आ.अ. 52.—यतः, भारत निर्वाचन आयोग द्वारा दिनांक 5 सितम्बर, 2024 की अधिसूचना सं. 464/भा0नि0आ0/हरि0-वि0स0/2024 के अनुसरण में हरियाणा राज्य के 32-गोहाना विधान सभा निर्वाचन क्षेत्र के लिए साधारण निर्वाचन, 2024 आयोजित किया गया था; और
यतः, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 78 के अनुसार, किसी निर्वाचन में, निर्वाचन लड़ने वाला प्रत्येक अभ्यर्थी, निर्वाचित अभ्यर्थी के निर्वाचन की तारीख से 30 दिनों के भीतर अपने निर्वाचन व्यय का लेखा जिला निर्वाचन अधिकारी के पास दाखिल करेगा जो उक्त अधिनियम की धारा 77 के अंतर्गत उसके द्वारा या उसके निर्वाचन अभिकर्ता (एजेंट) द्वारा रखे गए लेखे की एक सत्य प्रति होगी; और

(129)130 THE GAZETTE OF INDIA : MAY 23, 2026/JYAISHTHA 2, 1948 [PART II—SEC. 3(iii)] यतः, हरियाणा राज्य के 32-गोहाना विधान सभा निर्वाचन क्षेत्र के साधारण निर्वाचन, 2024 का परिणाम रिटनिग आफिसर द्वारा दिनांक 8 अक्तू बर, 2024 को घोषित किया गया था और इस प्रकार निर्वाचन व्यय के लेखे दाखिल करने की अन्तिम तारीख 7 नवम्बर, 2024 थी; और
यतः, निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (1) के अंतर्गत, जिला निर्वाचन अधिकारी, सोनीपत की रिपोर्ट दिनांक 08.11.2024 जो मुख्य निर्वाचन अधिकारी, हरियाणा से दिनांक 05.02.2025 पत्र सं0 6/Elect-Exp./GELA-HR-2024/Elec-2025/2AE-692 को प्राप्त हुई थी, के अनुसार श्री दिनेश कु मार जो हरियाणा राज्य के 32-गोहाना विधान सभा निर्वाचन क्षेत्र, 2024 से निर्वाचन लड़ने वाले अभ्यर्थी हैं, विधि के अंतर्गत यथापेक्षित रीति से अपने निर्वाचन व्ययों का लेखा दाखिल करने में असफल रहे हैं और
यतः, जिला निर्वाचन अधिकारी की उक्त रिपोर्ट के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (5) के अंतर्गत श्री दिनेश कु मार को अपने निर्वाचन व्यय के लेखे प्रस्तुत नहीं करने के लिए कारण बताओ नोटिस सं. 76/हरि/वि.स./व्यय लेखा/2024/सी.ई.एम.एस.-1, दिनांकः 30 अप्रैल, 2025 को जारी किया गया था, और
यतः, उपयु र्क्त कारण बताओ नोटिस के जरिए और निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (6) के अनुसार श्री दिनेश कु मार को लेखा प्रस्तुत न किए जाने संबंधी कारणों को स्पष्ट करते हुए, आयोग को अपना अभ्यावेदन लिखित रूप में प्रस्तुत करने और नोटिस के प्राप्त होने की तारीख से 20 दिनो के भीतर जिला निर्वाचन अधिकारी, सोनीपत को अपने निर्वाचन व्यय का लेखा प्रस्तुत करने का निदेश दिया गया था, और
यतः, जिला निर्वाचन अधिकारी, सोनीपत से दिनांक 19.06.2025 के पत्र सं0- निर्वाचन-2025/564 के द्वारा सूचित किया है कि उक्त कारण बताओ नोटिस विधिवत रूप से श्री दिनेश कु मार की माता (श्रीमती विद्या देवी) द्वारा दिनांक 30.05.2025 को तामील किया गया था, और
यतः, जिला निर्वाचन अधिकारी, सोनीपत ने पत्र सं0- निर्वाचन-2025/564 दिनांक 19.06.2025 के द्वारा प्रस्तुत की गई अनुपूरक रिपोर्ट में यह बताया है कि श्री दिनेश कु मार ने निर्वाचन व्यय का लेखा प्रस्तुत नहीं किया है। इसके अतिरिक्त, उक्त नोटिस की पावती के उपरांत, श्री दिनेश कु मार ने विधि के अंतर्गत यथा विहित लेखा दाखिल करने में अपनी असफलता के लिए भारत निर्वाचन आयोग को न तो कोई कारण बताया है और न ही कोई स्पष्टीकरण दिया है, और
यतः, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में यह उपबंधित किया गया है किः
"यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति
(क) निर्वाचन व्ययों का लेखा उस समय के भीतर और रीति में जैसी इस अधिनियम के द्वारा या अधीन अपेक्षित है, दाखिल करने में असफल रहा है, और
(ख) उस असफलता के लिए कोई अच्छा कारण अथवा न्यायोचित्य नहीं रखता है, तो निर्वाचन आयोग, शासकीय राजपत्र में प्रकाशित आदेश द्वारा उसको निरहित घोषित करेगा और ऐसा व्यक्ति उस आदेश की तारीख से तीन वर्ष की कालावधि के लिए निरहित होगा ।
यतः, तथ्यों और उपलब्ध रिकार्डों के आधार पर आयोग का यह समाधान हो गया है कि श्री दिनेश कु मार अपने निर्वाचन व्यय के लेखे दाखिल करने में असफल रहे हैं और उनके पास ऐसा करने में असफल रहने के लिए कोई भी उचित कारण अथवा औचित्य नहीं है, और131 [भाग II—खण्ड 3(iii)] भारत का राजपत्र : मई 23, 2026/ज्येष्ठ 2, 1948 अतः, अब, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अनुसरण में भारत निर्वाचन आयोग
एतद्वारा घोषणा करता है कि विधान सभा के साधारण निर्वाचन, 2024 में हरियाणा राज्य के 32-गोहाना विधान सभा
निर्वाचन क्षेत्र से निर्वाचन लड़ने वाले अभ्यर्थी श्री दिनेश कु मार, गांव एंव डाकखाना आंवली, तहसील गोहाना, जिला
सोनीपत, इस आदेश की तारीख से तीन वर्ष की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य क्षेत्र
की विधानसभा अथवा विधान परिषद का सदस्य चुने जाने अथवा होने के लिए निरहित होंगे।

New Delhi, the 12th May, 2026
O.N. 52.—WHEREAS, the General Election to Legislative Assembly of Haryana, 2024 for 32- Gohana Assembly Constituency was held in pursuance of the Election Commission of India Notification No. 464/ECI/HAR- LA/2024, dated 5th September, 2024; and
WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate at an election shall, within 30 days from the date of election of the returned candidate, lodge with the District Election Officer an account of his/her election expenses which shall be true copy of the account kept by him/her or his/her election agent under Section 77 of the said act; and
WHEREAS, the result of the above-mentioned election for 32- Gohana Assembly Constituency of Haryana, 2024 was declared by the Returning Officer on 8th October, 2024 and hence the last date for lodging the account of Election Expenses was 7th November, 2024; and
WHEREAS, as per the report submitted by DEO, Sonipat report dated 08.11.2024 forwarded by the Chief Electoral Officer, Haryana vide his letter no. 6/Elect-Exp./GELA-HR-2024/Elec-2025/2AE-692 dated 05.02.2025, under sub-rule (1) of Rule 89 of the Conduct of Elections Rules, 1961, Sh. Dinesh Kumar a contesting candidate from 32- Gohana Assembly Constituency of state of Haryana has failed to lodge account of election expenses, as required under law; and
WHEREAS, on the basis of the said report of the District Election Officer, Sonipat a Show-Cause notice No. 76/HR-LA/Exp. Account/2024/CEMS-I, dated 30th April, 2025 was issued under sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India to Sh. Dinesh Kumar for not lodging of his account of Election Expenses; and
WHEREAS, through the above said Show Cause Notice and under sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, Sh. Dinesh Kumar, was directed to submit representation in writing to the Commission explaining the reasons for not lodging the account and also to lodge account of election expenses with the District Election Officer, Sonipat within 20 days from the date of receipt of the notice; and
WHEREAS, the District Election Officer, Sonipat vide his letter no. Elec-2025/564 dated 19.06.2025 has informed that the notice was duly served and received by Sh. Dinesh Kumar' mother (name Smt. Vidya Devi), on 30.05.2025; and
WHEREAS, the District Election Officer, Sonipat in his Supplementary Report, vide its letter no. Elec- 2025/564 dated 19.06.2025 has reported that Sh. Dinesh Kumar has not submitted account of election expenses. Further, after receipt of the said notice, Sh. Dinesh Kumar has neither furnished any reason nor explanation to the Election Commission of India, for failure to lodge the account of his election expenses as prescribed under law; and
WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that:-
"If the Election Commission is satisfied that a person-
(a) has failed to lodge an account of election expenses, within the time and in the manner required by or under
this Act, and
(b) has no good reason or justification for the failure, the Election Commission shall, by order published in the
Official Gazette, declare him to be disqualified and any such person shall be disqualified for a period of three years
from the date of the order.";

Dinesh Kumar has failed to lodge account of his election expenses and has no good reason or justification for the failure to do so; and NOW, THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission of India hereby declares Sh. Dinesh Kumar, Village and Post Office Anwali, Tehsil Gohana, District Sonepat, a contesting candidate for 32-Gohana Assembly Constituency of Haryana in General Election to Legislative Assembly, 2024 to be disqualified for being chosen as and for being a member of either House of the Parliament or the Legislative Assembly or the Legislative Council of a State or Union Territory for a period of three years from the date of this order.

आ.अ. 53.—यतः, भारत निर्वाचन आयोग की अधिसूचना सं. 464/ईपीएस/2024(7) दिनांक 7 मई, 2024 के अनुसरण में पंजाब के लोक सभा निर्वाचन क्षेत्र, 02-अमृतसर के लिए साधारण निर्वाचन ,2024 आयोजित किया गया था;
और
यत:, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 78 के अनुसार, किसी भी निर्वाचन में निर्वाचन लड़ने वाला प्रत्येक अभ्यर्थी, निर्वाचित अभ्यर्थी के निर्वाचन की तारीख से 30 दिनों के भीतर अपने निर्वाचन व्यय के लेखे जिला निर्वाचन अधिकारी के पास दाखिल करेगा जो उक्त अधिनियम की धारा 77 के अन्तर्गत उसके द्वारा या उसके निर्वाचन अभिकर्ता द्वारा रखे गए लेखे की एक सत्य प्रति होगी; और
यतः, पंजाब के 02-अमृतसर संसदीय निर्वाचन क्षेत्र के लिए साधारण निर्वाचन, 2024 का परिणाम, रिटनिग अधिकारी द्वारा दिनांक 04 जून, 2024 को घोषित किया गया था और इस प्रकार निर्वाचन व्यय के लेखे दाखिल करने की अन्तिम तारीख 04 जुलाई, 2024 थी; और
यतः, निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (1) के अंतर्गत, मुख्य निर्वाचन अधिकारी, पंजाब से उनके दिनांक 22.07.2024 के पत्र सं. Elec-2024/R-7458, के तहत प्राप्त जिला निर्वाचन अधिकारी, अमृतसर की दिनांक 05.07.2024 की रिपोर्ट के अनुसार, श्री सिमरनप्रीत सिह, जो पंजाब के 02-अमृतसर संसदीय निर्वाचन क्षेत्र से निर्वाचन लड़ने वाले अभ्यर्थी हैं, विधि के अंतर्गत यथा अपेक्षित निर्वाचन व्यय का लेखा दाखिल करने में असफल रहे हैं; और
यतः, जिला निर्वाचन अधिकारी, अमृतसर की उक्त रिपोर्ट के आधार पर, भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (5) के अंतर्गत श्री सिमरनप्रीत सिह को अपने निर्वाचन व्यय के लेखे प्रस्तुत नहीं करने के लिए कारण बताओ नोटिस सं. 76/PB-LS/2/2024/सीईएमएस-I, दिनांक 12.08.2025 को जारी किया गया था; और
यत:, उपयु र्क्त उक्त कारण बताओ नोटिस के जरिए और निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (6) के अंतर्गत, श्री सिमरनप्रीत सिह को लेखा दाखिल न किए जाने संबंधी कारणों को स्पष्ट करते हुए आयोग को अपना अभ्यावेदन लिखित रूप में प्रस्तुत करने और नोटिस के प्राप्त होने की तारीख से 20 दिनों के भीतर जिला निर्वाचन अधिकारी, अमृतसर जिला को अपने निर्वाचन व्यय के लेखे प्रस्तुत करने का निदेश दिया गया था; और
यत:, जिला निर्वाचन अधिकारी, अमृतसर ने अपने पत्र द्वारा सूचित किया है कि उक्त कारण बताओ नोटिस सुश्री जसनप्रीत कौर (श्री सिमरनप्रीत सिह की पत्नी ) को दिनांक 13.03.2026 को तामील किया गया था; और133 [भाग II—खण्ड 3(iii)] भारत का राजपत्र : मई 23, 2026/ज्येष्ठ 2, 1948 यत:, मुख्य निर्वाचन अधिकारी, पंजाब से उनके दिनांक 12.05.2026 के पत्र सं. Elec-2026/R-4303, के तहत प्राप्त जिला निर्वाचन अधिकारी, अमृतसर की अनुपूरक रिपोर्ट के द्वारा सूचित किया है कि श्री सिमरनप्रीत सिह ने निर्वाचन व्यय के लेखे का कोई विवरण प्रस्तुत नहीं किया है। इसके अतिरिक्त, उक्त नोटिस मिलने के उपरांत, श्री सिमरनप्रीत सिह द्वारा विधि के अंतर्गत यथा-विहित लेखे दाखिल करने में अपनी असफलता के लिए भारत निर्वाचन आयोग को न तो कोई कारण बताया है और न ही कोई स्पष्टीकरण दिया है; और
यत:, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में यह उपबंधित किया गया है कि:-
"यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व् यक्ति-

अत:, अब, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अनुसरण में, भारत निर्वाचन आयोग एतद्द्वारा घोषणा करता है कि पंजाब के 02-अमृतसर संसदीय निर्वाचन क्षेत्र से निर्वाचन लड़ने वाले अभ्यर्थी, श्री सिमरनप्रीत सिह, निवासी- म.नं.-41 गली नं.- 4, कपूर नगर, सुल्तानविड रोड, अमृतसर, पंजाब-143006, इस आदेश की तारीख से तीन वर्ष की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य क्षेत्र की विधान सभा अथवा विधान परिषद का सदस्य चुने जाने अथवा होने के लिए निरहित होंगे ।

O.N. 53.—WHEREAS, the General Election to Lok Sabha of Punjab, 2024, for 2- Amritsar Parliamentary Constituency was held in pursuance of the Election Commission of India Notification No. 464/EPS/2024(7), dated 7th May, 2024; and
WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate at an election shall, within 30 days from the date of election of the returned candidate, lodge with the District Election Officer an account of his/her election expenses which shall be a true copy of the account kept by him/her or his/her election agent under Section 77 of the said act; and
WHEREAS, the result of the election for 2- Amritsar Parliamentary Constituency of Punjab, 2024 was declared by the Returning Officer on 04th June, 2024 and hence the last date for lodging the account of Election Expenses was 4th July, 2024; and
WHEREAS, as per the report dated 05.07.2024 of DEO, Amritsar under sub-rule (1) of Rule 89 of the Conduct of Elections Rules, 1961 received through the CEO, Punjab vide his letter no. Elec-2024/R-7458, dated 22.07.2024 stating that Sh. Simranpreet Singh, a contesting candidate from 2- Amritsar Parliamentary Constituency of State of Punjab has failed to lodge the account of his election expenses, as required under law; and134 THE GAZETTE OF INDIA : MAY 23, 2026/JYAISHTHA 2, 1948 [PART II—SEC. 3(iii)] WHEREAS, on the basis of the said report of the District Election Officer, a 'Show-Cause Notice' No. 76/PB- LS/2/2024/CEMS-I, dated 12th August, 2025 was issued under sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India to Sh. Simranpreet Singh, for not lodging of the account of Election Expenses; and
WHEREAS, through the above said 'Show Cause Notice' and under sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, Sh. Simranpreet Singh was directed to submit representation in writing to the Commission explaining the reasons for not lodging the account and also to lodge the account of his election expenses with the District Election Officer, Amritsar District within 20 days from the date of receipt of the notice; and
WHEREAS, the DEO, Amritsar has reported that the said 'Show Cause Notice' was served to Smt.
Jashanpreet Kaur (W/o Sh. Simranpreet Singh) on 13.03.2026; and
WHEREAS, the District Election Officer, Amritsar in his Supplementary Report, received through the CEO, Punjab vide his letter no. Elec-2026/R-4303, dated 12.05.2026 has reported that Sh. Simranpreet Singh has not submitted any representation or statement of account of election expenses. Further, after receipt of the said notice, Sh. Simranpreet Singh has neither furnished any reason nor explanation to the Election Commission of India for failure to lodge the account of his election expenses as prescribed under law; and
WHEREAS, Section 10A of the Representation of the People Act, 1951 provides that:-
"If the Election Commission is satisfied that a person-
(a) has failed to lodge an account of election expenses within the time and in the manner required by or
under this Act, and
(b) has no good reason or justification for the failure,

यतः, पंजाब के 13-पटियाला संसदीय निर्वाचन क्षेत्र के लिए साधारण निर्वाचन, 2024 का परिणाम, रिटनिग अधिकारी द्वारा दिनांक 04 जून, 2024 को घोषित किया गया था और इस प्रकार निर्वाचन व्यय के लेखे दाखिल करने की अन्तिम तारीख 04 जुलाई, 2024 थी; और135 [भाग II—खण्ड 3(iii)] भारत का राजपत्र : मई 23, 2026/ज्येष्ठ 2, 1948 यतः, निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (1) के अंतर्गत, मुख्य निर्वाचन अधिकारी, पंजाब से उनके दिनांक 22.07.2024 के पत्र सं. Elec-2024/R-7458, के तहत प्राप्त जिला निर्वाचन अधिकारी, पटियाला की दिनांक 05.07.2024 की रिपोर्ट के अनुसार, श्री सुखविदर सिह, जो पंजाब के 13-पटियाला संसदीय निर्वाचन क्षेत्र से निर्वाचन लड़ने वाले अभ्यर्थी हैं, विधि के अंतर्गत यथा अपेक्षित निर्वाचन व्यय का लेखा दाखिल करने में असफल रहे हैं; और
यतः, जिला निर्वाचन अधिकारी, पटियाला की उक्त रिपोर्ट के आधार पर, भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (5) के अंतर्गत श्री सुखविदर सिह को अपने निर्वाचन व्यय के लेखे प्रस्तुत नहीं करने के लिए कारण बताओ नोटिस सं. 76/PB-LS/13/2024/सीईएमएस-I, दिनांक 31.01.2025 को जारी किया गया था; और
यत:, उपयु र्क्त उक्त कारण बताओ नोटिस के जरिए और निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (6) के अंतर्गत, श्री सुखविदर सिह को लेखा दाखिल न किए जाने संबंधी कारणों को स्पष्ट करते हुए आयोग को अपना अभ्यावेदन लिखित रूप में प्रस्तुत करने और नोटिस के प्राप्त होने की तारीख से 20 दिनों के भीतर जिला निर्वाचन अधिकारी, पटियाला जिला को अपने निर्वाचन व्यय के लेखे प्रस्तुत करने का निदेश दिया गया था; और
यत:, जिला निर्वाचन अधिकारी, पटियाला ने अपने पत्र द्वारा सूचित किया है कि उक्त कारण बताओ नोटिस श्री सुखविदर सिह को दिनांक 06.02.2025 को तामील किया गया था; और
यत:, मुख्य निर्वाचन अधिकारी, पंजाब से उनके दिनांक 25.10.2025 के पत्र सं. Elec-2025/R-8097, के तहत प्राप्त जिला निर्वाचन अधिकारी, पटियाला की अनुपूरक रिपोर्ट के द्वारा सूचित किया है कि श्री सुखविदर सिह ने निर्वाचन व्यय के लेखे का कोई विवरण प्रस्तुत नहीं किया है। इसके अतिरिक्त, उक्त नोटिस मिलने के उपरांत, श्री सुखविदर सिह द्वारा विधि के अंतर्गत यथा-विहित लेखे दाखिल करने में अपनी असफलता के लिए भारत निर्वाचन आयोग को न तो कोई कारण बताया है और न ही कोई स्पष्टीकरण दिया है; और
यत:, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में यह उपबंधित किया गया है कि:-
"यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व् यक्ति-
(क) निर्वाचन व्ययों का लेखा उस समय के भीतर और उस रीति में जैसी इस अधिनियम के द्वारा या अधीन अपेक्षित है ,दाखिल करने में असफल रहा है; तथा
(ख) उस असफलता के लिए कोई अच्छा कारण या न्यायोचित्य नहीं रखता है,
तो निर्वाचन आयोग शासकीय राजपत्र में प्रकाशित आदेश द्वारा उसको निरहित घोषित करेगा और ऐसा व् यक्ति उस आदेश की तारीख से तीन वर्ष की कालावधि के लिए निरहित होगा।";
यत:, तथ्यों और उपलब्ध रिकार्डों के आधार पर , आयोग का यह समाधान हो गया है कि श्री सुखविदर सिह अपने निर्वाचन व्यय के लेखे दाखिल करने में असफल रहे हैं और उनके पास ऐसा करने में असफल रहने के लिए कोई भी उचित कारण अथवा औचित्य नहीं है; और
अत:, अब, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अनुसरण में, भारत निर्वाचन आयोग एतद्द्वारा घोषणा करता है कि पंजाब के 13-पटियाला संसदीय निर्वाचन क्षेत्र से निर्वाचन लड़ने वाले अभ्यर्थी, श्री सुखविदर सिह, निवासी- म.नं.-11 गली नं.- 32-बी, आनंद नगर-बी, पटियाला, पंजाब-147001, इस आदेश की तारीख से तीन वर्ष की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य क्षेत्र की विधान सभा अथवा विधान परिषद का सदस्य चुने जाने अथवा होने के लिए निरहित होंगे ।

O.N. 54.—WHEREAS, the General Election to Lok Sabha of Punjab, 2024, for 13- Patiala Parliamentary Constituency was held in pursuance of the Election Commission of India Notification No. 464/EPS/2024(7), dated 7th May, 2024; and
WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate at an election shall, within 30 days from the date of election of the returned candidate, lodge with the District Election Officer an account of his/her election expenses which shall be a true copy of the account kept by him/her or his/her election agent under Section 77 of the said act; and
WHEREAS, the result of the election for 13- Patiala Parliamentary Constituency of Punjab, 2024 was declared by the Returning Officer on 04th June, 2024 and hence the last date for lodging the account of Election Expenses was 4th July, 2024; and
WHEREAS, as per the report dated 05.07.2024 of DEO, Patiala under sub-rule (1) of Rule 89 of the Conduct of Elections Rules, 1961 received through the CEO, Punjab vide his letter no. Elec-2024/R-7458, dated 22.07.2024 stating that Sh. Sukhvinder Singh, a contesting candidate from 13- Patiala Parliamentary Constituency of State of Punjab has failed to lodge the account of his election expenses, as required under law; and
WHEREAS, on the basis of the said report of the District Election Officer, a 'Show-Cause Notice' No. 76/PB- LS/13/2024/CEMS-I, dated 31st January, 2025 was issued under sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India to Sh. Sukhvinder Singh, for not lodging of the account of Election Expenses; and
WHEREAS, through the above said 'Show Cause Notice' and under sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, Sh. Sukhvinder Singh was directed to submit representation in writing to the Commission explaining the reasons for not lodging the account and also to lodge the account of his election expenses with the District Election Officer, Patiala District within 20 days from the date of receipt of the notice; and
WHEREAS, the DEO, Patiala has reported that the said 'Show Cause Notice' was served to Sh. Sukhvinder Singh on 06.02.2025; and
WHEREAS, the District Election Officer, Patiala in his Supplementary Report, received through the CEO, Punjab vide his letter no. Elec-2025/R-8097, dated 25.10.2025 has reported that Sh. Sukhvinder Singh has not submitted any representation or statement of account of election expenses. Further, after receipt of the said notice, Sh. Sukhvinder Singh has neither furnished any reason nor explanation to the Election Commission of India for failure to lodge the account of his election expenses as prescribed under law; and
WHEREAS, Section 10A of the Representation of the People Act, 1951 provides that:-
"If the Election Commission is satisfied that a person-
(a) has failed to lodge an account of election expenses within the time and in the manner required by or
under this Act, and
(b) has no good reason or justification for the failure,
the Election Commission shall, by order published in the Official Gazette, declare him to be disqualified and any such
person shall be disqualified for a period of three years from the date of the order.";
WHEREAS, on basis of the facts and available records, the Commission is satisfied that Sh. Sukhvinder Singh has failed to lodge the account of his election expenses and has no good reason or justification for the failure to do so; and
NOW, THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission of India hereby declares Sh. Sukhvinder Singh, resident of H.No. 11, Street No. 32-B, Anand Nagar-B, Patiala, Punjab, Pin-147001 and a contesting candidate from 13- Patiala Parliamentary Constituency of State of Punjab, to be disqualified for being chosen as and for being a member of either House of the Parliament or the Legislative Assembly or the Legislative Council of a State or Union Territory for a period of three years from the date of this order.

आ. अ. 55.—यतः, भारत निर्वाचन आयोग की अधिसूचना सं. 464/ईपीएस/2024(7) दिनांक 7 मई, 2024 के अनुसरण में पंजाब के लोक सभा निर्वाचन क्षेत्र, 13-पटियाला के लिए साधारण निर्वाचन, 2024 आयोजित किया गया था; और
यत:, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 78 के अनुसार, किसी भी निर्वाचन में निर्वाचन लड़ने वाला प्रत्येक अभ्यर्थी, निर्वाचित अभ्यर्थी के निर्वाचन की तारीख से 30 दिनों के भीतर अपने निर्वाचन व्यय के लेखे जिला निर्वाचन अधिकारी के पास दाखिल करेगा जो उक्त अधिनियम की धारा 77 के अन्तर्गत उसके द्वारा या उसके निर्वाचन अभिकर्ता द्वारा रखे गए लेखे की एक सत्य प्रति होगी; और
