आ.अ. 102.—यतः, उत्तर प्रदेश राज्य की 169-बक्शी का तालाब विधान सभा क्षेत्र के साधारण निर्वाचन 2022 की घोषणा अधिसूचना नं. 68/61-2022 दिनांक 27.01.2022 के जरिए की गई थी।
यतः लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 78 के अनुसार, निर्वाचन लड़ने वाले प्रत्येक अभ्यर्थी को, निर्वाचित अभ्यर्थी के निर्वाचन की तारीख से 30 दिनों के भीतर निर्वाचन व्यय के अपने लेखे की सही प्रति जिला निर्वाचन अधिकारी को दाखिल करनी होती है; और
यतः 169-बक्शी का तालाब विधान सभा निर्वाचन क्षेत्र के रिटनिग अधिकारी द्वारा उक्त निर्वाचन का परिणाम 10 मार्च, 2022 को घोषित किया गया था। इस प्रकार, निर्वाचन व्यय का लेखा दाखिल करने की अन्तिम तारीख 09 अप्रैल, 2022 थी; और

(729)730 THE GAZETTE OF INDIA : SEPTEMBER 28, 2024/ASVINA 6, 1946 [PART II—SEC. 3(iii)] यतः, जिला निर्वाचन अधिकारी, लखनऊ, उत्तर प्रदेश के द्वारा प्रस्तुत और संयुक्त मुख्य निर्वाचन अधिकारी, उत्तर प्रदेश द्वारा पत्र सं. 287/निर्वाचन व्यय सेल/वि0स0सा0नि0-2022/पत्रा0-01/2021 के जरिए अग्रेषित दिनांक 27/04/2022 की रिपोर्ट के अनुसार श्री किशोर कु मार जो उत्तर प्रदेश विधान सभा का साधारण निर्वाचन 2022 के निर्वाचन क्षेत्र 169-बक्शी का तालाब से लड़ने वाले अभ्यर्थी हैं, विधि द्वारा यथापेक्षित रीति से अपने निर्वाचन व्यय का कोई भी लेखा दाखिल करने में विफल रहे हैं; और,
यतः, जिला निर्वाचन अधिकारी, लखनऊ, उत्तर प्रदेश, और मुख्य निर्वाचन अधिकारी, उत्तर प्रदेश की उक्त रिपोर्टों के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम 1961 के नियम 89 के उप नियम (5) के अंतर्गत निर्वाचन व्यय प्रस्तुत नहीं करने के लिए श्री किशोर कु मार को कारण बताओ नोटिस सं. 76/उत्तरप्रदेश- वि.स./2022/सी.ई.एम.एस.-III, दिनांक 29.11.2022 जारी किया गया था; और
यतः, निर्वाचनों का संचालन नियम 1961 के नियम 89 के उप-नियम (6) के अनुसार, दिनांक 29.11.2022 के उपयु र्क्त कारण बताओ नोटिस के जरिए श्री किशोर कु मार को निदेश दिया गया था कि वे इस नोटिस के प्राप्त होने के 20 दिनों के अंदर लेखा न प्रस्तुत कर पाने के कारणों को स्पष्ट करते हुए लिखित रूप में अपना अभ्यावेदन प्रस्तुत करें और साथ ही, निर्वाचन व्यय का अपना लेखा दाखिल करें; और
यतः, जिला निर्वाचन अधिकारी, लखनऊ द्वारा अपने दिनांक 27.02.2023 के पत्र संख्या 223/निर्वाचन-8- 219/2021-23 के जरिए आयोग को सूचना दी गई की उक्त नोटिस अभ्यर्थी के घर पर दिनांक 04.02.2023 को चस्पा किया गया था; और,
यतः, जिला निर्वाचन अधिकारी, लखनऊ द्वारा दिनांक 27.02.2023 के पत्र संख्या 223/निर्वाचन-8- 219/2021-23 के जरिए प्रस्तुत की गई अनुपूरक संवीक्षा रिपोर्ट में यह बताया गया है कि श्री किशोर कु मार ने अपने निर्वाचन व्यय का लेखा दाखिल नहीं किया है। अभ्यर्थी श्री किशोर कु मार ने अपने अभ्यावेदन दिनांक 20.02.2023 में कहा कि उनके सम्पूर्ण व्यय लेखा दस्तावेज खो गये है | जिस पर जिला निर्वाचन अधिकारी, लखनऊ ने अपने पत्र 1140/निर्वाचन-8-219/2021-23 दिनांक 17.10.2023 के पत्र कहा है कि उक्त अभ्यर्थी ने न तो अपना लेखा निरिक्षण के लिए चुनाव के दौरान प्रस्तुत किया न ही अपना लेखा दाखिल किया, अत: अभ्यर्थी का कथन मिथ्या है; और,
यतः, आयोग का यह समाधान हो गया है कि श्री किशोर कु मार निर्वाचन खर्चों का लेखा दाखिल करने में विफल रहे हैं और उनके पास इस विफलता के लिए कोई भी उचितकारण अथवा औचित्य नहीं है; और
यत:, लोक प्रतिनिधित्व अधिनियम,1951 की धारा 10क में अनुबंधित किया गया है कि:-
"यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति -
(क) निर्वाचन व्ययों का लेखा उस समय के भीतर और उस रीति में जैसी इस अधिनियम के द्वारा या अधीन अपेक्षित है, दाखिल करने में असफल रहा है; तथा
(ख) उस असफलता के लिए कोई अच्छा कारण या न्यायोचित्य नहीं रखता है, तो निर्वाचन आयोग शासकीय राजपत्र में प्रकाशित आदेश द्वारा उसको निरहित घोषित करेगा और ऐसा व्यक्ति उस आदेश की तारीख से तीन वर्ष की कालावधि के लिए निरहित होगा;
अतः, अब लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अनुसरण में भारत निर्वाचन आयोग एतद्द्वारा घोषणा करता है कि उत्तर प्रदेश राज्य के 169-बक्शी का तालाब विधान सभा निर्वाचन क्षेत्र से उत्तर प्रदेश राज्य में विधान सभा के साधारण निर्वाचन, 2022 में निर्वाचन लड़ने वाले अभ्यर्थी श्री किशोर कु मार निवासी 2/374, विनम्र खण्ड, गोमती नगर, लखनऊ को इस आदेश की तारीख से तीन वर्ष की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य-क्षेत्र की विधान सभा अथवा विधान परिषद् का सदस्य चुने जाने अथवा होने के लिए निरहित है।

New Delhi, the 23rd february, 2024
O.N. 102.—WHEREAS, the General Election to 169-Bakshi Kaa Talab Legislative Assembly of Uttar Pradesh, 2022 was announced vide Notification No. 68/61-2022 dated 27th January, 2022.
WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate at an election has to, within 30 days from the date of election of the returned candidate, lodge a true copy of the account of his election expenses with the District Election Officer; and,
WHEREAS, the result of the said election along with 169-Bakshi Kaa Talab Assembly Constituency was declared by the concerned Returning Officer on 10th March, 2022. Hence, the last date for lodging the account of Election Expenses was 09th April, 2022; and,
WHEREAS, as per the report submitted by the District Election Officer, Lucknow, Uttar Pradesh and forwarded by the Joint Chief Electoral Officer, Uttar Pradesh vide their letter No. 287/Nirvachan Vayy Cell/GE- LA/2022/Patra-01/2021, dated 27th April, 2022, Shri Kishor Kumar, a contesting candidate of Uttar Pradesh from 169-Bakshi Kaa Talab Assembly Constituency of Uttar Pradesh, has failed to lodge account of his election expenses, in the manner, as required under law; and,
WHEREAS, on the basis of the reports of the District Election Office, Lucknow, Uttar Pradesh and the Chief Electoral Officer, Uttar Pradesh, a Show-Cause notice, 76/UP-LA/2022/CEMS-III dated 29.11.2022 was issued under sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India to Shri Kishor Kumar for not lodging the account of Election Expenses; and,
WHEREAS, As per the sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, through the above said Show-Cause Notice, dated 29.11.2022, Shri Kishor Kumar was directed to submit his representation in writing with explaining the reasons for not lodging the account and to lodge account of election expenses within 20 days from the date of receipt of the notice; and,
WHEREAS, the said notice was pasted at the address given by the candidate on 04.02.2023. The acknowledgment receipt has been submitted to the Commission by the District Election Officer, Lucknow, vide its letter no. 223/निवााचन-8-219/2021-23; and,
WHEREAS, the District Election Officer, Lucknow in his Supplementary Report, vide its letter No. 223/निवााचन-8-219/2021-23 dated 27.02.2023 has reported that Shri Kishor Kumar has not submitted his account of election expenses. Candidate Shri Kishor Kumar had submitted a representation dated 20.02.2023 stating that all his election expenses had lost. On the representation District Election Officer, Lucknow in his letter No. 1140/निवााचन- 8-219/2021-23 dated 17.10.2023 stated that the said candidate neither present for inspection during election nor submit his account. Hence, the statement of the candidate is false; and,
WHEREAS, the Commission is satisfied that Shri Kishor Kumar has failed to lodge the account of election expenses and has no good reason or justification for the failure,
WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that:-
"If the Election Commission is satisfied that a person-
(a) has failed to lodge an account of election expenses, within the time and in the manner required by or
under this Act, and
(b) has no good reason or justification for the failure,
the Election Commission shall, by order published in the Official Gazette, declare him to be disqualified and
any such person shall be disqualified for a period of three years from the date of the order";
NOW, THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission of India hereby declares Shri Kishor Kumar resident of 2/374 Vinmra Khand, Gomti Nagar, Lucknow a contesting candidate from 169-Bakshi Kaa Talab Assembly Constituency of the State of Uttar Pradesh in the General Election to the Legislative Assembly 2022 to be disqualified for being chosen as and for being a member of either House of the Parliament or the Legislative Assembly or the Legislative Council of a State or Union Territory for a period of three years from the date of this order.

आ.अ. 103.— यतः, भारत निर्वाचन आयोग की अधिसूचना सं. 464/के टी-एलए/2023 दिनांक 13 अप्रैल, 2023 के अनुसरण में 128- चिक्कनैकानाहल्ली विधान सभा निर्वाचन क्षेत्र के लिए कर्नाटक विधान सभा का साधारण निर्वाचन, 2023 आयोजित किया गया था; और
यत:, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 78 के अनुसार, किसी भी निर्वाचन में निर्वाचन लड़ने वाला प्रत्येक अभ्यर्थी, निर्वाचित अभ्यर्थी के निर्वाचन की तारीख से 30 दिनों के भीतर अपने निर्वाचन व्यय के लेखे जिला निर्वाचन अधिकारी के पास दाखिल करेगा जो उक्त अधिनियम की धारा 77 के अन्तर्गत उसके द्वारा या उसके निर्वाचन अभिकर्ता द्वारा रखे गए लेखे की एक सत्य प्रति होगी; और
यतः, कर्नाटक के 128-चिक्कनैकानाहल्ली विधानसभा निर्वाचन क्षेत्र के लिए निर्वाचन, 2023 का परिणाम, रिटनिग अधिकारी द्वारा 13 मई, 2023 को घोषित किया गया था और इस प्रकार निर्वाचन व्यय के लेखे दाखिल करने की अन्तिम तारीख 12 जून, 2023 थी; और
यतः, निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (1) के अंतर्गत, मुख्य निर्वाचन अधिकारी, कर्नाटक से उनके दिनांक 27.06.2023 के पत्र सं. DPAR 29 CHUVEBA (Addl CEO-1)2023 के तहत प्राप्त जिला निर्वाचन अधिकारी, टुमकु र की रिपोर्ट दिनांक 12.06.2023 के अनुसार, डॉ एम के पाशा, जो कर्नाटक के 128- चिक्कनैकानाहल्ली विधान सभा निर्वाचन क्षेत्र, 2023 से निर्वाचन लड़ने वाले अभ्यर्थी हैं, विधि के अंतर्गत यथापेक्षित रीति से अपने निर्वाचन व्यय के लेखे दाखिल करने में असफल रहे हैं; और
यतः, जिला निर्वाचन अधिकारी, टुमकु र की उक्त रिपोर्ट के आधार पर, भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (5) के अंतर्गत डॉ एम के पाशा को अपने निर्वाचन व्यय के लेखे प्रस्तुत नहीं करने के लिए कारण बताओ नोटिस सं. 76/के टी-एलए/26/2023/सीईएमएस-II, दिनांक 26 फरवरी 2024 को जारी किया गया था; और
यत:, उपयु र्क्त उक्त कारण बताओ नोटिस के जरिए और निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (6) के अंतर्गत, डॉ एम के पाशा को लेखा दाखिल न किए जाने संबंधी कारणों को स्पष्ट करते हुए आयोग को अपना अभ्यावेदन लिखित रूप में प्रस्तुत करने और नोटिस के प्राप्त होने की तारीख से 20 दिनों के भीतर जिला निर्वाचन अधिकारी, टुमकु र जिला को अपने निर्वाचन व्यय के लेखे प्रस्तुत करने का निदेश दिया गया था; और
यत:, जिला निर्वाचन अधिकारी, टुमकु र जिला ने अपनी रिपोर्ट सं. ELN(1):VIVA:48/2023-24; दिनांक 23.08.2024 में सूचित किया है कि उक्त कारण बताओ नोटिस डॉ एम के पाशा को दिनांक 26.07.2024 को तामील किया गया था; और
यत:, जिला निर्वाचन अधिकारी, टुमकु र ने अपनी अनुपूरक रिपोर्ट सं. ELN(1):VIVA:48/2023-24; दिनांक 23.08.2024 जो कि मुख्य निर्वाचन अधिकारी, कर्नाटक के पत्र सं. DPAR/29/Chuvebha(Addl.CEO-1) 2023 दिनांक 27.09.2024 द्वारा प्राप्त हुई है, उसमें सूचित किया है कि डॉ एम के पाशा ने निर्वाचन व्यय के लेखे का कोई विवरण या अभ्यावेदन प्रस्तुत नहीं किया है। इसके अतिरिक्त, उक्त नोटिस मिलने के उपरांत, डॉ एम के पाशा ने विधि के अंतर्गत यथा-विहित लेखे दाखिल करने में अपनी असफलता के लिए भारत निर्वाचन आयोग को न तो कोई कारण बताया है और न ही कोई स्पष्टीकरण दिया है; और
यत:, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में यह उपबंधित किया गया है कि:-
''यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति-
(क) निर्वाचन व्ययों का लेखा उस समय के भीतर और उस रीति में जैसी इस अधिनियम के द्वारा या अधीन अपेक्षित है, दाखिल करने में असफल रहा है; तथा
(ख) उस असफलता के लिए कोई अच्छा कारण या न्यायोचित्य नहीं रखता है,
तो निर्वाचन आयोग शासकीय राजपत्र में प्रकाशित आदेश द्वारा उसको निरहित घोषित करेगा और ऐसा व्यक्ति उस आदेश की तारीख से तीन वर्ष की कालावधि के लिए निरहित होगा।";

यत:, तथ्यों और उपलब्ध रिकार्डों के आधार पर, आयोग का यह समाधान हो गया है कि डॉ एम के पाशा अपने निर्वाचन व्यय के लेखे दाखिल करने में असफल रहे हैं और उनके पास ऐसा करने में असफल रहने के लिए कोई भी उचित कारण अथवा औचित्य नहीं है; और
अत:, अब, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अनुसरण में, भारत निर्वाचन आयोग एतद्द्वारा घोषणा करता है कि कर्नाटक के 128- चिक्कनैकानाहल्ली विधान सभा निर्वाचन क्षेत्र के लिए साधारण निर्वाचन, 2023 में निर्वाचन लड़ने वाले अभ्यर्थी, डॉ एम के पाशा, निवासी- नं. 117 गजेरिया लेआउट सुभाष नगर नेलमंगला बेंगलुरु, इस आदेश की तारीख से तीन वर्ष की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य क्षेत्र की विधान सभा अथवा विधान परिषद का सदस्य चुने जाने अथवा होने के लिए निरहित होंगे।

O.N. 103.—WHEREAS, the General Election to Legislative Assembly of Karnataka, 2023 for 128- Chikkanayakanahalli Assembly Constituency was held in pursuance of the Election Commission of India Notification No. 464/KT-LA/2023, dated 13th April, 2023; and
WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate at an election shall, within 30 days from the date of election of the returned candidate, lodge with the District Election Officer an account of his/her election expenses which shall be a true copy of the account kept by him/her or his/her election agent under Section 77 of the said act; and
WHEREAS, the result of the election for 128-Chikkanayakanahalli Assembly Constituency of Karnataka, 2023 was declared by the Returning Officer on 13th May, 2023 and hence the last date for lodging the account of Election Expenses was 12th June, 2023; and
WHEREAS, as per the report dated 12.06.2023 of DEO, Tumkur under sub-rule (1) of Rule 89 of the Conduct of Elections Rules, 1961 received through the CEO, Karnataka vide his letter no. DPAR 29 CHUVEBA (Addl CEO-1)2023; dated 27.06.2023 stating that Dr M K Pasha, a contesting candidate from 128- Chikkanayakanahalli Assembly Constituency in General Election to Legislative Assembly of Karnataka, 2023 has failed to lodge the account of his election expenses, as required under law; and
WHEREAS, on basis of the said report of the District Election Officer, DEO, Tumkur a 'Show-Cause Notice' No. 76/KT-LA/26/2023/CEMS-II, dated 26th February, 2024 was issued under sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India to Dr M K Pasha, for not lodging of the account of Election Expenses; and
WHEREAS, through the above said 'Show Cause Notice' and under sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, Dr M K Pasha was directed to submit representation in writing to the Commission explaining the reasons for not lodging the account and also to lodge the account of his election expenses with the District Election Officer, DEO, Tumkur District within 20 days from the date of receipt of the notice; and
WHEREAS, the DEO, Tumkur in his report no. ELN(1):VIVA:48/2023-24; dated 23.08.2024 has reported that the said Show Cause Notice was served to Dr M K Pasha on 26.07.2024; and
WHEREAS, the District Election Officer, Tumkur in his Supplementary Report no. ELN(1):VIVA:48/2023-24; dated 23.08.2024 on account of the candidate received through CEO, Karnataka letter No. DPAR/29/Chuvebha(Addl.CEO-1) 2023; dated 27.09.2024 has reported that Dr M K Pasha has not submitted any representation or statement of account of election expenses. Further, after receipt of the said notice, Dr M K Pasha has neither furnished any reason nor explanation to the Election Commission of India for failure to lodge the account of his election expenses as prescribed under law; and
WHEREAS, Section 10A of the Representation of the People Act, 1951 provides that:-
"If the Election Commission is satisfied that a person-
(a) has failed to lodge an account of election expenses within the time and in the manner required by or

(b) has no good reason or justification for the failure,
the Election Commission shall, by order published in the Official Gazette, declare him to be disqualified and any such
person shall be disqualified for a period of three years from the date of the order.";
WHEREAS, on basis of the facts and available records, the Commission is satisfied that Dr M K Pasha has failed to lodge the account of his election expenses and has no good reason or justification for the failure to do so; and
NOW, THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission of India hereby declares Dr M K Pasha, resident of No 117 Gajeriya Layout Subhash Nagar Nelamangala Bengalore and a contesting candidate from 128-Chikkanayakanahalli Assembly Constituency of G.E. to LA of Karnataka, 2023, to be disqualified for being chosen as and for being a member of either House of the Parliament or the Legislative Assembly or the Legislative Council of a State or Union Territory for a period of three years from the date of this order.

यत:, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 78 के अनुसार, किसी भी निर्वाचन में निर्वाचन लड़ने वाला प्रत्येक अभ्यर्थी, निर्वाचित अभ्यर्थी के निर्वाचन की तारीख से 30 दिनों के भीतर अपने निर्वाचन व्यय के लेखे जिला निर्वाचन अधिकारी के पास दाखिल करेगा जो उक्त अधिनियम की धारा 77 के अन्तर्गत उसके द्वारा या उसके निर्वाचन अभिकर्ता द्वारा रखे गए लेखे की एक सत्य प्रति होगी; और
यतः, कर्नाटक के 137- पावागाडा (अ. जा.) विधानसभा निर्वाचन क्षेत्र के लिए निर्वाचन, 2023 का परिणाम, रिटनिग अधिकारी द्वारा 13 मई, 2023 को घोषित किया गया था और इस प्रकार निर्वाचन व्यय के लेखे दाखिल करने की अन्तिम तारीख 12 जून, 2023 थी; और
यतः, निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (1) के अंतर्गत, मुख्य निर्वाचन अधिकारी, कर्नाटक से उनके दिनांक 07.05.2024 के पत्र सं. DPAR/29/Chuvebha(Addl.CEO-1) 2023 के तहत प्राप्त जिला निर्वाचन अधिकारी, टुमकु र की रिपोर्ट दिनांक 12.06.2023 के अनुसार, नागराजप्पा, जो कर्नाटक के 137- पावागाडा (अ. जा.) विधान सभा निर्वाचन क्षेत्र, 2023 से निर्वाचन लड़ने वाले अभ्यर्थी हैं, विधि के अंतर्गत यथापेक्षित रीति से अपने निर्वाचन व्यय के लेखे दाखिल करने में असफल रहे हैं; और
यतः, जिला निर्वाचन अधिकारी, टुमकु र की उक्त रिपोर्ट के आधार पर, भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (5) के अंतर्गत नागराजप्पा को अपने निर्वाचन व्यय के लेखे प्रस्तुत नहीं करने के लिए कारण बताओ नोटिस सं. 76/के टी-एलए/26/2023/सीईएमएस-II, दिनांक 11 जुलाई 2024 को जारी किया गया था; और
यत:, उपयु र्क्त उक्त कारण बताओ नोटिस के जरिए और निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (6) के अंतर्गत, नागराजप्पा को लेखा दाखिल न किए जाने संबंधी कारणों को स्पष्ट करते हुए आयोग को अपना अभ्यावेदन लिखित रूप में प्रस्तुत करने और नोटिस के प्राप्त होने की तारीख से 20 दिनों के भीतर जिला निर्वाचन अधिकारी, टुमकु र जिला को अपने निर्वाचन व्यय के लेखे प्रस्तुत करने का निदेश दिया गया था; और [भाग II—खण्ड 3(iii)] भारत का राजपत्र : सितम्बर 28, 2024/ आश्विन 6, 1946 735
यत:, जिला निर्वाचन अधिकारी, टुमकु र जिला ने अपनी रिपोर्ट सं. ELN(1):VIVA:48/2023-24; दिनांक 23.08.2024 में सूचित किया है कि उक्त कारण बताओ नोटिस नागराजप्पा को दिनांक 19.07.2024 को तामील किया गया था; और
यत:, जिला निर्वाचन अधिकारी, टुमकु र ने अपनी अनुपूरक रिपोर्ट सं. ELN(1):VIVA:48/2023-24; दिनांक 23.08.2024 जो कि मुख्य निर्वाचन अधिकारी, कर्नाटक के पत्र सं. DPAR/29/Chuvebha(Addl.CEO-1) 2023 दिनांक 27.09.2024 द्वारा प्राप्त हुई है, उसमें सूचित किया है कि नागराजप्पा ने निर्वाचन व्यय के लेखे का कोई विवरण या अभ्यावेदन प्रस्तुत नहीं किया है। इसके अतिरिक्त, उक्त नोटिस मिलने के उपरांत, नागराजप्पा ने विधि के अंतर्गत यथा- विहित लेखे दाखिल करने में अपनी असफलता के लिए भारत निर्वाचन आयोग को न तो कोई कारण बताया है और न ही कोई स्पष्टीकरण दिया है; और
यत:, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में यह उपबंधित किया गया है कि:-
''यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति-
(क) निर्वाचन व्ययों का लेखा उस समय के भीतर और उस रीति में जैसी इस अधिनियम के द्वारा या अधीन अपेक्षित है, दाखिल करने में असफल रहा है; तथा
(ख) उस असफलता के लिए कोई अच्छा कारण या न्यायोचित्य नहीं रखता है,
तो निर्वाचन आयोग शासकीय राजपत्र में प्रकाशित आदेश द्वारा उसको निरहित घोषित करेगा और ऐसा व्यक्ति उस आदेश की तारीख से तीन वर्ष की कालावधि के लिए निरहित होगा।";
यत:, तथ्यों और उपलब्ध रिकार्डों के आधार पर, आयोग का यह समाधान हो गया है कि नागराजप्पा अपने निर्वाचन व्यय के लेखे दाखिल करने में असफल रहे हैं और उनके पास ऐसा करने में असफल रहने के लिए कोई भी उचित कारण अथवा औचित्य नहीं है; और
अत:, अब, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अनुसरण में, भारत निर्वाचन आयोग एतद्द्वारा घोषणा करता है कि कर्नाटक के 137- पावागाडा (अ. जा.) विधान सभा निर्वाचन क्षेत्र के लिए साधारण निर्वाचन, 2023 में निर्वाचन लड़ने वाले अभ्यर्थी, नागराजप्पा, निवासी- कोडामाडागु एडे पोस्ट, पावागाडा (टीए), टुमकु र (जिला), इस आदेश की तारीख से तीन वर्ष की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य क्षेत्र की विधान सभा अथवा विधान परिषद का सदस्य चुने जाने अथवा होने के लिए निरहित होंगे।

New Delhi, the 14th October, 2024
O.N. 104.—WHEREAS, the General Election to Legislative Assembly of Karnataka, 2023 for 137- Pavagada (SC) Assembly Constituency was held in pursuance of the Election Commission of India Notification No. 464/KT-LA/2023, dated 13th April, 2023; and
WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate at an election shall, within 30 days from the date of election of the returned candidate, lodge with the District Election Officer an account of his/her election expenses which shall be a true copy of the account kept by him/her or his/her election agent under Section 77 of the said act; and
WHEREAS, the result of the election for 137-Pavagada (SC) Assembly Constituency of Karnataka, 2023 was declared by the Returning Officer on 13th May, 2023 and hence the last date for lodging the account of Election Expenses was 12th June, 2023; and736 THE GAZETTE OF INDIA : SEPTEMBER 28, 2024/ASVINA 6, 1946 [PART II—SEC. 3(iii)] WHEREAS, as per the report dated 12.06.2023 of DEO, Tumkur under sub-rule (1) of Rule 89 of the Conduct of Elections Rules, 1961 received through the CEO, Karnataka vide his letter no. DPAR/29/Chuvebha(Addl.CEO-1) 2023; dated 07.05.2024 stating that Nagarajappa, a contesting candidate from 137-Pavagada (SC) Assembly Constituency in General Election to Legislative Assembly of Karnataka, 2023 has failed to lodge the account of his election expenses, as required under law; and
WHEREAS, on basis of the said report of the District Election Officer, DEO, Tumkur a 'Show-Cause Notice' No. 76/KT-LA/26/2023/CEMS-II, dated 11th July, 2024 was issued under sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India to Nagarajappa, for not lodging of the account of Election Expenses; and
WHEREAS, through the above said 'Show Cause Notice' and under sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, Nagarajappa was directed to submit representation in writing to the Commission explaining the reasons for not lodging the account and also to lodge the account of his election expenses with the District Election Officer, DEO, Tumkur District within 20 days from the date of receipt of the notice; and
WHEREAS, the DEO, Tumkur in his report no. ELN(1):VIVA:48/2023-24; dated 23.08.2024 has reported that the said Show Cause Notice was served to Nagarajappa on 19.07.2024; and
WHEREAS, the District Election Officer, Tumkur in his Supplementary Report no. ELN(1):VIVA:48/2023-24; dated 23.08.2024 on account of the candidate received through CEO, Karnataka letter No. DPAR/29/Chuvebha(Addl.CEO-1) 2023; dated 27.09.2024 has reported that Nagarajappa has not submitted any representation or statement of account of election expenses. Further, after receipt of the said notice, Nagarajappa has neither furnished any reason nor explanation to the Election Commission of India for failure to lodge the account of his election expenses as prescribed under law; and
WHEREAS, Section 10A of the Representation of the People Act, 1951 provides that:-
"If the Election Commission is satisfied that a person-
(a) has failed to lodge an account of election expenses within the time and in the manner required by or
under this Act, and
(b) has no good reason or justification for the failure,
the Election Commission shall, by order published in the Official Gazette, declare him to be disqualified and
any such person shall be disqualified for a period of three years from the date of the order.";
WHEREAS, on basis of the facts and available records, the Commission is satisfied that Nagarajappa has failed to lodge the account of his election expenses and has no good reason or justification for the failure to do so; and
NOW, THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission of India hereby declares Nagarajappa, resident of Kodamadagu Ade Post, Pavagada (TA), Tumkur (Dist) and a contesting candidate from 137-Pavagada (SC) Assembly Constituency of G.E. to LA of Karnataka, 2023, to be disqualified for being chosen as and for being a member of either House of the Parliament or the Legislative Assembly or the Legislative Council of a State or Union Territory for a period of three years from the date of this order.
