आ.अ. 61.—यतः, उत्तराखण्ड राज्य की 09-घनसाली विधान सभा क्षेत्र के साधारण निर्वाचन 2022 अधिसूचना नं. 464/उत्तरा0-वि0स0/2022 दिनांक 21.01.2022 के जरिए की गई थी।

यतःलोक प्रतिनिधित्व अधिनियम, 1951 की धारा 78 के अनुसार, निर्वाचन लड़ने वाले प्रत्येक अभ्यर्थी को, निर्वाचित अभ्यर्थी के निर्वाचन की तारीख से 30 दिनों के भीतर निर्वाचन व्यय के अपने लेखे की सही प्रति जिला निर्वाचन अधिकारी को दाखिल करनी होती है; और

यतः09-घनसाली विधान सभा निर्वाचन क्षेत्र के रिटनिग अधिकारी द्वारा उक्त निर्वाचन का परिणाम10 मार्च, 2022 को घोषित किया गया था। इस प्रकार, निर्वाचन व्यय का लेखा दाखिल करने की अन्तिम तारीख 09 अप्रैल, 2022 थी; और141 [भाग II—खण्ड 3(iii)] भारत का राजपत्र : मार्च 23, 2024/चैत्र 3, 1946 यतः, जिला निर्वाचन अधिकारी, टिहरी गढ़वाल, उत्तराखण्ड के द्वारा प्रस्तुत और मुख्य निर्वाचन अधिकारी,उत्तराखण्ड द्वारा पत्र सं. 2782/XXV-53/2022 देहरादून के जरिए अग्रेषित दिनांक 22/04/2022 की रिपोर्ट के अनुसार श्री विजय प्रकाश, जो उत्तराखण्ड विधान सभा का साधारण निर्वाचन 2022 के निर्वाचन क्षेत्र 09-घनसाली से लड़ने वाले अभ्यर्थी हैं, विधि द्वारा यथापेक्षित रीति से अपने निर्वाचन व्यय का कोई भी लेखा दाखिल करने में विफल रहे हैं; और,

यतः, जिला निर्वाचन अधिकारी, टिहरी गढ़वाल, उत्तराखण्ड, और मुख्य निर्वाचन अधिकारी, उत्तराखण्ड की उक्त रिपोर्टों के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम 1961 के नियम 89 के उप नियम (5) के अंतर्गत निर्वाचन व्यय प्रस्तुत नहीं करने के लिए श्री विजय प्रकाश, को कारण बताओ नोटिस सं. 76/उत्तराखण्ड- वि.स./09/2022/सी.ई.एम.एस.-III, दिनांक 20 अक्टूबर,2022 जारी किया गया था; और

यतः, निर्वाचनों का संचालन नियम 1961 के नियम 89 के उप-नियम (6) के अनुसार, दिनांक 20 अक्टूबर, 2022 के उपयु र्क्त कारण बताओ नोटिस के जरिए श्री विजय प्रकाश, को निदेश दिया गया था कि वे इस नोटिस के प्राप्त होने के 20 दिनों के अंदर लेखा न प्रस्तुत कर पाने के कारणों को स्पष्ट करते हुए लिखित रूप में अपना अभ्यावेदन प्रस्तुत करें और साथ ही, निर्वाचन व्यय का अपना लेखा दाखिल करें; और

यतः, जिला निर्वाचन अधिकारी, टिहरी गढ़वाल द्वारा अपने पत्र संख्या 1860/29-23/2021 दिनांक 29.11.2022 जो मुख्य निर्वाचन अधिकारी के पत्र सं0 891/XXV-22(II)/2008 दिनांक15.06.2023 के द्वारा अग्रेषित कर आयोग को सूचना दी गई कि उक्त नोटिस अभ्यर्थी के भाई श्री विजय थपलियाल, द्वारा दिनांक 26.11.2022 को प्राप्त किया गया था; और,

यतः, जिला निर्वाचन अधिकारी, टिहरी गढ़वाल द्वारा अपने पत्र संख्या 947/29-23-(2)/2023 नई टिहरी, दिनांक 12.10.2023 के द्वारा अग्रेषित कर भेजी गई अनुपूरक रिपोर्ट दिनांक 12.10.2023 में यह बताया गया है कि श्री विजय प्रकाश, ने न तो कोई भी अभ्यावेदन और न ही अपने निर्वाचन व्यय का लेखा दाखिल किया है। इसके अतिरिक्त उन्होंने भारत निर्वाचन आयोग का सम्यक् नोटिस मिलने के उपरांत भी उक्त विफलता के लिए न तो कोई कारण बताया है और न ही कोई स्पष्टीकरण दिया है;और,

यतः, आयोग का यह समाधान हो गया है कि श्री विजय प्रकाश, निर्वाचन खर्चों का लेखा दाखिल करने में विफल रहे हैं और उनके पास इस विफलता के लिए कोई भी उचित कारण अथवा औचित्य नहीं है; और

यत:, लोक प्रतिनिधित्व अधिनियम,1951 की धारा 10क में अनुबंधित किया गया है कि:-

"यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति -

(क) निर्वाचन व्ययों का लेखा उस समय के भीतर और उस रीति में जैसी इस अधिनियम के द्वारा या अधीन अपेक्षित है, दाखिल करने में असफल रहा है; तथा

(ख) उस असफलता के लिए कोई अच्छा कारण या न्यायोचित्य नहीं रखता है, तो निर्वाचन आयोग शासकीय राजपत्र में प्रकाशित आदेश द्वारा उसको निरहित घोषित करेगा और ऐसा व्यक्ति उस आदेश की तारीख से तीन वर्ष की कालावधि के लिए निरहित होगा;

अतः, अब लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अनुसरण में भारत निर्वाचन आयोग एतद्द्वारा घोषणा करता है कि उत्तराखण्ड राज्य के 09-घनसाली विधान सभा निर्वाचन क्षेत्र से उत्तराखण्ड राज्य में विधान सभा के साधारण निर्वाचन, 2022 में निर्वाचन लड़ने वाले अभ्यर्थी श्री विजय प्रकाश, निवासी ग्राम एंव पोस्ट- मल्याकोट, पट्टी- नैलचामी, घनसाली, टिहरी गढ़वाल, को इस आदेश की तारीख से तीन वर्ष की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य-क्षेत्र की विधान सभा अथवा विधान परिषद् का सदस्य चुने जाने अथवा होने के लिए निरहित है।

O.N. 61.—WHEREAS, the General Election to 09-Ghansali Legislative Assembly of Uttarakhand, 2022 was held vide Notification No. 464/Uttarakhand -LA/2022 dated 21st January, 2022.

WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate at an election has to, within 30 days from the date of election of the returned candidate, lodge a true copy of the account of his election expenses with the District Election Officer; and,

WHEREAS, the result of the said election along with 09-Ghansali Assembly Constituency was declared by the concerned Returning Officer on 10th March, 2022. Hence, the last date for lodging the account of Election Expenses was 09th April, 2022; and,

WHEREAS, as per the report submitted by the District Election Officer, Tehri Garhwal, Uttarakhand and forwarded by the Chief Electoral Officer, Uttarakhand vide their letter No. 2782/XXV-53/2022, dated 22th April, 2021, Sh. Vijay Prakash, a contesting candidate of Uttarakhand from 09-Ghansali Assembly Constituency of Uttarakhand, has failed to lodge account of his election expenses, in the manner, as required under law; and,

WHEREAS, on the basis of the reports of the District Election Officer Tehri Garhwal, Uttarakhand and the Chief Electoral Officer, Uttarakhand, a Show-Cause notice, 76/Uttarakhand -LA/2022/09/CEMS-III dated 20.10.2022 was issued under sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India to Sh. Vijay Prakash, for not lodging the account of Election Expenses; and,

WHEREAS, As per the sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, through the above said Show-Cause Notice, dated 20.10.2022, Sh. Vijay Prakash, was directed to submit his representation in writing with explaining the reasons for not lodging the account and to lodge account of election expenses within 20 days from the date of receipt of the notice; and,

WHEREAS, the said notice was received by the candidate's brother Sh. Vijay Thapliyal on 26.11.2022. The acknowledgment receipt has been submitted to the Commission by the District Election Officer, Tehri Garhwal, vide its letter No. 1860/29-23/2021 dated 29.11.2022; forwarded by Chief Electoral Officer, Uttarakhand, letter no.891/XXV-22(II)/2008 date15.06.2023; and,

WHEREAS, the District Election Officer, Tehri Garhwal, in his Supplementary Report dated 12.10.2023 vide its letter No. 947/29-23-(2)/2023 New Tehri, dated 12.10.2023 forwarded by has reported that Sh. Vijay Prakash has neither submitted any representation nor any statement of account of election expenses. Further, after receipt of the due notice of the Election Commission of India, he has furnished neither any reason nor explanation for the said failure; and,

WHEREAS, the Commission is satisfied that Sh. Vijay Prakash, has failed to lodge the account of election expenses and has no good reason or justification for the failure,

WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that:-

"If the Election Commission is satisfied that a person-

(a) has failed to lodge an account of election expenses, within the time and in the manner required by or under this Act, and

(b) has no good reason or justification for the failure,

the Election Commission shall, by order published in the Official Gazette, declare him to be disqualified and any such person shall be disqualified for a period of three years from the date of the order‖;

NOW, THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the

Election Commission of India hereby declares Sh. Vijay Prakash resident of Village & Post- Malyakot, Patti-

Nailchami, Ghansali, Tehri Garhwal, a contesting candidate from 09-Ghansali Assembly Constituency of the State

of Uttarakhand in the General Election to the Legislative Assembly 2022 to be disqualified for being chosen as and

for being a member of either House of the Parliament or the Legislative Assembly or the Legislative Council of a

State or Union Territory for a period of three years from the date of this order.

आ.अ. 62.—यतः, उत्तराखण्ड राज्य की 32-खानपुर, विधान सभा क्षेत्र के साधारण निर्वाचन 2022 अधिसूचना नं. 464/उत्तरा.-वि.स./2022 दिनांक 21.01.2022 के जरिए की गई थी।

यतः 32-खानपुर, विधान सभा निर्वाचन क्षेत्र के रिटनिग अधिकारी द्वारा उक्त निर्वाचन का परिणाम 10 मार्च, 2022 को घोषित किया गया था। इस प्रकार, निर्वाचन व्यय का लेखा दाखिल करने की अन्तिम तारीख 09 अप्रैल, 2022 थी; और

यतः, जिला निर्वाचन अधिकारी, हरिद्वार, उत्तराखण्ड, और मुख्य निर्वाचन अधिकारी, उत्तराखण्ड की उक्त रिपोर्टों के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम 1961 के नियम 89 के उप नियम (5) के अंतर्गत निर्वाचन व्यय प्रस्तुत नहीं करने के लिए मनोरमा त्यागी, को कारण बताओ नोटिस सं. 76/उत्तराखण्ड- वि.स./32/2022/सी.ई.एम.एस.-III, दिनांक 20अक्टूबर, 2022 जारी किया गया था; और

यतः, जिला निर्वाचन अधिकारी, हरिद्वार द्वारा अपने पत्र संख्या 1152/29--40(निर्वाचन व्ययलेखा)/2022 दिनांक 13.12.2023 के द्वारा अग्रेषित कर भेजी गई अनुपूरक रिपोर्ट में यह बताया गया है कि मनोरमा त्यागी, ने न तो कोई भी अभ्यावेदन और न ही अपने निर्वाचन व्यय का लेखा दाखिल किया है। इसके अतिरिक्त उन्होंने भारत निर्वाचन आयोग का सम्यक् नोटिस मिलने के उपरांत भी उक्त विफलता के लिए न तो कोई कारण बताया है और न ही कोई स्पष्टीकरण दिया है;और,

O.N. 62.—WHEREAS, the General Election to 32-Khanpur, Legislative Assembly of Uttarakhand, 2022 was held vide Notification No. 464/Uttarakhand -LA/2022 dated21st January, 2022.

WHEREAS, the result of the said election along with 32-Khanpur Assembly Constituency was declared by the concerned Returning Officer on 10th March, 2022. Hence, the last date for lodging the account of Election Expenses was 09th April, 2022; and,

WHEREAS, on the basis of the reports of the District Election Officer Haridwar, Uttarakhand and the Chief Electoral Officer,Uttarakhand, a Show-Cause notice, 76/Uttarakhand -LA/2022/32/CEMS-III dated 20.10.2022 was issued under sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India to Manorma Taygi, for not lodging the account of Election Expenses; and,

WHEREAS, As per the sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, through the above said Show-Cause Notice, dated 20.10.2022, Manorma Taygi, was directed to submit his representation in writing with explaining the reasons for not lodging the account and to lodge account of election expenses within 20 days from the date of receipt of the notice; and,

WHEREAS, the said notice was pasted at dakshin muhana dukan on 08.11.2022 and an email were also sent on 27.09.2023 by the district election officer at email-id given by the candidate on affidavit. The acknowledgment receipt has been submitted to the Commission by the District Election Officer, Haridwar, vide its letter 1152/29- 40(र्नविा0 व्यय लेखव)/2022 dated 13.12.2023, and;

WHEREAS, the District Election Officer, Haridwar, in his Supplementary Report forwarded vide its letter No. 1152/29-40(र्नविा. व्यय लेखव)/2022 दवििांक13.12.2023 reported that Manorma Taygi, neither submitted any representation nor any statement of account of election expenses. Further, after receipt of the due notice of the Election Commission of India, he neither furnished any reason nor explanation for the said failure; and,

WHEREAS, the Commission is satisfied that Manorma Taygi, has failed to lodge the account of election expenses and has no good reason or justification for the failure,

WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that:-

"If the Election Commission is satisfied that a person-

(a) has failed to lodge an account of election expenses, within the time and in the manner required by or under this Act, and

(b) has no good reason or justification for the failure,

NOW, THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission of India hereby declares Manorma Taygi, resident of H.N. आ.अ. 63.—यतः, उत्तराखण्ड राज्य की 20-राजपुर रोड (अ.जा.) विधान सभा क्षेत्र के साधारण निर्वाचन 2022 अधिसूचना नं. 464/उत्तरा.-वि.स./2022 दिनांक 21.01.2022 के जरिए की गई थी।

यतः20-राजपुर रोड (अ.जा.) विधान सभा निर्वाचन क्षेत्र के रिटनिग अधिकारी द्वारा उक्त निर्वाचन का परिणाम10 मार्च, 2022 को घोषित किया गया था। इस प्रकार, निर्वाचन व्यय का लेखा दाखिल करने की अन्तिम तारीख 09 अप्रैल, 2022 थी; और

यतः, जिला निर्वाचन अधिकारी, देहरादून, उत्तराखण्ड के द्वारा प्रस्तुत और मुख्य निर्वाचन अधिकारी,उत्तराखण्ड द्वारा पत्र सं. 2782/XXV-53/2022 देहरादून के जरिए अग्रेषित दिनांक 22/04/2022 की रिपोर्ट के अनुसार श्री अमर सिह स्वेडिया, जो उत्तराखण्ड विधान सभा का साधारण निर्वाचन 2022 के निर्वाचन क्षेत्र 20-राजपुर रोड (अ.जा.) से लड़ने वाले अभ्यर्थी हैं, विधि द्वारा यथापेक्षित रीति से अपने निर्वाचन व्यय का कोई भी लेखा दाखिल करने में विफल रहे हैं; और,

यतः, जिला निर्वाचन अधिकारी, देहरादून, उत्तराखण्ड, और मुख्य निर्वाचन अधिकारी, उत्तराखण्ड की उक्त रिपोर्टों के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम 1961 के नियम 89 के उप नियम (5) के अंतर्गत निर्वाचन व्यय प्रस्तुत नहीं करने के लिए श्री अमर सिह स्वेडिया, को कारण बताओ नोटिस सं. 76/उत्तराखण्ड- वि.स./20/2022/सी.ई.एम.एस.-III, दिनांक 20 अक्टूबर, 2022 जारी किया गया था; और

यतः, निर्वाचनों का संचालन नियम 1961 के नियम 89 के उप-नियम (6) के अनुसार, दिनांक 20 अक्टूबर, 2022 के उपयु र्क्त कारण बताओ नोटिस के जरिए श्री अमर सिह स्वेडिया, को निदेश दिया गया था कि वे इस नोटिस के प्राप्त होने के 20 दिनों के अंदर लेखा न प्रस्तुत कर पाने के कारणों को स्पष्ट करते हुए लिखित रूप में अपना अभ्यावेदन प्रस्तुत करें और साथ ही, निर्वाचन व्यय का अपना लेखा दाखिल करें; और

यतः, जिला निर्वाचन अधिकारी, देहरादून द्वारा अपने पत्र संख्या 1768/25-75/2023 दिनांक 26.12.2023 के द्वारा आयोग को सूचना दी गई कि उक्त नोटिस अभ्यर्थी के द्वारा दिनांक 19.11.2022 को प्राप्त किया गया था; और,

यतः, जिला निर्वाचन अधिकारी, देहरादून द्वारा अपने पत्र संख्या 1768/25-75/2023 दिनांक 26.12.2022 के द्वारा भेजी गई संवीक्षा रिपोर्ट में यह बताया गया है कि श्री अमर सिह स्वेडिया, ने न तो कोई भी अभ्यावेदन और न ही अपने निर्वाचन व्यय का लेखा दाखिल किया है। इसके अतिरिक्त उन्होंने भारत निर्वाचन आयोग का सम्यक् नोटिस मिलने के उपरांत भी उक्त विफलता के लिए न तो कोई कारण बताया है और न ही कोई स्पष्टीकरण दिया है;और,

यतः, आयोग का यह समाधान हो गया है कि श्री अमर सिह स्वेडिया, निर्वाचन खर्चों का लेखा दाखिल करने में विफल रहे हैं और उनके पास इस विफलता के लिए कोई भी उचित कारण अथवा औचित्य नहीं है; और

यत:, लोक प्रतिनिधित्व अधिनियम,1951 की धारा 10क में अनुबंधित किया गया है कि:-

O.N. 63.—WHEREAS, the General Election to 20 Rajpur Road (SC) Legislative Assembly of Uttarakhand, 2022 was held vide Notification No. 464/Uttarakhand -LA/2022 dated 21st January, 2022.

WHEREAS, the result of the said election along with 20 Rajpur Road (SC) Assembly Constituency was declared by the concerned Returning Officer on 10th March, 2022. Hence, the last date for lodging the account of Election Expenses was 09th April, 2022; and,

WHEREAS, as per the report submitted by the District Election Officer, Dehradun, Uttarakhand and forwarded by the Chief Electoral Officer, Uttarakhand vide their letter No. 2782/XXV-53/2022, dated 22th April, 2021, Sh. Amar Singh Swedia, a contesting candidate of Uttarakhand from 20 Rajpur Road (SC) Assembly Constituency of Uttarakhand, has failed to lodge account of his election expenses, in the manner, as required under law; and,

WHEREAS, on the basis of the reports of the District Election Officer Dehradun, Uttarakhand and the Chief Electoral Officer, Uttarakhand, a Show-Cause notice, 76/Uttarakhand -LA/2022/20/CEMS-III dated 20.10.2022 was issued under sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India to Sh. Amar Singh Swedia, for not lodging the account of Election Expenses; and,

WHEREAS, As per the sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, through the above said Show-Cause Notice, dated 20.10.2022, Sh. Amar Singh Swedia, was directed to submit his representation in writing with explaining the reasons for not lodging the account and to lodge account of election expenses within 20 days from the date of receipt of the notice; and,

WHEREAS, the said notice was received by the candidate on 19.11.2022. The acknowledgment receipt has been submitted to the Commission by the District Election Officer, Dehradun, vide its letter No. 1768/25-75/2023 dated 26.12.2023; and,

WHEREAS, the District Election Officer, Dehradun, in his Scrutiny Report dated vide its letter No. 1786/25-75-/2023 Dehradun, dated 26.12.2023 forwarded by has reported that Sh. Amar Singh Swedia has neither submitted any representation nor any statement of account of election expenses. Further, after receipt of the due notice of the Election Commission of India, he has furnished neither any reason nor explanation for the said failure; and,

WHEREAS, the Commission is satisfied that Sh. Amar Singh Swedia, has failed to lodge the account of election expenses and has no good reason or justification for the failure,

WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that:-

"If the Election Commission is satisfied that a person-147 [भाग II—खण्ड 3(iii)] भारत का राजपत्र : मार्च 23, 2024/चैत्र 3, 1946 (a) has failed to lodge an account of election expenses, within the time and in the manner required by or under this Act, and

(b) has no good reason or justification for the failure,

आ.अ. 65.— यतः, उत्तराखण्ड राज्य की 67-किच्छा विधान सभा क्षेत्र के साधारण निर्वाचन 2022 अधिसूचना नं. 464/उत्तरा0-वि0स0/2022 दिनांक 21.01.2022 के जरिए की गई थी।

यतः लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 78 के अनुसार, निर्वाचन लड़ने वाले प्रत्येक अभ्यर्थी को, निर्वाचित अभ्यर्थीके निर्वाचन की तारीख से 30 दिनों के भीतर निर्वाचन व्यय के अपने लेखे की सही प्रति जिला निर्वाचन अधिकारी को दाखिल करनी होती है; और

यतः, जिला निर्वाचन अधिकारी, ऊधम सिह नगर उत्तराखण्ड के द्वारा प्रस्तुत और मुख्य निर्वाचन अधिकारी, उत्तराखण्ड द्वारा पत्र सं. 2782/XXV-53/2022देहरादून के जरिए अग्रेषित दिनांक 22/04/2022 की रिपोर्ट के अनुसार उबैद अली खाँ उर्फ नवाब राशिद खाँ, जो उत्तराखण्ड विधान सभाका साधारण निर्वाचन 2022 के निर्वाचन क्षेत्र 67-किच्छा से लड़ने वाले अभ्यर्थी हैं, विधि द्वारा यथापेक्षित रीति से अपने निर्वाचन व्यय का कोई भी लेखा दाखिल करने में विफल रहे हैं; और,

यतः, जिला निर्वाचन अधिकारी, ऊधम सिह नगर द्वारा अपने पत्र संख्या 965/29-व्यय लेखा/वि.स.नि.- 202/2023 दिनांक 19.12.2023 जो मुख्य निर्वाचन अधिकारी के पत्र सं0 2578/XXV-53/2021 दिनांक 27.12.2023 के द्वारा अग्रेषित की गई अनुपूरक संवीक्षा रिपोर्ट में यह बताया गया है कि उबैद अली खाँ उर्फ नवाब राशिद खाँने न तो कोई भी अभ्यावेदन और न ही अपने निर्वाचन व्यय का लेखा दाखिल किया है। इसके अतिरिक्त उन्होंने भारत निर्वाचन आयोग का सम्यक् नोटिस मिलने के उपरांत भी उक्त विफलता के लिए न तो कोई कारण बताया है और न ही कोई स्पष्टीकरण दिया है; और,

WHEREAS, as per the report submitted by the District Election Officer, Udham Singh Nagar, Uttarakhand and forwarded by the Chief Electoral Officer, Uttarakhandvide their letter No. 2782/XXV-53/2022, dated 22th April, 2021, UbaidUllah Khan alias Nawab Rashid Khan a contesting candidate of Uttarakhandfrom 67-Kichha Assembly Constituency of Uttarakhand, has failed to lodge account of his election expenses, in the manner, as required under law; and,151 [भाग II—खण्ड 3(iii)] भारत का राजपत्र : मार्च 23, 2024/चैत्र 3, 1946 WHEREAS, on the basis of the reports of the District Election Officer Udham Singh Nagar, Uttarakhand and the Chief Electoral Officer, Uttarakhand, a Show-Cause notice,76/Uttarakhand -LA/2022/26/CEMS-III dated 20.10.2022 was issued under sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India to Ubaid Ullah Khan alias Nawab Rashid Khan, for not lodging the account of Election Expenses; and,

WHEREAS, As per the sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, through the above said Show-Cause Notice, dated 20.10.2022, Ubaid Ullah Khan alias Nawab Rashid Khan, was directed to submit his representation in writing with explaining the reasons for not lodging the account and to lodge account of election expenses within 20 days from the date of receipt of the notice; and,

WHEREAS, the said notice was received bythe candidateon 05.12.2022. The acknowledgment receipt has been submitted to the Commission by the District Election Officer, Udham Singh Nagar, vide its letter No.1354/29- Expenditure-2022dated 12.12.2022forwarded by Chief Electoral Officer, Uttarakhand, vide letter no.891/XXV- 22(II)/2008dated 15.06.2023; and,

WHEREAS, the District Election Officer, Udham Singh Nagar, in his Supplementary Report vide its letter No. 965/29-व्यय लेखव/र्व.स.नि.-202/2023dated 19.12.2023 forwarded by Chief Electoral Officer, Uttarakhand, letter no. 2578/XXV-53/2021dated 27.12.2022has reported that Ubaid Ullah Khan alias Nawab Rashid Khan has neither submitted any representation nor any statement of account of election expenses. Further, after receipt of the due notice of the Election Commission of India, he has furnished neither any reason nor explanation for the said failure; and,

WHEREAS, the Commission is satisfied that Ubaid Ullah Khan alias Nawab Rashid Khan, has failed to lodge the account of election expenses and has no good reason or justification for the failure,

WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that:-

"If the Election Commission is satisfied that a person-

(a) has failed to lodge an account of election expenses, within the time and in the manner required by or under this Act, and

(b) has no good reason or justification for the failure, the Election Commission shall, by order published in the Official Gazette, declare him to be disqualified and any such person shall be disqualified for a period of three years from the date of the order‖;

NOW, THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission of India hereby declaresUbaid Ullah Khan alias Nawab Rashid Khan resident of Ward No. 25, Banbhulpura, Haldwani, acontesting candidate from 67-Kichha Assembly Constituency of the State of Uttarakhand in the General Election to the Legislative Assembly 2022 to be disqualified for being chosen as and for being a member of either House of the Parliament or the Legislative Assembly or the Legislative Council of a State or Union Territory for a period of three years from the date of this order.

आ.अ. 66.—यतः, उत्तराखण्ड राज्य की 41-कोटद्वार विधान सभा क्षेत्र के साधारण निर्वाचन 2022 अधिसूचना नं. 464/उत्तरा0-वि0स0/2022 दिनांक 21.01.2022 के जरिए की गई थी।

यतःलोक प्रतिनिधित्व अधिनियम, 1951 की धारा 78 के अनुसार, निर्वाचन लड़ने वाले प्रत्येक अभ्यर्थी को निर्वाचित अभ्यर्थी के निर्वाचन की तारीख से 30 दिनों के भीतर निर्वाचन व्यय के अपने लेखे की सही प्रति जिला निर्वाचन अधिकारी को दाखिल करनी होती है; और

यतः, जिला निर्वाचन अधिकारी, पौङी गढवाल, उत्तराखण्ड, और मुख्य निर्वाचन अधिकारी, उत्तराखण्ड की उक्त रिपोर्टों के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम 1961 के नियम 89 के उप नियम (5) के अंतर्गत निर्वाचन व्यय प्रस्तुत नहीं करने के लिए श्रीमति महिमा चौधरी, को कारण बताओ नोटिस सं. 76/उत्तराखण्ड- वि.स./41/2022/सी.ई.एम.एस.-III, दिनांक 20 अक्टूबर, 2022 जारी किया गया था; और

यतः, निर्वाचनों का संचालन नियम 1961 के नियम 89 के उप-नियम (6) के अनुसार, दिनांक 20 अक्टूबर, 2022 के उपयु र्क्त कारण बताओ नोटिस के जरिए श्रीमति महिमा चौधरी, को निदेश दिया गया था कि वे इस नोटिस के प्राप्त होने के 20 दिनों के अंदर लेखा न प्रस्तुत कर पाने के कारणों को स्पष्ट करते हुए लिखित रूप में अपना अभ्यावेदन प्रस्तुत करें और साथ ही, निर्वाचन व्यय का अपना लेखा दाखिल करें; और

यतः, जिला निर्वाचन अधिकारी, पौङी गढवाल द्वारा अपने पत्र संख्या 1333/29-EE/2022 दिनांक 23.11.2023 जो मुख्य निर्वाचन अधिकारी के पत्र सं0 2578/XXV-53/2021 दिनांक 27.12.2023 के द्वारा अग्रेषित कर आयोग को सूचना दी गई कि उक्त नोटिस दिनांक 20.10.2023 को अभ्यर्थी के घर पर निवासरत नही होने के कारण मकान के सहज दृश्य भाग पर नोटिस चस्पा कर साथ ही नोटिस की सूचना अभ्यर्थी के मो0 9634932010 पर व्हाटसप के माध्यम से भी भेज दिया गया था।; और,

यतः, जिला निर्वाचन अधिकारी, पौङी गढवाल द्वारा अपने पत्र संख्या 1333/29-EE/2022 दिनांक 23.11.2023 जो मुख्य निर्वाचन अधिकारी के पत्र सं0 2578/XXV-53/2021 दिनांक 27.12.2023 के द्वारा द्वारा अग्रेषित कर भेजी गई संवीक्षा रिपोर्ट में यह बताया गया है कि श्रीमति महिमा चौधरी, ने न तो कोई भी अभ्यावेदन और न ही अपने निर्वाचन व्यय का लेखा दाखिल किया है। इसके अतिरिक्त उन्होंने भारत निर्वाचन आयोग का सम्यक् नोटिस मिलने के उपरांत भी उक्त विफलता के लिए न तो कोई कारण बताया है और न ही कोई स्पष्टीकरण दिया है;और,

यतः, आयोग का यह समाधान हो गया है कि श्रीमति महिमा चौधरी, निर्वाचन खर्चों का लेखा दाखिल करने में विफल रहे हैं और उनके पास इस विफलता के लिए कोई भी उचित कारण अथवा औचित्य नहीं है; और

यत:, लोक प्रतिनिधित्व अधिनियम,1951 की धारा 10क में अनुबंधित किया गया है कि:-

"यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति -

अतः, अब लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अनुसरण में भारत निर्वाचन आयोग एतद्द्वारा घोषणा करता है कि उत्तराखण्ड राज्य के 41-कोटद्वार विधान सभा निर्वाचन क्षेत्र से उत्तराखण्ड राज्य में विधान सभा के साधारण निर्वाचन, 2022 में निर्वाचन लड़ने वाले अभ्यर्थी श्रीमति महिमा चौधरी, निवासी ग्राम- मन्नाखेडी, पोस्ट - मंगलोर, तहसील- रूङकी, जिला- हरिद्वार, हाल- कु करेती भवन द्वितीय फ्लोर, निकट- झण्डाचौक, कोटद्वार, को इस आदेश की तारीख से तीन वर्ष की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य-क्षेत्र की विधान सभा अथवा विधान परिषद् का सदस्य चुने जाने अथवा होने के लिए निरहित है।

WHEREAS, the result of the said election along with 41-Kotdwar Assembly Constituency was declared by the concerned Returning Officer on 10th March, 2022. Hence, the last date for lodging the account of Election Expenses was 09th April, 2022; and,

WHEREAS, as per the report submitted by the District Election Officer, Pauri Garhwal, Uttarakhand and forwarded by the Chief Electoral Officer, Uttarakhand vide their letter No. 2782/XXV-53/2022, dated 22th April, 2021, Smt. Mahima Chaudhary, a contesting candidate of Uttarakhand from 41-Kotdwar Assembly Constituency of Uttarakhand, has failed to lodge account of his election expenses, in the manner, as required under law; and,

WHEREAS, on the basis of the reports of the District Election Officer Pauri Garhwal, Uttarakhand and the Chief Electoral Officer, Uttarakhand, a Show-Cause notice,76/Uttarakhand -LA/2022/41/CEMS-III dated 20.10.2022 was issued under sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India to Smt. Mahima Chaudhary, for not lodging the account of Election Expenses; and,

WHEREAS, As per the sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, through the above said Show-Cause Notice, dated 20.10.2022, Smt. Mahima Chaudhary, was directed to submit his representation in writing with explaining the reasons for not lodging the account and to lodge account of election expenses within 20 days from the date of receipt of the notice; and,

WHEREAS, the said notice was pasted on 20.10.2023 in a visible part of the house due to the candidate not residing at house and notice was also served through whatsapp no. 9634932010. The acknowledgment receipt has been submitted to the Commission by the District Election Officer, Pauri Garhwal, vide its letter No. 1333/29- EE/2022 dated 23.11.2023; forwarded by Chief Electoral Officer, Uttarakhand, letter no. 2578/XXV-53/2021 date 27.12.2023; and,

WHEREAS, the District Election Officer, Pauri Garhwal, in his Scrutiny Report forwarded vide its letter No. 1333/29-EE/2022 dated 23.11.2023; forwarded by Chief Electoral Officer, Uttarakhand, letter no. 2578/XXV- 53/2021 date 27.12.2023; reported that Smt. Mahima Chaudhary, neither submitted any representation nor any statement of account of election expenses. Further, after receipt of the due notice of the Election Commission of India, he neither furnished any reason nor explanation for the said failure; and,

WHEREAS, the Commission is satisfied that Smt. Mahima Chaudhary, has failed to lodge the account of election expenses and has no good reason or justification for the failure,

यतः, 62-जसपुर, विधान सभा निर्वाचन क्षेत्र के रिटनिग अधिकारी द्वारा उक्त निर्वाचन का परिणाम 10 मार्च, 2022 को घोषित किया गया था। इस प्रकार, निर्वाचन व्यय का लेखा दाखिल करने की अन्तिम तारीख 09 अप्रैल, 2022 थी; और

यतः, जिला निर्वाचन अधिकारी, उधम सिह नगर, उत्तराखण्ड के द्वारा प्रस्तुत और मुख्य निर्वाचन अधिकारी, उत्तराखण्ड द्वारा पत्र सं. 2782/XXV-53/2022 देहरादून के जरिए अग्रेषित दिनांक 22/04/2022 की रिपोर्ट के अनुसार नफीस आजाद, जो उत्तराखण्ड विधान सभा का साधारण निर्वाचन 2022 के निर्वाचन क्षेत्र 62-जसपुर, से लड़ने वाले अभ्यर्थी हैं, विधि द्वारा यथापेक्षित रीति से अपने निर्वाचन व्यय का कोई भी लेखा दाखिल करने में विफल रहे हैं; और,

यतः, जिला निर्वाचन अधिकारी, उधम सिह नगर, उत्तराखण्ड, और मुख्य निर्वाचन अधिकारी, उत्तराखण्ड की उक्त रिपोर्टों के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम 1961 के नियम 89 के उप नियम (5) के अंतर्गत निर्वाचन व्यय प्रस्तुत नहीं करने के लिए नफीस आजाद, को कारण बताओ नोटिससं. 76/उत्तराखण्ड- वि.स./62/2022/सी.ई.एम.एस.-III, दिनांक 20अक्टूबर, 2022 जारी किया गया था; और

यतः, निर्वाचनों का संचालन नियम 1961 के नियम 89 के उप-नियम (6) के अनुसार, दिनांक 20अक्टूबर, 2022 के उपयु र्क्त कारण बताओ नोटिस के जरिए नफीस आजाद, को निदेश दिया गया था कि वे इस नोटिस के प्राप्त होने के 20 दिनों के अंदर लेखा न प्रस्तुत कर पाने के कारणों को स्पष्ट करते हुए लिखित रूप में अपना अभ्यावेदन प्रस्तुत करें और साथ ही, निर्वाचन व्यय का अपना लेखा दाखिल करें; और

यतः, जिला निर्वाचन अधिकारी, उधम सिह नगर, द्वारा अपने पत्र संख्या 1354/29-Expenditure- 2022 दिनांक12.12.2022 जो मुख्य निर्वाचन अधिकारी के पत्र सं0 891/XXV-22(II)/2008 दिनांक 15.06.2023 के द्वारा अग्रेषित कर आयोग को सूचना दी गई कि उक्त नोटिस अभ्यर्थी की पत्नी सलमा नाज, द्वारा दिनांक 02.11.2022 को प्राप्त किया गया था।; और,

यतः, जिला निर्वाचन अधिकारी, उधम सिह नगर, द्वारा अपने पत्र संख्या 965/29-व्यय लेखा/वि0स0नि0- 202/2023 दिनांक19.12.2023 जो मुख्य निर्वाचन अधिकारी के पत्र सं0 2578/XXV-53/2021 दिनांक 27.12.2023 के द्वारा अग्रेषित कर भेजी गई अनुपूरक संवीक्षा रिपोर्ट में यह बताया गया है कि नफीस आजाद, ने न तो कोई भी अभ्यावेदन और न ही अपने निर्वाचन व्यय का लेखा दाखिल किया है। इसके अतिरिक्त उन्होंने भारत निर्वाचन आयोग का सम्यक् नोटिस मिलने के उपरांत भी उक्त विफलता के लिए न तो कोई कारण बताया है और न ही कोई स्पष्टीकरण दिया है;और,

यतः, आयोग का यह समाधान हो गया है कि नफीस आजाद, निर्वाचन खर्चों का लेखा दाखिल करने में विफल रहे हैं और उनके पास इस विफलता के लिए कोई भी उचित कारण अथवा औचित्य नहीं है; और157 [भाग II—खण्ड 3(iii)] भारत का राजपत्र : मार्च 23, 2024/चैत्र 3, 1946 यत:, लोक प्रतिनिधित्व अधिनियम,1951 की धारा 10क में अनुबंधित किया गया है कि:-

"यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति -

अतः, अब लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अनुसरण में भारत निर्वाचन आयोग एतद्द्वारा घोषणा करता है कि उत्तराखण्ड राज्य के 62-जसपुर, विधान सभा निर्वाचन क्षेत्र से उत्तराखण्ड राज्य में विधान सभा के साधारण निर्वाचन, 2022 में निर्वाचन लड़ने वाले अभ्यर्थी नफीस आजाद, निवासी नई बस्ती, वार्ड नं0- 12, जसपुर, को इस आदेश की तारीख से तीन वर्ष की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य-क्षेत्र की विधान सभा अथवा विधान परिषद् का सदस्य चुने जाने अथवा होने के लिए निरहित है।

O.N. 68.—WHEREAS, the General Election to 62-Jaspur, Legislative Assembly of Uttarakhand, 2022 was held vide Notification No. 464/Uttarakhand -LA/2022dated21st January, 2022.

WHEREAS, the result of the said election along with 62-Jaspur, Assembly Constituency was declared by the concerned Returning Officer on 10th March, 2022. Hence, the last date for lodging the account of Election Expenses was 09th April, 2022; and,

WHEREAS, as per the report submitted by the District Election Officer, Udham Singh Nagar, and forwarded by the Chief Electoral Officer, Uttarakhand vide their letter No. 2782/XXV-53/2022, dated 22th April, 2021, Nafees Azad, a contesting candidate of Uttarakhand from 62-Jaspur, Assembly Constituency of Uttarakhand, has failed to lodge account of his election expenses, in the manner, as required under law; and,

WHEREAS, on the basis of the reports of the District Election Officer Udham Singh Nagar, and the Chief Electoral Officer, Uttarakhand, a Show-Cause notice,76/Uttarakhand -LA/2022/62/CEMS-III dated 20.10.2022 was issued under sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India to Nafees Azad, for not lodging the account of Election Expenses; and,

WHEREAS, As per the sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, through the above said Show-Cause Notice, dated 20.10.2022, Nafees Azad, was directed to submit his representation in writing with explaining the reasons for not lodging the account and to lodge account of election expenses within 20 days from the date of receipt of the notice; and,

WHEREAS, the said notice was received by the candidate's wife Salma Naaz, on 02.11.2022 The acknowledgment receipt has been submitted to the Commission by the District Election Officer, Udham Singh Nagar, vide its letter No.1354/29-Expenditure-2022 dated 12.12.2022; forwarded by Chief Electoral Officer, Uttarakhand, letter no. 891/XXV-22(II)/2008 date 15.06.2023; and,

WHEREAS, the District Election Officer,Udham Singh Nagar, in his Supplementary Scrutiny Report forwarded vide its letter No. 965/29-व्यय लेखव/र्व0स0नि0-202/2023 dated 19.12.2023; forwarded by Chief Electoral Officer, Uttarakhand, letter no. 2578/XXV-53/2021 date 27.12.2023; reported that Nafees Azad, neither submitted any representation nor any statement of account of election expenses. Further, after receipt of the due notice of the Election Commission of India, he neither furnished any reason nor explanation for the said failure; and,

WHEREAS, the Commission is satisfied that Nafees Azad, has failed to lodge the account of election expenses and has no good reason or justification for the failure,158 THE GAZETTE OF INDIA : MARCH 23, 2024/CHAITRA 3, 1946 [PART II—SEC. 3(iii)] WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that:-

"If the Election Commission is satisfied that a person-

(a) has failed to lodge an account of election expenses, within the time and in the manner required by or under this Act, and

(b) has no good reason or justification for the failure,

NOW, THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission of India hereby declares Nafees Azad, resident of Nai Basti, Ward no- 12 Jaspur, a contesting candidate from 62-Jaspur, Assembly Constituency of the State of Uttarakhand in the General Election to the Legislative Assembly 2022 to be disqualified for being chosen as and for being a member of either House of the Parliament or the Legislative Assembly or the Legislative Council of a State or Union Territory for a period of three years from the date of this order

WHEREAS, As per the sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, through the above said Show-Cause Notice, dated 20.10.2022, Sh. Navneet Uniyal, was directed to submit his representation in writing with explaining the reasons for not lodging the account and to lodge account of election expenses within 20 days from the date of receipt of the notice; and,

यतः, निर्वाचनों का संचालन नियम 1961 के नियम 89 के उप-नियम (6) के अनुसार, दिनांक 20 अक्टूबर, 2022 के उपयु र्क्त कारण बताओ नोटिस के जरिए श्री राजू सिहं, को निदेश दिया गया था कि वे इस नोटिस के प्राप्त होने के161 [भाग II—खण्ड 3(iii)] भारत का राजपत्र : मार्च 23, 2024/चैत्र 3, 1946 20 दिनों के अंदर लेखा न प्रस्तुत कर पाने के कारणों को स्पष्ट करते हुए लिखित रूप में अपना अभ्यावेदन प्रस्तुत करें और साथ ही, निर्वाचन व्यय का अपना लेखा दाखिल करें; और

यतः, सहायक मुख्य निर्वाचन अधिकारी, उत्तराखंड द्वारा अपने पत्र संख्या 891/XXV-22(II)2008 दिनांक 15.06.2023 जो जिला निर्वाचन अधिकारी के पत्र सं0 347/29-40(निर्वा. व्यय लेखा)/2022 दिनांक 12.04.2023 के व ग्राम प्रधान की सूचना के द्वारा अग्रेषित कर आयोग को सूचना दी गई कि उक्त नोटिस दिनांक 20.10.2023 को अभ्यर्थी के घर पर निवासरत नही होने के कारण नोटिस बिना तामील वापस हो गया। तदुपरांत

जिला निर्वाचन अधिकारी, हरिद्वार द्वारा अपने पत्र संख्या 1153/29-40(निर्वा.व्यय लेखा)/2022 दिनांक 13.12.2023 जो मुख्य निर्वाचन अधिकारी के पत्र सं0 2578/XXV-53/2021 दिनांक 27.12.2023 के द्वारा अग्रेषित कर भेजी गई संवीक्षा रिपोर्ट में यह बताया गया है कि श्री राजू सिहं, के निवास पर नोटिस की प्रति गवाहों के सामने दिनांक 14.10.2023 को चस्पा करने के बाद जिला निर्वाचन अधिकारी ने अपने पत्र संख्या 1517/29-40(निर्वा.व्यय लेखा)/2022 दिनांक 14 फरवरी, 2024 में बताया कि अभी तक अभ्यर्थी ने न तो कोई भी अभ्यावेदन किया है और न ही अपने निर्वाचन व्यय का लेखा दाखिल किया है। इसके अतिरिक्त उन्होंने भारत निर्वाचन आयोग का सम्यक् नोटिस मिलने के उपरांत भी उक्त विफलता के लिए न तो कोई कारण बताया है और न ही कोई स्पष्टीकरण दिया है; और,

यतः, आयोग का यह समाधान हो गया है कि श्री राजू सिहं, निर्वाचन खर्चों का लेखा दाखिल करने में विफल रहे हैं और उनके पास इस विफलता के लिए कोई भी उचित कारण अथवा औचित्य नहीं है; और

यत:, लोक प्रतिनिधित्व अधिनियम,1951 की धारा 10क में अनुबंधित किया गया है कि:-

अतः, अब लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अनुसरण में भारत निर्वाचन आयोग एतद्द्वारा घोषणा करता है कि उत्तराखण्ड राज्य के 29-झबरेरा विधान सभा निर्वाचन क्षेत्र से उत्तराखण्ड राज्य में विधान सभा के साधारण निर्वाचन, 2022 में निर्वाचन लड़ने वाले अभ्यर्थी श्री राजू सिहं, निवासी ग्राम- दरगाहपुर, पोस्ट - राइसी, जिला- हरिद्वार । को इस आदेश की तारीख से तीन वर्ष की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य-क्षेत्र की विधान सभा अथवा विधान परिषद् का सदस्य चुने जाने अथवा होने के लिए निरहित है।

O.N. 70.—WHEREAS, the General Election to 29-Jhabrera Legislative Assembly of Uttarakhand, 2022 was held vide Notification No. 464/Uttarakhand -LA/2022 dated 21st January, 2022.

WHEREAS, the result of the said election along with 29-Jhabrera Assembly Constituency was declared by the concerned Returning Officer on 10th March, 2022. Hence, the last date for lodging the account of Election Expenses was 09th April, 2022; and,

WHEREAS, as per the report submitted by the District Election Officer, Haridwar, Uttarakhand and forwarded by the Chief Electoral Officer, Uttarakhand vide their letter No. 2782/XXV-53/2022, dated 22th April, 2021, Shri Rajoo Singh, a contesting candidate of Uttarakhand from 29-Jhabrera Assembly Constituency of Uttarakhand, has failed to lodge account of his election expenses, in the manner, as required under law; and,162 THE GAZETTE OF INDIA : MARCH 23, 2024/CHAITRA 3, 1946 [PART II—SEC. 3(iii)] WHEREAS, on the basis of the reports of the District Election Officer Haridwar, Uttarakhand and the Chief Electoral Officer, Uttarakhand, a Show-Cause notice,76/Uttarakhand-LA/2022/29/CEMS-III dated 20.10.2022 was issued under sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India to Shri Rajoo Singh, for not lodging the account of Election Expenses; and,

WHEREAS, As per the sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, through the above said Show-Cause Notice, dated 20.10.2022, Shri Rajoo Singh, was directed to submit his representation in writing with explaining the reasons for not lodging the account and to lodge account of election expenses within 20 days from the date of receipt of the notice; and,

WHEREAS, Assistant chief election officer, Uttrakhand Whereas, the Assistant Chief Electoral Officer, Uttarakhand vide his letter No. 891/XXV-22(II)2008 dated 15.06.2023 which is vide District Election Officer's letter No. 347/29-40(Expenditure Account)/2022 dated 12.04.2023 And by forwarding the information of the village head, it was informed to the Commission that the said notice was returned without service due to the candidate not residing at his house on 20.10.2023.

WHEREAS, District Election Officer, Haridwar in its letter No. 1153/29-40(Expenditure Account)/2022 dated 13.12.2023 which was forwarded by the Chief Electoral Officer's letter No. 2578/XXV-53/2021 dated 27.12.2023 stated that after pasting notice at the residence of Mr. Rajoo Singh in front of witnesses on 14.10.2023, the

District Election Officer stated in his letter No. 1517/29-40 (र्नविा.व्यय लेखव)/2022 dated 14 February, 2024 that till now the candidate has neither made any representation nor Has filed the account of his election expenditure. Apart from this, even after receiving due notice from the Election Commission of India, he has neither given any reason nor given any explanation for the said failure; And,

WHEREAS, the Commission is satisfied that Shri Rajoo Singh, has failed to lodge the account of election expenses and has no good reason or justification for the failure,

WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that:-

"If the Election Commission is satisfied that a person-

(a) has failed to lodge an account of election expenses, within the time and in the manner required by or under this Act, and

NOW, THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission of India hereby declares Shri Rajoo Singh resident of Village- Dargahpur, Post- Raisi, Dist.- Haridwar, a contesting candidate from 29-Jhabrera Assembly Constituency of the State of Uttarakhand in the General Election to the Legislative Assembly 2022 to be disqualified for being chosen as and for being a member of either House of the Parliament or the Legislative Assembly or the Legislative Council of a State or Union Territory for a period of three years from the date of this order.

आ.अ. 71.—यतः, उत्तराखण्ड राज्य की 16-विकासनगर, विधान सभा क्षेत्र के साधारण निर्वाचन 2022 अधिसूचना नं. 464/उत्तरा0-वि0स0/2022 दिनांक 21.01.2022 के जरिए की गई थी।

यतः लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 78 के अनुसार, निर्वाचन लड़ने वाले प्रत्येक अभ्यर्थी को,

निर्वाचित अभ्यर्थी के निर्वाचन की तारीख से 30 दिनों के भीतर निर्वाचन व्यय के अपने लेखे की सही प्रति जिला निर्वाचन

अधिकारी को दाखिल करनी होती है; और

यतः 16-विकासनगर, विधान सभा निर्वाचन क्षेत्र के रिटनिग अधिकारी द्वारा उक्त निर्वाचन का परिणाम

10 मार्च, 2022 को घोषित किया गया था। इस प्रकार, निर्वाचन व्यय का लेखा दाखिल करने की अन्तिम तारीख

09 अप्रैल, 2022 थी; और163 [भाग II—खण्ड 3(iii)] भारत का राजपत्र : मार्च 23, 2024/चैत्र 3, 1946 यतः, जिला निर्वाचन अधिकारी, देहरादून, उत्तराखण्ड के द्वारा प्रस्तुत और मुख्य निर्वाचन अधिकारी, उत्तराखण्ड द्वारा पत्र सं. 2782/XXV-53/2022 देहरादून के जरिए अग्रेषित दिनांक 22/04/2022 की रिपोर्ट के अनुसार श्री संदीप दुबे, जो उत्तराखण्ड विधान सभा का साधारण निर्वाचन 2022 के निर्वाचन क्षेत्र 16-विकासनगर, से लड़ने वाले अभ्यर्थी हैं, विधि द्वारा यथापेक्षित रीति से अपने निर्वाचन व्यय का कोई भी लेखा दाखिल करने में विफल रहे हैं; और,

यतः, जिला निर्वाचन अधिकारी, देहरादून, उत्तराखण्ड, और मुख्य निर्वाचन अधिकारी, उत्तराखण्ड की उक्त रिपोर्टों के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम 1961 के नियम 89 के उप नियम (5) के अंतर्गत निर्वाचन व्यय प्रस्तुत नहीं करने के लिए श्री संदीप दुबे, को कारण बताओ नोटिस सं. 76/उत्तराखण्ड- वि.स./16/2022/सी.ई.एम.एस.-III, दिनांक 20 अक्टूबर, 2022 जारी किया गया था; और

यतः, निर्वाचनों का संचालन नियम 1961 के नियम 89 के उप-नियम (6) के अनुसार, दिनांक 20 अक्टूबर, 2022 के उपयु र्क्त कारण बताओ नोटिस के जरिए श्री संदीप दुबे, को निदेश दिया गया था कि वे इस नोटिस के प्राप्त होने के 20 दिनों के अंदर लेखा न प्रस्तुत कर पाने के कारणों को स्पष्ट करते हुए लिखित रूप में अपना अभ्यावेदन प्रस्तुत करें और साथ ही, निर्वाचन व्यय का अपना लेखा दाखिल करें; और

यतः, जिला निर्वाचन अधिकारी, देहरादून ने अपने पत्र संख्या 312/25-75/2022-23 दिनांक 20.03.2023 के जरिए आयोग को सूचना दी गई कि उक्त नोटिस अभ्यर्थी की बहन कु .शीतल शर्मा द्वारा दिनांक 26.11.2022 को प्राप्त किया गया था, और

यतः, जिला निर्वाचन अधिकारी, देहरादून द्वारा अपने पत्र संख्या 1763/25-75/2023 दिनांक 26.12.2023 के द्वारा अग्रेषित कर भेजी गई अनुपूरक रिपोर्ट में यह बताया गया है कि श्री संदीप दुबे, ने न तो कोई भी अभ्यावेदन किया और न ही अपने निर्वाचन व्यय का लेखा दाखिल किया है। इसके अतिरिक्त उन्होंने भारत निर्वाचन आयोग का सम्यक् नोटिस मिलने के उपरांत भी उक्त विफलता के लिए न तो कोई कारण बताया है और न ही कोई स्पष्टीकरण दिया है; और,

यतः, आयोग का यह समाधान हो गया है कि श्री संदीप दुबे, निर्वाचन खर्चों का लेखा दाखिल करने में विफल रहे हैं और उनके पास इस विफलता के लिए कोई भी उचित कारण अथवा औचित्य नहीं है; और

यत:, लोक प्रतिनिधित्व अधिनियम,1951 की धारा 10क में अनुबंधित किया गया है कि:-

"यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति -

WHEREAS, As per the sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, through the above said Show-Cause Notice, dated 20.10.2022, Sandeep Duby, was directed to submit his representation in writing with explaining the reasons for not lodging the account and to lodge account of election expenses within 20 days from the date of receipt of the notice; and,

Whereas, District Election Officer, Dehradun informed the Commission through its letter No. 312/25- 75/2022-23 dated 20.03.2023 that the said notice was received by the candidate's sister Ms Sheetal Sharma on 26.11.2022, And

WHEREAS, the District Election Officer, Dehradun, in his Supplementary Report forwarded vide its letter No. 1763/25-75/2023 dated 26.12.2023 reported that Sandeep Duby, neither submitted any representation nor any statement of account of election expenses. Further, after receipt of the due notice of the Election Commission of India, he neither furnished any reason nor explanation for the said failure; and,

WHEREAS, the Commission is satisfied that Sandeep Duby, has failed to lodge the account of election expenses and has no good reason or justification for the failure,

WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that:-

"If the Election Commission is satisfied that a person-

(a) has failed to lodge an account of election expenses, within the time and in the manner required by or under this Act, and

आ.अ. 72.—यतः, श्री बिनोद तिवारी, तितरा टोले गंधुछापर तितरा, सिवान (इसमें इसके बाद "अभ्यर्थी" के रूप

में संदभित) वर्ष 2020 में संपन्न 106-जीरादेई विधान सभा निर्वाचन क्षेत्र से बिहार विधान सभा, 2020 के साधारण

निर्वाचन के लिए निर्वाचन लड़ने वाले अभ्यर्थी थे। लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 78 के अनुसार,

निर्वाचन लड़ने वाले अभ्यथियों को धारा 77 के अधीन परिणाम की घोषणा होने के 30 दिनों के भीतर उसके अथवा उसके

निर्वाचन अभिकर्ता द्वारा रखे गए निर्वाचन व्ययों का अपना लेखा प्रस्तुत करना अपेक्षित होता है; और165 [भाग II—खण्ड 3(iii)] भारत का राजपत्र : मार्च 23, 2024/चैत्र 3, 1946 यतः, मुख्य निर्वाचन अधिकारी, बिहार (यहां इसके बाद 'सीईओ' के रूप में संदभित) के जरिए दिनांक 24.12.2020 और 06.01.2021 के पत्रों के माध्यम से प्राप्त जिला निर्वाचन अधिकारी, सीवान (यहां इसके बाद 'डीईओ' के रूप में संदभित) की रिपोर्ट के अनुसार, श्री बिनोद तिवारी ने अपने निर्वाचन व्ययों का लेखा प्रस्तुत नहीं किया। इस अभ्यर्थी को अपने निर्वाचन व्ययों का लेखा प्रस्तुत करने में असफल रहने के लिए निर्वाचनों का संचालन नियम, 1961 के नियम 89(5) के अधीन दिनांक 25.06.2021 को कारण बताओ नोटिस जारी किया गया था। नोटिस अभ्यर्थी द्वारा दिनांक 10.07.2021 को प्राप्त किया गया था; और

यतः, जिला निर्वाचन अधिकारी, सीवान ने दिनांक 08.12.2022 की अपनी पूरक रिपोर्ट के जरिए सूचित किया है कि दिनांक 25.06.2021 की आयोग के कारण बताओ नोटिस प्राप्त करने के बाद भी अभ्यर्थी ने अपना निर्वाचन व्यय नहीं प्रस्तुत किया है। तदनुसार, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अधीन अपने निर्वाचन व्यय को आयोग के समक्ष प्रस्तुत न करने के कारण आयोग के दिनांक 11.01.2023 के आदेश सं. 76/बीआर- एलए/2020/106/सीईएमएस-।।। के जरिए उन्हें तीन वर्ष की अवधि के लिए संसद के किसी भी सदन अथवा राज्य के विधान सभा अथवा विधान परिषद का सदस्य चुने जाने अथवा होने से निरहित कर दिया था; और

यतः, दिनांक 11.01.2023 के निरर्हता आदेश के प्रत्युत्तर में अभ्यर्थी ने दिनांक 31.01.2023 को अपना अभ्यावेदन प्रस्तुत कर दिया है, जिसमें उन्होंने कहा है कि उन्होंने अपने समस्त निर्वाचन व्यय का लेखा दिनांक 16.12.2020 को डीईओ, सीवान को प्रस्तुत कर दिया है। अभ्यर्थी को आयोग के कार्यालय आदेश सं. 4/2015-एसडीआर, दिनांक 08.09.2015 में यथाविनिदिष्ट निरर्हता को हटाने की प्रक्रिया का पालन करने और अपीली प्राधिकारी के समक्ष अपील करने की सलाह दी गई थी।

यतः, अभ्यर्थी ने निरर्हता आदेश में उल्लिखित कारणों से हुई निरर्हता को हटाने के लिए लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 11 के अधीन दिनांक 24.04.2023 को एक अपील दायर की है; और

यतः, अधोहस्ताक्षरी ने पाया है कि आयोग के पत्र क्रमशः दिनांक 13.04.2023 एवं 28.06.2023 के जरिए अभ्यावेदन तथा अपील को डीईओ, सीवान को उनकी टिप्पणियों के लिए भेजा गया था। डीईओ, सीवान ने दिनांक 09.08.2023 के अपने पत्र के जरिए अपनी टिप्पणियां प्रस्तुत की हैं तथा उल्लेख किया है कि अभ्यर्थी ने न तो आयोग द्वारा जारी नोटिस का जवाब दिया है और न ही मूल लेखा प्रस्तुत किया है; और

यतः, दिनांक 04.01.2024 को उक्त अपील और संपूर्ण निर्वाचन व्ययों के प्राप्त होने पर उन्हें अधोहस्ताक्षरी जो इस मामले में लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 19(क) के अधीन आयोग द्वारा अधोहस्ताक्षरी को प्रत्यायोजित आयोग की शक्तियों के नाते इस के स में अपीली प्राधिकारी हैं, के समक्ष दिनांक 22 फरवरी, 2024 को व्यक्तिगत: सुने जाने और अपना के स प्रस्तुत करने का मौका दिया गया था; और

यतः, अधोहस्ताक्षरी ने व्यक्तिगत सुनवाई के दौरान उनके द्वारा दी गई प्रस्तुति के साथ-साथ दिनांक 31.01.2023 के अपने अभ्यावेदन में उनके द्वारा उठाए गए बिदुओं और इस मामले में अन्य जारी संगत तथ्यों सहित दिनांक 24.04.2023 की अपील पर सावधानीपूर्वक विचार किया है; और

यतः, चू ंकि नोटिस दिए जाने के बाद भी अभ्यर्थी ने अपनी निरर्हता के समय तक, दिनांक 25.06.2021 के आयोग के उक्त कारण बताओ नोटिस के विरुद्ध कोई अभ्यावेदन प्रस्तुत नहीं किया, इसलिए अधोहस्ताक्षरी का अभिमत है कि यद्यपि यह के स निरर्हता हटाए जाने के बिल्कु ल भी योग्य नहीं है, फिर भी न्याय के उद्देश्य की उस स्थिति में समुचित रूप से पूति हो जाएगी जब निरर्हता की अवधि पहले ही व्यतीत की जा चुकी अवधि तक घटा दी जाए, क्योंकि अभ्यर्थी ने दिनांक 04.01.2024 को प्राधिकारी को निर्वाचन व्ययों का अपना संपूर्ण लेखा प्रस्तुत कर दिया है; और

अब, इसलिए, निर्वाचन आयोग द्वारा इस संबंध में प्रत्यायोजित शक्तियों का प्रयोग करते हुए, अधोहस्ताक्षरी एतद्द्वारा, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 11 के अधीन आदेश देते हैं कि उक्त श्री बिनोद तिवारी पर उक्त अधिनियम की धारा 10क के अधीन आदेश सं. 76/बीआर-एलए/2020/106/सीईएमएस-।।। के जरिए दिनांक 11 जनवरी, 2023 को लगाई गई निरर्हता को घटाकर दिनांक 04 जनवरी, 2024 सहित इसी अवधि तक कम कर दी जाए और दिनांक 05.01.2024 और इसके बाद से उक्त निरर्हता लागू नहीं रह जाएगी। यह भी आदेश दिया जाता है कि इस आदेश का सभी संबंधितों द्वारा तत्काल अनुपालन किया जाएगा।

O.N. 72.—WHEREAS, Shri Binod Tiwari, Titra Tole Gandhuchhapar Titra, Siwan (hereinafter referred to as ―the candidate‖) was a contesting candidate for the General Election to the Legislative Assembly,Bihar, 2020 from 106-Ziradei Assembly Constituency, held in the year, 2020. As per the Section 78 of the Representation of the People Act, 1951 the contesting candidates are required to lodge his account of election expenses within 30 days of declaration of result kept by him or by his election agent under Section 77; and

WHEREAS, as per report of District Election Officer (hereinafter referred to as DEO), Siwan received through Chief Electoral Officer (hereinafter referred to as CEO), Bihar vide letters dated 24.12.2020 and 06.01.2021, Shri Binod Tiwari did not file the account of his election expenses. The Candidate was issued Show Cause Notice on 25.06.2021 under rule 89(5) of the Conduct of Election Rules 1961 for failing to lodge his account of election expenses. The notice was received by the candidate on 10.07.2021; and

WHEREAS, the DEO, Siwan vide his Supplementary Report dated 08.12.2022 has informed that the candidate has not submitted his election expenses even after the receipt of the Commission's show cause notice dated 25.06.2021. Accordingly, he was disqualified for not lodging his account of election expenses under section 10A of the Representation of People Act, 1951 vide Commission's Order No. 76/BR-LA/2020/106/CEMS-III dated 11.01.2023 for being chosen as, and for being, a member of either House of the Parliament or of Legislative Assembly or Legislative Council of a State for a period of three years; and

WHEREAS, in response to the disqualification order dated 11.01.2023, the candidate has submitted his representation dated 31.01.2023 wherein he has stated that he has submitted all the account of election expenditure to the DEO, Siwan on 16.12.2020. The candidate were advised to appeal to the Appellate Authority and follow the procedure for removal of disqualification as prescribed in Commission's office order no. 4/2015-SDR dated 08.09.2015; and

WHEREAS, the candidate has now preferred an appeal dated 24.04.2023 under Section 11 of the Representation of the People Act, 1951 for the removal of the disqualification for the reasons stated therein; and

WHEREAS, the undersigned has noted that the representation and the appeal were sent to DEO, Siwan for his comments vide the Commission's letters dated 13.04.2023 and 28.06.2023 respectively. The DEO, Siwan has furnished his comments vide their letter dated 09.08.2023 and stated that the candidate neither responded to the notice issued by the Commission nor submitted original account; and

WHEREAS, upon receipt of the said appeal and complete election expenses on 04.01.2024, he was afforded with an opportunity of being heard in person and present his case on 22nd February, 2024, before the undersigned, who is the Appellate Authority in the case, by virtue of the powers of the Commission delegated to the undersigned by the Commission under section 19A of the Representation of the People Act, 1951; and

WHEREAS, the undersigned has carefully considered the submission made by him during the personal hearing as well as the points raised by him in his representation dated 31.01.2023 and appeal dated 24.04.2023 including all other relevant facts in the case; and

WHEREAS, since even after serving notice, the candidate did not submit any representation against the Commission's said Show Cause Notice dated 25.06.2021, till the time of his disqualification, the undersigned is of the view that though the case is not fit for removal of disqualification altogether, the ends of justice will be adequately met if the disqualification period is reduced to the period already undergone as the candidate has furnished his complete account of election expenses to the authority on 04.01.2024; and

NOW, THEREFORE, in exercise of the powers delegated in this regard by the Election Commission, the undersigned hereby orders, under Section 11 of the Representation of the People Act, 1951, that the disqualification imposed on 11th January, 2023 vide Order No. 76/BR-LA/2020/106/CEMS-III under Section 10A of the said Act, on the said Shri Binod Tiwari be reduced to the period up to and including 04th January, 2024 , and the said disqualification shall not be operative with effect from 05th January, 2024 onwards. It is further ordered that this order shall be executed immediately by all concerned.
