2. अधिकारी की नियुक्ति निम्न न्यायालयीन मामलों के परिणामों के अधीन होगी तथा किसी अन्य संबंधित मामले में किसी भी सक्षम न्यायालय द्वारा पारित किसी अन्य आदेश के अधीन होगी:

i. माननीय सवोच्च न्यायालय में सिविल अपील सं. 629/2022 और संबद्ध मामले (जरनैल सिंह बैच के मामले)।

ii. अनुभाग अधिकारी/सहायक अनुभाग अधिकारी ग्रेड में वरिष्ठता, पदोन्नति आदि से संबद्ध मामले, यदि कोई हों जो किसी भी सक्षम न्यायालय में आज तक दायर किए गए हों।

3. सीएसएस नियमों के नियम 2(ग) (iii) के अनुसार, एसओएसएल 2025 (एसक्यू) में शामिल अधिकरियों के संबंध में स्वीकृ त सेवा की गणना दिनांक 1 जुलाई, 2025 से की जाएगी। तथापि, डीपीसी दिशा-निदेशों के संदर्भ में, पदोन्नति के वल भविष्यलक्षी तिथि से प्रभावी होगी तथा वास्तविक पदोन्नति की तिथि से पूर्व की तिथि से कल्पित वेतन-नियतन नहीं किया जाएगा।

2. यह नियुक्ति माननीय उच्चतम न्यायालय के दिनांक 26 सितम्बर 2018 के निर्णय सं. एस.एल.पी. (सिविल) सं. 30621/2011 के अध्यधीन है ।

3. एफ़ आर 22 (I)(ए)(1) के प्रावधानों के अनुसार, अधिकारी इस अधिसूचना के निर्गत होने के 30 दिनों के भीतर वेतन निर्धारण के अपने विकल्प का प्रयोग करने के पात्र हैं।
