचन, 2022 की घोषणा की गई थी;
और
यत:, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 78 के अनुसार, निर्वाचन लड़ने वाले प्रत्येक अभ्यर्थी को निर्वाचित अभ्यर्थी के निर्वाचन की तारीख से 30 दिनों के भीतर, जिला चुनाव अधिकारी के पास अपने चुनाव खर्च का लेखा-जोखा प्रस्तुत करेगा जो उक्त अधिनियम की धारा 77 के तहत उसके या उसके चुनाव एजेंट द्वारा रखे गए खाते की सही प्रति होगी; और
यतः, 107-बोटाद विधान सभा निर्वाचन क्षेत्र के निर्वाचन परिणाम रिर्टनंिग अधिकारी द्वारा 08 दिसम्बर, 2022 को घोषित किया गया था और इस प्रकार निर्वाचन व्यय के लेखे दाखिल करने की अन्तिम तारीख 07 जनवरी, 2023 थी;
और

ELC/2922/LA-37/CHH (Exp.) दिनांक 30 जनवरी, 2023 के जरिए अग्रेषित की गई रिपोर्ट के अनुसार श्री धाधल अमिराजसिंह जगुभाई , जो गुजरात विधान सभा का साधारण निर्वाचन 2022 के निर्वाचन क्षेत्र 107-बोटाद से लड़ने वाले अभ्यर्थी हैं, विधि द्वारा यथापेक्षित रीति से अपने निर्वाचन व्यय का कोई भी लेखा दाखिल करने में विफल रहे हैं ;और,
यतः, जिला निर्वाचन अधिकारी की उक्त रिपोर्ट के आधार पर, भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम )5 ( के अंतर्गत श्री धाधल अमिराजसिंह जगुभाई को अपने निर्वाचन व्यय के लेखे प्रस्तुत नहीं करने के लिए कारण बताओ नोटिस सं. 76/GJ-LA/19(107)/2023/CEMS-IV दिनांक 12 जून, 2023 जारी किया गया था; और
यत:, उपयु र्क्त कारण बताओ नोटिस के माध्यम से और निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप- नियम )6 ( के अंतर्गत, श्री धाधल अमिराजसिंह जगुभाई को लेखा प्रस्तुत न किए जाने संबंधी कारणों को स्पष्ट करते हुए आयोग को अपना अभ्यावेदन लिखित रूप में प्रस्तुत करने और नोटिस के प्राप्त होने की तारीख से 20 दिनों के अंदर जिला निर्वाचन अधिकारी ,बोटाद को अपने निर्वाचन व्यय का लेखा भी प्रस्तुत करने का निदेश दिया गया था; और
यत:, मुख्य निर्वाचन अधिकारी, गुजरात ने अपने पत्र संख्या ELC/2922/AC-107/CHH (Exp. Cell) दिनांक 23 अगस्त, 2023 के माध्यम से सूचित किया है कि उक्त नोटिस उम्मीदवार को 26.06.2023 को प्राप्त हुआ है; और
यत:, जिला निर्वाचन अधिकारी ,बोटाद, ने अपने पत्र संख्या ELC/BOTAD/GJ-LA/03/2023 दिनांक 23 अक्टूबर, 2023 द्वारा प्रस्तुत अनुपूरक रिपोर्ट जो मुख्य निर्वाचन अधिकारी, गुजरात पत्र सं 0 ELC/2922/AC-107- Chh (Exp) दिनांक 10 नवम्बर, 2023 के द्वारा अग्रेषित कर भेजी गई रिपोर्ट में यह बताया गया है कि श्री धाधल अमिराजसिंह जगुभाई ने अपने निर्वाचन व्यय के खाते का कोई विवरण प्रस्तुत नहीं किया है; और
यत:, उक्त नोटिस प्राप्त होने के बाद, श्री धाधल अमिराजसिंह जगुभाई ने कानून के तहत निर्धारित खाते को दर्ज करने में विफलता के लिए भारत के चुनाव आयोग को न तो कोई कारण और न ही कोई स्पष्टीकरण प्रस्तुत किया है; और
यत:, तथ्यों और उपलब्ध अभिलेखों के आधार पर आयोग का यह समाधान हो गया है कि श्री धाधल अमिराजसिंह जगुभाई अपने निर्वाचन व्यय का लेखा दाखिल करने में असफल रहे हैं और उनके पास इस विफलता के लिए कोई भी उचित कारण अथवा औचित्य नहीं है; और
यत:, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10 क में यह उपबंधित किया गया है कि :-
''यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति-
(ट) निर्वाचन व्ययों का लेखा उस समय के भीतर और उस रीति में जैसी इस अधिनियम के द्वारा या अधीन अपेक्षित है, दाखिल करने में असफल रहा है, तथा
(ठ) उस असफलता के लिए कोई अच्छा कारण या न्यायोचित्य नहीं रखता है,तो निर्वाचन आयोग शासकीय राजपत्र में प्रकाशित आदेश द्वारा उसको निर्रर्हत घोषित करेगा और ऐसा व्यक्ति उस आदेश की तारीख से तीन वर्ष की कालावधि के लिए निर्रर्हत होगाI"
अत :, अब, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10 क के अनुसरण में, भारत निर्वाचन आयोग एतद्द्वारा घोषणा करता है कि गुजरात राज्य के 107-बोटाद विधान सभा निर्वाचन क्षेत्र से गुजरात राज्य में विधान सभा के साधारण निर्वाचन, 2022 में निर्वाचन लड़ने वाले अभ्यर्थी, श्री धाधल अमिराजसिंह जगुभाई निवासी गायत्रीनगर नज़दीक रेलवे स्टेशन, बोटाद, तहसील जिला – बोटाद, गुजरात – 364710, को इस आदेश की तारीख से तीन वर्ष की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य-क्षेत्र की विधान सभा अथवा विधान परिषद का सदस्य चुने जाने अथवा होने के लिए निर्रर्हत होंगे।

ELECTION COMMISSION OF INDIA
ORDER
New Delhi, the 3rd January, 2024
O.N. 2.—WHEREAS, the General Election for 107-Botad Assembly Constituency of Gujarat, 2022 was held in pursuance of the Election Commission of India Notification No. 464/GJ-LA/2022 dated 5th November, 2022; and
WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate at an election shall, within 30 days from the date of election of the returned candidate, lodge with the District Election Officer, an account of his election expenses which shall be true copy of the account kept by him or his election agent under Section 77 of the said act; and
WHEREAS, the result of the election for 107-Botad Assembly Constituency of Gujarat, was declared by the Returning Officer on 8th December, 2022 and hence the last date for lodging the account of Election Expenses was 7th January, 2023; and
WHEREAS, as per the report submitted by the District Election Officer, Botad and forwarded by the Chief Electoral Officer, Gujarat vide their letter no. ELC/2922/LA-37/CHH(Exp.) dated 30th January, 2023, Sh. Dhadhal Amirajsinh Jagubhai, a contesting candidate from 107-Botad Assembly Constituency of Gujarat, 2022, has failed to lodge account of his election expenses, as required under law; and
WHEREAS, on the basis of the said reports of the District Election Officer, a Show-Cause notice No. 76/GJ-LA/19(107)/2023/CEMS-IV, dated 12th June, 2023 was issued under sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India to Sh. Dhadhal Amirajsinh Jagubhai, for not lodging of account of Election Expenses; and
WHEREAS, through the above said Show Cause Notice and under sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, Sh. Dhadhal Amirajsinh Jagubhai, was directed to submit his representation in writing to the Commission explaining the reason for not lodging the account and also to lodge account of election expenses with the District Election Officer, Botad within 20 days from the date of receipt of the notice; and
WHEREAS, the Chief Electoral Officer, Gujarat vide his letter no. ELC/2922/AC-107/CHH (Exp. Cell) dated 23rd August, 2023 has informed that the said notice was served to the candidate on 26.06.2023; and
WHEREAS, the District Election Officer, Botad in his supplementary report vide letter no. ELC/BOTAD/GJ-LA/03/2023 dated 27.10.2023 forwarded by the Chief Electoral Officer, Gujarat, vide letter no. ELC/2922/AC-107-Chh (Exp) dated 10th November, 2023 has reported that Sh. Dhadhal Amirajsinh Jagubhai has not submitted his account of election expenses.
WHEREAS, after receipt of the said notice, Sh. Dhadhal Amirajsinh Jagubhai has neither furnished any reason nor any explanation to the Election Commission of India, for failure to lodge the account of election expenses as prescribed under law; and
WHEREAS, on the basis of facts and available records, the Commission is satisfied that Sh. Dhadhal Amirajsinh Jagubhai has failed to lodge account of election expenses and has not furnished any reason or justification for the failure to do so; and
WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that:-
"If the Election Commission is satisfied that a person-
(o) has failed to lodge an account of election expenses, within the time and in the manner required by or under
this Act, and
(p) has no good reason or justification for the failure,
the Election Commission shall, by order published in the Official Gazette, declare him to be disqualified and any
such person shall be disqualified for a period of three years from the date of the order."
NOW, THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission of India hereby declares Sh. Dhadhal Amirajsinh Jagubhai resident of Gayatrinagar, Near Railway Station, Botad, Ta. Dist. Botad, Gujarat-364710. a contesting candidate from 107-Botad Assembly Constituency of the State of Gujarat in the General Election to the Legislative Assembly, 2022 to be disqualified for being chosen as and for being a member of either House of Parliament or the Legislative Assembly or Legislative Council of a State or Union Territory for a period of three years from the date of this order.

ELC/2922/LA-37/CHH (Exp.) दिनांक 30 जनवरी, 2023 के जरिए अग्रेषित की गई रिपोर्ट के अनुसार श्री धोरिया रमेशभाई भावाभाई , जो गुजरात विधान सभा का साधारण निर्वाचन 2022 के निर्वाचन क्षेत्र 61- लिंबडी से लड़ने वाले अभ्यर्थी हैं, विधि द्वारा यथापेक्षित रीति से अपने निर्वाचन व्यय का कोई भी लेखा दाखिल करने में विफल रहे हैं ;और,
यतः, जिला निर्वाचन अधिकारी की उक्त रिपोर्ट के आधार पर, भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम )5 ( के अंतर्गत श्री धोरिया रमेशभाई भावाभाई को अपने निर्वाचन व्यय के लेखे प्रस्तुत नहीं करने के लिए कारण बताओ नोटिस सं. 76/GJ-LA/9(61)/2023/CEMS-IV दिनांक 09 जून, 2023 जारी किया गया था; और

यत:, जिला निर्वाचन अधिकारी ,सुरेंरनगर, द्वारा अपनी अनुपूरक रिपोर्ट दिनांक 12.07.2023 जो मुख्य निर्वाचन अधिकारी, गुजरात पत्र सं 0 ELC/2922/AC-61-CHH (Exp) दिनांक 10 नवम्बर, 2023 के द्वारा अग्रेषित कर भेजी गई रिपोर्ट में यह बताया गया है कि श्री धोरिया रमेशभाई भावाभाई ने भारत निर्वाचन आयोग के दिनांक 09.06.2023 के कारण बताओ नोटिस की प्राप्ति के बाद भी न तो कोई अभ्यावेदन और न ही अपने निर्वाचन व्यय के खाते का कोई विवरण प्रस्तुत किया है; और
यत:, उक्त नोटिस प्राप्त होने के बाद, श्री धोरिया रमेशभाई भावाभाई ने कानून के तहत निर्धारित खाते को दर्ज करने में विफलता के लिए भारत के चुनाव आयोग को न तो कोई कारण और न ही कोई स्पष्टीकरण प्रस्तुत किया है; और

(झ) निर्वाचन व्ययों का लेखा उस समय के भीतर और उस रीति में जैसी इस अधिनियम के द्वारा या अधीन अपेक्षित है, दाखिल करने में असफल रहा है, तथा11 [भाग II—खण्ड 3(iii)] भारत का राजपत्र : जनवरी 20, 2024/पौष 30, 1945 (ञ) उस असफलता के लिए कोई अच्छा कारण या न्यायोचित्य नहीं रखता है,तो निर्वाचन आयोग शासकीय राजपत्र में
प्रकाशित आदेश द्वारा उसको निर्रर्हत घोषित करेगा और ऐसा व्यक्ति उस आदेश की तारीख से तीन वर्ष की
कालावधि के लिए निर्रर्हत होगाI"
अत :, अब, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10 क के अनुसरण में, भारत निर्वाचन आयोग एतद्द्वारा
घोषणा करता है कि गुजरात राज्य के 61- लिंबडी विधान सभा निर्वाचन क्षेत्र से गुजरात राज्य में विधान सभा के साधारण
निर्वाचन, 2022 में निर्वाचन लड़ने वाले अभ्यर्थी, श्री धोरिया रमेशभाई भावाभाई निवासी खिन्टला, तहसील – सायला,
जिला – सुरेंरनगर, गुजरात - 363440, को इस आदेश की तारीख से तीन वर्ष की अवधि के लिए संसद के किसी भी सदन
अथवा राज्य अथवा संघ राज्य-क्षेत्र की विधान सभा अथवा विधान परिषद का सदस्य चुने जाने अथवा होने के लिए
निर्रर्हत होंगे।

Dhoriya Rameshbhai Bhavabhai, for not lodging of account of Election Expenses; and
WHEREAS, through the above said Show Cause Notice and under sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, Sh. Dhoriya Rameshbhai Bhavabhai, was directed to submit his representation in writing to the Commission explaining the reason for not lodging the account and also to lodge account of election expenses with the District Election Officer, Surendranagar within 20 days from the date of receipt of the notice; and

WHEREAS, the District Election Officer, Devbhumi Dwarka in his supplementary report dated 12.07.2023 forwarded by the Chief Electoral Officer, Gujarat, vide letter no. ELC/2922/AC-61-CHH (Exp) dated 10th November, 2023 has reported that Sh. Dhoriya Rameshbhai Bhavabhai has neither submitted any representation nor any statement of account of election expenses even after receipt of the Show Cause Notice dated 09.06.2023 of the Election Commission of India; and
WHEREAS, after receipt of the said notice, Sh. Dhoriya Rameshbhai Bhavabhai has neither furnished any reason nor any explanation to the Election Commission of India, for failure to lodge the account of election expenses as prescribed under law; and12 THE GAZETTE OF INDIA : JANUARY 20, 2024/PAUSHA 30, 1945 [PART II—SEC. 3(iii)] WHEREAS, on the basis of facts and available records, the Commission is satisfied that Sh.
