आ.अ. 54.—लोक प्रतिनिधित्व अधिनियम, 1950 (1950 का 43) की धारा 13-क की उप-धारा (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए भारत निर्वाचन आयोग महाराष्ट्र राज्य सरकार के परामर्श से एतद्द्वारा, श्री एस. एम. देशपांडे, आई.ए.एस. के स्थान पर श्री एस. चॉकलिंगम, आई.ए.एस. (एम.एच.:1996) को उनके कार्यभार ग्रहण करने की तारीख से आगामी आदेशों तक के लिए महाराष्ट्र राज्य के मुख्य निर्वाचन अधिकारी के रूप में नामित करता है।
2. श्री एस. चॉकलिंगम, महाराष्ट्र सरकार के अधीन सभी पदभार या किसी कार्य के पदभारों को तत्काल सौंप देंगे या धारण करना समाप्त कर देंगे, जो कि वे ऐसा पदभार ग्रहण करने से पहले धारण कर रहे थे।
3. श्री एस. चॉकलिंगम, मुख्य निर्वाचन अधिकारी, महाराष्ट्र के रूप में कार्य करते हुए महाराष्ट्र सरकार के अधीन किसी भी प्रकार का कोई अतिरिक्त कार्यभार ग्रहण नहीं करेंगे सिवाय इसके कि उनको राज्य सचिवालय में निर्वाचन विभाग के प्रभारी, सरकार के सचिव पदाभिहित किया जाएगा।

NOTIFICATION
New Delhi, the 28th February, 2024
O.N. 54.—In exercise of the powers conferred by sub-section (1) of section 13A of the Representation of the People Act, 1950 (43 of 1950), the Election Commission of India in consultation with the Government of Maharashtra hereby designates Shri S. Chockalingam, IAS, (MH:1996) as the Chief Electoral Officer for the State of Maharashtra with effect from the date he takes over charge and until further orders in place of Shri S. M. Deshpande, IAS.
2. Shri S. Chockalingam, shall cease to hold and hand over forthwith the charge of all or any charges of work under the Government of Maharashtra, which he may be holding before such assumption of office.
3. Shri S. Chockalingam, while functioning as the Chief Electoral Officer, Maharashtra shall not hold any additional charge whatsoever under the Government of Maharashtra except that he should be designated Secretary to the Government in charge of Election Department in the State Secretariat.

आदेश से, ORDER
New Delhi, the 1st March, 2024
O.N. 55.—WHEREAS, the General Election to Legislative Assembly of Himachal Pradesh, 2022 for 52-Doon Assembly Constituency was held in pursuance of the Election Commission of India Notification No. 464/HP-LA/2022, dated 17th October, 2022; and
WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate at an election shall, within 30 days from the date of election of the returned candidate, lodge with the District Election Officer an account of his election expenses which shall be true copy of the account kept by him or his election agent under Section 77 of the said act; and
WHEREAS, the result of the election for 52-Doon Assembly Constituency of Himachal Pradesh, 2022 was declared by the Returning Officer on 8th December, 2022 and hence the last date for lodging the account of Election Expenses was 7th January, 2023; and
WHEREAS, as per the report the DEO, Solan under sub-rule (1) of Rule 89 of the Conduct of Elections Rules, 1961, received his letter No.3-Solan-3/2022-ELN-78 dated 10.01.2023, Sh. Balwant Singh, a contesting candidate from 52-Doon Assembly Constituency of Himachal Pradesh, 2022 has failed to lodge account of election expenses, as required under law; and
WHEREAS, on the basis of the said report of the District Election Officer Solan, a Show-Cause notice No. 76/HP-LA/52/2023/CEMS-I, dated 20th April, 2023 was issued under sub rule (5) of Rule 89 of the Conduct of128 THE GAZETTE OF INDIA : MARCH 9, 2024/PHALGUNA 19, 1945 [PART II—SEC. 3(iii)] Elections Rules, 1961 by the Election Commission of India Sh. Balwant Singh, for not lodging of account of Election Expenses; and
WHEREAS, through the above said Show Cause Notice and under sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, Sh. Balwant Singh, was directed to submit representation in writing to the Commission explaining the reasons for not lodging the account and also to lodge account of election expenses with the District Election Officer, Solan, District within 20 days from the date of receipt of the notice; and
WHEREAS, the Chief Electrol Officer, Himachal Pradesh, vide his letter No 3-7/2023-ELN-EEM-III -953 dated 18th May, 2023 District , enclosing the DEO, Solan letter No.- 3-Solan-3/2023-ELN/884 dated 10th May, 2023 has reported that the said notice was served to Sh. Balwant Singh, on 04.05.2023; and
WHEREAS, the CEO, Himachal Pradesh vide letter No 3-7/2022-ELN-EEM-III dated 20.12.2023 forwarded the District Election Officer, Solan Supplementary Report No.3-Solan-3/2023-ELN–2152, dated 02.09. 2023 and reported stated that Sh. Balwant Singh has not submitted any representation of a statement of correct account of election expenses duly signed alongwith original vouchers etc. Further, after receipt of the said notice, Sh. Balwant Singh has neither furnished any reason nor explanation to the Election Commission of India, for failure to lodge the account as prescribed under law; and
WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that :-
"If the Election Commission is satisfied that a person-
(a) has failed to lodge an account of election expenses, within the time and in the manner required by or
under this Act, and
(b) has no good reason or justification for the failure,
the Election Commission shall, by order published in the Official Gazette, declare him to be disqualified
and any such person shall be disqualified for a period of three years from the date of the order.";
WHEREAS, on the basis of facts and available records, the Commission is satisfied that Sh. Balwant Singh has failed to lodge account of election expenses and has no good reason or justification for the failure to do so; and NOW, THEREFORE, in pursuance of Section 10A of the Representation of the People Act,1951, the Election Commission of India hereby declares Sh.Balwant Singh, Village & P.O.Chandi, Tehsil Krishangarh, District Solan, Himachal Pradesh and a contesting candidate in 52-Doon Assembly Constituency of the State of Himachal Pradesh in the General Election to the Legislative Assembly 2022 to be disqualified for being chosen as and for being a member of either House of the Parliament or the Legislative Assembly or the Legislative Council of a State or Union Territory for a period of three years from the date of this order.

आ.अ. 56.—यत भारत निर्वाचन आयोग द्वारा की अधिसूचना सं0 464/ह0िप्र0-व0िस0/2022, हनि ांक 17 अक्टू बर, 2022 के अनुसरण में 52-दून विधान सभा निर्वाचन क्षेत्र के लिए हिमाचल प्रदेष विधान सभा का साधारण निर्वाचन, 2022 आयोजित किया गया था; और
यतः लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 78 के अनुसार, किसी निर्वाचन में, निर्वाचन लडने वाला प्रत्येक अभ्यर्थी, निर्वाचित अभ्यर्थी के निर्वाचन की तारीख से 30 दिनों के भीतर अपने निर्वाचन व्यय का लेखा जिला निर्वाचन अधिकारी के पास दाखिल करेगा जो उक्त अधिनियम की धारा 77 के अंतर्गत उसके द्वारा या उसके निर्वाचन अभिकर्ता (एजेंट) द्वारा रखे गए लेखे की एक सत्य प्रति होगी; और
यतः, हिमाचल प्रदेष 52-दून विधान सभा निर्वाचन क्षेत्र के साधारण निर्वाचन, 2022 का परिणाम रिटर्निंग ऑफिसर द्वारा दिनांक 08 दिसंबर, 2022 को घोशित किया गया था और इस प्रकार निर्वाचन व्यय के लेखे दाखिल करने की अन्तिम तारीख 07 जनवरी, 2023 थी; और
यतः, निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (1) के अंतर्गत, जिला निर्वाचन अधिकारी, सोलन दिनांक 10.01.2023 के पत्र सं0 3-सौलन-3/2022-ई एल एन/78 की रिपोर्ट के अनुसार श्री स्वर्ण सिंह सैणी , जो हिमाचल प्रदेष के 52-दून विधान सभा निर्वाचन क्षेत्र, 2022 से निर्वाचन लड़ने वाले अभ्यर्थी हैं विधि के अंतर्गत यथापेक्षित रीति से अपने निर्वाचन व्यय का लेखे दाखिल करने में असफल रहे हैं और129 [भाग II—खण्ड 3(iii)] भारत का राजपत्र : मार्च 9, 2024/फाल्गुन 19, 1945 यतः, जिला निर्वाचन अधिकारी, सोलन की उक्त रिपोर्ट के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (5) के अंतर्गत श्री स्वर्ण सिंह सैणी को अपने निर्वाचन व्यय के लेखे प्रस्तुत नहीं करने के लिए कारण बताओ नोटिस सं. 76/हिमा.-वि..स./52/2023/सी.ई.एम.एस.-1 दिनांक 20 अप्रैल , 2023 जारी किया गया था, और
यतः, उपर्युक्त कारण बताओ नोटिस के जरिए और निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (6) के अन्र्तगत श्री स्वर्ण सिंह सैणी, को लेखा प्रस्तुत न किए जाने संबंधी कारणों को स्पश्ट करते हुए, आयोग को अपना अभ्यावेदन लिखित रूप में प्रस्तुत करने और नोटिस के प्राप्त होने की तारीख से 20 दिनो के भीतर जिला निर्वाचन अधिकारी षिमला जिला को अपने निर्वाचन व्यय का लेखा प्रस्तुत करने का निदेष दिया गया था, और
यतः मुख्य निर्वाचन अधिकारी, हिमाचल प्रदेष ने पत्र सं0 3-7/2023-ईएलएन-ईईएम-III-953 दिनांक 18 मई, 2023 के द्वारा जिला निर्वाचन अधिकारी, सोलन के पत्र सं0 3-सोलन-3/2023-ईएलएन-884 दिनांक 10 मई, .2023 के द्वारा प्रस्तुत किया कि उक्त कारण बताओ नोटिस श्री स्वर्ण सिंह सैणी, को दिनांक 03.05.2023 को तामील किया गया था, और
यतः मुख्य निर्वाचन अधिकारी, हिमाचल प्रदेष ने पत्र सं0 3-7/2022-ईएलएन-ईईएम-III दिनांक 20.12..2024 के द्वारा जिला निर्वाचन अधिकारी, सोलन की अनुपूरक रिपोर्ट सं 3-सोलन-3/2023-ईएलएन-2152 दिनांक 02.09.2023 अग्रेशित किया और बताया कि श्री स्वर्ण सिंह सैणी, ने निर्वाचन व्यय के लेखे का कोई विवरण या अभ्यावेदन प्रस्तुत नहीं किया है। इसके अतिरिक्त, उक्त नोटिस की पावती के उपरांत, श्री स्वर्ण सिंह सैणी, ने विधि के अंतर्गत यथा विहित लेखा दाखिल करने में अपनी असफलता के लिए भारत निर्वाचन आयोग को न तो कोई कारण बताया है और न ही कोई स्पश्टीकरण दिया है, और
यतः लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में यह उपबंधित किया गया है किः
"यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति
(क) निर्वाचन व्ययों का लेखा उस समय के भीतर और रीति में जैसी इस अधिनियम के द्वारा या अधीन अपेक्षित है, दाखिल करने में असफल रहा है, और
(ख) उस असफलता के लिए कोई अच्छा कारण अथवा न्यायोचित्य नहीं रखता है
तो निर्वाचन आयोग, शासकीय राजपत्र में प्रकाषित आदेष द्वारा उसको निरर्हित घोशित करेगा और ऐसा व्यक्ति उस आदेष की तारीख से तीन वर्श की कालावधि के लिए निरर्हित होगा
यतः, तथ्यों और उपलब्ध रिकार्डों के आधार पर, आयोग का यह समाधान हो गया है कि श्री स्वर्ण सिंह सैणी, अपने निर्वाचन व्यय के लेखे दाखिल करने में असफल रहे हैं और उनके पास ऐसा करने में असफल रहने के लिए कोई भी उचित कारण अथवा औचित्य नहीं है, और
अतः अब लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अनुसरण में, भारत निर्वाचन आयोग एतद्द्वारा धोशणा करता है कि हिमाचल प्रदेष के 52-दून विधान सभा निर्वाचन क्षेत्र के लिए साधारण निर्वाचन 2022 में निर्वाचन लड़ने वाले अभ्यर्थी श्री स्वर्ण सिंह सैणी, गांव व डा0 भुड, तहसील बददी, जिला, सोलन, हिमाचल प्रदेष । इस आदेष की तारीख से तीन वर्श की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य क्षेत्र की विधानसभा अथवा विधान परिशद का सदस्य चुने जाने अथवा होने के लिए निरर्हित होंगे।
