आ.अ. 31.—यतः भारत निर्वाचन आयोग द्वारा दिनांक 01 अक्तूबर, 2021 की अधिसूचना सं0 100/ एएस-एलए/3/2021/एनईएस-।। के अनुसरण में आसाम के 58-तमूलपुर विधान सभा निर्वाचन क्षेत्र के लिए उप-निर्वाचन, 2021 आयोजित किया गया था; और

यतः, आसाम के 58-तमूलपुर विधान सभा निर्वाचन क्षेत्र के उप-निर्वाचन, 2021 के परिणाम रिटर्निंग ऑफिसर द्वारा दिनांक 02 नवम्बर, 2021 को घोशित किए गए थे और इस प्रकार निर्वाचन व्यय के लेखे दाखिल करने की अन्तिम तारीख 01 दिसम्बर, 2021 थी; और

(73)74 THE GAZETTE OF INDIA : FEBRUARY 10, 2024/MAGHA 21, 1945 [PART II—SEC. 3(iii)] यतः, निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम(1) के अंतर्गत, मुख्य निर्वाचन अधिकारी, असम से दिनांक 18.01.2022 के पत्र सं0 ईएलई-283/2021/82 के द्वारा प्राप्त जिला निर्वाचन अधिकारी की दिनांक 01.12.2021 के रिपोर्ट के अनुसार श्री यषवंत चौहान, जो असम के 58-तमूलपुर विधानसभा निर्वाचन क्षेत्र, 2021 से निर्वाचन लड़ने वाले अभ्यर्थी हैं, विधि द्वारा यथापेक्षित रीति से अपने निर्वाचन व्यय के लेखे दाखिल करने में असफल रहे हैं;

यतः, जिला निर्वाचन अधिकारी की उक्त रिपोर्ट के आधार पर. भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (5) के अंतर्गत श्री यषवंत चौहान को अपने निर्वाचन व्यय के लेखे प्रस्तुत नहीं करने के लिए कारण बताओ नोटिस सं. 76/एएस-एलए/1/2021/सी.ई.एम.एस.-1 दिनांक 18 फरवरी, 2022 जारी किया गया था, और

यतः, उपर्युक्त कारण बताओ नोटिस के जरिए और निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (6) के अनुसार श्री यषवंत चौहान को लेखा प्रस्तुत न किए जाने संबंधी कारणों को स्पश्ट करते हुए, आयोग को अपना अभ्यावेदन लिखित रूप में प्रस्तुत करने और नोटिस के प्राप्त होने की तारीख से 20 दिनो के भीतर जिला निर्वाचन अधिकारी, बक्सा को अपने निर्वाचन व्यय का पूर्ण लेखा प्रस्तुत करने का निदेष दिया गया था, और

यतः जिला निर्वाचन अधिकारी, बक्सा ने अपनी पत्र सं0 बीईएल/ईईएम/2021 (उप निर्वाचन)/5 दिनांक 9 मार्च, 2022 में सूचित किया है कि उक्त कारण बताओ नोटिस श्री यषवंत चौहान के पिताजी श्री पदुम बहादुर चौहान को दिनांक 08 मार्च, 2022 को तामील किया गया था, और

यतः जिला निर्वाचन अधिकारी, बक्सा ने पत्र सं0 ईएलई-22/262/2023-ईएलई-बीएके-109085 दिनांक 12.9.2023 की अनुपूरक रिपोर्ट अग्रेशित की है और बताया है कि श्री यषवंत चौहान ने निर्वाचन व्यय का लेखा प्रस्तुत नहीं किया है। इसके अतिरिक्त, उक्त नोटिस की पावती के उपरांत, श्री यषवंत चौहान ने विधि के अंतर्गत यथा विहित लेखा दाखिल करने में अपनी असफलता के लिए भारत निर्वाचन आयोग को न तो कोई कारण बताया है और न ही कोई स्पश्टीकरण दिया है, और

यतः लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में यह उपबंधित किया गया है किः

यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति

(क) निर्वाचन व्ययों का लेखा उस समय के भीतर और रीति में जैसी इस अधिनियम के द्वारा या अधीन अपेक्षित है, दाखिल करने में असफल रहा है, और

(ख) उस असफलता के लिए कोई अच्छा कारण अथवा न्यायोचित्य नहीं रखता है तो निर्वाचन आयोग, शासकीय राजपत्र में प्रकाषित आदेष द्वारा उसको निरर्हित घोशित करेगा और ऐसा व्यक्ति उस आदेष की तारीख से तीन वर्श की कालावधि के लिए निरर्हित होगा

यतः, तथ्यों और उपलब्ध रिकार्डों के आधार पर आयोग का यह समाधान हो गया है कि श्री यषवंत चौहान, अपने निर्वाचन व्यय के लेखे दाखिल करने में असफल रहे हैं और उनके पास ऐसा करने में असफल रहने के लिए कोई भी उचित कारण अथवा औचित्य नहीं है, और

अतः अब लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अनुसरण में भारत निर्वाचन आयोग एतद्‌द्वारा धोशणा करता है कि आसाम राज्य के उप-निर्वाचन, 2021 के 58-तमूलपुर विधानसभा निर्वाचन क्षेत्र से निर्वाचन लड़ने वाले अभ्यर्थी श्री यषवंत चौहान, गांव कुम्भीझर डा0 नगरिजूलि, पीएस-तमूलपुर, जिला-बक्सा, आसाम इस आदेष की तारीख से तीन वर्श की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य क्षेत्र की विधानसभा अथवा विधान परिशद का सदस्य चुने जाने अथवा होने के लिए निरर्हित होंगे।

O.N. 31.—WHEREAS, the Bye-Election to Legislative Assembly of Assam, 2021 for 58-Tamulpur Assembly Constituency was held in pursuance of the Election Commission of India Notification No.100/AS- LA/3//2021 , dated 01st October, 2021; and

WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate at an election shall, within 30 days from the date of election of the returned candidate, lodge with the District Election Officer an account of his election expenses which shall be true copy of the account kept by him or his election agent under Section 77 of the said act; and75 [भाग II—खण्ड 3(iii)] भारत का राजपत्र : फरवरी 10, 2024/माघ 21, 1945 WHEREAS, the result of the bye-election for 58-Tamulpur Assembly Constituency of Assam, 2021 was declared by the Returning Officer on 02nd November, 2021 and hence the last date for lodging the account of Election Expenses was 01st December, 2021; and

WHEREAS, as per the report dated 01-12-2021 of the DEO, Baksa under sub-rule (1) of Rule 89 of the Conduct of Elections Rules, 1961, received from the CEO, Assam vide his letter no. ELE-283/2021/82 dated 18.01.2022, Shri Yaswanta Chauhan, a contesting candidate from 58-Tamulpur Assembly Constituency of Assam, 2021 has failed to lodge account of election expenses, as required under law; and

WHEREAS, on the basis of the said report of the District Election Officer, a Show-Cause notice No. 76/AS- LA/1/2022/CEMS-I(Bye), dated 18 February, 2022 was issued under sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India to Shri Yaswanta Chauhan, for not lodging of account of Election Expenses; and

WHEREAS, through the above said Show Cause Notice and under sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, Shri Yaswanta Chauhan, was directed to submit representation in writing to the Commission explaining the reasons for not lodging the account and also to lodge account of election expenses with the District Election Officer, Baksa District within 20 days from the date of receipt of the notice; and

WHEREAS, the District Election Officer, Baksa District, vide his letter no. BEL/EEM/2023(Bye-Election)/5 dated 09.03.2022 has reported that the said notice was served to Shri Yaswanta Chauhan's father Shri Padum Bahadur Chauhan on 08.03.2022; and

WHEREAS, the District Election Officer, Baksa, Supplementary Report No. ELE-22/262/2023-ELE-BK- 109085 dated 12-09-2023 and reported that Shri Yaswanta Chauhan, has not submitted account of election expenses. Further, after receipt of the said notice, Shri Yaswanta Chauhan, has neither furnished any reason nor explanation to the Election Commission of India, for failure to lodge the account as prescribed under law; and

WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that:-

"If the Election Commission is satisfied that a person-

(a) has failed to lodge an account of election expenses, within the time and in the manner required by

or under this Act, and

(b) has no good reason or justification for the failure,

the Election Commission shall, by order published in the Official Gazette, declare him to be disqualified and any

such person shall be disqualified for a period of three years from the date of the order.";

WHEREAS, on the basis of facts and available records, the Commission is satisfied that Shri Yaswanta Chauhan has failed to lodge account of election expenses and has no good reason or justification for the failure to do so; and

NOW, THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission of India hereby declares Shri Yaswanta Chauhan, Vill. Kumbhijhar, PO- Nagrijuli, PS- Tamulpur, Distt. Baksa, Assam and a contesting candidate in 58-Tamulpur Assembly Constituency Bye Election of the State of Assam to be disqualified for being chosen as and for being a member of either House of the Parliament or the Legislative Assembly or the Legislative Council of a State or Union Territory for a period of three years from the date of this order.

आ.अ. 32.—यतः भारत निर्वाचन आयोग द्वारा दिनांक 25 जनवरी 2022 की अधिसूचना सं0 464/ पीबी-वि0स0/2022 के

अनुसरण में पंजाब राज्य के 79-जलालाबाद विधान सभा निर्वाचन क्षेत्र के लिए साधारण निर्वाचन, 2022 आयोजित किया गया था; और

यतः लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 78 के अनुसार, किसी निर्वाचन में, निर्वाचन लड़ रहा प्रत्येक अभ्यर्थी, निर्वाचित अभ्यर्थी के निर्वाचन की तारीख से 30 दिनों के भीतर अपने निर्वाचन व्यय का लेखा जिला निर्वाचन अधिकारी के पास दाखिल76 THE GAZETTE OF INDIA : FEBRUARY 10, 2024/MAGHA 21, 1945 [PART II—SEC. 3(iii)] करेगा जो उक्त अधिनियम की धारा 77 के अंतर्गत उसके द्वारा या उसके निर्वाचन अभिकर्ता (एजेंट)द्वारा रखे गए लेखे की एक सत्य प्रति होगी; और

यतः, पंजाब राज्य के 79-जलालाबाद विधान सभा निर्वाचन क्षेत्र के साधारण निर्वाचन, 2022 का परिणाम रिटर्निंग ऑफिसर द्वारा दिनांक 10 मार्च , 2022 को घोशित किया गया था और इस प्रकार निर्वाचन व्यय के लेखे दाखिल करने की अन्तिम तारीख 09 अपै्रल 2022 थी; और

यतः, निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (1) के अंतर्गत, मुख्य निर्वाचन अधिकारी, पंजाब से दिनांक 26 अप्रैल 2022 के पत्र सं0 इलेक्.-2022/आर-8510 के तहत प्राप्त जिला निर्वाचन अधिकारी की रिपोर्ट दिनांक 14 अप्रैल 2022 के अनुसार श्री बलजीत सिंह जो पंजाब राज्य के 79-जलालाबाद विधान सभा निर्वाचन क्षेत्र, 2022 से निर्वाचन लड़ने वाले अभ्यर्थी हैं,विधि के अंतर्गत यथापेक्षित रीति से अपने निर्वाचन व्ययों का लेखा दाखिल करने में असफल रहे हैं और

यतः, जिला निर्वाचन अधिकारी, फाजिल्का की उक्त रिपोर्ट के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (5) के अंतर्गत श्री बलजीत सिंह को अपने निर्वाचन व्यय के लेखे प्रस्तुत नहीं करने के लिए कारण बताओ नोटिस सं. 76/पीबी-वि..स./79/2022/सी.ई.एम.एस.-1 दिनांकःः 15 जून, 2022 जारी किया गया था, और

यतः, उपर्युक्त कारण बताओ नोटिस के जरिए और निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (6) के अनुसार श्री बलजीत सिंह,को लेखा प्रस्तुत न किए जाने संबंधी कारणों को स्पश्ट करते हुए, आयोग को अपना अभ्यावेदन लिखित रूप में प्रस्तुत करने और नोटिस के प्राप्त होने की तारीख से 20 दिनो के भीतर जिला निर्वाचन अधिकारी, फाजिल्का जिला को अपने निर्वाचन व्यय का लेखा प्रस्तुत करने का निदेष दिया गया था, और

यतः मुख्य निर्वाचन अधिकारी, पंजाब राज्य ने पत्र सं0 इलेक्.-2022/आर-3550 दिनांक 21.06.2023 के द्वारा जिला निर्वाचन अधिकारी, फाजिल्का, की अनुपूरक रिपोर्ट सं. दिनांक 06.04.2023 अग्रेशित किया और बताया कि श्री बलजीत सिंह , ने निर्वाचन व्यय का लेखा प्रस्तुत नहीं किया है। इसके अतिरिक्त, उक्त नोटिस की पावती के उपरांत, श्री बलजीत सिंह ने लेखा दाखिल नही करने में अपनी असफलता के लिए भारत निर्वाचन आयोग को न तो कोई कारण बताया है और न ही कोई स्पश्टीकरण दिया है, और

यतः लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में यह उपबंधित किया गया है किः

"यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति

O.N. 32.—WHEREAS, the General Election to Legislative Assembly of Punjab, 2022 for 79-Jalalabad Assembly Constituency was held in pursuance of the Election Commission of India Notification No. 464/PB-LA/2022, dated 25th January, 2022 and

WHEREAS, the result of the election for 79-Jalalabad Assembly Constituency of Punjab, 2022 was declared by the Returning Officer on 10th March, 2022 and hence the last date for lodging the account of Election Expenses was 9th April, 2022; and

WHEREAS, as per the report dated 14th April, 2022, of the DEO, Fazilka under sub-rule (1) of Rule 89 of the Conduct of Elections Rules, 1961, received through the CEO, Punjab vide his letter No. Elec-2022 /R-8510 dated 26 April 2022 stating that Sh. Baljit Singh a contesting candidate from 79-Jalalabad Assembly Constituency in General Election to Legislative Assembly of Punjab, 2022 has failed to lodge account of election expenses, as required under law; and

WHEREAS, on the basis of the said report of the District Election Officer, Fazilka Show-Cause notice No. 76/PB-LA/79/2022/CEMS-I, dated 15th June, 2022 was issued under sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India Sh. Baljit Singh for not lodging of account of Election Expenses; and

WHEREAS, through the above said Show Cause Notice and under sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, Sh. Baljit Singh was directed to submit representation in writing to the Commission explaining the reasons for not lodging the account and also to lodge account of election expenses with the District Election Officer, Fazilka District within 20 days from the date of receipt of the notice; and

WHEREAS, the District Election Officer, Fazilka in his report No. 2023/386 dated 06.04.2023 reported that the said notice was served to Sh. Baljit Singh on 07.07.2022; and

WHEREAS, the CEO, Punjab vide letter no Elect-2023-3550 dated 21st June, 2023 forwarded the District Election Officer, Fazilka Supplementary Report No. dated 6th April, 2023 and reported that Sh. Baljit Singh has not submitted any representation of a statement of correct account of election expenses duly signed alongwith original vouchers etc. Further, after receipt of the said notice, Sh. Baljit Singh has neither furnished any reason nor explanation to the Election Commission of India, for failure to lodge the account as prescribed under law; and

WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that:-

"If the Election Commission is satisfied that a person-

(a) has failed to lodge an account of election expenses, within the time and in the manner required by or

under this Act, and

(b) has no good reason or justification for the failure,

यतः, पंजाब राज्य के 82-बलुआना ( अ0 जा0 ) विधान सभा निर्वाचन क्षेत्र के साधारण निर्वाचन, 2022 परिणाम रिटर्निंग ऑफिसर द्वारा दिनांक 10 मार्च , 2022 को घोशित किया गया था और इस प्रकार निर्वाचन व्यय के लेखे दाखिल करने की अन्तिम तारीख 09 अपै्रल 2022 थी; और

यतः, जिला निर्वाचन अधिकारी की उक्त रिपोर्ट के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (5) के अंतर्गत श्री प्रीथी राम मेघ को अपने निर्वाचन व्यय के लेखे प्रस्तुत नहीं करने के लिए कारण बताओ नोटिस सं. 76/पीबी-वि..स./82/2022/सी.ई.एम.एस.-1 दिनांकःः 15 जून, 2022जारी किया गया था, और

यतः, उपर्युक्त कारण बताओ नोटिस के जरिए और निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (6) के अनुसार श्री प्रीथी राम मेघ को लेखा प्रस्तुत न किए जाने संबंधी कारणों को स्पश्ट करते हुए, आयोग को अपना अभ्यावेदन लिखित रूप में प्रस्तुत करने और नोटिस के प्राप्त होने की तारीख से 20 दिनो के भीतर जिला निर्वाचन अधिकारी, फाजिल्का का ेअपने निर्वाचन व्यय का लेखा प्रस्तुत करन ेका निदेष दिया गया था, और

यतः जिला निर्वाचन अधिकारी, फाजिल्का जिला ने सूचित किया है कि उक्त कारण बताओ नोटिस श्री प्रीथी राम मेघ को दिनांक 08.07.2022 को तामील किया गया था, और

यतः मुख्य निर्वाचन अधिकारी, पंजाब राज्य ने पत्र सं0 इलेक्.-2023/आर-3550 दिनांक 21.06.2023 के द्वारा जिला निर्वाचन अधिकारी, फाजिल्का, की अनुपूरक रिपोर्ट सं. दिनांक 06.04.2023 अग्रेशित किया और बताया कि श्री प्रीथी राम मेघ, ने निर्वाचन व्यय का लेखा प्रस्तुत नहीं किया है। इसके अतिरिक्त, उक्त नोटिस की पावती के उपरांत, श्री प्रीथी राम मेघ ने लेखा दाखिल नही करने में अपनी असफलता के लिए भारत निर्वाचन आयोग को न तो कोई कारण बताया है और न ही कोई स्पश्टीकरण दिया है, और यतः लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में यह उपबंधित किया गया है किः "यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति (क) निर्वाचन व्ययों का लेखा उस समय के भीतर और रीति में जैसी इस अधिनियम के द्वारा या अधीन अपेक्षित है, दाखिल करने में असफल रहा है, और (ख) उस असफलता के लिए कोई अच्छा कारण अथवा न्यायोचित्य नहीं रखता है तो निर्वाचन आयोग, शासकीय राजपत्र में प्रकाषित आदेष द्वारा उस को निरर्हित घोशित करेगा और ऐसा व्यक्ति उस आदेष की तारीख से तीन वर्श की कालावधि के लिए निरर्हित होगा

यतः, तथ्यों और उपलब्ध रिकार्डों के आधार पर आयोग का यह समाधान हो गया है कि श्री प्रीथी राम मेघ अपने निर्वाचन व्यय के लेखे दाखिल करने में असफल रहे हैं और उनके पास ऐसा करने में असफल रहने के लिए कोई भी उचित कारण अथवा औचित्य नहीं है, और

अतः अब लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अनुसरण में भारत निर्वाचन आयोग एतद्वारा धोशणा करता है कि पंजाब राज्य के साधारण निर्वाचन, 2022 के 82-बलुआना ( अ0 जा0 ) विधान सभा निर्वाचन क्षेत्र से निर्वाचन लड़ने वाले अभ्यर्थी श्री प्रीथी राम मेघ, वीपीओ0 मलौट , तह0 मलौट जिला श्री मुक्तसर साहिब, पिन-152107 इस आदेष की तारीख से तीन वर्श की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य क्षेत्र की विधान सभा अथवा विधान परिशद का सदस्य चुने जाने अथवा होने के लिए निरर्हित होंगे।

O.N. 33.—WHEREAS, the General Election to Legislative Assembly of Punjab, 2022 for 82-Balluana (SC)Assembly Constituency was held in pursuance of the Election Commission of India Notification No. 464/PB- LA/2022, dated 25th January 2022; and

WHEREAS, the result of the election for 82-Balluana (SC) Assembly Constituency of Punjab, 2022 was declared by the Returning Officer on 10thMarch, 2022 and hence the last date for lodging the account of Election Expenses was 9th April, 2022; and

WHEREAS, as per the report dated 14th April, 2022,of the DEO, Fazilka under sub-rule (1)of Rule 89 of the Conduct of Elections Rules, 1961, received through the CEO, Punjab vide his letter No. Elec-2022 /R-8510 dated 26 April 2022 stating that Sh. Prithi Ram Megh a contesting candidate from 82-Balluana (SC) Assembly Constituency in General Election to Legislative Assembly of Punjab, 2022 has failed to lodge account of election expenses, as required under law; and

WHEREAS, on the basis of the said report of the District Election Officer, a Show-Cause notice No. 76/PB- LA/82/2022/CEMS-I, dated 15th June, 2022 was issued under sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India Sh. Prithi Ram Megh for not lodging of account of Election Expenses; and

WHEREAS, through the above said Show Cause Notice and under sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, Sh. Prithi Ram Megh was directed to submit representation in writing to the Commission explaining the reasons for not lodging the account and also to lodge account of election expenses with the District Election Officer, Fazilka District within 20 days from the date of receipt of the notice; and

WHEREAS, the District Election Officer, Fazilka in his report No. 2023/386 dated 06.04.2023 reported that the said notice was served toSh. Prithi Ram Megh on 08.07.2022; and

WHEREAS, the CEO, Punjab vide letter no Elect-2023-3550 dated 21st June, 2023

forwarded the District Election Officer, Fazilka Supplementary Report No. dated 6th April, 2023 and reported that Sh. Prithi Ram Megh has not submitted any representation of a statement of correct account of election expenses duly signed alongwith original vouchers etc. Further, after receipt of the said notice, Sh. Prithi Ram Meghhas neither furnished any reason nor explanation to the Election Commission of India, for failure to lodge the account as prescribed under law; and

WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that:-

"If the Election Commission is satisfied that a person-

(a) has failed to lodge an account of election expenses, within the time and in the manner required by or

under this Act, and

(b) has no good reason or justification for the failure,

the Election Commission shall, by order published in the Official Gazette, declare him to be disqualified and

any such person shall be disqualified for a period of three years from the date of the order.";

WHEREAS, on the basis of facts and available records, the Commission is satisfied that

Sh. Prithi Ram Meghhas failed to lodge account of election expenses and has no good reason or justification for the failure to do so; and

NOW, THEREFORE, in pursuance of Section 10A of the Representation of the People Act,1951, the Election Commission of India hereby declares Sh. Prithi Ram Megh VPO:Malout, Tehsil Malout, Distt. Sri Muktsar Sahib, Pin : 152107 and a contesting candidate in 82-Balluana(SC) Assembly Constituency of the State of Punjab in the General Election to the Legislative Assembly 2022 to be disqualified for being chosen as and for being a member of either House of the Parliament or the Legislative Assembly or the Legislative Council of a State or Union Territory for a period of three years from the date of this order.

यतः, पंजाब के 105-मलेरकोटला विधान सभा निर्वाचन क्षेत्र के साधारण निर्वाचन, 2022 परिणाम रिटर्निंग ऑफिसर द्वारा दिनांक 10 मार्च, 2022 को घोशित किया गया था और इस प्रकार निर्वाचन व्यय के लेखे दाखिल करने की अन्तिम तारीख 09 अपे्रल, 2022 थी; और

यतः, निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (1) के अंतर्गत, मुख्य निर्वाचन अधिकारी, पंजाब से दिनांक 26.04.2022 के पत्र सं0 ईएलईसी-2022/आर-8510 की रिपोर्ट के अनुसार श्री धर्मिन्दर सिंह, जो पंजाब के 105-मलेरकोटला विधानसभा निर्वाचन क्षेत्र, 2022 से निर्वाचन लड़ने वाले अभ्यर्थी हैं, जो अपने निर्वाचन व्यय का लेखा दाखिल करने में असफल रहे ह,ैं और

यतः मुख्य निर्वाचन अधिकारी, पंजाब ने पत्र सं0 ईएलईसी -2023/आर-3550 दिनांक 21.06.2023 के द्वारा जिला निर्वाचन अधिकारी, मलेरकोटला की अनुपूरक रिपोर्ट दिनांक 31.08..2023 अग्रेशित किया और बताया कि श्री धर्मिन्दर सिंह ने निर्वाचन व्यय का लेखा प्रस्तुत नहीं किया है। इसके अतिरिक्त, उक्त नोटिस की पावती के उपरांत, श्री धर्मिन्दर सिंह ने विधि के अंतर्गत यथा विहित लेखा दाखिल करने में अपनी असफलता के लिए भारत निर्वाचन आयोग को न तो कोई कारण बताया है और न ही कोई स्पश्टीकरण दिया है, और

यतः लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में यह उपबंधित किया गया है किः

WHEREAS, through the above said Show Cause Notice and under sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, Shri Dharminder Singh, was directed to submit representation in writing to the Commission explaining the reasons for not lodging the account and also to lodge account of election expenses with the District Election Officer, Malerkotla District within 20 days from the date of receipt of the notice; and

WHEREAS, the Chief Electoral Officer, Punjab vide his letter no. Elec.2023/R-3550 dated 21.06.2023 forwarded the report of the District Election Officer, Malerkotla dated 07.09.2022 wherein it was informed that notice was served to Shri Dharminder Singh, on 06 July, 2022; and

WHEREAS, the CEO, Punjab vide letter no ELEC-2023/R-3550, dated 21.06.2023 forwarded the District Election Officer, Malerkotla Supplementary Report dated 31.08.2022 and reported that Shri Dharminder Singh, has not submitted account of election expenses. Further, after receipt of the said notice, Shri Dharminder Singh, has neither furnished any reason nor explanation to the Election Commission of India, for failure to lodge the account as prescribed under law; and

यतः, हिमाचल प्रदेष के 27-सुंदरनगर विधान सभा निर्वाचन क्षेत्र के साधारण निर्वाचन, 2022 परिणाम रिटर्निंग ऑफिसर द्वारा दिनांक 08 दिसंबर, 2022 को घोशित किया गया था और इस प्रकार निर्वाचन व्यय के लेखे दाखिल करने की अन्तिम तारीख 07 जनवरी, 2023 थी, और

यतः, जिला निर्वाचन अधिकारी की उक्त रिपोर्ट के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (5) के अंतर्गत श्री हेत राम को अपने निर्वाचन व्यय के लेखे प्रस्तुत नहीं करने के लिए कारण बताओ नोटिस सं. 76/हिमा.-वि..स./27/2023/सी.ई.एम.एस.-1 दिनांक 12 जुलाई, 2023 जारी किया गया था, और

यतः मुख्य निर्वाचन अधिकारी, हिमाचल प्रदेष से दिनांक 08 अगस्त, 2023 के पत्र सं0 3-7/2023-ईएलएन-ईईएम-III के द्वारा प्राप्त जिला निर्वाचन अधिकारी, मंडी ने अपनी पत्र सं0 ईएलएन-एमएनडी-एफ(2)-1/2022-1-1594 दिनांक 7 अगस्त, 2023 में सूचित किया है कि उक्त कारण बताओ नोटिस श्री हेत राम को दिनांक 01.08.2023 को तामील किया गया था, और

यतः मुख्य निर्वाचन अधिकारी, हिमाचल प्रदेष ने पत्र सं0 3-7/2023-ईएलएन-ईईएम-III दिनांक 19.9.2023 के द्वारा जिला निर्वाचन अधिकारी, मंडी, की अनुपूरक रिपोर्ट सं. ईएलएन-एमएनडी-एफ(2)-1/2022-1-1819 दिनांक 25.08.2023 अग्रेशित किया और बताया कि श्री हेत राम ने निर्वाचन व्यय का लेखा प्रस्तुत नहीं किया है। इसके अतिरिक्त, उक्त नोटिस की पावती के उपरांत, श्री हेत राम ने विधि के अंतर्गत यथा विहित लेखा दाखिल करने में अपनी असफलता के लिए भारत निर्वाचन आयोग को न तो कोई कारण बताया है और न ही कोई स्पश्टीकरण दिया है, और

यतः लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में यह उपबंधित किया गया है किः

WHEREAS, through the above said Show Cause Notice and under sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, Shri Het Ram, was directed to submit representation in writing to the Commission explaining the reasons for not lodging the account and also to lodge account of election expenses with the District Election Officer, Mandi District within 20 days from the date of receipt of the notice; and

WHEREAS, the Chief Electoral Officer, Himachal Pradesh vide letter no. 3-7\2023-ELN-EEM-III dated 08.08.2023 forwarded the District Election Officer, Mandi Distt., vide his letter no. ELN-MND-F(2)- 1/2022-1-1594 Mandi-175001 dated 07-08-2023 has reported that the said notice was served to Shri Het Ram, on 01.08.2023; and

WHEREAS, the CEO, Himachal Pradesh vide letter no 3-7\2023-ELN-EEM-III-1361, dated 19.09.2023 forwarded the District Election Officer, Mandi Supplementary Report No . ELN-MND-F(2)-1/2022- 1-1819 dated 25.08.2022 and reported that Shri Het Ram has not submitted account of election expenses. Further, after receipt of the said notice, Shri Het Ram, has neither furnished any reason nor explanation to the Election Commission of India, for failure to lodge the account as prescribed under law; and84 THE GAZETTE OF INDIA : FEBRUARY 10, 2024/MAGHA 21, 1945 [PART II—SEC. 3(iii)] WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that:-

"If the Election Commission is satisfied that a person-

(a) has failed to lodge an account of election expenses, within the time and in the manner required by

or under this Act, and

(b) has no good reason or justification for the failure,

the Election Commission shall, by order published in the Official Gazette, declare him to be disqualified

and any such person shall be disqualified for a period of three years from the date of the order.";

WHEREAS, on the basis of facts and available records, the Commission is satisfied that Shri Het Ram, has failed to lodge account of election expenses and has no good reason or justification for the failure to do so; and

NOW, THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission of India hereby declares Shri Het Ram, Vill.-Mahwra, P.O.Seri Kothi, Teh.- Sundernagar, Distt. Mandi, Himachal Pradesh and a contesting candidate in 27-Sundernagar Assembly Constituency of General Election to the Legislative Assembly of Himachal Pradesh, 2022, to be disqualified for being chosen as and for being a member of either House of the Parliament or the Legislative Assembly or the Legislative Council of a State or Union Territory for a period of three years from the date of this order.

यतः, निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (1) के अंतर्गत, जिला निर्वाचन अधिकारी मंडी से दिनांक 10.01.2023 के पत्र सं0 ईएलएन-एमएनडी-एफ(2)-1/2022-1-93 की रिपोर्ट के अनुसार श्री रणविजय सिंह ,जो हिमाचल प्रदेष के 27-सुंदरनगर विधानसभा निर्वाचन क्षेत्र से निर्वाचन लड़ने वाले अभ्यर्थी हैं, विधि द्वारा यथापेक्षित रीति से अपने निर्वाचन व्यय के लेखे दाखिल करने में असफल रहे हैं और

यतः, जिला निर्वाचन अधिकारी की उक्त रिपोर्ट के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (5) के अंतर्गत श्री रणविजय सिंह को अपने निर्वाचन व्यय के लेखे प्रस्तुत नहीं करने के लिए कारण बताओ नोटिस सं. 76/हिमा.-वि..स./27/2023/सी.ई.एम.एस.-1 दिनांक 12 जुलाई, 2023 जारी किया गया था, और

यतः, उपर्युक्त कारण बताओ नोटिस के जरिए और निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (6) के अनुसार श्री रणविजय सिंह को लेखा प्रस्तुत न किए जाने संबंधी कारणों को स्पश्ट करते हुए, आयोग को अपना अभ्यावेदन लिखित रूप में प्रस्तुत करने और नोटिस के प्राप्त होने की तारीख से 20 दिनो के भीतर जिला निर्वाचन अधिकारी, मंडी को अपने निर्वाचन व्यय का पूर्ण लेखा प्रस्तुत करने का निदेष दिया गया था, और

यतः मुख्य निर्वाचन अधिकारी, हिमाचल प्रदेष से दिनांक 08 अगस्त, 2023 के पत्र सं0 3-7/2023-ईएलएन-ईईएम-III के द्वारा प्राप्त जिला निर्वाचन अधिकारी, मंडी ने अपनी पत्र सं0 ईएलएन-एमएनडी-एफ(2)-1/2022-1-1594 दिनांक 7 अगस्त, 2023 में सूचित किया है कि उक्त कारण बताओ नोटिस श्री रणविजय सिंह को दिनांक 02 अगस्त, 2023 को तामील किया गया था, और

यतः मुख्य निर्वाचन अधिकारी, हिमाचल प्रदेष ने पत्र सं0 3-7/2023-ईएलएन-ईईएम-III-1361 दिनांक 19.9.2023 के द्वारा जिला निर्वाचन अधिकारी, मंडी, की अनुपूरक रिपोर्ट सं. ईएलएन-एमएनडी-एफ(2)-1/2022-1-1819 दिनांक 25.08.2023 अग्रेशित85 [भाग II—खण्ड 3(iii)] भारत का राजपत्र : फरवरी 10, 2024/माघ 21, 1945 किया और बताया कि श्री रणविजय सिंह ने निर्वाचन व्यय का लेखा प्रस्तुत नहीं किया है। इसके अतिरिक्त, उक्त नोटिस की पावती के उपरांत, श्री रणविजय सिंह ने विधि के अंतर्गत यथा विहित लेखा दाखिल करने में अपनी असफलता के लिए भारत निर्वाचन आयोग को न तो कोई कारण बताया है और न ही कोई स्पश्टीकरण दिया है, और

यतः लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में यह उपबंधित किया गया है किः

"यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति

यतः, तथ्यों और उपलब्ध रिकार्डों के आधार पर आयोग का यह समाधान हो गया है कि श्री रणविजय सिंह, अपने निर्वाचन व्यय के लेखे दाखिल करने में असफल रहे हैं और उनके पास ऐसा करने में असफल रहने के लिए कोई भी उचित कारण अथवा औचित्य नहीं है, और

अतः अब लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अनुसरण में भारत निर्वाचन आयोग एतद्‌द्वारा धोशणा करता है कि हिमाचल प्रदेष राज्य के साधारण निर्वाचन, 2022 के 27-सुंदरनगर विधानसभा विधानसभा निर्वाचन क्षेत्र से निर्वाचन लड़ने वाले अभ्यर्थी श्री रणविजय सिंह,गांव घारण्डाडा0 मैरामसीत, तहसील-सुन्दरनगर,जिला-मंडी, हिमाचल प्रदेष इस आदेष की तारीख से तीन वर्श की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य क्षेत्र की विधानसभा अथवा विधान परिशद का सदस्य चुने जाने अथवा होने के लिए निरर्हित होंगे।

WHEREAS, on the basis of the said report of the District Election Officer, a Show-Cause notice No. 76/HP-LA/27/2023/CEMS-I, dated 12th July, 2023 was issued under sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India to Shri Ran Vijay Singh, for not lodging of account of Election Expenses; and

WHEREAS, through the above said Show Cause Notice and under sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, Shri Ran Vijay Singh, was directed to submit representation in writing to the Commission explaining the reasons for not lodging the account and also to lodge account of election expenses with the District Election Officer, Mandi District within 20 days from the date of receipt of the notice; and86 THE GAZETTE OF INDIA : FEBRUARY 10, 2024/MAGHA 21, 1945 [PART II—SEC. 3(iii)] WHEREAS, the Chief Electoral Officer, Himachal Pradesh vide letter no. 3-7\2023-ELN-EEM-III dated 08.08.2023 forwarded the District Election Officer, Mandi Distt., vide his letter no. ELN-MND-F(2)- 1/2022-1-1594 dated 07-08-2023 has reported that the said notice was served to Shri Ran Vijay Singh, on 02.08.2023; and

आ.अ. 38.—यतः भारत निर्वाचन आयोग द्वारा दिनांक 25 जनवरी, 2022 की अधिसूचना सं. 464/पंजाब-वि.स./2022 के

अनुसरण में पंजाब के 106-अमरगढ़ विधान सभा निर्वाचन क्षेत्र के लिए साधारण निर्वाचन, 2022 आयोजित किया गया था; और

यतः मुख्य निर्वाचन अधिकारी, पंजाब से दिनांक 21 जून, 2023 के पत्र सं0 ईएलईसी ईएलईसी -2023/आर-3550 द्वारा प्राप्त जिला निर्वाचन अधिकारी, मलेरकोटला ने अपने पत्र दिनांक 07 सितम्बर, 2022 में सूचित किया है कि उक्त कारण बताओ नोटिस श्री सतवीर सिंह शीरा बनभौरा को दिनांक 07 जुलाई, 2022 को तामील किया गया था, और

यतः मुख्य निर्वाचन अधिकारी, पंजाब ने पत्र सं0 ईएलईसी-2023/आर-3550 दिनांक 21.06.2023 के द्वारा जिला निर्वाचन अधिकारी, मलेरकोटला, की अनुपूरक रिपोर्ट दिनांक 31.08.2022 अग्रेशित किया और बताया कि श्री सतवीर सिंह शीरा बनभौरा ने निर्वाचन व्यय का लेखा प्रस्तुत नहीं किया है। इसके अतिरिक्त, उक्त नोटिस की पावती के उपरांत, श्री सतवीर सिंह शीरा बनभौरा, ने विधि के अंतर्गत यथा विहित लेखा दाखिल करने में अपनी असफलता के लिए भारत निर्वाचन आयोग को न तो कोई कारण बताया है और न ही कोई स्पश्टीकरण दिया है, और

यतः लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में यह उपबंधित किया गया है किः

"यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति

यतः, तथ्यों और उपलब्ध रिकार्डों के आधार पर आयोग का यह समाधान हो गया है कि श्री सतवीर सिंह शीरा बनभौरा,, अपने निर्वाचन व्यय के लेखे दाखिल करने में असफल रहे हैं और उनके पास ऐसा करने में असफल रहने के लिए कोई भी उचित कारण अथवा औचित्य नहीं है, और

अतः अब लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अनुसरण में भारत निर्वाचन आयोग एतद्‌द्वारा धोशणा करता है कि पंजाब राज्य के साधारण निर्वाचन, 2022 के 106-अमरगढ़ विधानसभा विधानसभा निर्वाचन क्षेत्र से निर्वाचन लड़ने वाले अभ्यर्थी श्री सतवीर सिंह शीरा बनभौरा, गांवः बनभौरा, तहसीलः अमरगढ़, जिलाः मलेरकोटला। इस आदेष की तारीख से तीन वर्श की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य क्षेत्र की विधानसभा अथवा विधान परिशद का सदस्य चुने जाने अथवा होने के लिए निरर्हित होंगे।

O.N. 38.—WHEREAS, the General Election to Legislative Assembly of Punjab, 2022 106-Amargarh Assembly Constituency was held in pursuance of the Election Commission of India vide Notification No. 464/PB- LA/2022, dated 25th January, 2022; and

WHEREAS, the result of the election for 106-Amargarh Assembly Constituency of Punjab, 2022 was declared by the Returning Officer on 10th March, 2022 and hence the last date for lodging the account of Election Expenses was 09th April, 2022; and

WHEREAS, as per the report no. Elec. 2022/R-8510, dated 26.04.2022 of the Chief Electoral Officer, Punjab under sub-rule (1) of Rule 89 of the Conduct of Elections Rules, 1961, received, Shri Satvir Singh Sheera Banbhaura, a contesting candidate from 106-Amargarh Assembly Constituency of Punjab, 2022 has failed to lodge account of election expenses, as required under law; and

WHEREAS, on the basis of the said report of the District Election Officer, a Show-Cause notice No. 76/PB-LA/106/2022/CEMS-I, dated 27th June, 2022 was issued under sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India to Shri Satvir Singh Sheera Banbhaura, for not lodging of account of Election Expenses; and

WHEREAS, through the above said Show Cause Notice and under sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, Shri Satvir Singh Sheera Banbhaura, was directed to submit representation in writing to the Commission explaining the reasons for not lodging the account and also to lodge account of election expenses with the District Election Officer, Malerkotla District within 20 days from the date of receipt of the notice; and

WHEREAS, the CEO, Punjab vide letter no ELEC-2023/R-3550, dated 21.06.2023 forwarded the District Election Officer, Malerkotla Supplementary Report dated 31.08.2022 and reported that Shri Satvir Singh Sheera Banbhaura, has not submitted account of election expenses. Further, after receipt of the said notice, Shri Satvir Singh Sheera Banbhaura, has neither furnished any reason nor explanation to the Election Commission of India, for failure to lodge the account as prescribed under law; and

WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that:-

"If the Election Commission is satisfied that a person-

(a) has failed to lodge an account of election expenses, within the time and in the manner required by or

under this Act, and

(b) has no good reason or justification for the failure,

the Election Commission shall, by order published in the Official Gazette, declare him to be disqualified

and any such person shall be disqualified for a period of three years from the date of the order.";

WHEREAS, on the basis of facts and available records, the Commission is satisfied that Shri Satvir Singh Sheera Banbhaura, has failed to lodge account of election expenses and has no good reason or justification for the failure to do so; and

NOW, THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission of India hereby declares Shri Satvir Singh Sheera Banbhaura,Vill. Banbhaura,Tehsil- Amargarh,Distt. Malerkotla and a contesting candidate in 106-Amargarh Assembly Constituency of General Election to the Legislative Assembly of Punjab, 2022, to be disqualified for being chosen as and for being a member of either House of the Parliament or the Legislative Assembly or the Legislative Council of a State or Union Territory for a period of three years from the date of this order.

आ.अ. 39.—यतः भारत निर्वाचन आयोग द्वारा दिनांक 17 अक्तूबर, 2022 की अधिसूचना सं0 464/ हि0प्र0-वि0स0 /2022 के अनुसरण में हिमाचल प्रदेष के 27-सुंदरनगर विधान सभा निर्वाचन क्षेत्र के लिए साधारण निर्वाचन, 2022 आयोजित किया गया था; और

यतः, निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (1) के अंतर्गत, जिला निर्वाचन अधिकारी मंडी से दिनांक 10.01.2023 के पत्र सं0 ईएलएन-एमएनडी-एफ(2)-1/2022-1-93 की रिपोर्ट के अनुसार श्री टेक चंद ,जो हिमाचल प्रदेष के 27-सुंदरनगर विधानसभा निर्वाचन क्षेत्र से निर्वाचन लड़ने वाले अभ्यर्थी हैं, विधि द्वारा यथापेक्षित रीति से अपने निर्वाचन व्यय के लेेखे दाखिल करने में असफल रहे हैं और

यतः, जिला निर्वाचन अधिकारी की उक्त रिपोर्ट के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (5) के अंतर्गत श्री टेक चंद को अपने निर्वाचन व्यय के लेखे प्रस्तुत नहीं करने के लिए कारण बताओ नोटिस सं. 76/हिमा.-वि..स./27/2023/सी.ई.एम.एस.-1 दिनांक 12 जुलाई, 2023 जारी किया गया था, और

यतः, उपर्युक्त कारण बताओ नोटिस के जरिए और निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (6) के अनुसार श्री टेक चंद को लेखा प्रस्तुत न किए जाने संबंधी कारणों को स्पश्ट करते हुए, आयोग को अपना अभ्यावेदन लिखित रूप में प्रस्तुत करने और नोटिस के प्राप्त होने की तारीख से 20 दिनो के भीतर जिला निर्वाचन अधिकारी, मंडी को अपने निर्वाचन व्यय का पूर्ण लेखा प्रस्तुत करने का निदेष दिया गया था, और

यतः मुख्य निर्वाचन अधिकारी, हिमाचल प्रदेष से दिनांक 08 अगस्त, 2023 के पत्र सं0 3-7/2023-ईएलएन-ईईएम-III के द्वारा प्राप्त जिला निर्वाचन अधिकारी, मंडी ने अपनी पत्र सं0 ईएलएन-एमएनडी-एफ(2)-1/2022-1-1594 दिनांक 7 अगस्त, 2023 में सूचित किया है कि उक्त कारण बताओ नोटिस श्री टेक चंद, को दिनांक 22.7.2023 को तामील किया गया था, और

यतः मुख्य निर्वाचन अधिकारी, हिमाचल प्रदेष ने पत्र सं0 3-7/2023-ईएलएन-ईईएम-III दनांक 19.9.2023 के द्वारा जिला निर्वाचन अधिकारी, मंडी, की अनुपूरक रिपोर्ट सं. ईएलएन-एमएनडी-एफ(2)-1/2022-1-1819 दिनांक 25.08.2023 अग्रेशित किया और बताया कि श्री टेक चंद ने निर्वाचन व्यय का लेखा प्रस्तुत नहीं किया है। इसके अतिरिक्त, उक्त नोटिस की पावती के उपरांत, श्री टेक चंद ने विधि के अंतर्गत यथा विहित लेखा दाखिल करने में अपनी असफलता के लिए भारत निर्वाचन आयोग को न तो कोई कारण बताया है और न ही कोई स्पश्टीकरण दिया है, और

यतः लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में यह उपबंधित किया गया है किः

WHEREAS, on the basis of the said report of the District Election Officer, a Show-Cause notice No. 76/HP-LA/27/2023/CEMS-I, dated 12th July, 2023 was issued under sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India to Shri Tek Chand, for not lodging of account of Election Expenses; and

WHEREAS, through the above said Show Cause Notice and under sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, Shri Tek Chand, was directed to submit representation in writing to the Commission explaining the reasons for not lodging the account and also to lodge account of election expenses with the District Election Officer, Mandi District within 20 days from the date of receipt of the notice; and

WHEREAS, the CEO, Himachal Pradesh vide letter no 3-7\2023-ELN-EEM-III-1361, dated 19.09.2023 forwarded the District Election Officer, Mandi Supplementary Report No . Further, after receipt of the said notice, Shri Tek Chand, has neither furnished any reason nor explanation to the Election Commission of India, for failure to lodge the account as prescribed under law; and

आ.अ. 40.—यतः, उत्तर प्रदेश राज्य की 377-जहूराबाद विधान सभा क्षेत्र के साधारण निर्वाचन 2022 की घोषणा अधिसूचना नं. 99/61-2022 दिनांक 10.02.2022 के जरिए की गई थी।

यतः लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 78 के अनुसार, निर्वाचन लड़ने वाले प्रत्येक अभ्यर्थी को, निर्वाचित अभ्यर्थी के निर्वाचन की तारीख से 30 दिनों के भीतर निर्वाचन व्यय के अपने लेखे की सही प्रति जिला निर्वाचन अधिकारी को दाखिल करनी होती है; और

यतः 377-जहूराबाद विधान सभा निर्वाचन क्षेत्र के रिर्टनंिग अधिकारी द्वारा उक्त निर्वाचन का परिणाम 10 मार्च, 2022 को घोषित किया गया था। इस प्रकार, निर्वाचन व्यय का लेखा दाखिल करने की अन्तिम तारीख 09 अप्रैल, 2022 थी; और

यतः, जिला निर्वाचन अधिकारी, गाजीपुर, उत्तर प्रदेश के द्वारा प्रस्तुत और संयुक्त मुख्य निर्वाचन अधिकारी,उत्तर प्रदेश द्वारा पत्र सं. 287/निर्वाचन व्यय सेल/वि0स0सा0नि0-2022/पत्रा0-01/2021 के जरिए अग्रेषित दिनांक 27/04/2022 की रिपोर्ट के अनुसार श्री अरविन्द जो उत्तर प्रदेशविधान सभा का साधारण निर्वाचन 2022 के निर्वाचन क्षेत्र 377-जहूराबाद से लड़ने वाले अभ्यर्थी हैं, विधि द्वारा यथापेक्षित रीति से अपने निर्वाचन व्यय का कोई भी लेखा दाखिल करने में विफल रहे हैं; और,

यतः, जिला निर्वाचन अधिकारी, गाजीपुर, उत्तर प्रदेश, और मुख्य निर्वाचन अधिकारी, उत्तर प्रदेश की उक्त रिपोटों के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम 1961 के नियम 89 के उप नियम (5) के अंतर्गत निर्वाचन व्यय प्रस्तुत नहीं करने के लिए श्री अरविन्द को कारण बताओ नोटिस सं. 76/उत्तर प्रदेश- वि.स./2022/सी.ई.एम.एस.-III, दिनांक 23 नवंबर, 2022 जारी किया गया था; और

यतः, निर्वाचनों का संचालन नियम 1961 के नियम 89 के उप-नियम (6) के अनुसार, दिनांक 23 नवम्बर, 2022 के उपयु र्क्त कारण बताओ नोटिस के जरिए श्री अरविन्द को निदेश दिया गया था कि वे इस नोटिस के प्राप्त होने के 20 दिनों के अंदर लेखा न प्रस्तुत कर पाने के कारणों को स्पष्ट करते हुए लिखित रूप में अपना अभ्यावेदन प्रस्तुत करें और साथ ही, निर्वाचन व्यय का अपना लेखा दाखिल करें; और

यतः, जिला निर्वाचन अधिकारी, गाजीपुर द्वारा अपने दिनांक 20.07.2023 के पत्र संख्या 432/निर्वाचन- नोटिस तामिला/11 के जरिए आयोग को सूचना दी गई की उक्त नोटिस अभ्यर्थी के भतीजे श्री मुके श कु मार द्वारा दिनांक 22.12.2022 को प्राप्त किया गया था; और,

यतः, जिला निर्वाचन अधिकारी, गाजीपुर द्वारा दिनांक 09.10.2023 के पत्र संख्या 685/निर्वाचन-नोटिस तामिला/11 के जरिए प्रस्तुत की गई अनुपूरक संवीक्षा रिपोर्ट में यह बताया गया है कि श्री अरविन्द ने न तो कोई भी अभ्यावेदन और न ही अपने निर्वाचन व्यय का लेखा दाखिल किया है। इसके अतिरिक्त उन्होंने भारत निर्वाचन आयोग का सम्यक् नोटिस मिलने के उपरांत उक्त विफलता के लिए न तो कोई कारण बताया है और न ही कोई स्पष्टीकरण दिया है;

और,

यतः, आयोग का यह समाधान हो गया है कि श्री अरविन्द निर्वाचन खचों का लेखा दाखिल करने में विफल रहे हैं और उनके पास इस विफलता के लिए कोई भी उचित कारण अथवा औचित्य नहीं है; और

यत:, लोक प्रतिनिधित्व अधिनियम,1951 की धारा 10क में अनुबंधित किया गया है कि:-

"यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति -94 THE GAZETTE OF INDIA : FEBRUARY 10, 2024/MAGHA 21, 1945 [PART II—SEC. 3(iii)] (क) निर्वाचन व्ययों का लेखा उस समय के भीतर और उस रीति में जैसी इस अधिनियम के द्वारा या अधीन अपेक्षित है, दाखिल करने में असफल रहा है; तथा

(ख) उस असफलता के लिए कोई अच्छा कारण या न्यायोचित्य नहीं रखता है, तो निर्वाचन आयोग शासकीय राजपत्र में प्रकाशित आदेश द्वारा उसको निर्रर्हत घोषित करेगा और ऐसा व्यक्ति उस आदेश की तारीख से तीन वर्ष की कालावधि के लिए निर्रर्हत होगा;

अतः, अब लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अनुसरण में भारत निर्वाचन आयोग एतद्द्वारा घोषणा करता है कि उत्तर प्रदेश राज्य के 377-जहूराबाद विधान सभा निर्वाचन क्षेत्र से उत्तर प्रदेश राज्य में विधान सभा के साधारण निर्वाचन, 2022 में निर्वाचन लड़ने वाले अभ्यर्थी श्री अरविन्द निवासी ग्राम- जगदीशपुर, पोस्ट – औदी, जिला – बलिया को इस आदेश की तारीख से तीन वर्ष की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य-क्षेत्र की विधान सभा अथवा विधान परिषद् का सदस्य चुने जाने अथवा होने के लिए निर्रर्हत है।

O.N. 40.—WHEREAS, the General Election to 377-Zahoorabad Legislative Assembly of Uttar Pradesh, 2022 was announced vide Notification No. 99/61-2022 dated 10th February, 2022.

WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate at an election has to, within 30 days from the date of election of the returned candidate, lodge a true copy of the account of his election expenses with the District Election Officer; and,

WHEREAS, the result of the said election along with 377-Zahoorabad Assembly Constituency was declared by the concerned Returning Officer on 10th March, 2022. Hence, the last date for lodging the account of Election Expenses was 09th April, 2022; and,

WHEREAS, as per the report submitted by the District Election Officer, Ghazipur, Uttar Pradesh and forwarded by the Joint Chief Electoral Officer, Uttar Pradesh vide their letter No. 287/NirvachanVayy Cell/GE- LA/2022/Patra-01/2021, dated 27th April, 2022, Shri Arvind, a contesting candidate of Uttar Pradesh from 377- Zahoorabad Assembly Constituency of Uttar Pradesh, has failed to lodge account of his election expenses, in the manner, as required under law; and,

WHEREAS, on the basis of the reports of the District Election Officer, Ghazipur, Uttar Pradesh and the Chief Electoral Officer, Uttar Pradesh, a Show-Cause notice,76/UP-LA/2022/CEMS-III dated 23.11.2022 was issued under sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India to Shri Arvind for not lodging the account of Election Expenses; and,

WHEREAS, As per the sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, through the above said Show-Cause Notice, dated 23.11.2022 Shri Arvind was directed to submit his representation in writing with explaining the reasons for not lodging the account and to lodge account of election expenses within 20 days from the date of receipt of the notice; and,

WHEREAS, the said notice was received by Sh. Mukesh Kumar, Nephew of the candidate on 22.12.2022. The acknowledgment receipt has been submitted to the Commission by the District Election Officer, Ghazipur vide

its letter no. 432/र्नविाचि-ोिटसि तवमलिव/11dated 20.07.2023 and,

WHEREAS, the District Election Officer, Ghazipur in his Supplementary Report, vide its letter No.

Further, after receipt of the due notice of the Election Commission of India, he has furnished neither any reason nor explanation for the said failure; and, WHEREAS, the Commission is satisfied that Shri Arvind has failed to lodge the account of election expenses and has no good reason or justification for the failure,

WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that:-

"If the Election Commission is satisfied that a person-

(a) has failed to lodge an account of election expenses, within the time and in the manner required by

or under this Act, and

(b has no good reason or justification for the failure,

the Election Commission shall, by order published in the Official Gazette, declare him to be disqualified and

आ.अ. 41.—यतः, उत्तर प्रदेश राज्य की 379-जमानियां विधान सभा क्षेत्र के साधारण निर्वाचन 2022 की घोषणा अधिसूचना नं. 99/61-2022 दिनांक 10.02.2022 के जरिए की गई थी।

यतःलोक प्रतिनिधित्व अधिनियम, 1951 की धारा 78 के अनुसार, निर्वाचन लड़ने वाले प्रत्येक अभ्यर्थी को, निर्वाचित अभ्यर्थी के निर्वाचन की तारीख से 30 दिनों के भीतर निर्वाचन व्यय के अपने लेखे की सही प्रति जिला निर्वाचन अधिकारी को दाखिल करनी होती है; और

यतः 379-जमानियां विधान सभा निर्वाचन क्षेत्र के रिर्टनंिग अधिकारी द्वारा उक्त निर्वाचन का परिणाम 10 मार्च, 2022 को घोषित किया गया था। इस प्रकार, निर्वाचन व्यय का लेखा दाखिल करने की अन्तिम तारीख 09 अप्रैल, 2022 थी; और

यतः, जिला निर्वाचन अधिकारी, गाजीपुर उत्तर प्रदेश के द्वारा प्रस्तुत और संयुक्त मुख्य निर्वाचन अधिकारी, उत्तर प्रदेश द्वारा पत्र सं. 287/निर्वाचन व्यय सेल/वि0स0सा0नि0-2022/पत्रा0-01/2021 के जरिए अग्रेषित दिनांक 27/04/2022 की रिपोर्ट के अनुसार श्रीमती सीमा देवी जो उत्तर प्रदेश विधान सभा का साधारण निर्वाचन 2022 के निर्वाचन क्षेत्र 379-जमानियां से लड़ने वाले अभ्यर्थी हैं, विधि द्वारा यथापेक्षित रीति से अपने निर्वाचन व्यय का कोई भी लेखा दाखिल करने में विफल रहे हैं; और,

यतः, जिला निर्वाचन अधिकारी, गाजीपुर, उत्तर प्रदेश, और मुख्य निर्वाचन अधिकारी, उत्तर प्रदेश की उक्त रिपोटों के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम 1961 के नियम 89 के उप नियम (5) के अंतर्गत निर्वाचन व्यय प्रस्तुत नहीं करने के लिए श्रीमती सीमा देवी को कारण बताओ नोटिस सं. 76/उत्तरप्रदेश- वि.स./2022/सी.ई.एम.एस.-III, दिनांक 23 नवम्बर, 2022 जारी किया गया था; और

यतः, निर्वाचनों का संचालन नियम 1961 के नियम 89 के उप-नियम (6) के अनुसार, दिनांक 23 नवम्बर, 2022 के उपयु र्क्त कारण बताओ नोटिस के जरिए श्रीमती सीमा देवी को निदेश दिया गया था कि वे इस नोटिस के प्राप्त होने के 20 दिनों के अंदर लेखा न प्रस्तुत कर पाने के कारणों को स्पष्ट करते हुए लिखित रूप में अपना अभ्यावेदन प्रस्तुत करें और साथ ही, निर्वाचन व्यय का अपना लेखा दाखिल करें; और

यतः, जिला निर्वाचन अधिकारी, गाजीपुर द्वारा अपने दिनांक 20.07.2023 के पत्र संख्या 432/निर्वाचन- नोटिस तामिला/11 के जरिए आयोग को सूचना दी गई की उक्त नोटिस अभ्यर्थी द्वारा दिनांक 26.11.2022 एवं 21-05- 2023 को प्राप्त किया गया था; और,

यतः, जिला निर्वाचन अधिकारी, गाजीपुर द्वारा दिनांक 09.10.2023 के पत्र संख्या 685/निर्वाचन-नोटिस तामिला/11 के जरिए प्रस्तुत की गई अनुपूरक संवीक्षा रिपोर्ट में यह बताया गया है कि श्रीमती सीमा देवी ने न तो कोई भी अभ्यावेदन और न ही अपने निर्वाचन व्यय का लेखा दाखिल किया है। इसके अतिरिक्त उन्होंने भारत निर्वाचन आयोग का सम्यक् नोटिस मिलने के उपरांत उक्त विफलता के लिए न तो कोई कारण बताया है और न ही कोई स्पष्टीकरण दिया है; और,

यतः, आयोग का यह समाधान हो गया है कि श्रीमती सीमा देवी निर्वाचन खचों का लेखा दाखिल करने में विफल रहे हैं और उनके पास इस विफलता के लिए कोई भी उचितकारण अथवा औचित्य नहीं है; और

यत:, लोक प्रतिनिधित्व अधिनियम,1951 की धारा 10क में अनुबंधित किया गया है कि:-

"यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति -

(क) निर्वाचन व्ययों का लेखा उस समय के भीतर और उस रीति में जैसी इस अधिनियम के द्वारा या अधीन अपेक्षित है, दाखिल करने में असफल रहा है; तथा

O.N. 41.—WHEREAS, the General Election to 379-Zamania Legislative Assembly of Uttar Pradesh, 2022 was announced vide Notification No. 99/61-2022 dated 10th February, 2022.

WHEREAS, the result of the said election along with 379-Zamania Assembly Constituency was declared by the concerned Returning Officer on 10th March, 2022. Hence, the last date for lodging the account of Election Expenses was 09th April, 2022; and,

WHEREAS, as per the report submitted by the District Election Officer, Ghazipur, Uttar Pradesh and forwarded by the Joint Chief Electoral Officer, Uttar Pradesh vide their letter No. 287/NirvachanVayy Cell/GE- LA/2022/Patra-01/2021, dated 27th April, 2022, Smt. Seema Devi, a contesting candidate of Uttar Pradesh from 379-Zamania Assembly Constituency of Uttar Pradesh, has failed to lodge account of his election expenses, in the manner, as required under law; and,

WHEREAS, on the basis of the reports of the District Election Officer, Ghazipur, Uttar Pradesh and the Chief Electoral Officer, Uttar Pradesh, a Show-Cause notice,76/UP-LA/2022/CEMS-III dated 23rd November, 2022 was issued under sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India to Smt. Seema Devi for not lodging the account of Election Expenses; and,

WHEREAS, As per the sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, through the above said Show-Cause Notice, dated 23.11.2022, Smt. Seema Devi was directed to submit his representation in writing with explaining the reasons for not lodging the account and to lodge account of election expenses within 20 days from the date of receipt of the notice; and,

WHEREAS, the said notice was received by the candidate on 26.11.2022 and 21.05.2023. The acknowledgment receipt has been submitted to the Commission by the District Election Officer, Ghazipur, vide its letter no.432/र्नविाचि-ोिटसि तवमलिव/11 dated 20.07.2023 ; and,97 [भाग II—खण्ड 3(iii)] भारत का राजपत्र : फरवरी 10, 2024/माघ 21, 1945 WHEREAS, the District Election Officer, Ghazipur in his Supplementary Report, vide its letter No. 685/र्नविाचि-ोिटसि तवमलिव/11 dated 09.10.2023 has reported that Smt. यत:, जिला निर्वाचन अधिकारी,भरक द्वारा प्रस्तुत अपनी अनुपूरक रिपोर्ट पत्र सं0 761/Elec दिनांक 01 नवम्बर, 2023 जो मुख्य निर्वाचन अधिकारी, उड़ीसा पत्र सं0 VE(A)75/2022-11241/Elec. दिनांक 6 नवम्बर, 2023 के द्वारा अग्रेषित कर भेजी गई रिपोर्ट में यह बताया गया है कि श्री बाबा हरेकृ ष्ण सेठी ,ने भारत निर्वाचन आयोग के दिनांक 19 जनवरी, 2023 के कारण बताओ नोटिस की प्राप्ति के बाद भी न तो कोई अभ्यावेदन और न ही अपने निर्वाचन व्यय के खाते का कोई विवरण प्रस्तुत किया है; और

यत:, उक्त नोटिस प्राप्त होने के बाद, श्री बाबा हरेकृ ष्ण सेठी ने कानून के तहत निर्धारित खाते को दर्ज करने में विफलता के लिए भारत के चुनाव आयोग को न तो कोई कारण और न ही कोई स्पष्टीकरण प्रस्तुत किया है; और

यत:, तथ्यों और उपलब्ध अभिलेखों के आधार पर आयोग का यह समाधान हो गया है कि श्री बाबा हरेकृ ष्ण सेठी अपने निर्वाचन व्यय का लेखा दाखिल करने में असफल रहे हैं और उनके पास इस विफलता के लिए कोई भी उचित कारण अथवा औचित्य नहीं है; और

यत:, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में यह उपबंधित किया गया है कि:-

''यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति-

(ख) उस असफलता के लिए कोई अच्छा कारण या न्यायोचित्य नहीं रखता है,तो निर्वाचन आयोग शासकीय राजपत्र में प्रकाशित आदेश द्वारा उसको निर्रर्हत घोषित करेगा और ऐसा व्यक्ति उस आदेश की तारीख से तीन वर्ष की कालावधि के लिए निर्रर्हत होगाI"

WHEREAS, the result of the said election for 46- Dhamnagar (SC) Assembly Constituency of Odisha, was declared by the Returning Officer on 6th November, 2022 and hence the last date for lodging the account of Election Expenses was 5th December, 2022; and

WHEREAS, as per the report submitted by CEO, Odisha vide their letter no. VE(A)-75/2022-10078/Elec. dated 23rd December, 2022 Sh. Baba Harekrushna Sethy, a contesting candidate from 46- Dhamnagar (SC) Assembly Constituency of Odisha, 2022 has failed to lodge account of his election expenses, as required under law; and

WHEREAS, on the basis of the said reports of the District Election Officer, a Show-Cause notice No. 76/OD-LA (Bye)/2021/CEMS-IV dated 19th January, 2023 was issued under sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India to Sh. Baba Harekrushna Sethy, for not lodging of account of Election Expenses; and

WHEREAS, through the above said Show Cause Notice and under sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, Sh. Baba Harekrushna Sethy, was directed to submit his representation in writing to the Commission explaining the reasons for not lodging the account and also to lodge account of election expenses with the District Election Officer, Bhadrak, within 20 days from the date of receipt of the notice; and

WHEREAS, as per the report submitted by the DEO, Bhadrak vide letter no. 91/Elec dated 08.02.2023 and forwarded by the Chief Electoral Officer, Odisha, vide his letter no. VE(A)75/2022-1398/Elec. Dated 13th February, 2023 has informed that said notice was served to Sh. Baba Harekrushna Sethy on 29.01.2023; and

WHEREAS, the District Election Officer, Bhadrak in his supplementary report vide letter no. 761/Elec dated 01.11.2023 forwarded by the Chief Electoral Officer, Odisha vide his letter No. VE(A)75/2022-11241/Elec. Dated 6th November, 2023 has reported that Sh. Baba Harekrushna Sethy has neither submitted any representation nor any statement of account of election expenses even after receipt of the Show Cause Notice dated 19th January, 2023 of the Election Commission of India; and

WHEREAS, after receipt of the said notice, Sh. Baba Harekrushna Sethy has neither furnished any reason nor any explanation to the Election Commission of India, for failure to lodge the account of election expenses as prescribed to do so; and

WHEREAS, on the basis of facts and available records, the Commission is satisfied that Sh. Baba Harekrushna Sethy has failed to lodge account of election expenses and has not furnished any reason or justification for the failure to do so; and

WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that:-

"If the Election Commission is satisfied that a person-

(a) has failed to lodge an account of election expenses, within the time and in the manner required by or

under this Act, and

आ.अ. 44.—यतः, भारत निर्वाचन आयोग की अधिसूचना सं. 464/के टी-एलए/2023 दिनांक 13 अप्रैल, 2023 के अनुसरण में 125-चिक्कामगलुरु विधान सभा निर्वाचन क्षेत्र के लिए कर्नाटक विधान सभा का साधारण निर्वाचन, 2023 आयोजित किया गया था; और

यत:, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 78 के अनुसार, किसी भी निर्वाचन में निर्वाचन लड़ने वाला प्रत्येक अभ्यर्थी, निर्वाचित अभ्यर्थी के निर्वाचन की तारीख से 30 दिनों के भीतर अपने निर्वाचन व्यय के लेखे जिला निर्वाचन अधिकारी के पास दाखिल करेगा जो उक्त अधिनियम की धारा 77 के अन्तर्गत उसके द्वारा या उसके निर्वाचन अभिकर्ता द्वारा रखे गए लेखे की एक सत्य प्रति होगी; और

यतः, कर्नाटक के 125-चिक्कामगलुरु विधानसभा निर्वाचन क्षेत्र के लिए निर्वाचन, 2023 का परिणाम, रिर्टनंिग अधिकारी द्वारा 13 मई, 2023 को घोषित किया गया था और इस प्रकार निर्वाचन व्यय के लेखे दाखिल करने की अन्तिम तारीख 12 जून, 2023 थी; और

यतः, निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (1) के अंतर्गत, मुख्य निर्वाचन अधिकारी, कर्नाटक से उनके दिनांक 26.06.2023 के पत्र सं. DPAR 16 CHUVEBA (Addl CEO-1) 2023 के तहत प्राप्त जिला निर्वाचन अधिकारी, चिक्कामगलुरु की रिपोर्ट दिनांक 14.06.2023 के अनुसार, बी. एम. थिम्माशेट्टी, जो कर्नाटक के 125-चिक्कामगलुरु विधान सभा निर्वाचन क्षेत्र, 2023 से निर्वाचन लड़ने वाला अभ्यर्थी हैं, विधि के अंतर्गत यथापेक्षित रीति से अपने निर्वाचन व्यय के लेखे दाखिल करने में असफल रहा हैं; और

यतः, जिला निर्वाचन अधिकारी, चिक्कामगलुरु की उक्त रिपोर्ट के आधार पर, भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (5) के अंतर्गत बी. एम. थिम्माशेट्टी को अपने निर्वाचन व्यय के लेखे प्रस्तुत नहीं करने के लिए कारण बताओ नोटिस सं. 76/के टी-एलए/10/2023/सीईएमएस-II, दिनांक 20 सितंबर, 2023 जारी किया गया था; और

यत:, उपयु र्क्त उक्त कारण बताओ नोटिस के जरिए और निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (6) के अंतर्गत, बी. एम. थिम्माशेट्टी को लेखा दाखिल न किए जाने संबंधी कारणों को स्पष्ट करते हुए आयोग को अपना अभ्यावेदन लिखित रूप में प्रस्तुत करने और नोटिस के प्राप्त होने की तारीख से 20 दिनों के भीतर जिला निर्वाचन अधिकारी, चिक्कामगलुरु जिला को अपने निर्वाचन व्यय के लेखे प्रस्तुत करने का निदेश दिया गया था; और

यत:, जिला निर्वाचन अधिकारी, चिक्कामगलुरु जिला ने अपनी रिपोर्ट सं. E1N(1) CR 57 /2023-24 दिनांक 16.10.2023 में सूचित किया है कि उक्त कारण बताओ नोटिस बी. एम. थिम्माशेट्टी को दिनांक 24.09.2023 को तामील किया गया था; और

यत:, जिला निर्वाचन अधिकारी, चिक्कामगलुरु ने अभ्यर्थी के संबंध में अनुपूरक रिपोर्ट सं. E1N(1) CR 57 /2023-24 दिनांक 16.10.2023 जोकि मुख्य निर्वाचन अधिकारी के पत्र सं. DPAR/16/CHUVEBHA (Addl.CEO- 1) 2023 दिनांक 16.10.2023 के द्वारा प्राप्त हुई, में सूचित किया है कि बी. एम. थिम्माशेट्टी ने निर्वाचन व्यय के लेखे का कोई विवरण या अभ्यावेदन प्रस्तुत नहीं किया है। इसके अतिरिक्त, उक्त नोटिस मिलने के उपरांत, बी. एम.

थिम्माशेट्टी ने विधि के अंतर्गत यथा-विहित लेखा दाखिल करने में अपनी असफलता के लिए भारत निर्वाचन आयोग को न तो कोई कारण बताया है और न ही कोई स्पष्टीकरण दिया है; और

यत:, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में यह उपबंधित किया गया है कि:-

''यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व् यक्ति-

(क) निर्वाचन व्ययों का लेखा उस समय के भीतर और उस रीति में जैसी इस अधिनियम के द्वारा या अधीन अपेक्षित है ,दाखिल करने में असफल रहा है; तथा

(ख) उस असफलता के लिए कोई अच्छा कारण या न्यायोचित्य नहीं रखता है ,

तो निर्वाचन आयोग शासकीय राजपत्र में प्रकाशित आदेश द्वारा उसको निर्रर्हत घोषित करेगा और ऐसा व् यक्ति उस आदेश की तारीख से तीन वर्ष की कालावधि के लिए निर्रर्हत होगा।";

यत:, तथ्यों और उपलब्ध रिकाडों के आधार पर, आयोग का यह समाधान हो गया है कि बी. एम. थिम्माशेट्टी अपने निर्वाचन व्यय के लेखे दाखिल करने में असफल रहे हैं और उनके पास ऐसा करने में असफल रहने के लिए कोई भी उचित कारण अथवा औचित्य नहीं है; और

अत:, अब, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अनुसरण में, भारत निर्वाचन आयोग एतद्द्वारा घोषणा करता है कि कर्नाटक के 125-चिक्कामगलुरु विधान सभा निर्वाचन क्षेत्र के लिए साधारण निर्वाचन, 2023 में निर्वाचन लड़ने वाले अभ्यर्थी, बी. एम. थिम्माशेट्टी, निवासी- बेलावाड़ी (पोस्ट) लाक्या (होबली) चिकमगलूर तालुक और जिला, इस आदेश की तारीख से तीन वर्ष की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य क्षेत्र की विधान सभा अथवा विधान परिषद का सदस्य चुने जाने अथवा होने के लिए निर्रर्हत होंगे।

O.N. 44.—WHEREAS, the General Election to Legislative Assembly of Karnataka, 2023 for 125- Chikmagaluru Assembly Constituency was held in pursuance of the Election Commission of India Notification No. 464/KT-LA/2023, dated 13th April, 2023; and

WHEREAS, as per the report of the DEO, Chikmagaluru dated 14.06.2023 under sub-rule (1) of Rule 89 of the Conduct of Elections Rules, 1961 received through the CEO, Karnataka vide his letter no. DPAR 16 CHUVEBA (Addl CEO-1) 2023, dated 26.06.2023 stating that B. M. Thimma Shetty, a contesting candidate from 125-Chikmagaluru Assembly Constituency in General Election to Legislative Assembly of Karnataka, 2023 has failed to lodge the account of his election expenses, as required under law; and

WHEREAS, on basis of the said report of the District Election Officer, Chikmagaluru a Show-Cause Notice No. 76/KT-LA/10/2023/CEMS-II, dated 20th September, 2023 was issued under sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India to B. M. Thimma Shetty, for not lodging of the account of Election Expenses; and

WHEREAS, through the above said Show Cause Notice and under sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, B. M. Thimma Shetty was directed to submit representation in writing to the Commission explaining the reasons for not lodging the account and also to lodge the account of his election expenses with the District Election Officer, Chikmagaluru District within 20 days from the date of receipt of the notice; and

WHEREAS, the DEO, Chikmagaluru in his report no. E1N(1) CR 57 /2023-24; dated 16.10.2023 has reported that the said Show Cause Notice was served to B. M. Thimma Shetty on 24.09.2023; and102 THE GAZETTE OF INDIA : FEBRUARY 10, 2024/MAGHA 21, 1945 [PART II—SEC. 3(iii)] WHEREAS, the District Election Officer, Chikmagaluru in his Supplementary Report vide no. E1N(1) CR 57 /2023-24; dated 16.10.2023 on account of the candidate received through CEO, Karnataka letter No. DPAR/16/CHUVEBHA (Addl. CEO-1) 2023; dated 16.10.2023, has reported that B. M. Thimma Shetty has not submitted any representation or statement of account of election expenses. Further, after receipt of the said notice, B. M. Thimma Shetty has neither furnished any reason nor explanation to the Election Commission of India for failure to lodge the account of his election expenses as prescribed under law; and

WHEREAS, Section 10A of the Representation of the People Act, 1951 provides that:-

"If the Election Commission is satisfied that a person-

(a) has failed to lodge an account of election expenses, within the time and in the manner required by or

under this Act, and

(b) has no good reason or justification for the failure,

the Election Commission shall, by order published in the Official Gazette, declare him to be disqualified

and any such person shall be disqualified for a period of three years from the date of the order.";

WHEREAS, on basis of the facts and available records, the Commission is satisfied that B. M. Thimma Shetty has failed to lodge the account of his election expenses and has no good reason or justification for the failure to do so; and

NOW, THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission of India hereby declares B. M. Thimma Shetty, resident of Belawadi (Post) Lakya (Hobli) Chikmagalur Taluk and District and a contesting candidate from 125-Chikkamagaluru Assembly Constituency of G.E. to LA of Karnataka, 2023, to be disqualified for being chosen as and for being a member of either House of the Parliament or the Legislative Assembly or the Legislative Council of a State or Union Territory for a period of three years from the date of this order.

यत:, उपयु र्क्त उक्त कारण बताओ नोटिस के जरिए और निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (6) के अंतर्गत, नारायण वेंकनागौड़ा पाटिल को लेखा दाखिल न किए जाने संबंधी कारणों को स्पष्ट करते हुए आयोग को अपना अभ्यावेदन लिखित रूप में प्रस्तुत करने और नोटिस के प्राप्त होने की तारीख से 20 दिनों के भीतर जिला निर्वाचन अधिकारी, हावेरी जिला को अपने निर्वाचन व्यय के लेखे प्रस्तुत करने का निदेश दिया गया था; और

यत:, जिला निर्वाचन अधिकारी, हावेरी जिला ने अपनी रिपोर्ट सं. ELN/CR-20/2023-24 दिनांक 30.12.2023 में सूचित किया है कि उक्त कारण बताओ नोटिस नारायण वेंकनागौड़ा पाटिल को दिनांक 28.11.2023 को तामील किया गया था; और

यत:, जिला निर्वाचन अधिकारी, हावेरी ने अपनी अनुपूरक रिपोर्ट सं. ELN/CR-20/2023-24 दिनांक 30.10.2023 जोकि मुख्य निर्वाचन अधिकारी, कर्नाटक के पत्र सं. DPAR/22/Chuvebha(Addl.CEO-1) 2023 दिनांक 02.01.2024 द्वारा प्राप्त हुई है, उसमें सूचित किया कि नारायण वेंकनागौड़ा पाटिल ने निर्वाचन व्यय के लेखे का कोई विवरण या अभ्यावेदन प्रस्तुत नहीं किया है। इसके अतिरिक्त, उक्त नोटिस मिलने के उपरांत, नारायण वेंकनागौड़ा पाटिल ने विधि के अंतर्गत यथा-विहित लेखे दाखिल करने में अपनी असफलता के लिए भारत निर्वाचन आयोग को न तो कोई कारण बताया है और न ही कोई स्पष्टीकरण दिया है; और

यत:, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में यह उपबंधित किया गया है कि:-

''यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व् यक्ति-

(क) निर्वाचन व्ययों का लेखा उस समय के भीतर और उस रीति में जैसी इस अधिनियम के द्वारा या अधीन अपेक्षित है ,दाखिल करने में असफल रहा है; तथा

(ख) उस असफलता के लिए कोई अच्छा कारण या न्यायोचित्य नहीं रखता है ,

यत:, तथ्यों और उपलब्ध रिकाडों के आधार पर, आयोग का यह समाधान हो गया है कि नारायण वेंकनागौड़ा पाटिल अपने निर्वाचन व्यय के लेखे दाखिल करने में असफल रहा हैं और उनके पास ऐसा करने में असफल रहने के लिए कोई भी उचित कारण अथवा औचित्य नहीं है; और

O.N. 46.—WHEREAS, the General Election to Legislative Assembly of Karnataka, 2023 for 87- Ranebennur Assembly Constituency was held in pursuance of the Election Commission of India Notification No. 464/KT-LA/2023, dated 13th April, 2023; and

WHEREAS, the result of the election for 87-Ranebennur Assembly Constituency of Karnataka, 2023 was declared by the Returning Officer on 13th May, 2023 and hence the last date for lodging the account of Election Expenses was 12th June, 2023; and

WHEREAS, as per the report of the DEO, Haveri dated 08.06.2023 under sub-rule (1) of Rule 89 of the Conduct of Elections Rules, 1961 received through the CEO, Karnataka vide his letter no. DPAR 22 CHUVEBA (Addl CEO-1) 2023, dated 27.06.2023 stating that Narayana Venkanagouda Patil, a contesting candidate from 87- Ranebennur Assembly Constituency in General Election to Legislative Assembly of Karnataka, 2023 has failed to lodge the account of his election expenses, as required under law; and

WHEREAS, on basis of the said report of the District Election Officer, Haveri a Show-Cause notice No. 76/KT-LA/16/2023/CEMS-II, dated 18th October, 2023 was issued under sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India to Narayana Venkanagouda Patil, for not lodging of the account of Election Expenses; and

WHEREAS, through the above said Show Cause Notice and under sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, Narayana Venkanagouda Patil was directed to submit representation in writing to the Commission explaining the reasons for not lodging the account and also to lodge the account of his election expenses with the District Election Officer, Haveri District within 20 days from the date of receipt of the notice; and

WHEREAS, the DEO, Haveri in his report no. ELN/CR-20/2023-24; dated 30.12.2023 has reported that the said Show Cause Notice was served to Narayana Venkanagouda Patil on 28.11.2023; and

WHEREAS, the District Election Officer, Haveri in his Supplementary Report no. ELN/CR-20/2023-24 dated 30.10.2023 on account of candidate received through CEO, Karnataka letter No. DPAR/22/Chuvebha(Addl.CEO-1) 2023; dated 02.01.2024 has reported that Narayana Venkanagouda Patil has not submitted any representation or statement of account of election expenses. Further, after receipt of the said notice, Narayana Venkanagouda Patil has neither furnished any reason nor explanation to the Election Commission of India for failure to lodge the account of his election expenses as prescribed under law; and

WHEREAS, Section 10A of the Representation of the People Act, 1951 provides that:-

"If the Election Commission is satisfied that a person-

(a) has failed to lodge an account of election expenses within the time and in the manner required by or

under this Act, and

(b) has no good reason or justification for the failure,

the Election Commission shall, by order published in the Official Gazette, declare him to be disqualified

and any such person shall be disqualified for a period of three years from the date of the order.";

WHEREAS, on basis of the facts and available records, the Commission is satisfied that Narayana Venkanagouda Patil has failed to lodge the account of his election expenses and has no good reason or justification for the failure to do so; and

NOW, THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission of India hereby declares Narayana Venkanagouda Patil, resident of Cotton Market Road Koppala Chala Ranebennur 581115 District Haveri and a contesting candidate from 87-Ranebennur Assembly Constituency of G.E. to LA of Karnataka, 2023, to be disqualified for being chosen as and for being a member of either House of the Parliament or the Legislative Assembly or the Legislative Council of a State or Union Territory for a period of three years from the date of this order.

यत:, जिला निर्वाचन अधिकारी, बेंगलुरु दक्षिण जिला ने अपनी रिपोर्ट सं. ELN(C)/PR/1154/2023-24 दिनांक 03/06.10.2023 में सूचित किया है कि उक्त कारण बताओ नोटिस मोहम्मद इदरीस के . एस को दिनांक 05.09.2023 को तामील किया गया था; और

यत:, जिला निर्वाचन अधिकारी, बेंगलुरु दक्षिण के अभ्यर्थी के संबंध में अनुपूरक रिपोर्ट सं.

ELN(C)/PR/1154/2023-24 दिनांक 03/06.10.2023 जोकि पत्र सं. डीपीएआर/27/चुवैबा/एडीडीएलसीईओ- 1/2023 दिनांक 07.10.2023में सूचित किया कि मोहम्मद इदरीस के . एस ने निर्वाचन व्यय के लेखे का कोई विवरण या अभ्यावेदन प्रस्तुत नहीं किया है। इसके अतिरिक्त, उक्त नोटिस मिलने के उपरांत, मोहम्मद इदरीस के . एस ने विधि के अंतर्गत यथा-विहित लेखे दाखिल करने में अपनी असफलता के लिए भारत निर्वाचन आयोग को न तो कोई कारण बताया है और न ही कोई स्पष्टीकरण दिया है; और

S was directed to submit representation in writing to the Commission explaining the reasons for not lodging the account and also to lodge the account of his election expenses with the District Election Officer, Bengaluru South District within 20 days from the date of receipt of the notice; and

यत:, जिला निर्वाचन अधिकारी, धारवाड़ की अभ्यर्थी के संबंध में अनुपूरक रिपोर्ट दिनांक 08.11.2023, जोकि मुख्य निर्वाचन अधिकारी, कर्नाटक के पत्र सं. WHEREAS, as per the report of the DEO, Dharwad dated 13.06.2023 under sub-rule (1) of Rule 89 of the Conduct of Elections Rules, 1961 received through the CEO, Karnataka vide his letter no. DPAR 09 CHUVEBA(Addl CEO-1) 2023, dated 26.06.2023 stating that Venkappa F Siddanath, a contesting candidate from 72 - Hubballi Dharwad East Assembly Constituency in General Election to Legislative Assembly of Karnataka, 2023 has failed to lodge the account of his election expenses, as required under law; and

WHEREAS, on basis of the said report of the District Election Officer, Dharwad a Show-Cause notice No. 76/KT-LA/10/2023/CEMS-II, dated 13th October, 2023 was issued under sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India to Venkappa F Siddanath, for not lodging of the account of Election Expenses; and

WHEREAS, through the above said Show Cause Notice and under sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, Venkappa F Siddanath was directed to submit representation in writing to the Commission explaining the reasons for not lodging the account and also to lodge the account of his election expenses with the District Election Officer, Dharwad District within 20 days from the date of receipt of the notice; and

WHEREAS, the DEO, Dharwad in his report no. Chunavane/vahi: 10 /2023-24; dated 08.11.2023 has reported that the said Show Cause Notice was served to Venkappa F Siddanath on 17.10.2023; and111 [भाग II—खण्ड 3(iii)] भारत का राजपत्र : फरवरी 10, 2024/माघ 21, 1945 WHEREAS, the District Election Officer, Dharwad in his Supplementary Report dated 08.11.2023 received through CEO, Karnataka vide letter No. DPAR/09/Chuvebha(Addl.CEO-1) 2023; dated 09.11.2023 on account of the candidate has reported that Venkappa F Siddanath has not submitted any representation or statement of account of election expenses. Further, after receipt of the said notice, Venkappa F Siddanath has neither furnished any reason nor explanation to the Election Commission of India for failure to lodge the account of his election expenses as prescribed under law; and

WHEREAS, Section 10A of the Representation of the People Act, 1951 provides that:-

"If the Election Commission is satisfied that a person-

(a) has failed to lodge an account of election expenses within the time and in the manner required by or

under this Act; and

(b) has no good reason or justification for the failure,

the Election Commission shall, by order published in the Official Gazette, declare him to be disqualified

and any such person shall be disqualified for a period of three years from the date of the order.";

WHEREAS, on basis of the facts and available records, the Commission is satisfied that Venkappa F Siddanath has failed to lodge the account of his election expenses and has no good reason or justification for the failure to do so; and

NOW, THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission of India hereby declares Venkappa F Siddanath, resident of Prajwal Building, 2nd floor, Near Shyandil Ashram, Dayanand Colony, Hubballi, TQ-Hubballi, Dist-Dharwad and a contesting candidate in 72 - Hubballi Dharwad East Assembly Constituency of G.E. to LA of Karnataka, 2023, to be disqualified for being chosen as and for being a member of either House of the Parliament or the Legislative Assembly or the Legislative Council of a State or Union Territory for a period of three years from the date of this order.
