सा.का.नि. 119.—संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए तथा विदेश मंत्रालय, विधि एवं संधि प्रभाग, समूह 'क' पद भर्ती नियम, 2013 का अधिक्रमण, ऐसे अधिक्रमण से पहले निष्पादित अथवा निष्पादन से छू ट प्राप्त बातों के सिवाय, करते हुए, राष्ट्रपति, विदेश मंत्रालय के विधि एवं संधि प्रभाग में अपर सचिव (विधि एवं संधि), संयुक्त सचिव (विधि एवं संधि), निदेशक (विधि एवं संधि), विधि अधिकारी (ग्रेड-I) तथा विधि अधिकारी (ग्रेड-II) के पदों पर भर्ती की पद्धति को विनियमित करने के लिए एतद्द्वारा निम्नलिखित नियम बनाती हैं, अर्थात:-

(831)832 THE GAZETTE OF INDIA :AUGUST 24, 2024/BHADRA, 2, 1946 [PART II—SEC. 3(i)] 1. संक्षिप्त नाम और प्रारंभ.-(1) इन नियमों को विदेश मंत्रालय, विधि एवं संधि प्रभाग (समूह 'क' पद) भर्ती नियम, 2024 कहा जाएगा।
(2) ये शासकीय राजपत्र में इनके प्रकाशन की तिथि से लागू होंगे।
2. पदों की संख्या, वर्गीकरण और वेतन मैट्रिक्स में स्तर- उक्त पदों की संख्या, उनका वर्गीकरण और उनके साथ सम्बद्ध वेतन मैट्रिक्स के स्तर वे होंगे जो उक्त अनुसूची के कॉलम (2) से (4) में विर्निर्दष्ट किए गए हैं।
3. भर्ती की पद्धति, आयु-सीमा, अन्य योग्यताएं, आदि- उक्त पद पर भर्ती की पद्धति, आयु-सीमा, योग्यताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के कॉलम (5) से (13) में विर्निर्दष्ट की गई हैं।
4. अयोग्यता-कोई भी व्यक्ति,-
(क) जिसने ऐसे व्यक्ति से विवाह अथवा विवाह का अनुबंध किया है जिसका पति या पत्नी जीवित है; अथवा (ख) जिसने अपने पति या पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह अथवा विवाह का अनुबंध किया है, उक्त पदों पर नियुक्ति हेतु पात्र नहीं होंगे:
बशते के न्द्रीय सरकार का यह समाधान हो जाए कि ऐसा विवाह ऐसे व्यक्ति और विवाह के दूसरे पक्षकार पर लागू पर्सनल लॉ के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार मौजूद हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छू ट दे सके गी।
5. शिथिल करने की शक्ति-जहाँ के न्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक अथवा समीचीन है, वहाँ वह आदेश द्वारा और उससे संबंधित कारणों को लिखित में दर्ज करके तथा संघ लोक सेवा आयोग के परामर्श से, इन नियमों के किसी उपबंध को किसी वर्ग अथवा श्रेणी के व्यक्तियों के संबंध में शिथिल कर सके गी।
6. अपवाद-इन नियमों में निहित कोई बात, इस संबंध में समय-समय पर के न्द्रीय सरकार द्वारा जारी किए गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़े वगों, भूतपूर्व सैनिकों और अन्य विशेष श्रेणी के व्यक्तियों को दिए जाने वाले आरक्षण, आयु-सीमा में छू ट और अन्य रियायतों पर प्रभाव नहीं डालेगी।

| पदोन्नति : वेतन मैट्रिक्स के लेवल-14(रु. 144200-218200) में संयुक्त सचिव (विधि एवं संधि), और इस ग्रेड में तीन वर्ष की नियमित सेवा की हो टिप्पण-यदि अर्हक या पात्रता सेवा पूरी करने वाले कनिष्ठ कर्मचारियों की पदोन्नति पर विचार किया जा रहा है तो उनसे वरिष्ठ कर्मचारियों पर भी विचार किया जाएगा बशते कि उनकी अर्हक या पात्रता सेवा अपेक्षित अर्हक या पात्रता सेवावधि के आधे से अधिक या दो वर्ष से कम न हो और उन्होंने अपने से कनिष्ठ कर्मचारियों, जिन्होंने ऐसी अर्हक या पात्रता सेवा पहले ही पूरी कर ली है, के साथ अगली उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवधि सफलतापूर्वक पूरी कर ली हो । प्रतिनियुक्ति: क े न्द्रीय सरकार या राज्य सरकार या संघ शासित क्षेत्र प्रशासन के अधिकारी— (क) मूल संवर्ग या विभाग में नियमित आधार पर धारित सदृश पद पर हों; और (ख) निम्नलिखित शैक्षिक योग्यताएं और अनुभव रखते हों,— अनिवार्य योग्यताएं:— (i) किसी मान्यता प्राप्त विश्वविद्यालय या संस्थान से अंतरराष्ट्रीय विधि अथवा अंतरराष्ट्रीय संबंध या अंतरराष्ट्रीय संगठन के क्षेत्र में विशेषज्ञता के साथ विधि में मास्टर डिग्री या अंतरराष्ट्रीय विधि में मास्टर ऑफ फिलॉसफी अथवा डॉक्टर ऑफ फिलॉसफी। अनुभव : न्यूनतम शैक्षणिक योग्यता प्राप्त करने के बाद निम्नलिखित क्षेत्र में बीस वर्ष का अनुभव - (i) वकालतरत अधिवक्ता; या (ii) किसी मान्यता प्राप्त विश्वविद्यालय या संस्थान से विधि के क्षेत्र में शोध अध्यापन, संचालन या मार्गदर्शन, जिसमें कम से कम दस वर्ष का अनुभव, अंतरराष्ट्रीय विधि या अंतरराष्ट्रीय संबंधों के क्षेत्र में होना चाहिए। वांछनीय योग्यता: अंतरराष्ट्रीय विधि, विशेषाधिकार एवं प्रतिरक्षा, अंतरराष्ट्रीय व्यापार कानून, अंतरराष्ट्रीय नदियों से संबंधित कानून और समुद्री कानून मामलों पर कार्य करने में पांच वर्ष का अनुभव। टिप्पणी 1.-प्रदायक कोटि के ऐसे विभागीय अधिकारी, जो प्रोन्नति की सीधी पंक्ति में हैं, प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे और इसी प्रकार प्रतिनियुक्त व्यक्ति प्रोन्नति द्वारा नियुक्ति के लिए विचार | समूह 'क' विभागीय पदोन्नति समिति (पदोन्नति पर विचार करने के लिए) में निम्नलिखित सदस्य शामिल हैं:- 1. संघ लोक सेवा आयोग के अध्यक्ष या सदस्य -अध्यक्ष; 2. विदेश सचिव -सदस्य; और 3. विधि एवं संधि प्रभाग के प्रभारी सचिव – सदस्य। | संघ लोक सेवा आयोग से परामर्श आवश्यक नहीं है। | NaN |

| पदोन्नति: वेतन मैट्रिक्स (रु. 123100-215900) में स्तर-13 में निदेशक (विधिक एवं संधि) जिन्होंने ग्रेड में तीन वर्ष की नियमित सेवा दी हो तथा विदेश मंत्रालय द्वारा र्निर्दष्ट संयुक्त सचिव (कानूनी एवं संधि) के पद के लिए कर्तव्यों एवं निर्वहन से संबंधित अंतरराष्ट्रीय कानून की किसी भी शाखा में एक सप्ताह का प्रशिक्षण सफलतापूर्वक पूरा किया हो। टिप्पण: जहाँ ऐसे कनिष्ठ पदाधिकारी, जिन्होंने अपनी अर्हक या पात्रता सेवा पूरी कर ली है, के संबंध में प्रोन्नति के लिए विचार किया जा रहा है वहां उनके वरिष्ठ पदाधिकारी के बारे में भी विचार किया जाएगा बशते कि उनकी अपेक्षित अर्हक या पात्रता सेवा का आधे से अधिक या दो वर्ष से, इनमें से जो भी कम हो, कम न हो और उन्होंने अपने ऐसे कनिष्ठ पदाधिकारियों के साथ, जिन्होंने ऐसी अर्हक या पात्रता सेवा पहले ही पूरी कर ली है, अगले उच्चतर ग्रेड में प्रोन्नति के लिए अपनी परिवीक्षा अवधि सफलतापूर्वक पूरी कर ली हो। प्रतिनियुक्ति : क े न्द्रीय सरकार या राज्य सरकार या संघ राज्य क्षेत्र प्रशासन के अधिकारी,— (क) मूल संवर्ग या विभाग में नियमित आधार पर सदृश पद धारण करते हों; और (ख) निम्नलिखित शैक्षणिक योग्यताएं और अनुभव रखते हों:- | समहू 'क' विभागीय पदोन्नति समिति (पदोन्नति पर विचार करने के लिए) जिसमें निम्नलिखित शामिल हैं:- 1. संघ लोक सेवा आयोग का अध्यक्ष या सदस्य - अध्यक्ष; 2. विदेश सचिव - सदस्य; 3. विधि एवं संधि प्रभाग के प्रभारी सचिव – सदस्य | संघ लोक सेवा आयोग से परामर्श आवश्यक नहीं है। | NaN |

G.S.R. 119.—In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Ministry of External Affairs, Legal and Treaties Division, Group 'A' Posts Recruitment Rules, 2013, except as respects things done or omitted to be done before such supersession, the President hereby makes the842 THE GAZETTE OF INDIA :AUGUST 24, 2024/BHADRA, 2, 1946 [PART II—SEC. 3(i)] following rules regulating the method of recruitment to the posts of Additional Secretary (Legal and Treaties), Joint Secretary (Legal and Treaties), Director (Legal and Treaties), Legal Officer (Grade-I) and Legal Officer (Grade-II) in the Legal and Treaties Division in the Ministry of External Affairs, namely :—
1. Short title and commencement.—(1) These rules may be called the Ministry of External Affairs, Legal and Treaties Division (Group 'A' Posts) Recruitment Rules, 2024.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. Number of posts, classification and level in pay matrix.—The number of the said posts, their classification and level in the pay matrix attached thereto shall be as specified in columns (2) to (4) of the said Schedule.
3. Method of recruitment, age-limit, other qualifications, etc.–The method of recruitment, age-limit, qualifications and other matters relating to the said post shall be as specified in columns (5) to (13) of the said Schedule.
4. Disqualification.—No person,—
(a) who has entered into or contracted a marriage with a person having a spouse living or
(b) who, having a spouse living, has entered into or contracted a marriage with any person,
shall be eligible for appointment to the said posts:
Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.
5. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order and for reasons to be recorded in writing and in consultation with the Union Public Service Commission, relax any of the provisions of these rules with respect to any class or category of persons.
6. Saving.—Nothing in these rules shall affect reservation, relaxation of age-limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, the other Backward Classes, the Ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.
