आ.अ. 73.— 1. यत:, आयोग ने अपने आदेश सं. 76/ईसीआई/आदेश/टीईआरआर/ईएस-II/ओआर-एलए/17/ 2019, दिनांक 28.12.2021 के जरिए वर्ष 2019 में आयोजित ओडिशा विधान सभा के साधारण निर्वाचन में 17-सम्बलपुर विधान सभा निर्वाचन क्षेत्र से निर्वाचन लड़ने वाले अभ्यर्थी श्री लक्ष्मण कु मार भोई, एनएच-6, धरसा रोड, डाकघर-धनकं डा को लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के तहत विधि द्वारा अपेक्षित रीति से अपने निर्वाचन व्यय का लेखा दाखिल नहीं किए जाने के लिए लोक सभा अथवा विधान सभा अथवा राज्य के विधान परिषद के सदस्य के रूप में चुने जाने के लिए एवं सदस्य होने के लिए, निरहित किया था; और2. यत:, उक्त श्री लक्ष्मण कु मार भोई ने उक्त आदेश के विरुद्ध लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 11 के तहत अपील दिनांक 14.12.2023 दायर की थी और उन्होंने अपने निर्वाचन व्यय का लेखा भी प्रस्तुत किया था तथा उक्त अपील में व्यक्त कारणों के लिए निरर्हता को हटाने का अनुरोध किया था; और 2256 GI/2024 (167) 168 THE GAZETTE OF INDIA : APRIL 6, 2024/CHAITRA 17, 1946 [PART II—SEC. 3(iii)] 3. यत:, सक्षम प्राधिकारी ने लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 11 के तहत इस अपील पर निर्णय लेने के लिए पूर्वोक्त आवेदक के लिए (वीडियो कां्े स के माध्यम से) सुनवाई करने का निर्णय लिया एवं उन्हें सुने जाने के बाद अपने आदेश दिनांक 26 मार्च, 2024 के जरिए यह निर्णय लिया है कि आदेश सं. 76/ईसीआई/आदेश/टीईआरआर/ ईएस-II/ओआर-एलए/17/2019 दिनांक 28.12.2021 के जरिए उक्त श्री लक्ष्मण कु मार भोई पर अधिरोपित निरर्हता का

तत्काल प्रभाव से प्रतिसंहरण कर दिया जाएगा ।

4. अब, अत:, आयोग के आदेश सं. 76/ईसीआई/आदेश/टीईआरआर/ईएस-II/ओआर-एलए/17/2019 दिनांक

28.12.2021 के अनुसार श्री लक्ष्मण कु मार भोई की निरर्हता को 28.12.2021 से 21.03.2024 तक की अवधि के लिए

क्रियाशील मानी जाएगी और तदुपरांत, उसका प्रतिसंहरण हो जाता है ।

ORDER

New Delhi, the 27th March, 2024

O.N. 73.—1. WHEREAS, the Commission, vide its Order No. 76/ECI/ORD/TERR/ES-II/OR-LA/17/2019 dated 28.12.2021, had disqualified Shri Laxman Kumar Bhoi, NH-6, Dharsa Road, PO-Dhankanda, Odisha, a contesting candidate for General Election to Odisha Legislative Assembly from 17-Sambalpur Assembly Constituency, held in the year 2019, under Section 10 A of the Representation of the People Act, 1951, for being chosen as, and for being a member of either House of the People or of the Legislative Assembly or Legislative Council of a State for a period of three years, for not lodging his account of election expenses in the manner required by law; and

2. WHEREAS, the said Shri Laxman Kumar Bhoi had preferred an appeal dated 14.12.2023 under Section 11 of the Representation of the People Act, 1951 against the said order and had also submitted his accounts of election expenses and had requested for the removal of the disqualification for the reasons stated in the said appeal; and

3. WHEREAS, the competent authority decided to give a hearing (through video conference) to the aforesaid applicant for deciding the appeal under section 11 of the Representation of People Act, 1951 and having heard him, has decided, vide its order dated 26th March, 2024 that the disqualification imposed on said Shri Laxman Kumar Bhoi, vide Order No. 76/ECI/ORD/TERR/ES-II/OR-LA/17/2019 dated 28.12.2021, shall be revoked with immediate effect.

4. NOW, THEREFORE, the disqualification of Shri Laxman Kumar Bhoi as per the Commission's Order No. 76/ECI/ORD/TERR/ES-II/OR-LA/17/2019 dated 28.12.2021 shall be treated operative for the period w.e.f. 28.12.2021 to 21.03.2024 and will, thereafter, stands revoked.
