सा.का.नि. 120.—राष्ट्रपति संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत शक्तियों का प्रयोग करते हुए राष्ट्रीय अनुसूचित जनजाति आयोग, जनजातीय कार्य मंत्रालय में अन्वेषक के पद की भर्ती की प्रयििा को विनियमित करते हुए निम्नलिखित नियमों को एतद् द्वारा बनाते हैं, अर्थात्–

(853)854 THE GAZETTE OF INDIA : AUGUST 31, 2024/BHADRA, 9, 1946 [PART II—SEC. 3(i)] 1. संक्षिप्त शीर्षक और प्रारम्भ.–(1) इन नियमों को 'राष्ट्रीय अनुसूचित जनजाति आयोग, अन्वेषक के पद की (समूह 'ख' पद) भर्ती नियम, 2024 कहा जा सकता है।
(2) वे अधिकारिक राजपत्र में उनके प्रकाशन की तारीख से प्रवृत्त (लागू) होंगे।
2. प्रारंभिक संविधान–(1) इन नियमों के प्रारंभ होने से ठीक पहले, नियमित आधार पर अन्वेषक के पदों को धारण करने वाले पदधारियों को इन नियमों के प्रावधानों के अनुसार नियुक्त किया गया माना जाएगा और इन नियमों के प्रारंभ होने से पहले उक्त पद पर उनके द्वारा प्रदान की गई सेवाओं को परिवीक्षा की अवधि के उद्देश्य को तय करने और अगले उच्च ग्रेड में पदोन्नति के लिए पात्रता तय करने के लिए ध्यान में रखा जाएगा।
3. पदों की संख्या, वर्गीकरण और वेतन मैट्रिक्स में स्तर–उक्त पद की संख्या, इसका वर्गीकरण और उनसे जुड़े वेतनमान के रूप में वेतन मैट्रिक्स में स्तर, इन नियमों के साथ सलंग्न अनुसूची के कॉलम (2) से (4) में र्निर्दष्ट होंगे ।
4. भर्ती की विधि, आयु-सीमा और योग्यताएं, आदि-उक्त पद पर भर्ती की विधि, आयु सीमा, योग्यताएं और उससे संबंधित अन्य मामले संलग्न उक्त अनुसूची के कॉलम (5) से (13) में यथा र्निर्दष्ट होंगे।
5. अयोग्यता – व्यक्ति पात्र नहीं होगा, -
(क) जिसने ऐसे व्यक्ति के साथ विवाह किया है या विवाह का अनुबंध किया है जिसका जीवनसाथी जीवित है; या
(ख) जिसने अपने पति/पत्नी के जीवित होते हुए भी किसी व्यक्ति के साथ विवाह किया है या विवाह का अनुबंध किया है;
उक्त पदों पर नियुक्ति के लिए पात्र होगा:
बशते कि के न्द्र सरकार, यदि संतुष्ट हो कि ऐसा विवाह ऐसे व्यक्ति और विवाह के दुसरे पक्ष पर लागू व्यक्तिगत कानून (पर्सनल लॉ) के तहत स्वीकार्य है और ऐसा करने के लिए अन्य आधार हैं, तो किसी भी व्यक्ति को इस नियम के संचालन से छू ट दे सकती है।
6. शिथिल करने की शक्ति–जहॉं कें द्र सरकार की राय है कि ऐसा करना आवश्यक या समीचीन है, वह लिखित में दर्ज किये जाने वाले कारणों से और संघ लोक सेवा आयोग के परामर्श से आदेश द्वारा किसी भी वर्ग या श्रेणी के व्यक्तियों के संबंध में इन नियमों के किसी प्रावधान को शिथिल कर सकती है।
7. व्यावृत्ति–इन नियमों में से कोई भी बात कें द्र सरकार द्वारा इस संबंध में समय-समय पर जारी आदेशों के अनुसार अनुसूचित जाति, अनुसूचित जनजाति, अन्य पिछड़ा वर्ग और अन्य विशेष श्रेणियों के व्यक्तियों के लिए प्रदान किए जाने वाले आरक्षण, आयु-सीमा में छू ट और अन्य रियायतों को प्रभावित नहीं करेगी।

(NATIONAL COMMISSION FOR SCHEDULED TRIBES)
NOTIFICATION
New Delhi, the 20th August, 2024
G.S.R. 120.—In exercise of the powers conferred by the proviso to Article 309 of the Constitution, the President hereby makes the following rules to regulate the method of recruitment to the posts of Investigator in the National Commission for Scheduled Tribes, Ministry of Tribal Affairs, namely: -
1. Short title and commencement.—(1) These rules may be called the National Commission for Scheduled Tribes, Investigator (Group 'B' Post ) Recruitment Rules, 2024.
(2)They shall come into force on the date of their publication in the Official Gazette.
2. Initial Constitution.—(1) The incumbents holding the posts of Investigator on regular basis, immediately before the commencement of these rules, shall be deemed to have been appointed in accordance with the provisions of these rules and the services rendered by them in the said post before the commencement of these rules shall be taken into account for deciding the purpose of period of probation and for deciding the eligibility for promotion to the next higher grade.
3. Number of posts, classification and level in pay matrix.—The number of the said post, its classification and the level in the pay matrix as pay scale attached thereto shall be as specified in columns (2) to (4) of the Schedule.
4. Method of recruitment, age limit and qualifications, etc.—The method of recruitment to the said post, age limit, qualifications and other matters relating thereto shall be as specified in columns (5) to (13) of the said Schedule annexed thereto.
5. Disqualification.—No person —
(a) who has entered into or contracted a marriage with a person having a spouse living; or
(b) who, having a spouse living, has entered into or contracted a marriage with any person,
shall be eligible for appointment to any of the said posts:
Provided that the Central Government may, if satisfied, that such marriage is permissible under the personal law applicable to such person and to the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.
6. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, for reasons to be recorded in writing and in consultation with the Union Public Service Commission, relax any of the provisions of these rules with respect to any class or category of persons.
7. Saving.—Nothing in these rules shall affect reservation, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, the Other Backward Classes and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.
