(605)606 भारत का राजपत्र, जून 20, 2026 (ज्येष्ठ 30, 1948) [भाग I—खण्ड 2 3. समिति राज्य सभा सचिवालय में महिलाओं के विरुद्ध लैंगिक उत्पीड़न के विरूद्ध सुरक्षा प्रदान करने, लैंगिक उत्पीड़न संबंधी शिकायतों के निवारण तथा उससे संबंधित या उसके आनुषंगिक विषयों के लिए जिम्मेदार होगी।

4. समिति महिलाओं का कार्यस्थल पर लैंगिक उत्पीड़न (निवारण, प्रतिषेध और प्रतितोष) अधिनियम, 2013 के अनुसार प्रदत्त शक्तियों का प्रयोग करेगी तथा उक्त अधिनियम के अधीन उसे सौंपे गए अथवा राज्य सभा सचिवालय द्वारा समय-समय पर सौंपे गए कर्तव्यों और जिम्मेदारियों का निर्वहन करेगी। उक्त अधिनियम तथा महिलाओं का कार्यस्थल पर लैंगिक उत्पीड़न (निवारण, प्रतिषेध और प्रतितोष) नियम, 2013 के अनुसार समिति द्वारा कतिपय अनुपालन किए जाना भी अपेक्षित है। उक्त अधिनियम तथा नियमों के उपबंधों के अनुरूप आंतरिक समिति का अधिदेश तथा कु छ प्रमुख जिम्मेदारियां इस अधिसूचना के साथ संलग्न हैं।

आंतरिक समिति (आई.सी.) का अधिदेश तथा प्रमुख जिम्मेदारियां

(i) शिकायतें प्राप्त करना: आई.सी. कर्मचारियों से लैंगिक उत्पीड़न संबंधी शिकायतें प्राप्त करने के लिए जिम्मेदार होगी। शिकायत प्राप्त होने पर, समिति व्यथित महिला से प्राप्त शिकायत की प्रतियों में से एक प्रति सात कार्य दिवसों की अवधि के भीतर प्रतिवादी को भेजेगी।

[नियम 7(2)]

(ii) सुलह रिपोर्ट: समझौते की स्थिति में आई.सी. प्रतिवेदन अभिलिखित करेगी तथा उसे नियोक्ता को अग्रेषित करेगी। प्रतिवेदन की प्रतियां दोनों पक्षों को भी उपलब्ध कराई जाएंगी। [धारा 10(2) एवं (3)]

(iii) जांच प्रक्रिया: प्राप्त शिकायतों की निष्पक्ष तथा समयबद्ध जांच करना, जो 90 दिनों की अवधि के भीतर पूर्ण की जाएगी।

(iv) सिफारिशें: उचित कार्रवाई के लिए जांच के निष्कर्ष तथा सिफारिशें (अंतरिम उपायों सहित) नियोक्ता को प्रस्तुत करना।

[धारा 12]

(v) जांच रिपोर्ट प्रस्तुत करना: जांच पूर्ण होने पर आई.सी. अपने निष्कषों का प्रतिवेदन जांच पूर्ण होने की तारीख से दस दिनों की अवधि के भीतर नियोक्ता को प्रस्तुत करेगी। [धारा 13(1)]

(vi) गोपनीयता: सम्पूर्ण प्रक्रिया के दौरान कड़ी गोपनीयता बनाए रखना। [धारा 16 एवं 17]

(vii) र्वार्षक प्रतिवेदन: नियम 14 के अधीन विहित रीति से र्वार्षक रिपोर्ट तैयार करना तथा प्रत्येक कै लेंडर वर्ष में उसे नियोक्ता को प्रस्तुत करना। [धारा 21]

सं. आरएस.6/(2)/2020/23-कार्र्मक—श्री नगेन्र कु मार सिंह, अपर सचिव (सेवानिवृत्त) को राज्य सभा के माननीय उप-सभापति के वैयक्तिक स्टाफ में वेतन मैट्रिक्स के लेवल-14 (पूर्व-संशोधित वेतन बैंड-4 रु. 37400-67000 + ग्रेड वेतन रु. 10000 के संगत) में सचिव के रूप में, उनके वैयक्तिक स्टाफ में वेतन मैट्रिक्स के लेवल-12 में संयुक्त निदेशक (पीएसएसएस) के पद (पूर्व-संशोधित वेतन बैंड-3 रु. 15600-39100 + ग्रेड वेतन रु. 7600 के संगत) का उन्नयन एवं पुनःपदनामित करके तथा उनके वैयक्तिक स्टाफ में वेतन मैट्रिक्स के लेवल-11 में वरिष्ठ निजी सचिव के एक रिक्त सावधिक पद (पूर्व-संशोधित वेतन बैंड-3 रु. 15600-39100 + ग्रेड वेतन रु. 6600 के संगत) को स्थगन में रखकर उससे होने वाली समतुल्य बचत का उपयोग करते हुए, 17 अप्रैल, 2026 के पूर्वाह्न से सह-पदावसान आधार पर तथा अगले आदेशों तक नियुक्त किया गया है। वरिष्ठ निजी सचिव का उपयु र्क्त पद सचिव के रूप में उनकी नियुक्ति की समाप्ति पर पुनः प्रचालन में आ जाएगा।

2. वेतनमान का यह उन्नयन राज्य सभा के माननीय उप-सभापति के वैयक्तिक स्टाफ में सचिव के रूप में श्री नगेन्र कु मार सिंह की नियुक्ति की अवधि तक उनके लिए वैयक्तिक होगा, जिसके उपरांत सचिव का उन्नयन पद उनके वैयक्तिक स्टाफ में वेतन मैट्रिक्स के लेवल-12 में संयुक्त निदेशक (पीएसएसएस) के मूल सावधिक पद (पूर्व-संशोधित वेतन बैंड-3 रु. 15600-39100 + ग्रेड वेतन रु. 7600 के संगत) में पुनर्र्वर्तत हो जाएगा।

2. The tenure of the committee shall be for a period of one year i.e., up to 5th May, 2027, or until further orders, whichever is earlier.

3. The Committee would be responsible for providing protection against sexual harassment of women in the Rajya Sabha Secretariat and redressal of complaints of sexual harassment and for matters connected therewith or incidental thereto.

4. The Committee will exercise the powers conferred in accordance with the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013, and perform the duties and responsibilities as assigned to it under the said Act or as assigned by the Rajya Sabha Secretariat from time to time. In terms of the said Act and Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Rules, 2013, certain compliances are also required to be observed by the Committee. The mandate and some key responsibilities of the Internal Committee, in line with the provisions of the aforesaid Act and Rules, are annexed to this Notification.

ANNEXURE

Mandate and key responsibilities of the Internal Committee (IC)

i. Receiving Complaints: The IC is responsible for receiving complaints of sexual harassment from employees. On receipt of the complaint, the Committee shall send one of the copies received from the aggrieved woman to the respondent within a period of seven working days. [Rule 7(2)]

ii. Conciliation Report: In case of settlement, the IC shall record and forward the report to the employer. Also copies of the report shall be provided to both the parties (Section 10 (2&3).

iii. Inquiry Process: Conducting a fair and timely inquiry into the complaints received, which shall be completed within a period of 90 days. [Section 11(4)].

iv. Recommendations: Submitting findings and recommendations (including interim measures) of the inquiry to the employer for appropriate action. (Section 12).

v. Submission of Inquiry Report: On completion of the inquiry, the IC shall submit a report of its findings to the employer within a period of ten days from the date of completion of the inquiry. [Section 13(1)]

vi. Confidentiality: Maintaining strict confidentiality throughout the process. (Section 16 & 17).

vii. Annual Reports: To prepare Annual Reports in the manner as prescribed under Rule 14 and submit to the employer in each Calendar Year (Section 21).
