आ. अ. 57.—यतः, भारत निर्वाचन आयोग की अधिसूचना सं.464/के एल-एलए/2021 दिनांक 12 मार्च, 2021 के अनुसरण में 124- कोल्लम विधान सभा निर्वाचन क्षेत्र के लिए के रल विधान सभा का साधारण निर्वाचन, 2021 आयोजित किया गया था; और

यत:, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 78 के अनुसार, किसी भी निर्वाचन में निर्वाचन लड़ने वाला प्रत्येक अभ्यर्थी, निर्वाचित अभ्यर्थी के निर्वाचन की तारीख से 30 दिनों के भीतर अपने निर्वाचन व्यय के लेखे जिला निर्वाचन अधिकारी के पास दाखिल करेगा जो उक्त अधिनियम की धारा 77 के तहत उसके या उसके निर्वाचन अभिकर्ता द्वारा रखे गए लेखे की एक सत्य प्रति होगी; और

यतः, के रल के 124-कोल्लम विधान सभा निर्वाचन क्षेत्र के लिए निर्वाचन, 2021 का परिणाम, रिर्टनंिग अधिकारी द्वारा दिनांक 02 मई, 2021 को घोषित किया गया था और इस प्रकार निर्वाचन व्यय के लेखे दाखिल करने की अन्तिम तारीख 01, जून, 2021 थी; और

(131)132 THE GAZETTE OF INDIA : MARCH 16, 2024/PHALGUNA 26, 1945 [PART II—SEC. 3(iii)] यतः, आयोग ने कोविड-19 की तत्कालीन वैकिि महामारी की स्थिति को ध्यान में रखते हुए, अभ्यर्थी द्वारा 31 जुलाई, 2021 तक विलंब से लेखा प्रस्तुत करने के किसी भी मामले को माफ करने का निर्णय लिया; और

यतः, निर्वाचनों का संचालन नियम,1961 के नियम 89 के उप-नियम (1) के तहत प्राप्त जिला निर्वाचन अधिकारी, कोल्लम की रिपोर्ट EL1-306232/2021 दिनांक 01.10.2022 के अनुसार, रेमनन, जो के रल के साधारण निर्वाचन के 124- कोल्लम विधान सभा निर्वाचन क्षेत्र, 2021 से निर्वाचन लड़ने वाले अभ्यर्थी हैं, विधि के अंतर्गत यथापेक्षित रीति से अपने निर्वाचन व्यय के लेखे दाखिल करने में असफल रहे हैं; और

यतः, जिला निर्वाचन अधिकारी, कोल्लम की उक्त रिपोर्ट के आधार पर, भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (5) के अंतर्गत रेमनन को अपने निर्वाचन व्यय के लेखे प्रस्तुत नहीं करने के लिए कारण बताओ नोटिस सं. 76/के एल-एलए/2021/सीईएमएस-।।, दिनांक 20.01.2023 को जारी किया गया था; और

यतः, उपयु र्क्त उक्त कारण बताओ नोटिस के जरिए और निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (6) के अंतर्गत, रेमनन को लेखा दाखिल नहीं किए जाने संबंधी कारणों को स्पष्ट करते हुए आयोग को लिखित में अपना अभ्यावेदन प्रस्तुत करने तथा नोटिस प्राप्त होने की तारीख से 20 दिनों के अंदर जिला निर्वाचन अधिकारी, कोल्लम जिला को अपने निर्वाचन व्यय के लेखे प्रस्तुत करने का निदेश दिया गया था; और

यतः, जिला निर्वाचन अधिकारी, कोल्लम ने अपनी रिपोर्ट सं. EL1-306232/2021; दिनांक 17.02.2023 में सूचित किया है कि उक्त कारण बताओ नोटिस रेमनन को दिनांक 08.02.2023 को तामील किया गया था ।

यतः, जिला निर्वाचन अधिकारी, कोल्लम की अभ्यर्थी के संबंध में अनुपूरक रिपोर्ट दिनांक 12.05.2023 जोकि मुख्य निर्वाचन अधिकारी, के रल के पत्र सं. EL1/2/2021-ELEC; दिनांक 03.11.2023 द्वारा प्राप्त हुई, में यह सूचित किया है कि रेमनन ने निर्वाचन व्यय के लेखे का कोई विवरण या अभ्यावेदन प्रस्तुत नहीं किया है। इसके अतिरिक्त,उपयु र्क्त नोटिस मिलने के बाद, रेमनन ने विधि के तहत यथा निर्धारित लेखे दाखिल करने में असफल रहने के लिए भारत निर्वाचन आयोग को न तो कोई कारण बताया है और न ही कोई स्पष्टीकरण दिया है; और

यत:, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में यह उपबंधित किया गया है कि:-

''यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व् यक्ति-

(क) निर्वाचन व्ययों का लेखा उस समय के भीतर और उस रीति में जैसी इस अधिनियम के द्वारा या अधीन अपेक्षित है, दाखिल करने में असफल रहा है; तथा

(ख) उस असफलता के लिए कोई अच्छा कारण या न्यायोचित्य नहीं रखता है ,

तो निर्वाचन आयोग शासकीय राजपत्र में प्रकाशित आदेश द्वारा उसको निर्रर्हत घोषित करेगा और ऐसा व् यक्ति उस आदेश की तारीख से तीन वर्ष की कालावधि के लिए निर्रर्हत होगा।";

यत:, तथ्यों और उपलब्ध रिकाडों के आधार पर आयोग का यह समाधान हो गया है कि रेमनन अपने निर्वाचन व्यय के लेखे दाखिल करने में असफल रहे हैं और उनके पास ऐसा करने में असफल रहने के लिए कोई भी उचित कारण अथवा औचित्य नहीं है; और

अत:, अब, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अनुसरण में, भारत निर्वाचन आयोग एतद्द्वारा घोषणा करता है कि के रल के 124- कोल्लम विधान सभा निर्वाचन क्षेत्र के लिए साधारण निर्वाचन 2021 से निर्वाचन लड़ने वाले अभ्यर्थी रेमनन, निवासी- रत्तीश भवन, पवित्रम नगर, कल्लुमथाज़म, कोल्लम को इस आदेश की तारीख से तीन वर्ष की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य-क्षेत्र की विधान सभा अथवा विधान परिषद का सदस्य चुने जाने अथवा होने के लिए निर्रर्हत होंगे।

ELECTION COMMISSION OF INDIA

ORDER

New Delhi, the 24th January, 2024

O.N. 57.—WHEREAS, the General Election to Legislative Assembly of Kerala, 2021 for 124-Kollam Assembly Constituency was held in pursuance of the Election Commission of India Notification No. 464/KL- LA/2021, dated 12th March, 2021; and

WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate at an election shall, within 30 days from the date of election of the returned candidate, lodge with the District Election Officer an account of his election expenses which shall be a true copy of the account kept by him or his election agent under Section 77 of the said act; and

WHEREAS, the result of the election for 124-Kollam Assembly Constituency of Kerala, 2021 was declared by the Returning Officer on 02nd May, 2021 and hence the last date for lodging the account of Election Expenses was 01st June, 2021; and

WHEREAS, the Commission having regard to the then prevailing pandemic situation of Covid-19, decided to condone any incidence of late submission of account by candidate till 31st July, 2021; and

WHEREAS, as per the report of the DEO, Kollam, under sub-rule (1) of Rule 89 of the Conduct of Elections Rules, 1961, received vide his letter no. EL1-306232/2021, dated 01.10.2022 stating that Remanan, a contesting candidate from 124-Kollam Assembly Constituency of General Election to Legislative Assembly of Kerala, 2021 has failed to lodge the account of his election expenses, as required under law; and

WHEREAS, on basis of the said report of the District Election Officer, Kollam a Show-Cause notice No. 76/KL-LA/2021/CEMS-II, dated 20th January, 2023 was issued under sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India to Remanan, for not lodging the account of Election Expenses; and

WHEREAS, through the above said Show Cause Notice and under sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, Remanan was directed to submit a representation in writing to the Commission explaining the reasons for not lodging the account and also to lodge the account of his election expenses with the District Election Officer, Kollam District within 20 days from the date of receipt of the notice; and

WHEREAS, the District Election Officer, Kollam District, in his report no. EL1-306232/2021; dated 17.02.2023 has reported that the said Show Cause Notice was served to Remanan on 08.02.2023; and

WHEREAS, the District Election Officer, Kollam in his Supplementary Report dated 12.05.2023 received through CEO, Kerala vide letter No. EL1/2/2021-ELEC; dated 03.11.2023 on account of the candidate has reported that Ramanan has not submitted any representation or statement of account of election expenses. Further, after receipt of the said notice, Remanan has neither furnished any reason nor explanation to the Election Commission of India, for failure to lodge the account of his election expenses as prescribed under law; and

WHEREAS, Section 10A of the Representation of the People Act, 1951 provides that:-

"If the Election Commission is satisfied that a person-

(a) has failed to lodge an account of election expenses, within the time and in the manner required by or

under this Act, and

(b) has no good reason or justification for the failure,

the Election Commission shall, by order published in the Official Gazette, declare him to be disqualified and

any such person shall be disqualified for a period of three years from the date of the order.";

WHEREAS, on basis of facts and available records, the Commission is satisfied that Remanan has failed to lodge the account of his election expenses and has no good reason or justification for the failure to do so; and

NOW, THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission of India hereby declares Remanan, resident of – Ratheesh Bhavanam, Pavithram Nagar, Kallumthazham, Kollam and a contesting candidate in 124- Kollam Assembly Constituency of Kerala, 2021, to be disqualified for being chosen as and for being a member of either House of the Parliament or the Legislative Assembly or the Legislative Council of a State or Union Territory for a period of three years from the date of this order.

यतः, के रल के 125-एराविपुरम विधान सभा निर्वाचन क्षेत्र के लिए निर्वाचन, 2021 का परिणाम, रिर्टनंिग अधिकारी द्वारा दिनांक 02 मई, 2021 को घोषित किया गया था और इस प्रकार निर्वाचन व्यय के लेखे दाखिल करने की अन्तिम तारीख 01, जून, 2021 थी; और

यतः, जिला निर्वाचन अधिकारी, कोल्लम की उक्त रिपोर्ट के आधार पर, भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (5) के अंतर्गत एन. शिहाबुदीन को अपने निर्वाचन व्यय के लेखे प्रस्तुत नहीं करने के लिए कारण बताओ नोटिस सं. 76/के एल-एलए/2021/सीईएमएस-।।, दिनांक 20.01.2023 को जारी किया गया था; और

यतः, जिला निर्वाचन अधिकारी, कोल्लम की अभ्यर्थी के संबंध में अनुपूरक रिपोर्ट दिनांक 12.05.2023 जोकि मुख्य निर्वाचन अधिकारी, के रल के पत्र सं. घोषणा करता है कि के रल के 125- एराविपुरम विधान सभा निर्वाचन क्षेत्र के लिए साधारण निर्वाचन 2021 से निर्वाचन

लड़ने वाले अभ्यर्थी एन. शिहाबुदीन, निवासी- शफीना मंजिल, चकाला मुक्कू , कायमकु लम पी.ओ. अलाप्पुझा को इस

आदेश की तारीख से तीन वर्ष की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य-क्षेत्र की विधान

सभा अथवा विधान परिषद का सदस्य चुने जाने अथवा होने के लिए निर्रर्हत होंगे।

WHEREAS, the result of the election for 125-Eravipuram Assembly Constituency of Kerala, 2021 was declared by the Returning Officer on 02nd May, 2021 and hence the last date for lodging the account of Election Expenses was 01st June, 2021; and

WHEREAS, the Commission having regard to the then prevailing pandemic situation of Covid-19, decided to condone any incidence of late submission of account by candidate till 31st July, 2021; and

WHEREAS, as per the report dated 01.10.2022 of the DEO, Kollam, under sub-rule (1) of Rule 89 of the Conduct of Elections Rules, 1961, received vide his letter no. EL1-306232/2021, dated 01.10.2022 stating that N. Shihabudeen, a contesting candidate from 125-Eravipuram Assembly Constituency of General Election to Legislative Assembly of Kerala, 2021 has failed to lodge the account of his election expenses, as required under law; and

WHEREAS, on basis of the said report of the District Election Officer, Kollam a Show-Cause notice No. 76/KL-LA/2021/CEMS-II, dated 20th January, 2023 was issued under sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India to N. Shihabudeen, for not lodging the account of Election Expenses; and

WHEREAS, through the above said Show Cause Notice and under sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, N. Shihabudeen was directed to submit a representation in writing to the Commission explaining the reasons for not lodging the account and also to lodge account of his election expenses with the District Election Officer, Kollam District within 20 days from the date of receipt of the notice; and

WHEREAS, the District Election Officer, Kollam District, in his report no. EL1-306232/2021; dated 18.04.2023 has reported that the said notice was served to N. Shihabudeen on 15.02.2023; and

WHEREAS, the District Election Officer, Kollam in his Supplementary Report dated 12.05.2023 received through CEO, Kerala vide letter No. EL1/2/2021-ELEC; dated 03.11.2023 on account of the candidate has reported that N. Shihabudeen has not submitted any representation or statement of correct account of election expenses. Besides, after receipt of the said notice, N. Shihabudeen has neither furnished any reason nor explanation to the Election Commission of India, for failure to lodge the account of his election expenses as prescribed under law; and

WHEREAS, Section 10A of the Representation of the People Act, 1951 provides that:-

"If the Election Commission is satisfied that a person-

यतः, तमिलनाडु के 160- सिरकाजी (अ. जा.) विधान सभा निर्वाचन क्षेत्र के लिए निर्वाचन, 2021 का परिणाम, रिर्टनंिग अधिकारी द्वारा दिनांक 02 मई, 2021 को घोषित किया गया था और इस प्रकार निर्वाचन व्यय के लेखे दाखिल करने की अन्तिम तारीख 01, जून, 2021 थी; और

यतः, निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (1) के तहत प्राप्त जिला निर्वाचन अधिकारी, नागापट्टीनम् की रिपोर्ट 5300/2022/G1 दिनांक 19.05.2022 जो कि मुख्य निर्वाचन अधिकारी, तमिलनाडु के पत्र सं. 19875/Ele-IV/2021-20; दिनांक 31.05.2022 के द्वारा प्राप्त हुई, जिसके अनुसार, बालू. पोन, जो तमिल नाडु के साधारण निर्वाचन के 160- सिरकाजी (अ.जा.) विधान सभा निर्वाचन क्षेत्र, 2021 से निर्वाचन लड़ने वाले अभ्यर्थी हैं, विधि के अंतर्गत यथापेक्षित रीति से अपने निर्वाचन व्यय के लेखे दाखिल करने में असफल रहे हैं; और

यतः, जिला निर्वाचन अधिकारी, नागापट्टीनम् की उक्त रिपोर्ट के आधार पर,भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (5) के अंतर्गत बालू. पोन को अपने निर्वाचन व्यय के लेखे प्रस्तुत नहीं करने के लिए कारण बताओ नोटिस सं. 76/टीएन-एलए/2021/सीईएमएस-।।/पार्ट-1, दिनांक 01.09.2022 को जारी किया गया था; और

यतः, उपयु र्क्त उक्त कारण बताओ नोटिस के जरिए और निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (6) के अंतर्गत, बालू. पोन को लेखा दाखिल नहीं किए जाने संबंधी कारणों को स्पष्ट करते हुए आयोग को लिखित में अपना अभ्यावेदन प्रस्तुत करने तथा नोटिस प्राप्त होने की तारीख से 20 दिनों के अंदर जिला निर्वाचन अधिकारी, नागापट्टीनम् जिला को अपने निर्वाचन व्यय के लेखे प्रस्तुत करने का निदेश दिया गया था; और

यतः, जिला निर्वाचन अधिकारी, नागापट्टीनम् ने अपनी रिपोर्ट RC No. 5300/2022/G1; दिनांक 05.12.2023 में सूचित किया है कि उक्त कारण बताओ नोटिस की मूल पावती उम्मीदवार से सिरकाली तहसीलदार की रिपोर्ट RC No. 63/2019/A3; दिनांक 13.12.2022 के माघ्यम से प्राप्त हुई।

यतः, जिला निर्वाचन अधिकारी, नागापट्टीनम् की अभ्यर्थी के संबंध में अनुपूरक रिपोर्ट दिनांक 05.12.2023 जोकि मुख्य निर्वाचन अधिकारी, तमिल नाडु के पत्र सं 5550/Ele-IV/2022-13; दिनांक 12.12.2023 के द्वारा प्राप्त हुई, जिसमें यह सूचित किया है कि बालू. पोन ने निर्वाचन व्यय के लेखे का कोई विवरण या अभ्यावेदन प्रस्तुत नहीं किया है।

इसके अतिरिक्त,उपयु र्क्त नोटिस मिलने के बाद, बालू. पोन ने विधि के तहत यथा निर्धारित लेखे दाखिल करने में असफल रहने के लिए भारत निर्वाचन आयोग को न तो कोई कारण बताया है और न ही कोई स्पष्टीकरण दिया है; और

यत:, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में यह उपबंधित किया गया है कि:-

''यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व् यक्ति-

(ख) उस असफलता के लिए कोई अच्छा कारण या न्यायोचित्य नहीं रखता है ,

यत:, तथ्यों और उपलब्ध रिकाडों के आधार पर आयोग का यह समाधान हो गया है कि बालू. पोन अपने निर्वाचन व्यय के लेखे दाखिल करने में असफल रहे हैं और उनके पास ऐसा करने में असफल रहने के लिए कोई भी उचित कारण अथवा औचित्य नहीं है; और

अत:, अब, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अनुसरण में, भारत निर्वाचन आयोग एतद्द्वारा घोषणा करता है कि तमिल नाडु के 160- सिरकाजी (अ. जा.) विधान सभा निर्वाचन क्षेत्र के लिए साधारण निर्वाचन 2021 से निर्वाचन लड़ने वाले अभ्यर्थी बालू. पोन, निवासी- 2/4 मेन रोड़, आथूकु डी और पोस्ट, मायिलादुथूरई तालुक को इस आदेश की तारीख से तीन वर्ष की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य-क्षेत्र की विधान सभा अथवा विधान परिषद का सदस्य चुने जाने अथवा होने के लिए निर्रर्हत होंगे।

O.N. 59.—WHEREAS, the General Election to Legislative Assembly of Tamil Nadu, 2021 for 160-Sirkazhi (SC) Assembly Constituency was held in pursuance of the Election Commission of India Notification No. 464/TN-LA/2021, dated 12th March, 2021; and

WHEREAS, the result of the election for 160-Sirkazhi (SC) Assembly Constituency of Tamil Nadu, 2021 was declared by the Returning Officer on 02nd May, 2021 and hence the last date for lodging the account of Election Expenses was 01st June, 2021; and

WHEREAS, the Commission having regard to the then prevailing pandemic situation of Covid-19, decided to condone any incidence of late submission of account by candidate till 31st July, 2021; and

WHEREAS, as per the report Rc. No. 5300/2022/G1; dated 19.05.2022 of the DEO, Nagapattinam, under sub-rule (1) of Rule 89 of the Conduct of Elections Rules, 1961, received through the CEO, Tamil Nadu vide his letter no. 19875/Ele-IV/2021-20; dated 31.05.2022 stating that Balu. Pon, a contesting candidate from 160-Sirkazhi (SC) Assembly Constituency of General Election to Legislative Assembly of Tamil Nadu, 2021 has failed to lodge the account of his election expenses, as required under law; and

WHEREAS, on basis of the said report of the District Election Officer, Nagapattinam a Show-Cause Notice No. 76/TN-LA/2021/CEMS-II/Pt-1; dated 01st September, 2022 was issued under sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India to Balu. Pon, for not lodging the account of Election Expenses; and138 THE GAZETTE OF INDIA : MARCH 16, 2024/PHALGUNA 26, 1945 [PART II—SEC. 3(iii)] WHEREAS, through the above said Show Cause Notice and under sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, Balu. Pon was directed to submit a representation in writing to the Commission explaining the reasons for not lodging the account and also to lodge account of his election expenses with the District Election Officer, Nagapattinam District within 20 days from the date of receipt of the notice; and

WHEREAS, the District Election Officer, Nagapattinam District, in his report Rc No. 5300/2022/G1; dated 05.12.2023 has reported that the original acknowledgment of said notice was obtained from the defaulting candidate through Sirkali Tahsildar vide R. C. No. 63/2019/A3; dated 13.12.2022; and

WHEREAS, the District Election Officer, Nagapattinam in his Supplementary Report dated 05.12.2023 received through CEO, Tamil Nadu vide letter No. 5550/Ele-IV/2022-13; dated 12.12.2023 on account of the candidate has reported that Balu. Pon has not submitted any representation or statement of correct account of election expenses. Besides, after receipt of the said notice, Balu. Pon has neither furnished any reason nor explanation to the Election Commission of India, for failure to lodge the account of his election expenses as prescribed under law; and

WHEREAS, Section 10A of the Representation of the People Act, 1951 provides that:-

"If the Election Commission is satisfied that a person-

(a) has failed to lodge an account of election expenses within the time and in the manner required by

or under this Act, and

(b) has no good reason or justification for the failure,

the Election Commission shall, by order published in the Official Gazette, declare him to be disqualified and

any such person shall be disqualified for a period of three years from the date of the order.";

WHEREAS, on basis of facts and available records, the Commission is satisfied that Balu. Pon has failed to lodge the account of his election expenses and has no good reason or justification for the failure to do so; and

NOW, THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission of India hereby declares Balu. Pon, resident of 2/4 Main Road, Aathukudi & Post, Mayiladuthurai Taluk and a contesting candidate in 160- Sirkazhi (SC) Assembly Constituency of Tamil Nadu, 2021, to be disqualified for being chosen as and for being a member of either House of the Parliament or the Legislative Assembly or the Legislative Council of a State or Union Territory for a period of three years from the date of this order
