आ.अ. 1.—यतः भारत निर्वाचन आयोग द्वारा दिनांक 25 जनवरी की अधिसूचना सं0 464/ पीबी-वि0स0/2022 के अनुसरण में पंजाब राज्य के 87-फरीदकोट विधान सभा निर्वाचन क्षेत्र के लिए साधारण निर्वाचन, 2022 आयोजित किया गया था; और यतः लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 78 के अनुसार, किसी निर्वाचन में, निर्वाचन लड़ रहा प्रत्येक अभ्यर्थी, निर्वाचित अभ्यर्थी के निर्वाचन की तारीख से 30 दिनों के भीतर अपने निर्वाचन व्यय का लेखा जिला निर्वाचन अधिकारी (गए लेखे की एक सत्य प्रति होगी; और

यतः, पंजाब राज्य के 87-फरीदकोट विधान सभा निर्वाचन क्षेत्र के साधारण निर्वाचन, 2022 परिणाम रिटर्निंग ऑफिसर द्वारा दिनांक 10 मार्च , 2022 को घोशित किया गया था और इस प्रकार निर्वाचन व्यय के लेखे दाखिल करने की अन्तिम तारीख 09 अपै्रल 2023 थी; और

यतः, निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (1) के अंतर्गत, मुख्य निर्वाचन अधिकारी, पंजाब से 479 GI/2025

(1)2 THE GAZETTE OF INDIA : FEBRUARY 1, 2025/MAGHA 12, 1946 [PART II—SEC. 3(iii)] दिनांक 26 अप्रैल 2023 के पत्र सं0 इलेक्.-2022/आर-8510 के द्वारा प्राप्त जिला निर्वाचन अधिकारी की रिपोर्ट दिनांक शून्य के अनुसार श्री गुरूचरण सिंह सांगा जो पंजाब राज्य के 87-फरीदकोट विधान सभा निर्वाचन क्षेत्र, 2022 से निर्वाचन लड़ने वाले अभ्यर्थी हैं, निर्वाचन व्ययों का लेखा दाखिल करने में असफल रहे हैं और

यतः, जिला निर्वाचन अधिकारी की उक्त रिपोर्ट के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (5) के अंतर्गत श्री गुरूचरण सिंह सांगा को अपने निर्वाचन व्यय के लेखे प्रस्तुत नहीं करने के लिए कारण बताओ नोटिस सं. 76/पीबी-वि.स./87/2022/सी.ई.एम.एस.-1 दिनांकः 15 जून, 2023 जारी किया गया था, और

यतः, उपर्युक्त कारण बताओ नोटिस के जरिए और निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (6) के अनुसार श्री गुरूचरण सिंह सांगा, को लेखा प्रस्तुत न किए जाने संबंधी कारणों को स्पश्ट करते हुए, आयोग को अपना अभ्यावेदन लिखित रूप में प्रस्तुत करने और नोटिस के प्राप्त होने की तारीख से 20 दिनो के भीतर जिला निर्वाचन अधिकारी, फरीदकोट को अपने निर्वाचन व्यय का लेखा प्रस्तुत करने का निदेष दिया गया था, और

यतः जिला निर्वाचन अधिकारी, फरीदकोट जिला ने पत्र सं0 इलेक्/2024/5069 दिनांक 12.08.2024 सूचित किया है कि उक्त कारण बताओ नोटिस श्री गुरूचरण सिंह सांगा को दिनांक 26.07.2024 को अग्रेशित किया गया था, और

यतः जिला निर्वाचन अधिकारी, फरीदकोट , की अनुपूरक रिपोर्ट के द्वारा पत्र सं 2023/493. दिनांक 25.04.2023 अग्रेशित किया और बताया कि श्री गुरूचरण सिंह सांगा , ने निर्वाचन व्यय का लेखा प्रस्तुत नहीं किया है। इसके अतिरिक्त, उक्त नोटिस की पावती के उपरांत, श्री गुरूचरण सिंह सांगा , ने लेखा दाखिल नही करने में अपनी असफलता के लिए भारत निर्वाचन आयोग को न तो कोई कारण बताया है और न ही कोई स्पश्टीकरण दिया है, और

यतः लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में यह उपबंधित किया गया है किः

"यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति

(क) निर्वाचन व्ययों का लेखा उस समय के भीतर और रीति में जैसी इस अधिनियम के द्वारा या अधीन अपेक्षित है, दाखिल करने में असफल रहा है, और

(ख) उस असफलता के लिए कोई अच्छा कारण अथवा न्यायोचित्य नहीं रखता है

तो निर्वाचन आयोग, शासकीय राजपत्र में प्रकाषित आदेष द्वारा उसको निरर्हित घोशित करेगा और ऐसा व्यक्ति उस आदेष की तारीख से तीन वर्श की कालावधि के लिए निरर्हित होगा

यतः, तथ्यों और उपलब्ध रिकार्डों के आधार पर आयोग का यह समाधान हो गया है कि श्री गुरूचरण सिंह सांगा अपने निर्वाचन व्यय के लेखे दाखिल करने में असफल रहे हैं और उनके पास ऐसा करने में असफल रहने के लिए कोई भी उचित कारण अथवा औचित्य नहीं है, और

अतः अब लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अनुसरण में भारत निर्वाचन आयोग एतद्वारा धोशणा करता है कि पंजाब राज्य के साधारण निर्वाचन, 2022 के 87-फरीदकोट विधान सभा निर्वाचन क्षेत्र से निर्वाचन लड़ने वाले अभ्यर्थी श्री गुरूचरण सिंह सांगा , गांव साधनवाला , तह0 और जिला फरीदकोट इस आदेष की तारीख से तीन वर्श की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य क्षेत्र की विधानसभा अथवा विधान परिशद का सदस्य चुने जाने अथवा होने के लिए निरर्हित होंगे।

New Delhi, the 20th September, 2024

O.N. 1.—WHEREAS, the General Election to Legislative Assembly of Punjab, 2022 for 87-Faridkot Assembly Constituency was held in pursuance of the Election Commission of India Notification No. 464/PB- LA/2022, dated 25th January; and

WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate at an election shall, within 30 days from the date of election of the returned candidate, lodge with the District Election Officer an account of his election expenses which shall be true copy of the account kept by him or his election agent under Section 77 of the said act; and

WHEREAS, the result of the election for 87-Faridkot Assembly Constituency of Punjab, 2022 was declared by the Returning Officer on 10th March, 2022 and hence the last date for lodging the account of Election Expenses was 9th April, 2023; and3 [भाग II—खण्ड 3(iii)] भारत का राजपत्र : फरवरी 1, 2025, /माघ 12, 1946 WHEREAS, as per the report dated nil, of the DEO, Faridkot under sub-rule (1) of Rule 89 of the Conduct of Elections Rules, 1961, received through the CEO, Punjab vide his letter No. Elec-2022 /R-8510 dated 26 April 2022 stating that Sh. Gurcharan Singh Sangha a contesting candidate from

87-Faridkot Assembly Constituency in General Election to Legislative Assembly of Punjab, 2022 has failed to lodge account of election expenses, as required under law; and

WHEREAS, on the basis of the said report of the District Election Officer, Faridkot a Show-Cause notice No. 76/PB-LA/87/2022/CEMS-I, dated 15th June, 2022 was issued under sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India Sh. Gurcharan Singh Sangha for not lodging of account of Election Expenses; and

WHEREAS, through the above said Show Cause Notice and under sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, Sh. Gurcharan Singh Sangha was directed to submit representation in writing to the Commission explaining the reasons for not lodging the account and also to lodge account of election expenses with the District Election Officer, Faridkot District within 20 days from the date of receipt of the notice; and

WHEREAS, the District Election Officer, Faridkot vide his report No. Elec-2024/5069 dated 12.08.2024 reported that the said notice was served to Sh. Gurcharan Singh Sangha on dated 26.07.2024; and

WHEREAS, the District Election Officer, Faridkot Supplementary vide letter no -2023-493 dated 25-04- 2023 Sh. Gurcharan Singh Sangha has not submitted any representation of a statement of correct account of election expenses duly signed alongwith original vouchers etc. Further, after receipt of the said notice, Sh. Gurcharan Singh Sangha has neither furnished any reason nor explanation to the Election Commission of India, for failure to lodge the account as prescribed under law; and

WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that:-

"If the Election Commission is satisfied that a person-

(a) has failed to lodge an account of election expenses, within the time and in the manner required by or under

this Act, and

(b) has no good reason or justification for the failure,

the Election Commission shall, by order published in the Official Gazette, declare him to be disqualified and any

such person shall be disqualified for a period of three years from the date of the order.";

WHEREAS, on the basis of facts and available records, the Commission is satisfied that Sh. Gurcharan Singh Sangha has failed to lodge account of election expenses and has no good reason or justification for the failure to do so; and

NOW, THEREFORE, in pursuance of Section 10A of the Representation of the People Act,1951, the Election Commission of India hereby declares Sh. Gurcharan Singh Sangha Vill. Sadhanwala Tehsil, & Distt. Faridkot and a contesting candidate in 87-Faridkot Assembly Constituency of the State of Punjab in the General Election to the Legislative Assembly 2022 to be disqualified for being chosen as and for being a member of either House of the Parliament or the Legislative Assembly or the Legislative Council of a State or Union Territory for a period of three years from the date of this order.

आ.अ. 2.—यतः भारत निर्वाचन आयोग द्वारा दिनांक 25 जनवरी, 2022 की अधिसूचना सं. 464/पंजाब-वि.स./2022 के

अनुसरण में पंजाब के 101-सुनाम विधान सभा निर्वाचन क्षेत्र के लिए साधारण निर्वाचन, 2022 आयोजित किया गया था; और

यतः, जिला निर्वाचन अधिकारी, संगरूर की उक्त रिपोर्ट के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (5) के अंतर्गत श्री हरभगवान शर्मा भिखि को अपने निर्वाचन व्यय के लेखे प्रस्तुत नहीं करने के लिए कारण बताओ नोटिस सं. 76/पंजाब-वि.स./101/2022/सी.ई.एम.एस.-1 दिनांक 28 जून, 2022 जारी किया गया था, और

यतः, उपर्युक्त कारण बताओ नोटिस के जरिए और निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (6) के अनुसार श्री हरभगवान शर्मा भिखि को लेखा प्रस्तुत न किए जाने संबंधी कारणों को स्पश्ट करते हुए, आयोग को अपना अभ्यावेदन लिखित रूप में प्रस्तुत करने और नोटिस के प्राप्त होने की तारीख से 20 दिनो के भीतर जिला निर्वाचन अधिकारी, संगरूर को अपने निर्वाचन व्यय का पूर्ण लेखा प्रस्तुत करने का निदेष दिया गया था, और

यतः मुख्य निर्वाचन अधिकारी, पंजाब से दिनांक 09 अगस्त, 2022 के पत्र सं0 ईएलईसी-2022/आर-11095 के द्वारा प्राप्त जिला निर्वाचन अधिकारी, संगरूर ने अपनी पत्र सं0 2022/13550 दिनांक 14 जुलाई, 2022 में सूचित किया है कि उक्त कारण बताओ नोटिस श्री हरभगवान शर्मा भिखि को दिनांक 11.07.2022 को तामील किया गया था, और

यतः मुख्य निर्वाचन अधिकारी, पंजाब ने पत्र सं0 ईएलईसी-2023/आर-5191 दिनांक 21.09.2023 के द्वारा जिला निर्वाचन अधिकारी, संगरूर, की अनुपूरक रिपोर्ट सं. 2023/1555 दिनांक 21.09.2023 अग्रेशित किया और बताया कि श्री हरभगवान शर्मा भिखि ने निर्वाचन व्यय का लेखा प्रस्तुत नहीं किया है। इसके अतिरिक्त, उक्त नोटिस की पावती के उपरांत, श्री हरभगवान शर्मा भिखि ने विधि के अंतर्गत यथा विहित लेखा दाखिल करने में अपनी असफलता के लिए भारत निर्वाचन आयोग को न तो कोई कारण बताया है और न ही कोई स्पश्टीकरण दिया है, और

यतः लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में यह उपबंधित किया गया है किः

"यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति

अतः अब लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अनुसरण में भारत निर्वाचन आयोग एतद्‌द्वारा धोशणा करता है कि पंजाब राज्य के साधारण निर्वाचन, 2022 के 101-सुनाम विधानसभा विधानसभा निर्वाचन क्षेत्र से निर्वाचन लड़ने वाले अभ्यर्थी श्री हरभगवान शर्मा भिखि, वार्ड नं0 6, भिखि, जिला मानसा। इस आदेष की तारीख से तीन वर्श की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य क्षेत्र की विधानसभा अथवा विधान परिशद का सदस्य चुने जाने अथवा होने के लिए निरर्हित होंगे।

O.N. 2.—WHEREAS, the General Election to Legislative Assembly of Punjab, 2022 101-Sunam Assembly Constituency was held in pursuance of the Election Commission of India vide Notification No. 464/PB-LA/2022,5 [भाग II—खण्ड 3(iii)] भारत का राजपत्र : फरवरी 1, 2025, /माघ 12, 1946

dated 25th January, 2022; and

WHEREAS, the result of the election for 101-Sunam Assembly Constituency of Punjab, 2022 was declared by the Returning Officer on 10th March, 2022 and hence the last date for lodging the account of Election Expenses was 09th April, 2022; and

WHEREAS, as per report of the District Election Officer, Sangrur received from Chief Electoral Officer, Punjab vide his letterno. Elec. 2022/R-8510, dated 26.04.2022 under sub-rule (1) of Rule 89 of the Conduct of Elections Rules, 1961, Shri Harbhagwan Sharma Bhikhi, a contesting candidate from 101-Sunam Assembly Constituency of Punjab, 2022 has failed to lodge account of election expenses, as required under law; and

WHEREAS, on the basis of the said report of the District Election Officer, Sangrur a Show- Cause notice No. 76/PB-LA/101/2022/CEMS-I, dated 28th June, 2022 was issued under sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India to Shri Harbhagwan Sharma Bhikhi, for not lodging of account of Election Expenses; and

WHEREAS, through the above said Show Cause Notice and under sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, Shri Harbhagwan Sharma Bhikhi, was directed to submit representation in writing to the Commission explaining the reasons for not lodging the account and also to lodge account of election expenses with the District Election Officer, Sangrur District within 20 days from the date of receipt of the notice; and

WHEREAS, the Chief Electoral Officer, Punjab vide his letter no. Elec.2022/R-11095 dated 09.08.2022 forwarded the District Election Officer, Sangrur has reported that the said notice was served to Shri Harbhagwan Sharma Bhikhi, dated 11.7.2022; and

WHEREAS, the CEO, Punjab vide letter no ELEC-2023/R-5191, dated 21.09.2023 forwarded the District Election Officer, Sangrur Supplementary Report No.2023/1555 dated 21.09.2023 and reported that Shri Harbhagwan Sharma Bhikhi has not submitted account of election expenses. Further, after receipt of the said notice, Shri Harbhagwan Sharma Bhikhi, has neither furnished any reason nor explanation to the Election Commission of India, for failure to lodge the account as prescribed under law; and

WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that: -

NOW, THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission of India hereby declares Shri Harbhagwan Sharma Bhikhi, Ward No.6, Bhikhi District,Mansa, Distt.Sangrur and a contesting candidate in 101-Sunam Assembly Constituency of General Election to the Legislative Assembly of Punjab, 2022, to be disqualified for being chosen as and for being a member of either House of the Parliament or the Legislative Assembly or the Legislative Council of a State or Union Territory for a period of three years from the date of this order.

अनुसरण में पंजाब के 107-धुरी विधान सभा निर्वाचन क्षेत्र के लिए साधारण निर्वाचन, 2022 आयोजित किया गया था; और यतः लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 78 के अनुसार, किसी निर्वाचन में, निर्वाचन लड़ रहा प्रत्येक अभ्यर्थी, निर्वाचित अभ्यर्थी के निर्वाचन की तारीख से 30 दिनों के भीतर अपने निर्वाचन व्यय का लेखा जिला निर्वाचन अधिकारी के पास दाखिल करेगा जो उक्त अधिनियम की धारा 77 के अंतर्गत उसके द्वारा या उसके निर्वाचन अभिकर्ता (एजेंट) द्वारा रखे गए लेखे की एक सत्य प्रति होगी; और यतः, पंजाब के 107-धुरी विधान सभा निर्वाचन क्षेत्र के साधारण निर्वाचन, 2022 परिणाम रिटर्निंग ऑफिसर द्वारा दिनांक 10 मार्च, 2022 को घोशित किया गया था और इस प्रकार निर्वाचन व्यय के लेखे दाखिल करने की अन्तिम तारीख 09 अपे्रल, 2022 थी; और यतः, निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (1) के अंतर्गत, जिला निर्वाचन अधिकारी, संगरूर की रिपोर्ट जो मुख्य निर्वाचन अधिकारी, पंजाब से दिनांक 26.04.2022 के पत्र सं0 ईएलईसी-2022/आर-8510 से प्राप्त हुई थी के अनुसार श्री जसविन्दर सिंह ,जो पंजाब के 107-धुरी विधानसभा निर्वाचन क्षेत्र, 2022 से निर्वाचन लड़ने वाले अभ्यर्थी हैं, जो अपने निर्वाचन व्यय का लेखा दाखिल करने में असफल रहे हैं और

यतः, जिला निर्वाचन अधिकारी, संगरूर की उक्त रिपोर्ट के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (5) के अंतर्गत श्री जसविन्दर सिंह, को अपने निर्वाचन व्यय के लेखे प्रस्तुत नहीं करने के लिए कारण बताओ नोटिस सं. 76/पंजाब-वि.स./107/2022/सी.ई.एम.एस.-1 दिनांक 28 जून, 2022 जारी किया गया था, और

यतः, उपर्युक्त कारण बताओ नोटिस के जरिए और निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (6) के अनुसार श्री जसविन्दर सिंह को लेखा प्रस्तुत न किए जाने संबंधी कारणों को स्पश्ट करते हुए, आयोग को अपना अभ्यावेदन लिखित रूप में प्रस्तुत करने और नोटिस के प्राप्त होने की तारीख से 20 दिनो के भीतर जिला निर्वाचन अधिकारी, संगरूर को अपने निर्वाचन व्यय का पूर्ण लेखा प्रस्तुत करने का निदेष दिया गया था, और

यतः मुख्य निर्वाचन अधिकारी, पंजाब से दिनांक 09 अगस्त, 2022 के पत्र सं0 ईएलईसी-2022/आर- 11095 के द्वारा प्राप्त जिला निर्वाचन अधिकारी, संगरूर ने अपनी पत्र सं0 2022/13550 दिनांक 14 जुलाई, 2022 में सूचित किया है कि उक्त कारण बताओ नोटिस श्री जसविन्दर सिंह को दिनांक 11.07.2022 को तामील किया गया था, और

यतः मुख्य निर्वाचन अधिकारी, पंजाब ने पत्र सं0 ईएलईसी-2023/आर-5191 दिनांक 21.09.2023 के द्वारा जिला निर्वाचन अधिकारी, संगरूर, की अनुपूरक रिपोर्ट सं. 2023/1555 दिनांक 21.09.2023 अग्रेशित किया और बताया कि श्री जसविन्दर सिंह ने निर्वाचन व्यय का लेखा प्रस्तुत नहीं किया है। इसके अतिरिक्त, उक्त नोटिस की पावती के उपरांत, श्री जसविन्दर सिंह ने विधि के अंतर्गत यथा विहित लेखा दाखिल करने में अपनी असफलता के लिए भारत निर्वाचन आयोग को न तो कोई कारण बताया है और न ही कोई स्पश्टीकरण दिया है, और

यतः लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में यह उपबंधित किया गया है किः

"यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति

(क) निर्वाचन व्ययों का लेखा उस समय के भीतर और रीति में जैसी इस अधिनियम के द्वारा या अधीन अपेक्षित है, दाखिल करने में असफल रहा है, और (ख) उस असफलता के लिए कोई अच्छा कारण अथवा न्यायोचित्य नहीं रखता है तो निर्वाचन आयोग, शासकीय राजपत्र में प्रकाषित आदेष द्वारा उसको निरर्हित घोशित करेगा और ऐसा व्यक्ति उस आदेष की तारीख से तीन वर्श की कालावधि के लिए निरर्हित होगा

यतः, तथ्यों और उपलब्ध रिकार्डों के आधार पर आयोग का यह समाधान हो गया है कि श्री जसविन्दर सिंह, अपने निर्वाचन व्यय के लेखे दाखिल करने में असफल रहे हैं और उनके पास ऐसा करने में असफल रहने के लिए कोई भी उचित कारण अथवा औचित्य नहीं है, और

अतः अब लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अनुसरण में भारत निर्वाचन आयोग एतद्‌द्वारा धोशणा करता है कि पंजाब राज्य के साधारण निर्वाचन, 2022 के 107-धुरी विधानसभा निर्वाचन क्षेत्र से निर्वाचन लड़ने वाले अभ्यर्थी श्री जसविन्दर7 [भाग II—खण्ड 3(iii)] भारत का राजपत्र : फरवरी 1, 2025, /माघ 12, 1946 सिंह, ककारवाल तहसील, धुरी इस आदेष की तारीख से तीन वर्श की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य क्षेत्र की विधानसभा अथवा विधान परिशद का सदस्य चुने जाने अथवा होने के लिए निरर्हित होंगे।

O.N. 3.—WHEREAS, the General Election to Legislative Assembly of Punjab, 2022 107-Dhuri Assembly Constituency was held in pursuance of the Election Commission of India vide Notification No. 464/PB- LA/2022, dated 25th January, 2022; and

WHEREAS, the result of the election for 107-Dhuri Assembly Constituency of Punjab, 2022 was declared by the Returning Officer on 10th March, 2022 and hence the last date for lodging the account of Election Expenses was 09th April, 2022; and

WHEREAS, as per report of the District Election Officer, Sangrur received from Chief Electoral Officer, Punjab vide his letterno. Elec. 2022/R-8510, dated 26.04.2022 under sub-rule (1) of Rule 89 of the Conduct of Elections Rules, 1961, Shri Jaswinder Singh, a contesting candidate from 107-Dhuri Assembly Constituency of Punjab, 2022 has failed to lodge account of election expenses, as required under law; and

WHEREAS, on the basis of the said report of the District Election Officer, Sangrur a Show-Cause notice No. 76/PB-LA/107/2022/CEMS-I, dated 28th June, 2022 was issued under sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India to Shri Jaswinder Singh, for not lodging of account of Election Expenses; and

WHEREAS, through the above said Show Cause Notice and under sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, Shri Jaswinder Singh, was directed to submit representation in writing to the Commission explaining the reasons for not lodging the account and also to lodge account of election expenses with the District Election Officer, Sangrur District within 20 days from the date of receipt of the notice; and

WHEREAS, the CEO, Punjab vide letter no ELEC-2023/R-5191, dated 21.09.2023 forwarded the District Election Officer, Sangrur Supplementary Report No. 2023/1555 dated 21.09.2023 and reported that Shri Jaswinder Singh has not submitted account of election expenses. Further, after receipt of the said notice, Shri Jaswinder Singh, has neither furnished any reason nor explanation to the Election Commission of India, for failure to lodge the account as prescribed under law; and

WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that: -

"If the Election Commission is satisfied that a person-

(a) has failed to lodge an account of election expenses, within the time and in the manner required by or

under this Act, and

(b) has no good reason or justification for the failure,

the Election Commission shall, by order published in the Official Gazette, declare him to be disqualified and any

such person shall be disqualified for a period of three years from the date of the order.";

WHEREAS, on the basis of facts and available records, the Commission is satisfied that Shri Jaswinder Singh, has failed to lodge account of election expenses and has no good reason or justification for the failure to do so; and

NOW, THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission of India hereby declares Shri Jaswinder Singh, Kakarwal Tehsil Dhuri, Distt.Sangrur and a contesting candidate in 107-Dhuri Assembly Constituency of General Election to the Legislative Assembly of8 THE GAZETTE OF INDIA : FEBRUARY 1, 2025/MAGHA 12, 1946 [PART II—SEC. 3(iii)] Punjab, 2022, to be disqualified for being chosen as and for being a member of either House of the Parliament or the Legislative Assembly or the Legislative Council of a State or Union Territory for a period of three years from the date of this order.

O.N. 5.—WHEREAS, the General Election to Legislative Assembly of Punjab, 2022 107-Dhuri Assembly Constituency was held in pursuance of the Election Commission of India vide Notification No. 464/PB-LA/2022, dated 25th January, 2022; and

WHEREAS, as per report of the District Election Officer, Sangrur received from Chief Electoral Officer, Punjab vide his letterno. Elec. 2022/R-8510, dated 26.04.2022 under sub-rule (1) of Rule 89 of the Conduct of Elections Rules, 1961, Shri Shakti Kumar Gupta, a contesting candidate from 107-Dhuri Assembly Constituency of Punjab, 2022 has failed to lodge account of election expenses, as required under law; and

WHEREAS, on the basis of the said report of the District Election Officer, Sangrur a Show-Cause notice No. 76/PB-LA/101/2022/CEMS-I, dated 28th June, 2022 was issued under sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India to Shri Shakti Kumar Gupta, for not lodging of account of Election Expenses; and

WHEREAS, through the above said Show Cause Notice and under sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, Shri Shakti Kumar Gupta, was directed to submit representation in writing to the12 THE GAZETTE OF INDIA : FEBRUARY 1, 2025/MAGHA 12, 1946 [PART II—SEC. 3(iii)] Commission explaining the reasons for not lodging the account and also to lodge account of election expenses with the District Election Officer, Sangrur District within 20 days from the date of receipt of the notice; and

WHEREAS, the CEO, Punjab vide letter no ELEC-2023/R-5191, dated 21.09.2023 forwarded the District Election Officer, Sangrur Supplementary Report No.2023/1555 dated 21.09.2023 and reported that Shri Shakti Kumar Gupta has not submitted account of election expenses. Further, after receipt of the said notice, Shri Shakti Kumar Gupta, has neither furnished any reason nor explanation to the Election Commission of India, for failure to lodge the account as prescribed under law; and

WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that:-

"If the Election Commission is satisfied that a person-

(a) has failed to lodge an account of election expenses, within the time and in the manner required by or

under this Act, and

(b) has no good reason or justification for the failure,

the Election Commission shall, by order published in the Official Gazette, declare him to be disqualified and any such

person shall be disqualified for a period of three years from the date of the order.";

WHEREAS, on the basis of facts and available records, the Commission is satisfied that Shri Shakti Kumar Gupta, has failed to lodge account of election expenses and has no good reason or justification for the failure to do so; and

NOW, THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission of India hereby declares Shri Shakti Kumar Gupta, #292, Ward No.2A, Janta Nagar, Dhuri, Distt.Sangrur and a contesting candidate in 107-Dhuri Assembly Constituency of General Election to the Legislative Assembly of Punjab, 2022, to be disqualified for being chosen as and for being a member of either House of the Parliament or the Legislative Assembly or the Legislative Council of a State or Union Territory for a period of three years from the date of this order.

यतः, निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (1) के अंतर्गत, जिला निर्वाचन अधिकारी, षिमला की दिनांक 03.07.2024 की रिपोर्ट जो मुख्य निर्वाचन अधिकारी, हिमाचल प्रदेष से दिनांक 19.07.2024 के पत्र सं0 3-1/2024-ईएलएन-ईईएम-VII-3114 से प्राप्त हुई थी, के अनुसार श्री सुरेष कुमार जो हिमाचल प्रदेष के 04-षिमला संसदीय निर्वाचन क्षेत्र से निर्वाचन लड़ने वाले अभ्यर्थी हैं, जो अपने निर्वाचन व्यय का लेखा दाखिल करने में असफल रहे हैं और13 [भाग II—खण्ड 3(iii)] भारत का राजपत्र : फरवरी 1, 2025, /माघ 12, 1946 यतः, जिला निर्वाचन अधिकारी, षिमला की उक्त रिपोर्ट के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (5) के अंतर्गत श्री सुरेष कुमार को अपने निर्वाचन व्यय के लेखे प्रस्तुत नहीं करने के लिए कारण बताओ नोटिस सं. 76/हि. प्र.-लो.स./04/2024/सी.ई.एम.एस.-1 दिनांक 19 सितम्बर, 2024 जारी किया गया था, और

यतः, उपर्युक्त कारण बताओ नोटिस के जरिए और निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (6) के अनुसार श्री सुरेष कुमार को लेखा प्रस्तुत न किए जाने संबंधी कारणों को स्पश्ट करते हुए, आयोग को अपना अभ्यावेदन लिखित रूप में प्रस्तुत करने और नोटिस के प्राप्त होने की तारीख से 20 दिनो के भीतर जिला निर्वाचन अधिकारी, षिमला को अपने निर्वाचन व्यय का पूर्ण लेखा प्रस्तुत करने का निदेष दिया गया था, और

यतः मुख्य निर्वाचन अधिकारी, हिमाचल प्रदेष से दिनांक 09 अक्तूबर, 2024 के पत्र सं0 3-1/2024-ईएलएन-ईईएम- X-8514 के द्वारा प्राप्त जिला निर्वाचन अधिकारी, षिमला ने अपनी पत्र सं0 नाहन-173001 दिनांक 5 अक्तूबर, 2024 में सूचित किया है कि उक्त कारण बताओ नोटिस श्री सुरेष कुमार को दिनांक 05.10.2024 को तामील किया गया था, और

यतः मुख्य निर्वाचन अधिकारी, हिमाचल प्रदेष ने पत्र सं0 3-1/2024-ईएलएन-ईईएम-X-8652 दिनांक 08.11.2024 के द्वारा प्राप्त जिला निर्वाचन अधिकारी, षिमला, की अनुपूरक रिपोर्ट सं. एसएमएल-7-1/2023-ईएलईसीप्।।-3037-39 दिनांक 04.10.2024 अग्रेशित किया और बताया कि श्री सुरेष कुमार ने निर्वाचन व्यय का लेखा प्रस्तुत नहीं किया है। इसके अतिरिक्त, उक्त नोटिस की पावती के उपरांत, श्री सुरेष कुमार ने निर्धारित अवधि के अंतर्गत यथा विहित लेखा दाखिल करने में अपनी असफलता के लिए भारत निर्वाचन आयोग को न तो कोई कारण बताया है और न ही कोई स्पश्टीकरण दिया है, और

यतः लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में यह उपबंधित किया गया है किः

"यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति

यतः, तथ्यों और उपलब्ध रिकार्डों के आधार पर आयोग का यह समाधान हो गया है कि श्री सुरेष कुमार अपने निर्वाचन व्यय के लेखे दाखिल करने में असफल रहे हैं और उनके पास ऐसा करने में असफल रहने के लिए कोई भी उचित कारण अथवा औचित्य नहीं है, और

WHEREAS, through the above said Show Cause Notice and under sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, Sh.Jameel Ahmed Khan, was directed to submit representation in writing to the Commission explaining the reasons for not lodging the account and also to lodge account of election expenses with the District Election Officer, Jaipur District within 20 days from the date of receipt of the notice; and

आ.अ. 8.—यतः भारत निर्वाचन आयोग द्वारा दिनांक 25 जनवरी की अधिसूचना सं0 464/ पीबी-वि0स0/2022 के अनुसरण में पंजाब राज्य के 26-भोलाथ विधान सभा निर्वाचन क्षेत्र के लिए साधारण निर्वाचन, 2022 आयोजित किया गया था; और

यतः लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 78 के अनुसार, किसी निर्वाचन में, निर्वाचन लड़ रहा प्रत्येक अभ्यर्थी, निर्वाचित अभ्यर्थी के निर्वाचन की तारीख से 30 दिनों के भीतर अपने निर्वाचन व्यय का लेखा जिला निर्वाचन अधिकारी दाखिल करेगा जो उक्त अधिनियम की धारा 77 के अंंतर्गत उसके द्वारा या उसके निर्वाचन अभिकर्ता (एजेंट) द्वारा रखे गए लेखे की एक सत्य प्रति होगी; और यतः, पंजाब राज्य के 26-भोलाथ विधान सभा निर्वाचन क्षेत्र के साधारण निर्वाचन, 2022 परिणाम रिटर्निंग ऑफिसर द्वारा दिनांक 10 मार्च , 2022 को घोशित किया गया था और इस प्रकार निर्वाचन व्यय के लेखे दाखिल करने की अन्तिम तारीख 09 अपै्रल 2023 थी; और

यतः, निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (1) के अंतर्गत, मुख्य निर्वाचन अधिकारी, पंजाब से दिनांक 26 अप्रैल 2023 के पत्र सं0 इलेक्.-2022/आर-8510 के द्वारा प्राप्त जिला निर्वाचन अधिकारी की रिपोर्ट दिनांक शून्य के अनुसार श्री जोगिन्दर सिंह मान जो पंजाब राज्य 26-भोलाथ विधान सभा निर्वाचन क्षेत्र, 2022 से निर्वाचन लड़ने वाले अभ्यर्थी हैं, निर्वाचन व्ययों का लेखा दाखिल करने में असफल रहे हैं और

यतः, जिला निर्वाचन अधिकारी की उक्त रिपोर्ट के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (5) के अंतर्गत श्री जोगिन्दर सिंह मान को अपने निर्वाचन व्यय के लेखे प्रस्तुत नहीं करने के लिए कारण बताओ नोटिस सं. 76/पीबी-वि.स./26/2022/सी.ई.एम.एस.-1 दिनांकः 15 जून, 2022 जारी किया गया था, और

यतः, उपर्युक्त कारण बताओ नोटिस के जरिए और निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (6) के अनुसार श्री जोगिन्दर सिंह मान , को लेखा प्रस्तुत न किए जाने संबंधी कारणों को स्पश्ट करते हुए, आयोग को अपना अभ्यावेदन लिखित रूप में प्रस्तुत करने और नोटिस के प्राप्त होने की तारीख से 20 दिनो के भीतर जिला निर्वाचन अधिकारी, कपूरथला को अपने निर्वाचन व्यय का लेखा प्रस्तुत करने का निदेष दिया गया था, और

यतः जिला निर्वाचन अधिकारी, कपूरथला जिला ने पत्र सं0 इलेक्/2022/6336 दिनांक 14.07.2022 सूचित किया है कि उक्त कारण बताओ नोटिस श्री जोगिन्दर सिंह मान को दिनांक 01.07.2022 को अग्रेशित किया गया था, और

यतः जिला निर्वाचन अधिकारी, कपूरथला , की अनुपूरक रिपोर्ट के द्वारा पत्र सं इलेक्.2024/आर0-9193.

दिनांक 17.10.2024 अग्रेशित किया और बताया कि श्री जोगिन्दर सिंह मान, ने निर्वाचन व्यय का लेखा प्रस्तुत नहीं किया है । इसके अतिरिक्त, उक्त नोटिस की पावती के उपरांत, श्री जोगिन्दर सिंह मान, ने लेखा दाखिल नही करने में अपनी असफलता के लिए भारत निर्वाचन आयोग को न तो कोई कारण बताया है और न ही कोई स्पश्टीकरण दिया है, और

यतः लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में यह उपबंधित किया गया है किः

"यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति

(ख) उस असफलता के लिए कोई अच्छा कारण अथवा न्यायोचित्य नहीं रखता है

यतः, तथ्यों और उपलब्ध रिकार्डों के आधार पर आयोग का यह समाधान हो गया है कि श्री जोगिन्दर सिंह मान अपने निर्वाचन व्यय के लेखे दाखिल करने में असफल रहे हैं और उनके पास ऐसा करने में असफल रहने के लिए कोई भी उचित कारण अथवा औचित्य नहीं है, और

अतः अब लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अनुसरण में भारत निर्वाचन आयोग एतद्वारा धोशणा करता है कि पंजाब राज्य के साधारण निर्वाचन, 2022 के 26-भोलाथ विधान सभा निर्वाचन क्षेत्र से निर्वाचन लड़ने18 THE GAZETTE OF INDIA : FEBRUARY 1, 2025/MAGHA 12, 1946 [PART II—SEC. 3(iii)] वाले अभ्यर्थी श्री जोगिन्दर सिंह मान , गांव बोपराई , तहसील भोलाथ ,जिला कपूरथला इस आदेष की तारीख से तीन वर्श की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य क्षेत्र की विधानसभा अथवा विधान परिशद का सदस्य चुने जाने अथवा होने के लिए निरर्हित होंगे।

New Delhi, the 6th January, 2025

O.N. 8.—WHEREAS, the General Election to Legislative Assembly of Punjab, 2022 for 26-Bholath Assembly Constituency was held in pursuance of the Election Commission of India Notification No. 464/PB- LA/2022, dated 25th January; and

WHEREAS, the result of the election for 26-Bholath Assembly Constituency of Punjab, 2022 was declared by the Returning Officer on 10th March, 2022 and hence the last date for lodging the account of Election Expenses was 9th April, 2023; and

WHEREAS, as per the report dated nil, of the DEO, Kapurthala under sub-rule (1) of Rule 89 of the Conduct of Elections Rules, 1961, received through the CEO, Punjab vide his letter No. Elec-2022 /R-8510 dated 26 April 2022 stating that Sh. Joginder Singh Maan a contesting candidate from

26-Bholath Assembly Constituency in General Election to Legislative Assembly of Punjab, 2022 has failed to lodge account of election expenses, as required under law; and

WHEREAS, on the basis of the said report of the District Election Officer, Kapurthala a Show-Cause notice No. 76/PB-LA/26/2022/CEMS-I, dated 15th June, 2022 was issued under sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India Sh. Joginder Singh Maan for not lodging of account of Election Expenses; and

WHEREAS, through the above said Show Cause Notice and under sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, Sh. Joginder Singh Maan was directed to submit representation in writing to the Commission explaining the reasons for not lodging the account and also to lodge account of election expenses with the District Election Officer, Kapurthala District within 20 days from the date of receipt of the notice; and

WHEREAS, the District Election Officer, Kapurthala vide his report No. Elec-2022/6336 dated 14.07.2022 reported that the said notice was served to Sh. Joginder Singh Maan, on dated 01.07.2022; and

WHEREAS, the District Election Officer, Kapurthala Supplementary vide letter no -2024-9193 dated 17- 10 -2024 Sh. Joginder Singh Maan, has not submitted any representation of a statement of correct account of election expenses duly signed alongwith original vouchers etc. Further, after receipt of the said notice, Sh. Joginder Singh Maan,

has neither furnished any reason nor explanation to the Election Commission of India, for failure to lodge the account as prescribed under law; and

WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that:-

"If the Election Commission is satisfied that a person-

(a) has failed to lodge an account of election expenses, within the time and in the manner required by or under

this Act, and

(b) has no good reason or justification for the failure,

the Election Commission shall, by order published in the Official Gazette, declare him to be disqualified and any

such person shall be disqualified for a period of three years from the date of the order.";

WHEREAS, on the basis of facts and available records, the Commission is satisfied that Sh. Joginder Singh Maan,

has failed to lodge account of election expenses and has no good reason or justification for the failure to do so; and

NOW, THEREFORE, in pursuance of Section 10A of the Representation of the People Act,1951, the Election Commission of India hereby declares Sh. Joginder Singh Maan,19 [भाग II—खण्ड 3(iii)] भारत का राजपत्र : फरवरी 1, 2025, /माघ 12, 1946 Vill. Boparai, Tehsil Bholath, District Kapurthala and a contesting candidate in 26-Bholath Assembly Constituency of the State of Punjab in the General Election to the Legislative Assembly 2022 to be disqualified for being chosen as and for being a member of either House of the Parliament or the Legislative Assembly or the Legislative Council of a State or Union Territory for a period of three years from the date of this order.
