आ.अ. 90.—यतः भारत निर्वाचन आयोग द्वारा दिनांक 25 जनवरी की अधिसूचना सं0 464/ पीबी-वि0स0/2022 के अनुसरण में पंजाब राज्य के 4-गुरदासपुर विधान सभा निर्वाचन क्षेत्र के लिए साधारण निर्वाचन, 2022 आयोजित किया गया था; और

यतः, पंजाब राज्य के 4-गुरदासपुर विधान सभा निर्वाचन क्षेत्र के साधारण निर्वाचन, 2022 का परिणाम रिटर्निंग ऑफिसर द्वारा दिनांक 10 मार्च , 2022 को घोशित किया गया था और इस प्रकार निर्वाचन व्यय के लेखे दाखिल करने की अन्तिम तारीख 09 अपै्रल 2023 थी; और यतः, निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (1) के अंतर्गत, मुख्य निर्वाचन अधिकारी, पंजाब से दिनांक 26 अप्रैल 2023 के पत्र सं0 इलेक्.-2022/आर-8510 के तहत प्राप्त जिला निर्वाचन अधिकारी की रिपोर्ट के अनुसार श्री गुरप्रीत सिंह , जो पंजाब राज्य के

यतः, जिला निर्वाचन अधिकारी, गुरदासपुर की उक्त रिपोर्ट के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (5) के अंतर्गत श्री गुरप्रीत सिंह , को अपने निर्वाचन व्यय के लेखे प्रस्तुत नहीं करने के लिए कारण बताओ नोटिस सं. 76/पीबी-वि.स./4/2022/सी.ई.एम.एस.-1 दिनांक 20 जून, 2022 जारी किया गया था, और

यतः, उपर्युक्त कारण बताओ नोटिस के जरिए और निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (6) के अनुसार श्री गुरप्रीत सिंह, को लेखा प्रस्तुत न किए जाने संबंधी कारणों को स्पश्ट करते हुए, आयोग को अपना अभ्यावेदन लिखित रूप में प्रस्तुत करने और नोटिस के प्राप्त होने की तारीख से 20 दिनो के भीतर जिला निर्वाचन अधिकारी, गुरदासपुर जिला को अपने निर्वाचन व्यय का लेखा प्रस्तुत करने का निदेष दिया गया था, और

यतः जिला निर्वाचन अधिकारी, गुरदासपुर अपने पत्र सं0 इलेक्.-2023/333 दिनांक 12.05.2023 जिला ने सूचित किया है कि कारण बताओ नोटिस श्री गुरप्रीत सिंह को दिनांक 06.07.2022 को तामील कराया गया था, और

यतः जिला निर्वाचन अधिकारी, गुरदासपुर, ने पत्र सं0 इलेक्.-2022/ 643 दिनांक 05.03.2024 के द्वारा बताया कि श्री गुरप्रीत सिंह , ने निर्वाचन व्यय का लेखा प्रस्तुत नहीं किया है। इसके अतिरिक्त, उक्त नोटिस की पावती के उपरांत, श्री गुरप्रीत सिंह , ने लेखा दाखिल नही करने में अपनी असफलता के लिए भारत निर्वाचन आयोग को न तो कोई कारण बताया है और न ही कोई स्पश्टीकरण दिया है, और

यतः लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में यह उपबंधित किया गया है किः

"यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति

(क) निर्वाचन व्ययों का लेखा उस समय के भीतर और रीति में जैसी इस अधिनियम के द्वारा या अधीन अपेक्षित है, दाखिल करने में असफल रहा है, और

(ख) उस असफलता के लिए कोई अच्छा कारण अथवा न्यायोचित्य नहीं रखता है

तो निर्वाचन आयोग, शासकीय राजपत्र में प्रकाषित आदेष द्वारा उसको निरर्हित घोशित करेगा और ऐसा व्यक्ति उस आदेष की तारीख से तीन वर्श की कालावधि के लिए निरर्हित होगा

यतः, तथ्यों और उपलब्ध रिकार्डों के आधार पर आयोग का यह समाधान हो गया है कि श्री गुरप्रीत सिंह , अपने निर्वाचन व्यय के लेखे दाखिल करने में असफल रहे हैं और उनके पास ऐसा करने में असफल रहने के लिए कोई भी उचित कारण अथवा औचित्य नहीं है, और

अतः अब लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अनुसरण में भारत निर्वाचन आयोग एतद्वारा धोशणा करता है कि पंजाब राज्य के साधारण निर्वाचन, 2022 4-गुरदासपुर विधान सभा निर्वाचन क्षेत्र से निर्वाचन लड़ने वाले अभ्यर्थी श्री गुरप्रीत सिंह, गांव बसरपुरा, तहसील बटाला , जिला गुरदासपुर, इस आदेष की तारीख से तीन वर्श की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य क्षेत्र की विधानसभा अथवा विधान परिशद का सदस्य चुने जाने अथवा होने के लिए निरर्हित होंगे।

O.N. 90.— WHEREAS, the General Election to Legislative Assembly of Punjab, 2022 for 04-Gurdaspur Assembly Constituency was held in pursuance of the Election Commission of India Notification No. 464/PB-LA/2022, dated 25th January; and

WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate at an election shall, within 30 days from the date of election of the returned candidate, lodge with the District Election Officer205 [भाग II—खण्ड 3(iii)] भारत का राजपत्र : अगस्त 24, 2024/भाद्र 2, 1946 an account of his election expenses which shall be true copy of the account kept by him or his election agent under Section 77 of the said act; and

WHEREAS, the result of the election for 04-Gurdaspur Assembly Constituency of Punjab, 2022 was declared by the Returning Officer on 10th March, 2022 and hence the last date for lodging the account of Election Expenses was 9th April, 2023; and

WHEREAS, as per the report of the DEO, Gurdaspur under sub-rule (1) of Rule 89 of the Conduct of Elections Rules, 1961, received through the CEO, Punjab vide his letter No. Elec-2022 /R-8510 dated 26 April 2022 stating that Sh. Gurpreet Singh, a contesting candidate from 04-Gurdaspur Assembly Constituency in General Election to Legislative Assembly of Punjab, 2022 has failed to lodge account of election expenses, as required under law; and

WHEREAS, on the basis of the said report of the District Election Officer, Gurdaspur a Show-Cause notice No. 76/PB-LA/4/2022/CEMS-I, dated 20th June, 2022 was issued under sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India Sh. Gurpreet Singh, for not lodging of account of Election Expenses; and

WHEREAS, through the above said Show Cause Notice and under sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, Sh. Gurpreet Singh, was directed to submit representation in writing to the Commission explaining the reasons for not lodging the account and also to lodge account of election expenses with the District Election Officer, Gurdaspur District within 20 days from the date of receipt of the notice; and

WHEREAS, the District Election Officer, Gurdaspur in his report No. Elec.2023/333 dated 12.05.2023 reported that the said notice was served to Sh. Gurpreet Singh, on 06.07.2022; and

WHEREAS, the forwarded the District Election Officer, Gurdaspur has sent Supplementary letter No. Elec.2024/643 dated 05.03.2022, reported stated that Sh. Gurpreet Singh, has not lodged account further, after receipt of the said notice, Sh. Gurpreet Singh, has neither furnished any reason nor explanation to the Election Commission of India, for failure to lodge the account as prescribed under law; and

WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that:-

"If the Election Commission is satisfied that a person-

(a) has failed to lodge an account of election expenses, within the time and in the manner required by

or under this Act, and

(b) has no good reason or justification for the failure,

the Election Commission shall, by order published in the Official Gazette, declare him to be disqualified and any such

person shall be disqualified for a period of three years from the date of the order.";

WHEREAS, on the basis of facts and available records, the Commission is satisfied that Sh. Gurpreet Singh, has failed to lodge account of election expenses and has no good reason or justification for the failure to do so; and

NOW, THEREFORE, in pursuance of Section 10A of the Representation of the People Act,1951, the Election Commission of India hereby declares Sh. Gurpreet Singh,Village :-Basarpura Tehsil Batala District Gurdaspur and a contesting candidate in 04-Gurdaspur Assembly Constituency of the State of Punjab in the General Election to the Legislative Assembly 2022 to be disqualified for being chosen as and for being a member of either House of the Parliament or the Legislative Assembly or the Legislative Council of a State or Union Territory for a period of three years from the date of this order.

आ.अ. 91.—यतः भारत निर्वाचन आयोग द्वारा दिनांक 25 जनवरी की अधिसूचना सं0 464/ पीबी-वि0स0/2022 के अनुसरण में पंजाब राज्य के 6-कांदीया विधान सभा निर्वाचन क्षेत्र के लिए साधारण निर्वाचन, 2022 आयोजित किया गया था; और206 THE GAZETTE OF INDIA : AUGUST 24, 2024/BHADRA 2, 1946 [PART II—SEC. 3(iii)] यतः लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 78 के अनुसार, किसी निर्वाचन में, निर्वाचन लड़ रहा प्रत्येक अभ्यर्थी, निर्वाचित अभ्यर्थी के निर्वाचन की तारीख से 30 दिनों के भीतर अपने निर्वाचन व्यय का लेखा जिला निर्वाचन अधिकारी के पास दाखिल करेगा जो उक्त अधिनियम की धारा 77 के अंतर्गत उसके द्वारा या उसके निर्वाचन अभिकर्ता (एजेंट)द्वारा रखे गए लेखे की एक सत्य प्रति होगी; और

यतः, पंजाब राज्य के 6-कांदीया विधान सभा निर्वाचन क्षेत्र के साधारण निर्वाचन, 2022 का परिणाम रिटर्निंग ऑफिसर द्वारा दिनांक 10 मार्च , 2022 को घोशित किया गया था और इस प्रकार निर्वाचन व्यय के लेखे दाखिल करने की अन्तिम तारीख 09 अपै्रल 2023 थी; और

WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate at an election shall, within 30 days from the date of election of the returned candidate, lodge with the District Election Officer an account of his election expenses which shall be true copy of the account kept by him or his election agent under Section 77 of the said act; and

WHEREAS, as per the report of the DEO, Gurdaspur under sub-rule (1) of Rule 89 of the Conduct of Elections Rules, 1961, received through the CEO, Punjab vide his letter No. Elec-2022 /R-8510 dated 26 April 2022 stating that Sh. Karandeep Singh, a contesting candidate from 04-Gurdaspur Assembly Constituency in General Election to Legislative Assembly of Punjab, 2022 has failed to lodge account of election expenses, as required under law; and

WHEREAS, on the basis of the said report of the District Election Officer, Gurdaspur a Show-Cause notice No. 76/PB-LA/4/2022/CEMS-I, dated 20th June, 2022 was issued under sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India Sh. Karandeep Singh for not lodging of account of Election Expenses; and

WHEREAS, through the above said Show Cause Notice and under sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, Sh. Karandeep Singh was directed to submit representation in writing to the Commission explaining the reasons for not lodging the account and also to lodge account of election expenses with the District Election Officer, Gurdaspur District within 20 days from the date of receipt of the notice; and

WHEREAS, the District Election Officer, Gurdaspur in his report No. Elec.2023/333 dated 12.05.2023 reported that the said notice was served on 05.07.2022; and

WHEREAS, the forwarded the District Election Officer, Gurdaspur has sent supplementary letter No. Elec.2024/643 dated 05.03.2024, reported stated that Sh. Karandeep Singh has not lodged account further, after receipt of the said notice, Sh. Karandeep Singh has neither furnished any reason nor explanation to the Election Commission of India, for failure to lodge the account as prescribed under law; and

WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that:—

"If the Election Commission is satisfied that a person—

(a) has failed to lodge an account of election expenses, within the time and in the manner required by

or under this Act, and

(b) has no good reason or justification for the failure,

the Election Commission shall, by order published in the Official Gazette, declare him to be disqualified and

any such person shall be disqualified for a period of three years from the date of the order.";

WHEREAS, on the basis of facts and available records, the Commission is satisfied that Sh. Karandeep Singh has failed to lodge account of election expenses and has no good reason or justification for the failure to do so; and

यतः, उपर्युक्त कारण बताओ नोटिस के जरिए और निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (6) के अनुसार श्री पे्रम सिंह, को लेखा प्रस्तुत न किए जाने संबंधी कारणों को स्पश्ट करते हुए, आयोग को अपना अभ्यावेदन लिखित रूप में प्रस्तुत करने और नोटिस के प्राप्त होने की तारीख से 20 दिनो के भीतर जिला निर्वाचन अधिकारी, गुरदासपुर जिला को अपने निर्वाचन व्यय का लेखा प्रस्तुत करने का निदेष दिया गया था, और

यतः जिला निर्वाचन अधिकारी, गुरदासपुर, ने पत्र सं0 इलेक्.-2024/643 दिनांक 05.03.2024 के द्वारा बताया कि श्री पे्रम सिंह , ने निर्वाचन व्यय का लेखा प्रस्तुत नहीं किया है। इसके अतिरिक्त, उक्त नोटिस की पावती के उपरांत, श्री पे्रम सिंह ने लेखा दाखिल नही करने में अपनी असफलता के लिए भारत निर्वाचन आयोग को न तो कोई कारण बताया है और न ही कोई स्पश्टीकरण दिया है, और211 [भाग II—खण्ड 3(iii)] भारत का राजपत्र : अगस्त 24, 2024/भाद्र 2, 1946 यतः लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में यह उपबंधित किया गया है किः

WHEREAS, as per the report of the DEO, Gurdaspur under sub-rule (1) of Rule 89 of the Conduct of Elections Rules, 1961, received through the CEO, Punjab vide his letter No. Elec-2022 /R-8510 dated 26 April 2022 stating that Sh. Sunny, a contesting candidate from 04-Gurdaspur Assembly Constituency in General Election to Legislative Assembly of Punjab, 2022 has failed to lodge account of election expenses, as required under law; and

WHEREAS, on the basis of te said report of the District Election Officer, Gurdaspur a Show-Cause notice No. 76/PB-LA/4/2022/CEMS-I, dated 20th June, 2022 was issued under sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India Sh. Sunny for not lodging of account of Election Expenses; and

WHEREAS, through the above said Show Cause Notice and under sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, Sh. Sunny was directed to submit representation in writing to the Commission explaining the reasons for not lodging the account and also to lodge account of election expenses with the District Election Officer, Gurdaspur District within 20 days from the date of receipt of the notice; and

WHEREAS, the District Election Officer, Gurdaspur in his report No. Elec.2023/333 dated 12.05.2023 reported that the said notice was served to Sh. Sunny on 05.07.2022; and

WHEREAS, the District Election Officer, Gurdaspur has sent Supplementary letter No. Elec.2024/643 dated 05.03.2024, reported stated that Sh. Sunny has not lodged the account further, after receipt of the said notice, Sh. Sunny has neither furnished any reason nor explanation to the Election Commission of India, for failure to lodge the account as prescribed under law; and

WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that:-

"If the Election Commission is satisfied that a person-

(a) has failed to lodge an account of election expenses, within the time and in the manner required by

or under this Act, and

(b) has no good reason or justification for the failure,

the Election Commission shall, by order published in the Official Gazette, declare him to be disqualified and

any such person shall be disqualified for a period of three years from the date of the order.";

WHEREAS, on the basis of facts and available records, the Commission is satisfied that Sh. Sunny has failed to lodge account of election expenses and has no good reason or justification for the failure to do so; and

NOW, THEREFORE, in pursuance of Section 10A of the Representation of the People Act,1951, the Election Commission of India hereby declares Sh. Sunny, Village:- Bhulle Chack, Post Office Tibbri Tehsil & District Gurdaspur and a contesting candidate in 04-Gurdaspur Assembly Constituency of the State of Punjab in the General Election to the Legislative Assembly 2022 to be disqualified for being chosen as and for being a member of either House of the Parliament or the Legislative Assembly or the Legislative Council of a State or Union Territory for a period of three years from the date of this order.

DATE : FEBRUARY 28, 2024 This election petition has been listed before this Court on the basis of a praecipe moved by the petitioner himself in person stating that he desires to withdraw the petition. The record shows that the petitioner is represented by an advocate.

2. The petitioner has appeared before this Court in person. He states that his advocate has not been appearing in this petition and that despite instructions, the advocate is not present in Court. In this situation, the petitioner appearing in person prays for withdrawal of the election petition. This Court has perused the original Aadhar Card of the petitioner to ascertain his identity. The Aadhar Card indeed shows that the petitioner Bapu Kelu Barde is present in Court today, making the aforesaid prayer for withdrawal of the petition. The original Aadhar Card is returned to the petitioner.

3. Chapter IV of the Representation of the People Act, 1950, consisting of Sections 108 to 116, pertains to 'withdrawal and abatement

of election petitions'. Section 109 specifically pertains to withdrawal of election petitions and sub-section (1) thereof provides that, an election petition can be withdrawn only by leave of the High Court. Sub-section (2) requires notice of fixing a date for hearing such application for withdrawal to be given to all other parties to the petition and to be published in the Official Gazette. Section 110, inter alia, requires the High Court to ascertain that such an application for withdrawal of the election petition has not been induced by any bargain or consideration, which ought not to be allowed. Section 111 of the Act stipulates that, report of such withdrawal should be made to the Election Commission, which in turn, shall publish the report in the Official Gazette.

4. In this election petition, the petitioner has prayed for declaring the election of respondent No.3 as void. The Election Commission of India and Returning Officer are respondent Nos.1 and 2. There is no prayer for declaring the petitioner as the elected candidate and therefore, the other candidates in the fray had rightly not been made parties in the election petition. Respondent Nos.1 and 2 are represented by Advocate Ms. Drishti Shah and Assistant Government Pleader Mr. Himanshu Takke respectively. Respondent No.3 is represented by Advocate Mr. Kamlesh Ghumre. Hence, all the three parties are before this Court and they have notice of the prayer made on behalf of the petitioner in person for withdrawing the election petition.

In the light of the fact that all the three respondents are here before this Court today and they have been given notice with regard to the intention of the petitioner to withdraw the election petition, the requirement of publishing notice in Official Gazette is dispensed with. This is particularly in the light of the statement made on behalf of the respondent No.1 i.e. the Election Commission of India that the report of such withdrawal will indeed be published in the Official Gazette in compliance of Section 111 of the aforesaid Act.

6. This Court has interacted with the petitioner in person and satisfaction of this Court is recorded to the effect that the prayer for withdrawal has not been induced by any bargain or consideration.

7. The Election Commission of India represented by counsel before this Court has taken note of such withdrawal and has undertaken that the Election Commission of India shall publish report of withdrawal of the present petition in the Official Gazette. It is submitted that such publication of the report shall be made within two weeks from today.

The election petition stands disposed of as withdrawn in the aboveterms.
